✧ The Blood Money of the Woman's Fetus

الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ عَنِ ابْنِ الْقَاسِمِ قَالَ حَدَّثَنِي مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ

أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمَّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ فَقَالَ الَّذِي قَضَى عَلَيْهِ كَيْفَ أُغَرَّمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا اسْتَهَلَّ وَلَا نَطَقَ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّمَا هَذَا مِنَ الْكُهَّانِ»

✧ The Messenger of Allah ﷺ ruled concerning a fetus killed in its mother's womb that a ghurrah—a male or female slave—was due. The one against whom the ruling was made said, 'How can I be fined for one who did not drink, eat, cry out, or speak? Such a one should be disregarded.' The Messenger of Allah ﷺ said, 'This man is one of the soothsayers.'
