al-Sunan al-Kubra (al-Nasa'i) 6957

✧ Interpretation of the Saying of Allah Almighty, "But whoever is forgiven something by his brother as a favor [i.e., out of kindness and generosity] then [let him] follow [his brother] with acceptable behavior and [let him] fulfill [his obligations to] him in a good manner." [al-Baqarah: 178]

الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ عَنْ سُفْيَانَ عَنْ عَمْرٍو عَنْ مُجَاهِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

كَانَ فِي بَنِي إِسْرَائِيلَ الْقِصَاصُ وَلَمْ تَكُنْ فِيهِمُ الدِّيَةُ فَأَنْزَلَ اللهُ ﷻ {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحَرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ} [البقرة 178] إِلَى قَوْلِهِ {فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ} [البقرة 178] فَالْعَفْوُ أَنْ يَقْبَلَ الدِّيَةَ فِي الْعَمْدِ وَ {فاتِّبَاعٌ بِالْمَعْرُوفٍ} [البقرة 178] يَقُولُ يَتْبَعُ هَذَا بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ وَيُؤَدِّي هَذَا بِإِحْسَانٍ {ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ} [البقرة 178] مَا كُتِبَ عَلَى مَنْ كَانَ قِبْلَكُمْ إِنَّمَا هُوَ كَانَ الْقِصَاصُ وَلَيْسَ الدِّيَةَ

✧ Among the Children of Israel there was retribution and no blood money. Then Allah, Mighty and Sublime, revealed: "Retribution is prescribed for you in the matter of the murdered: the free for the free, the slave for the slave" up to His saying: "But whoever is pardoned by his brother anything, then follow up with appropriate behavior and payment to him with kindness." [al-Baqarah: 178] Pardon is accepting blood money in cases of intentional killing. "Then follow up with appropriate behavior" means this one follows with appropriate behavior, and "payment to him with kindness" means this one pays with kindness. "That is an alleviation from your Lord" [al-Baqarah: 178] compared to what was prescribed for those before you; for them there was only retribution and no blood money.
