  1. al-Mustadrak (al-Hakim) 8113Abu Dawud silent

    «إِنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ»

    ✧ The Messenger of Allah ﷺ said, "If someone drinks alcohol, flog him. If he repeats it, flog him again. If he does it a third time, flog him. If he repeats it for the fourth time, kill him." Al-Dhahabi remained silent about this in his summary.

    ✧ "The Prophet ﷺ said regarding alcohol: 'If they drink it, then flog them. If they drink it again, then flog them. If they drink it again, then flog them. And if they drink it again, then kill them on the fourth occasion.' Al-Dhahabi remained silent about it in his summary."

    سَمِعْتُ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ يُحَدِّثُ عَبْدَ الْمَلِكِ بْنَ مَرْوَانَ فِي الْخَمْرِ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ فِي الْخَمْرِ «إِنْ شَرِبَهَا فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» فَسَمِعْتُ أَبَا عَلِيٍّ الْحَافِظَ يُحَدِّثُنَا بِهَذَا الْحَدِيثِ فَقَالَ فِي آخِرِهِ هَذَا الصَّحَابِيُّ مِنْ أَهْلِ الشَّامِ هُوَ شُرَحْبِيلُ بْنُ أَوْسٍ

    ✧ I heard a man from the Companions of the Prophet ﷺ relating to ʿAbd al-Malik b. Marwān concerning wine that the Messenger of Allah ﷺ said about wine: "If he drinks it, flog him; if he repeats, flog him; then if he repeats, flog him; then if he repeats for the fourth time, kill him." Then I heard Abū ʿAlī al-Ḥāfiẓ narrating this hadith to us and saying at its end: This Companion is from the people of Syria—he is Shuraḥbīl b. Aws.

    وَأَمَّا حَدِيثُ النَّضْرِ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ»

    ✧ As for the hadith of al-Naḍr, one of the Companions of the Messenger of Allah ﷺ, he said: The Messenger of Allah ﷺ said: "Whoever drinks wine, flog him; if he repeats, flog him; if he repeats, flog him; if he repeats the fourth time, kill him."

    عَنِ النَّبِيِّ ﷺ نَحْوَهُ وَقَالَ «فَضَرَبَ رَسُولُ اللَّهِ ﷺ النُّعَيْمَانَ أَرْبَعَ مَرَّاتٍ»

    ✧ From the Prophet ﷺ something similar, and he said: "So the Messenger of Allah ﷺ struck al-Nuʿaymān four times."

    «أَنَّ رَسُولَ اللَّهِ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا» قَالَ ابْنُ عَبَّاسٍ شَرِبَ رَجُلٌ فَسَكِرَ فَثَمِلَ فِي الْفَجِّ فَانْطَلَقْنَا بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا حَاذَى بِدَارِ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ «أَفَعَلَهَا؟» وَلَمْ يَأْمُرْ فِيهِ بِشَيْءٍ

    ✧ That the Messenger of Allah ﷺ did not set a fixed punishment for wine. Ibn ʿAbbās said: A man drank and became drunk, and he staggered in the mountain pass, so we took him to the Prophet ﷺ. When he came alongside the house of al-ʿAbbās, he broke loose and entered upon al-ʿAbbās and clung to him. That was mentioned to the Prophet ﷺ, and he laughed and said: "Did he do that?" And he did not order anything concerning him.

    «جِيءَ بِالنُّعَيْمَانِ أَوْ بِابْنِ النُّعَيْمَانِ شَارِبًا فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبَهُ» قَالَ «وَكُنْتُ أَنَا فِيمَنْ ضَرَبَهُ فَضَرَبْنَاهُ بِالنِّعَالِ وَالْجَرِيدِ»

    ✧ Al-Nuʿaymān—or the son of al-Nuʿaymān—was brought as a drinker, and the Messenger of Allah ﷺ ordered those in the house to beat him. He said: "And I was among those who beat him, and we beat him with sandals and palm stalks."

    «جِيءَ بِالنُّعَيْمَانِ فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ فِي الْبَيْتِ فَضَرَبُوهُ بِالْأَيْدِي وَالنِّعَالِ» وَكُنْتُ فِيمَنْ ضَرَبَهُعلى شرط البخاري ومسلم

    ✧ Al-Nuʿaymān was brought, and the Messenger of Allah ﷺ ordered those in the house, so they beat him with hands and sandals. And I was among those who beat him. This is according to the conditions of al-Bukhārī and Muslim.

    «كَانَ يُؤْتَى بِالشَّارِبِ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ وَفِي إِمْرَةِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمْرَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَنِعَالِنَا وَأَرْدِيَتِنَا حَتَّى كَانَ صَدْرًا مِنْ إِمَارَةِ عُمَرَ فَجَلَدَ فِيهَا أَرْبَعِينَ حَتَّى إِذَا عَاثُوا فِيهَا وَفَسَقُوا جَلْدَ فِيهَا ثَمَانِينَ»

    ✧ "The mustache was presented during the time of the Prophet Muhammad ﷺ, and during the caliphate of Abu Bakr, and part of the caliphate of Umar. We would go to it and strike it with our hands, sandals, and cloaks until it became red from the caliphate of Umar. He would then lash it forty times until it became damaged and split into eighty pieces."

    أُتِيَ النَّبِيُّ ﷺ بِشَارِبٍ فَقَالَ «قُومُوا إِلَيْهِ فَاضْرِبُوهُ» فَقَامُوا إِلَيْهِ فَخَفَقُوهُ بِنِعَالِهِمْ

    ✧ A drunkard was brought to the Prophet ﷺ, and he said, “Rise to him and strike him.” So they rose to him and struck him with their sandals.

  17. al-Mustadrak (al-Hakim) 8129Sahih

    لَا أَشْرَبُ نَبِيذَ الْجَرِّ بَعْدَ إِذْ أُتِيَ النَّبِيُّ ﷺ بِنَشْوَانَ فَقَالَ يَا رَسُولَ اللَّهِ مَا شَرِبْتُ خَمْرًا لَكِنِّي شَرِبْتُ نَبِيذَ زَبَيبِ وَتَمْرٍ فِي دُبَّاءَ «فَأَمَرَ بِهِ فَنُهِزَ بِالْأَيْدِي وَخُفِقَ بِالنِّعَالِ وَنَهَى عَنِ الزَّبِيبِ وَالتَّمْرِ وَعَنِ الدُّبَّاءِ»

    ✧ “I will not drink nabidh from jars after a drunken man was brought to the Prophet ﷺ. He said, ‘O Messenger of Allah, I did not drink wine; rather, I drank nabidh of raisins and dates in a gourd.’ So he ordered him to be struck with hands and beaten with sandals, and he forbade raisins, dates, and gourds.”

    «رَأَيْتُ رَسُولَ اللَّهِ ﷺ يَوْمَ حُنَيْنٍ وَهُوَ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِسَكْرَانَ فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ كَانَ عِنْدَهُ أَنْ يَضْرِبُوهُ بِمَا كَانَ فِي أَيْدِيهِمْ» قَالَ «وَحَثَا رَسُولُ اللَّهِ ﷺ التُّرَابَ فِي وَجْهِهِ» قَالَ «ثُمَّ أُتِيَ أَبُو بَكْرٍ بِسَكْرَانَ» قَالَ «فَتَوَخَّى الَّذِينَ كَانَ مَنْ ضَرْبَهُمْ يَوْمَئِذٍ فَضُرِبَ أَرْبَعِينَ» وَضَرَبَ عُمَرُ أَرْبَعِينَ

    ✧ “I saw the Messenger of Allah ﷺ on the day of Hunayn while he was moving among the people asking about the camp of Khalid b. al-Walid. Then a drunkard was brought, and the Messenger of Allah ﷺ ordered those with him to strike him with whatever was in their hands.” He said, “And the Messenger of Allah ﷺ threw dust in his face.” He said, “Then a drunkard was brought to Abu Bakr.” He said, “He sought out those who had struck him that day, and he was struck forty times.” And Umar struck forty.

  19. al-Mustadrak (al-Hakim) 8131Sahih

    عَلِيٌّ نَرَاهُ إِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ فَقَالَ عُمَرُ أَبْلِغْ صَاحِبَكَ مَا قَالَ فَجَلَدَ خَالِدٌ ثَمَانِينَ وَجَلَدَ عُمَرُ ثَمَانِينَ وَكَانَ عُمَرُ إِذَا أُتِيَ بِالرَّجُلِ الْقَوِيِّ الْمُنْهَمِكِ فِي الشَّرَابِ جَلَدَهُ ثَمَانِينَ وَإِذَا أُتِيَ بِالرَّجُلِ الضَّعِيفِ الَّتِي كَانَتْ مِنْهُ الزَّلَّةُ جَلَدَ أَرْبَعِينَ ثُمَّ جَلَدَ عُثْمَانُ ثَمَانِينَ وَأَرْبَعِينَ

    ✧ Ali, we see him when this (person) gets drunk and when this (person) fabricates lies, and upon the liar is eighty (lashes). Then Umar said, "Inform your companion of what he said." Khalid was then flogged eighty times, and Umar was flogged eighty times. When a strong man heavily indulged in drinking was brought to Umar, he would flog him eighty times. And when a weak man, who was prone to making mistakes, was brought to him, he would flog him forty times. Then Uthman was flogged eighty-four times.

    إِنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعَصَا حَتَّى تُوُفِّيَ رَسُولُ اللَّهِ ﷺ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ أَكْثَرَ مِنْهُمْ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَقَالَ أَبُو بَكْرٍ لَوْ فَرَضْنَا لَهُمْ حَدًّا فَتَوَخَّى نَحْوًا مِمَّا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَكَانَ أَبُو بَكْرٍ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ قَامَ مِنْ بَعْدِهِ عُمَرُ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينَ الْأَوَّلِينَ وَقَدْ كَانَ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لِمَ تَجْلِدُنَي بَيْنِي وَبَيْنَكَ كِتَابُ اللَّهِ ﷻ فَقَالَ عُمَرُ فِي أَيِّ كِتَابِ اللَّهِ تَجِدُ أَنِّي لَا أَجْلِدُكَ؟ فَقَالَ إِنَّ اللَّهَ تَعَالَى يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ فَأَنَا مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقُوا وَآمَنُوا ثُمَّ اتَّقُوا وَأَحْسِنُوا شَهِدْتُ مَعَ رَسُولِ اللَّهِ ﷺ بَدْرًا وَالْحُدَيْبِيَةَ وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَذِهِ الْآيَاتِ أُنْزِلَتْ عُذْرًا لِلْمَاضِينَ وَحَجَّةً عَلَى الْبَاقِينَ لِأَنَّ اللَّهَ ﷻ يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمِلِ الشَّيْطَانِ} [المائدة 90] ثُمَّ قَرَأَ حَتَّى أَنْفَذَ الْآيَةَ الْأُخْرَى {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا} [المائدة 93] فَإِنَّ اللَّهَ ﷻ قَدْ نَهَى أَنْ يُشْرَبَ الْخَمْرُ فَقَالَ عُمَرُ صَدَقْتَ فَمَاذَا تَرَوْنَ فَقَالَ عَلِيٌّ «نَرَى أَنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً» فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ

    ✧ Drinkers used to be beaten in the time of the Messenger of Allah ﷺ with hands, sandals, and staffs until the Messenger of Allah ﷺ passed away. And they were more numerous in the caliphate of Abu Bakr than they had been in the time of the Messenger of Allah ﷺ. Abu Bakr said, “If we appoint a fixed punishment for them,” and he sought an amount similar to what they used to be beaten with in the time of the Messenger of Allah ﷺ. Abu Bakr would flog them forty lashes until he passed away. Then Umar succeeded him and flogged them likewise, forty lashes, until a man from the early Muhajirun was brought, and he had drunk. He ordered that he be flogged, and the man said, “Why do you flog me? Between me and you is the Book of Allah ﷻ.” Umar said, “In which part of the Book of Allah do you find that I should not flog you?” He said, “Allah, Exalted is He, says in His Book: {There is no blame upon those who believe and do righteous deeds for what they have eaten} [al-Ma'idah 93], to the end of the verse. I am among those who believed and did righteous deeds, then feared and believed, then feared and did good. I witnessed Badr, al-Hudaybiyyah, the Trench, and the battles with the Messenger of Allah ﷺ.” Umar said, “Will you not respond to what he says?” Ibn Abbas said, “These verses were revealed as an excuse for those who have passed and as a proof against those who remain, because Allah ﷻ says: {O you who believe, indeed wine, gambling, sacrificing on stone altars, and divining arrows are but defilement from the work of Satan} [al-Ma'idah 90].” Then he recited until he completed the other verse: {There is no blame upon those who believe and do righteous deeds for what they have eaten, if they fear and believe and do righteous deeds, then fear and believe, then fear and do good} [al-Ma'idah 93]. For Allah ﷻ has forbidden drinking wine. Umar said, “You have spoken the truth. So what do you think?” Ali said, “We think that if he drinks, he becomes intoxicated; if he becomes intoxicated, he raves; if he raves, he fabricates lies; and upon the fabricator are eighty lashes.” So Umar ordered that he be flogged eighty lashes.

    أَنَّ امْرَأَةً كَانَتْ بَغِيًّا فِي الْجَاهِلِيَّةِ مَرَّ بِهَا رَجُلٌ فَبَسَطَ يَدَهُ إِلَيْهَا وَلَاعَبَهَا فَقَالَتْ مَهْ إِنَّ اللَّهَ تَعَالَى ذَهَبَ بِالشِّرْكِ وَجَاءَ بِالْإِسْلَامِ فَتَرَكَهَا وَوَلَّى فَجَعَلَ يَلْتَفِتُ يَنْظُرُ إِلَيْهَا حَتَّى أَصَابَ وَجْهَهُ الْحَائِطُ قَالَ فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ «أَنْتَ عَبْدٌ أَرَادَ اللَّهُ بِكَ خَيْرًا إِنَّ اللَّهَ إِذَا أَرَادَ بِعَبْدٍ خَيْرًا عَجَّلَ لَهُ عُقُوبَةَ ذَنْبِهِ وَإِذَا أَرَادَ شَرًّا أَمْسَكَ عَلَيْهِ الْعُقُوبَةَ بِذَنْبِهِ حَتَّى يُوَافِيَ بِهِ يَوْمَ الْقِيَامَةِ

    ✧ A woman was a prostitute in the pre-Islamic era. A man passed by her and extended his hand to her and flirted with her. She said, “Stop! Indeed, Allah, Exalted is He, has removed polytheism and brought Islam.” So he left her and turned away, but he kept looking back at her until his face hit a wall. He came to the Prophet ﷺ and mentioned that to him. He said, “You are a servant for whom Allah intends good. When Allah intends good for a servant, He hastens for him the punishment for his sin; and when He intends evil, He withholds the punishment for his sin until he meets Him on the Day of Resurrection.”

    كُنْتُ بِالْمَدِينَةِ فَمَرَّتْ بِي جَارِيَةٌ فَأَخَذْتُ بِكَشْحِهَا ثُمَّ أَتَيْتُ النَّبِيَّ ﷺ وَهُوَ يُبَايِعُ النَّاسَ فَقَالَ لِي «أَلَسْتَ صَاحِبَ الْجُبَيْذَةِ بِالْأَمْسِ؟» قُلْتُ لَا أَعُودُ يَا رَسُولَ اللَّهِ فَبَايَعَنِي

    ✧ I was in Madinah when a slave girl passed by me, and I grabbed her by her side. Then I came to the Prophet ﷺ while he was taking the pledge of allegiance from the people. He said to me, “Are you not the one who grabbed the girl yesterday?” I said, “I will not do it again, O Messenger of Allah.” So he accepted my pledge.

    أَنَّهُ حَرَسَ لَيْلَةً مَعَ عُمَرَ بْنِ الْخَطَّابِ بِالْمَدِينَةِ فَبَيْنَمَا هُمْ يَمْشُونَ شَبَّ لَهُمْ سِرَاجٌ فِي بَيْتٍ فَانْطَلَقُوا يَؤُمُّونَهُ حَتَّى إِذَا دَنَوْا مِنْهُ إِذَا بَابٌ مُجَافٌ عَلَى قَوْمٍ لَهُمْ فِيهِ أَصْوَاتٌ مُرْتَفِعَةٌ فَقَالَ عُمَرُ وَأَخَذَ بِيَدِ عَبْدِ الرَّحْمَنِ أَتَدْرِي بَيْتُ مَنْ هَذَا؟ قَالَ لَا قَالَ هَذَا بَيْتُ رَبِيعَةَ بْنِ أُمَيَّةَ بْنِ خَلَفٍ وَهُمُ الْآنَ شَرْبٌ فَمَا تَرَى؟ فَقَالَ عَبْدُ الرَّحْمَنِ أَرَى قَدْ أَتَيْنَا مَا نَهَى اللَّهُ عَنْهُ نَهَانَا اللَّهُ ﷻ فَقَالَ {وَلَا تَجَسَّسُوا} [الحجرات 12] فَقَدْ تَجَسَّسْنَا «فَانْصَرَفَ عُمَرُ عَنْهُمْ وَتَرَكَهُمْ»

    ✧ He guarded one night with Umar b. al-Khattab in Madinah. While they were walking, a lamp appeared to them in a house. They went toward it until when they drew near, they found a door closed upon a people who had raised voices inside. Umar, taking Abd al-Rahman by the hand, said, “Do you know whose house this is?” He said, “No.” He said, “This is the house of Rabi'ah b. Umayyah b. Khalaf, and they are now drinking. What do you think?” Abd al-Rahman said, “I think we have done what Allah has forbidden. Allah ﷻ forbade us, for He said: {And do not spy} [al-Hujurat 12], and we have spied.” So Umar turned away from them and left them.

    ✧ "The hand was not severed during the time of the Messenger of Allah ﷺ except in exchange for a slave, and its price at that time was a dinar." I heard Abu Al-Abbas saying, I heard Ar-Rabi' saying, I heard Ash-Shafi'i saying, "This right hand is the son of the woman of Ka'b, and he is not the son of the mother of Ayyman, and he did not meet the Prophet ﷺ."

    ✧ And Ayman was a man of whom good was mentioned. He said: "The hand of the thief is cut off for less than the price of a shield, and the price of a shield then was a dinar." Ayman ibn Umm Ayman, the Companion, brother of Usamah through his mother, is too great and noble to be attributed to obscurity and called "a man of whom good was mentioned." Such wording is only used for an unknown narrator whose reliability is not established, although Jarir stopped it on Ayman and did not trace it back. Al-Dhahabi remained silent about it in the Talkhis.

    أُتِيَ النَّبِيُّ ﷺ بِامْرَأَةٍ قَدْ سَرَقَتْ فَعَاذَتْ بِرَبِيبِ رَسُولِ اللَّهِ ﷺ فَقَالَ النَّبِيُّ ﷺ «لَوْ كَانَتْ فَاطِمَةَ لَقَطَعْتُ يَدَهَا» فَقَطَعَهَا

    ✧ A woman who had stolen was brought to the Prophet ﷺ, and she sought refuge with the stepson of the Messenger of Allah ﷺ. The Prophet ﷺ said: "Even if she were Fatimah, I would cut off her hand." Then he cut it off.

    ✧ The stepson of the Messenger of Allah ﷺ was Salamah ibn Abi Salamah, and the Makhzumi woman who stole sought refuge with one of them. The two Shaykhs agreed on narrating the hadith of al-Zuhri from Urwah from Aisha that the Makhzumi woman sought refuge with Usamah ibn Zayd, and that is the correct version. Al-Dhahabi remained silent about it in the Talkhis.

    لَمَّا سَرَقَتْ تِلْكَ الْمَرْأَةُ الْقَطِيفَةَ مِنْ بَيْتِ رَسُولِ اللَّهِ ﷺ أَعْظَمْنَا ذَلِكَ وَكَانَتِ امْرَأَةً مِنْ قُرَيْشٍ فَجِئْنَا رَسُولَ اللَّهِ ﷺ فَكَلَّمْنَاهُ فَقُلْنَا يَا رَسُولَ اللَّهِ نَحْنُ نَفْدِيهَا بِأَرْبَعِينَ أُوقِيَّةً قَالَ «تَطَّهَّرُ خَيْرٌ لَهَا» فَلَمَّا سَمِعْنَا مِنْ قَوْلِ رَسُولِ اللَّهِ ﷺ أَتَيْنَا أُسَامَةَ بْنَ زَيْدٍ فَقُلْنَا اشْفَعْ لَنَا إِلَى رَسُولِ اللَّهِ ﷺ فِي شَأْنِ هَذِهِ الْمَرْأَةِ نَحْنُ نَفْدِيهَا بِأَرْبَعِينَ أُوقِيَّةً فَلَمَّا رَأَى رَسُولُ اللَّهِ ﷺ جِدَّ النَّاسِ فِي ذَلِكَ قَامَ خَطِيبًا فَقَالَ «يَا أَيُّهَا النَّاسُ مَا إِكْثَارُكُمْ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ وَقَعَ عَلَى أَمَةٍ مِنْ إِمَاءِ اللَّهِ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ لَوْ كَانَتْ فَاطِمَةُ بِنْتُ مُحَمَّدٍ نَزَلَتْ بِالَّذِي بِهِ هَذِهِ الْمَرْأَةُ لَقَطَعَ مُحَمَّدٌ يَدَهَا» قَالَ فَأَيِسَ النَّاسُ وَقَطَعَ رَسُولُ اللَّهِ ﷺ يَدَهَا قَالَ مُحَمَّدُ بْنُ إِسْحَاقَ فَحَدَّثَنِي عَبْدُ اللَّهِ بْنُ أَبِي بَكْرٍ «أَنَّ رَسُولَ اللَّهِ ﷺ بَعْدَ ذَلِكَ كَانَ يَرْحَمُهَا وَيَصِلَهَا»

    ✧ When that woman stole the velvet cloth from the house of the Messenger of Allah ﷺ, we considered it a grave matter. She was a woman from Quraysh, so we came to the Messenger of Allah ﷺ and spoke to him, saying: "O Messenger of Allah, we will ransom her for forty uqiyyah." He said: "That she be purified is better for her." When we heard the words of the Messenger of Allah ﷺ, we went to Usamah ibn Zayd and said: "Intercede for us with the Messenger of Allah ﷺ regarding this woman; we will ransom her for forty uqiyyah." When the Messenger of Allah ﷺ saw the people's insistence on that, he stood up to deliver a sermon and said: "O people, why do you make so much fuss about a punishment from among the punishments of Allah that has befallen a maidservant from among the maidservants of Allah? By Him in whose hand is the soul of Muhammad, if Fatimah bint Muhammad were to commit what this woman has committed, Muhammad would cut off her hand." He said: The people despaired, and the Messenger of Allah ﷺ cut off her hand. Muhammad ibn Ishaq said: Abdullah ibn Abi Bakr told me that after that, the Messenger of Allah ﷺ showed her mercy and maintained ties with her.

    أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ أَتَى النَّبِيَّ ﷺ بِرَجُلٍ قَدْ سَرَقَ حُلَّةً لَهُ ثُمَّ قَالَ يَا رَسُولَ اللَّهِ هَبْهُ لِي فَقَالَ رَسُولُ اللَّهِ ﷺ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنَا بِهِ»

    ✧ Safwan ibn Umayyah brought a man who had stolen a hullah of his to the Prophet ﷺ, then said: "O Messenger of Allah, give him to me." The Messenger of Allah ﷺ said: "Why not before you brought him to us?"

    كُنْتُ نَائِمًا فِي الْمَسْجِدِ وَعَلَيَّ خَمِيصَةٌ لِي ثَمَنُ ثَلَاثِينَ دِرْهَمًا فَجَاءَ رَجُلٌ فَاخْتَلَسَهَا مِنِّي فَأُخِذَ الرَّجُلُ فَجِيءَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِهِ أَنْ يُقْطَعَ فَأَتَيْتُهُ فَقُلْتُ أَتَقْطَعُهُ مِنْ أَجْلِ ثَلَاثِينَ دِرْهَمًا؟ أَنَا أَبِيعُهُ وَأَنْسِيهِ ثَمَنَهَا قَالَ «فَهَلَّا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ» سكت عنه الذهبي في التلخيص

    ✧ I was sleeping in the mosque, wearing a khamisah of mine worth thirty dirhams. A man came and snatched it from me. The man was seized and brought to the Prophet ﷺ, and he ordered that his hand be cut off. I went to him and said: "Will you cut off his hand for thirty dirhams? I will sell it to him and let him pay its price later." He said: "Why did you not do this before you brought him to me?" Al-Dhahabi remained silent about it in the Talkhis.

    أَنَّ رَسُولَ اللَّهِ ﷺ أُتِيَ بِسَارِقٍ قَدْ سَرَقَ شَمْلَةً فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ هَذَا سَرَقَ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا إِخَالُهُ سَرَقَ» فَقَالَ السَّارِقُ بَلَى يَا رَسُولَ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «اذْهَبُوا بِهِ فَاقْطَعُوهُ ثُمَّ احْسِمُوهُ ثُمَّ ايْتُونِي بِهِ» فَقُطِعَ ثُمَّ أُتِيَ بِهِ فَقَالَ «تُبْ إِلَى اللَّهِ» فَقَالَ تُبْتُ إِلَى اللَّهِ فَقَالَ «تَابَ اللَّهُ عَلَيْكَ»

    ✧ A thief who had stolen a shamlah was brought to the Messenger of Allah ﷺ. They said: "O Messenger of Allah, this man has stolen." The Messenger of Allah ﷺ said: "I do not think he has stolen." The thief said: "Yes, O Messenger of Allah." The Messenger of Allah ﷺ said: "Take him and cut off his hand, then cauterize it, then bring him to me." His hand was cut off, then he was brought to him. He said: "Repent to Allah." He said: "I repent to Allah." He said: "May Allah accept your repentance."

    أَنَّ رَجُلًا مِنْ مُزَيْنَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ؟ قَالَ «هِيَ مِثْلُهَا وَالنَّكَالُ لَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلَّا مَا آوَاهُ الْمَرَاحُ فَبَلَغَ فِي الْمِجَنِّ فَفِيهِ الْقَطْعُ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتٌ نَكَالٌ»

    ✧ A man from Muzaynah came to the Prophet ﷺ and said: "O Messenger of Allah, what do you think about the harisah of the mountain?" He said: "It is like it, and there is no punishment of amputation for any livestock except what the pen has sheltered and it reaches the value of a shield, then there is amputation. If it does not reach the price of a shield, then there is a fine of twice its value and lashes as a punishment."

    «لَا يُجْلَدُ فَوْقَ عَشْرَةِ أَسْوَاطٍ فِيمَا دُونَ حَدٍّ مِنْ حُدُودِ اللَّهِ ﷻ»

    ✧ I heard the Messenger of Allah ﷺ say, "No more than ten lashes should be given for a punishment below the limit set by Allah Almighty."

    أَنَّ رَجُلًا سَرَقَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَقَالَ «اقْتُلُوهُ» فَقَالُوا إِنَّمَا سَرَقَ قَالَ «فَاقْطَعُوهُ» ثُمَّ سَرَقَ أَيْضًا فَقُطِعَ ثُمَّ سَرَقَ عَلَى عَهْدِ أَبِي بَكْرٍ فَقُطِعَ ثُمَّ سَرَقَ فَقُطِعَ حَتَّى قُطِعَتْ قَوَائِمُهُ ثُمَّ سَرَقَ الْخَامِسَةَ فَقَالَ أَبُو بَكْرٍ كَانَ رَسُولُ اللَّهِ ﷺ أَعْلَمَ بِهَذَا حِينَ أَمَرَ بِقَتْلِهِ اذْهَبُوا بِهِ فَاقْتُلُوهُ فَدُفِعَ إِلَى فِتْيَةٍ مِنْ قُرَيْشٍ فِيهِمْ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ فَقَالَ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ أَمِّرُونِي عَلَيْكُمْ فَأَمَّرُوهُ فَكَانَ إِذَا ضَرَبَهُ ضَرَبُوهُ حَتَّى قَتَلُوهُ

    ✧ A man stole during the time of the Messenger of Allah ﷺ and was brought to the Prophet ﷺ. He said: "Kill him." They said: "He only stole." He said: "Cut off his hand." Then he stole again, and his hand was cut off. Then he stole during the time of Abu Bakr, and his hand was cut off. Then he stole again, and his hand was cut off, until all his limbs were cut off. Then he stole a fifth time. Abu Bakr said: "The Messenger of Allah ﷺ knew better about this when he ordered his execution. Take him and kill him." He was handed over to a group of young men from Quraysh, among them Abdullah ibn al-Zubayr. Abdullah ibn al-Zubayr said: "Put me in charge over you." They put him in charge, and whenever he struck him, they struck him until they killed him.

    ✧ I do not recall the first man whose hand the Messenger of Allah ﷺ cut off. A thief was brought and he ordered his hand to be cut off, and it was as if grief appeared on the face of the Messenger of Allah ﷺ. They said, “O Messenger of Allah, it seems you disliked cutting him.” He said, “And what prevents me? Do not be helpers of Satan against your brother. It is not fitting for the ruler, when a prescribed punishment reaches him, except to carry it out. Allah is Pardoning and loves pardon, so let them pardon and overlook. Do you not love that Allah should forgive you? And Allah is Forgiving, Merciful.”

    أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ بَعْدَ أَنْ رَجَمَ الْأَسْلَمِيَّ فَقَالَ «اجْتَنِبُوا هَذِهِ الْقَاذُورَةَ الَّتِي نَهَى اللَّهُ عَنْهَا فَمَنْ أَلَمَّ فَلْيَسْتَتِرْ بِسِتْرِ اللَّهِ وَلْيَتُبْ إِلَى اللَّهِ فَإِنَّهُ مَنْ يَبْدُ لَنَا صَفْحَتُهُ نُقِمْ عَلَيْهِ كِتَابَ اللَّهِ تَعَالَى ﷻ» على شرط البخاري ومسلم

    ✧ That the Messenger of Allah ﷺ said, after he had stoned the Aslami: “Avoid this filth that Allah has forbidden. Whoever falls into it, let him conceal himself with the concealment of Allah and repent to Allah, for whoever exposes his page to us, we shall enforce upon him the Book of Allah, Exalted and Majestic.” According to the conditions of al-Bukhari and Muslim.

    «مَنْ سَتَرَ أَخَاهُ فِي الدُّنْيَا سَتَرَهُ اللَّهُ فِي الدُّنْيَا وَالْآخِرَةِ وَمَنْ نَفَّسَ عَنْ أَخِيهِ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا نَفَّسَ اللَّهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَاللَّهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ»

    ✧ “Whoever conceals his brother in this world, Allah will conceal him in this world and the Hereafter. Whoever relieves his brother of a distress of the distresses of this world, Allah will relieve him of a distress of the distresses of the Day of Resurrection. Allah aids the servant as long as the servant aids his brother.”

    ✧ “No servant conceals another servant in this world except that Allah will conceal him on the Day of Resurrection.”

    ثَلَاثٌ أَحْلِفُ عَلَيْهِنَّ وَالرَّابِعُ لَوْ حَلَفْتُ عَلَيْهِ لَرَجَوْتُ أَنْ لَا آثَمَ لَا يَجْعَلُ اللَّهُ عَبْدًا لَهُ سَهْمٌ فِي الْإِسْلَامِ كَمَنْ لَا سَهْمَ لَهُ وَلَا يَتَوَلَّى اللَّهَ عَبْدٌ فِي الدُّنْيَا فَيُوَلِّيَهُ غَيْرَهُ يَوْمَ الْقِيَامَةِ وَلَا يُحِبُّ رَجُلٌ قَوْمًا إِلَّا كَانَ مَعَهُمْ أَوْ مِنْهُمْ وَالرَّابِعَةُ لَوْ حَلَفْتُ عَلَيْهَا لَرَجَوْتُ أَنْ لَا آثَمَ لَا يَسْتُرُ اللَّهُ عَلَى عَبْدٍ فِي الدُّنْيَا إِلَّا سَتَرَ اللَّهُ عَلَيْهِ فِي الْآخِرَةِ

    ✧ Three things I swear by them, and a fourth if I were to swear by it I would hope not to sin: Allah will not make a servant who has a share in Islam like one who has no share; no servant takes Allah as his protector in this world and then Allah entrusts him to other than Him on the Day of Resurrection; and no man loves a people except that he will be with them or among them. And the fourth, if I were to swear by it I would hope not to sin: Allah does not conceal a servant in this world except that Allah will conceal him in the Hereafter.

    ✧ “Whoever sees a private part and conceals it, it is as if he revived a buried female infant from her grave.”

    ✧ “Ward off the prescribed punishments from the Muslims as much as you can. If you find a way out for a Muslim, then let him go, for it is better for the ruler to err in pardon than to err in punishment.”

قَالَ أُصْلِتُ وَاللَّهِ بِالسَّيْفِ ثُمَّ قَالَ أَيْ بَنِي الْأُبَيْرِقِ وَأَنَا أَسْرِقُ فَوَاللَّهِ لَيُخَالِطَنَّكُمْ هَذَا السَّيْفُ أَوْ لَتُبَيِّنُنَّ مَنْ صَاحِبُ هَذِهِ السَّرِقَةِ فَقَالُوا انْصَرِفْ عَنَّا فَوَاللَّهِ إِنَّكَ لَبَرِئٌ مِنْ هَذِهِ السَّرِقَةِ فَقَالَ كَلَّا وَقَدْ زَعَمْتُمْ ثُمَّ سَأَلْنَا فِي الدَّارِ وَتَجَسَّسْنَا حَتَّى قِيلَ لَنَا وَاللَّهِ لَقَدِ اسْتَوْقَدَ بَنُو أُبَيْرِقٍ اللَّيْلَةَ وَمَا نَرَاهُ إِلَّا عَلَى طَعَامِكُمْ فَمَا زِلْنَا حَتَّى كِدْنَا نَسْتَيْقِنُ أَنَّهُمْ أَصْحَابُهُ فَجِئْتُ رَسُولَ اللَّهِ ﷺ فَكَلَّمَتْهُ فِيهِمْ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ أَهْلَ بَيْتٍ مِنَّا أَهْلَ جَفَاءٍ وَسَفَهٍ غَدَوْا عَلَى عَمِّي فَخَرَقُوا عُلِّيَّةً لَهُ مِنْ ظَهْرِهَا فَغَدَوْا عَلَى طَعَامٍ وَسِلَاحٍ فَأَمَّا الطَّعَامُ فَلَا حَاجَةَ لَنَا فِيهِ وَأَمَّا السِّلَاحُ فَلْيَرُدَّهُ عَلَيْنَا فَقَالَ رَسُولُ اللَّهِ ﷺ «سَأَنْظُرُ فِي ذَلِكَ» وَكَانَ لَهُمُ ابْنُ عَمٍّ يُقَالُ لَهُ أَسِيرُ بْنُ عُرْوَةَ فَجَمَعَ رِجَالَ قَوْمِهِ ثُمَّ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ رِفَاعَةَ بْنَ زَيْدٍ وَابْنَ أَخِيهِ قَتَادَةَ بْنَ النُّعْمَانِ قَدْ عَمَدَا إِلَى أَهْلِ بَيْتٍ مِنَّا أَهْلَ حَسَبِ وَشَرَفٍ وَصَلَاحٍ يَأْبِنُونَهُمْ بِالْقَبِيحِ وَيَأْبِنُونَهُمْ بِالسَّرِقَةِ بِغَيْرِ بَيِّنَةٍ وَلَا شَهَادَةٍ فَوَضَعَ عِنْدَ رَسُولِ اللَّهِ ﷺ بِلِسَانِهِ مَا شَاءَ ثُمَّ انْصَرَفَ وَجِئْتُ رَسُولَ اللَّهِ ﷺ وَكَلَّمْتُهُ فَجَبَهَنِي جَبْهًا شَدِيدًا وَقَالَ «بِئْسَ مَا صَنَعْتَ وَبِئْسَ مَا مَشَيْتَ فِيهِ عَمَدْتَ إِلَى أَهْلِ بَيْتٍ مِنْكُمْ أَهْلِ حَسَبٍ وَصَلَاحٍ تَرْمِيهِمْ بِالسَّرِقَةِ وَتَأْبِنُهُمْ فِيهَا بِغَيْرِ بَيِّنَةٍ وَلَا تَثَبُّتٍ» فَسَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ مَا أَكْرَهُ فَانْصَرَفْتُ عَنْهُ وَلَوَدِدْتُ أَنِّي خَرَجْتُ مِنْ مَالِي وَلَمْ أُكَلِّمْهُ فَلَمَّا أَنْ رَجَعْتُ إِلَى الدَّارِ أَرْسَلَ إِلَيَّ عَمِّي يَا ابْنَ أَخِي مَا صَنَعْتَ؟ فَقُلْتُ وَاللَّهِ لَوَدِدْتُ أَنِّي خَرَجْتُ مِنْ مَالِي وَلَمْ أُكَلِّمْ رَسُولَ اللَّهِ ﷺ فِيهِ وَايْمُ اللَّهِ لَا أَعُودُ إِلَيْهِ أَبَدًا فَقَالَ اللَّهُ الْمُسْتَعَانُ فَنَزَلَ الْقُرْآنُ {إِنَّا أَنْزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ لِتَحْكُمَ بَيْنَ النَّاسِ بِمَا أَرَاكَ اللَّهُ وَلَا تَكُنْ لِلْخَائِنِينَ خَصِيمًا} [النساء 105] أَيْ طُعْمَةَ بْنِ أُبَيْرِقٍ فَقَرَأَ حَتَّى بَلَغَ {ثُمَّ يَرِمْ بِهِ بَرِيئًا} [النساء 112] أَيْ لَبِيدَ بْنَ سَهْلٍ {وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكَ وَرَحْمَتُهُ لَهَمَّتْ طَائِفَةٌ مِنْهُمْ أَنْ يُضِلُّوكَ} [النساء 113] يَعْنِي أَسِيرَ بْنَ عُرْوَةَ وَأَصْحَابَهُ ثُمَّ قَالَ {لَا خَيْرَ فِي كَثِيرٍ مِنْ نَجْوَاهُمْ} [النساء 114] إِلَى قَوْلِهِ {وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ} [النساء 48] أَيًّا كَانَ ذَنْبُهُ دُونَ الشِّرْكِ فَلَمَّا نَزَلَ الْقُرْآنُ هَرَبَ فَلَحِقَ بِمَكَّةَ وَبَعَثَ رَسُولُ اللَّهِ ﷺ إِلَيَّ الدَّرْعَيْنِ وَأَدَاتَهُمَا فَرَدَّهُمَا عَلَى رِفَاعَةَ قَالَ قَتَادَةُ فَلَمَّا جِئْتُهُ بِهِمَا وَمَا مَعَهُمَا قَالَ يَا ابْنَ أَخِي هُمَا فِي سَبِيلِ اللَّهِ ﷻ فَرَجَوْتُ أَنَّ عَمِّي حَسُنَ إِسْلَامُهُ وَكَانَ ظَنِّي بِهِ غَيْرَ ذَلِكَ وَخَرَجَ ابْنُ أُبَيْرِقٍ حَتَّى نَزَلَ عَلَى سَلَّامَةَ بِنْتِ سَعْدِ بْنِ سَهْلٍ أُخْتِ بَنِي عَمْرِو بْنِ عَوْفٍ وَكَانَتْ عِنْدَ طَلْحَةَ بْنِ أَبِي طَلْحَةَ بِمَكَّةَ فَوَقَعَ بِرَسُولِ اللَّهِ ﷺ وَأَصْحَابِهِ يَشْتُمُهُمْ فَرَمَاهُ حَسَّانُ بْنُ ثَابِتٍ بِأَبْيَاتٍ فَقَالَ [البحر الطويل] أَيَا سَارِقَ الدَّرْعَيْنِ إِنْ كُنْتَ ذَاكِرًا بِذِي كَرَمٍ بَيْنَ الرِّجَالِ أُوَادِعُهْ وَقَدْ أَنْزَلْتَهُ بِنْتُ سَعْدٍ فَأَصْبَحَتْ يُنَازِعُهَا جَلْدَ اسْتِهِ وَتُنَازِعُهْ فَهَلَّا أَسِيرًا جِئْتَ جَارَكَ رَاغِبًا إِلَيْهِ وَلَمْ تَعْمَدْ لَهُ فَتُدَافِعُهْ ظَنَنْتُمْ بِأَنْ يَخْفَى الَّذِي قَدْ فَعَلْتُمُ وَفِيكُمْ نَبِيٌّ عِنْدَهُ الْوَحْيُ وَاضِعُهْ فَلَوْلَا رِجَالٌ مِنْكُمُ تَشْتُمُونَهُمْ بِذَاكَ لَقَدْ حَلَّتْ عَلَيْهِ طَوَالِعُهْ فَإِنْ تَذْكُرُوا كَعْبًا إِلَى مَا نَسَبْتُمُ فَهَلْ مِنْ أَدِيمٍ لَيْسَ فِيهِ أَكَارِعُهْ وَجَدْتَهُمُ يَرْجُونَكُمْ قَدْ عَلِمْتُمُ كَمَا الْغَيْثُ يُرْجِيهِ السَّمِينُ وَتَابِعُهْ فَلَمَّا بَلَغَهَا شِعْرُ حَسَّانَ أَخَذَتْ رَحْلَ أُبَيْرِقٍ فَوَضَعَتْهُ عَلَى رَأْسِهَا حَتَّى قَذَفَتْهُ بِالْأَبْطَحِ ثُمَّ حَلَقَتْ وَسَلَقَتْ وَخَرَقَتْ وَخَلَفَتْ إِنْ بِتَّ فِي بَيْتِي لَيْلَةً سَوْدَاءَ أَهْدَيْتَ لِي شِعْرَ حَسَّانَ بْنِ ثَابِتٍ مَا كُنْتَ لِتَنْزِلَ عَلَيَّ بِخَيْرٍ فَلَمَّا أَخْرَجَتْهُ لَحِقَ بِالطَّائِفِ فَدَخَلَ بَيْتًا لَيْسَ فِيهِ أَحَدٌ فَوَقَعَ عَلَيْهِ فَقَتَلَهُ فَجَعَلَتْ قُرَيْشٌ تَقُولُ وَاللَّهِ لَا يُفَارِقُ مُحَمَّدًا أَحَدٌ مِنْ أَصْحَابِهِ فِيهِ خَيْرٌ

    ✧ The Banu Ubayriq were a clan from the Banu Zufar, and they were three: Bashir, Bishr, and Mubashshir. Bashir was called Abu Tu'mah; he was a poet and a hypocrite. He would compose poetry satirizing the companions of the Messenger of Allah ﷺ, then say, “So-and-so said it.” When it reached them, they would say, “The enemy of Allah lied; none said it but he.” He said [in kamil meter]: “Is it whenever men utter a poem, they attribute it to me, saying Ubayriq said it, strutting as if I fear them—may Allah cut off their noses and sever them.” They were a people of poverty and need in the Jahiliyyah and Islam. My paternal uncle Rifa'ah b. Zayd was a wealthy man who had embraced Islam. By Allah, I used to think there was something lacking in his Islam. When he had plenty and a caravan of these Nabataeans arrived from al-Sadam carrying fine flour, he would buy for himself what suited him, while for the family he would provide barley. A caravan arrived—they were Nabataeans—carrying fine flour, and Rifa'ah bought two loads of barley and put them in an upper room of his, where there were also two of his coats of mail and the tools to repair them. Bashir came to him at night, tore open the upper room from its back, took the food, then took the weapons. When morning came, my uncle sent for me, and I came to him. He said, “We were raided last night; our food and weapons were taken.” Bashir and his brothers said, “By Allah, the only one who took your goods is Labid b. Sahl,” a man of ours of good lineage and righteousness. When that reached him, he said, “By Allah, I drew the sword.” Then he said, “O Banu al-Ubayriq, am I to steal? By Allah, either this sword will be mixed with you or you will make clear who the thief of this theft is.” They said, “Leave us; by Allah, you are innocent of this theft.” He said, “Not at all, while you have claimed it.” Then we asked around the neighborhood and spied until it was said to us, “By Allah, the Banu Ubayriq lit a fire last night, and we think it was only for your food.” We kept at it until we nearly became certain that they were its perpetrators. So I went to the Messenger of Allah ﷺ and spoke to him about them. I said, “O Messenger of Allah, a household among us of rudeness and folly raided my uncle, tore open an upper room of his from its back, and took food and weapons. As for the food, we have no need of it; as for the weapons, let him return them to us.” The Messenger of Allah ﷺ said, “I will look into that.” They had a paternal cousin called Usayr b. 'Urwah, who gathered men of his people, then came to the Messenger of Allah ﷺ and said, “Rifa'ah b. Zayd and his nephew Qatadah b. al-Nu'man have gone to a household among us of good lineage, honor, and righteousness, accusing them of indecency and theft without evidence or testimony.” He said before the Messenger of Allah ﷺ whatever he wished, then left. I came to the Messenger of Allah ﷺ and spoke to him, and he rebuked me severely, saying, “What an evil thing you have done and what an evil path you have walked in! You went to a household among you of good lineage and righteousness, accusing them of theft without evidence or verification.” I heard from the Messenger of Allah ﷺ what I disliked, so I left, and I wished I had gone out from my wealth and not spoken to him. When I returned home, my uncle sent to me: “O nephew, what did you do?” I said, “By Allah, I wish I had gone out from my wealth and not spoken to the Messenger of Allah ﷺ about it. By Allah, I will never return to it.” He said, “Allah is the one whose help is sought.” Then the Qur'an was revealed: {Indeed, We have sent down to you the Book in truth so that you may judge between people by what Allah has shown you, and do not be an advocate for the treacherous} [al-Nisa' 105]—meaning Tu'mah b. Ubayriq. He recited until he reached {then he casts it upon an innocent person} [al-Nisa' 112]—meaning Labid b. Sahl—{And were it not for the favor of Allah upon you and His mercy, a party of them would have resolved to mislead you} [al-Nisa' 113]—meaning Usayr b. 'Urwah and his companions. Then he said, {No good is there in much of their private conversation} [al-Nisa' 114] up to His saying {and He forgives what is less than that for whom He wills} [al-Nisa' 48]—whatever his sin short of idolatry. When the Qur'an was revealed, he fled and joined Makkah. The Messenger of Allah ﷺ sent me the two coats of mail and their tools, and I returned them to Rifa'ah. Qatadah said: When I brought them to him with what was with them, he said, “O nephew, they are in the cause of Allah, Exalted and Majestic.” I hoped that my uncle's Islam had become good, and my opinion of him had been otherwise. Ibn Ubayriq went out until he stayed with Salamah bt. Sa'd b. Sahl, sister of the Banu 'Amr b. 'Awf, and she was married to Talhah b. Abi Talhah in Makkah. He fell upon the Messenger of Allah ﷺ and his companions, reviling them, and Hassan b. Thabit hit back at him with some verses, saying [in tawil meter]: “O stealer of the two coats of mail, if you remember one of noble standing among men, I befriend him. The daughter of Sa'd lodged you, and she began to dispute with the skin of his backside and he with her. Why did you not come to Usayr, your neighbor, seeking his favor, and not intend harm to him so that you might fend him off? You thought that what you did would remain hidden, while among you is a Prophet with revelation placed before him. Were it not for men among you whom you revile, for that its rising stars would have descended upon him. If you recall Ka'b, to what do you attribute? Is there any hide without its shanks? You found them hoping in you—you knew—as the fat one and his follower hope for rain.” When Hassan's poetry reached her, she took Ubayriq's saddle and placed it on her head until she threw it into al-Abtah, then she shaved, wailed, tore, and swore: “If you spend even one black night in my house, you would bring me Hassan b. Thabit's poetry; you would never have brought me any good.” When she expelled him, he joined al-Ta'if and entered a house with no one in it, and it fell upon him and killed him. Quraysh began to say, “By Allah, no one of Muhammad's companions leaves him while there is good in him.”

    «مَنْ أَذْنَبَ ذَنْبًا فِي الدُّنْيَا فَسَتَرَهُ اللَّهُ عَلَيْهِ وَعَفَا عَنْهُ فَاللَّهُ أَكْرَمُ مِنْ أَنْ يَرْجِعَ فِي شَيْءٍ قَدْ عَفَا عَنْهُ وَسَتَرَهُ وَمَنْ أَذْنَبَ ذَنْبًا فِي الدُّنْيَا فَعُوقِبَ عَلَيْهِ فَاللَّهُ أَعْدَلُ مِنْ أَنْ يُثَنِّيَ عُقُوبَتَهُ عَلَى عَبْدٍ مَرَّتَيْنِ»

    ✧ “Whoever commits a sin in this world and Allah conceals it for him and pardons him, Allah is too generous to return to something He has already pardoned and concealed. Whoever commits a sin in this world and is punished for it, Allah is too just to double his punishment upon a servant twice.”

    ✧ The Prophet of Allah ﷺ informed me: {Whatever misfortune befalls you} [al-Shura 30] is because of what your hands have earned, and He pardons much. “Allah is too generous to double the punishment upon them, and whatever Allah has pardoned in this world, Allah is too generous to return in His pardon.” Al-Dhahabi remained silent about it in the Talkhis.

    أُتِيَ عُمَرُ بِمُبْتَلَاةٍ قَدْ فَجَرَتْ فَأَمَرَ بِرَجْمِهَا فَمَرَّ بِهَا عَلِيُّ بْنُ أَبِي طَالِبٍ وَمَعَهَا الصِّبْيَانُ يَتْبَعُونَهَا فَقَالَ «مَا هَذِهِ؟» قَالُوا أَمَرَ بِهَا عُمَرُ أَنْ تُرْجَمَ قَالَ فَرَدَّهَا وَذَهَبَ مَعَهَا إِلَى عُمَرَ وَقَالَ «أَلَمْ تَعْلَمْ أَنَّ الْقَلَمَ رُفِعَ عَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَعَنِ الْمُبْتَلَى حَتَّى يُفِيقَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ»

    ✧ A woman afflicted [with insanity] who had committed fornication was brought to Umar, and he ordered her to be stoned. Ali b. Abi Talib passed by her while children were following her, so he said, "What is this?" They said, "Umar has ordered her to be stoned." He said, "So he sent her back and went with her to Umar and said, 'Do you not know that the pen has been lifted from the insane until he regains his reason, from the afflicted until he recovers, from the sleeper until he wakes, and from the child until he reaches puberty?'"

    ✧ A pregnant insane woman was brought to Umar, and he intended to stone her. Ali said to him, "Do you not know that the pen has been lifted from three: from the insane until he regains his reason, from the child until he reaches puberty, and from the sleeper until he wakes?" So he let her go.

    وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللَّهِ ﷺ كِتَابَانِ «إِنَّ أَشَدَّ النَّاسِ عُتُوًّا رَجُلٌ ضَرَبَ غَيْرَ ضَارِبِهِ وَرَجُلٌ قَتَلَ غَيْرَ قَاتِلِهِ وَرَجُلٌ تَوَلَّى غَيْرَ أَهْلِ نِعْمَتِهِ فَمَنْ فَعَلَ ذَلِكَ فَقَدْ كَفَرَ بِاللَّهِ وَرَسُولِهِ وَلَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ»

    ✧ In the list of the Prophet Muhammad's possessions, two books were found containing the following statement: "Indeed, the most oppressive of people is a man who attacks someone who does not attack him, a man who kills someone who does not kill him, and a man who withholds his blessings from those who deserve them. Whoever does these things has disbelieved in Allah and His Messenger, and his repentance will not be accepted."

    ✧ Among the most insolent people toward Allah, Exalted is He, is one who kills someone other than his killer, or seeks a blood claim from the people of Islam based on a pre-Islamic era blood feud, or one who makes his eyes see in sleep what they did not see.

    ✧ When Iblis wakes up in the morning, he dispatches his troops and says: 'Whoever leads a Muslim astray today, I will place the crown on him.' One of them comes and says: 'I kept at him until he was undutiful to his father.' He says: 'He may soon be dutiful to him.' Another comes and says: 'I kept at him until he divorced his wife.' He says: 'He may soon remarry.' Another comes and says: 'I kept at him until he committed shirk.' He says: 'You are the one, you are the one.' Another comes and says: 'I kept at him until he killed.' He says: 'You are the one, you are the one,' and he places the crown on him.

    ✧ That the Messenger of Allah ﷺ said: 'The blood of a Muslim person is not lawful except for one of three: adultery after chastity, apostasy after Islam, or killing a person unjustly, for which he is killed.' 'By Allah, I did not commit adultery in pre-Islamic times or in Islam, nor did I apostatize since I pledged allegiance to the Messenger of Allah ﷺ, nor did I kill a person whom Allah has forbidden to kill. So for what will you kill me?'

    ✧ Indeed it is only four; I am not today more elderly than the day I heard them from the Messenger of Allah ﷺ. I heard the Messenger of Allah ﷺ say during the Farewell Pilgrimage: "Do not associate anything with Allah, do not kill the soul which Allah has forbidden except by right, do not steal, and do not commit adultery."

    ✧ A slain man was killed during the time of the Prophet ﷺ in Madinah. He ascended the pulpit as a preacher and said, "Do you not know who killed this slain man among you?" three times. They said, "By Allah, we know of no killer for him." He ﷺ said, "By the One in whose hand is my soul, if the inhabitants of the heavens and the inhabitants of the earth joined together to kill a believer and were pleased with it, Allah would admit them all into Hell. By the One in whose hand is my soul, no one hates us, the people of the House, except that Allah will cast him face down into the Fire." A weak report.

    ✧ Ammar entered upon Aisha on the Day of the Camel and said, "Peace be upon you, O my mother." She replied, "I am not your mother." He said, "Indeed you are my mother, even if you dislike it." She asked, "Who is that whose voice I hear with you?" He said, "Al-Ashtar." She said, "O Ashtar, are you the one who wanted to kill my nephew?" He replied, "I was eager to kill him and he was eager to kill me, but neither of us could." She said, "By Allah, if you had killed him, you would not have prospered. As for you, O Ammar, you know that the Messenger of Allah ﷺ said: None is to be killed except one of three: a man who kills a man and is killed for it, a man who commits adultery after being married, and a man who apostatizes from Islam."

    كُنْتُ أُبْطِنُ شَيْئًا بِالْكَذَّابِ أَدْخَلَ عَلَيْهِ بِسَيْفِي فَدَخَلْتُ عَلَيْهِ ذَاتَ يَوْمٍ فَقَالَ جِئْتَنِي وَاللَّهِ وَلَقَدْ قَامَ جِبْرِيلُ عَنْ هَذَا الْكُرْسِيِّ فَأَهْوَيْتُ إِلَى قَائِمٍ سَيْفِي فَقُلْتُ مَا أَنْتَظِرُ أَنْ أَمْشِيَ بَيْنَ رَأْسَهِ وَجَسَدِهِ حَتَّى ذَكَرْتُ حَدِيثًا حَدَّثَنَاهُ عَمْرُو بْنُ الْحَمِقِ قَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِذَا اطْمَأَنَّ الرَّجُلُ إِلَى الرَّجُلِ ثُمَّ قَتَلَهُ بَعْدَمَا اطْمَأَنَّ إِلَيْهِ نُصِبَ لَهُ يَوْمَ الْقِيَامَةِ لِوَاءُ غَدْرٍ»

    ✧ I was concealing something against the liar; I intended to enter upon him with my sword. One day I entered upon him and he said, "By Allah, you have come to me while Gabriel has just risen from this chair." I reached for the hilt of my sword and said, "What do I wait for? I will strike between his head and his body," until I remembered a hadith that Amr b. al-Hamiq narrated to us. He said: I heard the Messenger of Allah ﷺ say, "When a man trusts another man and then kills him after he trusted him, a banner of treachery will be set up for him on the Day of Resurrection."

    لَا يَحِلُّ دَمُ امْرِئٍ مِنْ أَهْلِ الْقِبْلَةِ إِلَّا بِإِحْدَى ثَلَاثٍ قَتَلَ فَيُقْتَلَ وَالثَّيِّبُ الزَّانِي وَالْمُفَارِقُ لِلْجَمَاعَةِ أَوْ قَالَ «الْخَارِجُ مِنَ الْجَمَاعَةِ»

    ✧ The blood of any person from the people of the Qiblah is not lawful except for one of three: he kills and is killed, a married adulterer, and one who abandons the community, or he said, "the one who exits from the community."

    ✧ The blood of anyone from the people of the Qiblah is not lawful except for one of three: a man who kills and is killed for it, a married adulterer, and one who abandons the community.

    كَانَتْ أُمُّ وَلَدٍ لِرَجُلٍ كَانَ لَهُ مِنْهَا ابْنَانِ مِثْلُ اللُّؤْلُؤَتَيْنِ وَكَانَتْ تَشْتُمُ النَّبِيَّ ﷺ فَيَنْهَاهَا وَلَا تَنْتَهِي وَيَزْجُرُهَا وَلَا تَنْزَجِرُ فَلَمَّا كَانَ ذَاتَ لَيْلَةٍ ذَكَرْتِ النَّبِيَّ ﷺ فَمَا صَبَرَ أَنْ قَامَ إِلَى مِغْوَلٍ فَوَضَعَهَا فِي بَطْنِهَا ثُمَّ اتَّكَأَ عَلَيْهَا حَتَّى أَنْفَذَهَا فَقَالَ رَسُولُ اللَّهِ ﷺ «أَشْهَدُ أَنَّ دَمَهَا هَدَرٌ»

    ✧ There was a woman who had two sons, both as precious as pearls. She used to insult the Prophet ﷺ and he would advise her and she would not stop, and he would scold her and she would not stop. One night, when the Prophet ﷺ mentioned her, he couldn't bear it anymore. He stood up and went to a dark spot, put it inside her and rested on it until he achieved release. Then the Messenger of Allah ﷺ said, "I bear witness that her blood has vanished."

    تَغَيَّظَ أَبُو بَكْرٍ عَلَى رَجُلٍ فَقُلْتُ مَنْ هُوَ يَا خَلِيفَةَ رَسُولِ اللَّهِ ﷺ؟ قَالَ «لَمْ؟» قُلْتُ لِأَضْرِبَ عُنُقَهُ إِنْ أَمَرْتَنِي بِذَلِكَ قَالَ فَقَالَ أَبُو بَكْرٍ «أَوَ كُنْتَ فَاعِلًا؟» قُلْتُ نَعَمْ قَالَ فَوَاللَّهِ لَأَذْهَبَ عِظَمُ كَلِمَتِي الَّتِي قُلْتُ غَضَبَهُ ثُمَّ قَالَ «مَا كَانَ لِأَحَدٍ بَعْدَ مُحَمَّدٍ ﷺ» صَحِيحُ الْإِسْنَادِ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم

    ✧ Abu Bakr became angry at a man, and I said, "Who is he, O Caliph of the Messenger of Allah ﷺ?" He said, "Why?" I said, "To strike his neck if you command me to." He said, "Would you do that?" I said, "Yes." He said, "By Allah, the gravity of my word that I spoke has gone; his anger has subsided." Then he said, "That is not for anyone after Muhammad ﷺ." This hadith has a sound chain according to the conditions of the two shaykhs, but they did not include it. On the condition of al-Bukhari and Muslim.

    ✧ A man spoke harshly to Abu Bakr al-Siddiq, so I said, 'O Caliph of the Messenger of Allah, shall I not kill him?' He said, 'This is only for one who reviles the Prophet ﷺ.' Al-Dhahabi remained silent about it in the Talkhis.

    ✧ The following is the translation of the Arabic text: "Al-Qa'nabi reported that Abdulrahman ibn Abdullah ibn Umar Al-Umari narrated from Suhail, from his father, from Abu Hurairah, who said that the Messenger of Allah ﷺ said, 'Whoever performs an act that the people of Lot (Sodom and Gomorrah) did, then they should be stoned, both the perpetrator and the receiver.'" Note: The translation does not include the phrase "ساقط" as it is not clear in this context and could have various interpretations.

    ✧ That the Messenger of Allah ﷺ said: "Allah curses whoever sacrifices for other than Allah; Allah curses whoever changes the boundaries of the land; Allah curses whoever misleads a blind person from the way; Allah curses whoever reviles his parents; Allah curses whoever affiliates himself with other than his rightful patrons; Allah curses whoever does the deed of the people of Lut."

    ✧ The Messenger of Allah ﷺ said: 'Allah has cursed seven of His creation.' The Messenger of Allah ﷺ repeated for each one three times, then said: 'Cursed, cursed, cursed is he who does the deed of the people of Lut; cursed is he who joins a woman and her daughter; cursed is he who reviles anything of his parents; cursed is he who has intercourse with any of the beasts; cursed is he who alters the boundaries of the land; cursed is he who slaughters for other than Allah; cursed is he who takes as patrons other than his own patrons.' Harun b. Harun al-Taymi: they declared him weak.

    ✧ I was searching for some camels of mine that had strayed, and I was going around some tents when suddenly I saw a rider and horsemen. The people of the watering place began to seek refuge in my dwelling and surrounded my courtyard, and they brought out a man from it. They did not speak to him until they struck his neck. When they left, I asked about him, and they said: 'He had married his father's wife.'

    ✧ I met my uncle, and with him was the banner. I said to him, 'Where are you heading?' He said, 'The Prophet ﷺ sent me to a man who married his father's wife, and he ordered me to strike his neck and take his property.' Al-Dhahabi remained silent about it in the Talkhis.

    ✧ If I had caught him, I would have struck him with the sword. Then I mentioned that to the Prophet ﷺ, and he said: 'I am more jealous than Sa'd, and Allah is more jealous than I. There is no one to whom excuses are more beloved than Allah; for that reason He sent the messengers. And there is no one to whom praise is more beloved than Allah; for that reason He promised Paradise.'

    ✧ Sa'd b. 'Ubada said: If I were to see a man with my father's wife, I would strike him with the sword, not with the flat side. This reached the Messenger of Allah ﷺ, and he said: "Are you amazed at Sa'd's jealousy? By Allah, I am more jealous than he, and Allah is more jealous than I. It is because of Allah's jealousy that He forbade indecencies, both open and secret. There is no one more jealous than Allah, and no one to whom excuses are dearer than Allah. For this reason, He has promised Paradise."

    قَالَ لِي أُبَيُّ بْنُ كَعْبٍ وَكَانَ يَقْرَأُ سُورَةَ الْأَحْزَابِ قَالَ: قُلْتُ ثَلَاثًا وَسَبْعِينَ آيَةً قَالَ «قَطُّ» قُلْتُ قَطُّ۔ قَالَ لَقَدْ رَأَيْتُهَا وَإِنَّهَا لَتَعْدِلُ الْبَقَرَةَ، وَلَقَدْ قَرَأْنَا فِيمَا قَرَأْنَا فِيهَا {الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ نَكَالًا مِنَ اللَّهِ وَاللَّهُ عَزِيزٌ حَكِيمٌ}

    Ubay b. Kaʿb told me while he was reciting Sūrat al-Aḥzāb and said, "I said ˹it was˺ seventy three Āyāt ˹long˺." He said, "Exactly." I said, "Exactly." He said, "I saw it and it was definitely ˹similar in size˺ to al-Baqarah, and we use to recite in it what we recited in it. It had 'The ˹married˺ man and the, if they commit adultery, then absolutely stone them as a deterrent from Allah; for Allah is Mighty and Wise'.

    مَنْ كَفَرَ بِالرَّجْمِ فَقَدْ كَفَرَ بِالْقُرْآنِ مِنْ حَيْثُ لَا يَحْتَسِبُ قَوْلِهِ ﷻ يَا أَهْلَ الْكِتَابِ قَدْ جَاءَكُمْ رَسُولُنَا يُبَيِّنُ لَكُمْ كَثِيرًا مِمَّا كُنْتُمْ تُخْفُونَ مِنَ الْكِتَابِ فَكَانَ الرَّجْمُ مِمَّا أَخْفَوْا

    ✧ Whoever disbelieves in stoning has disbelieved in the Qur'an from where he does not realize: His saying ﷻ: "O People of the Scripture, there has come to you Our Messenger, making clear to you much of what you used to conceal of the Scripture." Stoning was among what they concealed.

    she said, the Messenger of Allāh ﷺ recited the Āyah of Stoning to us: "al-shaykhu wa-al-shaykhah idhā zanayā fārjumūhumā al-battata bimā qaḍayā min al-ladhhah (The ˹married˺ man and a woman, if they commit adultery, then absolutely stone them for what they spent in ˹seeking˺ pleasure.)"

    سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ» فَقَالَ عَمْرٌو لَمَّا نَزَلَتْ أَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ أَكْتُبُهَا؟ فَكَأَنَّهُ كَرِهَ ذَلِكَ فَقَالَ لَهُ عَمْرٌو «أَلَا تَرَى أَنَّ الشَّيْخَ إِذَا زَنَى وَقَدْ أُحْصِنَ جُلِدَ وَرُجِمَ وَإِذَا لَمْ يُحْصِنْ جُلِدَ وَأَنَّ الثَّيِّبَ إِذَا زَنَى وَقَدْ أُحْصِنَ رُجِمَ»

    ✧ I heard the Messenger of Allah ﷺ say: "The old man and the old woman, if they commit adultery, stone them absolutely." 'Amr said: When it was revealed, I came to the Prophet ﷺ and said, "Shall I write it down?" It was as if he disliked that. 'Amr said to him: "Do you not see that an old man, if he commits adultery and is muhsan, he is flogged and stoned; and if he is not muhsan, he is flogged; and that a previously married person, if he commits adultery and is muhsan, he is stoned."

    كَانَ رَجُلٌ يَدْخُلُ عَلَى النَّبِيِّ ﷺ فَسَحَرَهُ رَجُلٌ فَعَقَدَ لَهُ عُقَدًا فَوَضَعَهُ وَطَرَحَهُ فِي بِئْرِ رَجُلٍ مِنَ الْأَنْصَارِ فَأَتَاهُ مَلَكَانِ يَعُودَانِهِ فَقَعَدَ أَحَدُهُمَا عِنْدَ رَأْسِهِ وَقَعَدَ الْآخَرُ عِنْدَ رِجْلَيْهِ فَقَالَ أَحَدُهُمَا أَتَدْرِي مَا وَجَعُهُ؟ قَالَ فُلَانٌ الَّذِي كَانَ يَدْخُلُ عَلَيْهِ عَقَدَ لَهُ عُقَدًا فَأَلْقَاهُ فِي بِئْرِ فُلَانٍ الْأَنْصَارِيِّ فَلَوْ أَرْسَلَ إِلَيْهِ رَجُلًا فَأَخَذَ مِنْهُ الْعُقَدَ فَوَجَدَ الْمَاءَ قَدِ اصْفَرَّ قَالَ «وَأَخَذَ الْعُقَدَ فَحَلَّهَا فِيهَا» قَالَ «فَكَانَ الرَّجُلُ بَعْدُ يَدْخُلُ عَلَى النَّبِيِّ ﷺ فَلَمْ يَذْكُرْ لَهُ شَيْئًا مِنْهُ وَلَمْ يُعَاتِبْهُ»

    ✧ There was a man who used to visit the Prophet ﷺ. A man bewitched him, tied knots for him, and cast them into the well of a man of the Ansar. Two angels came to visit him. One sat at his head and the other at his feet. One of them said, "Do you know what ails him?" He said, "So-and-so, who used to visit him, tied knots for him and threw them into the well of So-and-so the Ansari. If only he would send a man to him to take the knots from him." They found the water had turned yellow. He said, "He took the knots and untied them in it." He said, "After that, the man continued to visit the Prophet ﷺ, and he did not mention anything of it to him nor reproach him."

    أَنَّ أَمِيرًا مِنْ أُمَرَاءِ الْكُوفَةِ دَعَا سَاحِرًا يَلْعَبُ بَيْنَ يَدَيِ النَّاسِ فَبَلَغَ جُنْدُبًا فَأَقْبَلَ بِسَيْفِهِ وَاشْتَمَلَ عَلَيْهِ فَلَمَّا رَآهُ ضَرَبَهُ بِسَيْفِهِ فَتَفَرَّقَ النَّاسُ عَنْهُ فَقَالَ أَيُّهَا النَّاسُ لَنْ تُرَاعُوا إِنَّمَا أَرَدْتُ السَّاحِرَ فَأَخَذَهُ الْأَمِيرُ فَحَبَسَهُ

    ✧ A commander among the commanders of Kufa summoned a magician to perform before the people. It reached Jundub, so he came with his sword and covered himself with it. When he saw him, he struck him with his sword, and the people dispersed from him. He said, "O people, do not be alarmed; I only intended the magician." The commander seized him and imprisoned him.

    أَنَّ النَّبِيَّ ﷺ قَالَ لِمَاعِزِ بْنِ مَالِكٍ «وَيْحَكَ لَعَلَّكَ قَبَّلْتَ أَوْ لَمَسْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ» قَالَ لَا قَالَ «أَفَعَلْتَهَا؟» قَالَ نَعَمْ فَعِنْدَ ذَلِكَ أَمَرَ بِرَجْمِهِ

    ✧ The Prophet ﷺ said to Ma'iz b. Malik: "Woe to you! Perhaps you kissed, or touched, or squeezed, or looked." He said, "No." He said, "Did you do it?" He said, "Yes." Thereupon he ordered that he be stoned.

    أَنَّ مَاعِزًا جَاءَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً فَمَا تَأْمُرُنِي؟ فَقَالَ لَهُ الرَّجُلُ اذْهَبْ إِلَى رَسُولِ اللَّهِ ﷺ يَسْتَغْفِرُ لَكَ فَأَتَى مَاعِزٌ رَسُولَ اللَّهِ ﷺ فَأَخْبَرَهُ فَكَرِهَ رَسُولُ اللَّهِ ﷺ كَلَامَهُ أَوْ قَالَ قَوْلَهُ ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ لِمَنْ كَانَ مَعَهُ «أَبِصَاحِبِكُمْ مَسٌّ؟» قَالَ ابْنُ عَبَّاسٍ فَنَظَرْتُ إِلَى الْقَوْمِ لِأُشِيرَ عَلَيْهِمْ فَلَمْ يَلْتَفِتْ إِلَيَّ مِنْهُمْ أَحَدٌ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «لَعَلَّكَ قَبَّلْتَهَا» قَالَ لَا قَالَ النَّبِيُّ ﷺ «فَمَسَسْتَهَا» قَالَ لَا قَالَ «فَفَعَلْتَ بِهَا وَلَمْ تُكَنِّ؟» قَالَ نَعَمْ قَالَ «فَارْجُمُوهُ» قَالَ فَبَيْنَا هُوَ يُرْجَمُ إِذْ رَمَاهُ الرَّجُلُ الَّذِي جَاءَهُ مَاعِزٌ يَسْتَشِيرُهُ رَمَاهُ بِعَظْمٍ فَخَرَّ مَاعِزٌ فَالْتَفَتَ إِلَيْهِ فَقَالَ لَهُ مَاعِزٌ قَاتَلَكَ اللَّهُ إِذْ رَأَيْتَنِي ثُمَّ أَنْتَ الْآنَ تَرْجُمُنِيحفص بن عمران العدني ضعفوه

    ✧ Ma'iz came to a man among the Muslims and said, "I have committed an indecency, so what do you command me?" The man said to him, "Go to the Messenger of Allah ﷺ and he will ask forgiveness for you." So Ma'iz came to the Messenger of Allah ﷺ and informed him. The Messenger of Allah ﷺ disliked his speech, or he said his words. Then the Messenger of Allah ﷺ said to those with him: "Does your companion have a touch of madness?" Ibn 'Abbas said: I looked at the people to signal them, but none of them paid attention to me. The Messenger of Allah ﷺ said to him: "Perhaps you kissed her?" He said, "No." The Prophet ﷺ said, "Then you touched her?" He said, "No." He said, "Then you did with her and did not use a euphemism?" He said, "Yes." He said, "So stone him." He said: While he was being stoned, the man whom Ma'iz had come to consult threw a bone at him, and Ma'iz fell. He turned to him and Ma'iz said to him, "May Allah fight you! When you saw me, and now you are stoning me!" Hafs b. 'Imran al-'Adani: they deemed him weak.

    كُنْتُ جَالِسًا عِنْدَ رَسُولِ اللَّهِ ﷺ فَجَاءَ الْأَسْلَمِيُّ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» فَرَجَعَ حَتَّى أَتَاهُ الثَّالِثَةَ فَأَتَى رَسُولُ اللَّهِ ﷺ قَوْمَهُ فَسَأَلَهُمْ فَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ فَقَالَ «كَيْفَ عَقْلُهُ؟ هَلْ بِهِ جُنُونٌ؟» قَالُوا لَا وَاللَّهِ وَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ فِي عَقْلِهِ وَدِينِهِ وَأَتَاهُ الرَّابِعَةَ فَسَأَلَهُمْ عَنْهُ فَقَالُوا لَهُ مِثْلَ ذَلِكَ فَأَمَرَهُمْ فَحَفَرُوا لَهُ حُفْرَةً إِلَى صَدْرِهِ ثُمَّ رَجَمُوهُ

    ✧ I was sitting with the Messenger of Allah ﷺ when Ma'iz b. Malik al-Aslami came and said, "O Messenger of Allah, I have committed fornication and I want you to purify me." The Prophet ﷺ said to him, "Go back." He went back until he came to him the third time. The Messenger of Allah ﷺ went to his people and asked them, and they praised him well. He said, "How is his intellect? Is there any madness in him?" They said, "No, by Allah," and they praised his intellect and his religion. He came to him the fourth time and asked them about him, and they said to him the same. So he ordered them, and they dug a pit for him up to his chest, then they stoned him.

    أَنَّ مَاعِزَ بْنَ مَالِكٍ أَتَى النَّبِيَّ ﷺ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً فَرَدَّهُ النَّبِيُّ ﷺ مِرَارًا فَسَأَلَ قَوْمَهُ «أَبِهِ بَأْسٌ؟» فَقَالُوا مَا بِهِ بَأْسٌ إِلَّا أَنَّهُ أَتَى أَمْرًا لَا يَرَى أَنْ يُخْرِجَهُ مِنْهُ إِلَّا أَنْ يُقَامَ عَلَيْهِ الْحَدُّ قَالَ فَأَمَرَنَا فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ قَالَ فَلَمْ نَحْفِرْ لَهُ وَلَمْ نُوَثِّقْهُ فَرَمَيْنَاهُ بِخَزَفٍ وَعِظَامٍ وَجَنْدَلٍ فَاسْتَكَنَّ فَسَعَى فَاشْتَدَدْنَا خَلْفَهُ فَأَتَى الْحَرَّةَ فَانْتَصَبَ لَنَا فَرَمَيْنَاهُ بِحَلَامِيذِهَا حَتَّى سَكَنَ فَقَامَ النَّبِيُّ ﷺ مِنَ الْعَشِيِّ خَطِيبًا فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ فَقَالَ «أَمَّا بَعْدُ فَمَا بَالُ أَقْوَامٍ إِذَا غَزَوْنَا فَتَخَلَّفَ أَحَدُهُمْ فِي عِيَالِنَا لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ أَمَا إِنِّي عَلَيَّ لَا أُوتَى بِأَحَدٍ مِنْهُمْ فَعَلَ ذَلِكَ إِلَّا نَكَّلْتُ بِهِ» قَالَ فَلَمْ يَسُبَّهُ وَلَمْ يَسْتَغْفِرْ لَهُ

    ✧ Ma'iz b. Malik came to the Prophet ﷺ and said, "I have committed an indecency." The Prophet ﷺ turned him away several times, then he asked his people, "Is there any harm in him?" They said, "There is no harm in him except that he has done something from which he thinks nothing can remove him except that the prescribed punishment be carried out on him." He said: He ordered us, so we went with him to Baqi' al-Gharqad. He said: We did not dig for him nor tie him, but we threw at him pieces of baked clay, bones, and stones. He crouched down, then ran, and we ran hard after him. He reached the lava field and stood facing us, and we threw at him the large stones of the lava field until he became still. Then the Prophet ﷺ stood in the evening as a preacher, praised and extolled Allah, and said: "Now then, what is the matter with people who, when we go on an expedition and one of them stays behind with our families, he has a bleating like the bleating of a he-goat? Indeed, if any of them is brought to me having done that, I will make an example of him." He said: He did not revile him nor ask forgiveness for him.

    قِيلَ لِلنَّبِيِّ ﷺ إِنَّ مَاعِزًا حِينَ وَجَدَ مَسَّ الْحِجَارَةِ وَالْمَوْتِ فَرَّ فَقَالَ «هَلَّا تَرَكْتُمُوهُ»

    ✧ It was said to the Prophet ﷺ that when Ma'iz felt the touch of the stones and death, he fled. He said, "Why did you not leave him?"

    جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللَّهِ فَأَعْرَضَ عَنْهُ حَتَّى جَاءَ أَرْبَعَ مَرَّاتٍ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» فَلَمَّا مَسَّتْهُ الْحِجَارَةُ جَزِعَ فَاشْتَدَّ قَالَ فَخَرَجَ عَبْدُ اللَّهِ بْنُ أُنَيْسٍ مِنْ بَادِيَتِهِ فَرَمَاهُ بِوَظِيفِ حِمَارٍ فَصَرَعَهُ وَرَمَاهُ النَّاسُ حَتَّى قَتَلُوهُ فَذَكِرَ لِلنَّبِيِّ ﷺ فِرَارُهُ فَقَالَ «هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ وَيَتُوبُ اللَّهُ عَلَيْهِ»

    ✧ Ma'iz b. Malik came to the Prophet ﷺ and said, "O Messenger of Allah, I have committed fornication, so carry out the Book of Allah on me." He turned away from him until he came four times. He said, "Take him and stone him." When the stones touched him, he panicked and ran. He said: 'Abd Allah b. Unays came out from his desert and threw at him the leg bone of a donkey and knocked him down, and the people threw at him until they killed him. His flight was mentioned to the Prophet ﷺ, and he said, "Why did you not leave him? Perhaps he would repent and Allah would accept his repentance."

    أَتَتِ امْرَأَةٌ مِنْ غَامِدٍ النَّبِيِّ ﷺ فَقُلْتُ قَدْ فَجَرْتُ فَقَالَ «اذْهَبِي» فَذَهَبَتْ ثُمَّ رَجَعَتْ فَقَالَتْ لَعَلَّكَ تُرِيدُ أَنْ تَصْنَعَ بِي كَمَا صَنَعْتَ بِمَاعِزِ بْنِ مَالِكٍ وَاللَّهِ إِنِّي لَحُبْلَى فَقَالَ «اذْهَبِي حَتَّى تَلِدِينَ» ثُمَّ جَاءَتْ بِهِ فِي خِرْقَةٍ فَقَالَتْ قَدْ وَلَدْتُ فَطَهِّرْنِي قَالَ «اذْهَبِي حَتَّى تَفْطِمِيهِ» فَذَهَبَتْ ثُمَّ جَاءَتْ بِهِ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ قَدْ فَطَمَتْهُ فَأَمَرَ بِرَجْمِهَا وَقَدْ رَوَاهُ إِبْرَاهِيمُ بْنُ مَيْمُونٍ الصَّائِغُ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍسكت عنه الذهبي في التلخيص

    ✧ A woman from Ghamid came to the Prophet ﷺ and I said: "I have committed fornication." He said, "Go away." She went away, then returned and said, "Perhaps you want to do to me as you did to Ma'iz b. Malik. By Allah, I am pregnant." He said, "Go away until you give birth." Then she came with him in a rag and said, "I have given birth, so purify me." He said, "Go away until you wean him." She went away, then came with him, in his hand a piece of bread, and said, "She has weaned him." So he ordered that she be stoned. It was also narrated by Ibrahim b. Maymun al-Sa'igh from Abu al-Zubayr from Jabir. Al-Dhahabi remained silent about it in the Talkhis.

    أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي قَدْ زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «انْطَلِقِي فَضَعِي مَا فِي بَطْنِكِ» فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا أَتَتْهُ فَقَالَتْ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «انْطَلِقِي حَتَّى تَفْطِمِي وَلَدَكِ» فَلَمَّا فَطَمَتْ وَلَدَهَا جَاءَتْ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «هَاتِي مَنْ يَكْفُلُ وَلَدَكِ» فَقَامَ رَجُلٌ فَقَالَ أَنَا أَكْفُلُ وَلَدَهَا فَرَجَمَهَا رَسُولُ اللَّهِ ﷺ وَسَلَّمَ

    ✧ A woman came to the Prophet ﷺ and said, "I have committed fornication, so carry out the prescribed punishment on me." He said, "Go away and give birth to what is in your womb." When she gave birth to what was in her womb, she came to him and said, "I have committed fornication, so carry out the prescribed punishment on me." He said, "Go away until you wean your child." When she had weaned her child, she came and said, "O Messenger of Allah, I have committed fornication, so carry out the prescribed punishment on me." He said, "Bring someone to take care of your child." A man stood up and said, "I will take care of her child." So the Messenger of Allah ﷺ stoned her.

    أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللَّهِ ﷺ فَقَالَتْ إِنَّهَا زَنَتْ وَهِيَ حُبْلَى فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «اذْهَبِي حَتَّى تَضَعِي» فَذَهَبْتُ فَلَمَّا وَضَعَتْ جَاءَتْهُ فَقَالَ «اذْهَبِي حَتَّى تُرْضِعِيهِ» فَلَمَّا أَرْضَعَتْهُ جَاءَتْهُ فَقَالَ «اذْهَبِي حَتَّى تَسْتَوْدِعِيهِ» فَلَمَّا اسْتَوْدَعَتْهُ جَاءَتْهُ فَأَقَامَ عَلَيْهَا الْحَدَّ

    ✧ A woman came to the Messenger of Allah ﷺ and said that she had committed fornication while she was pregnant. The Messenger of Allah ﷺ said to her, "Go away until you give birth." She went away, and when she gave birth, she came to him. He said, "Go away until you breastfeed him." When she had breastfed him, she came to him. He said, "Go away until you entrust him to someone." When she had entrusted him, she came to him, and he carried out the prescribed punishment on her.

    مَا رَأَيْتُ رَجُلًا قَطُّ أَشَدَّ رَمْيَةً مِنْ عَلِيِّ بْنِ أَبِي طَالِبٍ أُتِيَ بِامْرَأَةٍ مِنْ هَمْدَانَ يُقَالُ لَهَا شُرَاحَةُ فَجَلَدَهَا مِائَةً ثُمَّ أَمَرَ بِرَجْمِهَا فَأَخَذَ عَلِيٌّ آجُرَّةً فَرَمَاهَا بِهَا فَمَا أَخْطَأَ أَصْلَ أُذُنِهَا مِنْهَا فَصَرَعَهَا فَرَجَمَهَا النَّاسُ حَتَّى قَتَلُوهَا ثُمَّ قَالَ جَلَدْتُهَا بِكِتَابِ اللَّهِ تَعَالَى وَرَجَمْتُهَا بِالسُّنَّةِ

    ✧ I have never seen a man with a stronger throw than 'Ali b. Abi Talib. A woman from Hamdan called Shuraha was brought to him, and he flogged her a hundred lashes, then ordered that she be stoned. 'Ali took a baked brick and threw it at her, and he did not miss the base of her ear. It knocked her down, and the people stoned her until they killed her. Then he said, "I flogged her according to the Book of Allah, the Exalted, and I stoned her according to the Sunnah."

    وَسُئِلَ هَلْ رَأَيْتَ أَمِيرَ الْمُؤْمِنِينَ عَلِيَّ بْنَ أَبِي طَالِبٍ قَالَ رَأَيْتُهُ أَبْيَضَ الرَّأْسِ وَاللِّحْيَةِ قِيلَ فَهَلْ تَذْكُرُ عَنْهُ شَيْئًا؟ قَالَ نَعَمْ أَذْكُرُ أَنَّهُ جَلْدَ شُرَاحَةَ يَوْمَ الْخَمِيسِ وَرَجَمَهَا يَوْمَ الْجُمُعَةِ فَقَالَ «جَلَدْتُهَا بِكِتَابِ اللَّهِ وَرَجَمْتُهَا بِسُنَّةِ رَسُولِ اللَّهِ ﷺ» وَهَذَا إِسْنَادٌ صَحِيحٌ وَإِنْ كَانَ فِي الْإِسْنَادِ الْأَوَّلِ الْخِلَافُ فِي سَمَاعِ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ مِنْ أَبِيهِ صحيح

    ✧ He was asked, "Did you see the Commander of the Believers, Ali b. Abi Talib?" He said, "I saw him, white of head and beard." It was said, "Do you remember anything from him?" He said, "Yes, I remember that he flogged Shuraha on Thursday and stoned her on Friday, and he said, 'I flogged her according to the Book of God, and I stoned her according to the Sunnah of the Messenger of God ﷺ.'" This is a sound chain, though in the first chain there is disagreement about Abd al-Rahman b. Abdullah b. Mas'ud's hearing from his father. Sahih.

    «أُتِيَ رَسُولُ اللَّهِ ﷺ بِيَهُودِيٍّ وَيَهُودِيَّةٍ قَدْ زَنَيَا وَقَدْ أُحْصِنَا فَسَأَلُوهُ أَنْ يَحْكُمَ فِيهِمَا فَحَكَمَ فِيهِمَا بِالرَّجْمِ فَرَجَمَهُمَا فِي قُبُلِ الْمَسْجِدِ فِي بَنِي غَنْمٍ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ قَامَ إِلَى صَاحَبْتِهِ فَحَنَى عَلَيْهَا لِيَقِيَهَا مَسَّ الْحِجَارَةِ وَكَانَ مِمَّا صَنَعَ اللَّهُ لِرَسُولِهِ ﷺ قِيَامَهُ إِلَيْهَا لِيَقِيَهَا الْحِجَارَةَ»

    ✧ The Messenger of God ﷺ was brought a Jewish man and a Jewish woman who had committed fornication, and they had been married. They asked him to judge between them, so he judged that they be stoned. He stoned them in front of the mosque among Banu Ghanm. When the man felt the touch of the stones, he went to his companion and leaned over her to protect her from the stones. That he rose to protect her from the stones was among what God did for His Messenger ﷺ.

    ✧ The Messenger of God ﷺ forbade that, except that he allowed it for araya. Al-Dhahabi remained silent about it in the Talkhis.

    فِي الرَّجُلِ أَتَى جَارِيَةَ امْرَأَتِهِ قَالَ «إِنْ كَانَتْ حَلَّلَتْهَا لَهُ جُلِدَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»

    ✧ About a man who has intercourse with his wife's slave girl, he said: "If she made her lawful for him, he is flogged one hundred lashes; but if she did not make her lawful for him, I stone him."

    ✧ "The Messenger of Allah ﷺ said, 'Whoever opposes his religion among the Muslims, then kill him. And if a slave says, "I bear witness that there is no god but Allah, and Muhammad is His slave and Messenger," then there is no way for us except to carry out his rights if he deserves to be punished.'"

    «كَانَ رَجُلٌ مِنَ الْأَنْصَارِ أَسْلَمَ ثُمَّ ارْتَدَّ وَلَحِقَ بِالشِّرْكِ ثُمَّ نَدِمَ فَأَرْسَلَ إِلَى قَوْمِهِ أَنْ سَلُوا رَسُولَ اللَّهِ ﷺ هَلْ لِي مِنْ تَوْبَةٍ؟» قَالَ فَنَزَلَتْ {كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ وَشَهِدُوا أَنَّ الرَّسُولَ حَقٌّ وَجَاءَهُمُ الْبَيِّنَاتُ} [آل عمران 86] إِلَى قَوْلِهِ {إِلَّا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ} [آل عمران 89] قَالَ «فَأَقْبَلَ إِلَيْهِ قَوْمُهُ فَأَسْلَمَ»

    ✧ A man of the Ansar accepted Islam, then apostatized and joined the polytheists. Then he regretted it and sent word to his people: "Ask the Messenger of God ﷺ whether there is any repentance for me." He said: Then was revealed: {How shall God guide a people who disbelieved after their belief and bore witness that the Messenger is true, and clear signs came to them} [Al 'Imran 86] up to His saying {Except those who repent after that and make amends, for God is Forgiving, Merciful} [Al 'Imran 89]. He said: "His people came to him, and he accepted Islam."

    عَنِ الْفُرَاتِ بْنِ حَيَّانَ وَكَانَ عَيْنًا لِأَبِي سُفْيَانَ وَحَلِيفًا وَكَانَ رَسُولُ اللَّهِ ﷺ قَدْ أَمَرَ بِقَتْلِهِ فَمَرَّ عَلَى حَلْقَةٍ مِنَ الْأَنْصَارِ فَقَالَ إِنِّي مُسْلِمٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ مِنْكُمْ رِجَالًا نَكِلُهُمْ إِلَى إِيمَانِهِمْ مِنْهُمُ الْفُرَاتُ بْنُ حَيَّانَ»

    ✧ About al-Furat b. Hayyan, who was a spy for Abu Sufyan and an ally. The Messenger of God ﷺ had ordered him killed, but he passed by a circle of the Ansar and said, "I am a Muslim." The Messenger of God ﷺ said: "Among you are men whom we entrust to their faith; among them is al-Furat b. Hayyan."

    كَانَتْ قُرَيْظَةُ وَالنَّضِيرُ وَكَانَ مِنْ أَشْرَافِ قُرَيْظَةَ فَكَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلًا مِنَ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ قَالُوا ادْفَعُوهُ إِلَيْنَا نَقْتُلُهُ فَقَالُوا بَيْنَنَا وَبَيْنَكُمُ النَّبِيُّ ﷺ فَأَتَوْهُ فَنَزَلَتْ {وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ} [المائدة 42] النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ {أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ} [المائدة 50]

    ✧ There were Qurayzah and al-Nadir, and he was among the nobles of Qurayzah. Whenever a man of Qurayzah killed a man of al-Nadir, he was killed for it. But when a man of al-Nadir killed a man of Qurayzah, they said, "Hand him over to us and we will kill him." They said, "Between us and you is the Prophet ﷺ." So they came to him, and it was revealed: {And if you judge, judge between them with justice. Indeed, God loves the just} [al-Ma'idah 42]: a life for a life. Then it was revealed: {Is it the judgment of ignorance they seek?} [al-Ma'idah 50].

    لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا فِي ثَلَاثِ خِصَالٍ زَانٍ مِحْصَنٍ فَيُرْجَمُ وَالرَّجُلُ يَقْتُلُ مُتَعَمِّدًا فَيُقْتَلُ بِهِ وَيُصْلَبُ أَوْ يُنْفَى مِنَ الْأَرْضِ

    ✧ The blood of a Muslim man is not lawful except in three cases: a married adulterer, who is stoned; a man who kills deliberately, who is killed for it and crucified or banished from the land.

    ✧ Ali b. Isa al-Hiri narrated to us: Muhammad b. Ishaq al-Imam narrated to us: Abu Bakr b. Muhammad b. al-Nadr al-Jarudi narrated to me: al-Fadl b. Sahl al-A'raj narrated to us: Yahya b. Abdullah narrated to us, and he mentioned something similar with his chain.

    جَاءَتْ جَارِيَةٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَتْ إِنَّ سَيِّدِي اتَّهَمَنِي فَأَقْعَدَنِي عَلَى النَّارِ حَتَّى احْتَرَقَ فَرْجِي فَقَالَ عُمَرُ هَلْ رَأَى ذَلِكَ عَلَيْكِ؟ قَالَتْ لَا قَالَ فَاعْتَرَفْتِ لَهُ بِشَيْءٍ؟ قَالَتْ لَا قَالَ عُمَرُ عَلَيَّ بِهِ فَلَمَّا رَأَى عُمَرُ الرَّجُلَ قَالَ أَتُعَذَّبُ بِعَذَابِ اللَّهِ؟ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اتَّهَمْتُهَا فِي نَفْسِهَا قَالَ رَأَيْتَ ذَلِكَ عَلَيْهَا؟ قَالَ الرَّجُلُ لَا قَالَ فَاعْتَرَفَتْ لَكَ بِذَلِكَ؟ قَالَ لَا قَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ لَمْ أَسْمَعْ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُقَادُ مَمْلُوكٌ مِنْ مَالِكِهِ وَلَا وَلَدٌ مِنْ وَالِدِهِ» لَأَقَدْتُهَا مِنْكَ فَبَرَّزَهُ وَضَرَبَهُ مِائَةَ سَوْطٍ ثُمَّ قَالَ اذْهَبِي فَأَنْتِ حُرَّةٌ لِوَجْهِ اللَّهِ وَأَنْتِ مَوْلَاةُ اللَّهِ وَرَسُولِهِ

    ✧ A slave girl came to Umar b. al-Khattab and said, 'My master accused me, so he made me sit on fire until my private parts burned.' Umar asked, 'Did he see that [i.e., adultery] from you?' She said, 'No.' He asked, 'Did you confess to him anything?' She said, 'No.' Umar said, 'Bring him to me.' When Umar saw the man, he said, 'Do you punish with the punishment of Allah?' The man said, 'O Commander of the Faithful, I accused her regarding her own self.' Umar asked, 'Did you see that from her?' The man said, 'No.' Umar asked, 'Did she confess that to you?' He said, 'No.' Umar said, 'By the One in Whose hand is my soul, had I not heard the Messenger of Allah ﷺ say: A slave is not to be subjected to retaliation for [an offense against] his owner, nor a child for [an offense against] his parent, I would have exacted retaliation from you for her.' He then exposed him and struck him with one hundred lashes. Then he said to her, 'Go, for you are free for the sake of Allah, and you are the freedwoman of Allah and His Messenger.'

    «مَنْ مَثَّلَ بِعَبْدِهِ فَهُوَ حُرٌّ وَهُوَ مَوْلَى اللَّهِ وَرَسُولِهِ»

    ✧ Whoever mutilates his slave, the slave is free and is the freedman of Allah and His Messenger.

    كُنَّا نُزُولًا فِي دَارِ سُوَيْدِ بْنِ مُقَرِّنٍ وَمَعَنَا شَيْخٌ حَدِيدٌ جَاهِلٌ فَلَا أَدْرِي مَا قَالَتْ وَلِيدَةُ سُوَيْدٍ فَلَطَمَهَا فَغَضِبَ مِنْ ذَلِكَ غَضَبًا مَا غَضِبَ مِثْلَهُ قَطُّ قَالَ «عَجَزَ عَلَيْكَ إِلَّا حُرُّ وَجْهِهَا لَقَدْ رَأَيْتُنِي سَابِعَ سَبْعَةٍ مِنْ بَنِي مُقَرِّنٍ مَا لَنَا إِلَّا خَادِمٌ وَاحِدٌ فَلَطَمَهَا أَصْغَرُنَا فَأَمَرَنَا رَسُولُ اللَّهِ ﷺ أَنْ نُعْتِقَهَا» صحيح

    ✧ We were lodging in the house of Suwayd b. Muqarrin, and with us was a sharp-tempered, ignorant old man. I do not know what the slave woman of Suwayd said, but he slapped her. Suwayd became angrier than I ever saw him before and said, 'Could you not have hit the free part of her face? I was one of seven from the Banu Muqarrin, and we had only one servant. The youngest of us slapped her, and the Messenger of Allah ﷺ ordered us to set her free.'

  142. al-Mustadrak (al-Hakim) 8104Abu Dawud silent

    «لَا يُقَادُ وَلَدٌ مِنْ وَالِدِهِ وَلَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ»

    ✧ A child is not to be subjected to retaliation for [an offense against] his parent, and the prescribed punishments are not to be carried out in mosques.

  143. al-Mustadrak (al-Hakim) 8105Sahih

    «أَنَّ النَّبِيَّ ﷺ ضَرَبَ وَغَرَّبَ» وَأَنَّ أَبَا بَكْرٍ ضَرَبَ وَغَرَّبَ «وَأَنَّ عُمَرَ ضَرَبَ وَغَرَّبَ»

    ✧ It means: "That the Prophet ﷺ traveled and immigrated [to Medina], and that Abu Bakr traveled and immigrated [with him], and that Umar traveled and immigrated [as well]."

    يَا أَيُّهَا النَّاسُ أَقِيمُوا الْحُدُودَ عَلَى أَرِقَّائِكُمْ مَنْ أُحْصِنَ مِنْهُنَّ وَمَنْ لَمْ يُحْصِنْ فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ ﷺ زَنَتْ فَأَمَرَنِي رَسُولُ اللَّهِ ﷺ أَنْ أَجْلِدَهَا فَأَتَيْتُهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا وَأَنْ تَمُوتَ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «أَحْسَنْتَ»

    ✧ O people, carry out the prescribed punishments on your slaves, whether they are married or unmarried. A slave woman belonging to the Messenger of Allah ﷺ committed adultery, and he ordered me to flog her. I went to her and found that she had recently given birth. I feared that if I flogged her I might kill her or she might die. I went to the Messenger of Allah ﷺ and mentioned that to him, and he said, 'You have done well.'

    «لَا يُجْلَدُ فَوْقَ عَشْرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ تَعَالَى»

    ✧ No one is to be flogged with more than ten lashes except for a prescribed punishment from the prescribed punishments of Allah, the Exalted.

    أَنَّهُ زَارَ عَمَّةً لَهُ فَدَعَتْ لَهُ بِطَعَامٍ فَأَبْطَأْتِ الْجَارِيَةُ فَقَالَتْ أَلَا تَسْتَعْجِلِي يَا زَانِيَةُ فَقَالَ عَمْرٌو سُبْحَانَ اللَّهِ لَقَدْ قُلْتِ أَمْرًا عَظِيمًا هَلِ اطَّلَعْتِ عَنْهَا عَلَى زِنًى؟ قَالَتْ لَا وَاللَّهِ فَقَالَ عَمْرٌو إِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَيُّمَا عَبْدٍ أَوِ امْرَأَةٍ قَالَ أَوْ قَالَتْ لِوَلِيدَتِهَا يَا زَانِيَةُ وَلَمْ تَطَّلِعْ مِنْهَا عَلَى زِنَاءٍ جَلَدَتْهَا وَلِيدَتُهَا يَوْمَ الْقِيَامَةِ لِأَنَّهُ لَا حَدَّ لَهُنَّ فِي الدُّنْيَا»

    ✧ He visited an aunt of his, and she called for food for him. The servant girl was slow, so she said, 'Why don't you hurry up, O adulteress?' Amr said, 'Glory be to Allah! You have said something terrible. Have you seen her commit adultery?' She said, 'No, by Allah.' Amr said, 'I heard the Messenger of Allah ﷺ say: Any male slave or woman who says to his or her slave girl, "O adulteress," without having seen her commit adultery, will be flogged by that slave girl on the Day of Resurrection, because there is no prescribed punishment for them in this world.'

  147. al-Mustadrak (al-Hakim) 8109Sahih

    حَدَّثَنِي سَهْلُ بْنُ سَعْدٍ صَاحِبُ رَسُولِ اللَّهِ ﷺ «أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّهُ زَنَى بِامْرَأَةٍ سَمَّاهَا وَأَنْكَرَتْ فَحَدَّهُ وَتَرْكَهَا» هَذَا إِسْنَادٌ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ وَشَاهِدُهُ صحيح

    ✧ Sahl b. Sa'd, the Companion of the Messenger of Allah ﷺ, told me that a man from Aslam came to the Prophet ﷺ and said that he had committed adultery with a woman whom he named, but she denied it. The Prophet ﷺ punished the man and left the woman alone. This is a sound chain of narration, though they did not record it, and its supporting evidence is sound.

    أَنَّ رَجُلًا مِنْ بَنِي بَكْرِ بْنِ لَيْثٍ أَتَى النَّبِيَّ ﷺ فَأَقَرَّ أَنَّهُ زَنَى بِامْرَأَةٍ أَرْبَعَ مِرَارٍ فَجُلِدَ مِائَةً وَكَانَ بِكْرًا ثُمَّ سَأَلَهُ الْبَيِّنَةَ عَلَى الْمَرْأَةِ فَقَالَتِ الْمَرْأَةُ كَذَبَ وَاللَّهِ يَا رَسُولَ اللَّهِ فَجَلَدَهُ حَدَّ الْفِرْيَةِ ثَمَانِينَ

    ✧ A man from Banu Bakr b. Layth came to the Prophet ﷺ and confessed four times that he had committed adultery with a woman. He was flogged with one hundred lashes, as he was a virgin. Then the Prophet ﷺ asked him for evidence against the woman, and she said, 'He has lied, by Allah, O Messenger of Allah.' So the Prophet ﷺ flogged him eighty lashes for slander.

    أَنَّ هِلَالَ بْنَ أُمَيَّةَ قَذَفَ امْرَأَتَهُ عِنْدَ النَّبِيِّ ﷺ بِشَرِيكِ بْنِ سَمْحَاءَ فَقَالَ رَسُولُ اللَّهِ ﷺ «الْبَيِّنَةُ أَوْ حَدٌّ فِي ظَهْرِكَ»

    ✧ Hilal b. Umayyah accused his wife before the Prophet ﷺ of adultery with Sharik b. Samha'. The Messenger of Allah ﷺ said, 'Produce evidence, or face the prescribed punishment on your back.'

    ثَنَا الْقَعْنَبِيُّ ثَنَا ابْنُ أَبِي ذِئْبٍ عَنْ خَالِهِ الْحَارِثِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ فِي الْخَمْرِ «إِنْ شَرِبَهَا فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ»

    ✧ Al-Qa'nabi narrated to us, Ibn Abi Dhi'b narrated to us, from his maternal uncle al-Harith b. 'Abd al-Rahman, from Abu Salamah, from Abu Hurayrah, that the Prophet ﷺ said regarding wine: 'If he drinks it, flog him. If he repeats, flog him. If he repeats for the fourth time, then kill him.'
