أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ عَنْ عَوْفِ بْنِ أَبِي جَمِيلَةَ قَالَ حَدَّثَنِي حَمْزَةُ أَبُو عُمَرَ الْعَائِذِيُّ قَالَ حَدَّثَنَا عَلْقَمَةُ بْنُ وَائِلٍ عَنْ وَائِلٍ قَالَ

شَهِدْتُ رَسُولَ اللهِ ﷺ حِينَ جِيءَ بِالْقَاتِلِ يَقُودُهُ وَلِيُّ الْمَقْتُولِ فِي نِسْعَةٍ فَقَالَ رَسُولُ اللهِ ﷺ لِوَلِيِّ الْمَقْتُولِ «أَتَعْفُو؟» قَالَ لَا قَالَ «تَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ؟» قَالَ نَعَمْ قَالَ «اذْهَبْ بِهِ» فَلَمَّا تَوَلَّى مِنْ عِنْدِهِ دَعَاهُ فَقَالَ لَهُ «أَتَعْفُو؟» قَالَ لَا قَالَ «أَتَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ» قَالَ نَعَمْ قَالَ «اذْهَبْ» فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ «أَمَا إِنَّكَ إِنْ عَفَوْتَ عَنْهُ يَبُوءُ بِإِثْمِهِ وَإِثْمِ صَاحِبِهِ» فَعَفَا عَنْهُ وَتَرَكَهُ قَالَ فَأَنَا رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ 6901 أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا يَحْيَى قَالَ حَدَّثَنَا جَامِعُ بْنُ مَطَرٍ الْحَبَطِيُّ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ بِمِثْلِهِ قَالَ يَحْيَى وَهُو أَحْسَنُ مِنْهُ

✧ I witnessed the Messenger of Allah ﷺ when the killer was brought, led by the guardian of the slain man with a rope. The Messenger of Allah ﷺ said to the guardian of the slain man, “Will you pardon?” He said, “No.” He said, “Will you take the blood money?” He said, “No.” He said, “Then will you kill him?” He said, “Yes.” He said, “Take him away.” When he turned away from him, he called him and said to him, “Will you pardon?” He said, “No.” He said, “Will you take the blood money?” He said, “No.” He said, “Then will you kill him?” He said, “Yes.” He said, “Go.” The Messenger of Allah ﷺ then said, “Indeed, if you pardon him, he will bear his sin and the sin of his companion.” So he pardoned him and left him. He said: I saw him dragging his rope.
