أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ عَبْدِ اللهِ قَالَ حَدَّثَنَا أَبُو مَعْمَرٍ قَالَ حَدَّثَنَا عَبْدُ الْوَارِثِ قَالَ حَدَّثَنَا قَطَنٌ أَبُو الْهَيْثَمِ قَالَ حَدَّثَنَا أَبُو يَزِيدَ الْمَدَنِيُّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ
أَوَّلُ قَسَامَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ كَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَ رَجُلًا مِنْ قُرَيْشٍ مِنْ فَخِذٍ أُخْرَى قَالَ فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ بِهِ رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَاهُ عِقَالًا فَشَدَّ بِهِ عُرْوَةَ جُوَالِقِهِ فَلَمَّا نَزَلُوا عُقِلَتِ الْإِبِلُ إِلَّا بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الْإِبِلِ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ؟ قَالَ مَرَّ بِي رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَاسْتَغَاثَنِي قَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَيْتُهُ عِقَالَهُ فَحَذَفَهُ بِعَصًا كَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ قَالَ أَتَشْهَدُ الْمَوْسِمَ؟ قَالَ مَا أَشْهَدُ وَرُبَّمَا شَهِدْتُ قَالَ هَلْ أَنْتَ مُبَلِّغٌ عَنِّي رِسَالَةً مَرَّةً مِنَ الدَّهْرِ؟ قَالَ نَعَمْ قَالَ إِذَا شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوكَ فَنَادِ يَا آلَ بَنِي هَاشِمٍ فَإِذَا أَجَابُوكَ فَسَلْ عَنْ أَبِي طَالِبٍ [316] فَأَخْبِرْهُ أَنَّ فُلَانًا قَتَلَنِي فِي عِقَالٍ قَالَ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا؟ قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ ثُمَّ مَاتَ فَوَلِيتُ دَفْنَهُ فَقَالَ كَانَ أَهْلُ ذَلِكَ مِنْكَ قَالَ فَمَكَثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الْيَمَانِيَّ الَّذِي كَانَ أَوْصَى إِلَيْهِ أَنْ يُبَلِّغَ عَنْهُ وَافَى الْمَوْسِمَ فَقَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ؟ قَالُوا هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلَانٌ أَنْ أُبَلِّغَكَ رِسَالَةً أَنَّ فُلَانًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ اخْتَرْ مِنَّا إِحْدَى ثَلَاثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنَ الْإِبِلِ فَإِنَّكَ قَتَلْتَ صَاحِبَنَا خَطَأً وَإِنْ شِئْتَ حَلَفَ خَمْسُونَ مِنْ قَوْمِكَ أَنَّكَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاكَ بِهِ فَأَتَى قَوْمَهُ فَذَكَرَ ذَلِكَ لَهُمْ فَقَالُوا نَحْلِفُ فَأَتَتْهُ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا رَجُلًا مِنَ الْخَمْسِينَ وَلَا تُصْبِرَ يَمِينَهُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلًا أَنْ يَحْلِفُوا مَكَانَ مِائَةٍ مِنَ الْإِبِلِ يُصِيبُ كُلَّ رَجُلٍ بَعِيرَانِ فَهَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلَا تُصْبِرْ يَمِينِي حَيْثُ تُصْبَرُ الْأَيْمَانُ فَقَبِلَهُمَا وَجَاءَ ثَمَانِيَةٌ وَأَرْبَعُونَ رَجُلًا حَلَفُوا قَالَ ابْنُ عَبَّاسٍ «فَوَالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنَ الثَّمَانِيَةِ وَالْأَرْبَعِينَ عَيْنٌ تَطْرِفُ»

✧ The first qasamah in the Jahiliyyah was this: a man of Banu Hashim hired a man of Quraysh from another clan. He set out with him with his camels. A man of Banu Hashim passed by him whose the handle of his sack had broken, so he said: 'Help me with a rope to tie the handle of my sack so that the camels do not run away.' So he gave him a rope and he tied the handle of his sack with it. When they halted, all the camels were hobbled except one camel. The one who hired him said: 'What is the matter with this camel that it has not been hobbled among the camels?' He said: 'It has no rope.' He said: 'Where is its rope?' He said: 'A man of Banu Hashim passed by me whose the handle of his sack had broken, and he asked me for help, saying: "Help me with a rope to tie the handle of my sack so that the camels do not run away." So I gave him its rope.' He struck him with a stick, and that was his death. Then a man from Yemen passed by him and said: 'Will you attend the fair?' He said: 'I do not attend it, but perhaps I may attend it.' He said: 'Will you convey a message from me once in your life?' He said: 'Yes.' He said: 'When you attend the fair, call out: O people of Quraysh! When they respond to you, call out: O people of Banu Hashim! When they respond to you, ask for Abu Talib and tell him that so-and-so killed me for the sake of a rope.' The narrator said: The hired man died. When the one who had hired him came, Abu Talib came to him and said: 'What did our companion do?' He said: 'He fell ill, and I took good care of him; then he died, and I took charge of his burial.' Abu Talib said: 'It was you who deserved that.' He remained for some time. Then the Yemeni man who had been entrusted to convey the message arrived at the fair and said: 'O people of Quraysh!' They said: 'These are Quraysh.' He said: 'O people of Banu Hashim!' They said: 'These are Banu Hashim.' He said: 'Where is Abu Talib?' They said: 'This is Abu Talib.' He said: 'So-and-so commanded me to convey to you a message: that so-and-so killed him for the sake of a rope.' Abu Talib came to the killer and said: 'Choose one of three options: if you wish, pay one hundred camels, for you killed our companion by mistake; if you wish, fifty of your people swear that you did not kill him; if you refuse, we will kill you in retaliation for him.' He went to his people and mentioned that to them. They said: 'We will swear.' A woman of Banu Hashim who was married to a man among them and had borne him a son came to Abu Talib and said: 'O Abu Talib, I would like you to excuse my son from being one of the fifty and not make him take the oath.' So he did. Then a man among them came and said: 'O Abu Talib, you wanted fifty men to swear in place of one hundred camels, so that each man would get two camels. Here are two camels, accept them from me and do not make me take the oath where oaths are taken.' He accepted them. Then forty-eight men came and swore. Ibn Abbas said: 'By the One in Whose hand is my soul, before the year had passed, not one of the forty-eight had an eye that blinked.'
