أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَسَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ
أَنَّهُ قَالَ اقْتَتَلَتِ امْرَأَتَانِ مِنْ هُذَيْلٍ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ وَذَكَرَ كَلِمَةً مَعْنَاهَا فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا إِلَى رَسُولِ اللهِ ﷺ فَقَضَى رَسُولُ اللهِ ﷺ أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ وَقَضَى بِدِيَةِ الْمَرْأَةِ عَلَى عَاقِلَتِهَا وَوَرَّثَهَا وَلَدَهَا وَمَنْ مَعَهُمْ فَقَالَ حَمَلُ بْنُ النَّابِغَةِ الْهُذَلِيُّ يَا رَسُولَ اللهِ كَيْفَ أُغَرَّمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ»

✧ He said: Two women from Hudhayl fought, and one of them threw a stone at the other—and he mentioned a word meaning—and killed her and what was in her womb. They brought their dispute to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ ruled that the blood money for her fetus was a ghurrah, a male or female slave, and he ruled the blood money of the woman upon her 'āqilah, and he made her children and those with them inherit her. Then Ḥaml b. al-Nābighah al-Hudhalī said, 'O Messenger of Allah, how can I be fined for one who did not drink, eat, speak, or cry out? Such a one should be disregarded.' The Messenger of Allah ﷺ said, 'This man is one of the brothers of the soothsayers, because of his rhymed speech that he produced.'
