أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ قَالَ حَدَّثَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مَنْصُورٍ قَالَ سَمِعْتُ إِبْرَاهِيمَ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

أَنَّ رَجُلًا مِنْ هُذَيْلٍ كَانَتْ لَهُ امْرَأَتَانِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ الْفُسْطَاطِ فَأَسْقَطَتْ فَقِيلَ أنَدِيَ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ فَقَالَ أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟ «فَقَضَى فِيهِ رَسُولُ اللهِ ﷺ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ وَجُعِلَتْ عَلَى عَاقِلَةِ الْمَرْأَةِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَرْسَلَهُ سُلَيْمَانُ الْأَعْمَشُ

✧ A man from Hudhayl had two wives, and one of them threw a tent pole at the other and caused her to miscarry. It was said, 'Should we pay for one who did not eat, drink, or cry out?' He said, 'Is it rhymed speech like the rhymed speech of the Bedouins?' The Messenger of Allah ﷺ ruled in it a ghurrah of a male or female slave, and it was placed upon the 'āqilah of the woman. Abu 'Abd al-Rahman said: Sulayman al-A'mash narrated it as mursal.
