أَخْبَرَنَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَلِيِّ بْنِ أَبِي الْمضَاءَ قَاضِي الْمَصِّيصَةِ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ قَتَادَةَ عَنِ النَّضْرِ بْنِ أَنَسٍ عَنْ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى

أَنَّ رَجُلَيْنِ ادَّعَيَا دَابَّةً وَجَدَاهَا عِنْدَ رَجُلٍ فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا شَاهِدَيْنِ أَنَّهَا دَابَّتُهُ «فَقَضَى بِهَا النَّبِيُّ ﷺ بَيْنَهُمَا نِصْفَيْنِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَطَأٌ وَمُحَمَّدُ بْنُ كَثِيرٍ هَذَا هُوَ الْمِصِّيصِيُّ وَهُوَ صَدُوقٌ إِلَّا أَنَّهُ كَثِيرُ الْخَطَإِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ فِي إِسْنَادِهِ وَفِي مَتْنِهِ

✧ Two men claimed an animal they found with a man, and each of them produced two witnesses that it was his animal. The Prophet ﷺ ruled it between them in halves. Abu Abd al-Rahman said: This is an error. This Muhammad b. Kathir is al-Missisi, and he is truthful, except that he errs a lot. Abu Abd al-Rahman said: Said b. Abi Arubah differed with him in its chain and in its text.
