✧ Inheritance of the paternal uncle

أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ رَاهَوَيْهِ قَالَ أَخْبَرَنَا وَكِيعٌ عَنْ سُفْيَانَ يَعْنِي الثَّوْرِيَّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ عَيَّاشِ بْنِ أَبِي رَبِيعَةَ عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ أَنَّ رَجُلًا رَمَى رَجُلًا بِسَهْمٍ فَقَتَلَهُ وَلَا وَارِثَ لَهُ إِلَّا خَالٌ فَكَتَبَ فِي ذَلِكَ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ إِلَى عُمَرَ فَكَتَبَ عُمَرُ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ»

✧ The Messenger of Allah ﷺ said: 'Allah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir.'
