✧ Inheritance of Relatives Other than Legal Guardians

أَخْبَرَنِي هِلَالُ بْنُ الْعَلَاءِ بْنِ هِلَالٍ الرَّقِّيُّ قَالَ حَدَّثَنَا أَبِي قَالَ حَدَّثَنَا عَبَّادٌ قَالَ حَدَّثَنَا أَبُو بَكْرِ بْنُ أَحْمَرَ عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ

أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ عِنْدِي مِيرَاثَ رَجُلٍ مِنَ الْأَزْدِ وَإِنِّي لَمْ أَجِدْ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ قَالَ «انْطَلِقْ فَالْتَمِسْ أَزْدِيًّا عَامًا» أَوْ قَالَ «حَوْلًا» فَانْطَلَقَ ثُمَّ أَتَاهُ فَجْرَ الْعَامِ الثَّانِي فَقَالَ يَا رَسُولَ اللهِ لَمْ أَجِدْ أَزْدِيًّا قَالَ انْطَلِقْ فَادْفَعْهُ إِلَى أَوَّلِ خُزَاعِيٍّ تَلْقَاهُ فَلَمَّا أَدْبَرَ قَالَ عَلَيَّ بِالرَّجُلِ فَرَجَعَ فَقَالَ انْطَلِقْ فَادْفَعْهُ إِلَى أَكْبَرِ خُزَاعَةَ

Translation

✧ That a man came to the Prophet ﷺ and said: “O Messenger of Allah, I have the inheritance of a man from Azd, and I have not found any Azdi to give it to.” He said: “Go and seek an Azdi for a year,” or he said “a full year.” He went, then came to him at the dawn of the second year and said: “O Messenger of Allah, I have not found any Azdi.” He said: “Go and give it to the first Khuzai you meet.” When he turned away, he said: “Bring the man to me.” He returned, and he said: “Go and give it to the eldest of Khuza'ah.”
