5969 5970 5931 أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا سُفْيَانُ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ

عَنْ أَبِي هُرَيْرَةَ وَزِيدِ بْنِ خَالِدٍ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ بِاللهِ إِلَّا مَا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَا بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ كَانَا أَخْبَرَانِي عَلَى ابْنِهِ الرَّجْمَ فَافْتَدَى مِنْهُ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمْ بِكِتَابِ اللهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ تُرَدُّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا» فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا نَعْلَمُ أَحَدًا تَابَعَ سُفْيَانَ عَلَى قَوْلِهِ وَشِبْلٍ رَوَاهُ مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ وَزِيدِ بْنِ خَالِدٍ وَرَوَاهُ بُكَيْرُ بْنُ الْأَشَجِّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ فَقَطْ وَحَدِيثُ مَالِكٍ وَعَمْرِو بْنِ شُعَيْبٍ أَوْلَى بِالصَّوَابِ مِنْ قَوْلِ ابْنِ عُيَيْنَةَ وَشِبْلٍ أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ سَمِعْتُ مَالِكَ بْنَ أَنَسٍ

✧ From Abū Hurayrah, Zayd b. Khālid, and Shibl, who said: “We were with the Prophet ﷺ when a man stood before him and said: ‘I adjure you by Allah to judge between us according to the Book of Allah.’ He said: ‘Speak.’ The man said: ‘My son was a worker for this man, and he committed adultery with his wife. I ransomed him with one hundred sheep and a servant. Some people had told me that my son deserved stoning, so I ransomed him. Then I asked men of knowledge, and they told me that my son deserves one hundred lashes and exile for a year.’ The Prophet ﷺ said to him: ‘By Him in whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to receive one hundred lashes and exile for a year. Go, Unays, to this man’s wife, and if she confesses, stone her.’ So Unays went to her, she confessed, and he stoned her.” Abū ʿAbd al-Raḥmān said: “We do not know of anyone who supported Sufyān in his statement “and Shibl.” Mālik narrated it from al-Zuhrī, from ʿUbayd Allāh, from Abū Hurayrah and Zayd b. Khālid. Bukayr b. al-Ashajj narrated it from ʿAmr b. Shuʿayb, from al-Zuhrī, from ʿUbayd Allāh b. ʿAbd Allāh, from Abū Hurayrah alone. The ḥadīth of Mālik and ʿAmr b. Shuʿayb is more correct than the statement of Ibn ʿUyaynah and Shibl. Yūnus b. ʿAbd al-Aʿlā informed us, saying: Ibn Wahb narrated to us, saying: I heard Mālik b. Anas.”
