أَخْبَرَنَا يُوسُفُ بْنُ سَعِيدِ بْنِ مُسْلِمٍ الْمِصِّيصِيُّ قَالَ حَدَّثَنَا حَجَّاجٌ عَنِ ابْنِ جُرَيْجٍ قَالَ أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ أَنَّهُ سَمِعَ طَاوُسًا يُحَدِّثُ عَنِ ابْنِ عَبَّاسٍ عَنْ عُمَرَ

أَنَّهُ نَشَدَ قَضَاءَ النَّبِيِّ ﷺ فِي ذَلِكَ فَقَامَ حَمَلُ بْنُ مَالِكٍ فَقَالَ «كُنْتُ بَيْنَ حُجْرَتَيِ امْرَأَتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ ﷺ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا»

✧ He asked about the judgment of the Prophet ﷺ concerning that, so Hamal b. Malik stood up and said: "I was between two chambers of my two wives, and one of them struck the other with a tent pole and killed her and her fetus. So the Prophet ﷺ ruled regarding her fetus with a ghurrah (a slave, male or female), and that she be executed for it."
