عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الْمُقْسِطِينَ عِنْدَ اللهِ تَعَالَى عَلَى مَنَابِرَ مِنْ نُورٍ عَنْ يَمِينِ الرَّحْمَنِ الَّذِينَ يَعْدِلُونَ فِي حُكْمِهِمْ وَأَهْلِيهِمْ وَمَا وُلُّوا»
The Prophet [SAW] said: "Those who are just and fair will be with Allah, Most High, on thrones of light, at the right hand of the Most Merciful, those who are just in their rulings and in their dealings with their families and those of whom they are in charge." Muhammad (one of the narrators) said in his Hadith: "And both of His hands are right hands." (Using translation from Nasāʾī 5379)

✧ The Messenger of Allah ﷺ said: "Indeed, those who are just in their rulings on behalf of Allah will be upon pulpits of light on the Day of Resurrection, before the Most Merciful, because of the justice they established in this world." Abu Abd al-Rahman said: Shu'ayb b. Abi Hamzah considered it mawquf.

عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ وَاحِدٌ» قَالَ ابْنُ الْهَادِ فَحَدَّثْتُ أَبَا بَكْرِ بْنَ عَمْرِو بْنِ حَزْمٍ فَقَالَ هَكَذَا حَدَّثَنِي أَبُو سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ إِسْحَاقُ لَمْ أَفْهَمْ عَمْرَو بْنَ الْعَاصِي مَنْ عَبْدُ الْعَزِيزِ 5888 أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا الْمُقْرِئُ قَالَ حَدَّثَنَا حَيْوَةُ بْنُ شُرَيْحٍ عَنْ يَزِيدَ بْنِ الْهَادِ كِلَا الْحَدِيثَيْنِ بِإِسْنَادِهِمَا سَوَاءٌ مِثْلَهُ
✧ From the Messenger of Allah ﷺ, he said: "When a judge rules and strives, and is correct, he gets two rewards. When he rules and strives, and errs, he gets one reward." Ibn al-Had said: I narrated this to Abu Bakr b. Amr b. Hazm, and he said: This is how Abu Salamah narrated to me from Abu Hurayrah. Ishaq said: I did not understand from Amr b. al-As who Abd al-Aziz is. 5888 Ishaq b. Ibrahim informed us, he said: Al-Muqri informed us, he said: Haywah b. Shurayh narrated to us from Yazid b. al-Had. Both hadiths with their chains are identical, similar to it.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ سَبْعَةٌ يُظِلُّهُمُ اللهُ يَوْمَ الْقِيَامَةِ بِظِلِّهِ يَوْمَ لَا ظِلَّ إِلَّا ظِلُّهُ إِمَامٌ عَادِلٌ وَشَابٌّ نَشَأَ فِي عِبَادَةِ اللهِ وَرَجُلٌ ذَكَرَ اللهَ فِي خَلَاءٍ فَفَاضَتْ عَيْنَاهُ وَرَجُلٌ قَلْبُهُ مُعَلَّقٌ بِالْمَسْجِدِ وَرَجُلَانِ تَحَابَّا فِي اللهِ وَرَجُلٌ دَعَتْهُ امْرَأَةٌ ذَاتُ مَنْصِبٍ وَجَمَالٍ إِلَى نَفْسِهَا فَقَالَ إِنِّي أَخَافُ اللهَ وَرَجُلٌ تَصَدَّقَ بِصَدَقَةٍ فَأَخْفَاهَا حَتَّى لَا تَعْلَمَ شِمَالُهُ مَا صَنَعَتْ يَمِينُهُ
The Prophet ﷺ said, "Seven (people) will be shaded by Allah by His Shade on the Day of Resurrection when there will be no shade except His Shade. (They will be), a just ruler, a young man who has been brought up in the worship of Allah, a man who remembers Allah in seclusion and his eyes are then flooded with tears, a man whose heart is attached to mosques (offers his compulsory congregational prayers in the mosque), two men who love each other for Allah's Sake, a man who is called by a charming lady of noble birth to commit illegal sexual intercourse with her, and he says, 'I am afraid of Allah,' and (finally), a man who gives in charity so secretly that his left hand does not know what his right hand has given." عَنْ رَسُولِ اللهِ ﷺ لَقُلْتُ إِنَّ الْقَاضِيَ إِذَا اجْتَهَدَ فَلَيْسَ عَلَيْهِ شَيْءٌ وَلَكِنْ قَالَ رَسُولُ اللهِ ﷺ «الْقُضَاةُ ثَلَاثَةٌ اثْنَانِ فِي النَّارِ وَوَاحِدٌ فِي الْجَنَّةِ رَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ فَهُوَ فِي الْجَنَّةِ وَرَجُلٌ عَرَفَ الْحَقَّ فَلَمْ يَقْضِ بِهِ وَجَارَ فِي الْحُكْمِ فَهُوَ فِي النَّارِ وَرَجُلٌ لَمْ يَعْرِفِ الْحَقَّ فَقَضَى لِلنَّاسِ عَنْ جَهْلٍ فَهُوَ فِي النَّارِ»
✧ On the authority of the Messenger of Allah ﷺ—I would have said: When a judge strives (to reach a ruling), he bears no blame. But the Messenger of Allah ﷺ said: “Judges are of three types: two are in the Fire and one is in Paradise. A man who knew the truth and judged by it—he is in Paradise. A man who knew the truth but did not judge by it and was unjust in his ruling—he is in the Fire. And a man who did not know the truth and judged for the people out of ignorance—he is in the Fire.”

قَالَ رَسُولُ اللهِ ﷺ «مَنِ اسْتُعْمِلَ عَلَى الْقَضَاءِ فَكَأَنَّمَا ذُبِحَ بِالسِّكِّينِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ عُثْمَانُ بْنُ مُحَمَّدٍ الْأَخْنَسِيُّ لَيْسَ بِذَاكَ الْقَوِيِّ وَإِنَّمَا ذَكَرْنَا لِئَلَّا يَخْرُجَ عُثْمَانُ مِنَ الْوَسَطِ وَيَجْعَلَ ابْنُ أَبِي ذِئْبٍ عَنْ سَعِيدٍ
✧ The Messenger of Allah ﷺ said: “Whoever is appointed to the judiciary is as if he has been slaughtered with a knife.” Abu Abd al-Rahman said: Uthman b. Muhammad al-Akhnasi is not that strong; we mentioned this only so that Uthman would not be left out of the middle rank, and so that Ibn Abi Dhi'b is made to transmit from Sa'id.

✧ On the authority of the Prophet ﷺ, he said: “You will eagerly desire leadership, and it will be a regret and a remorse on the Day of Resurrection. What a good wet-nurse she is, and what an evil weaner!”

جَاءَ رَجُلَانِ مِنَ الْأَشْعَرِيِّينَ إِلَى النَّبِيِّ ﷺ فَجَعَلَا يُعَرِّضَانِ بِالْعَمَلِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَخْوَنَكُمْ عِنْدِي مَنْ طَلَبَهُ» فَمَا اسْتَعَانَ بِهِمَا عَلَى شَيْءٍ قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَدْخَلَ عَبَّادُ بْنُ الْعَوَّامِ بَيْنَ أَخِيهِ وَبَيْنَ أَبِي بُرْدَةَ قُرَّةَ بْنَ بِشْرٍ
✧ Two men from the Ash'aris came to the Prophet ﷺ and began to solicit an appointment. The Messenger of Allah ﷺ said: “The most treacherous of you in my sight is the one who asks for it.” So he did not seek their help in anything. Abu Abd al-Rahman said: Abbad b. al-Awwam inserted Qurrah b. Bishr between his brother and Abu Burdah.

أَتَيْتُ رَسُولَ اللهِ ﷺ أَنَا وَرَجُلَانِ فَتَشَهَّدَ أَحَدُهُمَا وَقَالَ يَا رَسُولَ اللهِ جِئْنَا تَسْتَعِينُ بِنَا عَلَى بَعْضِ عَمَلِكَ وَتَشَهَّدَ الْآخَرُ فَقَالَ مِثْلَ مَقَالَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَخْوَنَكُمْ عِنْدِي مَنْ يَطْلُبُهُ» فَلَمْ يَسْتَعِنْ بِهِمَا فِي شَيْءٍ حَتَّى قُبِضَ
✧ I came to the Messenger of Allah ﷺ with two men. One of them bore witness and said: O Messenger of Allah, we have come so that you may seek our help in some of your work. The other bore witness and said the like of his statement. The Messenger of Allah ﷺ said: “The most treacherous of you in my sight is the one who asks for it.” So he did not seek their help in anything until he passed away.

أَقْبَلْتُ عَلَى النَّبِيِّ ﷺ وَمَعِي رَجُلَانِ مِنَ الْأَشْعَرِيِّيِّنَ أَحَدُهُمَا عَنْ يَمِينِي وَالْآخَرُ عَنْ يَسَارِي ورَسُولُ اللهِ ﷺ يَسْتَاكُ فَكِلَاهُمَا سَأَلَ الْعَمَلَ قُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَطْلَعَانِي عَلَى مَا فِي أَنْفُسِهِمَا وَمَا شَعَرْتُ أَنَّهُمَا يَطْلُبَانِ الْعَمَلَ فَكَأَنِّي أَنْظُرُ إِلَى سِوَاكِهِ تَحْتَ شَفَتِهِ قَلُصَتْ قَالَ «إِنَّا لَا أَوْ لَنْ نَسْتَعْمِلَ عَلَى عَمَلِنَا مَنْ أَرَادَهُ وَلَكِنْ اذْهَبْ أَنْتَ» فَبَعَثَهُ عَلَى الْيَمَنِ ثُمَّ أَتْبَعَهُ مُعَاذَ بْنَ جَبَلٍ
✧ I approached the Prophet ﷺ with two men from the Ash'aris, one on my right and the other on my left, while the Messenger of Allah ﷺ was using a toothstick. Both of them asked for an appointment. I said: By the One who sent you with the truth, they did not inform me of what was in their hearts, and I did not realize that they were seeking the appointment. It was as if I could see his toothstick under his lip, and it had receded. He said: “We do not—or we will not—appoint over our work anyone who desires it. But you go.” So he sent him to Yemen, then sent Mu'adh b. Jabal after him.

أَنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ رَسُولَ اللهِ ﷺ فَقَالَ أَلَا تَسْتَعْمِلُنِي كَمَا اسْتَعْمَلْتَ فُلَانًا؟ قَالَ «إِنَّكُمْ سَتَلْقَوْنَ بَعْدِي أَثَرَةً فَاصْبِرُوا حَتَّى تَلْقَوْنِي عَلَى الْحَوْضِ»
✧ A man from the Ansar came to the Messenger of Allah ﷺ and said: Will you not appoint me as you appointed so-and-so? He said: “You will encounter after me preferential treatment, so be patient until you meet me at the Basin.”

قَالَ كَأَنَّهُ يَعْنِي النَّبِيَّ ﷺ «لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ أُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا عَلَى غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا»
✧ He said, as if meaning the Prophet ﷺ: “Do not ask for leadership, for if you are given it after asking, you will be left to it; but if you are given it without asking, you will be helped in it.”

أَخْبَرَهُ أَنَّهُ قَدِمَ الرَّكْبُ مِنْ بَنِي تَمِيمٍ عَلَى النَّبِيِّ ﷺ قَالَ أَبُو بَكْرٍ أَمِّرِ الْقَعْقَاعَ بْنَ مَعْبَدٍ وَقَالَ عُمَرُ بَلْ أَمِّرِ الْأَقْرَعَ بْنَ حَابِسٍ فَتَمَارَيَا حَتَّى ارْتَفَعَتْ أَصْوَاتُهُمَا فَنَزَلَتْ فِي ذَلِكَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُقَدِّمُوا بَيْنَ يَدَيِ اللهِ وَرَسُولِهِ} [الحجرات 1] حَتَّى انْقَضَتِ الْآيَةُ {وَلَوْ أَنَّهُمْ صَبَرُوا حَتَّى تَخْرُجَ إِلَيْهِمْ لَكَانَ خَيْرًا لَهُمْ} [الحجرات 5]
✧ He informed him that the delegation of Banu Tamim came to the Prophet ﷺ. Abu Bakr said, "Appoint al-Qa'qa' b. Ma'bad as commander," while 'Umar said, "Rather, appoint al-Aqra' b. Habis." They disputed until their voices rose, and regarding that was revealed: {O you who believe, do not put [yourselves] before Allah and His Messenger} [al-Hujurat: 1] until the verse ended: {And if they had been patient until you came out to them, it would have been better for them} [al-Hujurat: 5].

عَصَمَنِي اللهُ ﷻ بِشَيْءٍ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ لَمَّا هَلَكَ كِسْرَى قَالَ «مَنِ اسْتَخْلَفُوا؟» قَالُوا ابْنَتَهُ قَالَ «لَنْ يُفْلِحَ قَوْمٌ وَلَّوْا أَمْرَهُمُ امْرَأَةً»
"Allah protected me with something that I heard from the Messenger of Allah [SAW]. When Chosroes died, he said: 'Whom have they appointed as his successor?' They said: 'His daughter.' He said: 'No people will ever prosper who entrust their leadership to a woman.'" (Using translation from Nasāʾī 5388)

أَنَّهَ سَمِعَهُ يَقُولُ لَمَّا نَزَلَ أَهْلُ قُرَيْظَةَ عَلَى حُكْمِ سَعْدٍ أَتَى النَّبِيُّ ﷺ عَلَى حِمَارٍ فَقَالَ «إِنَّ هَؤُلَاءِ نَزَلُوا عَلَى حُكْمِكَ» قَالَ فَإِنِّي أَحْكُمُ أَنْ تُقْتَلَ مُقَاتِلَتُهُمْ وَتُسْبَى ذَرَارِيُّهُمْ قَالَ «حَكَمْتَ فِيهِمْ بِحُكْمِ الْمَلِكِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ مُحَمَّدُ بْنُ صَالِحٍ
✧ That he heard him say: When the people of Qurayzah submitted to the judgment of Sa'd, the Prophet ﷺ came on a donkey and said, "These people have submitted to your judgment." He said, "Then I judge that their fighters be killed and their offspring be taken captive." He said, "You have judged among them with the judgment of the King." Abu 'Abd al-Rahman said: Muhammad b. Salih contradicted him.

وَأَنْ تُقْسَمَ أَمْوَالُهُمْ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «حَكَمْتَ فِيهِمْ بِحُكْمِ اللهِ الَّذِي حَكَمَ بِهِ فَوْقَ سَبْعِ سَمَوَاتٍ»
✧ And that their wealth be divided. That was mentioned to the Prophet ﷺ and he said, "You have judged among them with the judgment of Allah, which He judged from above the seven heavens."

أَنَّهُ لَمَّا وَفَدَ إِلَى رَسُولِ اللهِ ﷺ مَعَ قَوْمِهِ سَمِعَهُ وَهُمْ يُكَنُّونَ هَانِئًا أَبَا الْحَكَمِ فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ لَهُ «إِنَّ اللهَ هُوَ الْحَكَمُ وَإِلَيْهِ الْحُكْمُ فَلِمَ تُكَنَّى أَبَا الْحَكَمِ؟» قَالَ إِنَّ قَوْمِي إِذَا اخْتَلَفُوا فِي شَيْءٍ أَتَوْنِي فَحَكَمْتُ بَيْنَهُمْ فَرَضِيَ كِلَا الْفَرِيقَيْنِ فَقَالَ «مَا أَحْسَنَ مِنْ هَذَا فَمَا لَكَ مِنَ الْوَلَدِ؟» قَالَ لِي شُرَيْحٌ وَعَبْدَ اللهِ وَمُسْلِمٌ قَالَ «مَنْ أَكْبَرُهُمْ؟» قَالَ شُرَيْحٌ قَالَ فَأَنْتَ أَبُو شُرَيْحٍ وَدَعَا لَهُ وَلِوَلَدِهِ
✧ That when he came as a delegate to the Messenger of Allah ﷺ with his people, he heard them giving Hani' the kunya Abu al-Hakam. The Messenger of Allah ﷺ called him and said to him, "Allah is the Judge, and to Him belongs judgment. So why are you called Abu al-Hakam?" He said, "When my people disagree about something, they come to me and I judge between them, and both parties are satisfied." He said, "How good this is! What children do you have?" He said, "I have Shurayh, 'Abdullah, and Muslim." He said, "Who is the eldest of them?" He said, "Shurayh." He said, "Then you are Abu Shurayh." And he supplicated for him and his children.

كَانَتْ مُلُوكٌ بَعْدَ عِيسَى بَدَّلُوا التَّوْرَاةَ وَالْإِنْجِيلَ فَكَانَ فِيهِمْ مُؤْمِنُونَ يَقْرَءُونَ التَّوْرَاةَ فَقِيلَ لِمُلُوكِهِمْ مَا نَجْدُ شَتْمًا أَشَدَّ مِنْ شَتْمٍ يَشْتِمُونَنَا هَؤُلَاءِ أَنَّهُمْ يَقْرَءُونَ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] هَؤُلَاءِ الْآيَاتُ مَعَ مَا يَعِيبُونَنَا بِهِ فِي أَعْمَالِنَا فِي قِرَاءَتِهِمْ فَادْعُهُمْ فَلْيَقْرَءُوا كَمَا نَقْرَأُ وَلْيُؤْمِنُوا كَمَا آمَنَّا فَدَعَاهُمْ فَجَمَعَهُمْ وَعَرَضَ عَلَيْهِمُ الْقَتْلَ أَوْ يَتْرُكُوا قِرَاءَةَ التَّوْرَاةِ وَالْإِنْجِيلِ إِلَّا مَا بَدَّلُوا مِنْهَا فَقَالُوا مَا تُرِيدُونَ إِلَى ذَلِكَ؟ دَعُونَا فَقَالَتْ طَائِفَةٌ مِنْهُمْ ابْنُوا لَنَا أُسْطُوَانَةً ثُمَّ ارْفَعُونَا إِلَيْهَا ثُمَّ أَعْطُونَا شَيْئًا نَرْفَعُ بِهِ طَعَامَنَا وَشَرَابَنَا فَلَا نَرُدُّ عَلَيْكُمْ وَقَالَتْ طَائِفَةٌ دَعُونَا نَسِيحُ فِي الْأَرْضِ وَنَهِيمُ وَنَشْرَبُ كَمَا يَشْرَبُ الْوَحْشُ فَإِنْ قَدَرْتُمْ عَلَيْنَا فِي أَرْضِكُمْ فَاقْتُلُونَا وَقَالَتْ طَائِفَةٌ ابْنُوا لَنَا دُورًا فِي الْفَيَافِي وَنَحْتَفِرُ الْآبَارَ وَنَحْتَرِثُ الْبُقُولَ فَلَا نَرِدُ عَلَيْكُمْ وَلَا نَقْرَبُكُمْ وَلَيْسَ أَحَدٌ مِنَ الْقَبَائِلِ إِلَّا ولَهُ حَمِيمٌ فِيهِمْ قَالَ فَفَعَلُوا ذَلِكَ فَأَنْزَلَ اللهُ تَعَالَى {وَرَهْبَانِيَّةً ابْتَدَعُوهَا مَا كَتَبْنَاهَا عَلَيْهِمْ إِلَّا ابْتِغَاءَ رِضْوَانِ اللهِ فَمَا رَعَوْهَا حَقَّ رِعَايَتِهَا} [الحديد 27] وَالْآخَرُونَ قَالُوا نَتَعَبَّدُ كَمَا تَعَبَّدَ فُلَانٌ وَنَسِيحُ كَمَا سَاحَ فُلَانٌ وَنَتَّخِذُ دُورًا كَمَا اتَّخَذَ فُلَانٌ عَلَى شِرْكِهِمْ لَا عِلْمَ لَهُمْ بِإِيمَانِ الَّذِينَ اقْتَدُوا بِهِ فَلَمَّا بَعَثَ اللهُ النَّبِيَّ ﷺ وَلَمْ يَبْقَ مِنْهُمْ إِلَّا قَلِيلٌ انْحَطَّ رَجُلٌ مِنْ صَوْمَعَتِهِ وَجَاءَ سَائِحٌ مِنْ سِيَاحَتِهِ وَصَاحِبُ الدَّيْرِ مِنْ دَيْرِهِ فَآمَنُوا بِهِ وَصَدَّقُوهُ فَقَالَ اللهُ تَعَالَى {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللهَ وَآمِنُوا بِرَسُولِهِ يُؤْتِكُمْ كِفْلَيْنِ مِنْ رَحْمَتِهِ} [الحديد 28] أَجْرَيْنِ بِإِيمَانِهِمْ بِعِيسَى عَلَيْهِ السَّلَامُ وَبِالتَّوْرَاةِ وَالْإِنْجِيلِ وَبِإِيمَانِهِمْ بِمُحَمَّدٍ ﷺ وَتَصْدِيقِهِمْ قَالَ {يَجْعَلْ لَكُمْ نُورًا تَمْشُونَ بِهِ} [الحديد 28] الْقُرْآنَ وَاتِّبَاعَهُمُ النَّبِيَّ ﷺ قَالَ {لِئَلَّا يَعْلَمَ أَهْلُ الْكِتَابِ} [الحديد 29] الَّذِينَ يَتَشَبَّهُونَ بِكُمْ {أَلَّا يَقْدِرُونَ عَلَى شَيْءٍ مِنْ فَضْلِ اللهِ وَأَنَّ الْفَضْلَ بِيَدِ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ وَاللهُ ذُو الْفَضْلِ الْعَظِيمِ} [الحديد 29] الْآيَةَ
✧ There were kings after Jesus who altered the Torah and the Gospel. Among them were believers who recited the Torah. It was said to their kings, "We do not find any insult more severe than the insult these people direct at us, for they recite {And whoever does not judge by what Allah has revealed, then it is those who are the disbelievers} [al-Ma'idah: 44] and these verses, along with the faults they find in our actions during their recitation. So summon them and let them recite as we recite and believe as we believe." So he summoned them and gathered them, and he offered them death or leaving off recitation of the Torah and the Gospel except what they had altered from it. They said, "What do you want from that? Leave us alone." One group of them said, "Build for us a pillar, then raise us up to it, then give us something with which to lift our food and drink, and we will not return to you." Another group said, "Let us roam the earth and wander and drink as wild animals drink. If you catch us in your land, then kill us." Another group said, "Build for us houses in the deserts, and we will dig wells and cultivate herbs, and we will not return to you or come near you." There was not one of the tribes but had a close friend among them. He said: So they did that. Then Allah, exalted is He, revealed: {And monasticism, which they innovated; We did not prescribe it for them except [for] seeking the pleasure of Allah, and they did not observe it with proper observance} [al-Hadid: 27]. The others said, "We will worship as so-and-so worshipped and roam as so-and-so roamed and adopt houses as so-and-so adopted, upon their polytheism, without knowledge of the faith of those whom they imitated." When Allah sent the Prophet ﷺ and only a few of them remained, a man descended from his hermitage, a wanderer came from his wandering, and the owner of the monastery from his monastery, and they believed in him and declared him true. Then Allah, exalted is He, said: {O you who believe, fear Allah and believe in His Messenger; He will give you a double portion of His mercy} [al-Hadid: 28] — two rewards: one for their belief in Jesus ﷺ and in the Torah and the Gospel, and one for their belief in Muhammad ﷺ and their declaration of him as true. He said: {He will make for you a light by which you may walk} [al-Hadid: 28] — the Qur'an and their following of the Prophet ﷺ. He said: {So that the People of the Book may know} [al-Hadid: 29] — those who resemble you — {that they have no power over anything of the bounty of Allah, and that bounty is in the hand of Allah; He gives it to whom He wills. And Allah is the possessor of great bounty} [al-Hadid: 29] — the verse.

أُحَدِّثُهُ كُلَّ أَحَدٍ إِنَّ رَسُولَ اللهِ ﷺ قَامَ عَلَى بَابٍ وَنَحْنُ فِيهِ فَقَالَ «الْأَئِمَّةُ مِنْ قُرَيْشٍ إِنَّ لَهُمْ عَلَيْكُمْ حَقًّا وَلَكُمْ عَلَيْهِمْ مِثْلُ ذَلِكَ مَا إِنِ اسْتُرْحِمُوا رَحِمُوا وَإِنْ عَاهَدُوا وَفَوْا وَإِنْ حَكَمُوا عَدَلُوا فَمَنْ لَمْ يَفْعَلْ ذَلِكَ مِنْهُمْ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ»
✧ I was telling everyone that the Messenger of Allah ﷺ stood at a door while we were inside and said, "The Imams are from Quraysh. They have a right over you, and you have a right over them: if they are asked for mercy, they show mercy; if they make a covenant, they fulfill it; and if they judge, they are just. Whoever of them does not do that, upon him is the curse of Allah, the angels, and all people."

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا أَنَا بَشَرٌ وَإِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَلَعَلَّ بَعْضُكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي لَهُ عَلَى نَحْوِ مَا أَسْمَعُ مِنْهُ فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ مِنْ حَقِّ أَخِيهِ فَلَا يَأْخُذْ مِنْهُ شَيْئًا فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ»
✧ That the Messenger of Allah ﷺ said, "I am only a human being, and you bring your disputes to me. Perhaps some of you is more eloquent in presenting his argument than others, so I judge in his favor according to what I hear from him. Whoever I judge in his favor concerning something of his brother's right, let him not take anything of it, for I am only cutting off for him a piece of the Fire."

✧ "Judge by what is in the Book of Allah. If it is not in the Book of Allah, then by the Sunnah of the Messenger of Allah ﷺ. If it is not in the Book of Allah or the Sunnah of the Messenger of Allah ﷺ, then judge by what the righteous have judged. If it is not in the Book of Allah or the Sunnah of the Messenger of Allah ﷺ, and the righteous have not judged it, then if you wish, proceed, and if you wish, hold back. I do not see holding back as anything but better for you. And peace be upon you."

أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ أَنَّ أَبِي أَدْرَكَهُ الْحَجُّ وَهُوَ شَيْخٌ كَبِيرٌ لَا يَثْبُتُ عَلَى رَاحِلَتِهِ فَإِنْ شَدَدْتُهُ خَشِيتُ أَنْ يَمُوتَ أَفَأَحُجُّ عَنْهُ؟ قَالَ «أَرَأَيْتَ لَوْ كَانَ عَلَيْهِ دَيْنٌ فَقَضَيْتَهُ أَكَانَ مُجْزِئًا؟» قَالَ نَعَمْ قَالَ «فَحُجَّ عَنْ أَبِيكَ»
✧ That a man asked the Prophet ﷺ: My father has reached old age while Hajj is obligatory upon him, and he is an elderly man who cannot stay upright on his riding beast. If I tie him on, I fear he may die. Should I perform Hajj on his behalf? He said, "Consider if he had a debt and you paid it, would that suffice?" He said yes. He said, "Then perform Hajj on behalf of your father."

✧ I was riding behind the Prophet ﷺ when a man came to him and said, "My father is old and has not performed Hajj. If I carry him on a camel, he cannot stay upright on it; if I tie him on it, I fear for him." He said, "Would you be a payer of a debt if he owed one?" He said yes. He said, "Perform Hajj on behalf of your father." Abu 'Abd al-Rahman said: Muhammad b. Sirin contradicted him, saying it was from al-Fadl b. 'Abbas.

✧ That he was riding behind the Prophet ﷺ when a man came to him and said, "O Messenger of Allah, my mother is an elderly old woman. If I carry her, she cannot hold on; if I tie her, I fear I may kill her." The Messenger of Allah ﷺ said, "Consider if your mother had a debt, would you pay it?" He said yes. He said, "Then perform Hajj on behalf of your mother."

✧ That he was riding behind the Messenger of Allah ﷺ on the morning of sacrifice when a woman from Khath'am came to him and said, "O Messenger of Allah, the obligation of Allah regarding Hajj upon His servants has reached my father, an elderly man who cannot ride except lying sideways. Should I perform Hajj on his behalf?" He said, "Yes, perform Hajj on his behalf." He said, "If he had a debt, would you pay it?"

أَخْبَرَهُ أَنَّ امْرَأَةً مِنْ خَثْعَمٍ اسْتَفْتَتْ رَسُولَ اللهِ ﷺ فِي حَجَّةِ الْوَدَاعِ وَالْفَضْلُ بْنُ عَبَّاسٍ رَدِيفُ رَسُولِ اللهِ ﷺ فقَالَتْ يَا رَسُولَ اللهِ إِنَّ فَرِيضَةَ اللهِ فِي الْحَجِّ عَلَى عِبَادِهِ أَدْرَكَتْ أَبِي شَيْخًا كَبِيرًا لَا يَسْتَوِي عَلَى الرَّاحِلَةِ فَهَلْ يَقْضِي عَنْهُ أَنْ أَحُجَّ عَنْهُ؟ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ «نَعَمْ» فَأَخَذَ الْفَضْلُ بْنُ عَبَّاسٍ يَلْتَفِتُ إِلَيْهَا وَكَانَتِ امْرَأَةً حَسْنَاءَ وَأَخَذَ رَسُولُ اللهِ ﷺ الْفَضْلَ فَيُحَوِّلُ وَجْهَهُ مِنَ الشِّقِّ الْآخَرَ
✧ He informed him that a woman from Khath'am sought a ruling from the Messenger of Allah ﷺ during the Farewell Pilgrimage, while al-Fadl b. Abbas was riding behind the Messenger of Allah ﷺ. She said, 'O Messenger of Allah, the obligation of Allah upon His servants regarding the Hajj has found my father an old man who cannot sit firmly on the riding camel. Can I perform Hajj on his behalf?' The Messenger of Allah ﷺ said to her, 'Yes.' Al-Fadl b. Abbas began to look at her, and she was a beautiful woman. The Messenger of Allah ﷺ took hold of al-Fadl and turned his face to the other side.

عَنِ النَّبِيِّ ﷺ قَالَ اخْتَصَمَتِ امْرَأَتَانِ إِلَى سُلَيْمَانَ بْنِ دَاوُدَ عَلَيْهِمَا السَّلَامُ فِي وَلَدٍ كُلُّ وَاحِدَةٍ مِنْهُمَا تَزْعُمُ أَنَّهَا وَلَدَتْهُ فَقَالَ نَبِيُّ اللهِ ﷺ هَاتُوا السِّكِّينَ حَتَّى نَقْطَعَهُ بَيْنَهُمَا قَالَتْ إِحْدَاهُمَا بَلْ أَدَعُهُ لَهَا قَالَ وَكَانَتِ الْأُخْرَى رَضِيَتْ فَقَالَ لَوْ كَانَ ابْنَكِ لَمْ تَرْضَيْ أَنْ يُقْطَعَ فَقَضَى بِهِ لِلْأُخْرَى
✧ From the Prophet ﷺ, he said, 'Two women brought a dispute to Sulayman b. Dawud, peace be upon them, concerning a child, each of them claiming that she had given birth to him. The Prophet of Allah ﷺ said, "Bring me a knife so that I may cut him in two between them." One of them said, "Rather, I give him up to her." He said, "The other one was content." He said, "If he were your son, you would not be content for him to be cut." So he ruled in favor of the other.'

✧ From the Messenger of Allah ﷺ that he said, 'Two women went out with their two young sons. A wolf attacked one of them and took her child. In the morning they were disputing over the remaining boy. They brought their dispute to Dawud, the Prophet, ﷺ, and he ruled in favor of the older of them. They passed by Sulayman, ﷺ, and he said, "What is your situation?" They told him the story, and he said, "Bring me a knife so that I may split the boy between you." The younger one said, "Will you split him?" He said, "Yes." She said, "Do not do it; my share of him is hers." He said, "He is your son," and ruled in his favor for her.'

✧ From the Prophet ﷺ, he said, 'Two women went out with their two sons. A wolf took one of them, and they disputed over the child before Dawud, ﷺ. He ruled in favor of the older of them. They passed by Sulayman, and he said, "How did he judge between you?" She said, "He ruled in favor of the older." Sulayman said, "Cut him in two halves, for this one a half and for this one a half." The older one said, "Yes, cut him." The younger one said, "Do not cut him; he is her child." So he ruled in favor of the one who refused to have him cut.'

يُحَدِّثُهُ عَنْ رَسُولِ اللهِ ﷺ قَالَ وَقَالَ بَيْنَمَا امْرَأَتَانِ مَعَهُمَا ابْنَاهُمَا جَاءَ الذِّئْبُ فَذَهَبَ بِابْنِ إِحْدَاهُمَا فَقَالَتْ هَذِهِ لِصَاحِبَتِهَا إِنَّمَا ذَهَبَ بِابْنِكِ وَقَالَتِ الْأُخْرَى إِنَّمَا ذَهَبَ بِابْنِكِ فَتَحَاكَمَتَا إِلَى دَاوُدَ عَلَيْهِ السَّلَامُ فَقَضَى لِلْكُبْرَى فَخَرَجَتَا عَلَى سُلَيْمَانَ بْنِ دَاوُدَ عَلَيْهِمَا السَّلَامُ فَأَخْبَرَتَاهُ فَقَالَ ائْتُونِي بِالسِّكِّينِ أَشُقُّهُ بَيْنَهُمَا فَقَالَتِ الصُّغْرَى لَا تَفْعَلْ يَرْحَمُكَ اللهُ هُوَ ابْنُهَا فَقَضَى بِهِ لِلصُّغْرَى قَالَ أَبُو هُرَيْرَةَ وَاللهِ إِنْ سَمِعْتُ بِالسِّكِّينِ قَطُّ إِلَّا يَوْمَئِذٍ وَمَا كُنَّا نَقُولُ إِلَّا الْمُدْيَةَ
✧ He narrated to him from the Messenger of Allah ﷺ, and he said, 'While two women were with their two sons, a wolf came and took the son of one of them. The other said to her companion, "It took your son." The other said, "It took your son." They took their dispute to Dawud, ﷺ, and he ruled in favor of the older. They went out to Sulayman b. Dawud, peace be upon them, and told him. He said, "Bring me a knife so that I may split him between you." The younger said, "Do not do it, may Allah have mercy on you. He is her son." So he ruled in favor of the younger. Abu Hurayrah said, "By Allah, I never heard of a knife except on that day, and we used to call it a mudyah."

بَعَثَ النَّبِيُّ ﷺ خَالِدَ بْنَ الْوَلِيدِ إِلَى بَنِي جَذِيمَةَ فَدَعَاهُمْ إِلَى الْإِسْلَامِ فَلَمْ يُحْسِنُوا أَنْ يَقُولُوا أَسْلَمْنَا فَجَعَلُوا يَقُولُونَ صَبَأْنَا صَبَأْنَا وَجَعَلَ خَالِدٌ بِهِمْ أَسْرًا وَقَتْلًا قَالَ وَدَفَعَ إِلَى كُلِّ رَجُلٍ مِنَّا أَسِيرًا حَتَّى إِذَا أَصْبَحَ يَوْمًا أَمَرَنَا خَالِدُ بْنُ الْوَلِيدِ أَنْ يَقْتُلَ كُلُّ رَجُلٍ مِنَّا أَسِيرَهُ قَالَ ابْنُ عُمَرَ فَقُلْتُ وَاللهِ لَا أُقْتُلُ أَسِيرِي وَلَا يَقْتُلُ أَحَدٌ مِنْ أَصْحَابِي أَسِيرَهُ قَالَ فَقَدِمْنَا عَلَى رَسُولِ اللهِ ﷺ فَذُكِرَ لَهُ صَنِيعُ خَالِدٍ فَقَالَ النَّبِيُّ ﷺ وَرَفَعَ يَدَيْهِ «اللهُمَّ إِنِّي أَبْرَأُ إِلَيْكَ مِمَّا صَنَعَ خَالِدٌ» اللهُمَّ إِنِّي أَبْرَأُ إِلَيْكَ مِمَّا صَنَعَ خَالِدٌ
✧ The Prophet ﷺ sent Khalid b. al-Walid to Banu Jadhima. He called them to Islam, but they were not good at saying "We have become Muslims," so they kept saying, "We have apostatized, we have apostatized." Khalid began taking them as captives and killing them. He said, 'He handed over to each one of us a captive, until one morning Khalid b. al-Walid ordered us each to kill his captive.' Ibn Umar said, 'I said, "By Allah, I will not kill my captive, and no one of my companions will kill his captive."' He said, 'We came to the Messenger of Allah ﷺ and Khalid's action was mentioned to him. The Prophet ﷺ raised his hands and said, "O Allah, I declare my innocence to You of what Khalid has done. O Allah, I declare my innocence to You of what Khalid has done."

أَنَّهُ خَاصَمَ رَجُلًا مِنَ الْأَنْصَارِ قَدْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ كَانَا يَسْقِيَانِ بِهِ كِلَاهُمَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ عَلَيْهِ فَأَبَى عَلَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ «اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ» فَغَضِبَ الْأَنْصَارِيُّ فََقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ وَاسْتَوْعَى رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ حَقَّهُ وَكَانَ رَسُولُ اللهِ ﷺ قَبْلَ ذَلِكَ أَشَارَ عَلَى الزُّبَيْرِ بِرَأْيٍ أَرَادَ فِيهِ السَّعَةَ لَهُ وَلِلْأَنْصَارِيِّ فَلَمَّا أَحْفَظَ رَسُولَ اللهِ ﷺ الْأَنْصَارِيُّ اسْتَوْعَى لِلزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الْحُكْمِ قَالَ الزُّبَيْرُ لَا أَحْسِبُ هَذِهِ الْآيَةَ أُنْزِلَتْ إِلَّا فِي ذَلِكَ فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ وَأَحَدُهُمَا يَزِيدُ عَلَى صَاحِبِهِ فِي الْقَصَّةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ قُتَيْبَةُ بْنُ سَعِيدٍ
✧ That he had a dispute with a man from the Ansar who had been present at Badr with the Messenger of Allah ﷺ concerning the water channels of the Harrah, by which they both irrigated palm trees. The Ansari said, 'Release the water so that it flows on.' He refused. The Messenger of Allah ﷺ said, 'Irrigate, O Zubayr, then release the water to your neighbor.' The Ansari became angry and said, 'O Messenger of Allah, is it because he is your aunt's son?' The face of the Messenger of Allah ﷺ changed color, then he said, 'O Zubayr, irrigate, then hold back the water until it returns to the wall.' The Messenger of Allah ﷺ gave Zubayr his full right. Before that, the Messenger of Allah ﷺ had suggested to Zubayr an opinion in which he intended leniency for both him and the Ansari. But when the Ansari angered the Messenger of Allah ﷺ, he gave Zubayr his full right in the explicit ruling. Zubayr said, 'I think this verse was revealed only about that: But no, by your Lord, they will not believe until they make you judge concerning what arises between them.' One of the two narrators adds something over the other in the story. Abu Abd al-Rahman said, 'Qutaybah b. Sa'id disagreed with him.'

✧ That a man from the Ansar brought a dispute with Zubayr to the Messenger of Allah ﷺ concerning the water channels of the Harrah by which they irrigated palm trees. ✧ That he demanded repayment of a debt owed to him by Ibn Abi Hadrad in the mosque. Their voices rose until the Messenger of Allah ﷺ heard them while he was in his house. He came out to them and lifted the curtain of his room and called, 'O Ka'b.' He said, 'At your service, O Messenger of Allah.' He said, 'Reduce your debt by this amount,' and he gestured to half. He said, 'I have done so.' He said, 'Then stand and pay it off.' Abu Abd al-Rahman said, 'Ma'mar sent it as mursal.'

✧ That he heard the Messenger of Allah ﷺ say, 'You will not believe until you love one another. Shall I not guide you to something by which you will love one another?' They said, 'Yes, O Messenger of Allah.' He said, 'Spread peace among yourselves. For by Him in Whose hand is my soul, you will not enter Paradise until you show mercy.' They said, 'O Messenger of Allah, all of us are merciful.' He said, 'It is not the mercy of one of you to his close ones, but mercy to the general public.'

✧ I heard Sahl b. Saʿd say: “Harsh words occurred between two clans of the Anṣār until they threw stones at each other. The Messenger of Allah ﷺ went to reconcile them. The prayer time arrived, so Bilāl gave the call to prayer and waited for the Messenger of Allah ﷺ, but he was delayed, so he called the iqāmah and Abū Bakr stepped forward to lead the people in prayer.”

✧ From Abū Hurayrah, Zayd b. Khālid, and Shibl, who said: “We were with the Prophet ﷺ when a man stood before him and said: ‘I adjure you by Allah to judge between us according to the Book of Allah.’ He said: ‘Speak.’ The man said: ‘My son was a worker for this man, and he committed adultery with his wife. I ransomed him with one hundred sheep and a servant. Some people had told me that my son deserved stoning, so I ransomed him. Then I asked men of knowledge, and they told me that my son deserves one hundred lashes and exile for a year.’ The Prophet ﷺ said to him: ‘By Him in whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to receive one hundred lashes and exile for a year. Go, Unays, to this man’s wife, and if she confesses, stone her.’ So Unays went to her, she confessed, and he stoned her.” Abū ʿAbd al-Raḥmān said: “We do not know of anyone who supported Sufyān in his statement “and Shibl.” Mālik narrated it from al-Zuhrī, from ʿUbayd Allāh, from Abū Hurayrah and Zayd b. Khālid. Bukayr b. al-Ashajj narrated it from ʿAmr b. Shuʿayb, from al-Zuhrī, from ʿUbayd Allāh b. ʿAbd Allāh, from Abū Hurayrah alone. The ḥadīth of Mālik and ʿAmr b. Shuʿayb is more correct than the statement of Ibn ʿUyaynah and Shibl. Yūnus b. ʿAbd al-Aʿlā informed us, saying: Ibn Wahb narrated to us, saying: I heard Mālik b. Anas.”

✧ Two men came to the Messenger of Allah ﷺ disputing before him. One of them said: “Judge between us according to the Book of Allah.” The other, who was more learned, said: “Yes, judge between us according to the Book of Allah and allow me to speak.” The Prophet said: “Speak.” He said: “My son was a worker for this man, and he committed adultery with his wife. I was told that my son deserved stoning, so I ransomed him with one hundred sheep and a slave-girl. Then I asked the people of knowledge, and they told me that my son deserves one hundred lashes and exile for a year, and that stoning is only for his wife.” The Messenger of Allah ﷺ said: “By Him in whose hand is my soul, I will judge between you according to the Book of Allah. Your sheep and slave-girl are to be returned to you.” So he had his son lashed one hundred times and exiled for a year, and he ordered Unays to stone the other man’s wife if she confessed. She confessed, so he stoned her.

أَنَّهُ كَانَ لَهُ عَلَى عَبْدِ اللهِ بْنِ أَبِي حَدْرَدٍ الْأَسْلَمِيِّ دَيْنٌ فَلَقِيَهُ فَلَزِمَهُ فَتَكَلَّمَا حَتَّى ارْتَفَعَتِ الْأَصْوَاتُ فَمَرَّ بِهِمَا رَسُولُ اللهِ ﷺ فَقَالَ «يَا كَعْبُ» فَأَشَارَ بِيَدِهِ كَأَنَّهُ يَقُولُ النِّصْفُ فَأَخَذَ نِصْفًا مِمَّا عَلَيْهِ وَتَرَكَ نِصْفًا
✧ He had a debt owed to him by ʿAbd Allāh b. Abī Ḥadrad al-Aslamī. He met him and held him to it, and they spoke until their voices rose. The Messenger of Allah ﷺ passed by them and said: “O Kaʿb,” and gestured with his hand as if to say “half.” So he took half of what was owed and waived the other half.

شَهِدْتُ رَسُولَ اللهِ ﷺ حِينَ جِيءَ بِالْقَاتِلِ يَقُودُهُ وَلِيُّ الْمَقْتُولِ فِي نِسْعَةٍ فَقَالَ رَسُولُ اللهِ ﷺ لِوَلِيِّ الْمَقْتُولِ «أَتَعْفُو؟» قَالَ لَا قَالَ «تَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ» قَالَ نَعَمْ قَالَ «اذْهَبْ» فَلَمَّا ذَهَبَ فَوَلَّى مِنْ عِنْدِهِ دَعَاهُ فَقَالَ «أَتَعْفُو؟» قَالَ لَا قَالَ «أَتَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ؟» قَالَ نَعَمْ قَالَ «اذْهَبْ بِهِ» فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ «أَمَا إِنَّكَ إِنْ عَفَوْتَ عَنْهُ يَبُوءُ بِإِثْمِهِ وَإِثْمِ صَاحِبِكَ» فَعَفَا عَنْهُ وَتَرَكَهُ فَأَنَا رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ [418] 5935 أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا يَحْيَى قَالَ حَدَّثَنَا جَامِعُ بْنُ مَطَرٍ الْحَبَطِيُّ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ مِثْلَهُ قَالَ يَحْيَى وَهَذَا أَحْسَنُ مِنْهُ
✧ I witnessed the Messenger of Allah ﷺ when the killer was brought, led by the guardian of the slain man with a leather strap. The Messenger of Allah ﷺ said to the guardian of the slain man: “Will you forgive?” He said: “No.” He said: “Will you take the blood money?” He said: “No.” He said: “Then you will kill him?” He said: “Yes.” He said: “Go.” When he went and turned away from him, he called him and said: “Will you forgive?” He said: “No.” He said: “Will you take the blood money?” He said: “No.” He said: “Then you will kill him?” He said: “Yes.” He said: “Go with him.” The Messenger of Allah ﷺ then said: “Indeed, if you forgive him, he will bear his own sin and the sin of your companion.” So he forgave him and let him go. I saw him dragging his strap. [418] 5935 Muḥammad b. Bashshār informed us: Yaḥyā narrated to us: Jāmiʿ b. Maṭar al-Ḥabaṭī narrated to us, from ʿAlqamah b. Wāʾil, from his father, from the Prophet ﷺ, something similar. Yaḥyā said: “This is better than it.”

أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ إِلَى رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمُوا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ «اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ» فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ «يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ» فَقَالَ الزُّبَيْرُ وَاللهِ إِنِّي لَأَحْسِبُ هَذِهِ الْآيَةَ أُنْزِلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ} [النساء 65]
✧ A man from the Anṣār disputed with al-Zubayr before the Messenger of Allah ﷺ about the streams of the ḥarrah from which they irrigated the date palms. The Anṣārī said: “Let the water flow.” Al-Zubayr refused, so they brought their dispute to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said to al-Zubayr: “Irrigate, O Zubayr, then release the water to your neighbor.” The Anṣārī became angry and said: “O Messenger of Allah, is it because he is your aunt’s son?” The face of the Messenger of Allah ﷺ changed color, then he said: “O Zubayr, irrigate, then hold back the water until it returns to the wall.” Al-Zubayr said: “By Allah, I think this verse was revealed about that: ‘But no, by your Lord, they will not believe…’ [Q 4:65].”

يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ «يَا عَبَّاسُ أَلَا تَعْجَبُ مِنْ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ بُغْضِ بَرِيرَةَ مُغِيثًا؟» فَقَالَ لَهَا النَّبِيُّ ﷺ «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» فَقَالَتْ يَا رَسُولَ اللهِ أَتَأْمُرُنِي؟ قَالَ «إِنَّمَا أَنَا شَفِيعٌ» قَالَتْ فَلَا حَاجَةَ لِي فِيهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ صَالِحٌ
✧ He was called Mughīth. It is as if I can see him walking behind her, weeping, his tears flowing onto his beard. The Prophet ﷺ said to al-ʿAbbās: “O ʿAbbās, are you not amazed at the love of Mughīth for Barīrah and the hatred of Barīrah for Mughīth?” The Prophet ﷺ said to her: “If only you would return to him, for he is the father of your child.” She said: “O Messenger of Allah, are you commanding me?” He said: “I am only interceding.” She said: “Then I have no need of him.” Abū ʿAbd al-Raḥmān said: “This is a good ḥadīth.”

عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَدَعَاهُ فَقَالَ «أَعْتَقْتَ غُلَامَكَ؟» قَالَ نَعَمْ فَقَالَ النَّبِيُّ ﷺ «أَنْتَ أَحْوَجُ إِلَيْهِ» ثُمَّ قَالَ «مَنْ يَشْتَرِيهِ؟» قَالَ نُعَيْمُ بْنُ عَبْدِ اللهِ أَنَا فَاشْتَرَاهُ فَأَخَذَ النَّبِيُّ ﷺ ثَمَنَهُ فَدَفَعَهُ إِلَى صَاحِبِهِ
✧ A man freed a slave after his death, and he was in need. He mentioned that to the Prophet ﷺ, so he called him and said: “Did you free your slave?” He said: “Yes.” The Prophet ﷺ said: “You are more in need of him.” Then he said: “Who will buy him?” Nuʿaym b. ʿAbd Allāh said: “I will.” So he bought him, and the Prophet ﷺ took the price and gave it to the owner.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنِ اقْتَطَعَ حَقَّ امْرِئٍ مُسْلِمٍ بِيَمِينِهِ فَقَدْ أَوْجَبَ اللهُ لَهُ النَّارَ وَحَرَّمَ عَلَيْهِ الْجَنَّةَ» فَقَالَ لَهُ رَجُلٌ وَإِنْ كَانَ شَيْئًا يَسِيرًا يَا رَسُولَ اللهِ؟ قَالَ «وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ»
✧ The Messenger of Allah ﷺ said: “Whoever seizes the right of a Muslim by his oath, Allah has made the Fire obligatory for him and forbidden Paradise to him.” A man asked: “Even if it is something small, O Messenger of Allah?” He said: “Even if it is a twig of an arāk tree.”

✧ He heard the Messenger of Allah ﷺ say: “No man seizes the right of a Muslim by his oath except that Allah forbids Paradise to him and makes the Fire obligatory for him.” A man from the people said: “O Messenger of Allah, even if it is something small?” He said: “Even if it is a tooth-stick of an arāk tree.”

إِنَّ زَوْجِي أَبَا سُفْيَانَ رَجُلٌ مُمْسِكٌ شَحِيحٌ لَا يُعْطِينِي مَا يَكْفِينِي وَبَنِيَّ أَفَآخُذُ مِنْ مَالِهِ وَهُوَ لَا يَعْلَمُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «خُذِي مَا يَكْفِيكِ وَبَنِيكِ بِالْمَعْرُوفِ»
✧ My husband Abū Sufyān is a stingy man who does not give me and my children enough. May I take from his wealth without his knowledge?” The Messenger of Allah ﷺ said: “Take what is sufficient for you and your children, in a fair manner.”

✧ I heard the Messenger of Allah ﷺ say: “None of you should pass two different rulings in one case, and none of you should judge between two disputants while he is angry.”

سَمِعَ رَسُولُ اللهِ ﷺ لَجَبَةَ خَصْمٍ عِنْدَ بَابِ أُمِّ سَلَمَةَ فَخَرَجَ إِلَيْهِمْ فَقَالَ «إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَعْلَمَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي لَهُ بِمَا أَسْمَعُ وَأَظُنُّهُ صَادِقًا فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ فَإِنَّمَا هِيَ قِطْعَةٌ مِنَ النَّارِ فَلْيَأْخُذْهَا أَوْ لِيَدَعْهَا»
✧ The Messenger of Allah ﷺ heard the clamor of disputants at the door of Umm Salamah, so he went out to them and said: “You bring your disputes to me, but I am only a human being. Perhaps one of you is more eloquent in presenting his argument than the other, so I judge in his favor based on what I hear and what I deem to be true. If I award someone something that belongs to his brother, it is only a piece of the Fire, so let him take it or leave it.”

✧ The Messenger of Allah ﷺ said: “The most hateful of men to Allah is the obstinate quarrelsome one.”

أَنْتُمْ وَاللهِ قَتَلْتُمُوهُ فَقَالُوا وَاللهِ مَا قَتَلْنَاهُ ثُمَّ أَقْبَلَ مَنْ قَدِمَ عَلَى رَسُولِ اللهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ ثُمَّ أَقْبَلَ هُوَ وَحُوَيِّصَةُ وَهُوَ أَخُوهُ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرْ كَبِّرْ وَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ» فَقَالَ رَسُولُ اللهِ ﷺ «إِمَّا أَنْ يَدُوا صَاحِبَكُمْ أَوْ يُؤْذَنُوا بِحَرْبٍ» وَكَتَبَ النَّبِيُّ ﷺ فِي ذَلِكَ فَكَتَبُوا أَمَا وَاللهِ مَا قَتَلْنَاهُ فَقَالَ رَسُولُ اللهِ ﷺ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ «تَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ؟» قَالُوا لَا قَالَ «فَتَحْلِفُ لَكُمْ يَهُودُ» قَالُوا لَيْسُوا بِمُسْلِمِينَ فَوَدَاهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ قَالَ سَهْلٌ لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ
✧ "You, by Allah, killed him." They said, "By Allah, we did not kill him." Then the one who had come to the Messenger of Allah ﷺ turned to him and mentioned that to him. Then he came forward, along with Huwayyisah—his brother, older than him—and Abd al-Rahman b. Sahl. Muhayyisah went to speak, and he was the one who had been at Khaybar. The Messenger of Allah ﷺ said: "Let the elder speak, let the elder speak." So Huwayyisah spoke, then Muhayyisah spoke. The Messenger of Allah ﷺ said: "Either they pay the blood money for your companion or they will be given a notice of war." The Prophet ﷺ wrote to them about that, and they wrote back: "By Allah, we did not kill him." The Messenger of Allah ﷺ said to Huwayyisah, Muhayyisah, and Abd al-Rahman: "Will you swear and thus be entitled to the blood of your companion?" They said, "No." He said: "Then will the Jews swear to you?" They said, "They are not Muslims." So the Messenger of Allah ﷺ paid the blood money himself and sent them one hundred camels, which were brought into their dwelling. Sahl said: "A red camel among them kicked me."

جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ إِنَّ هَذَا غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لِأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ النَّبِيُّ ﷺ «أَلَكَ بَيِّنَةٌ؟» قَالَ لَا قَالَ «عَلَيْكَ يَمِينُهُ» قَالَ يَا رَسُولَ اللهِ إِنَّ الرَّجُلَ فَاجِرٌ لَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ قَالَ «لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ» فَانْطَلَقَ لِيَحْلِفَ فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا أَدْبَرَ «أَمَا إِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا لَيَلْقَيَنَّ اللهَ وَهُوَ عَنْهُ مُعْرِضٌ»
✧ A man from Hadramawt and a man from Kindah came to the Prophet ﷺ. The Hadrami said: "O Messenger of Allah, this man has usurped my land that belonged to my father." The Kindi said: "It is my land, in my possession; I cultivate it. He has no right to it." The Prophet ﷺ said: "Do you have evidence?" He said: "No." He said: "Then he must swear an oath." He said: "O Messenger of Allah, the man is wicked; he does not care what he swears, and he does not refrain from anything." He said: "You have no other recourse against him." So the man went to swear. When he turned away, the Messenger of Allah ﷺ said: "If he swears falsely to seize his property wrongfully, he will meet Allah while He is turning away from him."

كُنَّا عِنْدَ رَسُولِ اللهِ ﷺ فَأَتَاهُ رَجُلَانِ يَخْتَصِمَانِ فِي أَرْضٍ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي فِي الْجَاهِلِيَّةِ وَهُوَ امْرُؤُ الْقَيْسِ الْكِنْدِيُّ وَخَصْمُهُ رَبِيعَةُ بْنُ عَبْدَانَ قَالَ بَيِّنَتُكَ قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ يَمِينُهُ قَالَ إِذًا يَذْهَبُ بِهَا قَالَ لَيْسَ إِلَّا ذَلِكَ فَلَمَّا قَامَ لِيَحْلِفَ قَالَ رَسُولُ اللهِ ﷺ «مَنِ اقْتَطَعَ أَرْضًا ظُلْمًا لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ»
✧ We were with the Messenger of Allah ﷺ when two men came to him disputing about a piece of land. One of them said: "O Messenger of Allah, this man seized my land in the days of ignorance." He was Imru' al-Qays al-Kindi, and his opponent was Rabi'ah b. Abdan. The Prophet ﷺ said: "Your evidence." He said: "I have no evidence." He said: "Then his oath." He said: "Then he will take it." He said: "There is nothing else." When he stood up to swear, the Messenger of Allah ﷺ said: "Whoever seizes land wrongfully will meet Allah on the Day of Resurrection while He is angry with him."

قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ هُوَ فِيهَا فَاجِرٌ لِيَقْطَعَ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» فَقَالَ الْأَشْعَثُ بْنُ قَيْسٍ فِيَّ وَاللهِ كَانَ ذَلِكَ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ مِنَ الْيَهُودِ أَرْضٌ فَجَحَدَنِي فَقَدَّمْتُهُ إِلَى النَّبِيِّ ﷺ فَقَالَ لِي رَسُولُ اللهِ ﷺ «أَلَكَ بَيِّنَةٌ؟» فَقُلْتُ لَا فَقَالَ لِلْيَهُودِيِّ «احْلِفْ» فَقُلْتُ وَاللهِ إِذًا يَحْلِفُ فَيَذْهَبُ حَقِّي فَأَنْزَلَ اللهُ تَعَالَى {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} [آل عمران 77] إِلَى آخِرِ الْآيَةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ فَاتَنِي مِنْ هَذَا الْحَدِيثِ حَرْفٌ فِيمَا أَعْلَمُ وَلَا أَقِفُ عَلَيْهِ وَلَا نَعْلَمُ أَحَدًا تَابَعَ أَبَا مُعَاوِيَةَ عَلَى قَوْلِهِ فَقَالَ لِلْيَهُودِيِّ احْلِفْ
✧ The Messenger of Allah ﷺ said: "Whoever swears an oath in which he is false, to cut off thereby the property of a Muslim man, will meet Allah while He is angry with him." Al-Ash'ath b. Qays said: "By Allah, that was concerning me. There was a piece of land between me and a Jew, and he denied me it. I brought him to the Prophet ﷺ, and the Messenger of Allah ﷺ said to me: 'Do you have evidence?' I said: 'No.' He said to the Jew: 'Swear.' I said: 'By Allah, then he will swear and take away my right.' Allah the Exalted then revealed: {Indeed, those who exchange the covenant of Allah and their oaths for a small price} [Al 'Imran 77] to the end of the verse." Abu Abd al-Rahman said: "I missed a word from this hadith, as far as I know, and I cannot ascertain it. We do not know of anyone who corroborated Abu Mu'awiyah in his saying: 'He said to the Jew: Swear.'"

قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالًا وَهُوَ فِيهَا كَاذِبٌ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» وَتَصْدِيقُهُ فِي كِتَابِ اللهِ ﷻ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا أُولَئِكَ لَا خَلَاقَ لَهُمْ فِي الْآخِرَةِ} [آل عمران 77] قَالَ فَجَاءَ الْأَشْعَثُ بْنُ قَيْسٍ فَقَالَ مَا يُحَدِّثُكُمْ أَبُو عَبْدِ الرَّحْمَنِ؟ قُلْنَا كَذَا وَكَذَا قَالَ صَدَقَ وَاللهِ لَأُنْزِلَتْ فِيَّ وَفِي فُلَانٍ كَانَتْ بَيْنِي وَبَيْنَهُ خُصُومَةٌ فَقَالَ رَسُولُ اللهِ ﷺ شُهُودُكَ أَوْ يَمِينُهُ قُلْتُ إِذًا يَحْلِفُ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالًا وَهُوَ فِيهَا كَاذِبٌ لَقِيَ اللهَ وَهُوَ غَضْبَانُ» فَأَنْزَلَ اللهُ هَذِهِ الْآيَةَ قَالَ أَبُو عَبْدِ الرَّحْمَنِ تَابَعَهُ مَنْصُورُ بْنُ الْمُعْتَمِرِ
✧ The Messenger of Allah ﷺ said: "Whoever swears an oath by which he wrongfully takes wealth, and he is lying in it, will meet Allah while He is angry with him." Its confirmation is in the Book of Allah ﷻ: {Indeed, those who exchange the covenant of Allah and their oaths for a small price—those will have no share in the Hereafter} [Al 'Imran 77]. He said: Then al-Ash'ath b. Qays came and said: "What is Abu Abd al-Rahman narrating to you?" We said: "Such and such." He said: "By Allah, he spoke the truth. It was revealed concerning me and a certain man. There was a dispute between me and him, and the Messenger of Allah ﷺ said: 'Your witnesses or his oath.' I said: 'Then he will swear.' He said: 'Whoever swears an oath by which he wrongfully takes wealth, and he is lying in it, will meet Allah while He is angry with him.' So Allah revealed this verse." ✧ There was a dispute between me and some people, so we brought our case to the Messenger of Allah ﷺ. He said: "Your two witnesses or his oath." I said: "Then he will swear and not care." The Messenger of Allah ﷺ said: "Whoever swears an oath to wrongfully claim wealth and is false in it will meet Allah while He is angry with him." Allah the Exalted then revealed in confirmation of that: {Indeed, those who exchange the covenant of Allah and their oaths for a small price} [Al 'Imran 77]—the verse.

✧ The Messenger of Allah ﷺ said: "If people were given whatever they claimed, men would claim the blood and property of others. But the oath is upon the defendant." This is the statement of the Prophet ﷺ.

✧ Two men came to the Prophet ﷺ disputing about a piece of land. One of them said: "It is mine," and the other said: "It is mine; I have taken possession of it and seized it." When he spoke to swear, the Messenger of Allah ﷺ said to him: "Indeed, whoever swears an oath about the property of a Muslim man will meet Allah while He is angry with him." He said: "What about the one who gives it up?" He said: "Paradise." Abu Abd al-Rahman said: "Jarir b. Hazim disagreed with him and inserted between 'Adi and his father Raja' b. Haywah and al-'Urs b. 'Amirah."

✧ There was a dispute between Imru' al-Qays and a man from Hadramawt, so they brought it to the Messenger of Allah ﷺ. He said to the Hadrami: "Your evidence, or else his oath." He said: "O Messenger of Allah, if he swears, he will take away my land." The Messenger of Allah ﷺ said: "Whoever swears a false oath to cut off thereby the right of his brother will meet Allah while He is angry with him." Imru' al-Qays said: "O Messenger of Allah, what is for the one who gives it up while knowing it is true?" He said: "Paradise." He said: "Then I call you to witness that I have given it up." Jarir said: "I was with Ayyub al-Sakhtiyani when we heard this hadith from 'Adi. Ayyub said: 'Adi said in the hadith of al-'Urs b. 'Amirah: And this verse was revealed: {Indeed, those who exchange the covenant of Allah and their oaths for a small price} [Al 'Imran 77]. Jarir said: 'I did not memorize it that day from 'Adi.'"

✧ Two men claimed an animal they found with a man, and each of them produced two witnesses that it was his animal. The Prophet ﷺ ruled it between them in halves. Abu Abd al-Rahman said: This is an error. This Muhammad b. Kathir is al-Missisi, and he is truthful, except that he errs a lot. Abu Abd al-Rahman said: Said b. Abi Arubah differed with him in its chain and in its text.

✧ A man from Hadramawt and a man from Kindah brought a dispute to the Prophet ﷺ. The Hadrami said: O Messenger of Allah, my land is in this man's possession; his father seized it from me. The Kindi said: My land is in my possession; I inherited it from my father. The Messenger of Allah ﷺ said: Do you have evidence, O brother of Hadramawt? He said: No, O Messenger of Allah, but make him swear by oath that he does not know that it is my land which his father seized from me. The Kindi prepared to swear. The Messenger of Allah ﷺ said: Whoever seizes property by his oath will meet Allah mutilated. When the Kindi heard it, he refrained from the oath and gave him the land.

وَمَعِي سَيْفٌ لِي فَجَعَلْتُ أَضْرِبُهُ وَلَا يُحَيِّكُ فِيهِ وَمَعَهُ سَيْفٌ لَهُ فَضَرَبْتُ يَدَهُ فَوَقَعَ السَّيْفُ فَأَخَذْتُهُ ثُمَّ كَشَفْتُ الْمِغْفَرَ عَنْ رَأْسِهِ فَضَرَبْتُ عُنُقَهُ ثُمَّ أَتَيْتُ رَسُولَ اللهِ ﷺ فَأَخْبَرْتُهُ فَقَالَ «آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ» قُلْتُ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ قَالَ «آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ» قُلْتُ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ قَالَ انْطَلِقْ فَاسْتَثْبِتْ فَانْطَلَقْتُ فَقَالَ رَسُولُ اللهِ ﷺ «إِنْ جَاءَكُمْ يَسْعَى مِثْلَ الطَّيْرِ يَضْحَكُ فَقَدْ صَدَقَ» فَانْطَلَقْتُ فَاسْتَثْبَتُّ ثُمَّ جِئْتُ وَأَنَا أَسْعَى مِثْلَ الطَّائِرِ أَضْحَكُ أَخْبَرْتُهُ فَقَالَ انْطَلِقْ فَأَرِنِي مَكَانَهُ فَانْطَلَقْتُ مَعَهُ فَأَرَيْتُهُ إِيَّاهُ فَلَمَّا وَقَفَ عَلَيْهِ رَسُولُ اللهِ ﷺ حَمِدَ اللهَ ثُمَّ قَالَ «هَذَا فِرْعَوْنُ هَذِهِ الْأُمَّةُ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سُفْيَانُ الثَّوْرِيُّ فَرَوَاهُ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي عُبَيْدَةَ عَنْ عَبْدِ اللهِ وَأَبُو عُبَيْدَةَ لَمْ يَسْمَعْ مِنْ أَبِيهِ وَرِوَايَةُ سُفْيَانَ هِيَ الصَّوَابُ
✧ With me was a sword of mine, and I kept striking him but it had no effect on him, while he had a sword with him. I struck his hand and the sword fell, so I took it. Then I uncovered the helmet from his head and struck his neck. Then I came to the Messenger of Allah ﷺ and told him. He said: By Allah, besides whom there is no god? I said: By Allah, besides whom there is no god. He said: By Allah, besides whom there is no god? I said: By Allah, besides whom there is no god. He said: Go and verify. So I went. The Messenger of Allah ﷺ said: If he comes to you running like a bird, laughing, then he has spoken the truth. So I went and verified, then I came running like a bird, laughing, and told him. He said: Go and show me his place. So I went with him and showed it to him. When the Messenger of Allah ﷺ stood over him, he praised Allah and then said: This is the Pharaoh of this community. Abu Abd al-Rahman said: Sufyan al-Thawri differed with him; he narrated it from Abu Ishaq from Abu Ubaydah from Abdullah, but Abu Ubaydah did not hear from his father, and Sufyan's version is the correct one.

✧ Two men came disputing to the Prophet ﷺ about something. He said to the claimant: Produce evidence, but he did not produce it. He said to the other: Swear, so he swore: By Allah, besides whom there is no god. The Prophet ﷺ said: Pay his right, and it will expiate for you what you did by saying: There is no god but Allah. Abu Abd al-Rahman said: This is the correct version, and I do not know anyone who agreed with Shubah in his saying from Abu al-Bakhtari from Ubaydah from Ibn al-Zubayr. Abu Abd al-Rahman said: Abu al-Ahwas agreed with him in its chain but differed in its wording.

He said: O Messenger of Allah, I have no evidence. He said to the other: Swear by Allah, besides whom there is no god, that he has nothing owed by you or in your possession, so he swore.

عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَمُحَيِّصَةَ بْنِ مَسْعُودِ بْنِ زَيْدٍ أَنَّهُمَا أَتَيَا خَيْبَرَ وَهِيَ يَوْمَئِذٍ صَلَحٌ فَتَفَرَّقَا لِحَوَائِجِهِمْ فَأَتَى مُحَيِّصَةُ عَلَى عَبْدِ اللهِ بْنِ سَهْلٍ وَهُوَ يَتَشَحَّطُ فِي دَمِهِ قَتِيلًا فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ وَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ إِلَى رَسُولِ اللهِ ﷺ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ وَهُوَ أَحْدَثُ الْقَوْمِ سِنًّا فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرِ الْكُبْرَ» فَسَكَتُّ فَتَكَلَّمَا فَقَالَ رَسُولُ اللهِ ﷺ «أَتَحْلِفُونَ بِخَمْسِينَ مِنْكُمْ فَتَسْتَحِقُّونَ صَاحِبَكُمْ أَوْ قَاتَلَكُمْ» قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ؟ قَالَ أَتُبْرِئُكُمْ يَهُودُ بِخَمْسِينَ؟ قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ كُفَّارٍ فَعَقَلَهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سَعِيدُ بْنُ عُبَيْدٍ فِي مَعْنَى الْحَدِيثِ
✧ From Sahl b. Abi Hathmah and Muhayyisah b. Masud b. Zayd that they went to Khaybar, which at that time was under a peace treaty, and they separated for their needs. Muhayyisah came upon Abdullah b. Sahl, who was rolling in his blood, slain. He buried him, then came to Madinah. Abd al-Rahman b. Sahl, Huwayyisah, and Muhayyisah went to the Messenger of Allah ﷺ. Abd al-Rahman began to speak, as he was the youngest of the people in age. The Messenger of Allah ﷺ said: Let the eldest speak, the eldest. So he fell silent, and the other two spoke. The Messenger of Allah ﷺ said: Will you swear fifty oaths from among you and thus be entitled to your companion or your slain man? They said: O Messenger of Allah, how can we swear when we did not witness and did not see? He said: Will the Jews exonerate themselves with fifty oaths? They said: O Messenger of Allah, how can we accept the oaths of a disbelieving people? So the Messenger of Allah ﷺ paid his blood money from his own resources. Abu Abd al-Rahman said: Said b. أَخْبَرَهُ أَنَّ نَفَرًا مِنْ قَوْمِهِ انْطَلَقُوا إِلَى خَيْبَرَ فَتَفَرَّقُوا فِيهَا فَوَجَدُوا أَحَدَهُمْ قَتِيلًا فَقَالُوا لِلَّذِينَ وَجَدُوهُ عِنْدَهُمْ قَتَلْتُمْ صَاحِبَنَا قَالُوا مَا قَتَلْنَا وَلَا عَلِمْنَا فَانْطَلَقُوا إِلَى نَبِيِّ اللهِ ﷺ فَقَالُوا يَا نَبِيَّ اللهِ انْطَلَقْنَا إِلَى خَيْبَرَ فَوَجَدْنَا أَحَدَنَا قَتِيلًا فَقَالَ رَسُولُ اللهِ ﷺ «الْكِبَرُ الْكِبَرُ» فَقَالَ لَهُمْ «تَأْتُونَ بِالْبَيِّنَةِ عَلَى مَنْ قَتَلَ» قَالُوا مَا لَنَا بَيِّنَةٌ قَالَ «فَيَحْلِفُونَ لَكُمْ» قَالُوا لَا نَرْضَى بِأَيْمَانِ الْيَهُودِ فَكَرِهَ رَسُولُ اللهِ ﷺ أَنْ يُبْطِلَ دَمَهُ فَوَدَاهُ مِائَةً مِنْ إِبِلِ الصَّدَقَةِ
✧ He informed him that a group of his people went to Khaybar and dispersed there, and they found one of them slain. They said to those with whom they found him: You killed our companion. They said: We did not kill him, and we have no knowledge. They went to the Prophet of Allah ﷺ and said: O Prophet of Allah, we went to Khaybar and found one of us slain. The Messenger of Allah ﷺ said: Let the eldest speak, the eldest. Then he said to them: Will you bring evidence as to who killed him? They said: We have no evidence. He said: Then they will swear to you. They said: We would not be satisfied with the oaths of the Jews. The Messenger of Allah ﷺ disliked that his blood be shed in vain, so he paid his blood money with one hundred camels from the sadaqah.

✧ The Prophet ﷺ 'judged by the oath with the witness.' Abu Abd al-Rahman said to us: This is a good chain, and Sayf is trustworthy and Qays is trustworthy. And Yahya b. Sa'id al-Qattan said: Sayf is trustworthy. And Muhammad b. Muslim al-Ta'ifi narrated this hadith from Amr b. Dinar, from Ibn Abbas, from the Prophet ﷺ: 'He judged by the oath with the witness.' And Muhammad b. Muslim is not that strong. And a weak person narrated it, saying: From Amr b. Dinar, from Muhammad b. Ali, as a mursal report. He is abandoned in hadith. And judgment is not made on the basis of weak narrators against trustworthy ones.

✧ From the Messenger of God ﷺ, he said: 'There are three whom God will not speak to on the Day of Resurrection, nor purify, and they will have a painful punishment: a man who has surplus water on a road and prevents the wayfarer from it; a man who gives allegiance to an imam for worldly gain—if he gives him what he wants, he fulfills his allegiance, but if he does not, he does not fulfill it; and a man who bargains with another over his merchandise after the afternoon prayer, then swears by God that he was offered such and such for it, and the other man believes him.'

"I am only a human being, and you bring your disputes to me, some perhaps being more eloquent in their plea than others, so that I give judgement on their behalf according to what I hear from them. ✧ My father took me with him to the Messenger of Allah ﷺ and said, "Indeed, Umrah bint Rawahah has requested from me that I release my son from my wealth, and I refused. But then it appeared to me that I should release him to her. She said, 'I will not accept until you come with him to the Messenger of Allah ﷺ as a witness for me.' He said, 'Do you have any other children?' I said, 'Yes.' He said, 'Have you treated all of them like you have treated this one?' I said, 'No.' He said, 'Then I will not bear witness to this, as this is injustice.'"

✧ She said: 'I have breastfed both of you.' So I came to the Messenger of Allah ﷺ and mentioned that to him, but he turned away. I moved aside and mentioned it to him again, and he said: 'How, when she has claimed that she breastfed both of you?' So he forbade him from her. Abu Abd al-Rahman said: I do not know of anyone who mentioned a black slave woman among those who narrated this hadith from Ibn Abi Mulaykah other than Ibn Jurayj.

✧ That he married the daughter of Abu Ihab al-Tamimi. Then a freed slave woman from the people of Makkah came the morning after he consummated the marriage and said: 'I have breastfed both of you.' So I asked the girl's family, and they denied that. Then I rode to the Messenger of Allah ﷺ while he was in Madinah and mentioned that to him. I said: 'O Messenger of Allah, I asked the girl's family, and they denied that.' The Messenger of Allah ﷺ said: 'How, when it has been said? How, when it has been said?' So he separated from her, and she married someone else.

✧ She said: 'I have breastfed both of you.' So I came to the Prophet ﷺ and said: 'I have married so-and-so daughter of so-and-so. Then a black woman came and said: "I have breastfed both of you," but she is lying.' He turned away from me, so I came to him from in front of his face and said: 'She is lying.' He said: 'How can you be with her when she has claimed that she breastfed both of you? Leave her.'

Then there will come a people who are plump and they will give testimony without being asked for it.'

وَاللهِ مَا لَكَ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ «لَيْسَ لَكِ نَفَقَةٌ» فَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ «تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ فَإِذَا حَلَلْتِ فَآذِنِينِي» فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللهِ ﷺ «أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ وَلَكِنِ انْكِحِي أُسَامَةَ» فَنَكَحْتُهُ فَجَعَلَ اللهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ
✧ By Allah, you have nothing owed to us. Then she came to the Messenger of Allah ﷺ and mentioned that to him. He said: 'You have no right to maintenance.' He ordered her to observe her waiting period in the house of Umm Sharik. Then he said: 'That is a woman whom my companions visit. Observe your waiting period in the house of Ibn Umm Maktum, for he is a blind man. You can put down your garments there. When you are free, inform me.' When I became free, I mentioned to him that Muawiyah b. Abi Sufyan and Abu Jahm had proposed to me. The Messenger of Allah ﷺ said: 'As for Abu Jahm, he does not put down his staff from his shoulder. As for Muawiyah, he is a poor man with no wealth. But marry Usamah.' So I married him, and Allah placed good in him, and I was content with him.

عَنْ حَدِيثِ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ حِينَ قَالَ لَهَا أَهْلُ الْإِفْكِ مَا قَالُوا فَبَرَّأَهَا اللهُ وَكُلٌّ حَدَّثَنِي طَائِفَةً مِنَ الْحَدِيثِ وَإِنْ كَانَ بَعْضُهُمْ أَوْعَى مِنْ بَعْضٍ زَعَمُوا أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ قَالَتْ وَدَعَا رَسُولُ اللهِ ﷺ عَلِيَّ بْنَ أَبِي طَالِبٍ وَأُسَامَةَ بْنَ زَيْدٍ حِينَ اسْتَلْبَثَ الْوَحْيُ يَسْتَشِيرُهُمَا فِي فِرَاقِ أَهْلِهِ فَأَمَّا أُسَامَةُ فَأَشَارَ عَلَى رَسُولِ اللهِ ﷺ بِالَّذِي يَعْلَمُ مِنْ بَرَاءَةِ أَهْلِهِ وَبِالَّذِي فِي نَفْسِهِ مِنَ الوُّدِّ لَهُمْ فَقَالَ يَا رَسُولَ اللهِ أَهْلُكَ وَلَا نَعْلَمُ إِلَّا خَيْرًا وَأَمَّا عَلِيٌّ فَقَالَ يَا رَسُولَ اللهِ لَمْ يُضَيِّقِ اللهُ عَلَيْكَ وَالنِّسَاءُ سِوَاهَا كَثِيرٌ وَإِنْ تَسْأَلِ الْجَارِيَةَ تَصْدُقْكَ فَدَعَا رَسُولُ اللهِ ﷺ بَرِيرَةَ فَقَالَ «أَيْ بَرِيرَةُ هَلْ رَأَيْتِ مِنْ شَيْءٍ يَرِيبُكِ؟» قَالَتْ بَرِيرَةُ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا رَأَيْتُ عَلَيْهَا أَمْرًا قَطُّ أَغْمِصُهُ عَلَيْهَا أَكْثَرَ مِنْ أَنَّهَا جَارِيَةٌ حَدِيثَةُ السِّنِّ تَنَامُ عَنْ عَجِينِ أَهْلِهَا فَيَأْتِي الدَّاجِنُ فَيَأْكُلُهُ
✧ From the hadith of Aishah, the wife of the Prophet ﷺ, when the people of the slander said what they said about her, and Allah declared her innocent. Each of them narrated to me a portion of the hadith, and some were more retentive than others. They claimed that Aishah, the wife of the Prophet ﷺ, said: The Messenger of Allah ﷺ called Ali b. Abi Talib and Usamah b. Zayd when the revelation was delayed, to consult them about separating from his wife. As for Usamah, he advised the Messenger of Allah ﷺ based on what he knew of the innocence of his wife and the affection he held for them, saying: 'O Messenger of Allah, she is your wife, and we know nothing but good about her.' As for Ali, he said: 'O Messenger of Allah, Allah has not restricted you, and there are many women other than her. If you ask the slave girl, she will tell you the truth.' So the Messenger of Allah ﷺ called Barirah and said: 'O Barirah, have you seen anything that makes you doubt?' Barirah said: 'No, by the One who sent you with the truth. I have never seen anything blameworthy about her, except that she is a young girl who sleeps and neglects her family's dough, and the domestic animal comes and eats it.'

سَمِعْتُ رَسُولَ اللهِ ﷺ يَسْأَلُ عَنِ اشْتِرَاءِ التَّمْرِ بِالرُّطَبِ قَالَ «أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟» قَالُوا نَعَمْ فَنَهَى عَنْهُ
Which of them is better? He replied: Soft and white kind of wheat. So he forbade him from it and said: I heard the Messenger of Allah (sawa) say, when he was asked about buying dry dates for fresh. The Messenger of Allah (sawa) said: Are fresh dates diminished when they become dry? The (the people) replied: Yes. So the Messenger of Allah ﷺ forbade that. Abu Dawud said: A similar tradition has also been transmitted by Isma'il b. Umayyah. (Using translation from Abū Dāʾūd 3359)

دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ ذَاتَ يَوْمٍ مَسْرُورًا فَقَالَ «يَا عَائِشَةُ أَلَمْ تَرَيْ أَنَّ مُجَزِّزًا الْمُدْلِجِيَّ دَخَلَ عَلَيَّ وَعِنْدِي أُسَامَةُ بْنُ زَيْدٍ فَرَأَى أُسَامَةَ وَزَيْدًا وَعَلَيْهِمَا قَطِيفَةٌ وَقَدْ غَطَّيَا رُءُوسَهُمَا وَبَدَتْ أَقْدَامُهُمَا؟» فَقَالَ هَذِهِ أَقْدَامٌ بَعْضُهَا مِنْ بَعْضٍ قَالَ سُفْيَانُ هَذَا تَقْوِيَةُ الْقَافَةِ
✧ The Messenger of Allah ﷺ entered upon me one day looking pleased and said: 'O Aishah, did you not see that Mujazziz al-Mudliji entered upon me while Usamah b. Zayd was with me? He saw Usamah and Zayd with a velvet cloth covering them, and their heads were covered but their feet were showing.' He said: 'These feet are from one another.' Sufyan said: This strengthens the verdict of the qafah.

أُتِيَ عَلِيٌّ بِثَلَاثَةٍ وَهُوَ بِالْيَمَنِ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَسَأَلَ اثْنَيْنِ أَتُقِرَّانِ يَعْنِي لِهَذَا بِالْوَلَدِ ؟ قَالَا لَا ثُمَّ سَأَلَ اثْنَيْنِ أَتُقِرَّانِ لِهَذَا بِالْوَلَدِ؟ قَالَا لَا فَأَقْرَعَ بَيْنَهُمْ فَقَضَى بِالْوَلَدِ لِلَّذِي صَارَتْ عَلَيْهِ الْقُرْعَةُ وَجَعَلَ عَلَيْهِ ثُلُثَيِ الدِّيَةِ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ 5994 أَخْبَرَنَا إِسْحَاقُ بْنُ شَاهِينَ قَالَ حَدَّثَنَا خَالِدٌ عَنِ الشَّيْبَانِيِّ عَنِ الشَّعْبِيِّ عَنْ رَجُلٍ مِنْ حَضْرَمَوْتَ عَنْ زَيْدِ بْنِ أَرْقَمَ قَالَ بَعَثَ رَسُولُ اللهِ ﷺ عَلِيًّا عَلَى الْيَمَنِ فَأُتِيَ بِغُلَامٍ تَنَازَعَ فِيهِ ثَلَاثَةٌ وَسَاقَ الْحَدِيثَ
✧ Ali was brought three men while he was in Yemen who had had intercourse with a woman during a single period of purity. He asked two of them: 'Do you acknowledge this child as belonging to this one?' They said: 'No.' Then he asked two of them: 'Do you acknowledge this child as belonging to this one?' They said: 'No.' So he drew lots among them and ruled the child to the one upon whom the lot fell, and he imposed on him two-thirds of the blood money. I mentioned that to the Prophet ﷺ, and he laughed until his molars showed. 5994: Ishaq b. Shahin informed us, he said: Khalid narrated to us from al-Shaybani from al-Shabi from a man from Hadramawt from Zayd b. Arqam, who said: The Messenger of Allah ﷺ sent Ali to Yemen, and a boy was brought to him about whom three men disputed. And he narrated the hadith.

إِنَّ الْأَنْصَارَ اقْتَرَعُوا مَنَازِلَهُمْ أَيُّهُمْ يُؤْوِي رَسُولَ اللهِ ﷺ فَقَرَعَهُمْ أَبُو أَيُّوبَ فَأَوَى إِلَيْهِ رَسُولَ اللهِ ﷺ فَكَانَ رَسُولُ اللهِ ﷺ إِذَا «أُهْدِيَ إِلَيْهِ طَعَامٌ بَعَثَ بِهِ إِلَيْنَا» مُخْتَصَرٌ قَالَ أَبُو عَبْدِ الرَّحْمَنِ بَحِيرُ بْنُ سَعْدٍ ثِقَةٌ
✧ The Ansar drew lots over their dwellings as to which of them would host the Messenger of Allah ﷺ, and the lot fell to Abu Ayyub, so the Messenger of Allah ﷺ stayed with him. Whenever food was gifted to the Messenger of Allah ﷺ, he would send it to us. Abridged. Abu Abd al-Rahman said: Buhayr b. Sa'd is trustworthy.
