21. Marriage

    «لَا تُنْكَحُ الْمَرْأَةُ بِغَيْرِ إِذْنِ وَلِيِّهَا فَإِنْ نُكِحَتْ فَنِكَاحُهَا بَاطِلٌ ثَلَاثَ مَرَّاتٍ فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»

    ✧ A woman is not to be married without the permission of her guardian; if she is married, then her marriage is invalid — three times — and if he has consummated with her, then she is entitled to her dowry for what he has had of her; and if they dispute, then the ruler is the guardian of the one who has no guardian.

    قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» هَذِهِ الْأَسَانِيدُ كُلُّهَا صَحِيحَةٌ وَقَدْ عَلَوْنَا فِيهِ عَنْ إِسْرَائِيلَ وَقَدْ وَصَلَهُ الْأَئِمَّةُ الْمُتَقَدِّمُونَ الَّذِينَ يَنْزِلُونَ فِي رِوَايَاتِهِمْ عَنْ إِسْرَائِيلَ مِثْلُ عَبْدِ الرَّحْمَنِ بْنِ مَهْدِيٍّ وَوَكِيعٌ وَيَحْيَى بْنُ آدَمَ وَيَحْيَى بْنُ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ وَغَيْرُهُمْ وَقَدْ حَكَمُوا لِهَذَا الْحَدِيثِ بِالصِّحَّةِ سَمِعْتُ أَبَا نَصْرٍ أَحْمَدَ بْنَ سَهْلٍ الْفَقِيهَ بِبُخَارَى يَقُولُ سَمِعْتُ صَالِحَ بْنَ مُحَمَّدِ بْنِ حَبِيبٍ الْحَافِظُ يَقُولُ سَمِعْتُ عَلِيَّ بْنَ عَبْدِ اللَّهِ الْمَدِينِيَّ يَقُولُ سَمِعْتُ عَبْدَ الرَّحْمَنِ بْنَ مَهْدِيٍّ يَقُولُ «كَانَ إِسْرَائِيلُ يَحْفَظُ حَدِيثَ أَبِي إِسْحَاقَ كَمَا يَحْفَظُ الْحَمْدَ» سَمِعْتُ أَبَا الْحَسَنِ بْنَ مَنْصُورٍ يَقُولُ سَمِعْتُ أَبَا بَكْرٍ مُحَمَّدَ بْنَ إِسْحَاقَ يَقُولُ سَمِعْتُ أَبَا مُوسَى يَقُولُ «كَانَ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ يُثْبِتُ حَدِيثَ إِسْرَائِيلَ عَنْ أَبِي إِسْحَاقَ يَعْنِي فِي النِّكَاحِ بِغَيْرِ وَلِيٍّ» حَدَّثَنِي مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الشَّيْبَانِيُّ ثنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ ثنا حَاتِمُ بْنُ يُونُسَ الْجُرْجَانِيُّ قَالَ قُلْتُ لِأَبِي الْوَلِيدِ الطَّيَالِسِيِّ مَا تَقُولُ فِي النِّكَاحِ بِغَيْرِ وَلِيٍّ؟ فَقَالَ «لَا يَجُوزُ» قُلْتُ مَا الْحُجَّةُ فِي ذَلِكَ؟ فَقَالَ ثنا قَيْسُ بْنُ الرَّبِيعِ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ عَنْ أَبِيهِ قُلْتُ فَإِنَّ الثَّوْرِيَّ وَشُعْبَةَ يُرْسِلَانِ قَالَ فَإِنَّ إِسْرَائِيلَ قَدْ تَابَعَ قَيْسًا حَدَّثَنِي مُحَمَّدُ بْنُ صَالِحِ بْنِ هَانِئٍ ثنا مُحَمَّدُ بْنُ الْمُنْذِرِ بْنِ سَعِيدٍ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ جَبَلَةَ سَمِعْتُ عَلِيَّ بْنَ الْمَدِينِيِّ يَقُولُ حَدِيثُ إِسْرَائِيلَ صَحِيحٌ فِي «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» سَمِعْتُ أَبَا الْحَسَنِ بْنَ مَنْصُورٍ يَقُولُ سَمِعْتُ أَبَا بَكْرٍ مُحَمَّدَ بْنَ إِسْحَاقَ الْإِمَامَ يَقُولُ سَأَلْتُ مُحَمَّدَ بْنَ يَحْيَى عَنْ هَذَا الْبَابِ فَقَالَ حَدِيثُ إِسْرَائِيلَ صَحِيحٌ عِنْدِي فَقُلْتُ لَهُ رَوَاهُ شَرِيكٌ أَيْضًا فَقَالَ مَنْ رَوَاهُ؟ فَقُلْتُ حَدَّثَنَا بِهِ عَلِيُّ بْنُ حُجْرٍ وَذَكَرْتُ لَهُ حَدِيثَ يُونُسَ عَنْ أَبِي إِسْحَاقَ وَقُلْتُ لَهُ رَوَاهُ شُعْبَةُ وَالثَّوْرِيُّ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ عَنِ النَّبِيِّ ﷺ قَالَ نَعَمْ «هَكَذَا رَوَيَاهُ وَلَكِنَّهُمْ كَانُوا يُحَدِّثُونَ بِالْحَدِيثِ فَيُرْسِلُونَهُ حَتَّى يُقَالَ لَهُمْ عَمَّنْ فَيُسْنِدُونَهُ» سَمِعْتُ أَبَا الْحَسَنِ أَحْمَدَ بْنَ مُحَمَّدٍ الْعَنَزِيَّ يَقُولُ سَمِعْتُ عُثْمَانَ بْنَ سَعِيدٍ الدَّارِمِيَّ يَقُولُ قُلْتُ لِيَحْيَى بْنِ مَعِينٍ يُونُسُ بْنُ أَبِي إِسْحَاقَ أَحَبُّ إِلَيْكَ أَوِ ابْنُهُ إِسْرَائِيلُ بْنُ يُونُسَ؟ فَقَالَ «كُلٌّ ثِقَةٌ» صحيح

    ✧ The Messenger of Allah ﷺ said: “There is no marriage except with a guardian.” All these chains of transmission are authentic, and we have a high chain through Isra'il. The leading earlier imams, who in their narrations descend through Isra'il, such as 'Abd al-Rahman b. Mahdi, Waki', Yahya b. Adam, Yahya b. Zakariyya b. Abi Za'idah, and others, have connected it, and they have ruled this hadith to be authentic. I heard Abu Nasr Ahmad b. Sahl al-Faqih in Bukhara say: I heard Salih b. Muhammad b. Habib al-Hafiz say: I heard 'Ali b. 'Abd Allah al-Madini say: I heard 'Abd al-Rahman b. Mahdi say: “Isra'il used to memorize the hadith of Abu Ishaq as he memorized the Surah al-Hamd.” I heard Abu al-Hasan b. Mansur say: I heard Abu Bakr Muhammad b. Ishaq say: I heard Abu Musa say: “'Abd al-Rahman b. Mahdi used to affirm the hadith of Isra'il from Abu Ishaq, meaning regarding marriage without a guardian.” Muhammad b. 'Abd Allah al-Shaybani narrated to me: Ahmad b. Muhammad b. al-Hasan narrated to us: Hatim b. Yunus al-Jurjani narrated to us: He said: I said to Abu al-Walid al-Tayalisi: What do you say about marriage without a guardian? He said: “It is not permissible.” I said: What is the proof for that? He said: Qays b. al-Rabi' narrated to us, from Abu Ishaq, from Abu Burdah, from his father. I said: But al-Thawri and Shu'bah narrate it as mursal. He said: Isra'il has followed Qays. Muhammad b. Salih b. Hani' narrated to me: Muhammad b. al-Mundhir b. Sa'id narrated to us: Ishaq b. Ibrahim b. Jabalah narrated to us: I heard 'Ali b. al-Madini say: The hadith of Isra'il is authentic regarding “There is no marriage except with a guardian.” I heard Abu al-Hasan b. Mansur say: I heard Abu Bakr Muhammad b. Ishaq al-Imam say: I asked Muhammad b. Yahya about this chapter, and he said: The hadith of Isra'il is authentic according to me. I said to him: Sharik also narrated it. He said: Who narrated it? I said: 'Ali b. Hujr narrated it to us, and I mentioned to him the hadith of Yunus from Abu Ishaq, and I said to him: Shu'bah and al-Thawri narrated it from Abu Ishaq, from Abu Burdah, from the Prophet ﷺ. He said: Yes, “They narrated it like that, but they used to narrate the hadith and send it as mursal until it was said to them: From whom? Then they would give its chain.” I heard Abu al-Hasan Ahmad b. Muhammad al-'Anazi say: I heard 'Uthman b. Sa'id al-Darimi say: I said to Yahya b. Ma'in: Is Yunus b. Abi Ishaq dearer to you, or his son Isra'il b. Yunus? He said: “Both are trustworthy.” Sahih.

    «يَا رَبِيعَةُ أَلَا تَتَزَوَّجُ؟» قَالَ فَقُلْتُ لَا وَاللَّهِ يَا رَسُولَ اللَّهِ مَا أُرِيدُ أَنْ أَتَزَوَّجَ مَا عِنْدِي مَا يُقِيمُ الْمَرْأَةَ وَمَا أُحِبُّ أَنْ يَشْغَلَنِي عَنْكَ شَيْءٌ قَالَ فَأَعْرَضَ عَنِّي ثُمَّ قَالَ لِي بَعْدَ ذَلِكَ «يَا رَبِيعَةُ أَلَا تَتَزَوَّجُ؟» قَالَ فَقُلْتُ لَا وَاللَّهِ يَا رَسُولَ اللَّهِ مَا أُرِيدُ أَنْ أَتَزَوَّجَ وَمَا عِنْدِي مَا يُقِيمُ الْمَرْأَةَ وَمَا أُحِبُّ أَنْ يَشْغَلَنِي عَنْكَ شَيْءٌ فأعرض عني قَالَ ثم رَاجَعْتُ نَفْسِي فَقُلْتُ وَاللَّهِ يَا رَسُولَ اللَّهِ أَنْتَ أَعْلَمُ بِمَا يُصْلِحُنِي فِي الدُّنْيَا وَالْآخِرَةِ قَالَ وَأَنَا أَقُولُ فِي نَفْسِي لَئِنْ قَالَ لِي الثَّالِثَةَ لَأَقُولَنَّ نَعَمْ قَالَ فَقَالَ لِيَ الثَّالِثَةَ «يَا رَبِيعَةُ أَلَا تَتَزَوَّجُ؟» قَالَ فَقُلْتُ بَلَى يَا رَسُولَ اللَّهِ مُرْنِي بِمَا شِئْتَ أَوْ بِمَا أَحْبَبْتَ قَالَ انْطَلِقْ إِلَى آلِ فُلَانٍ إِلَى حَيٍّ مِنَ الْأَنْصَارِ فِيهِمْ تَرَاخي عَنْ رَسُولِ اللَّهِ ﷺ فَقُلْ لَهُمْ إِنَّ رَسُولَ اللَّهِ ﷺ يُقْرِئُكُمُ السَّلَامَ وَيَأْمُرُكُمْ أَنْ تُزَوِّجُوا رَبِيعَةَ فُلَانَةً امْرَأَةً مِنْهُمْ قَالَ فَأَتَيْتُهُمْ فَقُلْتُ لَهُمْ ذَلِكَ قَالُوا مَرْحَبًا بِرَسُولِ اللَّهِ ﷺ وَبِرَسُولِ رَسُولِ اللَّهِ ﷺ وَاللَّهِ لَا يَرْجِعُ رَسُولُ رَسُولِ اللَّهِ ﷺ إِلَّا بِحَاجَتِهِ قَالَ فَأَكْرَمُونِي وَزَوَّجُونِي وَأَلْطَفُونِي وَلَمْ يَسْأَلُونِي الْبَيِّنَةَ فَرَجَعْتُ حَزِينًا فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا بَالُكَ؟» فَقُلْتُ يَا رَسُولَ اللَّهِ أَتَيْتُ قَوْمًا كِرَامًا فَزَوَّجُونِي وَأَكْرَمُونِي وَأَلْطَفُونِي وَلَمْ يَسْأَلُونِي الْبَيِّنَةَ فَمِنْ أَيْنَ لِيَ الصَّدَاقُ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ لِبُرَيْدَةَ الْأَسْلَمِيِّ «يَا بُرَيْدَةُ اجْمَعُوا لَهُ وَزْنَ نَوَاةٍ مِنْ ذَهَبٍ» قَالَ فَجَمَعُوا لِهُ وَزْنَ نَوَاةٍ مِنْ ذَهَبٍ قَالَ فَقَالَ النَّبِيُّ ﷺ «اذْهَبْ بِهَذَا إِلَيْهِمْ وَقُلْ هَذَا صَدَاقُهَا» فَذَهَبْتُ بِهِ إِلَيْهِمْ فَقُلْتُ هَذَا صَدَاقُهَا قَالَ فَقَالُوا كَثِيرٌ طَيِّبٌ فَقَبِلُوا وَرَضُوا بِهِ قَالَ فَقُلْتُ مِنْ أَيْنَ أُولِمُ؟ قَالَ فَقَالَ «يَا بُرَيْدَةُ اجْمَعُوا لَهُ فِي شَاةٍ» قَالَ فَجَمَعُوا لِهُ فِي كَبْشٍ سَمِينٍ قَالَ وَقَالَ النَّبِيُّ ﷺ اذْهَبْ إِلَى عَائِشَةَ فَقُلِ انْظُرِي إِلَى الْمِكْتَلَ الَّذِي فِيهِ الطَّعَامُ فَابْعَثِي بِهِ قَالَ فَأَتَيْتُ عَائِشَةَ فَقُلْتُ لَهَا ذَاكَ فَقَالَتْ هَا هُوَ ذَاكَ الْمِكْتَلُ فِيهِ سَبْعَةُ آصُعٍ مِنْ شَعِيرٍ وَاللَّهِ إِنْ أَصْبَحَ لَنَا طَعَامٌ غَيْرُهُ قَالَ فَأَخَذْتُهُ فَجِئْتُ بِهِ إِلَى النَّبِيِّ ﷺ فَقَالَ اذْهَبْ بِهَا إِلَيْهِمْ فَقُلْ لِيُصْلَحْ هَذَا عِنْدَكُمْ خُبْزًا قَالَ فَذَهَبْتُ بِهِ وَبِالْكَبْشِ فَقَالَ فَقَبِلُوا الطَّعَامَ وَقَالُوا اكْفُونَا أَنْتُمُ الْكَبْشَ قَالَ وَجَاءَ نَاسٌ مِنْ أَسْلَمَ فَذَبَحُوا وَسَلَخُوا وَطَبَخُوا قَالَ فَأَصْبَحَ عِنْدَنَا خُبْزٌ وَلَحْمٌ فَأَوْلَمْتُ وَدَعَوْتُ رَسُولَ اللَّهِ ﷺلم يحتج مسلم بمبارك

    ✧ I used to serve the Prophet ﷺ, then the Prophet ﷺ said to me, "O Rabi'ah! Why don't you get married?" I replied, "By Allah, O Messenger of Allah, I don't want to get married. I don't have enough to provide for a wife, and I don't want anything to distract me from you." Then he turned away from me. After that, he asked me again, "O Rabi'ah! Why don't you get married?" I replied, "By Allah, O Messenger of Allah, I don't want to get married. I don't have enough to provide for a wife, and I don't want anything to distract me from you." He turned away from me again. Then I revisited myself and said, "By Allah, O Messenger of Allah, you know what is best for me in this life and the hereafter." He said, "And I say to myself, if he asks me for the third time, I will say yes." Then he asked me for the third time, "O Rabi'ah! Why don't you get married?" I said, "Yes, O Messenger of Allah, do whatever you think is best for me or whatever you like." He said, "Go to the family of so and so in such and such place among the Ansar. Tell them that the Messenger of Allah ﷺ sends his greetings to you and orders you to marry Rabi'ah the daughter of so and so." So I went to them and conveyed the message. They said, "Welcome to the Messenger of Allah ﷺ and the Messenger of the Messenger of Allah ﷺ. By Allah, the Messenger of the Messenger of Allah ﷺ does not ask us for something without a reason." They honored me, married me to her, treated me kindly, and did not ask for any proof. I returned feeling sad, so the Messenger of Allah ﷺ asked me, "What's wrong?" I said, "O Messenger of Allah, I went to a noble people, they honored and treated me kindly, and did not ask for any proof. But where will I get the dowry?" The Messenger of Allah ﷺ said to Buraidah Al-Aslami, "O Buraidah, collect the weight of a date seed in gold for him." So they collected the weight of a date seed in gold for me. Then the Prophet ﷺ said, "Take it to them and say, 'This is her dowry.'" So I took it to them and said, "This is her dowry." They said, "It's a lot, but we accept it." Then I asked, "Where should I stay?" They said, "O Buraidah, give him a sheep." So they gave me a fat sheep. The Prophet ﷺ said, "Go to Aishah and tell her to look at the dough in which the food is baked and send it to us." So I went to Aishah, told her about it, and she said, "Here it is, the dough in which the food is baked. By Allah, we don't have any other food in the morning." So I took it and the sheep to the Prophet ﷺ. They accepted the food and said, "You keep the sheep." Then some Muslims came, slaughtered, skinned, and cooked it. So we had bread and meat in the morning. I felt content and prayed for the blessings of the Muslims.

    عَنِ الْحَسَنِ فِي قَوْلِ اللَّهِ ﷻ {فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ} [البقرة 232] قَالَ حَدَّثَنِي مَعْقِلُ بْنُ يَسَارٍ الْمُزَنِيُّ أَنَّهَا نَزَلَتْ فِيهِ قَالَ كُنْتُ زَوَّجْتُ أُخْتًا لِي مِنْ رَجُلٍ فَطَلَّقَهَا حَتَّى إِذَا انْقَضَتْ عِدَّتُهَا جَاءَ يَخْطُبُهَا فَقُلْتُ لَهُ زَوَّجْتُكَ وَفَرَّشْتُكَ وَأَكْرَمْتُكَ فَطَلَّقْتَهَا ثُمَّ جِئْتَ تَخْطُبُهَا لَا وَاللَّهِ لَا تَعُودُ إِلَيْهَا أَبَدًا قَالَ وَكَانَ رَجُلًا لَا بَأْسَ بِهِ وَكَانَتِ الْمَرْأَةُ تُرِيدُ أَنْ تَرْجِعَ إِلَيْهِ قَالَ فَأَنْزَلَ اللَّهُ هَذِهِ الْآيَةَ فَقُلْتُ «الْآنَ أَفْعَلُ يَا رَسُولَ اللَّهِ فَزَوَّجْتُهَا إِيَّاهُ» قَالَ أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِسْحَاقَ «فِي هَذَا الْحَدِيثِ دَلَالَةٌ وَاضِحَةٌ عَلَى أَنَّ اللَّهَ ﷻ جَعَلَ عَقْدَ النِّكَاحِ إِلَى الْأَوْلِيَاءِ دُونَهُنَّ وَإِنَّهُ لَيْسَ إِلَى النِّسَاءِ وَإِنْ كُنَّ ثَيِّبَاتٍ مِنَ الْعَقْدِ شَيْءُ»

    ✧ From al-Hasan regarding the saying of Allah ﷻ {So do not prevent them from remarrying their husbands} [al-Baqarah 232], he said: Ma'qil b. Yasar al-Muzani narrated to me that it was revealed concerning him. He said: I had married a sister of mine to a man, and he divorced her until when her waiting period ended, he came to propose to her. I said to him: I married you, prepared a bed for you, honored you, then you divorced her, and now you come to propose to her? No, by Allah, she will never return to you. He said: He was a man with no fault in him, and the woman wanted to return to him. He said: So Allah revealed this verse, and I said: “Now I will do it, O Messenger of Allah,” and I married her to him. Abu Bakr Muhammad b. Ishaq said: “In this hadith there is clear evidence that Allah ﷻ placed the marriage contract in the hands of the guardians, not in their hands, and that women, even if they are previously married, have no role in the contract.”

    «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ وَأَيُّمَا رَجُلَيْنِ ابْتَاعَا بَيْعًا فَهُوَ لِلْأَوَّلِ مِنْهُمَا»

    ✧ Any woman whom two guardians marry, she belongs to the first of them; and any two men who purchase a sale, it belongs to the first of them.

    «أَيُّمَا رَجُلٍ بَاعَ مِنْ رَجُلَيْنِ بَيْعًا فَهُوَ لِلْأَوَّلِ مِنْهُمَا وَأَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ»

    ✧ Whichever man sells to two men a sale, it belongs to the first of them; and whichever woman two guardians give in marriage, she belongs to the first.

    قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا نَكَحَ الْوَلِيَّانِ فَهُوَ لِلْأَوَّلِ وَإِذَا بَاعَ الْمُجِيزَانِ فَهُوَ لِلْأَوَّلِ» وَقَدْ تَابَعَ قَتَادَةُ عَلَى رِوَايَتِهِ عَنِ الْحَسَنِ أَشْعَثَ بْنَ عَبْدِ الْمَلِكِ الْحُمْرَانِيَّ

    ✧ The Messenger of Allah ﷺ said: "If two guardians contract a marriage, it belongs to the first; and if two authorizers sell, it belongs to the first." And Qatadah was followed in his narration from al-Hasan by Ash'ath ibn 'Abd al-Malik al-Humrani.

    عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا نَكَحَ الْمُجِيزَانِ فَالْأَوَّلُ أَحَقُّ» هَذِهِ الطُّرُقُ الْوَاضِحَةُ الَّتِي ذَكَرْتُهَا لِهَذَا الْمَتْنِ كُلُّهَا صَحِيحَةٌ عَلَى شَرْطِ الْبُخَارِيِّ وَلَمْ يُخَرِّجَاهُ على شرط البخاري

    ✧ From the Prophet ﷺ, he said: "If two authorizers contract a marriage, then the first has more right." These clear paths that I have mentioned for this text are all sound according to the condition of al-Bukhari, but they did not include it on the condition of al-Bukhari.

    ✧ Verily, do not go to excess in the dowers of women, for if it were a mark of honor in this world or piety before Allah, then the most deserving of it and the most entitled to it among you would be Muhammad ﷺ. He did not give as dower to any woman among his wives more than twelve uqiyyahs. And indeed one of you goes to excess in the dower of his wife until there is enmity in his heart against her, and he says, 'I have been burdened for you with the sweat of the water-skin.'

    ✧ That 'Umar ibn al-Khattab addressed the people and said: O people, do not go to excess in the dowers of women, for if it were a mark of honor, none of you would be more entitled to it or more deserving than the Prophet ﷺ. He did not give as dower to any of his wives, nor did he give as dower for any of his daughters, more than twelve uqiyyahs. And the uqiyyah is forty dirhams, so that is four hundred and eighty dirhams. And that is the most the Messenger of Allah ﷺ ever gave as dower. So I do not know of anyone who exceeded four hundred dirhams. And it has been narrated in a sound manner from 'Abdullah ibn 'Abbas from 'Umar.

    ✧ That 'Umar ibn al-Khattab stood on his pulpit, praised Allah and extolled Him, then said: Verily, do not go to excess in the dowers of women, for if it were a mark of honor in this world or piety before Allah, the most deserving of it among you would be your Prophet ﷺ. No woman among his wives or daughters was given more than twelve uqiyyahs, and that is four hundred and eighty dirhams; the uqiyyah is forty dirhams. The sound chains have become mutawatir for the authenticity of the sermon of the Commander of the Faithful 'Umar ibn al-Khattab, and this chapter I have compiled in a large volume, but they did not include it.

    أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً مِنَ الْأَنْصَارِ عَلَى ثَمَانِي أَوَاقٍ فَتَفَزَّعَ لَهَا رَسُولُ اللَّهِ ﷺ فَقَالَ «كَأَنَّمَا تَنْحِتُونَ الْفِضَّةَ مِنْ عَرَضِ هَذَا الْجَبَلِ هَلْ رَأَيْتُهَا فَإِنَّ فِي عُيُونِ الْأَنْصَارِ شَيْئًا؟» قَالَ قَدْ رَأَيْتُهَا قَالَ «مَا عِنْدَنَا شَيْءٌ وَلَكِنَّا سَنَبْعَثُكَ فِي بَعْثٍ وَأَنَا أَرْجُو أَنْ تُصِيبَ خَيْرًا» فَبَعَثَهُ فِي نَاسٍ إِلَى أُنَاسٍ مِنْ بَنِي عَبْسٍ وَأَمَرَ لَهُمُ النَّبِيُّ ﷺ بِنَاقَةٍ فَحَمَلُوا عَلَيْهَا مَتَاعَهُمْ فَلَمْ يَرْمِ إِلَّا قَلِيلًا حَتَّى بَرَكَتْ فَأَعْيَتْهُمْ أَنْ تَنْبَعِثَ فَلَمْ يَكُنْ فِي الْقَوْمِ أَصْغَرُ مِنَ الَّذِي تَزَوَّجَ فَجَاءَ إِلَى نَبِيِّ اللَّهِ ﷺ وَهُوَ مُسْتَلْقٍ فِي الْمَسْجِدِ فَقَامَ عِنْدَ رَأْسِهِ كَرَاهِيَةَ أَنْ يُوقِظَهُ فَانْتَبَهَ نَبِيُّ اللَّهِ ﷺ فَقَالَ يَا نَبِيَّ اللَّهِ إِنَّ الَّذِي أَعْطَيْتَنَا أَحْبَبْنَا أَنْ تَبْعَثَهَ فَنَاوَلَهُ النَّبِيُّ ﷺ يَمِينَهُ وَأَخَذَ رِدَاءَهُ بِشِمَالِهِ فَوَضَعَهُ عَلَى عَاتِقِهِ وَانْطَلَقَ يَمْشِي حَتَّى أَتَاهَا فَضَرَبَهَا بِبَاطِنِ قَدَمِهِ وَالَّذِي نَفْسُ أَبِي هُرَيْرَةَ بِيَدِهِ لَقَدْ كَانَتْ بَعْدَ ذَلِكَ تَسْبِقُ الْقَائِدَ وَإِنَّهُمْ نَزَلُوا بِحَضْرَةِ الْعَدُوِّ وَقَدْ أَوْقَدُوا النِّيرَانَ فَأَحَاطَ بِهِمْ فَتَفَرَّقُوا عَلَيْهِمْ وَكَبَّرُوا تَكْبِيرَةَ رَجُلٍ وَاحِدٍ وَإِنَّ اللَّهَ هَزَمَهُمْ وَأَسَرَ مِنْهُمْ

    ✧ That a man came to the Messenger of Allah ﷺ and said: I have married a woman from the Ansar for eight uqiyyahs. The Messenger of Allah ﷺ was startled by that and said: "It is as if you are carving silver from the side of this mountain. Have you seen her? For in the eyes of the Ansar there is something." He said: I have seen her. He said: "We have nothing, but we will send you on an expedition, and I hope you will obtain good." So he sent him with a group of people to some people of Banu 'Abs, and the Prophet ﷺ ordered for them a she-camel. They loaded their belongings on it, and it had not gone but a little when it knelt down and was too exhausted to get up. There was no one among the people younger than the one who had married. He came to the Prophet of Allah ﷺ while he was lying on his back in the mosque, and he stood by his head, disliking to wake him. The Prophet of Allah ﷺ woke up and said: O Prophet of Allah, the one you gave us – we would like you to rouse it. The Prophet ﷺ extended his right hand to him, took his cloak with his left hand, placed it on his shoulder, and went walking until he came to it. He struck it with the sole of his foot, and by the One in Whose hand is the soul of Abu Hurayrah, after that it would outstrip the leader. Then they camped in the presence of the enemy, and the enemy had lit fires, and they surrounded them, then they dispersed upon them and said the takbir with the takbir of one man, and Allah routed them and took captives from them.

    أَنَّهُ أَتَى النَّبِيَّ ﷺ يَسْتَعِينُهُ فِي مَهْرِ امْرَأَةٍ فَقَالَ «كَمْ أَمْهَرْتَهَا؟» فَقَالَ مِائَتَيْ دِرْهَمٍ فَقَالَ ﷺ «لَوْ كُنْتُمْ تَغْرِفُونَ مِنْ بُطْحَانَ مَا زِدْتُمْ»

    ✧ He came to the Prophet ﷺ seeking his assistance in obtaining the dowry for a woman. The Prophet ﷺ asked, "How much did you marry her for?" He replied, "Two hundred dirhams." The Prophet ﷺ then said, "If you were to scoop from the ocean, you would not increase."

    سُئِلَ رَسُولُ اللَّهِ ﷺ عَنْ قَوْلِ اللَّهِ ﷻ {وَالْقَنَاطِيرِ الْمُقَنْطَرَةِ} [آل عمران 14] قَالَ «الْقِنْطَارُ أَلْفَا أُوقِيَّةٍ»

    ✧ The Messenger of Allah ﷺ was asked about the saying of Allah ﷻ {and heaps of gold and silver} [Al 'Imran 14]. He said: "The qintar is two thousand uqiyyahs."

    مَنْ أَصَابَهُ مُصِيبَةٌ فَلْيَقُلْ إِنَّا لِلَّهِ وَإِنَّا إِلَيْهِ رَاجِعُونَ اللَّهُمَّ عِنْدَكَ أَحْتَسِبُ مُصِيبَتِي فَأْجُرْنِي فِيهَا وَأَبْدِلْنِي خَيْرًا مِنْهَا فَلَمَّا مَاتَ أَبُو سَلَمَةَ قُلْتُهَا فَجَعَلْتُ كُلَّمَا بَلَغْتُ أَبْدِلْنِي بِهَا خَيْرًا مِنْهَا قُلْتُ فِي نَفْسِي مَنْ خَيْرٌ مِنْ أَبِي سَلَمَةَ؟ ثُمَّ قُلْتُهَا فَلَمَّا انْقَضَتْ عِدَّتُهَا بَعَثَ إِلَيْهَا رَسُولُ اللَّهِ ﷺ عُمَرَ بْنَ الْخَطَّابِ يَخْطُبُهَا عَلَيْهِ فَقَالَتْ لِابْنِهَا يَا عُمَرُ قُمْ فَزَوِّجْ رَسُولَ اللَّهِ ﷺ فَزَوَّجَهُ فَكَانَ رَسُولُ اللَّهِ ﷺ يَأْتِيهَا لِيَدْخُلَ بِهَا فَإِذَا رَأَتْهُ أَخَذَتِ ابْنَتَهَا زَيْنَبَ فَجَعَلَتْهَا فِي حِجْرِهَا فَيَنْقَلِبُ رَسُولُ اللَّهِ ﷺ فَعَلِمَ بِذَلِكَ عَمَّارُ بْنُ يَاسِرٍ وَكَانَ أَخَاهَا مِنَ الرَّضَاعَةَ فَجَاءَ إِلَيْهَا فَقَالَ أَيْنَ هَذِهِ الْمَقْبُوحَةُ الْمَنْبُوحَةُ الَّتِي قَدْ آذَتْ رَسُولَ اللَّهِ ﷺ؟ فَأَخَذَهَا فَذَهَبَ بِهَا فَجَاءَ رَسُولُ اللَّهِ ﷺ فَدَخَلَ عَلَيْهَا يَضْرِبُ بِبَصَرِهِ فِي جَوَانِبِ الْبَيْتِ فَقَالَ «مَا فَعَلَتْ زُنَابُ؟» قَالَ جَاءَ عَمَّارٌ فَأَخَذَهَا فَذَهَبَ بِهَا فَبَنَى بِهَا رَسُولُ اللَّهِ ﷺ وَقَالَ «إِنِّي لَا أَنْقُصُكِ شَيْئًا مِمَّا أَعْطَيْتُ فُلَانَةً رَحَاتَيْنِ وَجَرَّتَيْنِ وَمِرْفَقَةً حَشْوُهَا لِيفٌ» وَقَالَ «إِنْ سَبَّعْتُ لَكَ سَبَّعْتُ لِنِسَائِي»

    ✧ Whoever is afflicted by a calamity should say: 'Indeed we belong to Allah, and indeed to Him we return. O Allah, with You I seek reward for my calamity, so reward me in it and give me something better in exchange.' When Abu Salamah died, I said it, and every time I reached 'give me something better in exchange,' I said to myself, 'Who is better than Abu Salamah?' Then I completed it. When her waiting period ended, the Messenger of Allah ﷺ sent Umar b. al-Khattab to propose to her on his behalf. She said to her son, 'O Umar, get up and marry the Messenger of Allah ﷺ [to me],' so he married her. Then the Messenger of Allah ﷺ used to come to her to consummate the marriage, but when she saw him she would take her daughter Zaynab and place her in her lap, so the Messenger of Allah ﷺ would leave. Ammar b. Yasir, who was her foster brother, learned of this, so he came to her and said, 'Where is this ugly, repulsive one who has annoyed the Messenger of Allah ﷺ?' He took her and went away. Then the Messenger of Allah ﷺ came, entered upon her, and looked around the corners of the house, saying, 'What happened to Zunab?' She said, 'Ammar came and took her away.' So the Messenger of Allah ﷺ consummated the marriage, and said, 'I shall not reduce anything for you from what I gave to so-and-so: two hand mills, two jars, and a cushion stuffed with palm fiber.' And he said, 'If I grant you seven nights, I would have to grant my wives seven nights too.'

    أَنَّ أَبَا طَلْحَةَ خَطَبَ أُمَّ سُلَيْمٍ فَقَالَتْ «يَا أَبَا طَلْحَةَ أَلَسْتَ تَعْلَمُ أَنَّ إِلَهَكَ الَّذِي نَعْبُدُ خَشَبَةٌ نَبَتَتْ مِنَ الْأَرْضِ نَجَرَهَا حَبَشِيُّ بَنِي فُلَانٍ إِنْ أَنْتَ أَسْلَمْتَ لَمْ أَرِدْ مِنْكَ مِنَ الصَّدَاقِ غَيْرَهُ» قَالَ حَتَّى أَنْظُرَ فِي أَمْرِي قَالَ فَذَهَبَ ثُمَّ جَاءَ فَقَالَ أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا رَسُولُ اللَّهِ قَالَتْ «يَا أَنَسُ زَوِّجْ أَبَا طَلْحَةَ»

    ✧ Abu Talhah proposed to Umm Sulaym, and she said, 'O Abu Talhah, do you not know that the god you worship is a piece of wood that grew from the earth, carved by an Abyssinian slave of Banu so-and-so? If you become Muslim, I will ask no other dowry from you.' He said, 'Let me consider my affair.' He went away, then came back and said, 'I bear witness that there is no deity but Allah, and I bear witness that Muhammad is the Messenger of Allah.' She said, 'O Anas, marry Abu Talhah.'

    أَنَّ قَوْمًا أَتَوْا عَبْدَ اللَّهِ بْنَ مَسْعُودٍ فَقَالُوا لَهُ إِنَّ رَجُلًا مِنَّا تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَجْمَعْهَا إِلَيْهِ حَتَّى مَاتَ فَقَالَ لَهُمْ عَبْدُ اللَّهِ مَا سُئِلْتُ عَنْ شَيْءٍ مُنْذُ فَارَقْتُ رَسُولَ اللَّهِ ﷺ أَشَدَّ عَلَيَّ مِنْ هَذِهِ فَأْتُوا غَيْرِي قَالُوا فَاخْتَلَفُوا إِلَيْهِ فِيهَا شَهْرًا ثُمَّ قَالُوا لَهُ فِي آخِرِ ذَلِكَ مَنْ نَسْأَلُ إِذَا لَمْ نَسْأَلْكَ وَأَنْتَ آخَيْتَ أَصْحَابَ مُحَمَّدٍ ﷺ فِي هَذَا الْبَلَدِ وَلَا نَجِدُ غَيْرَكَ فَقَالَ سَأَقُولُ فِيهَا بِجَهْدِ رَأْيِي فَإِنْ كَانَ صَوَابًا فَمِنَ اللَّهِ وَحْدَهُ لَا شَرِيكَ لَهُ وَإِنْ كَانَ خَطَأً فَمِنِّي وَاللَّهُ وَرَسُولُهُ مِنْهُ بَرِيءٌ «أَرَى أَنْ أَجْعَلَ لَهَا صَدَاقًا كَصَدَاقِ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا» قَالَ وَذَلِكَ يَسْمَعُ أُنَاسٌ مِنْ أَشْجَعَ فَقَامُوا فَقَالُوا نَشْهَدُ أَنَّكَ قَضَيْتَ بِمِثْلِ الَّذِي قَضَى بِهِ رَسُولُ اللَّهِ ﷺ فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بِرْوَعُ بِنْتُ وَاشِقٍ قَالَ فَمَا رُؤِيَ عَبْدُ اللَّهِ فَرِحَ بِشَيْءٍ مَا فَرِحَ يَوْمَئِذٍ إِلَّا بِإِسْلَامِهِ ثُمَّ قَالَ «اللَّهُمَّ إِنْ كَانَ صَوَابًا فَمِنْكَ وَحْدَكَ لَا شَرِيكَ لَكَ وَإِنْ كَانَ خَطَأً فَمِنِّي وَمِنَ الشَّيْطَانِ وَاللَّهُ وَرَسُولُهُ مِنْهُ بَرِيءٌ»

    ✧ Some people came to Abdullah b. Masud and said to him, 'A man among us married a woman but did not assign her a dowry and did not consummate the marriage, and then he died.' Abdullah said to them, 'I have not been asked about anything since I parted from the Messenger of Allah ﷺ that is harder on me than this. Ask someone else.' They kept coming back to him about it for a month. Finally they said to him, 'Whom shall we ask if we do not ask you? You are among the companions of Muhammad ﷺ in this land, and we find no one else.' He said, 'I will state my own judgment in this matter, with all my effort. If it is correct, it is from Allah alone, with no partner; if it is wrong, it is from me, and Allah and His Messenger are free of it.' [He said,] 'I hold that she should be given a dowry like that of her peers, with no reduction or excess; she has the inheritance, and upon her is the waiting period of four months and ten days.' He said, 'Some people from Ashja' heard that, and they stood up and said, 'We bear witness that you have judged as the Messenger of Allah ﷺ judged in the case of a woman of ours called Birwa' bt. Washiq.' Abdullah was never seen so overjoyed at anything as he was that day, except for his acceptance of Islam. Then he said, 'O Allah, if it is correct, it is from You alone, with no partner; if it is wrong, it is from me and from Satan, and Allah and His Messenger are free of it.'

    فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضِ لَهَا فَقَالَ لَهَا الصَّدَاقُ كَامِلًا وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَامَ مَعْقِلُ بْنُ سِنَانٍ فَقَالَ «شَهِدْتُ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ فَصَارَ الْحَدِيثُ صَحِيحًا عَلَى شَرْطِ الشَّيْخَيْنِ على شرط البخاري ومسلم

    ✧ Concerning a man who married a woman and then died without having consummated the marriage or assigned her a dowry, he [Ibn Masud] ruled that she receives the full dowry, the waiting period is upon her, and she inherits. Then Ma'qil b. Sinan stood up and said, 'I witnessed the Messenger of Allah ﷺ judge likewise in the case of Birwa' bt. Washiq.' Thus the hadith became authentic according to the conditions of the two Shaykhs, according to the conditions of al-Bukhari and Muslim.

    «مِنْ يُمْنِ الْمَرْأَةِ أَنْ يَتَيَسَّرَ خِطْبَتُهَا وَأَنْ يَتَيَسَّرَ صَدَاقُهَا وَأَنْ يَتَيَسَّرَ رَحِمُهَا» قَالَ عُرْوَةُ «يَعْنِي يَتَيَسَّرُ رَحِمُهَا لِلْوِلَادَةِ» قَالَ عُرْوَةُ وَأَنَا أَقُولُ مِنْ عِنْدِي مِنْ أَوَّلِ شُؤْمِهَا أَنْ يَكْثُرَ صَدَاقُهَا

    ✧ From the good fortune of a woman is that her proposal is easy, her dowry is easy, and her womb is easy. Urwah said, 'That is, her womb is easy for giving birth.' Urwah said, 'And I say, from my own opinion, one of the first signs of her ill fortune is that her dowry is large.'

    عَنْ صَدَاقِ النَّبِيِّ ﷺ قَالَتْ «اثْنَتَا عَشْرَةَ أُوقِيَّةً وَنَشٌّ» فَقُلْتُ مَا نَشٌّ؟ قَالَتْ نِصْفُ أُوقِيَّةٍ

    ✧ Regarding the dowry of the Prophet ﷺ, she said, 'Twelve awqiyah and a nashsh.' I asked, 'What is a nashsh?' She said, 'Half an awqiyah.'

  34. al-Mustadrak (al-Hakim) 2741Sahih

    أَنَّهَا كَانَتْ تَحْتَ عُبَيْدِ اللَّهِ بْنِ جَحْشٍ فَمَاتَ بِأَرْضِ الْحَبَشَةِ «فَزَوَّجَهَا النَّجَاشِيُّ النَّبِيَّ ﷺ وَأَمْهَرَهَا عَنْهُ أَرْبَعَةَ آلَافٍ وَبَعَثَ بِهَا إِلَى رَسُولِ اللَّهِ ﷺ مَعَ شُرَحْبِيلَ بْنِ حَسَنَةَ»

    ✧ She had been married to Ubayd Allah b. Jahsh, who died in Abyssinia. The Negus married her to the Prophet ﷺ and paid a dowry on his behalf of four thousand, and sent her to the Messenger of Allah ﷺ with Shurahbil b. Hasanah.

    أَنَّ النَّبِيَّ ﷺ قَالَ لِرَجُلٍ «أَتَرْضَى أَنْ أُزَوِّجَكَ فُلَانَةً؟» قَالَ نَعَمْ وَقَالَ لِلْمَرْأَةِ «أَتَرْضَيْنَ أَنْ أُزَوِّجَكَ فُلَانًا؟» قَالَتْ نَعَمْ فَزَوِّجْ أَحَدَهُمَا صَاحِبَهُ وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يُعْطِهَا شَيْئًا وَكَانَ مِمَّنْ شَهِدَ الْحُدَيْبِيَةَ وَكَانَ مَنْ شَهِدَ الْحُدَيْبِيَةَ لَهُ سَهْمٌ بِخَيْبَرَ فَلَمَّا حَضَرَتْهُ الْوَفَاةُ قَالَ إِنَّ رَسُولَ اللَّهِ ﷺ زَوَّجَنِي فُلَانَةً وَلَمْ أَفْرِضْ لَهَا صَدَاقًا وَلَمْ أُعْطِهَا شَيْئًا وَإِنِّي أُشْهِدُكُمْ أَنِّي أَعْطَيْتُهَا صَدَاقَهَا سَهْمِي بِخَيْبَرَ فَأَخَذَتْ سَهْمًا فَبَاعَتْهُ بِمِائَةِ أَلْفٍ قَالَ وَقَالَ رَسُولُ اللَّهِ ﷺ «خَيْرُ الصَّدَاقِ أَيْسَرُهُ»

    ✧ The Prophet ﷺ said to a man, 'Would you like me to marry you to so-and-so?' He said, 'Yes.' And he said to the woman, 'Would you like me to marry you to so-and-so?' She said, 'Yes.' So he married one of them to the other. He did not assign her a dowry, nor give her anything. The man was among those who attended al-Hudaybiyah, and whoever attended al-Hudaybiyah had a share in Khaybar. When death approached him, he said, 'The Messenger of Allah ﷺ married me to so-and-so, and I did not assign her a dowry or give her anything. I call upon you to witness that I give her my share in Khaybar as her dowry.' So she took the share and sold it for one hundred thousand. And the Messenger of Allah ﷺ said, 'The best dowry is the easiest one.'

    «إِنَّ أَعْظَمَ الذُّنُوبِ عِنْدَ اللَّهِ رَجُلٌ تَزَوَّجَ امْرَأَةً فَلَمَّا قَضَى حَاجَتَهُ مِنْهَا طَلَّقَهَا وَذَهَبَ بِمَهْرِهَا وَرَجُلٌ اسْتَعْمَلَ رَجُلًا فَذَهَبَ بِأُجْرَتِهِ وَآخَرُ يَقْتُلُ دَابَّةً عَبَثًا»

    ✧ Among the greatest sins in the sight of Allah are: a man marries a woman, and when he has satisfied his need of her, he divorces her and takes away her dowry; a man hires a worker and then withholds his wages; and another kills an animal in vain.

    أَنَّهُ عَلَّمَنَا خُطْبَةَ الْحَاجَةِ «الْحَمْدُ لِلَّهِ نَحْمَدُهُ وَنَسْتَعِينُهُ وَنَسْتَغْفِرُهُ وَنَعُوذُ بِاللَّهِ مِنْ شُرُورِ أَنْفُسِنَا مَنْ يَهْدِهِ اللَّهُ فَلَا مُضِلَّ لَهُ وَمَنْ يُضْلِلْ فَلَا هَادِيَ لَهُ وَأَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ» ثُمَّ يَقْرَأُ ثَلَاثَ آيَاتٍ {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ حَقَّ تُقَاتِهِ وَلَا تَمُوتُنَّ إِلَّا وَأَنْتُمْ مُسْلِمُونَ} [آل عمران 102] {يَا أَيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً وَاتَّقُوا اللَّهَ الَّذِي تَسَاءَلُونَ بِهِ وَالْأَرْحَامَ إِنَّ اللَّهَ كَانَ عَلَيْكُمْ رَقِيبًا} [النساء 1] {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَقُولُوا قَوْلًا سَدِيدًا يُصْلِحْ لَكُمْ أَعْمَالَكُمْ وَيَغْفِرْ لَكُمْ ذُنُوبَكُمْ وَمَنْ يُطِعِ اللَّهَ وَرَسُولَهُ فَقَدْ فَازَ فَوْزًا عَظِيمًا} [الأحزاب 71] ثُمَّ يَذْكُرُ حَاجَتَهُ سكت عنه الذهبي في التلخيص

    ✧ He taught us the sermon of need: 'Praise be to Allah, we praise Him, seek His help and His forgiveness, and seek refuge in Allah from the evils of ourselves. Whomever Allah guides, none can mislead, and whomever He misleads, none can guide. I bear witness that there is no deity but Allah, and I bear witness that Muhammad is His servant and Messenger.' Then he recited three verses: {O you who believe, fear Allah as He should be feared, and do not die except as Muslims} [Al Imran 102]; {O mankind, fear your Lord, who created you from a single soul and from it created its mate and dispersed from both of them many men and women. And fear Allah, through whom you ask one another, and the wombs. Indeed Allah is ever, over you, an Observer} [An-Nisa 1]; {O you who believe, fear Allah and speak words of appropriate justice. He will amend for you your deeds and forgive you your sins. And whoever obeys Allah and His Messenger has certainly attained a great attainment} [Al-Ahzab 71]. Then he mentioned his need. Al-Dhahabi remained silent about it in the Talkhis.

    كَانَ إِذَا رَفَّأَ الْإِنْسَانُ إِذَا تَزَوَّجَ قَالَ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ وَجَمَعَ بَيْنَكُمَا فِي خَيْرٍ»

    ✧ When he congratulated someone on marriage, he would say: 'May Allah bless you, and bless upon you, and unite you both in goodness.'

    ✧ From a man among the companions of the Messenger of Allah ﷺ from the Ansar called Basra, he said: I married a virgin woman while she was in her veil. Then I entered upon her and found her pregnant. The Prophet ﷺ said to me: “She is entitled to the dower because you deemed her private parts lawful, and the child is a slave for you. When she gives birth, flog her.”

    ✧ That he married a virgin woman and consummated the marriage with her and found her pregnant. “The Prophet ﷺ made her child a slave belonging to him and separated the two of them.”

    ✧ We escorted a woman from the Ansar to her husband. The Messenger of Allah ﷺ said: “Did you have any entertainment with you? For the Ansar love entertainment.”

    ✧ I said to Muhammad bin Hatib, "I married two women, and there was no sound in either of them," meaning the sound of a drum. So Muhammad said, the Messenger of Allah ﷺ said, "The distinction between what is permissible and what is forbidden is the sound of the drum."

    دَخَلْتُ عَلَى قَرَظَةَ بْنِ كَعْبٍ وَأَبِي مَسْعُودٍ الْأَنْصَارِيِّ فِي عُرْسٍ وَإِذَا جَوَارٍ يُغَنِّينَ فَقُلْتُ أَنْتُمْ أَصْحَابُ رَسُولِ اللَّهِ ﷺ وَأَهْلُ بَدْرٍ يُفْعَلُ هَذَا عِنْدَكُمْ؟ فَقَالَا إِنْ شِئْتَ فَأَقِمْ مَعَنَا وَإِنْ شِئْتَ فَاذْهَبْ فَإِنَّهُ رَخَّصَ لَنَا فِي اللَّهْوِ عِنْدَ الْعُرْسِ وَفِي الْبُكَاءِ عِنْدَ الْمُصِيبَةِ قَالَ شَرِيكٌ أُرَاهُ قَالَ فِي غَيْرِ نَوْحٍ سكت عنه الذهبي في التلخيص

    ✧ I entered upon Qaraza b. Ka'b and Abu Mas'ud al-Ansari at a wedding, and there were slave girls singing. I said: You are companions of the Messenger of Allah ﷺ and people of Badr, and this is done in your presence? They said: If you wish, stay with us, and if you wish, go. For he permitted us entertainment at weddings and weeping at calamity. Sharik said: I think he said: other than wailing. Al-Dhahabi remained silent about it in the Talkhis.

  46. al-Mustadrak (al-Hakim) 2753Sahih

    سَمِعَ النَّبِيُّ ﷺ نَاسًا يَتَغَنَّوْنَ فِي عُرْسٍ لَهُمْ وَأَهْدَى لَهَا كَبْشًا يُنَحْنَحْنَ فِي مِرْبَدٍ وَحُبُّكِ فِي النَّادِي وَيَعْلَمُ مَا فِي غَدِ قَالَ النَّبِيُّ ﷺ «لَا يَعْلَمُ مَا فِي غَدٍ إِلَّا اللَّهُ»

    ✧ The Prophet ﷺ heard people singing at a wedding of theirs, and he had gifted her a ram. They were reciting in a sheep pen: “And your love is in the gathering, and He knows what is tomorrow.” The Prophet ﷺ said: “No one knows what is tomorrow except Allah.”

    خَطَبَنِي رَسُولُ اللَّهِ ﷺ فَاعْتَذَرْتُ إِلَيْهِ فَعَذَرَنِي ثُمَّ أُنْزِلَ عَلَيْهِ {إِنَّا أَحْلَلْنَا لَكَ أَزْوَاجَكَ} [الأحزاب 50] الْآيَةُ فَقَالَتْ لَمْ أَكُنْ أَحِلَّ لَهُ لَمْ أُهَاجِرْ مَعَهُ وَكُنْتُ مَعَ الطُّلَقَاءِ

    ✧ The Messenger of Allah ﷺ proposed to me, and I excused myself to him, and he accepted my excuse. Then it was revealed to him: {Indeed We have made lawful to you your wives} [al-Ahzab: 50] the verse. She said: I was not lawful for him because I had not emigrated with him, and I was among the released ones.

    «جَهَّزَ رَسُولُ اللَّهِ ﷺ فَاطِمَةَ فِي خَمِيلٍ وَقِرْبَةٍ وَوِسَادَةٍ مِنْ أَدَمٍ حَشْوُهَا لِيفٌ»

    ✧ “The Messenger of Allah ﷺ equipped Fatima with a velvet garment, a water skin, and a leather cushion stuffed with palm fiber.”

    أَنْ تُسَمِّنَنِيَ لِدُخُولِي عَلَى رَسُولِ اللَّهِ ﷺ فَلَمْ أُقْبِلْ عَلَيْهَا بِشَيْءٍ مِمَّا تُرِيدُ حَتَّى أَطْعَمَتْنِي الْقِثَّاءَ وَالرُّطَبَ فَسَمِنْتُ عَلَيْهِ كَأَحْسَنِ السِّمَنِ»

    ✧ That she should fatten me for my entering upon the Messenger of Allah ﷺ. I did not respond to her with any of what she wanted until she fed me cucumber and fresh dates, and I became fat upon that, the best of fatness.”

    إِذَا أَفَادَ أَحَدُكُمُ الْجَارِيَةَ أَوِ الْمَرْأَةَ أَوِ الدَّابَّةَ فَلْيَأْخُذْ بِنَاصِيَتِهَا وَلْيَدْعُ بِالْبَرَكَةَ وَلْيَقُلِ اللَّهُمَّ إِنِّي أَسْأَلُكَ خَيْرَهَا وَخَيْرَ مَا جُبِلَتْ عَلَيْهِ وَأَعُوذُ بِكَ مِنْ شَرِّهَا وَشَرِّ مَا جُبِلَتْ عَلَيْهِ وَإِنْ كَانَ بَعِيرًا فَلْيَأْخُذْ بِذِرْوَةِ سَنَامِهِ

    ✧ When one of you acquires a slave girl, a wife, or a riding beast, let him take hold of its forelock and supplicate for blessing, and say: O Allah, I ask You for its good and the good of what it was created upon, and I seek refuge with You from its evil and the evil of what it was created upon. And if it is a camel, let him take hold of the top of its hump.

    أَنَّ عَلِيًّا أَضَافَ رَجُلًا وَصَنَعَ لَهُ طَعَامًا فَقَالَ لَوْ دَعَوْنَا رَسُولَ اللَّهِ ﷺ فَأَكَلَ مَعَنَا فَدَعَوْا رَسُولَ اللَّهِ ﷺ فَجَاءَ فَرَأَى فِرَاشًا قَدْ ضُرِبَ فِي نَاحِيَةِ الْبَيْتِ فَرَجَعَ فَقَالَتْ فَاطِمَةُ ارْجِعْ فَقُلْ لَهُ مَا رَجَعَكَ يَا رَسُولَ اللَّهِ؟ فَذَهَبَ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ لِنَبِيٍّ أَنْ يَدْخُلَ بَيْتًا مُزَوَّقًا»

    ✧ That 'Ali hosted a man and prepared food for him. He said: If only we invited the Messenger of Allah ﷺ and he ate with us. So they invited the Messenger of Allah ﷺ and he came. Then he saw a bed that had been set up in a corner of the house, so he returned. Fatima said: Go back and ask him what made you return, O Messenger of Allah? He went and the Messenger of Allah ﷺ said: “It is not for a prophet to enter a decorated house.”

    «إِذَا كَانَ عِنْدَ الرَّجُلِ امْرَأَتَانِ فَلَمْ يَعْدِلْ بَيْنَهُمَا جَاءَ يَوْمَ الْقِيَامَةِ وَشِقُّهُ سَاقِطٌ»

    ✧ «When a man has two wives and he does not treat them fairly, he will come on the Day of Resurrection with one of his sides drooping.»

    أَنَّهَا قَالَتْ لَهُ يَا ابْنَ أُخْتِي «كَانَ رَسُولُ اللَّهِ ﷺ لَا يَفْضُلُ بَعْضَنَا عَلَى بَعْضٍ فِي مُكْثِهِ عِنْدَنَا وَكَانَ قَلَّ يَوْمٌ إِلَّا وَهُوَ يَطُوفُ عَلَيْنَا فَيَدْنُو مِنْ كُلِّ امْرَأَةٍ مِنْ غَيْرِ مَسِيسٍ حَتَّى يَبْلُغَ إِلَى مَنْ هُوَ يَوْمُهَا فَيَبِيتَ عِنْدَهَا» وَلَقَدْ قَالَتْ سَوْدَةُ بِنْتُ زَمْعَةَ حِينَ أَسَنَّتْ وَفَرِقَتْ أَنْ يُفَارِقَهَا رَسُولُ اللَّهِ ﷺ يَا رَسُولَ اللَّهِ يَوْمِي هُوَ لِعَائِشَةَ فَقَبِلَ ذَلِكَ مِنْهَا رَسُولُ اللَّهِ ﷺ قَالَتْ عَائِشَةُ فِي ذَاكَ أَنْزَلَ اللَّهُ ﷻ فِيهَا وَفِي أَشْبَاهِهَا {وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا} [النساء 128]

    ✧ She said to him: O son of my sister, «The Messenger of Allah ﷺ did not favor some of us over others in the length of his stay with us, and seldom did a day pass but he would visit us, drawing near to each wife without engaging in intercourse, until he reached the one whose turn it was and spent the night with her.» And Sawdah bt. Zamʿah said when she grew old and feared that the Messenger of Allah ﷺ would separate from her: O Messenger of Allah, my day is for ʿĀʾishah. The Messenger of Allah ﷺ accepted that from her. ʿĀʾishah said: Concerning that, Allah, glorified be He, revealed about her and her likes: {And if a woman fears from her husband contempt or evasion} [al-Nisāʾ 4:128].

  54. al-Mustadrak (al-Hakim) 2761Sahih

    كَانَ رَسُولُ اللَّهِ ﷺ يَقْسِمُ فَيَعْدِلُ فَيَقُولُ «اللَّهُمَّ هَذَا قَسْمِي فِيمَا أَمْلِكُ فَلَا تَلُمْنِي فِيمَا تَمْلِكُ وَلَا أَمْلِكُ» قَالَ إِسْمَاعِيلُ الْقَاضِي «يَعْنِي الْقَلْبَ وَهَذَا فِي الْعَدْلِ بَيْنَ نِسَائِهِ»

    ✧ The Messenger of Allah ﷺ used to divide [his time] and be just, and he would say: «O Allah, this is my division in what I possess, so do not blame me for what You possess and I do not possess.» Ismāʿīl al-Qāḍī said: «He means the heart, and this is regarding justice between his wives.»

    كَانَ رَسُولُ اللَّهِ ﷺ يَسْتَأْذِنُ إِذَا كَانَ فِي يَوْمِ الْمَرْأَةِ مِنَّا بَعْدَ مَا نَزَلَ {تُرْجِي مَنْ تَشَاءُ مِنْهُنَّ وَتُؤْوِي} [الأحزاب 51] إِلَيْكَ مَنْ تَشَاءُ قَالَتْ مُعَاذَةُ فَقُلْتُ لِعَائِشَةَ مَا كُنْتُ تَقُولِينَ لِرَسُولِ اللَّهِ ﷺ؟ قَالَتْ كُنْتُ أَقُولُ إِنْ كَانَ ذَاكَ إِلَيَّ لَمْ أُوثِرْ أَحَدًا عَلَى نَفْسِي

    ✧ The Messenger of Allah ﷺ used to seek permission when it was the day of one of us, after [the verse] was revealed: {You may defer whom you will of them and receive to you whom you will} [al-Aḥzāb 33:51]. Muʿādhah said: I said to ʿĀʾishah: What did you used to say to the Messenger of Allah ﷺ? She said: I used to say: If that were up to me, I would not prefer anyone over myself.

    أَتَيْتُ الْحِيرَةَ فَرَأَيْتُهُمْ يَسْجُدُونَ لِمَرْزُبَانٍ لَهُمْ فَقُلْتُ رَسُولُ اللَّهِ ﷺ أَحَقُّ أَنْ يُسْجَدَ لَهُ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَقُلْتُ إِنِّي أَتَيْتُ الْحِيرَةَ فَرَأَيْتُهُمْ يَسْجُدُونَ لِمَرْزُبَانٍ لَهُمْ فَأَنْتَ رَسُولُ اللَّهِ ﷺ أَحَقُّ أَنْ يُسْجَدَ لَكَ قَالَ «أَرَأَيْتَ لَوْ مَرَرْتَ بِقَبْرِي أَكُنْتَ تَسْجُدُ لَهُ؟» قُلْتُ لَا قَالَ «فَلَا تَفْعَلُوا لَوْ كُنْتُ آمِرًا أَحَدًا أَنْ يَسْجُدَ لِأَحَدٍ لَأَمَرْتُ النِّسَاءَ أَنْ يَسْجُدْنَ لِأَزْوَاجِهِنَّ لَمَا جَعَلَ اللَّهُ لَهُمْ عَلَيْهِنَّ مِنْ حَقٍّ»

    ✧ I came to al-Ḥīrah and saw them prostrating to a governor of theirs. I said: The Messenger of Allah ﷺ is more worthy of being prostrated to. So I came to the Messenger of Allah ﷺ and said: I came to al-Ḥīrah and saw them prostrating to a governor of theirs, and you, Messenger of Allah ﷺ, are more worthy of being prostrated to. He said: «Tell me, if you passed by my grave, would you prostrate to it?» I said: No. He said: «Then do not do so. If I were to command anyone to prostrate to anyone, I would command women to prostrate to their husbands because of the right Allah has given them over them.»

    قُلْتُ يَا رَسُولَ اللَّهِ مَا حَقُّ زَوْجَةِ أَحَدِنَا عَلَيْهِ؟ قَالَ «أَنْ يُطْعِمَهَا إِذَا طَعِمَ وَيَكْسُوَهَا إِذَا اكْتَسَى وَلَا يَضْرِبِ الْوَجْهَ وَلَا يُقَبِّحْ وَلَا يَهْجُرْ إِلَّا فِي الْبَيْتِ»

    ✧ I said: O Messenger of Allah, what is the right of the wife of one of us upon him? He said: «That he feed her when he eats, clothe her when he dresses, not strike the face, not revile, and not abandon except within the house.»

    قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَضْرِبُوا إِمَاءَ اللَّهِ» فَجَاءَ عُمَرُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ ذَئِرْنَ النِّسَاءُ عَلَى أَزْوَاجِهِنَّ فَرَخَّصَ فِي ضَرْبِهِنَّ فَأَطَافَ بِآلِ رَسُولِ اللَّهِ ﷺ نِسَاءٌ كَثِيرٌ يَشْتَكِينَ أَزْوَاجَهُنَّ فَقَالَ النَّبِيُّ ﷺ «لَقَدْ طَافَ بِآلِ مُحَمَّدٍ ﷺ نِسَاءٌ كَثِيرٌ يَشْتَكِينَ أَزْوَاجَهُنَّ لَيْسَ أُولَائِكَ بِخِيَارِكُمْ»

    ✧ The Messenger of Allah ﷺ said: «Do not strike the maidservants of Allah.» Then ʿUmar came to the Messenger of Allah ﷺ and said: O Messenger of Allah, the women have become bold against their husbands. So he permitted striking them. Then many women went around the family of the Messenger of Allah ﷺ complaining about their husbands. The Prophet ﷺ said: «Many women have gone around the family of Muḥammad ﷺ complaining about their husbands. Those are not the best of you.»

    لَمَّا تَزَوَّجَ رَسُولُ اللَّهِ ﷺ أُمَّ سَلَمَةَ قَالَ لَهَا «إِنِّي أَهْدَيْتُ إِلَى النَّجَاشِيِّ أَوَاقِيَا مِنْ مِسْكٍ وَحُلَّةً وَإِنِّي لَا أُرَاهُ إِلَّا قَدْ مَاتَ وَلَا أَرَى الْهَدِيَّةَ الَّتِي أُهْدِيَتْ إِلَيْهِ إِلَّا سَتُرَدُّ فَإِذَا رُدَّتْ إِلَيَّ فَهُوَ لَكِ أَمْ لَكُمْ؟» فَكَانَ كَمَا قَالَ هَلَكَ النَّجَاشِيُّ فَلَمَّا رُدَّتْ إِلَيْهِ الْهَدِيَّةُ أَعْطَى كُلَّ امْرَأَةٍ مِنْ نِسَائِهِ أُوقِيَّةً مِنْ ذَلِكَ الْمِسْكِ وَأَعْطَى سَائِرَهُ أُمَّ سَلَمَةَ وَأَعْطَاهَا الْحُلَّةَ

    ✧ When the Messenger of Allah ﷺ married Umm Salamah, he said to her: «I sent to the Negus ounces of musk and a garment, and I think he has died, and I think the gift that was sent to him will be returned. When it is returned to me, it is for you—or for all of you?» It was as he said: the Negus died. When the gift was returned to him, he gave each of his wives an ounce of that musk, gave the rest to Umm Salamah, and gave her the garment.

    عَنْ نَهَارٍ الْعَبْدِيِّ وَكَانَ مِنْ أَصْحَابِ أَبِي سَعِيدٍ الْخُدْرِيِّ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ بِابْنَةٍ لَهُ فَقَالَ يَا رَسُولَ اللَّهِ هَذِهِ ابْنَتِي قَدْ أَبَتْ أَنْ تَزَوَّجَ فَقَالَ لَهَا النَّبِيُّ ﷺ «أَطِيعِي أَبَاكِ» فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ حَتَّى تُخْبِرَنِي مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ؟ قَالَ حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ أَنْ لَوْ كَانَتْ بِهِ قَرْحَةٌ فَلَحَسَتْهَا مَا أَدَّتْ حَقَّهُ

    ✧ From Nahār al-ʿAbdī, who was one of the companions of Abū Saʿīd al-Khudrī, from Abū Saʿīd al-Khudrī: A man came to the Messenger of Allah ﷺ with a daughter of his and said: O Messenger of Allah, this is my daughter; she has refused to marry. The Prophet ﷺ said to her: «Obey your father.» She said: By the One who sent you with the truth, I will not marry until you tell me what the right of the husband over his wife is. He said: The right of the husband over his wife is that if he had a wound and she licked it, she would not have fulfilled his right.

    جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ أَنَا فُلَانَةُ بِنْتُ فُلَانٍ قَالَ «قَدْ عَرَفْتُكِ فَمَا حَاجَتُكِ؟» قَالَتْ حَاجَتِي إِلَى ابْنِ عَمِّي فُلَانٍ الْعَابِدِ قَالَ رَسُولُ اللَّهِ ﷺ «قَدْ عَرَفْتُهُ» قَالَتْ يَخْطُبُنِي فَأَخْبِرْنِي مَا حَقُّ الزَّوْجِ عَلَى الزَّوْجَةِ فَإِنْ كَانَ شَيْئًا أُطِيقُهُ تَزَوَّجْتُهُ وَإِنْ لَمْ أُطِقْ لَا أَتَزَوَّجْ قَالَ مِنْ حَقِّ الزَّوْجِ عَلَى الزَّوْجَةِ أَنْ لَوْ سَالَتْ مَنْخِرَاهُ دَمًا وَقَيْحًا وَصَدِيدًا فَلَحَسَتْهُ بِلِسَانِهَا مَا أَدَّتْ حَقَّهُ لَوْ كَانَ يَنْبَغِي لِبَشَرٍ أَنْ يَسْجُدَ لِبَشَرٍ لَأَمَرْتُ الْمَرْأَةَ أَنْ تَسْجُدَ لِزَوْجِهَا إِذَا دَخَلَ عَلَيْهَا لِمَا فَضَّلَهُ اللَّهُ عَلَيْهَا قَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ مَا بَقِيَتُ فِي الدُّنْيَا

    ✧ A woman came to the Messenger of Allah ﷺ and said: O Messenger of Allah, I am so-and-so, daughter of so-and-so. He said: «I know you; what is your need?» She said: My need concerns my cousin, so-and-so the devout worshipper. The Messenger of Allah ﷺ said: «I know him.» She said: He has proposed to me. Tell me what the right of the husband over the wife is, for if it is something I can bear, I will marry him, and if I cannot bear it, I will not marry. He said: Part of the right of the husband over the wife is that if his nostrils flowed with blood, pus, and ichor, and she licked it with her tongue, she would not have fulfilled his right. If it were proper for a human being to prostrate to a human being, I would command the woman to prostrate to her husband when he enters upon her because of the excellence Allah has given him over her. She said: By the One who sent you with the truth, I will not marry as long as I remain in this world.

    أَتَيْتُ النَّبِيَّ ﷺ فِي بَعْضِ الْحَاجَةِ فَقَالَ «أَيْ هَذِهِ أَذَاتُ بَعْلٍ أَنْتِ؟» قُلْتُ نَعَمْ قَالَ «كَيْفَ أَنْتِ لَهُ؟» قَالَتْ مَا آلُوهُ إِلَّا مَا عَجَزْتُ عَنْهُ قَالَ «فَأَيْنَ أَنْتِ مِنْهُ؟ فَإِنَّمَا هُوَ جَنَّتُكِ وَنَارُكِ» هَكَذَا رَوَاهُ مَالِكُ بْنُ أَنَسٍ وَحَمَّادُ بْنُ زَيْدٍ وَالدَّرَاوَرْدِيُّ عَنْ يَحْيَى بْنِ سَعِيدٍ وَهُوَ صَحِيحٌ وَلَمْ يُخَرِّجَاهُصحيح

    ✧ I came to the Prophet ﷺ for some need, and he said: «O this one, are you married?» I said: Yes. He said: «How are you toward him?» She said: I do not fall short except in what I am unable to do. He said: «Then where are you in relation to him? For he is your Paradise and your Hell.» This is how Mālik b. Anas, Ḥammād b. Zayd, and al-Darāwardī narrated it from Yaḥyā b. Saʿīd, and it is authentic, but they did not include it.

    «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَأْذَنَ فِي بَيْتِ زَوْجِهَا وَهُوَ كَارِهٌ وَلَا تَخْرُجَ وَهُوَ كَارِهٌ وَلَا تُطِيعَ فِيهِ أَحَدًا وَلَا تَخْشَنَ بِصَدْرِهِ وَلَا تَعْتَزِلَ فِرَاشَهُ وَلَا تَضْرِبَهُ فَإِنْ كَانَ هُوَ أَظْلَمَ فَلْتَأْتِهِ حَتَّى تُرْضِيَهُ فَإِنْ كَانَ هُوَ قَبِلَ فَبِهَا وَنِعْمَتْ وَقَبِلَ اللَّهُ عُذْرَهَا وَأَفْلَحَ حُجَّتَهَا وَلَا إِثْمَ عَلَيْهِ وَإِنْ هُوَ أَبِي بِرِضَاهَا عَنْهَا فَقَدْ أَبَلَغَتْ عِنْدَ اللَّهِ عُذْرَهَا»

    ✧ «It is not lawful for a woman who believes in Allah and the Last Day to give permission in her husband's house while he is unwilling, nor to go out while he is unwilling, nor to obey anyone therein, nor to be harsh toward him, nor to abandon his bed, nor to strike him. If he is more wrong, let her come to him until she pleases him. If he accepts, then it is good and blessed, and Allah accepts her excuse and makes her argument successful, and there is no sin upon him. But if he refuses to be pleased with her, she has indeed conveyed her excuse before Allah.»

    ✧ «Allah does not look at a woman who does not thank her husband while she cannot do without him.»

    «يَا مَعْشَرَ النِّسَاءِ تَصَدَّقْنَ وَلَوْ مِنْ حُلِيِّكُنَّ فَإِنَّكُنَّ أَكْثَرُ أَهْلِ جَهَنَّمَ» فَقَالَتِ امْرَأَةٌ لَيْسَتْ مِنْ عِلْيَةِ النِّسَاءِ وَبِمَ يَا رَسُولَ اللَّهِ نَحْنُ أَكْثَرُ أَهْلِ جَهَنَّمَ؟ قَالَ «إِنَّكُنَّ تُكْثِرْنَ اللَّعْنَ وَتَكْفُرْنَ الْعَشِيرَ وَمَا وُجِدَ مِنْ نَاقِصِ الدِّينِ وَالرَّأْيِ أَغْلَبَ لِلرِّجَالِ ذَوِي الْأَمْرِ عَلَى أُمُورِهِمْ مِنَ النِّسَاءِ» قَالُوا وَمَا نَقْصُ دِينِهِنَّ وَرَأْيِهِنَّ؟ قَالَ «أَمَّا نَقْصُ رَأْيِهِنَّ فَجُعِلَتْ شَهَادَةُ امْرَأَتَيْنِ بِشَهَادَةِ رَجُلٍ وَأَمَّا نَقْصُ دِينِهِنَّ فَإِنَّ إِحْدَاهُنَّ تَقْعُدُ مَا شَاءَ اللَّهُ مِنْ يَوْمٍ وَلَيْلَةٍ لَا تَسْجُدُ لِلَّهِ سَجْدَةً»

    ✧ The Messenger of Allah ﷺ said, "O women, give in charity, even from your jewelry, for indeed you comprise the majority of the inhabitants of Hell." A woman who was not among the elite women asked, "Why are we the majority of the inhabitants of Hell, O Messenger of Allah?" He replied, "Because you curse frequently and show ingratitude towards your husbands. I have not seen anyone more deficient in intelligence and religious commitment than you. A wise man could be led astray by some of you." They asked, "O Messenger of Allah, what is the deficiency in our intelligence and religious commitment?" He said, "As for the deficiency in intelligence, the testimony of two women is equal to that of one man. As for the deficiency in religious commitment, one of you may stay without praying for many days and nights, not prostrating to Allah."

    سَمِعْتَ مِنْ رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنَّ الْفُسَّاقَ هُمْ أَهْلُ النَّارِ» قَالُوا يَا رَسُولَ اللَّهِ وَمَنِ الْفُسَّاقُ؟ قَالَ «النِّسَاءُ» قَالُوا يَا رَسُولَ اللَّهِ أَلَيْسَ أُمَّهَاتِنَا وَبَنَاتِنَا وَأَخَوَاتِنَا؟ قَالَ «بَلَى وَلَكِنَّهُنَّ إِذَا أُعْطِينَ لَمْ يَشْكُرْنَ وَإِذَا ابْتُلِينَ لَمْ يَصْبِرْنَ»

    ✧ He heard from the Messenger of Allah ﷺ, and he said: Indeed, I heard the Messenger of Allah ﷺ say: «Indeed, the wicked are the people of the Fire.» They said: O Messenger of Allah, who are the wicked? He said: «Women.» They said: O Messenger of Allah, are they not our mothers, daughters, and sisters? He said: «Yes, but when they are given, they do not give thanks, and when they are tested, they do not have patience.»

    قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَضْرِبُوا إِمَاءَ اللَّهِ» فَجَاءَ عُمَرُ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ قَدْ ذَئِرْنَ النِّسَاءُ عَلَى أَزْوَاجِهِنَّ فَأَذِنَ رَسُولُ اللَّهِ ﷺ أَنْ يَضْرِبُوهُنَّ قَالَ فَأَطَافَ بِآلِ مُحَمَّدٍ ﷺ سَبْعُونَ امْرَأَةً كُلُّهُنَّ يَشْتَكِينَ أَزْوَاجَهُنَّ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ أُولَئِكَ خِيَارُكُمْ»

    ✧ The Messenger of Allah ﷺ said: «Do not strike the female servants of Allah.» Then Umar came to the Prophet ﷺ and said: O Messenger of Allah, the women have become defiant toward their husbands. So the Messenger of Allah ﷺ permitted striking them. He said: Then seventy women surrounded the family of Muhammad ﷺ, all of them complaining about their husbands. So the Messenger of Allah ﷺ said: «Those are not the best of you.»

    ✧ About striking women. Then they complained about them to the Messenger of Allah ﷺ, so he allowed them to strike them. Then he said: Tonight seventy women surrounded the family of Muhammad ﷺ, all of them having been struck. Yahya said: And I think that al-Qasim said: Then it was said to them afterwards: «And the best of you will never strike.»

    ✧ I met my maternal uncle carrying the banner. I said: Where do you intend? He said: «The Prophet ﷺ sent me to a man who married his father's wife after him, and he ordered me to strike his neck.»

    إِنِّي لَأَطُوفُ عَلَى إِبِلٍ لِي ضَلَّتْ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَبَيْنَا أَنَا أَجُولُ فِي أَبْيَاتٍ فَإِذَا أَنَا بِرَكْبٍ وَفَوَارِسَ جَاءُوا فَأَطَافُوا فَاسْتَخْرَجُوا رَجُلًا فَمَا سَأَلُوهُ وَلَا كَلَّمُوهُ حَتَّى ضَرَبُوا عُنُقَهُ فَلَمَّا ذَهَبُوا سَأَلْتُ عَنْهُ قَالُوا عَرَّسَ بِامْرَأَةِ أَبِيهِ إسناده مليح

    ✧ I was searching for a lost camel of mine during the time of the Messenger of Allah ﷺ. While I was wandering among tents, suddenly I saw a group of riders and horsemen come and surround a man. They did not ask him or speak to him until they struck his neck. When they left, I asked about him. They said: He had consummated marriage with his father's wife. Its chain is good.

    ✧ Ghaylan b. Salamah al-Thaqafi accepted Islam while he had ten wives, and the Prophet ﷺ ordered him to take four of them. Thus the earlier companions of Sa'id narrated it: Yazid b. Zuray', Isma'il b. 'Ulayyah, Ghundar, and the leading memorizers among the people of Basra. Imam Muslim b. al-Hajjaj ruled that this hadith is one in which Ma'mar erred in Basra. If a reliable narrator outside the Basrans narrated it from him, we would judge it authentic. I found that Sufyan al-Thawri, 'Abd al-Rahman b. Muhammad al-Muharibi, and 'Isa b. Yunus—all three of them Kufans—narrated it from Ma'mar.

    ✧ Ghaylan b. Salamah al-Thaqafi accepted Islam while he had ten wives. The Messenger of Allah ﷺ commanded him to keep four and separate from the rest. My judgment leads me to the conclusion that Ma'mar b. Rashid narrated it in both ways: he sent it once and connected it once. The evidence for this is that those who connected it from him among the people of Basra also sent it. Yet connection is preferable to transmission, for the addition of a trustworthy narrator is accepted, and Allah knows best.

    ✧ A man from the people of Kufa came to 'Amr b. Shu'ayb and said, 'Aren't you amazed that al-Hasan says: The fornicator who has been flogged may marry none but a flogged woman like him?' 'Amr said, 'What amazes you about that? Sa'id al-Maqburi narrated it to us from Abu Hurayrah, from the Prophet ﷺ. And 'Abd Allah b. 'Amr used to proclaim it publicly.'

    أَنَّ رَجُلًا مِنَ الْمُسْلِمِينَ اسْتَأْذَنَ نَبِيَّ اللَّهِ ﷺ فِي امْرَأَةٍ يُقَالُ لَهَا أُمُّ مُهَرْوِلٍ كَانَتْ تُسَافِحُ وَتَشْتَرِطُ أَنْ يُنْفِقَ عَلَيْهِ وَأَنَّهُ اسْتَأْذَنَ فِيهَا نَبِيَّ اللَّهِ ﷺ وَذَكَرَ لَهُ أَمْرَهَا فَقَرَأَ نَبِيُّ اللَّهِ ﷺ {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور 3] وَنَزَلَتْ {الزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور 3]

    ✧ A man among the Muslims asked permission of the Prophet of Allah ﷺ regarding a woman called Umm Muharwil who used to commit fornication and stipulated that he would spend on her. He asked permission of the Prophet of Allah ﷺ concerning her and mentioned her situation to him. The Prophet of Allah ﷺ recited: {The fornicator marries not but a fornicatress or an idolatress} [al-Nur 3]. And it was revealed: {The fornicatress none marries her except a fornicator or an idolater} [al-Nur 3].

    ✧ The Messenger of Allah ﷺ was on a military expedition when he saw a woman who was heavily pregnant. He said, 'Perhaps her companion has had intercourse with her.' They said, 'Yes.' He said, 'I was determined to curse him with a curse that would enter the grave with him. How can he make him an heir when he is not lawful for him, and how can he employ him as a servant when he is not lawful for him?'

    ✧ Ibn 'Umar, may Allah forgive him, made a mistake. This tribe of the Ansar, who were idolaters, lived alongside this tribe of the Jews, who were People of the Book. They considered the Jews to have superiority over them, so they imitated many of their practices. Among the practices of the People of the Book was that they did not approach women except in one position, which was the most concealing for the woman. This tribe of the Ansar adopted that from them. Meanwhile, this tribe of Quraysh used to spread women in a detestable manner, deriving pleasure from them facing forward and backward and lying on their backs. When the Emigrants came to Madinah, a man among them married a woman from the Ansar and went to do with her as he was accustomed. She objected and said, 'We are only approached in one position, so do that, otherwise stay away from me.' Their matter became widely known and reached the Messenger of Allah ﷺ. Then Allah, Blessed and Exalted, revealed: {Your wives are a tilth for you, so come to your tilth as you will} [al-Baqarah 223].

    ✧ Three are from happiness and three are from misery. From happiness are: a wife whom you see and she pleases you, and when you are absent you trust her with herself and your wealth; a mount that is compliant and catches you up with your companions; and a house that is spacious and has many conveniences. From misery are: a wife whom you see and she displeases you, and she wields her tongue against you, and if you are absent from her you do not trust her with herself and your wealth; a mount that is slow, and if you beat it, it tires you, and if you ride it, it does not catch you up with your companions; and a house that is cramped and has few conveniences.

    ✧ A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have found a woman of noble lineage, rank, and wealth, except that she does not bear children. Should I marry her?" He forbade him. Then he came to him a second time and said the like of that, and he forbade him. Then he came to him a third time and said the like of that. The Messenger of Allah ﷺ said, "Marry the loving, fertile woman, for I will boast of your great numbers before the nations."

    ثَلَاثٌ يَا عَلِيُّ لَا تُؤَخِّرْهُنَّ الصَّلَاةُ إِذَا آنَتْ وَالْجَنَازَةُ إِذَا حَضَرَتْ وَالْأَيِّمُ إِذَا وَجَدَتْ كُفْؤًا

    ✧ Three things, O 'Ali, do not delay: prayer when its time comes, the funeral when it is present, and the single woman when she finds a suitable match.

    أَنَّ أَبَا حُذَيْفَةَ بْنَ عُتْبَةَ بْنِ رَبِيعَةَ بْنِ عَبْدِ شَمْسٍ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللَّهِ ﷺ تَبَنَّى سَالِمًا وَأَنْكَحَهُ بِنْتَ أَخِيهِ هِنْدَ ابْنَةَ الْوَلِيدِ بْنِ عُتْبَةَ بْنِ رَبِيعَةَ بْنِ عَبْدِ شَمْسٍ وَهُوَ مَوْلًى لِامْرَأَةٍ مِنَ الْأَنْصَارِ فَتَبَنَّاهُ كَمَا تَبَنَّى رَسُولُ اللَّهِ ﷺ زَيْدًا وَكَانَ مَنْ تَبَنَّى رَجُلًا فِي الْجَاهِلِيَّةِ دَعَاهُ النَّاسُ إِلَيْهِ وَوَرِثَ مِنْ مِيرَاثِهِ حَتَّى أَنْزَلَ اللَّهُ تَعَالَى فِي ذَلِكَ {ادْعُوهُمْ لِآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ فَإِنْ لَمْ تَعْلَمُوا آبَاءَهُمْ فَإِخْوَانُكُمْ فِي الدِّينِ وَمَوَالِيكُمْ} [الأحزاب 5] فَرَدُّوهُمْ إِلَى آبَائِهِمْ فَمَنْ لَمْ يُعْلَمْ لَهُ أَبٌ كَانَ مَوْلَاهُ أَوْ أَخَاهُ فِي الدِّينِ قَالَتْ عَائِشَةُ وَإِنَّ سَهْلَةَ بِنْتَ سُهَيْلِ بْنِ عَمْرٍو الْقُرَشِيِّ ثُمَّ الْعَامِرِيِّ وَكَانَتْ تَحْتَ أَبِي حُذَيْفَةَ بْنِ عُتْبَةَ بْنِ رَبِيعَةَ جَاءَتْ رَسُولَ اللَّهِ ﷺ حِينَ أَنْزَلَ اللَّهُ ذَلِكَ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّا كُنَّا نَرَى سَالِمًا وَلَدًا وَكَانَ رَسُولُ اللَّهِ ﷺ قَدْ آوَاهُ فَكَانَ يَأْوِي مَعَهُ وَمَعَ أَبِي حُذَيْفَةَ فِي بَيْتٍ وَاحِدٍ وَيَرَانِي وَأَنَا فَضْلٌ وَقَدْ أَنْزَلَ اللَّهُ فِيهِمْ مَا قَدْ عَلِمْتَ فَمَا تَرَى فِي شَأْنِهِ يَا رَسُولَ اللَّهِ؟ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «أَرْضِعِيهِ» فَأَرْضَعَتْهُ خَمْسَ رَضَعَاتٍ فَحُرِّمَ بِهِنَّ وَكَانَ بِمَنْزِلَةِ وَلَدِهَا مِنَ الرَّضَاعَةَ

    ✧ Abu Hudhayfa b. 'Utba b. Rabi'a b. 'Abd Shams, who was one of those who witnessed Badr with the Messenger of Allah ﷺ, adopted Salim as a son and married him to his brother's daughter, Hind bt. al-Walid b. 'Utba b. Rabi'a b. 'Abd Shams. Salim was a freedman of a woman of the Ansar. He adopted him as the Messenger of Allah ﷺ adopted Zayd. In the Jahiliyya, whoever adopted a man, people called him to that (adoptive father) and he inherited from his estate, until Allah the Exalted revealed concerning that: {Call them by their fathers; that is more just in the sight of Allah. But if you do not know their fathers, then they are your brothers in religion and your clients} [al-Ahzab 5]. So they returned them to their fathers; whoever had no known father became his client or brother in religion. 'A'isha said: Sahlah bt. Suhayl b. 'Amr al-Qurashi, then al-'Amiri, who was the wife of Abu Hudhayfa b. 'Utba b. Rabi'a, came to the Messenger of Allah ﷺ after Allah revealed that. She said, "O Messenger of Allah, we used to regard Salim as a son, and the Messenger of Allah ﷺ had given him shelter, and he stayed with him and with Abu Hudhayfa in one house, and he sees me while I am unveiled. Allah has revealed about them what you know. What is your opinion concerning his matter, O Messenger of Allah?" The Messenger of Allah ﷺ said to her, "Suckle him." So she suckled him with five sucklings, and he became forbidden by them, and he took the status of her son by suckling.

    «يَا بَنِي بَيَاضَةَ أَنْكِحُوا أَبَا هِنْدٍ وَأَنْكِحُوا إِلَيْهِ» قَالَ وَكَانَ حَجَّامًا

    ✧ "O Banu Bayada, give Abu Hind in marriage, and marry to him." He said, and he was a cupper.

    ✧ If someone whose character and religion please you comes to you, then marry him. If you do not, there will be tribulation on earth and widespread corruption.

    «إِذَا خَطَبَ أَحَدُكُمُ امْرَأَةً فَإِنِ اسْتَطَاعَ أَنْ يَنْظُرَ إِلَى بَعْضِ مَا يَدْعُوهُ إِلَى نِكَاحِهَا فَلْيَفْعَلْ» فَخَطَبْتُ امْرَأَةً مِنْ بَنِي سُلَيْمٍ فَكُنْتُ أَتَخَبَّأُ لَهَا فِي أُصُولِ النَّخْلِ حَتَّى رَأَيْتُ مِنْهَا مَا دَعَانِي إِلَى نِكَاحِهَا فَتَزَوَّجْتُهَا

    ✧ The Messenger of Allah ﷺ said: "When one of you proposes to a woman, if he is able to look at some of what invites him to marry her, then let him do so." He said: I proposed to a woman from Banu Sulaym, and I used to hide for her among the roots of palm trees until I saw from her what invited me to marry her, then I married her.

    رَسُولُ اللَّهِ ﷺ «اذْهَبْ فَانْظُرْ إِلَيْهَا فَإِنَّهُ أَحْرَى أَنْ يُؤْدَمَ بَيْنَكُمَا» قَالَ فَذَهَبَ فَنَظَرَ إِلَيْهَا فَذَكَرَ مِنْ مُوَافَقَتِهَا

    ✧ The Messenger of Allah ﷺ said: "Go and look at her, for it is more likely to create affection between you." He said: So he went and looked at her, then he mentioned her suitability.

    أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ اكْتُمِ الْخُطْبَةَ ثُمَّ تَوَضَّأْ فَأَحْسِنِ وُضُوءَكَ ثُمَّ صَلِّ مَا كَتَبَ اللَّهُ تَعَالَى لَكَ ثُمَّ احْمَدْ رَبَّكَ وَمَجِّدْهُ ثُمَّ قُلِ اللَّهُمَّ إِنَّكَ تَقْدِرُ وَلَا أَقْدِرُ وَتَعْلَمُ وَلَا أَعْلَمُ وَأَنْتَ عَلَّامُ الْغُيُوبِ فَإِنْ رَأَيْتَ لِيَ فِي فُلَانَةٍ يُسَمِّيهَا بِاسْمِهَا خَيْرًا لِي فِي دِينِي وَدُنْيَايَ وَآخِرَتِي فَاقْدُرْهَا لِي فَإِنْ كَانَ غَيْرُهَا خَيْرًا لِي فِي دِينِي وَدُنْيَايَ وَآخِرَتِي فَاقْدُرْهَا لِي

    ✧ That the Messenger of Allah ﷺ said: "Conceal the proposal, then perform ablution and do it well, then pray what Allah Most High has decreed for you, then praise your Lord and glorify Him, then say: O Allah, You have power and I have no power, and You know and I do not know, and You are the Knower of the unseen. If You see for me in so-and-so (naming her by her name) good in my religion, my worldly life, and my hereafter, then decree her for me. If someone else is better for me in my religion, my worldly life, and my hereafter, then decree her for me."

    أَنَّ النَّبِيَّ ﷺ أَرَادَ أَنْ يَتَزَوَّجَ امْرَأَةً فَبَعَثَ امْرَأَةً لِتَنْظُرَ إِلَيْهَا فَقَالَ «شُمِّي عَوَارِضَهَا وَانْظُرِي إِلَى عُرْقُوبَيْهَا» قَالَ فَجَاءَتْ إِلَيْهِمْ فَقَالُوا أَلَا نُغَدِّيكِ يَا أُمَّ فُلَانٍ؟ فَقَالَتْ لَا آكُلُ إِلَّا مِنْ طَعَامٍ جَاءَتْ بِهِ فُلَانَةٌ قَالَ فَصَعِدْتُ فِي رَفٍّ لَهُمْ فَنَظَرَتْ إِلَى عُرْقُوبَيْهَا ثُمَّ قَالَتْ أَفْلِينِي يَا بُنَيَّةُ قَالَ فَجَعَلَتْ تُفْلِيهَا وَهِيَ تَشُمُّ عَوَارِضَهَا قَالَ فَجَاءَتْ فَأَخْبَرَتْ

    ✧ That the Prophet ﷺ wanted to marry a woman, so he sent a woman to look at her. He said: "Smell her molars and look at her Achilles tendons." He said: So she came to them, and they said: "Shall we not feed you, O Umm so-and-so?" She said: "I will not eat except from food brought by so-and-so." He said: So I climbed onto a shelf of theirs and looked at her Achilles tendons, then she said: "Comb my hair, O my little daughter." He said: So she began to comb her hair while smelling her molars. He said: Then she came and reported.

    «أَلَا لَا يَنْكِحِ الزَّانِي الْمَجْلُودُ إِلَّا مِثْلَهُ»

    ✧ The Messenger of Allah ﷺ said: "Indeed, the fornicator who has been flogged should not marry except one like him."

  115. al-Mustadrak (al-Hakim) 2701Sahih

    فَجِئْتُ إِلَى النَّبِيِّ ﷺ فَقُلْتُ يَا رَسُولَ اللَّهِ أَنْكِحُ عَنَاقَ؟ قَالَ فَسَكَتَ عَنِّي فَنَزَلَتْ {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور 3] فَقَرَأَ عَلَيَّ رَسُولُ اللَّهِ ﷺ وَقَالَ «لَا تَنْكِحْهَا»

    ✧ I came to the Prophet ﷺ and said: "O Messenger of Allah, should I marry 'Anaq?" He said: He was silent, then it was revealed: "The fornicator does not marry except a fornicatress or an idolatress, and the fornicatress does not marry except a fornicator or an idolater, and that has been made forbidden to the believers" [Quran 24:3]. The Messenger of Allah ﷺ recited it to me and said: "Do not marry her."

    «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ رِضَاهَا وَإِنْ كَرِهَتْ فَلَا كُرْهَ عَلَيْهَا»

    ✧ The Prophet ﷺ heard saying, "The orphan girl is consulted regarding herself. If she remains silent, it is her consent. And if she disagrees, no compulsion is on her."

    فَذَهَبَتْ أُمُّهَا إِلَى النَّبِيِّ ﷺ فَقَالَتْ إِنَّ ابْنَتِي تَكْرَهُ وَاللَّهِ فَأَمَرَهُ رَسُولُ اللَّهِ ﷺ أَنْ يُفَارِقَهَا فَفَارَقَهَا وَقَالَ «لَا تَنْكِحُوا النِّسَاءَ حَتَّى تَسْتَأْمِرُوهُنَّ فَإِذَا سَكَتْنَ فَهُوَ إِذْنُهُنَّ» فَتَزَوَّجَهَا بَعْدَهُ الْمُغِيرَةُ بْنُ شُعْبَةَ

    ✧ Her mother went to the Prophet ﷺ and said: "My daughter dislikes him, by Allah." So the Messenger of Allah ﷺ ordered him to separate from her, and he separated from her, and he said: "Do not marry women until you seek their consent, and if they remain silent, that is their permission." Afterwards, al-Mughira b. Shu'ba married her.

    خَوْلَةُ بِنْتُ حَكِيمِ بْنِ أُمَيَّةَ بْنِ الْأَوْقَصِ امْرَأَةُ عُثْمَانَ بْنِ مَظْعُونٍ وَذَلِكَ بِمَكَّةَ أَيْ رَسُولَ اللَّهِ أَلَا تَزَوَّجُ؟ قَالَ «وَمَنْ؟» قَالَتْ إِنْ شِئْتَ بِكْرًا وَإِنْ شِئْتَ ثَيِّبًا قَالَ «وَمَنِ الْبِكْرُ؟» قَالَتِ ابْنَةُ أَحَبِّ خَلْقِ اللَّهِ إِلَيْكَ عَائِشَةُ بِنْتُ أَبِي بَكْرٍ قَالَ «وَمَنِ الثَّيِّبُ؟» قَالَتْ سَوْدَةُ بِنْتُ زَمْعَةَ بْنِ قَيْسٍ قَدْ آمَنَتْ بِكَ وَاتَّبَعَتْكَ عَلَى مَا أَنْتَ عَلَيْهِ قَالَ فَاذْهَبِي فَاذْكُرِيهِمَا فَجَاءَتْ فَدَخَلَتْ بَيْتَ أَبِي بَكْرٍ فَقَالَتْ يَا أَبَا بَكْرٍ مَاذَا أَدْخَلَ اللَّهُ عَلَيْكَ مِنَ الْخَيْرِ وَالْبَرَكَةِ أَرْسَلَنِي رَسُولُ اللَّهِ ﷺ أَخْطُبُ عَلَيْهِ عَائِشَةَ قَالَ ادْعِي لِي رَسُولَ اللَّهِ ﷺ فَدَعَتْهُ فَجَاءَ فَأَنْكَحَهُ وَهِيَ يَوْمَئِذٍ ابْنَةُ سَبْعِ سِنِينَ

    ✧ Khawla bt. Hakim b. Umayya b. al-Awqas, the wife of 'Uthman b. Maz'un, and that was in Makkah: she said: "O Messenger of Allah, will you not marry?" He said: "Who?" She said: "If you wish, a virgin; and if you wish, a previously married woman." He said: "Who is the virgin?" She said: "The daughter of the most beloved of Allah's creation to you, 'A'isha bt. Abi Bakr." He said: "Who is the previously married woman?" She said: "Sawda bt. Zam'a b. Qays, who has believed in you and followed you in what you are upon." He said: "Go and mention them." So she came and entered the house of Abu Bakr and said: "O Abu Bakr, what good and blessing has Allah brought upon you! The Messenger of Allah ﷺ sent me to propose 'A'isha on his behalf." He said: "Call the Messenger of Allah ﷺ for me." So she called him, and he came and married her, and she was at that time a girl of seven years.

    رَسُولُ اللَّهِ ﷺ «إِنَّهَا صَغِيرَةٌ» فَخَطَبَهَا عَلِيٌّ فَزَوَّجَهَا

    «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَهَا وَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»

    ✧ The Messenger of Allah ﷺ said: "Any woman married without the consent of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If he has consummated with her, she is entitled to her dowry for what he has consummated. If they dispute, then the ruler is the guardian of the one who has no guardian."
