22. Divorce

  1. al-Mustadrak (al-Hakim) 2841Sahih

    «مَنْ أَعْتَقَ رَقَبَةً فَكَّ اللَّهُ بِكُلِّ عُضْوٍ مِنْ أَعْضَائِهِ عُضْوًا مِنْ أَعْضَائِهِ مِنَ النَّارِ»

    ✧ Whoever frees a slave, Allah will free from the Fire for every limb of his a limb of his.

  2. al-Mustadrak (al-Hakim) 2842Abu Dawud silent

    «مَنْ أَعْتَقَ رَقَبَةً أَوْ عَبْدًا كَانَتْ فِكَاكَهُ مِنَ النَّارِ عُضْوًا بِعُضْوٍ»

    ✧ Whoever frees a slave or a servant, it will be his ransom from the Fire, limb for limb.

    حَدِّثْنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللَّهِ ﷺ لَيْسَ فِيهِ زِيَادَةٌ وَلَا نُقْصَانُ فَغَضِبَ وَقَالَ إِنَّ مُصْحَفَ أَحَدِكُمْ مُعَلَّقٌ فِي بَيْتِهِ وَهُوَ يَزِيدُ وَيَنْقُصُ قَالَ فَقُلْنَا لَيْسَ هَذَا أَرَدْنَا أَرَدْنَا أَنْ تُحَدِّثَنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللَّهِ ﷺ قَالَ أَتَيْنَا رَسُولَ اللَّهِ ﷺ فِي صَاحِبٍ لَنَا قَدْ أَوْجَبَ يَعْنِي النَّارَ فَقَالَ «أَعْتِقُوا عَنْهُ يُعْتِقْ اللَّهُ بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنْهُ مِنَ النَّارِ» عَرِيفٌ هَذَا لَقَبٌ لِعَبْدِ اللَّهِ بْنِ الدَّيْلَمِيِّ صحيح

    ✧ Narrate to us a hadith you heard from the Messenger of Allah ﷺ with no addition or omission. He became angry and said: 'One of you has his mushaf hanging in his house, and he adds and omits.' We said: 'We did not mean that; we meant that you narrate to us a hadith you heard from the Messenger of Allah ﷺ.' He said: 'We came to the Messenger of Allah ﷺ regarding a companion of ours who had obligated (i.e., earned) the Fire. He said: "Free on his behalf; Allah will free from the Fire for every limb of his a limb of his."' Arif—this is a nickname for Abdullah b. al-Daylami. Sahih.

    حَدَّثَنِي هَذَا الشَّيْخُ يَعْنِي وَاثِلَةَ قُلْتُ مَا حَدَّثَكَ؟ فَقَالَ حَدَّثَنِي كُنْتُ جَالِسًا مَعَ رَسُولِ اللَّهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَأَتَاهُ نَفَرٌ مِنْ بَنِي سُلَيْمٍ فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ صَاحِبَنَا قَدْ أَوْجَبَ قَالَ رَسُولُ اللَّهِ ﷺ «أَعْتِقُوا عَنْهُ يُعْتِقِ اللَّهُ بِكُلِّ عُضْوٍ مِنْهَا عُضْوًا مِنْهُ مِنَ النَّارِ» فَصَارَ حَدِيثُ وَاثِلَةَ بِهَذِهِ الرِّوَايَاتِ صَحِيحًا عَلَى شَرْطِ الشَّيْخَيْنِ وَقَدْ أَخْرَجَ مُسْلِمٌ مِنْ حَدِيثِ أَبِي هُرَيْرَةَ لَفْظَهُ فِي عِتْقِ امْرِئٍ مُسْلِمٍ امْرَءًا مُسْلِمًا صحيح

    ✧ This old man—meaning Wathilah—narrated to me. I said: 'What did he narrate to you?' He said: 'He narrated to me: I was sitting with the Messenger of Allah ﷺ during the expedition of Tabuk, when a group from Banu Sulaym came to him and said: "O Messenger of Allah, our companion has obligated (the Fire)." The Messenger of Allah ﷺ said: "Free on his behalf; Allah will free from the Fire, for every limb of his, a limb of his."' Thus the hadith of Wathilah is sahih according to the criteria of the two shaykhs through these narrations. Muslim has already reported its wording from the hadith of Abu Hurayrah regarding a Muslim man freeing a Muslim man. Sahih.

    ✧ Whoever frees a Muslim will have his ransom from the Fire, for every limb of this one a limb of that one.

    أَوْصَى إِلَيَّ أَخِي بِطَائِفَةٍ مِنْ مَالِهِ فَلَقِيتُ أَبَا الدَّرْدَاءِ فَقُلْتُ إِنَّ أَخِي قَدْ أَوْصَى إِلَيَّ بِطَائِفَةٍ مِنْ مَالِهِ فَأَيْنَ أَضَعُهُ؟ فِي الْفُقَرَاءِ أَوِ الْمَسَاكِينِ أَوِ الْمُهَاجِرِينَ؟ فَقَالَ أَمَّا أَنَا فَلَوْ كُنْتُ لَمْ أَعْدِلْ بِالْمُجَاهِدِينَ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ «مَثَلُ الَّذِي يُعْتِقُ عِنْدَ الْمَوْتِ كَمَثَلِ الَّذِي يُهْدِي إِذَا شَبِعَ»

    ✧ My brother bequeathed to me a portion of his wealth, so I met Abu al-Darda' and said: My brother has bequeathed to me a portion of his wealth, so where should I put it? Among the poor, the needy, or the emigrants? He said: As for me, if I were in your place, I would not overlook the mujahidin, for I heard the Messenger of Allah ﷺ say: 'The likeness of one who frees a slave at the time of death is like the likeness of one who gives a gift when he is full.'

    أَعْتَقْتُ جَارِيَةً لِي فَدَخَلَ عَلَيَّ النَّبِيُّ ﷺ فَأَخْبَرْتُهُ بِعِتْقِهَا فَقَالَ «أَمَا إِنَّكِ لَوْ كُنْتِ أَعْطَيْتِهَا أَخْوَالَكِ كَانَ أَعْظَمَ لِأَجْرِكِ»

    ✧ I freed a slave-girl of mine, and the Prophet ﷺ came in to me, so I informed him of her emancipation. He said: 'If you had given her to your maternal uncles, it would have been greater for your reward.'

    أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لِأَبِي بَكْرٍ الصِّدِّيقِ وَكَانَ سَعْدٌ مَمْلُوكًا لَهُ وَكَانَ رَسُولُ اللَّهِ ﷺ يُعْجِبُهُ خِدْمَتُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «يَا أَبَا بَكْرٍ أَعْتِقْ سَعْدًا» فَقَالَ يَا رَسُولَ اللَّهِ مَا لَنَا غَيْرُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَتَتْكَ الرِّجَالُ أَتَتْكَ الرِّجَالُ»

    ✧ That the Messenger of Allah ﷺ said to Abu Bakr al-Siddiq, while Sa'd was a slave belonging to him and the Messenger of Allah ﷺ was pleased with his service: 'O Abu Bakr, free Sa'd.' He said: O Messenger of Allah, we have no one besides him. The Messenger of Allah ﷺ said: 'The men are coming to you, the men are coming to you.'

  9. al-Mustadrak (al-Hakim) 2849Sahih

    لِي أُمُّ سَلَمَةَ أُعْتِقُكَ وَأَشْتَرِطُ عَلَيْكَ أَنْ تَخْدُمَ رَسُولَ اللَّهِ ﷺ مَا عِشْتَ قَالَ قُلْتُ «لَوْ أَنَّكِ لَمْ تَشْتَرِطِي عَلَيَّ مَا فَارَقْتُ رَسُولَ اللَّهِ ﷺ مَا عِشْتُ» قَالَ «فَأَعْتَقَتْنِي وَاشْتَرَطَتْ عَلَيَّ أَنْ أَخْدُمَ رَسُولَ اللَّهِ ﷺ مَا عِشْتُ»

    ✧ Umm Salamah said to me: I will free you, but I stipulate that you serve the Messenger of Allah ﷺ as long as you live. He (the narrator) said: I said: 'Even if you did not stipulate it, I would not part from the Messenger of Allah ﷺ as long as I live.' He said: 'So she freed me and stipulated that I serve the Messenger of Allah ﷺ as long as I live.'

  10. al-Mustadrak (al-Hakim) 2850Sahih

    قَالَ رَجُلٌ أَعْتِقُ عَنِ ابْنِي يَا رَسُولَ اللَّهِ؟ قَالَ «نَعَمْ»

    ✧ A man said: Should I free a slave on behalf of my son, O Messenger of Allah? He said: 'Yes.'

    «مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ حُرٌّ»

    ✧ Whoever owns a forbidden blood relative, he is free.

    «مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ حُرٌّ»

    ✧ Whoever owns a forbidden blood relative, he is free.

    «وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ» قَالَ أَبُو هُرَيْرَةَ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ أَنْ أُعْتِقَ وَلَدَ زِنْيَةٍ»

    ✧ 'The child of adultery is the worst of the three.' Abu Hurayrah said: 'To be provided with a whip in the way of Allah is more beloved to me than to free a child of adultery.'

    أَنَّ أَبَا هُرَيْرَةَ يَقُولُ إِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا» وَإِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ» «وَإِنَّ الْمَيِّتَ يُعَذَّبُ بِبُكَاءِ الْحَيِّ» فَقَالَتْ عَائِشَةُ رَحِمَ اللَّهُ أَبَا هُرَيْرَةَ أَسَاءَ سَمْعًا فَأَسَاءَ إِصَابَةً أَمَّا قَوْلُهُ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا» أَنَّهَا لَمَّا نَزَلَتْ {فَلَا اقْتَحَمَ الْعَقَبَةَ وَمَا أَدْرَاكَ مَا الْعَقَبَةُ} [البلد 12] قِيلَ يَا رَسُولَ اللَّهِ مَا عِنْدَنَا مَا نُعْتِقُ إِلَّا أَنَّ أَحَدَنَا لَهُ جَارِيَةٌ سَوْدَاءُ تَخْدُمُهُ وَتَسْعَى عَلَيْهِ فَلَوْ أَمَرْنَاهُنَّ فَزَنَيْنَ فَجِئْنَ بِالْأَوْلَادِ فَأَعْتَقْنَاهُمْ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَأَنْ أُمَتَّعْ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ آمُرَ بِالزِّنَا ثُمَّ أُعْتِقَ الْوَلَدَ» سلمة لم يحتج به مسلم وقد وثق وضعفه ابن راهويه

    ✧ That Abu Hurayrah said: The Messenger of Allah ﷺ said: 'To be provided with a whip in the way of Allah is more beloved to me than to free a child of adultery,' and the Messenger of Allah ﷺ said: 'The child of adultery is the worst of the three,' and 'The dead is punished by the weeping of the living.' A'ishah said: May Allah have mercy on Abu Hurayrah; he heard wrongly and thus erred. As for his saying, 'To be provided with a whip in the way of Allah is more beloved to me than to free a child of adultery,' when the verse descended: 'But he has not attempted the steep path. And what can make you know what is the steep path?' (al-Balad 11-12), it was said: O Messenger of Allah, we have nothing to free except that one of us has a black slave-girl who serves him and works for him. If we commanded them to commit adultery and then they brought children, we would free them. The Messenger of Allah ﷺ said: 'To be provided with a whip in the way of Allah is more beloved to me than to command adultery and then free the child.' Salamah: Muslim did not use him as evidence; he was considered trustworthy but weakened by Ibn Rahawayh.

    جَاءَتْ جَارِيَةٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَتْ إِنَّ سَيِّدِي اتَّهَمَنِي فَأَقْعَدَنِي عَلَى النَّارِ حَتَّى احْتَرَقَ فَرْجِي فَقَالَ لَهَا عُمَرُ هَلْ رَأَى ذَلِكَ عَلَيْكِ؟ قَالَتْ لَا قَالَ فَهَلِ اعْتَرَفْتِ لَهُ بِشَيْءٍ؟ قَالَتْ لَا فَقَالَ عُمَرُ عَلَيَّ بِهِ فَلَمَّا رَأَى عُمَرُ الرَّجُلَ قَالَ أَتُعَذِّبُ بِعَذَابِ اللَّهِ؟ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اتَّهَمْتُهَا فِي نَفْسِي قَالَ رَأَيْتَ ذَلِكَ عَلَيْهَا؟ قَالَ الرَّجُلُ لَا قَالَ فَاعْتَرَفَتْ بِهِ؟ قَالَ لَا قَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ لَمْ أَسْمَعْ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُقَادُ مَمْلُوكٌ مِنْ مَالِكِهِ وَلَا وَالِدٌ مِنْ وَلَدِهِ» لَأَقَدْتُهَا مِنْكَ فَبَرَّزَهُ وَضَرَبَهُ مِائَةَ سَوْطٍ وَقَالَ لِلْجَارِيَةِ اذْهَبِي فَأَنْتِ حُرَّةٌ لِوَجْهِ اللَّهِ أَنْتِ مَوْلَاةُ اللَّهِ وَرَسُولِهِ

    ✧ A slave-girl came to Umar b. al-Khattab and said: My master accused me, so he made me sit on a fire until my private part burned. Umar said to her: Did he see that from you? She said: No. He said: Did you confess to him about anything? She said: No. Umar said: Bring him to me. When Umar saw the man, he said: Do you punish with the punishment of Allah? He said: O Commander of the Faithful, I suspected her in my mind. He said: Did you see that from her? The man said: No. He said: Did she confess to it? He said: No. He said: By the One in whose hand is my soul, had I not heard the Messenger of Allah ﷺ say: 'A slave is not to be retaliated against by his master, nor a parent by his child,' I would have retaliated against you from her. Then he brought him out and flogged him with a hundred lashes, and said to the slave-girl: Go, for you are free for the sake of Allah; you are the freedwoman of Allah and His Messenger.

    أَنَّ سَبْيًا مِنْ خَوْلَانَ قَدِمَ وَكَانَ عَلَى عَائِشَةَ رَقَبَةٌ مِنْ وَلَدِ إِسْمَاعِيلَ فَقَدِمَ سَبْيٌ مِنَ الْيَمَنِ فَأَرَادَتْ أَنْ تُعْتِقَ مِنْهُمْ «فَنَهَاهَا النَّبِيُّ ﷺ» فَقَدِمَ سَبْيٌ مِنْ مُضَرَ أَحْسِبُهُ قَالَ مِنْ بَنِي الْعَنْبَرِ «فَأَمَرَهَا أَنْ تُعْتِقَ» تَابَعَهُ شُعْبَةُ عَنْ عُبَيْدِ بْنِ الْحَسَنِالحديث صحيح

    ✧ A group of captives from Khawlan arrived, and ‘A’ishah had an obligation to free a slave from the descendants of Isma‘il. Then captives from Yemen arrived, and she wanted to free one of them, but the Prophet ﷺ forbade her. Then captives from Mudar arrived – I think he said from Banu al-‘Anbar – and he commanded her to free one. Shu‘bah concurred with him, from ‘Ubayd b. al-Hasan. The hadith is authentic.

    كَانَ عَلَى عَائِشَةَ مُحَرَّرٌ مِنْ وَلَدِ إِسْمَاعِيلَ فَأُتِيَ رَسُولُ اللَّهِ ﷺ بِسَبْيٍ مِنْ بَنِي الْعَنْبَرِ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «أَعْتِقِي مِنْ بَنِي الْعَنْبَرِ أَوْ مِنْ بَنِي لِحْيَانَ وَلَا تَعْتِقِي مِنْ بَنِي الْخَوْلَانِ»

    ✧ ‘A’ishah had an obligation to free a slave from the descendants of Isma‘il. Captives from Banu al-‘Anbar were brought to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said to her: “Free one from Banu al-‘Anbar or from Banu Lihyan, but do not free one from Banu al-Khawlan.”

    أَنَّ ثَلَاثًا كُنَّ يُرْدَدْنَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ إِلَى وَاحِدَةٍ قَالَ «نَعَمْ»

    ✧ Three pronouncements of divorce were referred back to one during the time of the Messenger of Allah ﷺ. He said, 'Yes.'

  20. al-Mustadrak (al-Hakim) 2793Sahih

    «كَانَ الطَّلَاقُ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ وَأَبِي بَكْرٍ وَسَنَتَيْنِ مِنْ خِلَافَةِ عُمَرَ طَلَاقُ الثَّلَاثِ وَاحِدَةٌ» فَقَالَ عُمَرُ «إِنَّ النَّاسَ قَدِ اسْتَعْجَلُوا فِي أَمْرٍ كَانَتْ لَهُمْ فِيهِ أَنَاةٌ فَلَوْ أَمْضَيْنَاهُ عَلَيْهِمْ فَأَمْضَاهُ عَلَيْهِمْ»

    ✧ Divorce during the time of the Messenger of Allah ﷺ, Abu Bakr, and the first two years of 'Umar's caliphate: a threefold divorce counted as one. Then 'Umar said, 'People have become hasty in a matter in which they had been given respite. If only we could enforce it upon them.' So he enforced it upon them.

  21. al-Mustadrak (al-Hakim) 2794Sahih

    «مَا أَحَلَّ اللَّهُ شَيْئًا أَبْغَضَ إِلَيْهِ مِنَ الطَّلَاقِ»

    ✧ Allah has not made anything lawful more hateful to Him than divorce.

  22. al-Mustadrak (al-Hakim) 2795Sahih

    «لَيْسَ مِنَّا مَنْ خَبَّبَ امْرَأَةً عَلَى زَوْجِهَا أَوْ عَبْدًا عَلَى سَيِّدِهِ»

    ✧ He is not one of us who corrupts a wife against her husband or a slave against his master.

  23. al-Mustadrak (al-Hakim) 2796Sahih

    «لَمَّا طَلَّقَ النَّبِيُّ ﷺ حَفْصَةَ أُمِرَ أَنْ يُرَاجِعَهَا فَرَاجَعَهَا»

    ✧ When the Prophet ﷺ divorced Hafsah, he was commanded to take her back, so he took her back.

    «أَنَّ رَسُولَ اللَّهِ ﷺ طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا»

    ✧ The Messenger of Allah ﷺ divorced Hafsah, then took her back.

  25. al-Mustadrak (al-Hakim) 2798Sahih

    كَانَتْ تَحْتِي امْرَأَةٌ أُحِبُّهَا وَكَانَ عُمَرُ يَكْرَهُهَا فَقَالَ عُمَرُ طَلِّقْهَا فَأَبَيْتُ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَطِعْ أَبَاكَ وَطَلِّقْهَا» فَطَلَّقْتُهَا

    ✧ I had a wife whom I loved, and Umar disliked her. Umar said: Divorce her. I refused. He mentioned that to the Prophet ﷺ, who said: 'Obey your father and divorce her.' So I divorced her.

    أَنَّ رَجُلًا أَتَى أَبَا الدَّرْدَاءِ فَقَالَ إِنَّ أُمِّي لَمْ تَزَلْ بِي حَتَّى تَزَوَّجْتُ وَإِنَّهَا تَأْمُرُنِي بِطَلَاقِهَا وَقَدْ أَبَتْ عَلَيَّ إِلَّا ذَاكَ فَقَالَ مَا أَنَا بِالَّذِي آمُرُكَ أَنْ تَعُقَّ وَالِدَتَكَ وَلَا أَنَا الَّذِي آمُرُكَ أَنْ تُطَلِّقَ امْرَأَتَكَ غَيْرَ أَنَّكَ إِنْ شِئْتَ حَدَّثْتُكَ بِمَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ يَقُولُ «الْوَالِدُ أَوْسَطُ أَبْوَابِ الْجَنَّةِ فَحَافِظْ عَلَى ذَلِكَ الْبَابِ إِنْ شِئْتَ أَوْ أَضِعْهُ»

    ✧ A man came to Abu al-Darda' and said: My mother kept pressing me until I married, and now she orders me to divorce her, insisting on that. He said: I am not the one to command you to disobey your mother, nor am I the one to command you to divorce your wife. But if you wish, I will tell you what I heard from the Messenger of Allah ﷺ say: 'The parent is the middle gate of Paradise, so preserve that gate if you wish or lose it.'

    «ثَلَاثٌ جِدُّهُنَّ جِدٌّ وَهَزْلُهُنَّ جِدٌّ النِّكَاحُ وَالطَّلَاقُ وَالرَّجْعَةُ»

    ✧ Three matters in which seriousness is serious and jest is serious: marriage, divorce, and taking back.

    ✧ The Messenger of Allah ﷺ said: 'Shall I not tell you about the borrowed billy goat?' They said: Yes, O Messenger of Allah. He said: 'He is the one who makes lawful. Allah cursed the one who makes lawful and the one for whom it is made lawful.' Then the Messenger of Allah ﷺ said: 'Allah cursed the one who makes lawful and the one for whom it is made lawful.'

    ✧ About a man who divorced his wife three times, then his brother married her without his instigation to make her lawful for his brother—does she become lawful for the first? He said: 'No. Marriage is out of desire. We used to consider this fornication at the time of the Messenger of Allah ﷺ.'

    أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ قَالَ فَسَأَلْتُ النَّبِيَّ ﷺ عَنْ ذَلِكَ فَقَالَ «مَا أَرَدْتَ بِذَلِكَ؟» قَالَ أَرَدْتُ بِهِ وَاحِدَةً قَالَ «آللَّهِ؟» قَالَ اللَّهِ قَالَ «فَهُوَ مَا أَرَدْتَ»

    ✧ He divorced his wife irrevocably during the time of the Messenger of Allah ﷺ. He said: I asked the Prophet ﷺ about that, and he said: 'What did you intend by that?' He said: I intended one divorce. He said: 'By Allah?' He said: By Allah. He said: 'It is as you intended.'

    أَنَّ رُكَانَةَ بْنَ عَبْدِ يَزِيدَ طَلَّقَ امْرَأَتَهُ سُهَيْمَةَ الْبَتَّةَ ثُمَّ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنِّي طَلَّقْتُ امْرَأَتِي سُهَيْمَةَ الْبَتَّةَ وَوَاللَّهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً «فَرَدَّهَا إِلَيْهِ رَسُولُ اللَّهِ ﷺ» فَطَلَّقَهَا الثَّانِيَةَ فِي زَمَنِ عُمَرَ وَالثَّالِثَةَ فِي زَمَنِ عُثْمَانَ «قَدْ صَحَّ الْحَدِيثُ بِهَذِهِ الرِّوَايَةِ فَإِنَّ الْإِمَامَ الشَّافِعِيَّ قَدْ أَتْقَنَهُ وَحَفِظَهُ عَنْ أَهْلِ بَيْتِهِ وَالسَّائِبُ بْنُ عَبْدِ يَزِيدَ أَبُو الشَّافِعِ بْنُ السَّائِبِ وَهُوَ أَخُو رُكَانَةَ بْنِ عَبْدِ يَزِيدَ وَمُحَمَّدُ بْنُ عَلِيِّ بْنِ شَافِعٍ عَمُّ الشَّافِعِيِّ شَيْخُ قُرَيْشٍ فِي عَصْرِهِ» سكت عنه الذهبي في التلخيص

    ✧ That Rukana b. 'Abd Yazid divorced his wife Suhayma with an irrevocable divorce. Then he came to the Messenger of Allah ﷺ and said, 'I have divorced my wife Suhayma with an irrevocable divorce. By Allah, I only intended one.' So the Messenger of Allah ﷺ returned her to him. Then he divorced her a second time during the time of 'Umar and a third time during the time of 'Uthman. The hadith is authentic by this narration, for Imam al-Shafi'i mastered it and preserved it from his family. And al-Sa'ib b. 'Abd Yazid is Abu al-Shafi' b. al-Sa'ib, and he is the brother of Rukana b. 'Abd Yazid. And Muhammad b. 'Ali b. Shafi', the paternal uncle of al-Shafi'i, was the shaykh of Quraysh in his time. Al-Dhahabi remained silent about it in the Talkhis.

    أَسْلَمَتِ امْرَأَةٌ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَتَزَوَّجَتْ فَجَاءَ زَوْجُهَا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي قَدْ أَسْلَمْتُ مَعَهَا وَعَلِمَتْ بِإِسْلَامِي مَعَهَا «فَنَزَعَهَا رَسُولُ اللَّهِ ﷺ مِنْ زَوْجِهَا الْآخَرَ وَرَدَّهَا إِلَى زَوْجِهَا الْأَوَّلِ»

    ✧ A woman became Muslim during the time of the Messenger of Allah ﷺ and then married. Her husband came to the Messenger of Allah ﷺ and said, 'I became Muslim along with her, and she knew of my Islam along with her.' So the Messenger of Allah ﷺ took her away from her other husband and returned her to her first husband.

    «رَدَّ النَّبِيُّ ﷺ ابْنَتَهُ زَيْنَبَ عَلَى زَوْجِهَا أَبِي الْعَاصِ بْنِ الرَّبِيعِ بِالنِّكَاحِ الْأَوَّلِ وَلَمْ يُحْدِثْ شَيْئًا» صحيح

    ✧ The Prophet ﷺ returned his daughter Zaynab to her husband Abu al-'As b. al-Rabi' based on the first marriage and did not initiate anything new. Sahih.

    عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ رَسُولَ اللَّهِ ﷺ لَمَّا قَدِمَ الْمَدِينَةَ خَرَجَتِ ابْنَتُهُ زَيْنَبُ مِنْ مَكَّةَ مَعَ كِنَانَةَ أَوِ ابْنِ كِنَانَةَ فَخَرَجُوا فِي أَثَرِهَا فَأَدْرَكَهَا هَبَّارُ بْنُ الْأَسْوَدِ فَلَمْ يَزَلْ يَطْعَنُ بَعِيرَهَا بِرُمْحِهِ حَتَّى صَرَعَهَا وَأَلْقَتْ مَا فِي بَطْنِهَا وَأُهْرِيقَتْ دَمًا فَاشْتَجَرَ فِيهَا بَنُو هَاشِمٍ وَبَنُو أُمَيَّةَ فَقَالَتْ بَنُو أُمَيَّةَ نَحْنُ أَحَقُّ بِهَا وَكَانَتْ تَحْتَ ابْنِ عَمِّهِمْ أَبِي الْعَاصِ فَكَانَتْ عِنْدَ هِنْدِ بِنْتِ عُتْبَةَ بْنِ رَبِيعَةَ فَكَانَتْ تَقُولُ لَهَا هِنْدٌ هَذَا بِسَبَبِ أَبِيكِ فَقَالَ رَسُولُ اللَّهِ ﷺ لِزَيْدِ بْنِ حَارِثَةَ «أَلَا تَنْطَلِقُ تَجِيئَنِي بِزَيْنَبَ؟» قَالَ بَلَى يَا رَسُولَ اللَّهِ قَالَ «فَخُذْ خَاتَمِي» فَأَعْطَاهُ إِيَّاهُ فَانْطَلَقَ زَيْدٌ وَبَرَّكَ بَعِيرَهُ فَلَمْ يَزَلْ يَتَلَطَّفُ حَتَّى لَقِيَ رَاعِيًا فَقَالَ لِمَنْ تَرْعَى؟ فَقَالَ لِأَبِي الْعَاصِ فَقَالَ فَلِمَنْ هَذِهِ الْأَغْنَامُ؟ قَالَ لِزَيْنَبَ بِنْتِ مُحَمَّدٍ فَسَارَ مَعَهُ شَيْئًا ثُمَّ قَالَ لَهُ هَلْ لَكَ أَنْ أُعْطِيَكَ شَيْئًا تُعْطِيَهُ إِيَّاهَا وَلَا تَذْكُرْهُ لِأَحَدٍ؟ قَالَ نَعَمْ فَأَعْطَاهُ الْخَاتَمَ فَانْطَلَقَ الرَّاعِي فَأَدْخَلَ غَنَمَهُ وَأَعْطَاهَا الْخَاتَمَ فَعَرَفَتْهُ فَقَالَتْ مَنْ أَعْطَاكَ هَذَا؟ قَالَ رَجُلٌ قَالَتْ فَأَيْنَ تَرَكْتَهُ؟ قَالَ بِمَكَانِ كَذَا وَكَذَا قَالَ فَسَكَتَتْ حَتَّى إِذَا كَانَ اللَّيْلُ خَرَجَتْ إِلَيْهِ فَلَمَّا جَاءَتْهُ قَالَ لَهَا ارْكَبِي بَيْنَ يَدَيَّ عَلَى بَعِيرِهِ قَالَتْ لَا وَلَكِنِ ارْكَبْ أَنْتَ بَيْنَ يَدَيَّ فَرَكِبَ وَرَكِبَتْ وَرَاءَهُ حَتَّى أَتَتْ فَكَانَ رَسُولُ اللَّهِ ﷺ يَقُولُ «هِيَ أَفْضَلُ بَنَاتِي أُصِيبَتْ فِيَّ» فَبَلَغَ ذَلِكَ عَلِيَّ بْنَ الْحُسَيْنِ فَانْطَلَقَ إِلَى عُرْوَةَ فَقَالَ مَا حَدِيثٌ بَلَغَنِي عَنْكَ تُحَدِّثُهُ تَنْتَقِصُ فِيهِ حَقَّ فَاطِمَةَ؟ فَقَالَ «وَاللَّهِ مَا أُحِبُّ أَنَّ لِيَ مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ وَإِنِّي أَنْتَقِصُ فَاطِمَةَ حَقًّا هُوَ لَهَا وَأَمَّا بَعْدُ فَلَكَ أَنْ لَا أُحَدِّثَ بِهِ أَبَدًا» قَالَ عُرْوَةُ وَإِنَّمَا كَانَ هَذَا قَبْلَ نُزُولِ آيَةِ {ادْعُوهُمْ لِآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ} [الأحزاب 5]

    ✧ From 'A'isha, the wife of the Prophet ﷺ, that when the Messenger of Allah ﷺ came to Madinah, his daughter Zaynab left Makkah with Kinana or the son of Kinana. They went out in pursuit of her, and Habbar b. al-Aswad caught up with her. He kept stabbing her camel with his spear until he made her fall, and she miscarried what was in her womb and lost blood. Banu Hashim and Banu Umayya disputed over her. Banu Umayya said, 'We have more right to her,' because she was married to their cousin Abu al-'As. She stayed with Hind bt. 'Utba b. Rabi'a, and Hind said to her, 'This is because of your father.' The Messenger of Allah ﷺ said to Zayd b. Haritha, 'Will you go and bring me Zaynab?' He said, 'Yes, O Messenger of Allah.' He said, 'Take my ring,' and gave it to him. Zayd set out, made his camel kneel, and kept being gentle until he met a shepherd. He said, 'For whom do you graze?' He said, 'For Abu al-'As.' He said, 'For whom are these sheep?' He said, 'For Zaynab bt. Muhammad.' He walked with him a little, then said to him, 'Would you like me to give you something to give to her, and do not mention it to anyone?' He said, 'Yes.' He gave him the ring. The shepherd went, brought in his sheep, and gave her the ring. She recognized it and said, 'Who gave you this?' He said, 'A man.' She said, 'Where did you leave him?' He said, 'At such and such a place.' She remained silent until night fell, then she went out to him. When she came to him, he said to her, 'Ride in front of me on his camel.' She said, 'No, but you ride in front of me.' So he rode and she rode behind him until she came. The Messenger of Allah ﷺ used to say, 'She is the best of my daughters; she was afflicted because of me.' That reached 'Ali b. al-Husayn, so he went to 'Urwa and said, 'What is this hadith that has reached me from you which you narrate, in which you diminish the right of Fatima?' He said, 'By Allah, I would not love to have what is between the east and the west while I diminish Fatima's right that is hers. As for after this, you have it that I will never narrate it again.' 'Urwa said, 'This was before the revelation of the verse: Call them by their fathers; that is more just in the sight of Allah [al-Ahzab: 5].'

    لَمَّا قَذَفَ هِلَالُ بْنُ أُمَيَّةَ امْرَأَتَهُ قِيلَ لَهُ وَاللَّهِ لَيَجْلِدَنَّكَ رَسُولُ اللَّهِ ﷺ ثَمَانِينَ جَلْدَةً قَالَ اللَّهُ أَعْدَلُ مِنْ ذَلِكَ أَنْ يَضْرِبَنِي ثَمَانِينَ جَلْدَةً وَقَدْ عَلِمَ أَنِّي رَأَيْتُ حَتَّىَ اسْتَيْقَنْتُ وَسَمِعْتُ حَتَّىَ اسْتَثْبَتُّ لَا وَاللَّهِ لَا يَضْرِبُنِي أَبَدًا فَنَزَلَتْ آيَةُ الْمُلَاعَنَةِ فَدَعَا بِهِمَا رَسُولُ اللَّهِ ﷺ حِينَ نَزَلَتِ الْآيَةُ فَقَالَ «اللَّهُ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ» فَقَالَ هِلَالٌ وَاللَّهِ إِنِّي لَصَادِقٌ فَقَالَ «احْلِفْ بِاللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنِّي لَصَادِقٌ» يَقُولُ ذَلِكَ أَرْبَعَ مَرَّاتٍ فَإِنْ كُنْتُ كَاذِبًا فَعَلَيَّ لَعْنَةُ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قِفُوهُ عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ» فَحَلَفَتْ ثُمَّ قَالَتْ أَرْبَعًا وَاللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَإِنْ كَانَ صَادِقًا فَعَلَيْهَا غَضَبُ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قِفُوهَا عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ فَرَدَّدَتْ وَهَمَّتْ بِالِاعْتِرَافِ» ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنْ جَاءَتْ بِهِ أَكْحَلَ أَدْعَجَ سَابِغَ الْأَلْيَتَيْنِ أَلَفَّ الْفَخِذَيْنِ حَدْلَجَ السَّاقَيْنِ فَهُوَ لِلَّذِي رُمِيَتْ بِهِ وَإِنْ جَاءَتْ بِهِ أَصْفَرَ قَصِفًا سَبِطًا فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ» فَجَاءَتْ بِهِ عَلَى الصِّفَةِ الْبَغِيِّ قَالَ أَيُّوبُ وَقَالَ مُحَمَّدُ بْنُ سِيرِينَ «كَانَ الرَّجُلُ الَّذِي بَلَغَهَا هِلَالُ بْنُ أُمَيَّةَ شَرِيكَ بْنَ سَحْمَاءَ وَكَانَ أَخَا الْبَرَاءِ بْنِ مَالِكٍ أَخِي أَنَسِ بْنِ مَالِكٍ لِأُمِّهِ وَكَانَتْ أُمُّهُ سَوْدَاءَ وَكَانَ شَرِيكٌ يَأْوِي إِلَى مَنْزِلِ هِلَالٍ وَيَكُونُ عِنْدَهُ»

    ✧ When Hilal b. Umayya accused his wife, it was said to him, 'By Allah, the Messenger of Allah ﷺ will surely flog you eighty lashes.' He said, 'Allah is more just than that He would flog me eighty lashes when He knows that I saw until I was certain and heard until I was sure. No, by Allah, He will never flog me.' Then the verse of mutual cursing was revealed. The Messenger of Allah ﷺ called them both when the verse was revealed and said, 'Allah knows that one of you is lying. Is there any of you who will repent?' Hilal said, 'By Allah, I am truthful.' He said, 'Swear by Allah, besides whom there is no deity, that I am truthful,' saying that four times, then 'If I am lying, then upon me be the curse of Allah.' The Messenger of Allah ﷺ said, 'Stop him at the fifth, for it is decisive.' Then she swore, then said four times, 'By Allah, besides whom there is no deity, he is indeed one of the liars,' and 'If he is truthful, then upon her be the wrath of Allah.' The Messenger of Allah ﷺ said, 'Stop her at the fifth, for it is decisive.' She hesitated and was about to confess, then said, 'I will not disgrace my people.' The Messenger of Allah ﷺ said, 'If she gives birth to a child with dark eyelids, wide black eyes, full buttocks, thick thighs, and slender legs, then he belongs to the one she was accused with. And if she gives birth to a fair, curly-haired, smooth-haired child, then he belongs to Hilal b. Umayya.' She gave birth to a child matching the description of the accused man. Ayyub said, and Muhammad b. Sirin said, 'The man whom Hilal b. Umayya accused her with was Sharik b. Sahma', and he was the brother of al-Bara' b. Malik, the brother of Anas b. Malik through his mother, and his mother was black, and Sharik used to stay at Hilal's house and be with him.'

    أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ لَمَّا نَزَلَتْ آيَةُ الْمُلَاعَنَةِ قَالَ النَّبِيُّ ﷺ «أَيُّمَا امْرَأَةٍ دَخَّلَتْ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ فَلَيْسَتْ مِنَ اللَّهِ فِي شَيْءٍ وَلَنْ يُدْخِلَهَا اللَّهُ جَنَّتَهُ وَأَيُّمَا رَجُلٍ جَحَدَ وَلَدَهُ وَهُوَ يَنْظُرُ إِلَيْهِ احْتَجَبَ اللَّهُ مِنْهُ وَفَضَحَهُ عَلَى رُءُوسِ الْخَلَائِقِ مِنَ الْأَوَّلِينَ وَالْآخِرِينَ»

    ✧ That he heard the Prophet ﷺ say when the verse of mutual cursing was revealed, the Prophet ﷺ said, 'Any woman who introduces into a people someone who is not of them, she has nothing to do with Allah, and Allah will never admit her to His Paradise. And any man who denies his child while looking at him, Allah will veil Himself from him and disgrace him before the heads of all creatures, the first and the last.'

    كُنْتُ امْرَأًً قَدْ أُوتِيتُ مِنْ جِمَاعِ النِّسَاءِ مَا لَمْ يُؤْتَ غَيْرِي فَلَمَّا دَخَلَ رَمَضَانُ ظَاهَرْتُ مِنِ امْرَأَتِي مَخَافَةَ أَنْ أُصِيبَ مِنْهَا شَيْئًا فِي بَعْضِ اللَّيْلِ وَأَتَتَابَعَ مِنْ ذَلِكَ وَلَا أَسْتَطِيعُ أَنْ أَنْزِعَ حَتَّى يُدْرِكَنِي الصُّبْحُ فَبَيْنَمَا هِيَ ذَاتَ لَيْلَةٍ تَخْدُمُنِي إِذَا انْكَشَفَ لِي مِنْهَا شَيْءٌ فَوَثَبْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى قَوْمِي فَأَخْبَرْتُهُمْ خَبَرِي فَقُلْتُ انْطَلِقُوا مَعِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَالُوا لَا وَاللَّهِ لَا نَذْهَبُ مَعَكَ نَخَافُ أَنْ يَنْزِلَ فِينَا قُرْآنٌ وَيَقُولُ فِينَا رَسُولُ اللَّهِ ﷺ مَقَالَةً يَبْقَى عَلَيْنَا عَارُهَا فَاذْهَبْ أَنْتَ فَاصْنَعْ مَا بَدَا لَكَ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَأَخْبَرْتُهُ خَبَرِي فَقَالَ «أَنْتَ ذَاكَ؟» فَقُلْتُ أَنَا ذَاكَ فَاقْضِ فِي حُكْمِ اللَّهِ فَإِنِّي صَابِرٌ مُحْتَسِبٌ قَالَ «أَعْتِقْ رَقَبَةً» فَضَرَبْتُ صَفْحَةَ عُنُقِ رَقَبَتِي بِيَدِي فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ غَيْرَهَا قَالَ «صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ» فَقُلْتُ يَا رَسُولَ اللَّهِ وَهَلْ أَصَابَنِي مَا أَصَابَنِي إِلَّا فِي الصِّيَامِ قَالَ «فَأَطْعِمْ سِتِّينَ مِسْكِينًا» قُلْتُ يَا رَسُولَ اللَّهِ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا هَذِهِ وَحْشًا مَا نَجِدُ عَشَاءً قَالَ «انْطَلِقْ إِلَى صَاحِبِ الصَّدَقَةِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ فَأَطْعِمْ مِنْهَا وَسْقًا سِتِّينَ مِسْكِينًا وَاسْتَعِنْ بِسَائِرِهَا عَلَى عِيَالِكَ» فَأَتَيْتُ قَوْمِي فَقُلْتُ وَجَدْتُ عِنْدَكُمُ الضِّيقَ

    ✧ I was a man who had been given such ability in sexual intercourse with women as no one else had been given. When Ramadan entered, I made a declaration of zihar against my wife, fearing that I might have intercourse with her at night and continue doing so, unable to stop until morning overtook me. While she was serving me one night, something of her became visible to me, and I jumped on her. When morning came, I went to my people and told them my story. I said, 'Come with me to the Messenger of Allah ﷺ.' They said, 'No, by Allah, we will not go with you. We fear that Qur'an will be revealed concerning us, and the Messenger of Allah ﷺ will say something about us whose shame will remain upon us. Go yourself and do what you think best.' So I came to the Messenger of Allah ﷺ and told him my story. He said, 'Are you that one?' I said, 'I am that one. So judge according to the ruling of Allah, for I am patient and seeking reward.' He said, 'Free a slave.' I struck the side of my neck with my hand and said, 'By the One who sent you with truth, I do not possess anything other than this.' He said, 'Fast two consecutive months.' I said, 'O Messenger of Allah, did what happened to me occur except during fasting?' He said, 'Then feed sixty poor people.' I said, 'O Messenger of Allah, by the One who sent you with truth, we spent this night hungry, finding no supper.' He said, 'Go to the collector of the sadaqa of Banu Zurayq, let him give it to you, and feed from it a wasq to sixty poor people, and use the rest for your family.' I came to my people and said, 'I found hardship with you.'

    أَنَّ سَلْمَانَ بْنَ صَخْرٍ الْأَنْصَارِيَّ جَعَلَ امْرَأَتَهُ عَلَيْهِ كَظَهْرِ أُمِّهِ ثُمَّ ذَكَرَ الْحَدِيثَ بِنَحْوِهِ مِنْهُ «هَذَا إِسْنَادٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ» على شرط البخاري ومسلم

    ✧ That Salman b. Sakhr al-Ansari made his wife like his mother's back to him, then he mentioned the hadith similarly. This is a sound chain according to the conditions of the two shaykhs, but they did not include it; according to the conditions of al-Bukhari and Muslim.

    ✧ That a man came to the Prophet ﷺ after he had made zihar against his wife and then had intercourse with her. He said, 'O Messenger of Allah, I made zihar against my wife and then had intercourse with her before I made expiation.' He said, 'What led you to that, may Allah have mercy on you?' He said, 'I saw her anklet in the moonlight.' He said, 'Do not approach her until you do what Allah, Exalted, has commanded.' Its witness is the hadith of Isma'il b. Muslim from 'Amr b. Dinar. The two shaykhs did not use Isma'il or al-Hakam b. Aban as authorities, except that al-Hakam b. Aban is truthful. Al-'Adani is not reliable.

    ✧ That a man made zihar against his wife, then he saw her anklet in the moonlight and it pleased him, so he had intercourse with her. He came to the Prophet ﷺ and mentioned that to him. He said, 'Allah, Exalted, said: before they touch one another [al-Mujadila: 3].' He said, 'That already happened.' The Messenger of Allah ﷺ said, 'Refrain until you make expiation.' Isma'il is weak.

    ✧ Allah ﷻ said: {O you who believe, when you marry believing women and then divorce them} [Al-Ahzab: 49], and He did not say: "When you divorce believing women and then marry them."

    ✧ From the Prophet ﷺ: "The divorce of a slave woman is two divorces, and her waiting period is two menstrual cycles." Abu 'Asim said: I mentioned it to Muzahir b. Aslam and said: Narrate to me as you narrated to Ibn Jurayj. Muzahir narrated to me from al-Qasim from 'A'ishah from the Prophet ﷺ: "The divorce of a slave woman is two divorces, and her waiting period is two menstrual cycles," similar to what Muzahir b. Aslam narrated. He is a shaykh from the people of Basra whom none of our earlier scholars mentioned with criticism, so the hadith is sahih, but they did not include it in the two Sahihs. A hadith contradicting it has been narrated from Ibn 'Abbas. Sahih.

    ✧ I said to Ayyub: Do you know anyone who holds the view of al-Hasan regarding "your affair is in your hand" that it is three? He said: No, except something Qatadah narrated to us from Kathir, the freed slave of 'Abd al-Rahman b. Samurah, from Abu Salamah, from Abu Hurayrah, from the Prophet ﷺ, similar to it. Ayyub said: Kathir came to us and he asked him, and he said: I never narrated this. I mentioned it to Qatadah, and he said: "Yes, but he forgot."

    ✧ She wanted to become Muslim. She came to the Prophet ﷺ and said: My daughter is weaned. Rafi' said: My daughter. The Prophet ﷺ said to Rafi': "Sit aside," and said to his wife: "Sit aside." He then seated the child between them and said: "Call her." The child inclined to her mother. The Prophet ﷺ said: "O Allah, guide her." She inclined to her father, and he took her.

    كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ إِذْ جَاءَهُ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ إِنَّ ثَلَاثَةً مِنْ أَهْلِ الْيَمَنِ أَتَوْا عَلِيًّا يَخْتَصِمُونَ إِلَيْهِ فِي وَلَدٍ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَقَالَ لِلِاثْنَيْنِ مِنْهُمَا طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ لِلِاثْنَيْنِ طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ لِلِاثْنَيْنِ طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ أَنْتُمْ شُرَكَاءُ مُتَشَاكِسُونَ إِنِّي مُقْرِعٌ بَيْنَكُمْ فَمَنْ قَرَعَ فَلَهُ الْوَلَدُ وَعَلَيْهِ لِصَاحِبَيْهِ ثُلُثَا الدِّيَةِ فَأَقْرَعَ بَيْنَهُمْ فَجَعَلَهُ لِمَنْ قَرَعَ فَضَحِكَ رَسُولُ اللَّهِ ﷺ حَتَّى بَدَتْ أَضْرَاسُهُ أَوْ قَالَ نَوَاجِذُهُ «قَدِ اتَّفَقَ الشَّيْخَانِ عَلَى تَرْكِ الِاحْتِجَاجِ بِالْأَجْلَحِ بْنِ عَبْدِ اللَّهِ الْكِنْدِيِّ وَإِنَّمَا نَقِمَا عَلَيْهِ حَدِيثًا وَاحِدًا لِعَبْدِ اللَّهِ بْنِ بُرَيْدَةَ وَقَدْ تَابَعَهُ عَلَى ذَلِكَ الْحَدِيثِ ثَلَاثَةٌ مِنَ الثِّقَاتِ فَهَذَا الْحَدِيثُ إِذًا صَحِيحٌ وَلَمْ يُخَرِّجَاهُ» هذا الحديث إذا صحيح

    ✧ I was sitting with the Prophet ﷺ when a man from Yemen came to him and said: Three men from Yemen came to 'Ali disputing about a child born after they had intercourse with a woman during a single period of purity. He said to two of them: "Give the child willingly to this one." They said: No. Then he said to two of them: "Give the child willingly to this one." They said: No. Then he said to two of them: "Give the child willingly to this one." They said: No. Then he said: "You are quarrelsome partners. I will cast lots among you, and whoever wins the lot gets the child and owes his two companions two-thirds of the blood money." He cast lots among them and gave the child to the one who won. The Messenger of Allah ﷺ laughed until his molars or his premolars appeared. "The two shaykhs agreed to abandon using al-Ajlah b. 'Abd Allah al-Kindi as evidence, and they only criticized him for a single hadith from 'Abd Allah b. Buraydah, and three trustworthy narrators followed him in that hadith. So this hadith is therefore sahih, but they did not include it in the two Sahihs." This hadith is indeed sahih.

    أَنَّ امْرَأَةً قَالَتْ يَا رَسُولَ اللَّهِ ابْنِي هَذَا كَانَ بَطْنِي لَهُ وِعَاءً وَثَدْيِي لَهُ سِقَاءً وَحِجْرِي لَهُ حِوَاءً وَإِنَّ أَبَاهُ طَلَّقَنِي وَأَرَادَ أَنْ يَنْزِعَهُ عَنِّي قَالَ لَهَا رَسُولُ اللَّهِ ﷺ «أَنْتِ أَحَقُّ بِهِ مَا لَمْ تَنْكِحِي»

    A woman said: Messenger of Allah, my womb is a vessel to this son of mine, my breasts, a water-skin for him, and my lap a guard for him, yet his father has divorced me, and wants to take him away from me. The Messenger of Allah ﷺ said: You have more right to him as long as you do not marry. (Using translation from Abū Dāʾūd 2276)

    طُلِّقَتْ خَالَتِي ثَلَاثًا فَخَرَجَتْ تَجُذُّ نَخْلًا لَهَا فَلَقِيَهَا رَجُلٌ فَنَهَاهَا فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ «اخْرُجِي فَجُذِّي لَعَلَّكِ أَنْ تَصَّدَّقِي مِنْهُ أَوْ تَفْعَلِي خَيْرًا»

    ✧ My maternal aunt was divorced three times, so she went out to cut down her palm trees. A man met her and forbade her, so she came to the Prophet ﷺ and mentioned that to him. The Prophet ﷺ said: "Go out and cut them down; perhaps you may give charity from it or do good."

    أَنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْلَاجٍ لَهُ فَقُتِلَ بِطَرَفِ الْقَدُومِ قَالَ حَمَّادٌ وَهُوَ مَوْضِعُ مَاءٍ قَالَتْ فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ مِنْ حَالِي وَذَكَرْتُ لَهُ النُّقْلَةَ إِلَى إِخْوَتِي قَالَتْ فَرَخَّصَ لِي فَلَمَّا جَاوَزْتُ نَادَانِي فَقَالَ «امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» سكت عنه الذهبي في التلخيص

    ✧ Her husband went out in search of some of his workers and was killed at the edge of al-Qadum. Hammad said: It is a watering place. She said: I came to the Prophet ﷺ and mentioned my situation to him and mentioned moving to my brothers. She said: He gave me permission. When I had passed by, he called me and said: "Stay in your house until the term reaches its appointed time." Al-Dhahabi remained silent about it in the Talkhis.

    أَنَّهَا سَمِعَتْ فُرَيْعَةَ بِنْتَ مَالِكٍ أُخْتَ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَتْ خَرَجَ زَوْجِي فِي طَلَبِ أَعْبُدٍ لَهُ فَأَدْرَكَهُمْ بِطَرَفِ الْقَدُومِ فَقَتَلُوهُ فَأَتَانِي نَعْيُهُ وَأَنَا فِي دَارٍ شَاسِعَةٍ مِنْ دُورِ أَهْلِي فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَقُلْتُ إِنَّهُ أَتَانِي نَعْيُ زَوْجِي وَأَنَا فِي دَارٍ شَاسِعَةٍ مِنْ دُورِ أَهْلِي وَلَمْ يَدَعْ لِي نَفَقَةً وَلَا مَالًا وَلَيْسَ الْمَسْكَنُ لِي وَلَوْ تَحَوَّلْتُ إِلَى إِخْوَتِي وَأَهْلِي كَانَ أَرْفَقَ بِي فِي بَعْضِ شَأْنِي فَقَالَ «تَحَوَّلِي» فَلَمَّا خَرَجْتُ إِلَى الْمَسْجِدِ أَوِ الْحُجْرَةِ دَعَانِي أَوْ أَمَرَ بِي فَدُعِيتُ لَهُ فَقَالَ «امْكُثِي فِي الْبَيْتِ الَّذِي أَتَاكَ فِيهِ نَعْيُ زَوْجِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَاعْتَدَّتْ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَأَرْسَلَ عُثْمَانُ بْنُ عَفَّانَ إِلَيَّ فَأَتَيْتُهُ فَحَدَّثْتُهُ فَأَخَذَ بِهِ

    ✧ that she heard Furay'ah bt. Malik, sister of Abu Sa'id al-Khudri, say: "My husband went out in search of some slaves of his, and they caught up with him at the edge of al-Qadum and killed him. His death notification came to me while I was in a house far from the houses of my family. I went to the Messenger of Allah ﷺ and said: 'The death notification of my husband has come to me while I am in a house far from the houses of my family. He did not leave me any maintenance or wealth, and the dwelling is not mine. If I were to move to my brothers and family, it would be easier for me in some of my affairs.' He said: 'Move.' When I went out to the mosque or the room, he called me, or ordered that I be called for him, and said: 'Stay in the house in which the death notification of your husband came to you until the prescribed period reaches its term.' So she observed her waiting period in it, four months and ten days." She said: "Then Uthman b. Affan sent for me, and I went to him and related it to him, and he adopted it."

    أَنَّهَا قَالَتْ طُلِّقَتِ امْرَأَةٌ فَمَكَثَتْ ثَلَاثًا وَعِشْرِينَ لَيْلَةً فَوَضَعْتُ حَمْلَهَا ثُمَّ أَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ لَهَا «تَزَوَّجِي»

    ✧ that she said: "A woman was divorced and remained for twenty-three nights, then she gave birth to her child. She then came to the Prophet ﷺ and mentioned that to him, and he said to her: 'Marry.'"

    أَنَّهَا كَانَتْ تَحْتَ الزُّبَيْرِ بْنِ الْعَوَّامِ فَكَرِهَتْهُ وَكَانَ شَدِيدًا عَلَى النِّسَاءِ فَقَالَتْ لِلزُّبَيْرِ يَا أَبَا عَبْدِ اللَّهِ رَوِّحْنِي بِتَطْلِيقَةٍ قَالَتْ وَذَلِكَ حِينَ وَجَدَتِ الطَّلْقَ قَالَ وَمَا يَنْفَعُكِ أَنْ أُطَلِّقَكِ تَطْلِيقَةً وَاحِدَةً ثُمَّ أُرَاجِعَكَ؟ قَالَتْ إِنِّي أَجِدُنِي أَسْتَرْوِحُ إِلَى ذَلِكَ قَالَ فَطَلَّقَهَا تَطْلِيقَةً وَاحِدَةً ثُمَّ خَرَجَ فَقَالَتْ لِجَارِيَتِهَا أَغْلِقِي الْأَبْوَابَ قَالَ فَوَضَعَتْ جَارِيَةً فَقَالَ فَأَتَى الزُّبَيْرُ فَبُشِّرَ بِهَا فَقَالَ مَكَرَتْ بِي ابْنَةُ أَبِي مُعَيْطٍ ثُمَّ خَرَجَ إِلَى رَسُولِ اللَّهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ «فَأَبَانَهَا مِنْهُ»

    ✧ that she was married to al-Zubayr b. al-Awwam, but she disliked him and he was harsh toward women. She said to al-Zubayr: 'O Abu Abd Allah, relieve me with a divorce.' She said that was when she felt labor pains. He said: 'What benefit is it to you if I divorce you one divorce and then take you back?' She said: 'I find myself relieved by that.' He said: 'Then he divorced her one divorce and went out.' She said to her slave girl: 'Close the doors.' She then gave birth to a girl. Al-Zubayr came and was given the good news, and he said: 'The daughter of Abu Mu'ayt deceived me.' Then he went out to the Messenger of Allah ﷺ and mentioned that to him, and he separated her from him.

    «لَا تُلَبِّسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا مُحَمَّدٍ ﷺ فِي أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا عِدَّتُهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا»

    ✧ Do not make ambiguous for us the Sunnah of our Prophet Muhammad ﷺ regarding the mother of a child when her master dies: her waiting period is four months and ten days.

    بَيْنَا أَنَا نَائِمٌ إِذْ أَتَانِي رَجُلَانِ فَأَخَذَا بِضَبْعِي فَأَتَيَا بِي جَبَلًا وَعْرًا فَقَالَا لِي اصْعَدْ فَقُلْتُ إِنِّي لَا أُطِيقُ فَقَالَا إِنَّا سَنُسَهِّلُهُ لَكَ فَصَعِدْتُ حَتَّى كُنْتُ فِي سَوَاءِ الْجَبَلِ إِذَا أَنَا بِأَصْوَاتٍ شَدِيدَةٍ قُلْتُ مَا هَذِهِ الْأَصْوَاتُ؟ قَالُوا هَذَا هُوَ عُوَاءُ أَهْلِ النَّارِ ثُمَّ انْطَلَقَ بِي فَإِذَا بِقَوْمٍ مُعَلَّقِينَ بِعَرَاقِيبِهِمْ مُشَقَّقَةً أَشْدَاقُهُمْ تَسِيلُ أَشْدَاقُهُمْ دَمًا فَقُلْتُ مَا هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ الَّذِينَ يُفْطِرُونَ قَبْلَ تَحِلَّةِ صَوْمِهِمْ ثُمَّ انْطَلِقَا بِي فَإِذَا بِقَوْمٍ أَشَدِّ شَيْءٍ انْتِفَاخًا وَأَنْتَنِهِ رِيحًا وَأَسْوَئِهِ مَنْظَرًا فَقُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ الزَّانُونَ وَالزَّوَانِي ثُمَّ انْطَلَقَ بِي فَإِذَا أَنَا بِنِسَاءٍ تَنْهَشُ ثَدْيَهُنَّ الْحَيَّاتُ فَقُلْتُ مَا بَالُ هَؤُلَاءِ؟ فَقَالَ هَؤُلَاءِ اللَّوَاتِي يَمْنَعْنَ أَوْلَادَهُنَّ أَلْبَانَهُنَّ ثُمَّ انْطَلَقَ بِي فَإِذَا بِغِلْمَانٍ يَلْعَبُونَ بَيْنَ نَهْرَيْنِ فَقُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ ذَرَارِيُّ الْمُؤْمِنِينَ ثُمَّ شَرَفَ لِي شَرَفٌ فَإِذَا أَنَا بِثَلَاثَةِ نَفَرٍ يَشْرَبُونَ مِنْ خَمْرٍ لَهُمْ قُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ جَعْفَرُ بْنُ أَبِي طَالِبٍ وَزَيْدُ بْنُ حَارِثَةَ وَعَبْدُ اللَّهِ بْنُ رَوَاحَةَ ثُمَّ شَرَفَ لِي شَرَفٌ آخَرُ فَإِذَا أَنَا بِثَلَاثَةِ نَفَرٍ قُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ إِبْرَاهِيمُ وَمُوسَى وَعِيسَى عَلَيْهِمُ السَّلَامُ يَنْتَظِرُونَكَ

    ✧ While I was sleeping, two men came to me, took me by my upper arms, and brought me to a rugged mountain. They said to me: 'Climb.' I said: 'I cannot.' They said: 'We will make it easy for you.' So I climbed until I was on level ground of the mountain, and suddenly I heard loud voices. I said: 'What are these voices?' They said: 'This is the howling of the people of the Fire.' Then they took me further, and I saw people suspended by their Achilles tendons, their cheeks split, and blood flowing from their cheeks. I said: 'Who are these?' He said: 'These are those who break their fast before the time to break their fast.' Then they took me further, and I saw people most swollen, most foul smelling, and worst in appearance. I said: 'Who are these?' He said: 'These are the male and female fornicators.' Then they took me further, and I saw women whose breasts were being bitten by snakes. I said: 'What is the matter with these?' He said: 'These are those who deny their children their milk.' Then they took me further, and I saw boys playing between two rivers. I said: 'Who are these?' He said: 'These are the offspring of the believers.' Then a high place was shown to me, and I saw three men drinking from their wine. I said: 'Who are these?' He said: 'These are Ja'far b. Abi Talib, Zayd b. Harithah, and Abdullah b. Rawahah.' Then another high place was shown to me, and I saw three men. I said: 'Who are these?' He said: 'Abraham, Moses, and Jesus (peace be upon them), waiting for you.'

    أَنَّ أَبَاهُ ثَابِتَ بْنَ قَيْسٍ فَارَقَ جَمِيلَةَ بِنْتَ عَبْدِ اللَّهِ بْنِ أُبَيٍّ وَهِيَ حَامِلَةٌ بِمُحَمَّدٍ فَلَمَّا وَلَدَتْهُ حَلَفَتْ أَنْ لَا تُلْبِنَهُ مِنْ لَبَنِهَا فَدَعَا بِهِ رَسُولُ اللَّهِ ﷺ فَبَزَقَ فِي فِيهِ وَحَنَّكَهُ بِتَمْرَةِ عَجْوَةٍ وَسَمَّاهُ مُحَمَّدًا وَقَالَ «اخْتَلِفْ بِهِ فَإِنَّ اللَّهَ رَازِقُهُ» فَأَتَيْتُهُ الْيَوْمَ الْأَوَّلَ وَالثَّانِي وَالثَّالِثَ فَإِذَا امْرَأَةٌ مِنَ الْعَرَبِ تَسْأَلُ عَنْ ثَابِتِ بْنِ قَيْسٍ فَقُلْتُ مَا تُرِيدِينَ مِنْهُ؟ أَنَا ثَابِتٌ فَقَالَتْ أُرِيتُ فِي مَنَامِي هَذِهِ كَأَنِّي أُرْضِعُ ابْنًا لَهُ يُقَالُ لَهُ مُحَمَّدٌ فَقَالَ فَأَنَا ثَابِتٌ وَهَذَا ابْنِي مُحَمَّدٌ قَالَ وَإِنَّ دِرْعَهَا يَتَعَصَّرُ مِنْ لَبَنِهَا

    ✧ that his father Thabit b. Qays separated from Jamilah bt. Abdullah b. Ubayy while she was pregnant with Muhammad. When she gave birth to him, she swore that she would not nurse him with her milk. The Messenger of Allah ﷺ called for him, spat into his mouth, and rubbed his palate with a ripe date, and named him Muhammad, and said: 'Take him around, for Allah will provide for him.' So I brought him on the first, second, and third day, and there was an Arab woman asking about Thabit b. Qays. I said: 'What do you want from him? I am Thabit.' She said: 'I saw in my dream as if I were nursing a son of his called Muhammad.' He said: 'I am Thabit, and this is my son Muhammad.' He said: 'And her breastplate was dripping with her milk.'

  66. al-Mustadrak (al-Hakim) 2839Sahih

    عَطَاءٌ إِنْ شَاءَتِ اعْتَدَّتْ عِنْدَ أَهْلِهَا وَسَكَنَتْ فِي وَصِيَّتِهَا وَإِنْ شَاءَتْ خَرَجَتْ لِقَوْلِ اللَّهِ تَعَالَى {فَلَا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ} [البقرة 234] قَالَ عَطَاءٌ «ثُمَّ جَاءَ الْمِيرَاثُ فَنَسَخَ السُّكْنَى فَتَعْتَدُّ حَيْثُ شَاءَتْ»

    ✧ Ata': If she wishes, she may observe her waiting period with her family and reside in her bequest, and if she wishes, she may go out, according to the saying of Allah Almighty: {There is no blame upon you for what they do} [al-Baqarah 234]. Ata' said: 'Then the inheritance came and abrogated the residence, so she observes her waiting period wherever she wishes.'

    جَاءَ مِسْكِينٌ لِبَعْضِ الْأَنْصَارِ فَقَالَ إِنَّ سَيِّدِي يُكْرِهُنِي عَلَى الْبِغَاءِ فَنَزَلَ فِي ذَلِكَ {وَلَا تُكْرِهُوا فَتَيَاتِكُمْ عَلَى الْبِغَاءِ}

    ✧ A poor man came to some of the Ansar and said: 'My master forces me into prostitution.' So concerning that it was revealed: {Do not compel your slave girls to prostitution}.
