أَوَّلُ قَسَامَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ كَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَ رَجُلًا مِنْ قُرَيْشٍ مِنْ فَخِذٍ أُخْرَى قَالَ فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ بِهِ رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَاهُ عِقَالًا فَشَدَّ بِهِ عُرْوَةَ جُوَالِقِهِ فَلَمَّا نَزَلُوا عُقِلَتِ الْإِبِلُ إِلَّا بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الْإِبِلِ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ؟ قَالَ مَرَّ بِي رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَاسْتَغَاثَنِي قَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَيْتُهُ عِقَالَهُ فَحَذَفَهُ بِعَصًا كَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ قَالَ أَتَشْهَدُ الْمَوْسِمَ؟ قَالَ مَا أَشْهَدُ وَرُبَّمَا شَهِدْتُ قَالَ هَلْ أَنْتَ مُبَلِّغٌ عَنِّي رِسَالَةً مَرَّةً مِنَ الدَّهْرِ؟ قَالَ نَعَمْ قَالَ إِذَا شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوكَ فَنَادِ يَا آلَ بَنِي هَاشِمٍ فَإِذَا أَجَابُوكَ فَسَلْ عَنْ أَبِي طَالِبٍ [316] فَأَخْبِرْهُ أَنَّ فُلَانًا قَتَلَنِي فِي عِقَالٍ قَالَ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا؟ قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ ثُمَّ مَاتَ فَوَلِيتُ دَفْنَهُ فَقَالَ كَانَ أَهْلُ ذَلِكَ مِنْكَ قَالَ فَمَكَثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الْيَمَانِيَّ الَّذِي كَانَ أَوْصَى إِلَيْهِ أَنْ يُبَلِّغَ عَنْهُ وَافَى الْمَوْسِمَ فَقَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ؟ قَالُوا هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلَانٌ أَنْ أُبَلِّغَكَ رِسَالَةً أَنَّ فُلَانًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ اخْتَرْ مِنَّا إِحْدَى ثَلَاثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنَ الْإِبِلِ فَإِنَّكَ قَتَلْتَ صَاحِبَنَا خَطَأً وَإِنْ شِئْتَ حَلَفَ خَمْسُونَ مِنْ قَوْمِكَ أَنَّكَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاكَ بِهِ فَأَتَى قَوْمَهُ فَذَكَرَ ذَلِكَ لَهُمْ فَقَالُوا نَحْلِفُ فَأَتَتْهُ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا رَجُلًا مِنَ الْخَمْسِينَ وَلَا تُصْبِرَ يَمِينَهُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلًا أَنْ يَحْلِفُوا مَكَانَ مِائَةٍ مِنَ الْإِبِلِ يُصِيبُ كُلَّ رَجُلٍ بَعِيرَانِ فَهَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلَا تُصْبِرْ يَمِينِي حَيْثُ تُصْبَرُ الْأَيْمَانُ فَقَبِلَهُمَا وَجَاءَ ثَمَانِيَةٌ وَأَرْبَعُونَ رَجُلًا حَلَفُوا قَالَ ابْنُ عَبَّاسٍ «فَوَالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنَ الثَّمَانِيَةِ وَالْأَرْبَعِينَ عَيْنٌ تَطْرِفُ»
✧ The first qasamah in the Jahiliyyah was this: a man of Banu Hashim hired a man of Quraysh from another clan. He set out with him with his camels. A man of Banu Hashim passed by him whose the handle of his sack had broken, so he said: 'Help me with a rope to tie the handle of my sack so that the camels do not run away.' So he gave him a rope and he tied the handle of his sack with it. When they halted, all the camels were hobbled except one camel. The one who hired him said: 'What is the matter with this camel that it has not been hobbled among the camels?' He said: 'It has no rope.' He said: 'Where is its rope?' He said: 'A man of Banu Hashim passed by me whose the handle of his sack had broken, and he asked me for help, saying: "Help me with a rope to tie the handle of my sack so that the camels do not run away." So I gave him its rope.' He struck him with a stick, and that was his death. Then a man from Yemen passed by him and said: 'Will you attend the fair?' He said: 'I do not attend it, but perhaps I may attend it.' He said: 'Will you convey a message from me once in your life?' He said: 'Yes.' He said: 'When you attend the fair, call out: O people of Quraysh! When they respond to you, call out: O people of Banu Hashim! When they respond to you, ask for Abu Talib and tell him that so-and-so killed me for the sake of a rope.' The narrator said: The hired man died. When the one who had hired him came, Abu Talib came to him and said: 'What did our companion do?' He said: 'He fell ill, and I took good care of him; then he died, and I took charge of his burial.' Abu Talib said: 'It was you who deserved that.' He remained for some time. Then the Yemeni man who had been entrusted to convey the message arrived at the fair and said: 'O people of Quraysh!' They said: 'These are Quraysh.' He said: 'O people of Banu Hashim!' They said: 'These are Banu Hashim.' He said: 'Where is Abu Talib?' They said: 'This is Abu Talib.' He said: 'So-and-so commanded me to convey to you a message: that so-and-so killed him for the sake of a rope.' Abu Talib came to the killer and said: 'Choose one of three options: if you wish, pay one hundred camels, for you killed our companion by mistake; if you wish, fifty of your people swear that you did not kill him; if you refuse, we will kill you in retaliation for him.' He went to his people and mentioned that to them. They said: 'We will swear.' A woman of Banu Hashim who was married to a man among them and had borne him a son came to Abu Talib and said: 'O Abu Talib, I would like you to excuse my son from being one of the fifty and not make him take the oath.' So he did. Then a man among them came and said: 'O Abu Talib, you wanted fifty men to swear in place of one hundred camels, so that each man would get two camels. Here are two camels, accept them from me and do not make me take the oath where oaths are taken.' He accepted them. Then forty-eight men came and swore. Ibn Abbas said: 'By the One in Whose hand is my soul, before the year had passed, not one of the forty-eight had an eye that blinked.'

✧ From a man among the companions of the Messenger of Allah ﷺ from the Ansar, that the Messenger of Allah ﷺ confirmed the qasamah as it was in the Jahiliyyah. The wording is that of Ahmad.

عَنْ أُنَاسٍ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ «أَنَّ الْقَسَامَةَ كَانَتْ فِي الْجَاهِلِيَّةِ فَأَقَرَّهَا رَسُولُ اللهِ ﷺ عَلَى مَا كَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ وَقَضَى بِهَا بَيْنَ نَاسٍ مِنَ الْأَنْصَارِ فِي قَتِيلٍ ادَّعَوْهُ عَلَى يَهُودِ خَيْبَرَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُمَا مَعْمَرٌ
✧ From some people among the companions of the Messenger of Allah ﷺ: 'The qasamah existed in the Jahiliyyah, and the Messenger of Allah ﷺ confirmed it as it was in the Jahiliyyah, and he judged by it between some people of the Ansar regarding a slain man they claimed against the Jews of Khaybar.' Abu Abd al-Rahman said: Ma'mar disagreed with the two of them.

كَانَتِ الْقَسَامَةُ فِي الْجَاهِلِيَّةِ ثُمَّ أَقَرَّهَا رَسُولُ اللهِ ﷺ فِي الْأَنْصَارِيِّ الَّذِي وُجِدَ مَقْتُولًا فِي جُبِّ الْيَهُودِ فَقَالَتِ الْأَنْصَارُ «إِنَّ الْيَهُودَ قَتَلُوا صَاحِبَنَا»
✧ The qasamah was practiced in the Jahiliyyah, then the Messenger of Allah ﷺ confirmed it in the case of the Ansari man who was found slain in the well of the Jews. The Ansar said: 'The Jews killed our companion.'

رَسُولُ اللهِ ﷺ «كَبِّرْ كَبِّرْ» وَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ فَقَالَ رَسُولُ اللهِ ﷺ «إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذَنُوا بِحَرْبٍ» فَكَتَبَ النَّبِيُّ ﷺ فِي ذَلِكَ فَكَتَبُوا إِنَّا وَاللهِ مَا قَتَلْنَاهُ فَقَالَ رَسُولُ اللهِ ﷺ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ «تَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ؟» قَالُوا لَا قَالَ «فَتَحْلِفُ لَكُمْ يَهُودُ» قَالُوا لَيْسُوا بِمُسْلِمِينَ قَالَ فَوَدَاهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ قَالَ سَهْلٌ لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ
✧ The Messenger of Allah ﷺ said: “Let the eldest speak, let the eldest speak.” Huwayyisah spoke, then Muhayyisah spoke. The Messenger of Allah ﷺ said: “Either they pay the blood money for your companion, or they must be prepared for war.” The Prophet ﷺ wrote to them about that, and they wrote back: “By Allah, we did not kill him.” The Messenger of Allah ﷺ said to Huwayyisah, Muhayyisah, and ‘Abd al-Rahman: “Will you swear fifty oaths and thus be entitled to the blood of your companion?” They said: “No.” He said: “Then will the Jews swear fifty oaths for you?” They said: “They are not Muslims.” So the Messenger of Allah ﷺ paid the blood money himself and sent them one hundred camels, until they were brought into the courtyard. Sahl said: “A red camel from among them kicked me.”

أَنَّهُ قَالَ وَعَنْ رَافِعِ بْنِ خَدِيجٍ أَنَّهُمَا قَالَا خَرَجَ عَبْدُ اللهِ بْنُ سَهْلِ بْنِ زَيْدٍ وَمُحَيِّصَةُ بْنُ مَسْعُودٍ حَتَّى إِذَا كَانَا بِخَيْبَرَ تَفَرَّقَا فِي بَعْضِ مَا هُنَالِكَ ثُمَّ إِذَا مُحَيِّصَةُ يَجِدُ عَبْدَ اللهِ بْنَ سَهْلٍ قَتِيلًا فَدَفَنَهُ ثُمَّ أَقْبَلَ إِلَى رَسُولِ اللهِ ﷺ هُوَ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَكَانَ أَصْغَرَ الْقَوْمِ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ قَبْلَ صَاحِبَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرِ لِلْكُبَرِ فِي السِّنِّ فَصَمَتَ وَتَكَلَّمَ صَاحِبَاهُ ثُمَّ تَكَلَّمَ مَعَهُمَا» فَذَكَرُوا لِرَسُولِ اللهِ ﷺ مَقْتَلَ عَبْدِ اللهِ بْنِ سَهْلٍ فَقَالَ لَهُمْ «أَتَحْلِفُونَ خَمْسِينَ يَمِينًا وَتَسْتَحِقُّونَ صَاحِبَكُمْ أَوْ قَاتِلَكُمْ؟» قَالُوا «كَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ؟» قَالَ «فَتُبَرِّئُكُمْ يَهُودُ بِخَمْسِينَ يَمِينًا» قَالُوا «وَكَيْفَ تَقْبَلُ أَيْمَانَ قَوْمٍ كُفَّارٍ فَلَمَّا رَأَى ذَلِكَ رَسُولُ اللهِ ﷺ أَعْطَاهُ عَقْلَهُ»
✧ He said: And from Rafi‘ b. Khadij that they both said: ‘Abd Allah b. Sahl b. Zayd and Muhayyisah b. Mas‘ud went out until when they were at Khaybar, they separated for some of their needs there. Then Muhayyisah found ‘Abd Allah b. Sahl slain, so he buried him. Then he came to the Messenger of Allah ﷺ, he and Huwayyisah b. Mas‘ud and ‘Abd al-Rahman b. Sahl, who was the youngest of the group. ‘Abd al-Rahman went to speak before his two companions, but the Messenger of Allah ﷺ said: “Let the eldest speak first, the eldest in age.” So he fell silent, and his two companions spoke, then he spoke with them. They mentioned to the Messenger of Allah ﷺ the killing of ‘Abd Allah b. Sahl. He said to them: “Will you swear fifty oaths and thus be entitled to your companion or your killer?” They said: “How can we swear when we did not witness?” He said: “Then the Jews will absolve themselves with fifty oaths.” They said: “How can we accept the oaths of a disbelieving people?” When the Messenger of Allah ﷺ saw that, he paid his blood money himself.

أَنَّ مُحَيِّصَةَ بْنَ مَسْعُودٍ وَعَبْدَ اللهِ بْنَ سَهْلٍ أَتَيَا خَيْبَرَ فِي حَاجَةٍ لَهُمَا فَتَفَرَّقَا فِي النَّخْلِ فَقُتِلَ عَبْدُ اللهِ بْنُ سَهْلٍ فَجَاءَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ ابْنَا عَمِّهِ إِلَى رَسُولِ اللهِ ﷺ فَتَكَلَّمَ عَبْدُ الرَّحْمَنِ فِي أَمْرِ أَخِيهِ وَهُوَ أَصْغَرُ مِنْهُمَا فَقَالَ رَسُولُ اللهِ ﷺ «الْكُبْرَ لِيَبْدَأِ الْأَكْبَرُ فَتَكَلَّمَا فِي أَمْرِ صَاحِبِهِمَا» فَقَالَ رَسُولُ اللهِ ﷺ وَذَكَرَ كَلِمَةً مَعْنَاهَا «يُقْسِمُ خَمْسُونَ مِنْكُمْ» فَقَالُوا يَا رَسُولَ اللهِ أَمْرٌ لَمْ نَشْهَدْهُ كَيْفَ نَحْلِفُ؟ قَالَ «فَتُبَرِّئُكُمْ يَهُودُ بِأَيْمَانِ خَمْسِينَ مِنْهُمْ» قَالُوا يَا رَسُولَ اللهِ قَوْمٌ كُفَّارٌ فَوَدَاهُ رَسُولُ اللهِ ﷺ مِنْ قِبَلِهِ قَالَ سَهْلٌ «فَدَخَلْتُ مِرْبَدًا لَهُمْ فَرَكَضَتْنِي نَاقَةٌ مِنْ تِلْكَ الْإِبِلِ رَكْضَةً»
✧ Muhayyisah b. Mas‘ud and ‘Abd Allah b. Sahl went to Khaybar for some need of theirs, and they separated among the palm trees. ‘Abd Allah b. Sahl was killed. His brother ‘Abd al-Rahman b. Sahl and Huwayyisah and Muhayyisah, the two sons of his paternal uncle, came to the Messenger of Allah ﷺ. ‘Abd al-Rahman spoke about the matter of his brother, and he was the youngest of them. The Messenger of Allah ﷺ said: “The eldest, let the eldest begin.” So the two spoke about the matter of their companion. The Messenger of Allah ﷺ said—and he mentioned a word whose meaning is—“Fifty of you shall swear.” They said: “O Messenger of Allah, it is a matter we did not witness; how can we swear?” He said: “Then the Jews will absolve themselves with the oaths of fifty of them.” They said: “O Messenger of Allah, they are a disbelieving people.” So the Messenger of Allah ﷺ paid the blood money from his own resources. Sahl said: “I entered an enclosure of theirs, and a camel from those camels kicked me with a kick.”

عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَمُحَيِّصَةَ بْنَ مَسْعُودِ بْنِ زَيْدٍ أَنَّهُمَا أَتَيَا خَيْبَرَ وَهُوَ يَوْمَئِذٍ صُلْحٌ فَتَفَرَّقَا لِحَوَائِجِهَا فَأَتَى مُحَيِّصَةُ عَلَى عَبْدِ اللهِ بْنِ سَهْلٍ وَهُوَ يَتَشَحَّطُ فِي دَمِهِ قَتِيلًا فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ وَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ إِلَى رَسُولِ اللهِ ﷺ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ وَهُوَ أَحْدَثُ الْقَوْمِ سِنًّا فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرِ الْكُبْرَ» فَسَكَتَ فَتَكَلَّمَا فَقَالَ رَسُولُ اللهِ ﷺ «تَحْلِفُونَ بِخَمْسِينَ مِنْكُمْ وَتَسْتَحِقُّونَ صَاحِبِكُمْ أَوْ قَاتِلِكُمْ؟» قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ؟ قَالَ «فتُبَرِّئُكُمْ يَهُودُ بِخَمْسِينَ» قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ كُفَّارٍ؟ فَعَقَلَهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ
✧ From Sahl b. Abi Hathmah and Muhayyisah b. Mas‘ud b. Zayd that they went to Khaybar, which at that time was under a peace treaty, and they separated for their needs. Muhayyisah came upon ‘Abd Allah b. Sahl while he was wallowing in his blood, slain, so he buried him. Then he came to Madinah. ‘Abd al-Rahman b. Sahl, Huwayyisah, and Muhayyisah went to the Messenger of Allah ﷺ. ‘Abd al-Rahman went to speak, and he was the youngest of the people in age. The Messenger of Allah ﷺ said: “Let the eldest speak first.” So he fell silent, and the two spoke. The Messenger of Allah ﷺ said: “Will you swear fifty oaths from among you and thus be entitled to your companion or your killer?” They said: “O Messenger of Allah, how can we swear when we did not witness and did not see?” He said: “Then the Jews will absolve you with fifty oaths.” They said: “O Messenger of Allah, how can we accept the oaths of a disbelieving people?” So the Messenger of Allah ﷺ paid the blood money himself.

✧ ‘Abd Allah b. Sahl al-Ansari and Muhayyisah b. Mas‘ud went out to Khaybar and separated for their needs, and ‘Abd Allah b. Sahl was killed. Muhayyisah, ‘Abd al-Rahman the brother of the slain man, and Huwayyisah b. Mas‘ud came until they reached the Messenger of Allah ﷺ. ‘Abd al-Rahman went to speak, but the Messenger of Allah ﷺ said: “The eldest, the eldest.” So Muhayyisah and Huwayyisah spoke and mentioned the matter of ‘Abd Allah b. Sahl. Mansur al-Makki informed us, he said: Sufyan narrated to us, he said: Yahya b. Sa‘id narrated to us from Bushayr b. Yasar from Sahl b. Abi Hathmah, who said: ‘Abd Allah b. Sahl was found slain. His brother and his two paternal uncles, Huwayyisah and Muhayyisah—they were the paternal uncles of ‘Abd Allah b. Sahl—came to the Messenger of Allah ﷺ. ‘Abd al-Rahman went to speak, but the Messenger of Allah ﷺ said: “The eldest, the eldest.” They said: “O Messenger of Allah, we found ‘Abd Allah b. Sahl slain in a well of—meaning one of the wells of Khaybar.” The Prophet ﷺ said: “Whom do you suspect?” They said: “We suspect the Jews.” He said: “Will you swear fifty oaths that the Jews killed him?” They said: “How can we swear to what we did not see?” He said: “Then the Jews will absolve you with fifty oaths that they did not kill him.” They said: “How can we be satisfied with their oaths when they are polytheists?” So the Messenger of Allah ﷺ paid the blood money himself. ✧ He informed him that a group of his people went to Khaybar and separated there, and they found one of them slain. They said to those among whom they found him: “You killed our companion.” They said: “We did not kill him, and we do not know any killer.” They went to the Prophet ﷺ and said: “O Prophet of Allah, we went to Khaybar and found one of us slain.” The Messenger of Allah ﷺ said: “The eldest, the eldest.” Then he said to them: “Will you bring clear proof of who killed him?” They said: “We have no proof.” He said: “Then they will swear to you.” They said: “We are not satisfied with the oaths of the Jews.” The Prophet of Allah ﷺ disliked that his blood should go unavenged, so he paid the blood money, one hundred camels from the charity camels. Abu ‘Abd al-Rahman said: We do not know of anyone who followed Sa‘id b. ‘Ubayd al-Ta’i in the wording of this hadith from Bushayr b. Yasar. Sa‘id b. ‘Ubayd is trustworthy, and his hadith is more likely correct in our view, and Allah knows best. ‘Amr b. Shu‘ayb disagreed with him.

✧ The Messenger of Allah ﷺ said: “Produce two witnesses against whom you claim killed him, and I will hand him over to you with his rope.” He said: “O Messenger of Allah, where would I get two witnesses when he was found slain at their doors?” He said: “Then swear fifty oaths.” He said: “O Messenger of Allah, how can we swear to what I do not know?” The Messenger of Allah ﷺ said: “Then require them to swear fifty oaths.” He said: “O Messenger of Allah, how can we require them to swear when they are Jews?” So the Messenger of Allah ﷺ divided the blood money among them and helped them with half of it. Abu ‘Abd al-Rahman said: We do not know of anyone who followed ‘Amr b. Shu‘ayb in this narration, nor Sa‘id b. ‘Ubayd in his narration from Bushayr b. Yasar, and Allah knows best.

✧ A man was killed during the time of the Messenger of Allah ﷺ, and the killer was brought to the Prophet ﷺ, who handed him over to the guardian of the slain man. The killer said: “O Messenger of Allah, by Allah, I did not intend to kill him.” The Messenger of Allah ﷺ said to the guardian of the slain man: “Indeed, if he is truthful and then you kill him, you will enter the Fire.” So he let him go. He said: He was bound with a leather strap, and he went out dragging his strap, so he was called Dhu al-Nis‘ah. The wording is that of Ahmad.

The guardian of the slain man brought him, and the Messenger of Allah ﷺ said to him, “Will you pardon?” He said, “No.” He said, “Will you take the blood money?” He said, “No.” He said, “Then execution?” He said, “Yes.” He said, “Go.” When he went, he said, “Indeed, if you pardon him, he will bear your sin and the sin of his companion.” So he pardoned him and let him go. He said: I saw him dragging his rope.

✧ I witnessed the Messenger of Allah ﷺ when the killer was brought, led by the guardian of the slain man with a rope. The Messenger of Allah ﷺ said to the guardian of the slain man, “Will you pardon?” He said, “No.” He said, “Will you take the blood money?” He said, “No.” He said, “Then will you kill him?” He said, “Yes.” He said, “Take him away.” When he turned away from him, he called him and said to him, “Will you pardon?” He said, “No.” He said, “Will you take the blood money?” He said, “No.” He said, “Then will you kill him?” He said, “Yes.” He said, “Go.” The Messenger of Allah ﷺ then said, “Indeed, if you pardon him, he will bear his sin and the sin of his companion.” So he pardoned him and left him. ✧ I was sitting with the Messenger of Allah ﷺ when a man came with a rope around his neck and said, “O Messenger of Allah, this man and my brother were digging a well, and he raised the pickaxe and struck his companion’s head with it, killing him.” The Prophet ﷺ said, “Pardon him.” He refused and stood up. He said, “O Prophet of Allah, this man and my brother were digging a well, and he raised the pickaxe and struck his companion’s head with it, killing him.” The Prophet ﷺ said, “Pardon him.” He refused. Then he stood up and said, “O Messenger of Allah, this man and my brother were digging a well, and he raised the pickaxe—I think he said—and struck his companion’s head with it, killing him.” He said, “Pardon him.” He refused. Then he said, “Go, for if you kill him, you will be like him.” So he went out with him until they had passed. Then we called out to him, “Do you not hear what the Messenger of Allah ﷺ says?” He returned and said, “If I kill him, I will be like him?” He said, “Yes. Pardon him.” He then went out dragging his rope until he disappeared from us.

✧ He was sitting with the Messenger of Allah ﷺ when a man came leading another by his rope and said, “O Messenger of Allah, this man killed my brother.” The Messenger of Allah ﷺ said to him, “Did you kill him?” He said, “O Messenger of Allah, if he had not confessed, I would have established evidence against him. Yes, I killed him.” He said, “How did you kill him?” He said, “He and I were gathering firewood from a tree, and he insulted me, which angered me, so I struck him on the side of his head with an axe.” The Messenger of Allah ﷺ said to him, “Do you have any wealth to pay for yourself?” He said, “O Messenger of Allah, by Allah, I have nothing but my axe and my cloak.” The Messenger of Allah ﷺ said to him, “Do you think your people will ransom you?” He said, “I am too insignificant to my people for that.” He threw the rope to the man and said, “Here is your companion.” When he turned away, the Messenger of Allah ﷺ said, “If he kills him, he will be like him.” The people caught up with the man and said to him, “Woe to you! The Messenger of Allah ﷺ says, ‘If he kills him, he will be like him.’” He returned to the Messenger of Allah ﷺ and said, “O Messenger of Allah, I was told that you said, ‘If he kills him, he will be like him,’ and I only took him by your command.” He said, “Do you not want him to bear your sin and the sin of your companion?” He said, “Yes.” He said, “Then that is how it is.”

✧ The Prophet ﷺ was brought a man who had killed another man, and he handed him over to the guardian of the slain man to execute him. The Prophet ﷺ said to those sitting with him, “The killer and the killed are in the Fire.” He said: A man followed him and informed him. When he was told, he let him go. He said: I saw him dragging his rope when he released him, walking away. I mentioned that to Habib, and he said: Sa'id b. Ashwa' told me, saying: He mentioned to me that the Prophet ﷺ commanded the man to pardon.

✧ A man brought a killer to the Messenger of Allah ﷺ, whose guardian he was. The Prophet ﷺ said, “Pardon him.” He refused. He said, “Take the blood money.” He refused. He said, “Go and kill him, for you will be like him.” He went, and the man was overtaken and told, “The Messenger of Allah ﷺ said, ‘Kill him, for you will be like him.’” So he let him go. The man passed by me dragging his rope.

✧ A man came to the Prophet ﷺ with another man and said, “This man killed my brother.” He said, “Go and kill him as he killed your brother.” The man said to him, “Fear Allah and pardon me, for it is greater for your reward and better for you and your brother on the Day of Resurrection.” He said: So he let him go. The Prophet ﷺ was informed, and he asked him. He told him what the man had said. He said, “You have set him free. Indeed, he will be better than what he does for you on the Day of Resurrection, when he will say, ‘O Lord, ask this one why he killed me.’”

كَانَ قُرَيْظَةُ وَالنَّضِيرُ وَكَانَ النَّضِيرُ أَشْرَفَ مِنْ قُرَيْظَةَ وَكَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلًا مِنَ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ وَدَى مِائَةَ وَسْقٍ مِنْ تَمْرٍ فَلَمَّا بُعِثَ النَّبِيُّ ﷺ قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ فَقَالَ ادْفَعُوهُ إِلَيْنَا نَقْتُلْهُ فَقَالُوا بَيْنَنَا وَبَيْنَكُمُ النَّبِيُّ ﷺ فَأَتَوْهُ فَنَزَلَتْ {وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ} [المائدة 42] وَالْقِسْطُ النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ {أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ} [المائدة 50]
✧ The Qurayzah and the Nadir tribes existed, and the Nadir were nobler than the Qurayzah. When a man from the Qurayzah killed a man from the Nadir, he was executed for it, but when a man from the Nadir killed a man from the Qurayzah, he paid a hundred wasq of dates as blood money. When the Prophet ﷺ was sent, a man from the Nadir killed a man from the Qurayzah. They said, “Hand him over to us so we can kill him.” They said, “Between us and you is the Prophet ﷺ.” So they came to him, and the verse was revealed: {And if you judge, judge between them with justice} [al-Ma'idah: 42]. Justice is a life for a life. Then it was revealed: {Is it the judgment of ignorance they seek?} [al-Ma'idah: 50]

اللهُ فِيهَا {فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ} [المائدة 42] إِلَى {الْمُقْسِطِينَ} [المائدة 42] إِنَّمَا نَزَلَتْ فِي الدِّيَةِ بَيْنَ بَنِي النَّضِيرِ وَبَنِي قُرَيْظَةَ وَذَلِكَ أَنَّ قَتْلَى النَّضِيرِ كَانَ لَهُمْ شَرَفٌ يُودَوْنَ الدِّيَةَ كَامِلَةً وَأَنَّ بَنِي قُرَيْظَةَ كَانُوا يُودَوْنَ نِصْفَ الدِّيَةِ فَتَحَاكَمُوا فِي ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ «فَأَنْزَلَ اللهُ ذَلِكَ فِيهِمْ فَحَمَلَهُمْ رَسُولُ اللهِ ﷺ عَلَى الْحَقِّ فِي ذَلِكَ فَجَعَلَ الدِّيَةَ سَوَاءً»
✧ Allah said in it: {So judge between them or turn away from them} [al-Ma'idah: 42] up to {the just} [al-Ma'idah: 42]. This was revealed only about the blood money between the Banu al-Nadir and Banu Qurayzah. That is because the slain of the Nadir had nobility and were paid full blood money, while the Banu Qurayzah were paid half the blood money. They brought their dispute about that to the Messenger of Allah ﷺ, and Allah revealed that concerning them. The Messenger of Allah ﷺ made them adhere to the truth in that matter and made the blood money equal.

انْطَلَقْتُ أَنَا وَالْأَشْتَرُ إِلَى عَلِيٍّ فَقُلْنَا هَلْ عَهِدَ إِلَيْكَ نَبِيُّ اللهِ ﷺ شَيْئًا لَمْ يَعْهَدْهُ إِلَى النَّاسِ عَامَّةً؟ قَالَ لَا إِلَّا مَا كَانَ فِي كِتَابِي هَذَا فَأَخْرَجَ كِتَابًا مِنْ قِرَابِ سَيْفِهِ فَإِذَا فِيهِ «الْمُؤْمِنُونَ تَكَافَأُ دِمَاؤُهُمْ وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ وَيَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ أَلَا لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ مَنْ أَحْدَثَ حَدَثًا فَعَلَى نَفْسِهِ أَوْ آوَى مُحْدِثًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ»
✧ Al-Ashtar and I went to 'Ali and said, “Did the Prophet of Allah ﷺ entrust you with anything that he did not entrust to the people in general?” He said, “No, except what is in this document of mine.” He brought out a document from the sheath of his sword, and in it was: “The believers' blood is equal, and they are one hand against others. The lowest of them may give protection on their behalf. Indeed, no believer is to be killed for a disbeliever, nor one with a covenant while his covenant stands. Whoever commits a crime, it is upon himself, or whoever shelters a criminal, upon him is the curse of Allah, the angels, and all people.”

✧ From the Prophet ﷺ, he said: "Whoever kills his slave, we kill him; and whoever cuts off the nose of his slave, we cut off his nose." Abu Abd al-Rahman said: Al-Hasan reported from Samurah. It is said that this is from the sahifah, not heard, except the hadith of the aqiqah. For it was said to al-Hasan: From whom did you hear the hadith of the aqiqah? He said: From Samurah. Not all scholars consider this narration authentic: his saying, "I said to al-Hasan: From whom did you hear the hadith of the aqiqah?"

أَنَّهُ نَشَدَ قَضَاءَ النَّبِيِّ ﷺ فِي ذَلِكَ فَقَامَ حَمَلُ بْنُ مَالِكٍ فَقَالَ «كُنْتُ بَيْنَ حُجْرَتَيِ امْرَأَتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ ﷺ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا»
✧ He asked about the judgment of the Prophet ﷺ concerning that, so Hamal b. Malik stood up and said: "I was between two chambers of my two wives, and one of them struck the other with a tent pole and killed her and her fetus. So the Prophet ﷺ ruled regarding her fetus with a ghurrah (a slave, male or female), and that she be executed for it."

✧ A Jew took silver ornaments from a girl, then crushed her head between two stones. They found her while she still had some life in her, and they began asking her as they brought people to her: "Is it this one? Is it this one?" She said: "Yes." So the Messenger of Allah ﷺ ordered that his head be crushed between two stones.

خَرَجَتْ جَارِيَةٌ عَلَيْهَا أَوْضَاحٌ فَأَخَذَهَا يَهُودِيٌّ فَرَضَخَ رَأْسَهَا وَأَخَذَ مَا عَلَيْهَا مِنَ الْحُلِيِّ فَأُدْرِكَتْ وَبِهَا رَمَقٌ فَأُتِيَ بِهَا رَسُولُ اللهِ ﷺ فَقَالَ «مَنْ قَتَلَكِ؟ فُلَانٌ؟» فَقَالَتْ بِرَأْسِهَا لَا قَالَ «فُلَانٌ؟» حَتَّى سَمَّى الْيَهُودِيَّ قَالَتْ بِرَأْسِهَا «نَعَمْ فَأُخِذَ فَاعْتَرَفَ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ فَرُضِخَ رَأْسُهُ بِحَجَرَيْنِ»
✧ A girl went out wearing silver ornaments, and a Jew seized her, crushed her head, and took the jewelry she had on. She was found while she still had some life in her, and she was brought to the Messenger of Allah ﷺ. He said: "Who killed you? So-and-so?" She nodded her head: no. He said: "So-and-so?" until he named the Jew, and she nodded her head: "Yes." So he was seized and confessed, and the Messenger of Allah ﷺ ordered that his head be crushed with two stones.

✧ From the Messenger of Allah ﷺ that he said: "It is not lawful to kill a Muslim except in one of three cases: a married adulterer who is stoned; a man who kills a Muslim deliberately and is killed; and a man who leaves Islam and fights Allah and His Messenger, so he is killed, crucified, or banished from the land."

✧ I heard Abu Juhayfah say: We asked Ali: "Do you have anything from the Messenger of Allah other than the Quran?" He said: "No, by the One who splits the grain and creates the soul, except that Allah may give a servant understanding of His Book, or what is in the sahifah." We said: "What is in the sahifah?" He said: "In it are the blood-money (aql), the ransom of captives, and that a Muslim is not to be killed for a disbeliever."

✧ Ali said: "The Messenger of Allah ﷺ did not entrust me with anything exclusively, apart from the people, except what is in a sahifah in the sheath of my sword." They kept at him until he brought out the sahifah, and in it was: "The believers' blood is equal; the lowest of them may offer their protection; they are one hand against others; a believer is not to be killed for a disbeliever, nor one with a covenant while his covenant stands."

✧ That the sister of al-Rubayyi', Umm Harithah, wounded a person, so they brought their dispute to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said: "Retribution, retribution." Then Umm al-Rubayyi' said: "O Messenger of Allah, will retribution be taken from so-and-so? No, by Allah, retribution will never be taken from her." The Messenger of Allah ﷺ said: "Glory be to Allah, O Umm al-Rabi'! Retribution is the Book of Allah." She said: "No, by Allah, retribution will never be taken from her." She kept on until they accepted blood money. Then the Messenger of Allah ﷺ said: "Among the servants of Allah are some who, if they swear by Allah, He fulfills their oath."

✧ That his paternal aunt broke the front tooth of a girl, so the Prophet of Allah ﷺ ruled for retribution. Her brother Anas b. al-Nadr said: "Will the front tooth of so-and-so be broken? No, by the One who sent you with the truth, the front tooth of so-and-so will not be broken." He said: And before that, they had asked her family for pardon and compensation, but when her brother swore—and he was the paternal uncle of Anas and the martyr on the day of Uhud—the people were content with pardon. The Prophet ﷺ said: "Among the servants of Allah are some who, if they swear by Allah, He fulfills their oath."

“Rubai, the paternal aunt of Anas, broke the tooth of a girl and they (her family) asked (the girl's family) to let her off, but they refused. They offered to pay compensatory money, but they refused. So they came to Prophet ﷺ who ordered retaliation. Anas bin Nadr said: 'O Messenger of Allah ﷺ, will the tooth of Rubai' be broken? By the One Who sent you with the truth, it will not be broken!' The Prophet ﷺ said: 'O Anas, what Allah has decreed is retaliation.' So the people accepted that and forgave her. The Messenger of Allah ﷺ said: 'there are among the slaves of Allah those who, if they swear by Allah, Allah fulfills their oath.'” (Using translation from Ibn Mājah 2649)

✧ A man bit the hand of another man, and he pulled his hand away, so his front tooth fell out, or he said "his front teeth." He sought help against him from the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said to him: "What do you order me to do? Do you order me to command him to leave his hand in your mouth for you to gnaw it as a stallion gnaws? If you wish, hand over your hand to him so he may bite it, then pull it away if you wish."

✧ A man from Banu Tamim fought a man, and he bit his hand; he pulled it away and knocked out his front tooth. They brought their dispute to the Messenger of Allah ﷺ, and he said: "One of you bites his brother as the young camel bites?" So he declared it void, meaning he invalidated it.

عَنْ عَمَّيْهِ سَلَمَةَ بْنِ أُمَيَّةَ وَيَعْلَى بْنِ أُمَيَّةَ قَالَا خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ وَمَعَنَا صَاحِبٌ لَنَا فَقَاتَلَ رَجُلًا مِنَ الْمُسْلِمِينَ فَعَضَّ الرَّجُلُ ذِرَاعَهُ فَجَذَبَهَا مِنْ فِيهِ فَطَرَحَ ثَنِيَّتَهُ فَأَتَى النَّبِيَّ ﷺ يَلْتَمِسُ الْعَقْلَ فَقَالَ «يَنْطَلِقُ أَحَدُكُمْ إِلَى أَخِيهِ فَيَعَضُّهُ عَضِيضَ الْفَحْلِ ثُمَّ يَأْتِي يَطْلُبُ الْعَقْلَ لَا عَقْلَ لَهَا» فَأَبْطَلَهَا رَسُولُ اللهِ ﷺ
✧ From his two paternal uncles, Salamah b. Umayyah and Ya'la b. Umayyah, who said: We went out with the Messenger of Allah ﷺ on the expedition of Tabuk, and with us was a companion of ours. He fought a man from the Muslims, and the man bit his forearm, so he pulled it out of his mouth and knocked out his front tooth. He came to the Prophet ﷺ seeking compensation. He said: "One of you goes to his brother and bites him as the stallion bites, then comes seeking compensation? There is no compensation for it." So the Messenger of Allah ﷺ invalidated it.

غَزَوْتُ مَعَ رَسُولِ اللهِ جَيْشَ الْعُسْرَةِ وَكَانَ أَوْثَقَ أَعْمَالِي فِي نَفْسِي وَكَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا فَعَضَّ أَحَدُهُمَا إِصْبَعَ صَاحِبِهِ فَانْتَزَعَ إِصْبَعَهُ فَأَنْدَرَ ثَنِيَّتَهُ فَسَقَطَتْ فَانْطَلَقَ إِلَى النَّبِيِّ ﷺ فَأَهْدَرَ ثَنِيَّتَهُ وَقَالَ «أَفَيَدَعُ يَدَهُ فِي فِيكَ تَقْضَمُهَا؟»
✧ I raided with the Messenger of Allah in the army of hardship, and it was the most reliable of my deeds in my estimation. I had a worker, and he fought a person; one of them bit the finger of his companion, and he pulled his finger out and knocked out his front tooth, and it fell out. He went to the Prophet ﷺ, and he declared the tooth void and said: "Should he leave his hand in your mouth for you to bite it?"

✧ A worker of Ya'la b. Munyah bit another on the forearm, and he pulled it out of his mouth. That was brought to the Prophet ﷺ, and his front tooth had fallen out. The Messenger of Allah ﷺ invalidated it and said: "Should he leave it in his mouth for him to bite it as the stallion bites?"

✧ His father raided with the Messenger of Allah ﷺ on the expedition of Tabuk and hired a worker. He fought a man, and the man bit his forearm; when it hurt him, he yanked it away and knocked out his front tooth. That was brought to the Messenger of Allah ﷺ, and he said: "One of you intends to bite his brother as the stallion bites?" So he invalidated the tooth.

The man cried out, and the Messenger of Allah ﷺ said to him, "Come and take retaliation." The man said, "Rather, I forgive, O Messenger of Allah."

أَنَّ رَجُلًا وَقَعَ فِي أَبٍ كَانَ لَهُ فِي الْجَاهِلِيَّةِ فَلَطَمَهُ الْعَبَّاسُ فَجَاءَ قَوْمَهُ فَقَالُوا لَيَلْطِمَنَّهُ كَمَا لَطَمَهُ فَلَبِسُوا السِّلَاحَ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَصَعِدَ الْمِنْبَرَ فَقَالَ «أَيُّهَا النَّاسُ أَيُّ أَهْلِ الْأَرْضِ تَعْلَمُونَ أَكْرَمُ عَلَى اللهِ؟» قَالُوا أَنْتَ قَالَ «فَإِنَّ الْعَبَّاسَ مِنِّي وَأَنَا مِنْهُ لَا تَسُبُّوا أَمْوَاتَنَا فَتُؤْذُوا أَحْيَاءَنَا» فَجَاءَ الْقَوْمُ فَقَالُوا يَا رَسُولَ اللهِ نَعُوذُ بِاللهِ مِنْ غَضَبِكَ اسْتَغْفِرْ لَنَا
✧ A man disparaged his father from the time of ignorance, and al-Abbas slapped him. His people came and said, "He must slap him as he slapped him." So they armed themselves. That reached the Prophet ﷺ, and he ascended the pulpit and said, "O people, which of the people of the earth do you know to be most honorable to Allah?" They said, "You." He said, "Indeed al-Abbas is from me and I am from him. Do not revile our dead and thereby harm our living." Then the people came and said, "O Messenger of Allah, we seek refuge in Allah from your anger; seek forgiveness for us."

كُنَّا نَقْعُدُ مَعَ رَسُولِ اللهِ ﷺ فِي الْمَسْجِدِ فَإِذَا قَامَ قُمْنَا فَقَامَ يَوْمًا فَقُمْنَا مَعَهُ حَتَّى لَمَّا بَلَغَ وَسَطَ الْمَسْجِدِ أَدْرَكَهُ أَعْرَابِيٌّ فَجَبَذَ بِرِدَائِهِ مِنْ وَرَائِهِ وَكَانَ رِدَاؤُهُ خَشِنًا فَحَمَّرَ رَقَبَتَهُ قَالَ يَا مُحَمَّدُ احْمِلْ لِي عَلَى بَعِيرَيَّ هَذَيْنِ فَإِنَّكَ لَا تَحْمِلُ مِنْ مَالِكَ وَلَا مِنْ مَالِ أَبِيكَ فَقَالَ رَسُولُ اللهِ ﷺ «لَا وَأَسْتَغْفِرُ اللهَ لَا أَحْمِلُ لَكَ حَتَّى تُقِيدَنِي مِمَّا جَبَذْتَ بِرَقَبَتِي» فَقَالَ الْأَعْرَابِيُّ لَا وَاللهِ لَا أُقِيدُكَ فَقَالَ رَسُولُ اللهِ ﷺ ذَلِكَ ثَلَاثَ مَرَّاتٍ كُلُّ ذَلِكَ يَقُولُ لَا وَاللهِ لَا أُقِيدُكَ فَلَمَّا سَمِعْنَا قَوْلَ الْأَعْرَابِيِّ أَقْبَلْنَا إِلَيْهِ سِرَاعًا فَالْتَفَتَ إِلَيْنَا رَسُولُ اللهِ ﷺ فَقَالَ «عَزَمْتُ عَلَى مَنْ سَمِعَ كَلَامِي أَنْ لَا يَبْرَحَ مَقَامَهُ حَتَّى آذَنَ لَهُ» فَقَالَ رَسُولُ اللهِ ﷺ لِرَجُلٍ مِنَ الْقَوْمِ «يَا فُلَانُ احْمِلْ لَهُ عَلَى بَعِيرٍ شَعِيرًا وَعَلَى بَعِيرٍ تَمْرًا» ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «انْصَرَفُوا»
✧ We used to sit with the Messenger of Allah ﷺ in the mosque, and when he stood we would stand. One day he stood and we stood with him until, when he reached the middle of the mosque, a Bedouin caught up with him and pulled his cloak from behind. His cloak was rough and it reddened his neck. He said, "O Muhammad, load for me on these two camels of mine, for you do not load from your own wealth nor from the wealth of your father." The Messenger of Allah ﷺ said, "No, and I seek Allah's forgiveness. I will not load for you until you give me retaliation for what you did by pulling my neck." The Bedouin said, "No, by Allah, I will not give you retaliation." The Messenger of Allah ﷺ said that three times, each time the Bedouin saying, "No, by Allah, I will not give you retaliation." When we heard the Bedouin's words, we hurried toward him. The Messenger of Allah ﷺ turned to us and said, "I solemnly adjure whoever hears my words not to leave his place until I give him permission." Then the Messenger of Allah ﷺ said to a man among the people, "O so-and-so, load for him on one camel barley and on one camel dates." Then the Messenger of Allah ﷺ said, "Depart."

أَنَّ النَّبِيَّ ﷺ بَعَثَ أَبَا جَهْمِ بْنَ حُذَيْفَةَ مُصَدِّقًا فَلَاحَّهُ رَجُلٌ فِي صَدَقَتِهِ فَضَرَبَهُ أَبُو جَهْمٍ فَأَتَوَا النَّبِيَّ ﷺ فَقَالُوا الْقَوَدُ يَا رَسُولَ اللهِ فَقَالَ «لَكُمْ كَذَا وَكَذَا» فَرَضُوا فَقَالَ رَسُولُ اللهِ ﷺ «إِنِّي خَاطِبٌ عَلَى النَّاسِ وَمُخْبِرُهُمْ بِرِضَاكُمْ» قَالُوا نَعَمْ فَخَطَبَ النَّبِيُّ ﷺ فَقَالَ «إِنَّ هَؤُلَاءِ أَتَوْنِي يُرِيدُونَ الْقَوَدَ فَعَرَضْتُ عَلَيْهِمْ كَذَا وَكَذَا فَرَضُوا» قَالُوا لَا فَهَّمَ الْمُهَاجِرُونَ بِهِمْ فَأَمَرَهُمُ النَّبِيُّ ﷺ أَنْ يَكُفُّوا فَكَفُّوا ثُمَّ دَعَاهُمْ فَقَالَ «أَرَضِيتُمْ؟» قَالُوا نَعَمْ قَالَ «فَإِنِّي خَاطِبٌ عَلَى النَّاسِ وَمُخْبِرُهُمْ بِرِضَاكُمْ» قَالُوا نَعَمْ فَخَطَبَ النَّاسَ ثُمَّ قَالَ «أَرَضِيتُمْ؟» قَالُوا نَعَمْ
✧ The Prophet ﷺ sent Abu Jahm b. Hudhayfah as a collector of zakah. A man disputed with him about his zakah, and Abu Jahm struck him. They came to the Prophet ﷺ and said, "Retaliation, O Messenger of Allah." He said, "You may have such and such." They were satisfied. Then the Messenger of Allah ﷺ said, "I am going to address the people and inform them of your satisfaction." They said, "Yes." So the Prophet ﷺ gave a sermon and said, "These people came to me seeking retaliation, and I offered them such and such, and they were satisfied." They said, "No." The Muhajirun were about to attack them, but the Prophet ﷺ ordered them to refrain, and they refrained. Then he called them and said, "Are you satisfied?" They said, "Yes." He said, "Then I will address the people and inform them of your satisfaction." They said, "Yes." So he addressed the people, then said, "Are you satisfied?" They said, "Yes."

أَنَّ يَهُودِيًّا رَأَى عَلَى جَارِيَةٍ أَوْضَاحًا فَقَتَلَهَا بِحَجَرٍ فَأُتِيَ بِهَا النَّبِيُّ ﷺ وَبِهَا رَمَقٌ فَقَالَ «أَقَتَلَكِ فُلَانٌ؟» فَأَشَارَ شُعْبَةُ بِرَأْسِهِ يَحْكِيهَا أَنْ لَا قَالَ «أَقَتَلَكِ فُلَانٌ؟» فَأَشَارَ شُعْبَةُ بِرَأْسِهِ يَحْكِيهَا أَنْ لَا فَقَالَ «أَقَتَلَكِ فُلَانٌ؟» فَأَشَارَ شُعْبَةُ بِرَأْسِهِ يَحْكِيهَا أَنْ نَعَمْ «فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَقَتَلَهُ بَيْنَ حَجَرَيْنِ»
✧ A Jew saw silver ornaments on a girl and killed her with a stone. She was brought to the Prophet ﷺ while she still had a spark of life. He said, "Did so-and-so kill you?" Shu'bah indicated with his head, imitating her, that she said no. He said, "Did so-and-so kill you?" Shu'bah indicated with his head, imitating her, that she said no. Then he said, "Did so-and-so kill you?" Shu'bah indicated with his head, imitating her, that she said yes. So the Messenger of Allah ﷺ summoned him and killed him between two stones.

أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ سَرِيَّةً إِلَى قَوْمٍ مِنْ خَثْعَمٍ فَاسْتَعْصَمُوا بِالسُّجُودِ فَقُتِلُوا فَقَضَى رَسُولُ اللهِ ﷺ بِنِصْفِ الْعَقْلِ وَقَالَ «أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ مَعَ مُشْرِكٍ» ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «أَلَا لَا تَرَاءَى نَارَاهُمَا»
✧ The Messenger of Allah ﷺ sent a military expedition to a people of Khath'am. They sought protection by prostrating, but they were killed. The Messenger of Allah ﷺ ruled for half the blood money and said, "I am free of any Muslim who lives with a polytheist." Then the Messenger of Allah ﷺ said, "Indeed, their two fires should not be visible to each other."

كَانَ فِي بَنِي إِسْرَائِيلَ الْقِصَاصُ وَلَمْ تَكُنْ فِيهِمُ الدِّيَةُ فَأَنْزَلَ اللهُ ﷻ {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحَرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ} [البقرة 178] إِلَى قَوْلِهِ {فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ} [البقرة 178] فَالْعَفْوُ أَنْ يَقْبَلَ الدِّيَةَ فِي الْعَمْدِ وَ {فاتِّبَاعٌ بِالْمَعْرُوفٍ} [البقرة 178] يَقُولُ يَتْبَعُ هَذَا بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ وَيُؤَدِّي هَذَا بِإِحْسَانٍ {ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ} [البقرة 178] مَا كُتِبَ عَلَى مَنْ كَانَ قِبْلَكُمْ إِنَّمَا هُوَ كَانَ الْقِصَاصُ وَلَيْسَ الدِّيَةَ
✧ Among the Children of Israel there was retribution and no blood money. Then Allah, Mighty and Sublime, revealed: "Retribution is prescribed for you in the matter of the murdered: the free for the free, the slave for the slave" up to His saying: "But whoever is pardoned by his brother anything, then follow up with appropriate behavior and payment to him with kindness." [al-Baqarah: 178] Pardon is accepting blood money in cases of intentional killing. "Then follow up with appropriate behavior" means this one follows with appropriate behavior, and "payment to him with kindness" means this one pays with kindness. "That is an alleviation from your Lord" [al-Baqarah: 178] compared to what was prescribed for those before you; for them there was only retribution and no blood money.

Then Allah revealed blood money and made it for this nation as an alleviation from what was upon the Children of Israel."

✧ The Messenger of Allah ﷺ said: "Whoever is killed and has a slain person (in revenge) is of the best of the two outcomes: either to be executed or to receive compensation." Ahmad bin Ibrahim bin Muhammad informed us, saying: Ibn 'Aidh informed us, saying: Yahya, the son of Hamza, informed us, saying: Al-Awza'i informed us, saying: Yahya bin Abi Kathir informed me that Abu Salama reported that the Messenger of Allah ﷺ said: "Whoever is killed and has a slain person (in revenge) is (to be) executed." ✧ The Messenger of Allah ﷺ stood on the day of the conquest of Makkah on the steps of the Kaaba, praised Allah, and extolled Him, and said: “Praise be to Allah who fulfilled His promise, aided His servant, and defeated the confederates alone. Indeed, the deliberate-unintentional killing by whip and stick, resembling intentional, carries one hundred camels, of which forty are pregnant with their young.”

✧ That the Messenger of Allah ﷺ said: “Whoever kills someone accidentally, his blood money is one hundred camels: thirty one-year-old she-camels, thirty two-year-old she-camels, thirty three-year-old she-camels, and ten two-year-old male camels.” He said: We found that the Messenger of Allah ﷺ valued it for the people of villages at four hundred dinars or its equivalent in silver. He valued it for the people of camels: when they were expensive, he raised their value, and when they were cheap, he reduced their value, down to about the time it happened. So their value in the time of the Messenger of Allah ﷺ reached between four hundred dinars and eight hundred dinars, or its equivalent in silver. And the Messenger of Allah ﷺ ruled that for those whose blood money is in cattle, it is two hundred cows, and for those whose blood money is in sheep, it is two thousand sheep. And the Messenger of Allah ﷺ ruled that the blood money is inherited according to their obligatory shares, and whatever remains is for the male relatives. And the Messenger of Allah ﷺ ruled that the woman’s male relatives pay on her behalf, whoever they may be, and they do not inherit anything from it except what remains after her heirs, and if she is killed, her blood money is divided among her heirs, and they may kill her killer. Abu Abd al-Rahman said: This is a rejected hadith, and Sulayman b. Musa is not strong in hadith, nor is Muhammad b. Rashid.

✧ I heard Ibn Masud say: “The Messenger of Allah ﷺ ruled the blood money for accidental killing as twenty one-year-old she-camels, twenty one-year-old male camels, twenty two-year-old she-camels, twenty four-year-old she-camels, and twenty three-year-old she-camels.” Abu Abd al-Rahman said: Al-Hajjaj b. Artah is weak and cannot be used as evidence.

✧ A man killed another man during the time of the Messenger of Allah ﷺ, and the Prophet ﷺ set his blood money at twelve thousand. And he mentioned His statement: {And they did not resent except that Allah and His Messenger had enriched them from His bounty} [al-Tawbah 74], regarding their taking of the blood money. The wording is that of Abu Dawud. 6979 Muhammad b. Maymun informed us, he said: Sufyan narrated to us from 'Amr from 'Ikrimah—we heard him once saying—from Ibn 'Abbas that the Prophet ﷺ "decreed twelve thousand, meaning for the blood money." Abu 'Abd al-Rahman said: Muhammad b. Muslim is not strong, and the correct position is that it is mursal, and Ibn Maymun is also not strong.

أَنَّ امْرَأَةً خَذَفَتِ امْرَأَةً فَأَسْقَطَتِ الْمَخْذُوفَةُ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ «فَجَعَلَ عَقْلَ وَلَدِهَا خَمْسَمِائَةٍ مِنَ الْغَنَمِ وَنَهَى يَوْمَئِذٍ عَنِ الْخَذْفِ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا وَهْمٌ وَيَنْبَغِي أَنْ يَكُونَ أَرَادَ مِائَةً مِنَ الْغَنَمِ وَقَدْ رُوِيَ النَّهْيُ عَنِ الْخَذْفِ عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ عَبْدِ اللهِ بْنِ مُغَفَّلٍ
✧ A woman threw a pebble at another woman, and the woman who was struck miscarried. The matter was brought to the Prophet ﷺ, "so he set the blood money for her child as five hundred sheep, and on that day he forbade throwing pebbles." Abu 'Abd al-Rahman said to us: This is a mistake, and it should be that he intended one hundred sheep. And the prohibition of throwing pebbles has been narrated from 'Abd Allah b. Buraydah from 'Abd Allah b. Mughaffal.

They brought their dispute to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ ruled that the blood money for her fetus was a ghurrah, a male or female slave, and he ruled the blood money of the woman upon her 'āqilah, and he made her children and those with them inherit her. Then Ḥaml b. al-Nābighah al-Hudhalī said, 'O Messenger of Allah, how can I be fined for one who did not drink, eat, speak, or cry out? Such a one should be disregarded.' The Messenger of Allah ﷺ said, 'This man is one of the brothers of the soothsayers, because of his rhymed speech that he produced.'

✧ There were two women who were neighbors and had a quarrel, and one of them threw a stone at the other and caused her to miscarry a boy whose hair had grown, stillborn, and the woman died. He ruled the blood money upon the 'āqilah. Her paternal uncle said, 'She miscarried, O Messenger of Allah, a boy whose hair had grown.' The father of the killer said, 'He is lying. By Allah, he did not cry out, drink, or eat; such a one should be disregarded.' The Prophet ﷺ said, 'Is it rhymed speech like the rhymed speech of the Jāhiliyyah and its soothsaying? Pay a ghurrah for the boy.' Ibn 'Abbas said: One of them was Mulaykah and the other was Umm Ghatif.

✧ That the Messenger of Allah ﷺ wrote to the people of Yemen a letter containing the obligatory shares, the sunnahs, and the blood monies, and sent it with Amr b. Hazm. It was read to the people of Yemen, and this is its copy: From Muhammad the Prophet to Shurahbil b. Abd Kulal, al-Harith b. Abd Kulal, and Nu'aym b. Abd Kulal, the qayl of Dhu Ru'ayn, Ma'afir, and Hamdan. To proceed: And it was in his letter that whoever kills a believer intentionally upon clear evidence, then there is retaliation unless the guardians of the slain person are satisfied. And for the life, the blood money is one hundred camels. And for the nose, if it is entirely cut off, the full blood money. And for the tongue, the full blood money. And for the two lips, the full blood money. And for the two testicles, the full blood money. And for the penis, the full blood money. And for the backbone, the full blood money. And for the two eyes, the full blood money. And for one foot, half the blood money. And for a head wound reaching the brain, one-third of the blood money. And for a wound penetrating the body cavity, one-third of the blood money. And for a wound that dislodges a bone, fifteen camels. And for each finger of the hand or foot, ten camels. And for a tooth, five camels. And for a clarifying wound, five camels. And a man is killed for a woman. And upon the people of the covenant, one thousand dinars." Abu Abd al-Rahman said: Muhammad b. ✧ That the Messenger of Allah ﷺ wrote to the people of Yemen a letter containing the obligatory shares, the sunnahs, and the blood monies, and sent it with Amr b. Hazm. ✧ I read the letter of the Messenger of Allah ﷺ which he wrote for Amr b. Hazm when he sent him to Najran. The letter was with Abu Bakr b. Hazm. The Messenger of Allah ﷺ wrote: "This is a clarification from Allah and His Messenger: {O you who believe, fulfill the contracts} [Al-Ma'idah: 1]." He wrote verses from it until he reached {Indeed, Allah is swift in account} [Al 'Imran: 199]. Then he wrote: "This is the book of wounds. For the life, one hundred camels," and so on.

✧ On the authority of the Messenger of Allah ﷺ: “This is a clarification from Allah and His Messenger: {O you who believe, fulfill your contracts} [Al-Ma'idah 1].” And he recited verses from it, then he said: “For a life, one hundred camels; for an eye, fifty; for a hand, fifty; for a foot, fifty; for a wound reaching the brain (ma'mumah), one-third of the blood money; for a wound penetrating the body cavity (ja'ifah), one-third of the blood money; for a wound that exposes the bone (munaqqilah), fifteen camels; for each finger, ten; for each tooth, five; for a wound that exposes the bone without displacing it (mudihah), five.”

أَنَّ أَعْرَابِيًّا أَتَى بَابَ النَّبِيِّ ﷺ فَأَلْقَمَ عَيْنَهُ خَصَاصَةَ الْبَابِ فَضَرَبَهُ النَّبِيُّ ﷺ فَتَوَخَّاهُ بِحَدِيدَةٍ أَوْ عُودٍ لِيَفْقَأَ عَيْنَهُ فَلَمَّا أَنْ بَصُرَ انْقَمَعَ فَقَالَ لَهُ النَّبِيُّ ﷺ «أَمَا إِنَّكَ لَوْ ثَبَتَّ لَفَقَأْتُ عَيْنَكَ»
✧ A Bedouin came to the door of the Prophet ﷺ and put his eye to a crack in the door. The Prophet ﷺ struck at him with an iron implement or a stick, intending to pierce his eye. When he saw that, he withdrew. The Prophet ﷺ said to him: “If you had remained, I would have pierced your eye.”

✧ A man looked through a hole in the door of the Prophet ﷺ, and the Messenger of Allah ﷺ had with him a comb with which he was scratching his head. When the Messenger of Allah ﷺ saw him, he said: “If I had known that you were watching me, I would have thrust it into your eye. Permission is required precisely because of sight.”

✧ That someone tried to pass in front of him, so he pushed him away, but he did not go back, so he struck him. The boy went out crying until he came to Marwan and informed him. Marwan said to Abu Sa'id: “Why did you strike your brother's son?” He said: “I did not strike him; I only struck the devil. I heard the Messenger of Allah ﷺ say: ‘When one of you is praying and a person wants to pass in front of him, let him push him away as much as he can; if he refuses, then let him fight him, for he is a devil.’”
