✧ Inheritance of Relatives Other than Legal Guardians

أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى أَبُو مُوسَى وَمُحَمَّدُ بْنُ بَشَّارٍ بُنْدَارٌ عَنْ عَبْدِ الرَّحْمَنِ يَعْنِي ابْنَ مَهْدِيٍّ قَالَ حَدَّثَنَا سُفْيَانُ يَعْنِي الثَّوْرِيَّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْأَصْبَهَانِيِّ عَنْ مُجَاهِدِ بْنِ وَرْدَانَ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ عَنْ عَائِشَةَ

أَنَّ مَوْلًى لِلنَّبِيِّ ﷺ خَرَّ مِنْ عِذْقِ نَخْلَةٍ فَمَاتَ فَأَتَى النَّبِيُّ ﷺ بِمِيرَاثِهِ فَقَالَ «هَلْ لَهُ مِنْ رَحِمٍ أَوْ نَسَبٍ؟» قَالُوا لَا قَالَ «انْظُرُوا بَعْضَ أَهْلِهِ» وَقَالَ ابْنُ بَشَّارٍ أَهْلَ قَوْمِهِ فَأَعْطُوهُ إِيَّاهُ

✧ That a freed slave of the Prophet ﷺ fell from a palm branch and died. The Prophet ﷺ was brought his inheritance and said: “Does he have any kin or relatives?” They said: “No.” He said: “Look for some of his family.” Ibn Bashshar said: “the people of his tribe.” So they gave it to him.
