قَالَ رَسُولُ اللهِ ﷺ «تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ فَإِنِّي امْرُؤٌ مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيَنْقُصُ حَتَّى يَخْتَلِفَ الِاثْنَانِ فِي الْفَرِيضَةِ فَلَا يَجِدَانِ مَنْ يَفْصِلُ بَيْنَهُمَا»
✧ The Messenger of God ﷺ said: «Learn the Qurʾān and teach it to the people, learn knowledge and teach it to the people, learn the obligatory shares and teach them to the people. For I am a man who will be taken, and knowledge will diminish until two people disagree about an obligatory share and find no one to judge between them.»

✧ ʿAbd Allāh b. ✧ ʿUmar said to ʿAbd al-Raḥmān, Saʿd, ʿUthmān, Ṭalḥa, and al-Zubayr: I adjure you by God, by whom the heavens and the earth stand, did you hear the Prophet ﷺ say: «We, the company of prophets, are not inherited; what we leave is charity»? They said: O God, yes.

حِينَ دَخَلْتُ عَلَيْهِ يَا مَالِكُ إِنَّهُ قَدْ دَقَّ أَهْلُ أَبْيَاتٍ وَقَدْ أَمَرْتُ فِيهِمْ بِرَضْخٍ فَخُذْهُ فَاقْسِمْ بَيْنَهُمْ قُلْتُ لَوْ أَمَرْتَ بِهِ غَيْرِي؟ قَالَ خُذْهُ فَجَاءَ يَرْفَأُ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي عُثْمَانَ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ وَالزُّبَيْرِ بْنِ الْعَوَّامِ وَسَعْدِ بْنِ أَبِي وَقَّاصٍ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمْ فَدَخَلُوا ثُمَّ جَاءَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي الْعَبَّاسِ وَعَلِيٍّ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمَا فَدَخَلَا فَقَالَ الْعَبَّاسُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنِي وَبَيْنَ هَذَا يَعْنِي عَلِيًّا فَقَالَ بَعْضُهُمْ أَجَلْ يَا أَمِيرَ الْمُؤْمِنِينَ فَاقْضِ بَيْنَهُمَا وَارْحَمْهُمَا فَقَالَ عُمَرُ أَنْشُدُكُمْ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ؟» قَالُوا نَعَمْ ثُمَّ أَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ؟ قَالَا نَعَمْ قَالَ فَإِنَّ اللهَ خَصَّ نَبِيَّهُ ﷺ بِخَاصَّةٍ لَمْ يَخُصَّ بِهَا أَحَدًا مِنَ النَّاسِ فَقَالَ {وَمَا أَفَاءَ اللهُ عَلَى رَسُولِهِ مِنْهُمْ فَمَا أَوْجَفْتُمْ عَلَيْهِ مِنْ خَيْلٍ وَلَا رِكَابٍ وَلَكِنَّ اللهَ يُسَلَّطُ رُسُلَهُ عَلَى مَنْ يَشَاءُ وَاللهُ عَلَى كُلِّ شَيْءٍ قَدِيرٌ} [الحشر 6] فَكَانَ اللهُ أَفَاءَ عَلَى رَسُولِهِ ﷺ بَنِي النَّضِيرِ فَوَاللهِ مَا اسْتَأْثَرَ بِهَا عَلَيْكُمْ وَلَا أَخَذَهَا دُونَكُمْ فَكَانَ رَسُولُ اللهِ ﷺ يَأْخُذُ مِنْهَا نَفَقَةَ سَنَةٍ وَيَجْعَلُ مَا بَقِيَ أُسْوَةَ الْمَالِ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ ذَلِكَ؟ قَالُوا نَعَمْ وَأَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمَانِ ذَلِكَ؟ قَالَا نَعَمْ فَلَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ قَالَ أَبُو بَكْرٍ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ فَجِئْتَ أَنْتَ وَهَذَا إِلَى أَبِي بَكْرٍ فَجِئْتَ أَنْتَ تَطْلُبُ مِيرَاثَكَ مِنِ ابْنِ أَخِيكَ وَيَطْلُبُ هَذَا مِيرَاثَ امْرَأَتِهِ مِنْ أَبِيهَا فَقَالَ أَبُو بَكْرٍ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» فَوَلِيَهَا أَبُو بَكْرٍ فَلَمَّا تُوُفِّيَ قُلْتُ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ وَوَلِيُّ أَبِي بَكْرٍ فَوَلِيتُهَا مَا شَاءَ اللهُ أَنْ أَلِيَهَا ثُمَّ جِئْتَ أَنْتَ وَهَذَا وَأَنْتُمَا جَمِيعًا وَأَمْرُكُمَا وَاحِدٌ فَسَأَلْتُمَانِيهَا فَقُلْتُ إِنْ شِئْتُمَا أَدْفَعَهَا إِلَيْكُمَا عَلَى أَنَّ عَلَيْكُمَا عَهْدَ اللهِ لِتَلِيَانَهَا بِالَّذِي كَانَ رَسُولُ اللهِ ﷺ يَلِيهَا بِهِ فَأَخَذْتُمَاهَا مِنِّي عَلَى ذَلِكَ ثُمَّ جِئْتُمَانِي لِأَقْضِيَ بَيْنَكُمَا بِغَيْرِ ذَلِكَ وَاللهِ لَا أَقْضِي بَيْنَكُمَا بِغَيْرِ ذَلِكَ حَتَّى تَقُومَ السَّاعَةُ فَإِنْ عَجَزْتُمَا عَنْهَا فَرُدَّاهَا إِلَيَّ
✧ When I entered upon him: O Mālik, some households have become needy, and I have ordered a gift for them, so take it and distribute it among them. I said: Perhaps you could order someone else? He said: Take it. Then Yarfaʾ came and said: O Commander of the Believers, do you want ʿUthmān, ʿAbd al-Raḥmān b. ʿAwf, al-Zubayr b. al-ʿAwwām, and Saʿd b. Abī Waqqāṣ? He said: Yes, so he gave them permission and they entered. Then he came and said: O Commander of the Believers, do you want al-ʿAbbās and ʿAlī? He said: Yes, so he gave them permission and they entered. Al-ʿAbbās said: O Commander of the Believers, judge between me and this one—meaning ʿAlī. Some of them said: Yes, O Commander of the Believers, judge between them and be merciful to them. ʿUmar said: I adjure you. Then he turned to that group and said: I adjure you by God, by whose permission the heavens and the earth stand, do you know that the Messenger of God ﷺ said: «We are not inherited; what we leave is charity»? They said: Yes. Then he turned to ʿAlī and al-ʿAbbās and said: I adjure you both by God, by whose permission the heavens and the earth stand, do you know that the Messenger of God ﷺ said: We are not inherited; what we leave is charity? They both said: Yes. He said: God singled out His Prophet ﷺ with a special thing with which He singled out no one else of the people, for He said: {And what God gave as spoil to His Messenger from them, you did not spur for it any horses or camels, but God gives His messengers authority over whom He wills, and God is over all things competent} [al-Ḥashr 6]. God gave as spoil to His Messenger ﷺ the Banū al-Naḍīr. By God, he did not keep it for himself to your exclusion, nor did he take it without you. The Messenger of God ﷺ used to take from it his yearly spending and make the rest like the common wealth. Then he turned to that group and said: I adjure you by God, by whose permission the heavens and the earth stand, do you know that? They said: Yes. And he turned to ʿAlī and al-ʿAbbās and said: I adjure you both by God, by whose permission the heavens and the earth stand, do you both know that? They both said: Yes. When the Messenger of God ﷺ died, Abū Bakr said: I am the successor of the Messenger of God ﷺ. Then you and this one came to Abū Bakr; you came seeking your inheritance from your brother's son, and this one seeking his wife's inheritance from her father. Abū Bakr said: The Messenger of God ﷺ said: «We are not inherited; what we leave is charity.» So Abū Bakr took charge of it. When he died, I said: I am the successor of the Messenger of God ﷺ and the successor of Abū Bakr, so I took charge of it as long as God willed me to take charge of it. Then you and this one came, and you were both together and your matter was one, so you asked me for it. I said: If you wish, I will hand it over to you on condition that you have God's covenant to manage it as the Messenger of God ﷺ used to manage it. So you took it from me on that condition. Then you came to me for me to judge between you other than that. By God, I will not judge between you other than that until the Hour comes. If you are unable to manage it, return it to me.

أَنَّ أَزْوَاجَ النَّبِيِّ ﷺ حِينَ تُوُفِّيَ رَسُولُ اللهِ ﷺ أَرَدْنَ أَنْ يَبْعَثْنَ عُثْمَانَ بْنَ عَفَّانَ إِلَى أَبِي بَكْرٍ؛ يَسْأَلْنَ مِيرَاثَهُنَّ مِنْ رَسُولِ اللهِ ﷺ فَقَالَتْ لَهُنَّ عَائِشَةُ أَلَيْسَ قَدْ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا فَهُوَ صَدَقَةٌ»
✧ The wives of the Prophet ﷺ, when the Messenger of God ﷺ died, wanted to send ʿUthmān b. ʿAffān to Abū Bakr to ask for their inheritance from the Messenger of God ﷺ. ʿĀʾisha said to them: Did not the Messenger of God ﷺ say: «We are not inherited; what we leave is charity»?

أَنَّ رَجُلًا مِنَ الْمُهَاجِرِينَ تَصَدَّقَ بِأَرْضٍ لَهُ عَظِيمَةٍ عَلَى أُمِّهِ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرُهُ فَأَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ أُمِّي كَانَتْ مِنْ أَحَبِّ النَّاسِ إِلَيَّ وَأَعَزَّهَمْ عَلَيَّ وَإِنِّي تَصَدَّقْتُ عَلَيْهَا بِأَرْضٍ لِي عَظِيمَةٍ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرِي فَكَيْفَ تَأْمُرُنِي أَنْ أَصْنَعَ بِهَا؟ قَالَ قَدْ أَوْجَبَ اللهُ لَكَ أَجْرَكَ وَرَدَّ عَلَيْكَ أَرْضَكَ فَاصْنَعْ بِهَا كَيْفَ شِئْتَ
✧ A man from the Emigrants gave as charity a great piece of land to his mother. She died and had no heir other than him. He came to the Prophet ﷺ and said: My mother was among the most beloved of people to me and the dearest of them to me, and I gave as charity to her a great piece of land of mine. She died and has no heir other than me. How do you order me to deal with it? He said: God has made your reward due and returned your land to you, so do with it whatever you wish.

✧ that a woman came to the Prophet ﷺ and said, 'I gave charity to my mother with a slave girl, then she died, so it returned to me in the inheritance.' He said, 'Allah has rewarded you and returned it to you in the inheritance.' Abu Abd al-Rahman said: This is a mistake; the correct is Abdullah b. Buraydah

✧ a woman came to the Prophet ﷺ and said, 'O Messenger of Allah, I gave charity to my mother with a slave girl, and she has died.' The Messenger of Allah ﷺ said, 'May Allah reward you and return the inheritance to you.'

قَالَ سَعْدٌ اشْتَكَيْتُ شَكْوَى بِمَكَّةَ فَدَخَلَ عَلَى رَسُولِ اللهِ ﷺ يَعُودُنِي قُلْتُ يَا رَسُولَ اللهِ إِنِّي تَرَكْتُ مَالًا وَلَيْسَ عِنْدِي إِلَّا ابْنَةٌ وَاحِدَةٌ أَفَأَوْصِي بِثُلُثَيْ مَالِي فَأَتْرُكُ لَهَا الثُّلُثَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالنِّصْفِ فَأَتْرُكُ لَهَا النِّصْفَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالثُّلُثِ وَأَتْرُكُ لَهَا الثُّلُثَيْنِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ» ثَلَاثَ مَرَّاتٍ وَوَضَعَ يَدَهُ عَلَى جَبْهَتِي فَمَسَحَ وَجْهِي وَصَدْرِي وَبَطْنِي قَالَ اللهُمَّ اشْفِ سَعْدًا وَأَتِمَّ لَهُ هِجْرَتَهُ فَمَا زِلْتُ أَجِدُ بَرْدَ يَدِهِ عَلَى كَبِدِي حَتَّى السَّاعَةِ
✧ Sa'd said: I fell ill in Makkah, and the Messenger of Allah ﷺ came in to visit me. I said, 'O Messenger of Allah, I have left wealth, and I have only one daughter. Shall I bequeath two-thirds of my wealth and leave one-third for her?' He said, 'No.' I said, 'Shall I bequeath half and leave half for her?' He said, 'No.' I said, 'Shall I bequeath one-third and leave two-thirds for her?' He said, 'One-third, and one-third is a lot,' three times. Then he placed his hand on my forehead and wiped my face, chest, and belly, saying, 'O Allah, cure Sa'd and complete his emigration.' I have not ceased to feel the coolness of his hand on my liver until this hour.

كَانَ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَلَمْ تَكُنْ لَهُ إِلَّا ابْنَةٌ وَاحِدَةٌ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ النِّصْفُ؟ قَالَ «لَا» قَالَ فَالثُّلُثُ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ
✧ the Prophet ﷺ used to visit him while he was in Makkah, and he had only one daughter. He said, 'O Messenger of Allah, shall I bequeath all my wealth?' He said, 'No.' He said, 'Half?' He said, 'No.' He said, 'One-third?' He said, 'One-third, and one-third is a lot. If you leave your heirs wealthy, it is better than leaving them needy, begging from people.'

أَنَّ رَجُلًا تَصَدَّقَ عَلَى وَلَدِهِ بِأَرْضٍ فَرَدَّهَا إِلَيْهِ الْمِيرَاثُ فَذَكَرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَهُ «وَجَبَ أَجْرُكَ وَرَجَعَ إِلَيْكَ مَالُكَ»
✧ that a man gave charity to his son with some land, then the inheritance returned it to him. He mentioned that to the Messenger of Allah ﷺ, and he said to him, 'Your reward is assured, and your wealth has returned to you.'

أَنَّ رَسُولَ اللهِ ﷺ عَادَهُ وَهُوَ لَا يَعْقِلُ فَتَوَضَّأَ فَصَبَّ عَلَيْهِ مِنْ وَضُوئِهِ فَعَقَلَ قُلْتُ يَرِثُنِي كَلَالَةٌ فَكَيْفَ الْمِيرَاثُ؟ فَأُنْزِلَ آيَةُ الْفَرْضِ
✧ that the Messenger of Allah ﷺ visited him while he was unconscious. He performed ablution and poured some of his ablution water on him, and he regained consciousness. I said, 'I will be inherited by distant relatives; how is the inheritance?' Then the verse of the obligatory shares was revealed.

✧ I heard Jabir say: I fell ill, and the Messenger of Allah ﷺ and Abu Bakr came to visit me, walking. They found me unconscious. The Messenger of Allah ﷺ performed ablution and poured his ablution water over me, and I regained consciousness. I said, 'O Messenger of Allah, how should I dispose of my wealth? What should I do with my wealth?' He did not answer me until the verse of inheritance was revealed: 'They ask you for a ruling. Say: Allah gives you a ruling concerning one who has neither descendants nor ascendants as heirs' [Quran 4:176]. Abu Abd al-Rahman said: Ibn Jurayj contradicted him.

✧ the Prophet ﷺ and Abu Bakr visited me among Banu Salamah and found me unconscious. He called for water, performed ablution, then sprinkled some of it on me, and I regained consciousness. I said to him, 'What should I do with my wealth, O Messenger of Allah?' Then Allah revealed: 'Allah instructs you concerning your children: for the male, the equivalent of the share of two females' [Quran 4:11].

I judge in it as the Messenger of Allah ﷺ judged: the daughter gets half, the son's daughter gets one-sixth, and what remains is for the sister.' Then he went to Abu Musa and mentioned that to him. He said: 'Do not ask me about anything as long as this scholar is among you.'

Abu Abd al-Rahman said: Sufyan al-Thawri has a better memory than Wuhayb, and Wuhayb is trustworthy and reliable. The hadith of al-Thawri seems closer to what is correct.

✧ Umar gathered the Companions of the Messenger of Allah ﷺ regarding the matter of the grandfather. He adjured them, asking who had heard the Messenger of Allah ﷺ mention anything about the grandfather. Ma'qil b. Yasar al-Muzani stood up and said: 'I heard that the Messenger of Allah ﷺ was brought a case of inheritance involving a grandfather, and he gave him a third or a sixth.' Umar said to him: 'What was the case?' He said: 'I do not know.' Umar kicked him with his foot and said: 'May you never know.'

✧ A man came to the Prophet ﷺ and said: 'My grandson has died; what do I inherit from him?' He said: 'You get one-sixth.' When he turned to leave, he called him and said: 'You get another sixth.' When he turned to leave, he called him and said: 'The other sixth is a gift.' Muhammad said in his narration: 'When he turned away, he said: You get another sixth, and the other is a gift for you.'

✧ I do not know of anything for you, but I will ask the people. After the people prayed the morning prayer, he asked them. Al-Mughira b. Shu'ba said: 'I heard the Messenger of Allah ﷺ give her one-sixth.' Abu Bakr said: 'Is there anyone else with you?' Muhammad b. Maslama said: 'I heard the Messenger of Allah ﷺ give her that.' So Abu Bakr gave her that. Ibn Shihab said: 'I do not know which of the two grandmothers she was.'

After he prayed Zuhr, he stood among the people and asked them. Al-Mughira b. Shu'ba said: 'I heard the Messenger of Allah ﷺ give her one-sixth.' He said: 'Did anyone hear that with you?' Muhammad b. Maslama called out to him and said: 'I heard the Messenger of Allah ﷺ give her one-sixth.' So Abu Bakr carried that out. Nasr b. Ali b. Nasr al-Jahdami informed us; he said: Abd al-A'la, meaning Ibn Abd al-A'la, informed us; he said: Ma'mar narrated to us from al-Zuhri from Qabisa b. ✧ You have nothing in the Book of Allah, and I do not know of anything for you in the Sunnah of the Messenger of Allah ﷺ. Go back until I ask the people. He asked the people, and al-Mughira b. ✧ From the Messenger of Allah ﷺ, that a man from the Ansar, from Banu Zurayq, accused his wife, so he came to the Messenger of Allah ﷺ and repeated that four times to the Messenger of Allah ﷺ, so Allah revealed the verse of li’an. The Messenger of Allah ﷺ said: “Where is the questioner? A great matter has come down from Allah.” But the man insisted on taking the oath of li’an against her, and she insisted on warding off the punishment from herself. So they took the oaths of li’an. The Messenger of Allah ﷺ said: “Either she will bring him forth as a small, dark-skinned child with sunken eyes and thin bones, and he belongs to the one who took the oath; or she will bring him forth as a black child, like a dark brown camel, and he belongs to another.” She brought him forth as a black child, like a dark brown camel. The Messenger of Allah ﷺ called for him and assigned him to the maternal relatives of his mother, and said: “Were it not for the oaths that have already been taken, I would have had such-and-such concerning him.”

✧ He heard the Messenger of Allah ﷺ make a statement about it, so al-Dahhak b. Sufyan al-Kilabi, whom the Prophet ﷺ had appointed over the zakat of Banu Kilab, said: “I have knowledge about it.” Umar said something to the effect: “Wait for me until I come out.” He entered a small tent, remained in it for a while, then came out and informed the people that the Prophet ﷺ had written to him to give the wife of Ashyam an inheritance from her husband's blood money, and so he retracted.

✧ He accepted Islam while his wife refused to accept Islam. She came to the Prophet ﷺ and said: “O Messenger of Allah, my daughter.” He said: “This is a weanling or like a weanling.” Abu al-Hakam said: “O Messenger of Allah, my daughter.” The Prophet ﷺ said to him: “Sit aside,” and to her: “Sit aside,” and seated the girl between them. Then he said: “Call her.” The girl inclined to her mother. The Messenger of Allah ﷺ said: “O Allah, guide her.” Then she inclined to her father.

✧ That his parents disputed over him before the Prophet ﷺ, one of them being a Muslim and the other a disbeliever. He turned toward the disbeliever. The Prophet ﷺ said: “O Allah, guide him.” He turned toward the Muslim, and he ruled in his favor. 6355 Abu Bakr b. Ali informed me: Abd al-A'la, meaning Ibn Hammad al-Narsi, narrated to us: Hammad b. ✧ That a freed slave of the Messenger of Allah ﷺ died, and they mentioned his inheritance to him. He said: “Is there anyone here from the people of his land?” They said: “Yes.” He said: “Then give it to him.” 6359 Abdullah b. Muhammad b. ✧ That a man came to the Prophet ﷺ and said: “O Messenger of Allah, I have the inheritance of a man from Azd, and I have not found any Azdi to give it to.” He said: “Go and seek an Azdi for a year,” or he said “a full year.” He went, then came to him at the dawn of the second year and said: “O Messenger of Allah, I have not found any Azdi.” He said: “Go and give it to the first Khuzai you meet.” When he turned away, he said: “Bring the man to me.” He returned, and he said: “Go and give it to the eldest of Khuza'ah.”

✧ A man came to the Prophet ﷺ and said: “I have the inheritance of a man from Azd, and I cannot find any Azdi to give it to.” He said: “Go and seek an Azdi for a full year.” He came to him after the year and said: “I have not found any Azdi to give it to.” He said: “Go and look for the best of Khuza'ah.” Muhammad b. ✧ Barirah came to me seeking help with her kitabah, so I said to her: 'If your masters wish, I will pour out your price in one payment and set you free.' Barirah mentioned that to her masters, and they said: 'No, unless she stipulates that the wala' is for us.' She said: I mentioned that to the Messenger of Allah ﷺ, and he said: 'Buy her, for the wala' belongs only to the one who sets free.' And the wording is Ahmad's. 6375 Al-Harith b. ✧ A man died during the time of the Prophet ﷺ and left no relative except a slave whom he had set free. The Prophet ﷺ gave him his inheritance. Abu 'Abd al-Rahman said: 'Awsajah is not well-known, and we do not know of anyone who narrated from him other than 'Amr b. Dinar. We did not find this hadith except from 'Awsajah.'

قَالَ تَمِيمٌ الدَّارِيُّ سَأَلْتُ رَسُولَ اللهِ ﷺ قُلْتُ أَرَأَيْتَ الرَّجُلَ مِنْ أَهْلِ الْكُفْرِ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ مِنْ أَهْلِ الْإِسْلَامِ كَيْفَ الْقَضَاءُ فِيهِ؟ قَالَ «هُوَ أَوْلَى النَّاسِ بِمَحْيَاهُ وَبِمَمَاتِهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ
✧ Tamim al-Dari said: I asked the Messenger of Allah ﷺ, saying: 'What do you think about a man from the people of disbelief who accepts Islam at the hands of a man from the people of Islam; how is the ruling concerning him?' He said: 'He is the closest of people to him in his life and in his death.' Abu Abd al-Rahman said: This is more correct than the one before it.

فِي قَوْلِهِ تَعَالَى {وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ} [النساء 33] قَالَ كَانَ الْمُهَاجِرُونَ حِينَ قَدِمُوا الْمَدِينَةَ تُورِثُ الْأَنْصَارَ دُونَ رَحِمِهِ لِلْأُخُوَّةِ الَّتِي آخَى رَسُولُ اللهِ ﷺ بَيْنَهُمْ فَلَمَّا نَزَلَتْ {وَلِكُلٍّ جَعَلْنَا مَوَالِيَ مِمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ} [النساء 33] قَالَ نَسَخَتْهَا {وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ} [النساء 33] مِنَ النَّصْرِ وَالنَّصِيحَةِ وَالرِّفَادَةِ وَيُوصِي لَهُ وَقَدْ ذَهَبَ الْمِيرَاثُ
"To those also, to whom your right hand was pledged, give your portion." When the Emigrants came to Medina. they inherited from the Helpers without any blood-relationship with them for the brotherhood which the Messenger of Allah ﷺ established between them. When the following verse was revealed: "To (benefit) everyone we have appointed shares and heirs to property left by parent and relatives." it abrogated the verse: "To those also, to whom your right hand was pledged, give their due portion." This alliance was made for help, well wishing and cooperation. Now a legacy can be made for him. (The right to)inheritance was abolished. (Using translation from Abū Dāʾūd 2922)

✧ That the Messenger of Allah ﷺ said: 'There is no alliance in Islam, and whichever alliance existed in the pre-Islamic era, Islam only increased it in strength.'

عَنْ رَسُولِ اللهِ ﷺ قَالَ «مَنْ تَرَكَ دَيْنًا أَوْ ضَيَاعًا فَإِلَيَّ وَمَنْ تَرَكَ مَالًا فَهُوَ لِوَرَثَتِهِ وَأَنَا وَلِيُّ مَنْ لَا وَلِيَّ لَهُ أَعْقِلُ عَنْهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ يَفُكُّ عَنْوَهُ وَيَرِثُ مَالَهُ»
✧ From the Messenger of Allah ﷺ, he said: 'Whoever leaves behind a debt or a dependent, then it is to me; and whoever leaves behind wealth, then it is for his heirs. I am the guardian of the one who has no guardian: I pay blood money on his behalf and inherit his wealth. And the maternal uncle is the guardian of the one who has no guardian: he ransoms his captive and inherits his wealth.'

✧ The Messenger of Allah ﷺ said: 'A woman acquires three inheritances: her freed slave, her foundling, and her child upon whom she invokes a curse.'
