al-Sunan al-Kubra (al-Nasa'i) 6186

✧ The date palm is sold as a whole, the buyer excludes its fruits.

أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا اللَّيْثُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ النَّبِيَّ ﷺ قَالَ «أَيُّمَا امْرِئٍ أَبَّرَ نَخْلًا ثُمَّ بَاعَ أَصْلَهَا فَلِلَّذِي أَبَّرَ ثَمَرُ النَّخْلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

Translation

✧ The Prophet ﷺ said: "Any man who pollinates date palms then sells their origin, the fruit of the date palms belongs to the one who pollinated them, unless the buyer stipulates."
