✧ The Messenger of Allah ﷺ commanded that charity be given. A man came with clusters from this sahl — Sufyan said, meaning the shīṣ (inferior dates) — and the Messenger of Allah ﷺ said, “Who brought this?” No one would bring something but it was attributed to the one who brought it. Then it was revealed: {And do not aim toward the defective therefrom, spending [from that]} [Al-Baqarah: 267]. He said, “And the Messenger of Allah ﷺ forbade the juʿrūr and the color of ḥubayq from being taken in charity.” Al-Zuhrī said, “Two varieties of charity dates.”

The Messenger of Allah ﷺ said: Such-and-such amount of dates. The man said: So-and-so has transgressed against me and taken from me such-and-such, and added a sa‘. The Messenger of Allah ﷺ said: Then how will it be when there are appointed over you those who will transgress against you more severely than this transgression? The people engaged in discussion and the talk overwhelmed them, until one of them said: O Messenger of Allah, if a man is absent from you with his camels, livestock, and crops, and he pays the zakat of his wealth, but the right is transgressed against him, what should he do while he is absent? The Messenger of Allah ﷺ said: Whoever pays the zakat of his wealth with a good heart, seeking thereby the face of Allah and the abode of the Hereafter, and does not hide anything of his wealth, and establishes the prayer and pays the zakat, then the right is transgressed against him, and he takes up his weapon and fights and is killed, then he is a martyr.

✧ In the year of al-Ramadiyy, when the land became barren, ‘Umar b. al-Khattab wrote to ‘Amr b. al-‘As: From ‘Abdullah ‘Umar, Commander of the Believers, to ‘Amr b. al-‘As. Al-‘Umari informed me: What do you care if you are fat and those with you are fat, while I and those with me are thin? O help! ‘Amr wrote back: Peace be upon you. To proceed: Labbayk, labbayk. A caravan has come to you whose first is with you and whose last is with me, and I hope to find a way to send by sea. When the first caravan arrived, he called al-Zubayr and said: Go out with the first of this caravan and meet it tomorrow, and carry to every household as much as you can carry to me. For those you cannot carry to, order for every household a camel with its load, and tell them to clothe the people as they have come, and to slaughter the camel, carry its hair, cut its meat into strips, use its skin for sandals, and then take a piece of dried meat, a piece of fat, and a bowl of flour, cook it and eat until Allah brings them provision. Al-Zubayr refused to go out, so he said: By Allah, you will not find the like of it until you leave this world. Then he called another, I think Talhah, and he came. Then he called Abu ‘Ubaydah b. al-Jarrah, and he went out for that. When he returned, he sent him a thousand dinars. Abu ‘Ubaydah said: I did not work for you, O Ibn Khattab; I worked only for Allah, and I will not take anything for that. ‘Umar said: The Messenger of Allah ﷺ gave us for things he sent us for, and we disliked it, but the Messenger of Allah ﷺ insisted upon us. So accept it, O man, and use it to help you in your worldly affairs. So Abu ‘Ubaydah b. al-Jarrah accepted it.

Yasār, that the Messenger of God ﷺ said: “Charity is not lawful except for five,” and he mentioned the hadith. This is according to my condition in the preface of the book that it is authentic, for Mālik may send it as mursal, but a trustworthy narrator connects it and gives it a chain, and the decisive statement is the statement of the trustworthy narrator who connects it and gives it a chain.

I took a letter from Thumamah bin ‘Abd Allah bin Anas. He presumed that Abu Bakr had written it for Anas when he sent him (to Al Bahrain) as a collector of zakat. This (letter) was stamped with the stamp of the Messenger of Allah ﷺ and was written by Abu Bakr for him(Anas). This letter goes “This is the obligatory sadaqah(zakat) which the Messenger of Allah ﷺ imposed on Muslims which Allah commanded his Prophet ﷺ to impose. Those Muslims who are asked for the proper amount must give it, but those who are asked for more than that must not give it. For less than twenty five Camels a goat is to be given for every five Camels. When they reach twenty five to thirty five, a she Camel in her second year is to be given. If there is no she Camel in her second year, a male Camel in its third year is to be given. When they reach thirty six to forty five, a she Camel in her third year is to be given. When they reach forty six to sixty, a she Camel in her fourth year which is ready to be covered by a stallion is to be given. When they reach sixty one to seventy five, a she Camel in her fifth year is to be given. When they reach seventy six to ninety, two she Camel in their third year are to be given. When they reach ninety one to a hundred and twenty, two she Camels in their fourth year are ready to be covered by a stallion are to be given. When they exceed a hundred and twenty, a she Camel in her third year is to be given for every forty and a she Camel in her fourth year for every fifty(Camels). In case the ages of the Camel vary in the payment of obligatory sadaqah(zakat) If anyone whose Camels reach the number on which a she Camel in her fifth year is payable does not possess one but possess one in her fourth year, that will be accepted from him along with two goats if he can conveniently give them, or else twenty dirhams. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable does not possess but possesses one in her fifth year, that will be accepted from him, and the collector must give him twenty dirhams or two goats. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable possesses only one in her third year, that will be accepted from him.” Abu Dawud said From here I could not retain accurately from Musa as I liked “And he must give along with it two goats if he can conveniently give them, or else twenty dirhams. If anyone whose Camels reach the number on which a she Camel in her third year is payable possesses only one in her fourth year, that will be accepted from him.” Abu Dawud said (I was doubtful) up to here, and retained correctly onward “and the collector must give him twenty dirhams or two goats. If anyone whose Camels reach the number on which a she Camel in her third year is payable does not possess one but possesses one in her second year, that will be accepted from him, but he must give two goats or twenty dirhams. Anyone whose Camels reach the number on which a she Camel in her second year is payable does not possess one but possesses a male Camel in its third year, that will be accepted from him, and nothing extra will be demanded along with it. If anyone possesses only four Camels, no zakat will be payable on them unless their owner wishes. If the numbers of the pasturing goats reach forty to one hundred and twenty, one goat is to be given. Over one hundred and twenty up to two hundred, two goats are to be given. If they exceed two hundred reaching three hundred, three goats are to be given. If they exceed three hundred, a goat is to be for every hundred. An old sheep, one with a defect in the eye, or a male goat is not to be accepted as sadaqah (zakat) unless the collector wishes. Those which are in separate flocks are not to be brought together and those which are in one flock are not to be separated from fear of sadaqah(zakat). Regarding what belongs to two partners, they can make claims for restitution from one another with equity, If a man’s pasturing animals are less than forty, no sadaqah(zakat) is due on them unless their owner wishes. On sliver dirhams a fortieth is payable, but if there are only a hundred and ninety, nothing is payable unless their owner wishes.” (Using translation from Abū Dāʾūd 1567)

He tied it to his sword, and Abu Bakr acted upon it until he passed away, then Umar acted upon it until he passed away. In it was: "For five camels, one sheep; for ten, two sheep; for fifteen, three sheep; for twenty, four sheep; for twenty-five, a bint makhāḍ (a one-year-old female camel) up to thirty-five. If one more is added, then a bint labūn (a two-year-old female camel) up to forty-five. If one more is added, then a ḥiqqah (a three-year-old female camel) up to sixty. If one more is added, then a jadhaʿah (a four-year-old female camel) up to seventy-five. If one more is added, then two bint labūn up to ninety. If one more is added, then two ḥiqqahs up to one hundred and twenty. If the camels are more than that, then for every fifty a ḥiqqah and for every forty a bint labūn. For sheep: for every forty sheep, one sheep up to one hundred and twenty. If one more is added, then two sheep up to two hundred. If one more is added above two hundred, then three sheep up to three hundred. If the sheep are more than that, then for every hundred sheep, one sheep. Nothing is due on them until they reach one hundred. Neither separated from a combined herd nor combined between separated ones out of fear of charity. Whatever is from two partners, they settle between them equally. Neither an old animal nor one with a defect is taken in charity." Al-Zuhrī said: "When the collector comes, the sheep are divided into thirds: one third worst, one third best, and one third middle, and the collector takes from the middle." ✧ This is a copy of the document of the Messenger of Allah ﷺ in which he wrote the charity, and it is with the family of Umar b. al-Khattab. Ibn Shihāb said: Sālim b. ʿAbd Allāh b. ʿUmar read it to me, and I memorized it accurately. It is the one that ʿUmar b. ʿAbd al-ʿAzīz copied from ʿAbd Allāh b. ʿAbd Allāh b. ʿUmar and Sālim b. ʿAbd Allāh when he was appointed governor over Madinah. He ordered his agents to act upon it and wrote it to al-Walīd, and al-Walīd ordered his agents to act upon it. Then the caliphs continued to order that after him. Then Hishām ordered it and copied it to every agent of the Muslims and ordered them to act upon its contents and not to exceed it. This is a document that explains it: "No charity is taken from any camels until they reach five dhawd (a small herd). When they reach five, then one sheep is due until they reach ten. When they reach ten, then two sheep are due until they reach fifteen. When they reach fifteen, then three sheep are due until they reach twenty. When they reach twenty, then four sheep are due until they reach twenty-five. When they reach twenty-five, a fariḍah (obligatory due) is imposed, and in it is a bint makhāḍ. If no bint makhāḍ is found, then a male ibn labūn up to thirty-five. When they reach thirty-six, then a bint labūn is due up to forty-five. When they are forty-six, then a ḥiqqah ṭarūqat al-jamal (a three-year-old female camel that has been mounted) is due up to sixty. When they are sixty-one, then a jadhaʿah is due up to seventy-five. When they reach seventy-six, then a bint labūn is due up to ninety. When they are ninety-one, then two ḥiqqahs ṭarūqatā al-jamal are due up to one hundred and twenty. When they are one hundred and twenty-one, then three bint labūn are due up to one hundred and twenty-nine. When they are one hundred and thirty, then two bint labūn and one ḥiqqah are due up to one hundred and thirty-nine. When they are one hundred and forty, then two ḥiqqahs and one bint labūn are due up to one hundred and forty-nine. When they are one hundred and fifty, then three ḥiqqahs are due up to one hundred and fifty-nine. When they are one hundred and sixty, then four bint labūn are due up to one hundred and sixty-nine. When they are one hundred and seventy, then three bint labūn and one ḥiqqah are due up to one hundred and seventy-nine. When they are one hundred and eighty, then two ḥiqqahs and two bint labūn are due up to one hundred and eighty-nine. When they are one hundred and ninety, then three ḥiqqahs and three bint labūn are due up to one hundred and ninety-nine. When they are two hundred, then four ḥiqqahs or five bint labūn, whichever age you find, you take according to what we have written in this document. Then everything of camels is based on that, taken according to what we have written in this document. No charity is taken from sheep until they reach forty sheep. When they reach forty sheep, then one sheep is due until they reach one hundred and twenty. When they are one hundred and twenty-one, then two sheep are due until they reach two hundred. When they are two hundred and one, then three sheep are due until they reach three hundred. If they exceed three hundred sheep, then only three sheep are due until they reach four hundred sheep. Then four sheep are due until they reach five hundred sheep. When they reach five hundred, then five sheep are due until they reach six hundred sheep. Then six sheep are due. When they reach seven hundred, then seven sheep are due until they reach eight hundred sheep. When they reach eight hundred sheep, then eight sheep are due until they reach nine hundred sheep. When they reach nine hundred sheep, then nine sheep are due until they reach one thousand sheep. When they reach one thousand sheep, then ten sheep are due. Then for every additional hundred sheep, one sheep is due." And part of what testifies to the authenticity of this hadith is...

✧ When ʿUmar b. ʿAbd al-ʿAzīz was made caliph, he sent to Madinah seeking the covenant of the Prophet ﷺ and his practice regarding charities. He found with the family of ʿUmar b. al-Khattab the document of ʿUmar to his agents regarding charities, similar to the document of the Prophet ﷺ to ʿAmr b. Ḥazm. ʿUmar b. ʿAbd al-ʿAzīz ordered his agents in charge of charities to act according to those two documents. In them was: "The charity for camels: if they exceed ninety by one, then two ḥiqqahs are due up to one hundred and twenty. If they exceed one hundred and twenty by one, then three bint labūn are due until they reach one hundred and twenty-nine. If the camels are more than that, then nothing is due on what does not reach ten of them until they reach ten." As for the document of the Prophet ﷺ to ʿAmr b. Ḥazm, its chain meets the criteria of this book, and for that reason I mentioned the full context.

✧ He wrote to the people of Yemen a document containing the obligatory shares, the sunnah, and the blood monies, and it was sent with ʿAmr b. Ḥazm, and it was read to the people of Yemen. This is its copy: In the name of Allah, the Most Merciful, the Most Compassionate. From Muhammad the Prophet to Shuraḥbīl b. ʿAbd Kulāl, al-Ḥārith b. ʿAbd Kulāl, and Nuʿaym b. Kulāl, meaning Dhū Ruʿayn, Maʿāfir, and Hamdān. Now then: "Your messenger has returned, and you have been given from the spoils one-fifth of Allah and what Allah has prescribed for the believers of the tithe on real estate: what the sky waters, or is flood-irrigated, or is watered by a spring, then a tithe is due on it when it reaches five awsuq. What is watered by a bucket or a waterwheel, then half a tithe is due on it when it reaches five awsuq. For every five grazing camels, one sheep is due until they reach twenty-four. If one more is added over twenty-four, then a bint makhāḍ is due; if not found, then a male ibn labūn, until they reach thirty-five. If one more is added over thirty-five, then a bint labūn is due until they reach forty-five. If one more is added over forty-five, then a ḥiqqah ṭarūqat al-faḥl is due until they reach sixty. If one more is added over sixty, then a jadhaʿah is due until they reach seventy-five. If one more is added over seventy-five, then a bint labūn is due until they reach ninety. If one more is added over ninety, then two ḥiqqahs ṭarūqatā al-jamal are due until they reach one hundred and twenty. What exceeds one hundred and twenty, then for every forty a bint labūn and for every fifty a ḥiqqah ṭarūqat al-jamal. For every thirty grazing cattle, a tabīʿ (a one-year-old male calf), and for every forty cattle, a cow. For every forty grazing sheep, one sheep is due until they reach one hundred and twenty. If one more is added over one hundred and twenty, then two sheep are due until they reach two hundred. If one more is added, then three sheep are due until they reach three hundred. If they increase, then for every additional hundred sheep, one sheep is due. Neither an old animal nor a lean one nor one with a defect is taken in charity, nor a male goat, unless the collector wishes. Neither combined between separated ones nor separated between a combined herd out of fear of charity. Whatever is taken from two partners, they settle between them equally. For every five ounces of silver, five dirhams are due, and what exceeds that, then for every forty dirhams, one dirham is due. Nothing is due on what is below five ounces. For every forty dinars, one dinar is due. Charity is not lawful for Muhammad nor for the family of Muhammad; it is only the zakah by which they purify themselves, and it is for the poor believers, in the cause of Allah, and for the wayfarer. Nothing is due on slaves, nor on a farm, nor on its workers if it pays its charity from the tithe. And there is nothing due on a Muslim slave nor on his horse."

If he accepts it from you, I will accept it, and if he rejects it to you, I will reject it." He said: "I will do that." He went out with me and took the she-camel that he offered to me until we came to the Messenger of Allah ﷺ. He said: "O Prophet of Allah, your messenger came to me to take from the charity of my wealth. By Allah, neither the Messenger of Allah ﷺ nor his messenger ever stood over my wealth before him. I gathered my wealth for him, and he claimed that nothing is due on it except a bint makhāḍ, and that is one that has no milk and no riding ability.
