    سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «إِنَّ الْحَلَالَ بَيِّنٌ وَإِنَّ الْحَرَامَ بَيِّنٌ وَإِنَّ بَيْنَ ذَلِكَ أُمُورًا مُشْتَبِهَاتٍ» قَالَ وَرُبَّمَا قَالَ وَإِنَّ مِنْ ذَلِكَ أُمُورًا مُشْتَبِهَةً وَسَأَضْرِبُ لَكُمْ فِي ذَلِكَ مَثَلًا إِنَّ اللهَ حَمَى حِمًى وَإِنَّ حِمَى اللهِ مَا حَرَّمَ وَإِنَّهُ مَنْ يَرْتَعْ حَوْلَ الْحِمَى يُوشِكُ أَنْ يُخَالِطَ الْحِمَى وَرُبَّمَا قَالَ إِنَّهُ مَنْ يَرْعَى حَوْلَ الْحِمَى يُوشِكُ أَنْ يَرْتَعَ فِيهِ وَإِنَّ مَنْ يُخَالِطُ الرِّيبَةَ يُوشِكُ أَنْ يَجْسُرَ

    I heard the Messenger of Allah ﷺ say: What is lawful is clear and what is unlawful is clear, but between them are certain doubtful things. I give you an example for this. Allah has a preserve, and Allah's preserve is the things He has declared unlawful. He who pastures (his animals) round the preserve will soon fall into it. He who falls into doubtful things will soon be courageous. (Using translation from Abū Dāʾūd 3329)

    ✧ The Messenger of Allah ﷺ said: "A time will come upon people when a man will not care from where he obtains wealth, whether from lawful or unlawful sources."

    ✧ The Messenger of Allah ﷺ said: "A time will come upon people when they will consume usury; whoever does not consume it will be affected by its dust."

    ✧ The Messenger of Allah ﷺ said: "Indeed, the purest of what a man eats is from his own earnings, and indeed, his child is from his earnings." 6004 Sulayman said: 'Umarah b. 'Umayr informed me from his paternal aunt, from 'A'ishah, from the Messenger of Allah ﷺ, something similar.

    قَالَ رَسُولُ اللهِ ﷺ إِنَّ مِنْ أَشْرَاطِ السَّاعَةِ أَنْ يَفْشُوَ الْمَالُ وَيَكْثُرَ وَتَفْشُوَ التِّجَارَةُ وَيَظْهَرَ الْجَهْلُ وَيَبِيعَ الرَّجُلُ الْبَيْعَ فَيَقُولَ حَتَّى أَسْتَأْمِرَ تَاجِرَ بَنِي فُلَانٍ وَيُلْتَمَسَ فِي الْحَيِّ الْعَظِيمِ الْكَاتِبُ فَلَا يُوجَدُ

    ✧ The Messenger of Allah ﷺ said: "Indeed, among the signs of the Hour are that wealth becomes widespread and abundant, trade becomes widespread, ignorance appears, a man sells a sale and says, 'Let me consult the merchant of Banu so-and-so,' and a scribe is sought in a great tribe but is not found."

    قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»

    ✧ The Messenger of Allah ﷺ said: "The two parties to a sale have the option as long as they have not separated. If they are truthful and make things clear, they will be blessed in their sale. But if they lie and conceal, the blessing of their sale will be erased."

    عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يَنْظُرُ إِلَيْهِمْ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ» فَقَرَأَهَا رَسُولُ اللهِ ﷺ فَقَالَ أَبُو ذَرٍّ خَابُوا وَخَسِرُوا قَالَ «الْمُسْبِلُ إِزَارَهُ خُيَلَاءَ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبِ وَالْمَنَّانُ عَطَاءَهُ»

    ✧ From the Prophet ﷺ, who said: "There are three whom Allah will not speak to on the Day of Resurrection, nor look at them, nor purify them, and for them is a painful punishment." The Messenger of Allah ﷺ recited it, and Abu Dharr said, "They are ruined and lost." He said: "The one who lets his garment hang low out of pride, the one who promotes his goods with false oaths, and the one who reminds others of his gifts."

    عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ لَا يَنْظُرُ اللهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ الَّذِي لَا يُعْطِي شَيْئًا إِلَّا مِنَّهُ وَالْمُسْبِلُ إِزَارَهُ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْكَذِبِ»

    ✧ From the Prophet ﷺ, who said: "There are three whom Allah will not look at on the Day of Resurrection, nor purify them, and for them is a painful punishment: the one who does not give anything except to remind others of it, the one who lets his garment hang low, and the one who promotes his goods with lies."

    ✧ From the Prophet ﷺ, who said: "Swearing oaths makes goods sell, but it wipes out the blessing of earnings."

    ✧ He heard the Messenger of Allah ﷺ say: "Beware of swearing oaths frequently in selling, for it promotes sales but then obliterates the blessing."

    عَنْ رَسُولِ اللهِ ﷺ قَالَ ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ رَجُلٌ بَخِلَ فَضْلَ مَاءٍ بِالطَّرِيقِ يَمْنَعُ ابْنَ السَّبِيلِ مِنْهُ وَرَجُلٌ بَايَعَ إِمَامًا لِدُنْيَا إِنْ أَعْطَاهُ مَا يُرِيدُ وَفَى لَهُ وَإِنْ لَمْ يُعْطِهِ لَمْ يَفِ لَهُ وَرَجُلٌ سَاوَمَ رَجُلًا عَلَى سِلْعَةٍ بَعْدَ الْعَصْرِ فَحَلَفَ لَهُ بِاللهِ لَقَدْ أُعْطِيَ بِهَا كَذَا وَكَذَا فَصَدَّقَهُ الْآخَرُ

    ✧ From the Messenger of God ﷺ, he said: Three are those whom God will not speak to on the Day of Resurrection, nor will He purify them, and for them is a painful punishment: a man who withheld surplus water on the road, preventing the wayfarer from it; a man who pledged allegiance to a ruler only for worldly gain—if he gives him what he wants, he fulfills his allegiance, and if not, he does not; and a man who bargained with another over a commodity after the afternoon prayer and swore to him by God that he had been offered such and such for it, so the other believed him.

    كُنَّا بِالْمَدِينَةِ نَبِيعُ الْأَوْسَاقَ وَنَبْتَاعُهَا وَنُسَمِّي أَنْفُسَنَا السَّمَاسِرَةَ وَيُسَمِّينَا النَّاسُ فَخَرَجَ إِلَيْنَا رَسُولُ اللهِ ﷺ فَسَمَّانَا بِاسْمٍ هُوَ خَيْرٌ لَنَا مِنَ الَّذِي سَمَّيْنَا بِهِ أَنْفُسَنَا فَقَالَ «يَا مَعْشَرَ التُّجَّارِ إِنَّهُ يَشْهَدُ بَيْعَكُمُ الْحَلِفُ وَاللَّغْوُ شُوبُوهُ بِالصَّدَقَةِ»

    ✧ We were in Madinah selling and buying loads of goods, naming ourselves as brokers, and the people called us that. Then the Messenger of God ﷺ came out to us and gave us a name better for us than what we named ourselves. He said, "O company of merchants, indeed your sales are witnessed by oath and vain talk, so mix them with charity."

    أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ بَيَّنَا وَصَدَقَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»

    ✧ The Messenger of God ﷺ said, "The two parties to a sale have the option as long as they have not separated. If they are clear and truthful, their sale is blessed; but if they lie and conceal, the blessing of their sale is wiped out."

    عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ حَتَّى يَتَفَرَّقَا» وَقَالَ مَرَّةً أُخْرَى مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ

    ✧ From the Messenger of God ﷺ, he said, "When two men engage in a transaction, each of them has the option until they separate." And he said another time, "as long as they have not separated," and they were together, or one of them gives the other a choice. If one gives the other a choice and they conclude the transaction on that basis, then the sale becomes binding. If they separate after concluding the transaction and neither of them leaves the sale, then the sale becomes binding.

    ✧ From the Messenger of God ﷺ: "The two parties to a transaction have the option in their sale as long as they have not separated, unless the sale is made with an option." Nafi' said, "Abd Allah b. Umar, whenever he bought something that pleased him, he would part from his companion."

    ✧ The Messenger of God ﷺ said: “The two parties to a sale have the option as long as they have not separated, unless it is a transaction with an option. And it is not lawful for him to separate from his companion fearing that he might ask him to cancel it.”

    أَنَّ رَجُلًا ذَكَرَ لِرَسُولِ اللهِ ﷺ أَنَّهُ يُخْدَعُ فِي الْبَيْعِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ إِذَا بَايَعْتَ فَقُلْ لَا خِلَابَةَ وَكَانَ الرَّجُلُ إِذَا بَاعَ يَقُولُ لَا خِلَابَةَ

Munābadhah is when a man throws a garment to another man and the other throws him a garment, and they make a transaction on that basis.

    ✧ The Messenger of God ﷺ forbade two ways of dressing, and the Messenger of God ﷺ forbade us two types of sale: munābadhah and mulāmasah. They are forms of sale that people used in pre-Islamic times. Abū ʿAbd al-Raḥmān said: This is a mistake. Jaʿfar b. Burqān is not strong in al-Zuhrī specifically, though there is no problem with him in other respects. Likewise Sufyān b. Ḥusayn and Sulaymān b. Kathīr.

    ✧ From the Prophet ﷺ that he forbade two types of sale. The two types of sale are munābadhah and mulāmasah. He claimed that mulāmasah is when a man says to another man, "I will sell you my garment for your garment," and neither of them looks at the other's garment, but he merely touches it. Munābadhah is when he says, "I will throw what I have and you throw what you have," and one of them buys from the other without either knowing how much the other has. Something like this he described, if God wills.

And the Messenger of Allah ﷺ said, "Have you considered: if Allah withholds the fruit, then for what would one of you take the wealth of his brother?"

    ✧ A man was afflicted during the time of the Messenger of Allah ﷺ in fruits he had purchased, and his debt became great. The Messenger of Allah ﷺ said, "Give charity to him." The people gave charity to him, but that did not reach the fulfillment of his debt. The Messenger of Allah ﷺ said, "Take what you find, and you have nothing but that." Abu 'Abd al-Rahman said: This is more correct than the hadith of Sulayman b. 'Atiq.

    ✧ That the Messenger of Allah ﷺ appointed a man over Khaybar. He came with fine dates. The Messenger of Allah ﷺ said to him: "Are all the dates of Khaybar like this?" He said: No, by Allah, O Messenger of Allah; we take a sa' of this for two sa's, and two sa's for three. The Messenger of Allah ﷺ said: "Do not do that. Sell the mixed dates for dirhams, then buy fine dates with the dirhams."

They said: We bought it by giving a sa' for two sa's of our dates. He said: "Do not do that, for this is not permissible. Sell your dates and buy what you need of this."

    ✧ We used to be given mixed dates as provisions in the time of the Messenger of Allah ﷺ, and we would sell two sa's for one sa'. That reached the Messenger of Allah ﷺ, and he said: "No two sa's of dates for one sa', nor two sa's of wheat for one sa', nor a dirham for two dirhams."

    ✧ Ubādah said: The Messenger of Allah ﷺ forbade us from selling gold for gold, silver for silver, wheat for wheat, barley for barley, and dates for dates. One of them said: "and salt for salt," but the other did not say it, except equal for equal, like for like. One of them said: "Whoever adds or asks for addition has committed ribā," but the other did not say it. And he commanded us to sell gold for silver, silver for gold, wheat for barley, and barley for wheat, hand to hand, however we wished. The hadith reached Muʿāwiyah, so he stood and said, "What is the matter with men who narrate hadiths from the Messenger of Allah ﷺ that we accompanied him but did not hear from him?" That reached ʿUbādah, so he stood, repeated the hadith, and said, "We shall narrate what we heard from the Messenger of Allah ﷺ even if Muʿāwiyah dislikes it." Qatādah differed from him and narrated it from Muslim b. Yasār, from Abu al-Ashʿath, from ʿUbādah.

    ✧ From ʿUbādah b. al-Ṣāmit, who was a Badrī and had pledged allegiance to the Messenger of Allah ﷺ that he would not fear the blame of any blamer in Allah's cause. ʿUbādah b. al-Ṣāmit stood as a speaker and said: "O people, you have innovated sales I do not know. Verily, gold for gold is weight for weight, its raw and its minted; silver for silver is weight for weight, its raw and its minted. There is no harm in selling silver for gold hand to hand, when silver is the larger of the two, but it is not valid on credit. Verily, wheat for wheat and barley for barley, mudy for mudy. There is no harm in selling barley for wheat hand to hand, when barley is the larger of the two, but it is not valid on credit. Verily, dates for dates, mudy for mudy, until he mentioned salt: mudy for mudy. Whoever adds or asks for addition has committed ribā."

    ✧ Abu al-Mutawakkil passed by them in the market, and a group of people stood up to him, including me. He said: We said, "We have come to you to ask you about money exchange." He said, "I heard Abu Saʿīd al-Khudrī." A man said to him, "Is there anyone between you and the Prophet ﷺ other than Abu Saʿīd?" He said, "There is no one between me and him except him." He said: "Gold for gold, silver for silver"—Sulaymān said, or he said: "silver for silver"—"wheat for wheat, barley for barley, dates for dates, and salt for salt, equal for equal. Whoever adds to that or asks for addition has committed ribā, and the taker and the giver are equal in it."

Muʿāwiyah said, "This man says nothing." ʿUbādah said, "By Allah, I do not care if I am not in a land where Muʿāwiyah is. I testify that I heard the Messenger of Allah ﷺ say that."     ✧ Amr b. Dinar and Amir b. Mus'ab informed me that they heard Abu al-Minhal say: I asked al-Bara' b. 'Azib and Zayd b. Arqam, and they said: "We were two merchants during the time of the Messenger of Allah ﷺ. We asked the Messenger of Allah ﷺ about sarf (exchange). He said: 'If it is hand to hand, there is no harm; and if it is on credit, it is not proper.'"

    سَمِعَ أَبَا سَعِيدٍ الْخُدْرِيَّ يَقُولُ قُلْتُ لِابْنِ عَبَّاسٍ أَرَأَيْتَ هَذَا الَّذِي تَقُولُ أَشَيْئًا وَجَدْتَهُ فِي كِتَابِ اللهِ أَوْ سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ؟ قَالَ مَا وَجَدْتُهُ فِي كِتَابِ اللهِ وَلَا سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ وَلَكِنْ أُسَامَةُ بْنُ زَيْدٍ أَخْبَرَنِي أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا الرِّبَا فِي النَّسِيئَةِ»

    ✧ I heard Abu Sa'id al-Khudri say: I said to Ibn 'Abbas: "Do you think this that you say is something you found in the Book of Allah or that you heard from the Messenger of Allah ﷺ?" He said: "I did not find it in the Book of Allah, nor did I hear it from the Messenger of Allah ﷺ, but Usamah b. Zayd informed me that the Messenger of Allah ﷺ said: 'Riba is only in delayed payment.'"

    ✧ I used to sell camels in al-Baqi', selling for dinars and taking dirhams. I came to the Prophet ﷺ in the house of Hafsah and said: "O Messenger of Allah, I want to ask you: I sell in al-Baqi', selling for dinars and taking dirhams." He said: "There is no harm in taking them at the price of that day, as long as nothing separates the two of you."

    "Abu Burdah and 'Abdullah bin Shaddad argued about payment in advance. They sent me to Ibn Abi Awfa and I asked him (about that). He said: 'We used to pay in advance during the time of the Messenger of Allah and Abu Bakr and 'Umar, for wheat, barley, raisins and dates, paying people whom we did not see it with them." He said to a man: «Go and buy him a young camel.» He came to him and said: I found only a four-year-old excellent young camel. He said: «Give it to him, for the best of Muslims is the one who is best in repayment.»

    ✧ A man was owed by the Prophet ﷺ a camel of a certain age. He came to demand it. He said: «Give him.» They found only a camel older than his due. He said: «Give him.» He said: You have repaid me in full. The Messenger of Allah ﷺ said: «The best of you is the one who is best in repayment.»

    سَمِعْتُ عِرْبَاضَ بْنَ سَارِيَةَ يَقُولُ بِعْتُ مِنَ النَّبِيِّ ﷺ بَكْرًا فَأَتَيْتُهُ أَتَقَاضَاهُ فَقَالَ «أَجَلْ لَا أَقْضِينَّكَهَا إِلَّا لُجَيْنِيَّةً» فَقَضَانِي فَأَحْسَنَ قَضَائِي وَجَاءَهُ أَعْرَابِيٌّ يَتَقَاضَاهُ سِنَّهُ فَقَالَ رَسُولُ اللهِ ﷺ «أَعْطُوهُ سِنًّا» فَأَعْطُوهُ يَوْمَئِذٍ جَمَلًا فَقَالَ هَذَا خَيْرٌ مِنْ سِنِّي فَقَالَ «خَيْرُكُمْ خَيْرُكُمْ قَضَاءً»

    ✧ I heard Irbad b. Sariyah say: I sold the Prophet ﷺ a young camel. I came to him demanding it. He said: «Yes, I will not repay you except with a silver-like one.» He repaid me and made my repayment excellent. A Bedouin came to him demanding his camel of a certain age. The Messenger of Allah ﷺ said: «Give him a camel of that age.» That day they gave him a male camel [jamal]. He said: This is better than my due. He said: «The best of you is the one who is best in repayment.»

    ✧ A slave came and pledged allegiance to the Messenger of Allah ﷺ for emigration, and the Prophet ﷺ did not realize that he was a slave. Then his master came wanting him back. The Prophet ﷺ said, "Sell him to me." He bought him for two black slaves. Then he did not accept allegiance from anyone after that without asking, "Is he a slave?"

    ✧ The Messenger of Allah ﷺ had on him two Qatari striped cloaks. When he sat and sweated in them, they became heavy on him. Merchandise from Syria arrived for a certain Jew. I said, "If only you would send to him and buy from him two garments on credit until a time of ease." So he sent to him. He said, "I know what Muhammad wants. He only wants to go away with my money, or go away with them." The Messenger of Allah ﷺ said, "He has lied. He knows that I am among the most God-fearing of them and the most faithful in fulfilling trust."

    كُنْتُ مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ فَأَعْيَا جَمَلِي فَأَرَدْتُ أَنْ أُسَيِّبَهُ فَلَحِقَنِي رَسُولُ اللهِ ﷺ وَدَعَا لَهُ وَضَرَبَهُ فَسَارَ سَيْرًا لَمْ يَسِرْ مِثْلَهُ قَالَ «بِعْنِيهِ بِوُقِيَّةٍ» قُلْتُ لَا قَالَ «بِعْنِيهِ فَبِعْتُهُ بِوُقِيَّةٍ» وَاسْتَثْنَيْتُ حُمْلَانَهُ إِلَى الْمَدِينَةِ فَلَمَّا بَلَغْنَا الْمَدِينَةَ أَتَيْتُهُ بِالْجَمَلِ وَانْتَقَدْتُ ثَمَنَهُ ثُمَّ رَجَعْتُ فَأَرْسَلَ إِلَيَّ فَقَالَ «أَتُرَانِي إِنَّمَا مَاكَسْتُكَ لِآخُذَ جَمَلَكَ؟ خُذْ جَمَلَكَ وَدَرَاهِمَكَ»

    ✧ I was with the Prophet ﷺ on a journey and my camel became exhausted. I wanted to let it go, but the Messenger of Allah ﷺ caught up with me, supplicated for it, and struck it. It then traveled as it had never traveled before. He said: "Sell it to me for an uqiyyah." I said: "No." He said: "Sell it to me." So I sold it to him for an uqiyyah, and I stipulated that I could ride it until we reached Madinah. When we reached Madinah, I brought him the camel and received its price. Then I returned, and he sent for me and said: "Do you think I only bargained with you to take your camel? Take your camel and your dirhams."

    غَزَوْتُ مَعَ النَّبِيِّ ﷺ عَلَى نَاضِحٍ لَنَا وَذَكَرَ كَلَامًا مَعْنَاهُ فَأُزْحِفَ الْجَمَلُ فَزَجَرَهُ النَّبِيُّ ﷺ فَانْبَسَطَ حَتَّى كَانَ أَمَامَ الْجَيْشِ فَقَالَ النَّبِيُّ ﷺ «يَا جَابِرُ مَا أَرَى جَمَلَكَ إِلَّا قَدِ انْبَسَطَ» قُلْتُ بَرَكَتُكَ يَا رَسُولَ اللهِ قَالَ «بِعْنِيهِ وَلَكَ ظَهْرُهُ حَتَّى تَقْدِمَ» فَبِعْتُهُ وَكَانَتْ لِي إِلَيْهِ حَاجَةٌ شَدِيدَةٌ وَلَكِنِّي اسْتَحْيَيْتُ مِنْهُ فَلَمَّا قَضَيْنَا غَزَاتَنَا وَدَنَوْنَا اسْتَأْذَنْتُهُ بِالتَّعْجِيلِ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي حَدِيثُ عَهْدٍ بِعُرْسٍ قَالَ «أَبِكْرًا تَزَوَّجْتَ أَمْ ثَيِّبًا؟» قُلْتُ بَلْ ثَيِّبًا يَا رَسُولَ اللهِ إِنَّ عَبْدَ اللهِ بْنَ عَمْرٍو أُصِيبَ يَوْمَ أُصِيبَ وَتَرَكَ جَوَارِيَ أَبْكَارًا فَكَرِهْتُ أَنْ آتِيَهُنَّ بِمِثْلِهِنَّ فَتَزَوَّجْتُ ثَيِّبًا تُعَلِّمُهُنَّ وَتُؤَدِّبُهُنَّ فَأَذِنَ لِي وَقَالَ لِي «ائْتِ أَهْلَكَ عِشَاءً» فَلَمَّا قَدِمْتُ أَخْبَرْتُ خَالِي بِبَيْعِيَ الْجَمَلَ فَلَامَنِي فَلَمَّا قَدِمَ رَسُولُ اللهِ ﷺ غَدَوْتُ إِلَيْهِ بِالْجَمَلِ فَأَعْطَانِي ثَمَنَ الْجَمَلِ وَالْجَمَلَ وَسَهْمِي مَعَ النَّاسِ

    ✧ I went on a military expedition with the Prophet ﷺ on a weak camel of ours. He mentioned words whose meaning was that the camel became lame, so the Prophet ﷺ urged it, and it sped ahead until it was in front of the army. The Prophet ﷺ said: "O Jabir, I see your camel has become energetic." I said: "It is due to your blessing, O Messenger of Allah." He said: "Sell it to me, and you may ride it until you arrive." So I sold it to him, though I was in great need of it, but I felt shy before him. When we finished our expedition and approached Madinah, I asked his permission to go ahead. I said: "O Messenger of Allah, I am newly married." He said: "Did you marry a virgin or a previously married woman?" I said: "A previously married woman, O Messenger of Allah, because Abdullah b. Amr was killed and left behind young virgin girls, and I disliked bringing them someone like them, so I married a previously married woman to teach and discipline them." He permitted me and said: "Go to your family at night." When I arrived, I told my maternal uncle about selling the camel, and he blamed me. When the Messenger of Allah ﷺ arrived, I went to him in the morning with the camel, and he gave me the price of the camel, the camel itself, and my share with the people.

    كُنْتُ مَعَ رَسُولِ اللهِ ﷺ فِي سَفَرٍ وَكُنْتُ عَلَى جَمَلٍ قَالَ مَا لَكَ فِي آخِرِ النَّاسِ قُلْتُ أَعْيَا بَعِيرِي قَالَ فَأَخَذَ بِذَنْبِهِ فَزَجَرَهُ فَإِنْ كُنْتُ إِنَّمَا أَنَا فِي أَوَّلِ النَّاسِ يُهِمُّنِي رَأْسُهُ فَلَمَّا دَنَوْنَا مِنَ الْمَدِينَةِ قَالَ «مَا فَعَلَ الْجَمَلُ؟ بِعْنِيهِ» قُلْتُ يَا رَسُولَ اللهِ لَا بَلْ هُوَ لَكَ قَالَ لَا بَلْ بِعْنِيهِ قُلْتُ لَا بَلْ هُوَ لَكَ قَالَ «بِعْنِيهِ قَدْ أَخَذْتُهُ بِوُقِيَّةٍ» ارْكَبْهُ فَإِذَا قَدِمَتِ الْمَدِينَةَ فَائْتِنَا بِهِ فَلَمَّا قَدِمَتِ الْمَدِينَةَ جِئْتُ بِهِ فَقَالَ لِبِلَالٍ «يَا بِلَالُ زِنْ لَهُ وُقِيَّةً وَزِدْهُ قِيرَاطًا» قُلْتُ هَذَا شَيْءٌ زَادَنِي رَسُولُ اللهِ ﷺ فَلَمْ يُفَارِقْنِي فَجَعَلْتُهُ فِي كِيسٍ فَلَمْ يَزَلْ عِنْدِي حَتَّى جَاءَ أَهْلُ الشَّامِ يَوْمَ الْحَرَّةِ فَأَخَذُوا مِنَّا مَا أَخَذُوا

    ✧ I was with the Messenger of Allah ﷺ on a journey, riding a camel. He said: "Why are you at the rear of the people?" I said: "My camel is exhausted." He took hold of its tail and urged it, and I found myself at the front of the people, concerned about its head. When we approached Madinah, he said: "What happened to the camel? Sell it to me." I said: "O Messenger of Allah, no, it is yours." He said: "No, sell it to me." I said: "No, it is yours." He said: "Sell it to me; I will take it for an uqiyyah. Ride it, and when you reach Madinah, bring it to us." When I reached Madinah, I brought it to him. He said to Bilal: "O Bilal, weigh out for him an uqiyyah and add a qirat." I said: "This is something extra the Messenger of Allah ﷺ gave me, and it has never left me." I put it in a pouch, and it remained with me until the people of Syria came on the Day of al-Harrah and took from us what they took.

    ✧ The Messenger of Allah ﷺ caught up with me while I was on a weak camel of ours. I said: "We always have a bad camel; woe is me!" The Prophet ﷺ said: "Will you sell it to me, O Jabir?" I said: "No, it is yours, O Messenger of Allah." He said: "O Allah, forgive him; O Allah, have mercy on him." He said: "I took it for such and such, and I have lent you its back until Madinah." When I reached Madinah, I prepared it and brought it to him. He said: "O Bilal, give him its price." When I turned away, he called me, and I feared he would return it to me, but he said: "It is yours."

    ✧ We were traveling with the Messenger of Allah ﷺ while I was on a weak camel. The Messenger of Allah ﷺ said: "Will you sell it to me for such and such, may Allah forgive you?" I said: "It is yours, O Prophet of Allah." He said: "Will you sell it to me for such and such, may Allah forgive you?" I said: "Yes, it is yours." Abu Nadrah said: "It was a phrase the Muslims used to say: 'Do such and such, may Allah forgive you.'"

    قَالَتِ اشْتَرَيْتُ بَرِيرَةَ فَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْطَى الْوَرِقَ» قَالَتْ فَعَتَقْتُهَا قَالَتْ فَدَعَاهَا رَسُولُ اللهِ ﷺ فَخَيَّرَهَا مِنْ زَوْجِهَا فَاخْتَارَتْ نَفْسَهَا وَكَانَ زَوْجُهَا حُرًّا

    ✧ She said: I bought Barirah and her owners stipulated that her loyalty would be to them. I mentioned that to the Prophet ﷺ, and he said: "Free her, for loyalty belongs to the one who gave the silver." She said: So I freed her. She said: Then the Messenger of Allah ﷺ called her and gave her the choice regarding her husband, and she chose herself. Her husband was a free man.

    ✧ That she should buy Barirah for the purpose of freeing her, and that they stipulated her loyalty would be to them. She mentioned that to the Messenger of Allah ﷺ, and he said: "Buy her and free her, for loyalty belongs to the one who frees." The Messenger of Allah ﷺ was brought some meat, and they said: "This was given as charity to Barirah." He said: "It is charity for her and a gift for us." And she was given the choice.

    ✧ The Messenger of Allah ﷺ said: “Pre-emption applies to every co-owned property, whether a house or a garden. It is not lawful for him to sell until he notifies his partner. If he sells, then the partner has a greater right to it until he gives him notice.”

    ✧ He was one of the companions of the Prophet ﷺ. The Prophet ﷺ bought a horse from a bedouin and asked him to follow him so that he could pay him the price of his horse. The Prophet ﷺ walked quickly, while the bedouin was slow. Some men began to approach the bedouin and bargain with him for the horse, not knowing that the Prophet ﷺ had already bought it, until one of them offered more than the price for which the Prophet ﷺ had bought it. The bedouin called out to the Prophet ﷺ, saying: “If you are going to buy this horse, then do so; otherwise I will sell it.” The Prophet ﷺ stood up when he heard his call and said: “Did I not buy it from you?” He said: “No, by Allah, I did not sell it to you.” The Prophet ﷺ said: “I did buy it from you.” The people began to gather around the Prophet ﷺ while the two of them were arguing back and forth. The bedouin kept saying: “Bring a witness who will testify that I sold it to you.” Khuzaymah b. Thabit said: “I testify that you sold it.” He said: “The Prophet ﷺ turned to Khuzaymah and said: ‘On what basis do you testify?’ He said: ‘On the basis of believing you, O Messenger of Allah.’ The Messenger of Allah ﷺ made the testimony of Khuzaymah equal to the testimony of two men.”

    "A man from Banu 'Udhrah declared that a slave of his would become free after he died. News of that reached the Messenger of Allah and he said: 'Do you have any property besides him?' He said: 'No.' The Messenger of Allah said: 'Who will buy him from me?' Nu'aim bin 'Abdullah Al-Adawi bought him for eight hundred Dirhams. The Messenger of Allah brought it (the money) and gave it to him, then he said: 'Start with yourself and if there is anything left, give it to our family. If there is anything left after your family (has been taken care of), then give it to your relatives. If there is anything left after your relatives (have been taken care of), then (give it) to such and such, saying: 'In front of you and to your right and to your left."'     ✧ He was called Yaʿqūb, and he had no property other than him. The Messenger of Allah ﷺ called for him and said: “Who will buy him? Who will buy him?” Nuʿaym b. ʿAbd Allah bought him for eight hundred dirhams, and he gave the money to him. Then he said: “If one of you is poor, let him begin with himself. If there is anything left over, then for his dependents. If there is anything left over, then for his relatives” – or he said “for his kin” – “and if there is anything left over, then here and here.”

    ✧ “If I pay off your kitābah (contract of manumission) and your walāʾ (patronage) belongs to me, I will do it.” Barīrah mentioned that to her owners, but they refused and said: “If she wants to count it as a favor to you, let her do so, but your walāʾ will belong to us.” She mentioned that to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said to her: “Buy her and manumit her, for walāʾ belongs to the one who manumits.” Then the Messenger of Allah ﷺ stood up and said: “What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates a condition that is not in the Book of Allah, it is not valid for him, even if he stipulates it a hundred times. The condition of Allah is more deserving and more binding.”

    ✧ “O ʿĀʾishah, I have made a kitābah contract with my owners for nine ūqiyyahs, one ūqiyyah each year, so help me.” She had not yet paid anything of her kitābah. ʿĀʾishah said to her, and she desired her for herself: “Return to your owners. If they like, I will give them the whole amount at once, and your walāʾ will belong to me, and I will do it.” Barīrah went to her owners and presented that to them, but they refused and said: “If she wants to count it as a favor to you, let her do so, but that will belong to us.” ʿĀʾishah mentioned that to the Messenger of Allah ﷺ, and he said: “Do not let that stop you from her. Buy her and manumit her, for walāʾ belongs to the one who manumits.” So she did it. Then the Messenger of Allah ﷺ stood up, praised Allah, and said: “To proceed: What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates a condition that is not in the Book of Allah, it is invalid, even if it is a hundred conditions. The decree of Allah is more deserving, and the condition of Allah is more binding, and walāʾ belongs to the one who manumits.”

    A person presented to Messenger of Allah ﷺ a small water-skin of wine. Messenger of Allah ﷺ said to him: Do you know that Allah has forbidden it? He said: No. He then whispered to another man. Messenger of Allah ﷺ asked him what he had whispered. He said: I advised him to sell that, whereupon he (the Holy Prophet) said: Verily He Who has forbidden its drinking has forbidden its sale also. He (the narrator) said: He opened the waterskin until what was contained in it was spilt. (Using translation from Muslim 1579a)

    أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ عَامَ الْفَتْحِ وَهُوَ بِمَكَّةَ «إِنَّ اللهَ وَرَسُولَهُ حَرَّمَ بَيْعَ الْخَمْرِ وَالْمَيْتَةِ وَالْخِنْزِيرِ وَالْأَصْنَامِ» فَقِيلَ يَا رَسُولَ اللهِ أَرَأَيْتَ شُحُومَ الْمَيْتَةِ؛ فَإِنَّهُ تُطْلَى بِهَا السُّفُنُ وَتُدْهَنُ بِهَا الْجُلُودُ وَيَسْتَصْبِحُ بِهَا النَّاسُ فَقَالَ «لَا هُوَ حَرَامٌ» فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ قَاتَلَ اللهُ الْيَهُوَدَ؛ إِنَّ اللهَ لَمَّا حَرَّمَ عَلَيْهِمْ شُحُومَهَا أَجْمَلُوهُ ثُمَّ بَاعُوهُ فَأَكَلُوا ثَمَنَهُ

    ✧ He heard the Messenger of Allah ﷺ say in the year of the conquest, while he was in Makkah: "Allah and His Messenger have forbidden the sale of wine, dead animals, pigs, and idols." It was said: O Messenger of Allah, what about the fat of dead animals, for it is used to coat ships, to grease leather, and people use it for lamps? He said: "No, it is haram." Then the Messenger of Allah ﷺ said: "May Allah fight the Jews; when Allah forbade them the fat, they melted it, then sold it and consumed its price."

    ✧ In the time of the Messenger of Allah ﷺ, a man suffered loss in fruits he had bought, and his debt became great. So the Messenger of Allah ﷺ said: "Give him charity." They gave him charity, but it did not reach the amount to pay off his debt. So the Messenger of Allah ﷺ said: "Take what you find, and you have nothing but that."

    ✧ That any man from whom something is stolen, he is more entitled to it wherever he finds it. Then Marwan wrote to me about that, so I wrote to Marwan that the Prophet ﷺ ruled that if the one who bought it from the one who stole it is not suspect, then the owner is given the choice: if he wishes, he may take what was stolen from him for its price, and if he wishes, he may pursue the thief. Then after him Abu Bakr, 'Umar, and 'Uthman ruled accordingly. Marwan sent my letter to Mu'awiyah, and Mu'awiyah wrote to Marwan: "You and Usayd are not judges. Rather, I judge in what I have been put in authority over you both, so carry out what I command you." Marwan sent Mu'awiyah's letter to me, and I said: "I will not judge by it as long as I am in authority, according to what Mu'awiyah said."

    ✧ We were sitting with the Messenger of Allah ﷺ when he raised his head toward the sky, then placed his palm on his forehead, then said: "Glory be to Allah! What severity has been sent down?" We fell silent and were afraid. The next day I asked him: "O Messenger of Allah, what is this severity that has been sent down?" He said: "By the One in whose hand is my soul, if a man were killed in the path of Allah, then brought to life, then killed, then brought to life, then killed, and he owed a debt, he would not enter Paradise until his debt is paid on his behalf."

    ✧ We were with the Prophet ﷺ at a funeral, and he said, “Is there anyone here from Banu so-and-so?” three times. A man stood up, and the Prophet ﷺ said, “What prevented you in the first two times from answering me? Indeed, I did not call you out except for good. Indeed, so-and-so, a man from among them, has died while being held captive by his debt.” More than one narrator has reported it from al-Shaʿbī from Samurah, and it has also been reported from al-Shaʿbī from the Prophet ﷺ in mursal form, and we do not know anyone who said in this hadith “from Samʿān” other than Saʿīd b. Masrūq.

    ✧ From the Messenger of Allah ﷺ, he said, “A man who never did any good used to lend money to people, and he would say to his servant, ‘Take what is easy and leave what is difficult, and overlook; perhaps Allah will overlook us.’ When he died, Allah said to him, ‘Did you ever do any good?’ He said, ‘No, except that I had a servant, and I used to lend money to people. When I sent him to collect, I said to him, ‘Take what is easy and leave what is difficult, and overlook; perhaps Allah will overlook us.’’ Allah, Exalted be He, said, ‘We have overlooked you.’”

    ✧ The Prophet ﷺ said: "Whoever frees his share in a slave, the remaining [share] is completed from his wealth if he has wealth reaching the price of the slave."

    قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَهُ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ 6255 وَعَنْ يُوسُفَ بْنِ سَعِيدٍ عَنْ حَجَّاجِ بْنِ مُحَمَّدٍ عَنِ ابْنِ جُرَيْجٍ بِهِ

    ✧ The Messenger of Allah ﷺ ruled with preemption in every partnership that has not been divided: a dwelling or an enclosed garden. It is not lawful for him to sell it until he informs his partner. If he wishes, he takes it; and if he wishes, he leaves it. If he sells and does not inform him, then [the partner] has more right to it. [6255] And from Yusuf b. Sa'id, from Hajjaj b. Muhammad, from Ibn Jurayj, with it.

    ✧ The Messenger of Allah ﷺ said: "The neighbor has more right to his adjacent property." [6257] And from Mahmud b. Ghaylan, from Abu Nu'aym, from Sufyan al-Thawri, from Ibrahim b. Maysarah, with it.

    ✧ From the Prophet ﷺ: "The partner is a preemptor, and preemption applies in everything." [6260] And from Muhammad b. 'Ali b. Maymun al-Raqqi, from Muhammad b. Yusuf al-Firyabi, from Isra'il, from 'Abd al-'Aziz b. Rufay', from Ibn Abi Mulaykah, from the Prophet ﷺ.

    ✧ From al-Shaʿbī regarding a man who bought a rock and built on it, then the preemptor came. He said: «He takes it by its value,» meaning the value of the building.
