22. Divorce

    أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَاسْتَفْتَى عُمَرُ النَّبِيَّ ﷺ فَقَالَ إِنَّ عَبْدَ اللهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ «مُرْ عَبْدَ اللهِ فَلْيُرَاجِعْهَا ثُمَّ يَدَعْهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا هَذِهِ ثُمَّ تَحِيضُ حَيْضَةً أُخْرَى فَإِذَا طَهُرَتْ فَإِنْ شَاءَ فَلْيُفَارِقْهَا قَبْلَ أَنْ يُجَامِعَهَا وَإِنْ شَاءَ فَلْيُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ»

    ✧ He divorced his wife while she was menstruating. Umar sought the verdict of the Prophet ﷺ and said: 'Abdullah has divorced his wife while she was menstruating.' He said: 'Command Abdullah to take her back, then leave her until she becomes pure from this menstruation, then she menstruates another menstruation. When she becomes pure, then if he wishes he may separate from her before having intercourse with her, and if he wishes he may keep her. That is the waiting period that Allah commanded for women to be divorced.'

    أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللهِ ﷺ «مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ بِهَا اللهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ»

    ✧ He divorced his wife while she was menstruating during the time of the Messenger of Allah ﷺ. Umar b. al-Khattab asked the Messenger of Allah ﷺ about that, and the Messenger of Allah ﷺ said: 'Command him to take her back, then keep her until she becomes pure, then she menstruates, then if he wishes he may keep her thereafter, and if he wishes he may divorce her before touching her. That is the waiting period that Allah commanded for women to be divorced.'

    طَلَّقْتُ امْرَأَتِي فِي حَيَاةِ رَسُولِ اللهِ ﷺ وَهِيَ حَائِضٌ فَذَكَرَ عُمَرُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَتَغَيَّظَ رَسُولُ اللهِ ﷺ فِي ذَلِكَ وَقَالَ «لِيُرَاجِعْهَا ثُمَّ يُمْسِكْهَا حَتَّى تَحِيضَ حَيْضَةً وَتَطْهُرَ فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا طَاهِرًا قَبْلَ أَنْ يَمَسَّهَا فَذَلِكَ الطَّلَاقُ لِلْعِدَّةِ كَمَا أَمَرَ اللهُ» قَالَ عَبْدُ اللهِ بْنُ عُمَرَ فَرَاجَعْتُهَا وَحَسِبْتُ لَهَا التَّطْلِيقَةَ الَّتِي طَلَّقْتُهَا

    ✧ I divorced my wife during the lifetime of the Messenger of Allah ﷺ while she was menstruating. Umar mentioned that to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ became angry about it and said: 'Let him take her back, then keep her until she menstruates one menstruation and becomes pure. If it appears to him to divorce her while she is pure before touching her, then that is the divorce according to the waiting period, as Allah commanded.' Abdullah b. Umar said: So I took her back, and I counted for her the divorce I had pronounced.

    لَهُ طَلَّقَ عَبْدُ اللهِ بْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ النَّبِيُّ ﷺ «لِيُرَاجِعْهَا» فَرَدَّهَا عَلَيَّ قَالَ «إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ» قَالَ ابْنُ عُمَرَ وَقَرَأَ النَّبِيُّ ﷺ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ} [الطلاق 1] فِي قُبُلِ عِدَّتِهِنَّ

    "What did you think about a man who divorces his wife when she is menstruating?" He said to him: "Abdullah bin 'Umar divorced his wife when she was menstruating during the time of the Messenger of Allah. 'Umar asked the Messenger of Allah (about that) and said: 'Abdullah bin 'Umar has divorced his wife while she was menstruating.' The Messenger of Allah said: 'Let him take her back.' So he made me take her back. He said: 'When she becomes pure, let him divorce her or keep her.' Ibn 'Umar said: 'The Prophet said: 'O Prophet! When you divorce women, divorce them before their 'Iddah (prescribed period) elapses.'" (Using translation from Nasāʾī 3392)

    عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ تَعَالَى {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} [الطلاق 1] قَالَ ابْنُ عَبَّاسٍ ؓ قُبُلَ عِدَّتِهِنَّ

    ✧ From Ibn Abbas, regarding the saying of the Exalted: {O Prophet, when you divorce women, divorce them at their waiting period} [At-Talaq 1], Ibn Abbas ؓ said: 'At the beginning of their waiting period.'

    أَنْ يُطَلِّقَهَا تَطْلِيقَةً وَهِيَ طَاهِرٌ فِي غَيْرِ جِمَاعٍ فَإِذَا حَاضَتْ وَطَهُرَتْ طَلَّقَهَا أُخْرَى فَإِذَا حَاضَتْ وَطَهُرَتْ طَلَّقَهَا أُخْرَى ثُمَّ تَعْتَدُّ بَعْدَ ذَلِكَ بِحَيْضَةٍ» قَالَ الْأَعْمَشُ سَأَلْتُ إِبْرَاهِيمَ فَقَالَ مِثْلَ ذَلِكَ

    "The Sunnah divorce is a divorce issued when she is pure (not menstruating) without having had intercourse with her. If she menstruates and becomes pure again, give her another divorce, and if she menstruates and becomes pure again, give her another divorce, then after that, she should wait for another menstrual cycle." (One of the narrators) Al-A'mash said: "I asked Ibrahim, and he said something similar." (Using translation from Nasāʾī 3394)

    أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً فَانْطَلَقَ عُمَرُ فَأَخْبَرَ النَّبِيَّ ﷺ بِذَلِكَ فَقَالَ لَهُ النَّبِيُّ ﷺ «مُرْ عَبْدَ اللهِ فَلْيُرَاجِعْهَا فَإِذَا اغْتَسَلَتْ فَلْيَتْرُكْهَا حَتَّى تَحِيضَ فَإِذَا اغْتَسَلَتْ مِنْ حَيْضَتِهَا الْأُخْرَى فَلَا يَمَسَّهَا حَتَّى يُطَلِّقَهَا فَإِنْ شَاءَ أَنْ يُمْسِكَهَا فَلْيُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ»

    ✧ He divorced his wife while she was menstruating with one divorce. Umar went and informed the Prophet ﷺ about that. The Prophet ﷺ said to him: 'Command Abdullah to take her back. Then when she has performed ghusl, let him leave her until she menstruates. Then when she has performed ghusl from her next menstruation, let him not touch her until he divorces her. And if he wishes to keep her, let him keep her. That is the waiting period that Allah commanded for women to be divorced.'

    أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرٌ أَوْ حَامِلٌ»

    ✧ He divorced his wife while she was menstruating. That was mentioned to the Prophet ﷺ, and he said: 'Command him to take her back, then divorce her when she is pure or pregnant.'

    ✧ He divorced his wife while she was menstruating, and the Messenger of Allah ﷺ returned her to him until he divorced her while she was pure.

    هَلْ تَعْرِفُ عَبْدَ اللهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا فَقُلْتْ لَهُ فَتَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ فَقَالَ «مَهْ أَرَأَيْتِ إِنْ عَجَزَ وَاسْتَحْمَقَ»

    ✧ Do you know Abdullah b. Umar? He divorced his wife while she was menstruating. Umar asked the Prophet ﷺ, and he ordered him to take her back. I said to him: Does she observe the waiting period for that divorce? He said: 'What! Do you think if he was incapable and foolish?'

    أَتَعْرِفُ عَبْدَ اللهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَسَأَلَهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ تَسْتَقْبِلُ عِدَّتَهَا قُلْتُ لَهُ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَهِيَ حَائِضٌ أَتَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ فَقَالَ «مَهْ أَوَإِنْ عَجَزَ وَاسْتَحْمَقَ»

    ✧ Do you know 'Abd Allah b. 'Umar? He divorced his wife while she was menstruating. 'Umar came to the Prophet ﷺ and asked him, so he commanded him to take her back, then she begins her waiting period afresh. I said to him, 'If a man divorces his wife while she is menstruating, does she observe the waiting period for that divorce?' He said, 'What! Even if he was incapable or foolish?'

    أُخْبِرَ رَسُولُ اللهِ ﷺ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثَ تَطْلِيقَاتٍ جَمِيعًا فَقَامَ غَضْبَانًا ثُمَّ قَالَ «أَيُلْعَبُ بِكِتَابِ اللهِ وَأَنَا بَيْنَ أَظْهُرِكُمْ» حَتَّى قَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ أَلَا أَقْتُلُهُ؟ قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْلَمُ أَحَدًا رَوَى هَذَا الْحَدِيثَ غَيْرَ مَخْرَمَةَ

    ✧ The Messenger of Allah ﷺ was told about a man who divorced his wife with three divorces all together. He stood up angry then said, 'Is the Book of Allah being toyed with while I am still among you?' until a man stood up and said, 'O Messenger of Allah, shall I kill him?' Abu 'Abd al-Rahman said: I do not know anyone who narrated this hadith other than Makhramah.

    أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَسَأَلَ عَاصِمٌ رَسُولَ اللهِ ﷺ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللهِ ﷺ وَسْطَ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا» قَالَ سَهْلٌ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغَ قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ

    Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). Ibn Shihab said “Then this became the method of invoking curses.” (Using translation from Abū Dāʾūd 2245)

    أَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ أَنَا بِنْتُ آلِ خَالِدٍ وَإِنَّ زَوْجِي فُلَانًا مُرْسِلٌ إِلَيَّ بِطَلَاقِي وَإِنِّي سَأَلْتُ أَهْلَهُ النَّفَقَةَ وَالسُّكْنَى فَأَبَوْا عَلَيَّ قَالُوا يَا رَسُولَ اللهِ إِنَّهُ أَرْسَلَ إِلَيْهَا بِثَلَاثِ تَطْلِيقَاتٍ قَالَتْ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّمَا النَّفَقَةُ وَالسُّكْنَى لِلْمَرْأَةِ إِذَا كَانَ لِزَوْجِهَا عَلَيْهَا الرَّجْعَةُ»

    ✧ I came to the Prophet ﷺ and said, 'I am the daughter of the family of Khalid. My husband so-and-so has sent me my divorce, and I asked his family for maintenance and lodging, but they refused me.' They said, 'O Messenger of Allah, he sent her three divorces.' She said: The Messenger of Allah ﷺ said, 'Maintenance and lodging are only for the woman when her husband has the right to take her back.'

    عَنِ النَّبِيِّ ﷺ «الْمُطَلَّقَةُ ثَلَاثًا لَيْسَ لَهَا سُكْنَى وَلَا نَفَقَةٌ»

    ✧ From the Prophet ﷺ: 'The woman divorced three times has no lodging and no maintenance.'

    أَنَّ أَبَا عَمْرِو بْنِ حَفْصٍ الْمَخْزُومِيَّ طَلَّقَهَا ثَلَاثًا فَانْطَلَقَ خَالِدُ بْنُ الْوَلِيدِ فِي نَفَرٍ مِنْ بَنِي مَخْزُومٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَ فَاطِمَةَ ثَلَاثًا فَهَلْ لَهَا نَفَقَةٌ؟ فَقَالَ النَّبِيُّ ﷺ «لَيْسَ لَهَا نَفَقَةٌ وَلَا سُكْنَى»

    ✧ Abu 'Amr b. Hafs al-Makhzumi divorced her three times. Khalid b. al-Walid went with a group from Banu Makhzum to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, Abu 'Amr b. Hafs has divorced Fatimah three times. Is she entitled to maintenance?' The Prophet ﷺ said, 'She has no maintenance and no lodging.'

    حَدَّثَنَا أَبُو عَاصِمٍ هُوَ النَّبِيلُ عَنِ ابْنِ جُرَيْجٍ عَنِ ابْنِ طَاوُسٍ عَنْ أَبِيهِ أَنَّ أَبَا الصَّهْبَاءِ جَاءَ إِلَى ابْنِ عَبَّاسٍ فَقَالَ يَا ابْنَ عَبَّاسٍ أَلَمْ تَعْلَمْ أَنَّ الثَّلَاثَ كَانَتْ عَلَى عَهْدِ النَّبِيِّ ﷺ وَأَبِي بَكْرٍ وَصَدْرًا مِنْ خِلَافَةِ عُمَرَ تُرَدُّ إِلَى الْوَاحِدَةِ؟ قَالَ «نَعَمْ»

    ✧ Abu 'Asim (who is al-Nabil) narrated to us from Ibn Jurayj from Ibn Tawus from his father that Abu al-Sahba' came to Ibn 'Abbas and said, 'O Ibn 'Abbas, do you not know that three divorces were, at the time of the Prophet ﷺ, Abu Bakr, and the beginning of 'Umar's caliphate, treated as one?' He said, 'Yes.'

    سُئِلَ رَسُولُ اللهِ ﷺ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ فَتَزَوَّجَتْ زَوْجًا غَيْرَهُ فَدَخَلَ بِهَا ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يُوَاقِعَهَا أَتَحِلُّ لِلْأَوَّلِ؟ فَقَالَ رَسُولُ اللهِ ﷺ «لَا حَتَّى يَذُوقَ الْآخَرُ عُسَيْلَتَهَا وَتَذُوقَ عُسَيْلَتَهُ»

    ✧ The Messenger of Allah ﷺ was asked about a man who divorced his wife, then she married another husband, who consummated the marriage with her, then divorced her before having intercourse with her. Is she lawful for the first husband? The Messenger of Allah ﷺ said, 'No, until the latter tastes her sweetness and she tastes his sweetness.'

    جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي نَكَحْتُ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ وَاللهِ مَا مَعَهُ إِلَّا مِثْلُ هَذِهِ الْهُدْبَةِ فَقَالَ رَسُولُ اللهِ ﷺ «لَعَلَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ وَتَذُوقِي عُسَيْلَتَهُ»

    ✧ The wife of Rifa'ah al-Qurazi came to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, I married 'Abd al-Rahman b. al-Zubayr, and by Allah, he has nothing but like this fringe.' The Messenger of Allah ﷺ said, 'Perhaps you want to return to Rifa'ah? No, until he tastes your sweetness and you taste his sweetness.'

    ✧ The wife of Rifa'ah al-Qurazi came to the Prophet ﷺ while Abu Bakr was with him. She said, 'O Messenger of Allah, I was married to Rifa'ah al-Qurazi, and he divorced me irrevocably. Then I married 'Abd al-Rahman b. al-Zubayr, and by Allah, O Messenger of Allah, he has nothing but like this fringe.' And she took a fringe from her outer garment. Khalid b. Sa'id was at the door and was not granted permission to enter. He said, 'O Abu Bakr, do you not hear this woman speaking openly in front of the Messenger of Allah ﷺ?' He said, 'You want to return to Rifa'ah? No, until you taste his sweetness and he tastes your sweetness.'

    ✧ The wife of Rifa'ah al-Qurazi came to the Messenger of Allah ﷺ and said, 'My husband divorced me with an irrevocable divorce. I then married 'Abd al-Rahman b. al-Zubayr, and he has nothing but like the fringe of a garment.' The Messenger of Allah ﷺ laughed and said, 'Perhaps you want to return to Rifa'ah? No, until he tastes your sweetness and you taste his sweetness.'

    ✧ Al-Ghumaysa' or al-Rumaysa' came to the Prophet ﷺ complaining about her husband that he did not reach her. It was not long before her husband came and said, "O Messenger of Allah, she is lying; he reaches her, but she wants to return to her first husband." The Messenger of Allah ﷺ said, "That is not for her until she tastes his sweetness."

    ✧ The Prophet ﷺ was asked about a man who divorces his wife three times, then another man marries her, closes the door, lowers the curtain, and then divorces her before consummating the marriage. He said, "She is not lawful for the first until the other has intercourse with her." Abu Abd al-Rahman said: This is more correct than the one before it, and Allah knows best.

Urwah told me from A'ishah that when the Kilabiyyah entered upon the Messenger of Allah ﷺ, she said, "I seek refuge in Allah from you." The Messenger of Allah ﷺ said, "You have sought refuge in a Great One. Go back to your family."

    ✧ I heard Fatimah bt. Qays say: My husband sent me my divorce, so I tied my garments tightly and came to the Prophet ﷺ. He said, "How many times did he divorce you?" I said, "Three." He said, "You have no maintenance, and observe your waiting period in the house of your cousin Ibn Umm Maktum, for he is blind; you can take off your clothes in his presence. When your waiting period ends, inform me." Abridged. 5582: Ubayd Allah b. Sa'id informed us, he said: Abd al-Rahman narrated to us from Sufyan from Mansur from Mujahid from Tamim, the freed slave of Fatimah, from Fatimah, something similar.

    ✧ I heard A'ishah, the wife of the Prophet ﷺ, say that the Prophet ﷺ used to stay with Zaynab and drink honey at her place. She and Hafsah agreed that whichever of them the Prophet ﷺ entered upon should say, "I find from you the smell of maghafir." He entered upon one of them and she said that to him. He said, "Rather, I drank honey at Zaynab's." And he said, "I will never do it again." Then was revealed: {Why do you forbid what Allah has made lawful for you} [al-Tahrim 1], {If you two repent to Allah} [al-Tahrim 4] to A'ishah and Hafsah. I did not understand Hafsah as I intended. {And when the Prophet confided to one of his wives} [al-Tahrim 3] for his saying, "Rather, I drank honey." All of this speech is in the hadith of Ata'. Abu Abd al-Rahman said: This hadith has an excellent chain, extremely authentic hadith of A'ishah regarding the honey.

    ✧ From the Messenger of Allah ﷺ during the campaign of Tabuk. He said in it: When the messenger of the Messenger of Allah ﷺ came to me, he said, "The Messenger of Allah ﷺ commands you [261]" 5586: Abu al-Rabi' Sulayman b. Dawud informed me, he said: Ibn Wahb informed us from Yunus, Ibn Shihab said: Abd al-Rahman b. Abd Allah b. Ka'b b. Malik informed me that Abd Allah b. Ka'b b. Malik said: I heard Ka'b b. Malik narrating his story when he stayed behind from the Messenger of Allah ﷺ during the campaign of Tabuk. He related his story and said: Until when forty days had passed, and he said: When the messenger of the Messenger of Allah ﷺ came to me, he said, "The Messenger of Allah ﷺ commands you to separate from your wife." I said, "Should I divorce her or what?" He said, "No, rather separate from her and do not approach her." So I said to my wife, "Go to your family and stay with them until Allah decides this matter."

    حَدَّثَنِي ابْنَا قُرَيْظَةَ أَنَّهُمْ عُرِضُوا عَلَى رَسُولِ اللهِ ﷺ يَوْمَ قُرَيْظَةَ «فَمَنْ كَانَ مُحْتَلِمًا أَوْ نَبَتَتْ عَانَتُهُ قُتِلَ وَمَنْ لَمْ يَكُنِ احْتَلَمَ أَوْ لَمْ تَنْبُتْ عَانَتُهُ تُرِكَ»

    ✧ The two sons of Qurayzah narrated to me that they were brought before the Messenger of Allah ﷺ on the day of Qurayzah. Whoever had reached puberty or had pubic hair was killed, and whoever had not reached puberty or had no pubic hair was left.

    "The Messenger of Allah had a Persian neighbor who was good at making soup. He came to the Messenger of Allah one day when 'Aishah was with him, and gestured to him with his hand to come. The Messenger of Allah gestured toward 'Aishah -meaning: 'What about her?'- and the man gestured to him like this, meaning, 'No,' two or three times." (Using translation from Nasāʾī 3436)

Whoever emigrated for Allah and His Messenger, his emigration was for Allah and His Messenger. Whoever emigrated for a worldly gain to attain or a woman to marry, his emigration was for what he emigrated for.

    ✧ Aisha, the wife of the Prophet ﷺ, said: When the Messenger of Allah ﷺ was commanded to give his wives a choice, he began with me and said: I am mentioning something to you, so do not hasten until you consult your parents. She said: He knew that my parents would not command me to separate from him. She said: Then he recited this verse: O Prophet, say to your wives: If you desire the life of this world and its adornment [Quran 33:28] up to His saying: a goodly provision [Quran 33:28]. I said: Regarding which of this should I consult my parents? I desire Allah and His Messenger and the Hereafter. Aisha said: Then the wives of the Prophet ﷺ did as I did, and that was not considered divorce when the Messenger of Allah ﷺ said to them and they chose him, because they chose him.

    ✧ When {And if you desire Allah and His Messenger and the Final Abode} was revealed, the Prophet ﷺ came in to me and began with me, saying, “O Aisha, I am going to mention something to you, but you need not hasten until you consult your parents.” She said, “By Allah, he knew that my parents would never command me to part with him.” Then he recited to me, {O Prophet, say to your wives: If you desire the life of this world and its adornment, then come} (Q33:28). I said, “Is it about this that I should consult my parents? For I desire Allah and His Messenger and the Final Abode.” Abu Abd al-Rahman said, “The hadith of Yunus and Musa b. Ali that precedes it is more likely correct.”

    ✧ From Aisha, the wife of the Prophet ﷺ, she said: There were three Sunnahs concerning Barirah. One of the three Sunnahs was that she was freed and given a choice regarding her husband. The Messenger of Allah ﷺ said, “Wala belongs to the one who frees.” The Messenger of Allah ﷺ entered while a pot was boiling with meat, and bread and some condiment from the household were brought near to him. The Messenger of Allah ﷺ said, “Did I not see the pot with meat in it?” They said, “Yes, O Messenger of Allah, but it is meat that was given as charity to Barirah, and you do not eat charity.” The Messenger of Allah ﷺ said, “It is charity for her, but it is a gift for us.”

    ✧ That they should sell her and stipulate the wala. I mentioned that to the Prophet ﷺ, and he said, “Buy her and free her, for the wala belongs to the one who frees.” She said: She was freed, and the Messenger of Allah ﷺ gave her a choice, and she chose herself. She used to be given charity, and she would gift some of it to us. I mentioned that to the Prophet ﷺ, and he said, “Eat it, for it is charity for her and a gift for us.”

    اشْتَرَيْتُ بَرِيرَةَ فَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَعْتِقِيهَا فَإِنَّ الْوَلَاءُ لِمَنْ أَعْطَى الْوَرِقَ» قَالَتْ فَأَعْتَقْتُهَا قَالَتْ فَدَعَاهَا النَّبِيُّ ﷺ «فَخَيَّرَهَا مِنْ زَوْجِهَا» قَالَتْ لَوْ أَعْطَانِي كَذَا وَكَذَا مَا أَقَمْتُ عِنْدَهُ فَاخْتَارَتْ نَفْسَهَا وَكَانَ زَوْجُهَا حُرًّا

    ✧ I bought Barirah, and her owners stipulated her wala. I mentioned that to the Prophet ﷺ, and he said, “Free her, for the wala belongs to the one who paid the silver.” She said: So I freed her. She said: The Prophet ﷺ called her and gave her a choice regarding her husband. She said, “If he gave me such and such, I would not stay with him,” and she chose herself. Her husband was a free man.

    ✧ To buy Barirah, but they stipulated her wala. I mentioned that to the Prophet ﷺ, and he said, “Buy her and free her, for the wala belongs to the one who frees.” Some meat was brought, and it was said, “This is from what was given as charity to Barirah.” He said, “It is charity for her and a gift for us.” The Messenger of Allah ﷺ gave her a choice, and her husband was a free man.

    كَاتَبْتُ بَرِيرَةَ عَلَى نَفْسِهَا تِسْعَ أَوَاقٍ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا فَقَالَتْ إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ فِي ذَلِكَ أَهْلَهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَجَاءَتْ إِلَى عَائِشَةَ وَجَاءَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ فَقَالَتْ لَهَا مَا قَالَ أَهْلُهَا فَقَالَتْ لَاهَا اللهُ إِذًا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي فَقَالَ رَسُولُ اللهِ ﷺ «مَا هَذَا؟» فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ بَرِيرَةَ أَتَتْنِي تَسْتَعِينُ بِي عَلَى كِتَابَتِهَا فَقُلْتُ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَقَالَ رَسُولُ اللهِ ﷺ «ابْتَاعِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءُ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» ثُمَّ قَامَ فَخَطَبَ النَّاسَ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ يَقُولُونَ أَعْتِقْ فُلَانًا وَالْوَلَاءُ لِي كِتَابُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَكُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ» فَخَيَّرَهَا رَسُولُ اللهِ ﷺ مِنْ زَوْجِهَا وَكَانَ عَبْدًا فَاخْتَارَتْ نَفْسَهَا قَالَ عُرْوَةُ وَلَوْ كَانَ حُرًّا مَا خَيَّرَهَا رَسُولُ اللهِ ﷺ

    ✧ I made a contract of manumission with Barirah for herself: nine uqiyahs, one uqiyah each year. She came to Aisha seeking her help, and she said, “Unless they agree that I pay them the full sum in one payment and the wala belongs to me.” Barirah went and spoke to her owners about that, but they refused unless the wala belonged to them. She came to Aisha, and the Messenger of Allah ﷺ came at that moment. She told her what her owners had said, and she said, “No, by Allah, not unless the wala belongs to me.” The Messenger of Allah ﷺ said, “What is this?” I said, “O Messenger of Allah, Barirah came to me seeking help with her kitabah, and I said, ‘No, unless they agree that I pay them the full sum in one payment and the wala belongs to me.’ She mentioned that to her owners, and they refused unless the wala belonged to them.” The Messenger of Allah ﷺ said, “Buy her and stipulate the wala for them, for the wala belongs to the one who frees.” Then he stood and addressed the people, praising and extolling Allah, then said, “What is the matter with people who stipulate conditions that are not in the Book of Allah, saying, ‘Free so-and-so and the wala belongs to me’? The Book of Allah is more deserving, and the condition of Allah is more binding. Any condition not in the Book of Allah is void, even if it is a hundred conditions.” The Messenger of Allah ﷺ then gave her a choice regarding her husband, who was a slave, and she chose herself. Urwah said, “If he had been free, the Messenger of Allah ﷺ would not have given her a choice.”

    رَسُولُ اللهِ ﷺ «الْوَلَاءُ لِمَنْ وَلِيَ النِّعْمَةَ» وَخَيَّرَهَا رَسُولُ اللهِ ﷺ وَكَانَ زَوْجُهَا عَبْدًا وَأَهْدَتْ لِعَائِشَةَ لَحْمًا فَقَالَ رَسُولُ اللهِ ﷺ «لَوْ وَضَعْتُمْ لَنَا مِنْ هَذَا اللَّحْمِ» فَقَالَتْ عَائِشَةُ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ»

    ✧ The Messenger of Allah ﷺ said: "Allegiance belongs to the one who grants favor." And the Messenger of Allah ﷺ gave her the choice. Her husband was a slave. She gave some meat to Aishah as a gift, so the Messenger of Allah ﷺ said: "If only you would put some of this meat before us." Aishah said: "It was given in charity to Barirah." He said: "It is charity for her and a gift for us."

    سَأَلْتُ رَسُولَ اللهِ ﷺ عَنْ بَرِيرَةَ وَأَرَدْتُ أَنِ اشْتَرِيَهَا وَاشْتَرِطَ الْوَلَاءَ لِأَهْلِهَا فَقَالَ «اشْتَرِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» قَالَ وَخُيِّرَتْ وَكَانَ زَوْجُهَا عَبْدًا ثُمَّ قَالَ بَعْدَ ذَلِكَ مَا أَدْرِي مَا أَدْرِي وَأُتِيَ رَسُولُ اللهِ ﷺ بِلَحْمٍ فَقَالُوا هَذَا مِمَّا تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ قَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»

    "Shu'bah narrated to us, from 'Abdur-Rahman bin Al-Qasim, from his father, from 'Aishah. He (Shu'bah) said: "And he ('Abdur-Rahman) was the executor for his father." He (Shu'bah) said: "I was afraid to say to him: 'Did you hear this from your father.'" -- 'Aishah said: "I asked the Messenger of Allah about Barirah, as I wanted to buy her but it was stipulated that the Wala' would go to her (former) masters. He said: 'Buy her, for the Wala' is to the one who sets the slave free.' And she was given the choice, as her husband was a slave." Then he said, after that: "I do not know." --"And some meat was brought to the Messenger of Allah and they said: 'This is some of that which was given in charity to Barirah.'     أَصْبَحْنَا يَوْمًا وَنِسَاءُ النَّبِيِّ ﷺ يَبْكِينَ عِنْدَ كُلِّ امْرَأَةٍ مِنْهُنَّ أَهْلُهَا فَدَخَلْتُ الْمَسْجِدَ فَإِذَا هُوَ مُلِأَ مِنَ النَّاسِ قَالَ فَجَاءَ عُمَرُ فَصَعِدَ إِلَى النَّبِيِّ ﷺ وَهُوَ فِي عُلِّيَّةٍ لَهُ فَسَلَّمَ عَلَيْهِ فَلَمْ يُجِبْهُ أَحَدٌ ثُمَّ سَلَّمَ فَلَمْ يُجِبْهُ أَحَدٌ فَرَجَعَ فَنَادَى بِلَالًا فَدَخَلَ عَلَى النَّبِيِّ ﷺ فَقَالَ أَطَلَّقْتَ نِسَاءَكَ؟ قَالَ «لَا وَلَكِنِّي آلَيْتُ مِنْهُنَّ شَهْرًا» فَمَكَثَ تِسْعًا وَعِشْرِينَ ثُمَّ نَزَلَ فَدَخَلَ عَلَى عَائِشَةَ

    ✧ One morning we woke up and the wives of the Prophet ﷺ were weeping, each woman with her family. I entered the mosque and found it full of people. Umar came and went up to the Prophet ﷺ while he was in an upper room of his. He greeted him, but no one answered. Then he greeted again, but no one answered. So he returned and called Bilal, who entered upon the Prophet ﷺ. He (Bilal) said: "Have you divorced your wives?" He said: "No, but I have sworn to stay away from them for a month." He remained twenty-nine days, then came down and entered upon Aishah.

    آلَى النَّبِيُّ ﷺ مِنْ نِسَائِهِ شَهْرًا فَقَعَدَ فِي مَشْرُبَةٍ لَهُ فَمَكَثَ تِسْعًا وَعِشْرِينَ لَيْلَةً ثُمَّ نَزَلَ فَقِيلَ يَا رَسُولَ اللهِ أَلَسْتَ آلَيْتَ عَلَى شَهْرٍ؟ قَالَ «الشَّهْرُ تِسْعٌ وَعِشْرُونَ»

    ✧ The Prophet ﷺ swore to stay away from his wives for a month and sat in an upper room of his. He remained twenty-nine nights, then came down. It was said: "O Messenger of Allah, did you not swear to stay away for a month?" He said: "The month is twenty-nine days."

    أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ قَدْ ظَاهَرَ مِنَ امْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَقَالَ يَا رَسُولَ اللهِ إِنِّي ظَاهَرْتُ مِنَ امْرَأَتِي فَوَقَعْتُ عَلَيْهَا قَبْلَ أَنْ أُكَفِّرَ قَالَ «وَمَا حَمَلَكَ عَلَى ذَلِكَ يَرْحَمُكَ اللهُ؟» قَالَ رَأَيْتُ خَلْخَالَهَا فِي ضَوْءِ الْقَمَرِ فَقَالَ «لَا تَقْرَبْهَا حَتَّى تَفْعَلَ مَا أَمَرَ اللهُ»

    "O Messenger of Allah, I declared Zihar on my wife, then I had intercourse with her before I offered the expiation." He said: "What made you do that, may Allah have mercy on you?" He said: "I saw her anklets in the light of the moon." He said: "Do not approach her until you have done that which Allah, the Mighty and Sublime, has commanded."     ✧ The Prophet ﷺ asked him: "What led you to do that?" He said: "May Allah have mercy on you, O Messenger of Allah. I saw her anklet or her legs in the moonlight." The Messenger of Allah ﷺ said: "Then keep away from her until you do what Allah has commanded you."

    أَنَّهَا قَالَتْ الْحَمْدُ لِلَّهِ الَّذِي وَسِعَ سَمْعُهُ الْأَصْوَاتَ لَقَدْ جَاءَتْ خَوْلَةُ إِلَى رَسُولِ اللهِ ﷺ تَشْكُو زَوْجَهَا فَكَانَ يَخْفَى عَلَيَّ كَلَامُهَا فَأَنْزَلَ اللهُ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللهِ وَاللهُ يَسْمَعُ تَحَاوُرَكُمَا} [المجادلة 1] الْآيَةَ

    ✧ She said: "Praise be to Allah, whose hearing encompasses all sounds. Khawlah came to the Messenger of Allah ﷺ complaining about her husband, and I could not hear her words, but Allah revealed: 'Allah has heard the words of her who disputes with you concerning her husband and complains to Allah, and Allah hears your mutual conversation' [al-Mujadilah 1] and the rest of the verse."

    وَأَنَّ رَسُولَ اللهِ ﷺ خَرَجَ إِلَى الصُّبْحِ فَوَجَدَ حَبِيبَةَ بِنْتَ سَهْلٍ عِنْدَ بَابِهِ فِي الْغَلَسِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ هَذِهِ؟» قَالَتْ أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ يَا رَسُولَ اللهِ فَقَالَ «مَا شَأْنُكِ؟» قَالَتْ لَا أَنَا وَلَا ثَابِتُ بْنُ قَيْسٍ لِزَوْجِهَا فَلَمَّا جَاءَ ثَابِتُ بْنُ قَيْسٍ قَالَ لَهُ رَسُولُ اللهِ ﷺ «هَذِهِ حَبِيبَةُ بِنْتُ سَهْلٍ قَدْ ذَكَرَتْ مَا شَاءَ اللهُ أَنْ تَذْكُرَ» فَقَالَتْ حَبِيبَةُ يَا رَسُولَ اللهِ كُلُّ مَا أَعْطَانِي عِنْدِي فَقَالَ رَسُولُ اللهِ ﷺ لِثَابِتٍ «خُذْ مِنْهَا» فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي أَهْلِهَا

    ✧ The Messenger of Allah ﷺ went out for the dawn prayer and found Habibah bint Sahl at his door in the darkness. The Messenger of Allah ﷺ said: "Who is this?" She said: "I am Habibah bint Sahl, O Messenger of Allah." He said: "What is the matter with you?" She said: "Neither I nor Thabit bin Qays," meaning her husband. When Thabit bin Qays came, the Messenger of Allah ﷺ said to him: "This is Habibah bint Sahl. She has mentioned what Allah willed she mention." Habibah said: "O Messenger of Allah, everything he gave me is with me." The Messenger of Allah ﷺ said to Thabit: "Take it from her." So he took it from her, and she stayed with her family.

    أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ ثَابِتُ بْنُ قَيْسٍ أَمَا إِنِّي مَا أَعْتِبُ عَلَيْهِ فِي خُلُقٍ وَلَا دِينٍ وَلَكِنِّي أَكْرَهُ الْكُفْرَ فِي الْإِسْلَامِ فَقَالَ رَسُولُ اللهِ ﷺ «أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ؟» قَالَتْ نَعَمْ قَالَ رَسُولُ اللهِ ﷺ «اقْبَلِ الْحَدِيقَةَ وَطَلِّقْهَا تَطْلِيقَةً»

    ✧ The wife of Thabit bin Qays came to the Prophet ﷺ and said: "O Messenger of Allah, Thabit bin Qays — I do not find fault with him in character or religion, but I dislike disbelief in Islam." The Messenger of Allah ﷺ said: "Will you return his garden to him?" She said: "Yes." The Messenger of Allah ﷺ said: "Accept the garden and divorce her with one divorce."

    ✧ O Messenger of Allah, under me is a beautiful wife who does not repel the hand of a toucher. He said: 'Divorce her.' He said: 'I cannot be patient away from her.' He said: 'Then keep her.' Abu Abd al-Rahman said: This is a mistake, and the correct view is mursal. Al-Nadr b. Shumayl has been contradicted in it. Others narrated it from Hammad b. Salama, from Harun b. Ri'ab and Abd al-Karim al-Mu'allim, from Ibn Ubayd Allah b. Umayr. Abd al-Karim said: from Ibn Abbas, but Abd al-Karim is not that strong, while Harun b. Ri'ab is trustworthy, and the hadith of Harun is more correct, and Harun sent it mursal.

    أَيْ عَاصِمُ أَرَأَيْتُمْ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ تَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ يَا عَاصِمُ؟ سَلْ عَنْ هَذَا لِي رَسُولَ اللهِ ﷺ فَسَأَلَ عَاصِمٌ عَنْ هَذَا النَّبِيَّ ﷺ فَعَابَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَكَرِهَهَا فَجَاءَهُ عُوَيْمِرٌ فَقَالَ مَا صَنَعْتَ يَا عَاصِمُ؟ قَالَ صَنَعْتُ أَنَّكَ لَمْ تَأْتِنِي بِخَيْرٍ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَأَسْأَلَنَّ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَانْطَلَقَ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «قَدْ أُنْزِلَ فِيكَ وَفِي صَاحِبَتِكَ فَائْتِ بِهَا» قَالَ سَهْلٌ وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَجَاءَ بِهَا فَتَلَاعَنَا فَقَالَ يَا رَسُولَ اللهِ وَاللهِ لَئِنْ أَمْسَكْتُهَا لَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ بِفِرَاقِهَا فَصَارَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ

    ✧ O Asim, do you think if a man saw a man with his wife and killed him, would you kill him? Or how should he act, O Asim? Ask the Messenger of Allah ﷺ about this for me. So Asim asked the Prophet ﷺ about this, and the Messenger of Allah ﷺ disapproved of such questions and disliked them. Then Uwaymir came to him and said: What did you do, O Asim? He said: I did not bring you any good; the Messenger of Allah ﷺ disliked such questions and disapproved of them. Uwaymir said: By Allah, I will ask the Messenger of Allah ﷺ about that. He went to the Messenger of Allah ﷺ and asked him, and the Messenger of Allah ﷺ said to him: 'It has been revealed concerning you and your wife, so bring her.' Sahl said: I was with the people near the Messenger of Allah ﷺ. He brought her, and they invoked mutual curses. He said: O Messenger of Allah, by Allah, if I keep her, I will have lied about her. So he separated from her before the Messenger of Allah ﷺ commanded him to separate from her, and that became the sunna for the two who invoke curses.

    لَاعَنَ فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا ثُمَّ قَالَ «ابْصُرُوهُ فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا قَضِيءَ الْعَيْنَيْنِ فَهُوَ لِهِلَالِ ابْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا أَحْمَشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ السَّحْمَاءِ» قَالَ فَأُنْبِئْتُ أَنَّهَا جَاءَتْ بِهِ أَكْحَلَ جَعْدًا أَحْمَشَ السَّاقَيْنِ

    ✧ He invoked curses, and the Messenger of Allah ﷺ conducted the cursing between them, then said: 'Observe her. If she gives birth to a child who is white, with lank hair, and weak eyes, then it is for Hilal b. Umayya; but if she gives birth to one with dark eyelids, curly hair, and thin shanks, then it is for Sharik b. al-Sahma.' He said: I was informed that she gave birth to one with dark eyelids, curly hair, and thin shanks.

    أَنَّ هِلَالَ ابْنَ أُمَيَّةَ قَذَفَ شَرِيكَ بْنَ السَّحْمَاءِ بِامْرَأَتِهِ فَأَتَى النَّبِيَّ ﷺ فَأَخْبَرَهُ بِذَلِكَ فَقَالَ لَهُ النَّبِيُّ ﷺ «أَرْبَعَةَ شُهَدَاءَ وَإِلَّا فَحَدٌّ فِي ظَهْرِكَ» يُرَدِّدُ ذَلِكَ عَلَيْهِ مِرَارًا فَقَالَ لَهُ هِلَالٌ وَاللهِ يَا رَسُولَ اللهِ إِنَّ اللهَ لَيَعْلَمُ أَنِّي صَادِقٌ وَلَيُنْزِلَنَّ اللهُ عَلَيْكَ مَا يُبَرِّئُ بِهِ ظَهْرِي مِنَ الْحَدِّ فَبَيْنَمَا هُمْ كَذَلِكَ إِذْ نَزَلَتْ عَلَيْهِ آيَةُ اللِّعَانِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} [النور 6] إِلَى آخِرِ الْآيَاتِ فَدُعِيَ هِلَالٌ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الصَّادِقِينَ وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ دُعِيَتِ الْمَرْأَةُ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ فَلَمَّا أَنْ كَانَ فِي الرَّابِعَةِ أَوِ الْخَامِسَةِ قَالَ رَسُولُ اللهِ ﷺ «وَقِّفُوهَا فَإِنَّهَا مُوجِبَةٌ» فَتَلَكَّأَتْ حَتَّى مَا شَكَكْنَا أَنَّهَا سَتَعْتَرِفُ ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ فَمَضَتْ عَلَى الْيَمِينِ فَقَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا قَضِيءَ الْعَيْنَيْنِ فَهُوَ لِهِلَالِ ابْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ آدَمَ جَعْدًا رَبْعًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ فَجَاءَتْ بِهِ آدَمَ جَعْدًا رَبْعًا حَمْشَ السَّاقَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ «لَوْلَا مَا سَبَقَ فِيهَا مِنْ كِتَابِ اللهِ لَكَانَ لِي وَلَهَا شَأْنٌ» وَالْقَضِيءُ الْعَيْنَيْنِ طَوِيلَ شُفْرِ الْعَيْنَيْنِ لَيْسَ بِمَفْتُوحِ الْعَيْنِ وَلَا جَاحِظِهِمَا

    ✧ Hilal b. Umayya accused Sharik b. al-Sahma of adultery with his wife. He came to the Prophet ﷺ and told him that, and the Prophet ﷺ said to him: 'Four witnesses, otherwise a hadd punishment on your back,' repeating that to him several times. Hilal said to him: By Allah, O Messenger of Allah, Allah knows that I am truthful, and Allah will surely reveal to you what will absolve my back from the hadd. While they were thus, the verse of li'an descended upon him: {And those who accuse their wives} [al-Nur 6] to the end of the verses. Hilal was called and he testified four times by Allah that he was truthful, and the fifth that the curse of Allah be upon him if he was among the liars. Then the woman was called and she testified four times by Allah that he was among the liars. When it came to the fourth or the fifth, the Messenger of Allah ﷺ said: 'Stop her, for it is binding.' She hesitated until we had no doubt that she would confess, then she said: I will not disgrace my people for the rest of the day. She proceeded with the oath. The Messenger of Allah ﷺ said: 'Observe her. If she gives birth to a child who is white, with lank hair, and weak eyes, then it is for Hilal b. Umayya; but if she gives birth to one who is dark, with curly hair, of medium build, and thin shanks, then it is for Sharik b. Sahma.' She gave birth to one who was dark, with curly hair, of medium build, and thin shanks. The Messenger of Allah ﷺ said: 'Were it not for what has preceded in the Book of Allah, I would have had a matter with her.' Al-qadi' al-'aynayn means long eyelashes, not open-eyed nor protruding-eyed.

    التَّلَاعُنُ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا ثُمَّ انْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ يَشْكُو إِلَيْهِ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلَّا لِقَوْلِي فَذَهَبَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ فَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرَةِ وَكَانَ الَّذِي ادَّعَى عَلَيْهِ أَنَّهُ وَجَدَهُ عِنْدَ امْرَأَتِهِ آدَمَ خَدْلًا كَثِيرَ اللَّحْمِ فَقَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ بَيِّنْ» فَوَضَعَتْ شَبِيهًا بِالرَّجُلِ الَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ «لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ رَجَمْتُ هَذِهِ»؟ فَقَالَ ابْنُ عَبَّاسٍ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السَّوءَ فِي الْإِسْلَامِ

    ✧ The mutual cursing took place in the presence of the Messenger of Allah ﷺ. Asim b. Adi said something about that, then left. A man from his people came to him complaining that he had found a man with his wife. Asim said: I was only afflicted with this because of my words. So he took him to the Messenger of Allah ﷺ and told him what he had found with his wife. That man was yellowish, with little flesh, and lank hair, while the one he accused of being found with his wife was dark, thick-calved, and fleshy. The Messenger of Allah ﷺ said: 'O Allah, make it clear.' She gave birth to a child resembling the man whom her husband mentioned finding with her. The Messenger of Allah ﷺ conducted the cursing between them. A man said to Ibn Abbas in the gathering: Is she the one about whom the Messenger of Allah ﷺ said: 'If I were to stone anyone without proof, I would stone this woman'? Ibn Abbas said: No, that was a woman who openly displayed evil in Islam.

    ✧ O Messenger of Allah, what do you think, and Amr did not say 'what do you think,' about a man among us who sees lewdness with his wife: if he speaks, it is a grave matter—Amr said: he has come with a grave matter—and if he remains silent, he remains silent over the like of that. He did not answer him. Later he came to him and said: The matter I asked you about has befallen me. Then Allah revealed these verses in Surat al-Nur: {And those who accuse their wives} [al-Nur 6] until reaching {and the fifth that the wrath of Allah be upon her if he is among the truthful} [al-Nur 9]. He began with the man, admonished him, reminded him, and told him that the punishment of this world is lighter than the punishment of the Hereafter. He said: By the One who sent you with the truth, I have not lied. Then he turned to the woman, admonished her and reminded her, and she said: By the One who sent you with the truth, he is a liar. He began with the man, and he testified four times by Allah that he was among the truthful, and the fifth that the curse of Allah be upon him if he was among the liars. Then he turned to the woman, and she testified four times by Allah that he was among the liars, and the fifth that the wrath of Allah be upon her if he was among the truthful.     ✧ The Prophet of Allah ﷺ separated between the two brothers of Banu al-Ajlan, then said: 'Allah knows best that one of you two is lying. Is there any of you two who will repent?' He said it three times, but they both refused, so he separated between them. Ayyub said: Amr b. Dinar said to me: In this hadith there is something I do not see you narrating. He said: The man said: What about my property? He said: You have no property. If you are truthful, you have consummated the marriage with her; and if you are lying, she is even further from you.

He said: O Messenger of Allah, what about my property? He said: 'You have no property. If you were truthful about her, it is in return for what you made lawful of her private part; and if you lied about her, that is even further from you.'

    There came a person to the Prophet (may peace he upon him) ) from Banu Fazara and said: My wife has given birth to a child who is black, whereupon Allah's Apostle ﷺ said: Have you any camels? He said: Yes. He again said: What is this colour? He said: They are red. He said: Is there a dusky one among them? He said: Yes, there are dusky ones among them He said: How has it come about? He said: It is perhaps the strain to which it has reverted, whereupon he (the Holy Prophet) said: It is perhaps the strain to which he (the child) has reverted. (Using translation from Muslim 1500a)

    "A man from Banu Fazarah came to the Prophet and said: 'My wife has given birth to a black boy' -and he wanted to disown him. He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray ones among them?' He said: 'There are some gray camels among them.' He said: 'Why is that do you think?' He said: 'Perhaps it is hereditary.' He said: 'Perhaps this is hereditary.' And he did not permit him to disown him." (Using translation from Nasāʾī 3479)

    "While we were with the Prophet, a man stood up and said: 'O Messenger of Allah, a black boy has been born to me.' The Messenger of Allah said: 'How did that happen?' He said: 'I do not know.' He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray camels among them?' He said: 'There are some gray camels among them.' He said: 'Where do they come from?' He said: 'I do not know, O Messenger of Allah! Perhaps it is hereditary.' He said: 'Perhaps this is also hereditary.' Because of this, the Messenger of Allah decreed the following: 'It is not allowed for a man, to disown a child who was born on his bed, unless he claimed that he had seen an immoral act (Fahishah).'"     ✧ He heard the Messenger of Allah ﷺ saying when the verse of li'an was revealed: Any woman who introduces into a people someone who is not of them, she has nothing to do with Allah, and Allah will never admit her to His Paradise. And any man who denies his child while looking at him, Allah will veil Himself from him and disgrace him before the first and the last.

    ✧ Saʿd said: “O Messenger of God, this is the son of my brother ʿUtbah b. Abī Waqqāṣ. He instructed me that he is his son. Look at his resemblance.” And ʿAbd b. Zamʿah said: “He is my brother, born on my father's bed from his slave woman.” The Messenger of God ﷺ looked at his resemblance and saw a clear resemblance to ʿUtbah. He said: “He is yours, O ʿAbd.     ✧ He had intercourse with her, and she gave birth to a child resembling the one she was suspected with. Then Zamʿah died while she was pregnant. Sawdah mentioned that to the Messenger of God ﷺ, and the Messenger of God ﷺ said: “The child belongs to the bed. And veil yourself from him, O Sawdah, for he is not a brother to you.”

    ✧ ʿAlī was brought three men while he was in Yemen. They had had intercourse with a woman during a single period of purity. He asked two of them: “Do you acknowledge this child for this one?” They said: “No.” Then he asked two: “Do you acknowledge this child for this one?” They said: “No.” So he cast lots among them and attached the child to the one upon whom the lot fell, and he imposed upon him two-thirds of the blood money. That was mentioned to the Prophet ﷺ, and he laughed until his molar teeth appeared. 5653 ʿAlī b. Ḥujr al-Marwazī informed us, he said: ʿAlī b. Mushir informed us, from al-Ajlaḥ, from al-Shaʿbī, who said: ʿAbdullāh b. Abī al-Khalīl al-Ḥaḍramī informed me, from Zayd b.     ✧ I was with the Prophet ﷺ and ʿAlī was in Yemen that day. A man came to him and said: “I witnessed ʿAlī when he was brought three men who claimed a woman's child. ʿAlī said to one of them: ‘Will you leave him to this one?’ He refused. He said to another: ‘Will you leave him to this one?’ He refused. He said to another: ‘Will you leave him to this one?’ He refused. ʿAlī said: ‘You are quarrelsome partners. I will cast lots among you. Whichever of you the lot falls upon, the child is his, and upon him is two-thirds of the blood money.’” The Messenger of God ﷺ laughed until his molar teeth appeared. Abū ʿAbd al-Raḥmān said: All these hadiths have disordered chains.

    ✧ “The Messenger of God ﷺ sent ʿAlī to Yemen, and he was brought a boy over whom three men disputed.” And he related the hadith. Abū ʿAbd al-Raḥmān said: Salamah b. Kuhayl contradicted them. [291] 5656 Muḥammad b. Bashshār Bundār informed us, he said: Muḥammad—meaning Ghundar—informed us, he said: Shuʿbah informed us, from Salamah b. Kuhayl, who said: I heard al-Shaʿbī narrate from Abū al-Khalīl or Ibn al-Khalīl that three men shared in a period of purity, and he mentioned something similar but did not mention Zayd b.     ✧ A woman came to the Messenger of Allah ﷺ and said to him, 'May my father and mother be your ransom, my husband wants to take away my son, who has benefited me and given me water from the well of Abu 'Inabah.' Then her husband came and said, 'Who will dispute with me concerning my son?' He said, 'O boy, this is your father and this is your mother; take the hand of whichever of them you wish.' So he took his mother's hand, and she went off with him.

    ✧ Thabit b. Qays b. Shammas struck his wife and broke her hand—she was Jamilah bt. 'Abd Allah b. Ubayy. Her brother came to complain about him to the Messenger of Allah ﷺ, so the Messenger of Allah ﷺ sent for Thabit and said to him, 'Take what she owes you and let her go.' He said, 'Yes.' Then the Messenger of Allah ﷺ commanded her to wait one menstrual period and then join her family.

    ✧ I obtained a khul' from my husband, then I came to 'Uthman and asked him what waiting period I owed. He said, 'You have no waiting period unless he has recently had intercourse with you, in which case you must wait until you have menstruated once.' She said, 'In that, the ruling of the Messenger of Allah ﷺ concerning Maryam al-Maghaliyyah is followed. She was married to Thabit b. Qays b. Shammas and obtained a khul' from him.'

He said: "One of you used to stay in her house wearing her shabbiest clothes for a year, then she would come out. No, (the mourning period is) four months and ten (days)."     ✧ From Yahya b. Sa'id b. Qays b. Qahd al-Ansari—whose grandfather met the Prophet ﷺ—from Humayd b. Nafi', from Zaynab bt. Umm Salamah, from Umm Salamah and Umm Habibah, who said: A woman came to the Prophet ﷺ and said, 'My daughter's husband has died, and I fear for her eyes; may I apply kohl to them?' The Messenger of Allah ﷺ said, 'One of you would sit for a year, but it is only four months and ten days. When the year was over, she would go out and throw a piece of dung behind her.'

    ✧ From one of the wives of the Prophet ﷺ, from Umm Salamah, that the Prophet ﷺ said: 'It is not lawful for a woman who believes in Allah and the Last Day, and believes in Allah and His Messenger, to mourn for any deceased person more than three days, except for a husband, for whom she mourns four months and ten days.'     ✧ Subay'ah gave birth twenty-three or twenty-five nights after her husband's death. When she was purified, she desired to remarry, but that was criticized. This was mentioned to the Messenger of Allah ﷺ, and he said, 'What prevents her? Her term has ended.'

    ✧ I heard Abu Salamah say: Abu Hurayrah and Ibn 'Abbas differed about a woman whose husband died and she gave birth. Abu Hurayrah said she may remarry, while Ibn 'Abbas said she must wait the longer of the two terms. They sent to Umm Salamah, who said: 'Subay'ah's husband died, and she gave birth fifteen and a half months after his death.' She said: 'Two men proposed to her, and she inclined toward one of them. When they feared she would act on her own, they said, "You are not lawful." She said: 'She went to the Messenger of Allah ﷺ, and he said, "You are lawful, so marry whomever you wish." '

    ✧ Abu Hurayrah said, 'If she gives birth, she becomes lawful.' Abu Salamah then visited Umm Salamah and asked her about that. She said, 'Subay'ah al-Aslamiyyah gave birth half a month after her husband's death. Two men proposed to her, one young and the other older. She was inclined to the young man, but the older man said, "She is not lawful." Her family was absent, and he hoped that when they came they would prefer him. She went to the Messenger of Allah ﷺ, and he said, "You are lawful, so marry whomever you wish." '

    "Whatever a Verse (revelation) do We abrogate or cause to be forgotten, We bring a better one or similar to it." and He said: "And when We change a Verse in place of another --and Allah knows best what He sends down." and He said: "Allah blots out what He wills and confirms (what He wills). And with Him is the Mother of the Book." "The first thing that was abrogated in the Qur'an was the Qiblah." And He said: "And divorced women shall wait (as regards their marriage) for three menstrual periods." and He said: "And those of your women as have passed the age of monthly courses, for them the 'Iddah, if you have doubt (about their periods), is three months." So (some) of that was abrogated, (according to) His, Most High, saying: "And then divorce them before you have sexual intercourse with them, no 'Iddah have you to count in respect of them."     ✧ It was said to Ibn 'Abbas regarding a woman who gave birth twenty nights after her husband's death: Is it permissible for her to marry? He said: No, not until the later of the two terms. He said: I said: Allah, Exalted is He, said {And those who are pregnant, their term is that they deliver their burden} [al-Talaq 4]. He said: That is only in divorce. Abu Hurayrah said: I am with my nephew, meaning Abu Salamah. So he sent his servant Kurayb and said: Go to Umm Salamah and ask her whether there was any precedent for this from the Messenger of Allah ﷺ. He came to him and said: She said: Yes, Subay'ah al-Aslamiyyah gave birth twenty nights after her husband's death, and the Messenger of Allah ﷺ commanded her to marry, and Abu al-Sanabil was among those who proposed to her.

    ✧ Abu Hurayrah: I am with my nephew. So they sent to Umm Salamah, the wife of the Prophet ﷺ, and she said: Subay'ah al-Aslamiyyah gave birth shortly after her husband's death. She sought the ruling of the Messenger of Allah ﷺ, and he commanded her to marry.

    ✧ Abu Salamah said: When she gives birth, she has become lawful. Then Abu Hurayrah came and said: I am with my nephew, meaning Abu Salamah. So they sent Kurayb, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about that. He came to them and informed them that she said: Subay'ah al-Aslamiyyah gave birth a few nights after her husband's death. She mentioned that to the Messenger of Allah ﷺ, and he said: 'You have become lawful.'

    ✧ Abu Salamah said: I said: When she gives birth, she has become lawful and her waiting period has ended. Abu Hurayrah said: I say what my nephew said. Abu Salamah said: So we sent Kurayb to Umm Salamah to ask her about that. He came to us from her with the news that Subay'ah's husband died, and she gave birth a few days after her husband's death, and the Messenger of Allah ﷺ commanded her to marry.

    ✧ From her mother Umm Salamah, the wife of the Prophet ﷺ, that a woman from Aslam called Subay'ah was married to her husband, and he died while she was pregnant. Abu al-Sanabil b. Ba'kak proposed to her, but she refused to marry him. He said: It is not lawful for you to marry until you observe the later of the two terms. She waited nearly twenty nights, then gave birth. She came to the Messenger of Allah ﷺ, and he said: 'Marry.'

    ✧ Her husband died while she was pregnant, and she gave birth less than four months after his death. Ibn 'Abbas said: Observe the later of the two terms. Abu Salamah said: A man from the companions of the Messenger of Allah ﷺ informed me that Subay'ah al-Aslamiyyah came to the Messenger of Allah ﷺ and said: Her husband died while she was pregnant, and she gave birth less than four months later. The Messenger of Allah ﷺ commanded her to marry. Abu Hurayrah said: And I bear witness to that.

    ✧ The Messenger of Allah ﷺ told her when she sought his ruling. 'Umar b. 'Abd Allah wrote to 'Abd Allah b. 'Utbah informing him that Subay'ah told him that she was married to Sa'd b. Khawlah, who was from Banu 'Amir b. Lu'ayy and was among those who witnessed Badr. He died during the Farewell Pilgrimage while she was pregnant. She did not remain long before giving birth after his death. When she recovered from her postpartum bleeding, she adorned herself for suitors. Abu al-Sanabil b. Ba'kak, a man from Banu 'Abd al-Dar, entered upon her and said: Why do I see you adorned? Perhaps you intend to marry. By Allah, you are not marrying until four months and ten days have passed. Subay'ah said: When he said that to me, I gathered my clothes when evening came and went to the Messenger of Allah ﷺ and asked him about that. He ruled that I had become lawful when I gave birth and commanded me to marry if I wished.

    ✧ To Subay'ah al-Aslamiyyah: You are not lawful until four months and ten days have passed, the longer of the two terms. She came to the Messenger of Allah ﷺ and asked him about that. She claimed that the Messenger of Allah ﷺ ruled that she may marry once she gave birth. She was pregnant in her ninth month when her husband died. She was married to Sa'd b. Khawlah, who died during the Farewell Pilgrimage with the Messenger of Allah ﷺ. She married a young man from her people when she gave birth to what was in her womb.

    ✧ He said: Enter upon Subay'ah bt. al-Harith al-Aslamiyyah and ask her about the ruling the Messenger of Allah ﷺ gave her concerning her pregnancy. He said: 'Umar b. 'Abd Allah entered upon her and asked her. She informed him that she was married to Sa'd b. Khawlah, who was one of the companions of the Messenger of Allah ﷺ and among those who witnessed Badr. She said: When I heard that from Abu al-Sanabil, I came to the Messenger of Allah ﷺ and told him my story. The Messenger of Allah ﷺ said: 'You have become lawful when you gave birth.'

    ✧ From a man who married a woman and did not stipulate a dowry for her and did not consummate the marriage with her until he died. Ibn Masʿūd said: “She is entitled to a dowry equivalent to that of her peers, without reduction or excess; she must observe the waiting period, and she inherits.” Then Maʿqil b. Sinān al-Ashjaʿī stood up and said: “The Messenger of Allah ﷺ ruled among us concerning Birwaʿ bt. Wāshiq, a woman from us, exactly as you have ruled.” Ibn Masʿūd rejoiced.

    ✧ Shuʿbah and Ibn Jurayj [narrated]: She was in a distant house, so she came, accompanied by her two brothers, to the Messenger of Allah ﷺ and mentioned it to him. He granted her a concession. Then when she turned to go back, he called her and said: “Stay in your house until the prescribed term reaches its end.”

    أَنَّ زَوْجَهَا تَكَارَى عُلُوجًا لِيَعْمَلُوا لَهُ فَقَتَلُوهُ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ وَقَالَتْ إِنِّي لَسْتُ فِي مَسْكَنٍ لَهُ وَلَا يَجْرِي عَلَيَّ مِنْهُ رِزْقٌ أَفَأَنْتَقِلُ إِلَى أَهْلِي وَيَتَامَايَ فَأَقُومُ عَلَيْهِمْ؟ قَالَ افْعَلِي ثُمَّ قَالَ كَيْفَ قُلْتُ فَأَعَادَتْ عَلَيْهِ قَوْلَهَا قَالَ «اعْتَدِّي حَيْثُ بَلَغَكِ الْخَبَرُ»

    ✧ Her husband hired some non-Arab laborers to work for him, but they killed him. She mentioned that to the Messenger of Allah ﷺ and said: “I am not in a dwelling that belongs to him, and no provision from him reaches me. May I move to my family and my orphan children so that I can look after them?” He said: “Do so.” Then he said: “What did you say?” She repeated her words. He said: “Observe your waiting period wherever the news reaches you.”

She said: I came to the Prophet ﷺ and mentioned to him moving to my family, and I described a situation of hers. She said: He gave me permission. But when I turned to go, he called me back and said: “Stay with your family until the prescribed term reaches its end.”

    ✧ Zaynab said: I entered upon Umm Ḥabībah, the wife of the Prophet ﷺ, when Abū Sufyān b. Ḥarb died. Umm Ḥabībah called for perfume and applied some of it to a slave girl, then touched her own cheeks with it. Then she said: “By Allah, I have no need of perfume, except that I heard the Messenger of Allah ﷺ say: ‘It is not lawful for a woman who believes in Allah and the Last Day to mourn a deceased person for more than three nights, except for a husband, four months and ten days.’” Zaynab said: Then I entered upon Zaynab bt. Jaḥsh when her brother died. She called for perfume and touched some of it, then said: “By Allah, I have no need of perfume, except that I heard the Messenger of Allah ﷺ say on the pulpit: ‘It is not lawful for a woman who believes in Allah and the Last Day to mourn a deceased person for more than three nights, except for a husband, four months and ten days.’” Zaynab also said: I heard Umm Salamah say: A woman came to the Messenger of Allah ﷺ and said: “O Messenger of Allah, my daughter’s husband has died and she is suffering from an eye ailment. May I apply kohl to her eyes?” The Messenger of Allah ﷺ said: “No.” Then he said: “It is only four months and ten days. In the pre-Islamic era, one of you would throw a piece of dung at the end of a year.” Ḥumayd said: I asked Zaynab, “What does throwing a piece of dung at the end of the year mean?” Zaynab said: “In the pre-Islamic era, when a woman’s husband died, she would enter a small tent, wear her worst clothes, and not touch perfume or anything until a year passed. Then she would be brought a donkey, a sheep, or a bird, and she would wipe herself with it. She rarely wiped herself with anything without it dying. Then she would come out and be given a piece of dung, which she would throw. After that she could resume whatever she wished of perfume or anything else.” Mālik said: “She would wipe herself with it” means she would rub herself with it. In the ḥadīth of Muḥammad, Mālik said: “al-ḥifsh is a small hut.”

    ✧ The Messenger of Allah ﷺ said: “A woman must not mourn a deceased person for more than three days, except for her husband; she mourns him for four months and ten days. She must not wear dyed clothing except a garment of ʿaṣb (a Yemeni fabric patterned with stripes), and she must not apply kohl, comb her hair, or touch perfume, except when she purifies herself after menstruation, a little of qust and aẓfār (types of incense) may be used.”

    أَنَّ زَوْجَهَا تُوُفِّيَ وَكَانَتْ تَشْتَكِي عَيْنَهَا فَتَكْتَحِلُ بِكُحْلِ الْجَلَاءِ فَأَرْسَلَتْ مَوْلَاةٌ لَهَا إِلَى أُمِّ سَلَمَةَ فَسَأَلَتْهَا عَنْ كُحْلِ الْجَلَاءِ فَقَالَتْ لَا تَكْتَحِلُ إِلَّا مِنْ أَمْرٍ لَا بُدَّ لَهَا مِنْهُ دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ حِينَ تُوُفِّيَ أَبُو سَلَمَةَ وَقَدْ جَعَلْتُ عَلَى عَيْنَيَّ صَبْرًا قَالَ «مَا هَذَا يَا أُمَّ سَلَمَةَ؟» قُلْتُ إِنَّمَا هُوَ صَبْرٌ يَا رَسُولَ اللهِ لَيْسَ فِيهِ طِيبٌ قَالَ «إِنَّهُ يَشُبُّ الْوَجْهَ فَلَا تَجْعَلِيهِ إِلَّا بِاللَّيْلِ وَلَا تَمْتَشِطِي بِالطِّيبِ وَلَا بِالْحِنَّاءِ؛ فَإِنَّهُ خِضَابٌ» قُلْتُ بِأَيِّ شَيْءٍ أَمْتَشِطُ يَا رَسُولَ اللهِ؟ قَالَ «بِالسِّدْرِ تُغَلِّفِينَ بِهِ رَأْسَكِ»

    ✧ Her husband died and she had an eye complaint, so she used to apply kohl of clarity (kuhl al-jala'). She sent a female client of hers to Umm Salamah and asked her about kohl of clarity. Umm Salamah said: "Do not apply kohl except out of necessity. The Messenger of God ﷺ came in to me when Abu Salamah died, and I had put aloe (sabir) on my eyes. He said: 'What is this, Umm Salamah?' I said: 'It is only aloe, O Messenger of God, with no perfume in it.' He said: 'It brightens the face, so do not apply it except at night. And do not comb with perfume or with henna, for it is a dye.' I said: 'With what should I comb, O Messenger of God?' He said: 'With sidr (lote-tree leaves), and cover your head with it.'"

    ✧ "O Messenger of God, my daughter has an eye inflammation; shall I apply kohl to her?" She was in mourning for her husband. He said: "Except four months and ten (days)." Then she said: "I fear for her eyesight." He said: "No, except four months and ten. In pre-Islamic times one of you would mourn her husband for a year, then at the end of the year she would throw a piece of dung."

    ✧ A woman from Quraysh came to the Messenger of God ﷺ and said: "My daughter's husband has died, and I fear for her eye; she wants to use kohl." He said: "One of you would throw a piece of dung after the end of a year; but it is only four months and ten (days)." I said to Zaynab: "What is the end of the year?" She said: "In pre-Islamic times, when a woman's husband died, she would go to the worst chamber she had and sit in it until a year passed; then she would come out and throw a piece of dung behind her."

    أَنَّ امْرَأَةً سَأَلَتْ أُمَّ سَلَمَةَ وَأَمَّ حَبِيبَةَ أَتَكْتَحِلُ فِي عِدَّتِهَا مِنْ وَفَاةِ زَوْجِهَا فَقَالَتْ أَتَتِ امْرَأَةٌ إِلَى النَّبِي ﷺ فَسَأَلْتُهُ عَنْ ذَلِكَ فَقَالَ «قَدْ كَانَتْ إِحْدَاكُنَّ فِي الْجَاهِلِيَّةِ إِذَا تُوُفِّيَ عَنْهَا زَوْجُهَا أَقَامَتْ سَنَةً ثُمَّ قَذَفَتْ وَرَاءَهَا بِبَعَرَةٍ ثُمَّ خَرَجَتْ وَإِنَّمَا هِيَ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ حَتَّى يَنْقَضِيَ الْأَجَلُ»

    ✧ A woman asked Umm Salamah and Umm Habibah whether she could apply kohl during her waiting period after her husband's death. Umm Salamah said: "A woman came to the Prophet ﷺ and asked him about that, and he said: 'In pre-Islamic times, when one of you lost her husband, she would stay for a year, then throw a piece of dung behind her and come out. But it is only four months and ten (days), until the term ends.'"

    ✧ Regarding His saying: "And those of you who die and leave wives behind—a bequest for their wives of maintenance for a year without turning them out" [al-Baqarah 240]; this was abrogated by the inheritance verse, in which she was allotted the fourth and the eighth, and the period of a year was abrogated when her term was made four months and ten (days).

    أَنْ يُعْطِيَهَا بَعْضَ النَّفَقَةِ فَتَقَالَّتْهَا فَانْطَلَقَتْ إِلَى بَعْضِ نِسَاءِ النَّبِي ﷺ فَدَخَلَ رَسُولُ اللهِ ﷺ وَهِيَ عِنْدَهَا فَقَالَتْ يَا رَسُولَ اللهِ هَذِهِ فَاطِمَةُ بِنْتُ قَيْسٍ طَلَّقَهَا فُلَانٌ فَأَرْسَلَ إِلَيْهَا بَعْضَ النَّفَقَةِ فَرَدَّتْهَا وَزَعَمَ أَنَّهُ شَيْءٌ تَطَوَّلَ بِهِ فَقَالَ صَدَقَ قَالَ النَّبِيُّ ﷺ «انْطَلِقِي إِلَى أُمِّ كُلْثُومٍ فَاعْتَدِّي عِنْدَهَا» ثُمَّ قَالَ «إِنَّ أُمَّ كُلْثُومٍ امْرَأَةٌ يَكْثُرُ عُوَّادُهَا فَانْطَلِقِي إِلَى عَبْدِ اللهِ بْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ أَعْمَى» فَانْتَقَلَتْ عِنْدَ عَبْدِ اللهِ بْنِ أُمِّ مَكْتُومٍ فَاعْتَدَّتْ عِنْدَهُ حَتَّى انْقَضَتْ عِدَّتُهَا ثُمَّ خَطَبَهَا أَبُو الْجَهْمِ وَمُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ فَجَاءَتْ رَسُولَ اللهِ ﷺ تَسْتَأْمِرُهُ فِيهِمَا فَقَالَ «أَمَّا أَبُو الْجَهْمِ فَرَجُلٌ أَخَافُ عَلَيْكِ قَسْقَاسَتَهُ لِلْعَصَا وَأَمَّا مُعَاوِيَةُ فَرَجُلٌ أَخْلَقَ مِنَ الْمَالِ» فَتَزَوَّجَتْ أُسَامَةَ بْنَ زَيْدٍ بَعْدَ ذَلِكَ

    ✧ He gave her some maintenance, but she considered it small, so she went to one of the wives of the Prophet ﷺ. The Messenger of God ﷺ entered while she was with her and said: "O Messenger of God, this is Fatimah bint Qays; so-and-so divorced her and sent her some maintenance, but she returned it and claimed that he had given it as a favour." He said: "He is right." The Prophet ﷺ said: "Go to Umm Kulthum and observe your waiting period with her." Then he said: "Umm Kulthum is a woman whom many visit; so go to Abdullah b. Umm Maktum, for he is blind." So she moved to Abdullah b. Umm Maktum and observed her waiting period with him until it ended. Then Abu al-Jahm and Muawiyah b. Abi Sufyan proposed to her. She came to the Messenger of God ﷺ to consult him about them. He said: "As for Abu al-Jahm, he is a man whose stick never leaves his shoulder (i.e., he beats women); as for Muawiyah, he is a man without means." So she married Usamah b. Zayd after that.

    ✧ She came to the Messenger of God ﷺ and asked his ruling about leaving her house; he ordered her to move to the house of Ibn Umm Maktum, the blind man. Marwan refused to accept Fatimah's report about the divorced woman leaving her house. Urwah said: Aishah disapproved of that on the part of Fatimah. 5710 Muhammad b. al-Muthanna informed us; Hafs narrated to us; Hisham narrated to us from his father from Fatimah: She said: "I said: 'O Messenger of God, my husband divorced me three times, and I fear that someone may break in upon me.' So he ordered her, and she moved."

    ✧ About the ruling of the Messenger of God ﷺ regarding her, she said: "Her husband divorced her irrevocably, and she brought a dispute before the Messenger of God ﷺ about housing and maintenance. She said: He did not grant me housing or maintenance, and ordered me to observe my waiting period in the house of Ibn Umm Maktum."

    ✧ My husband divorced me, and I wanted to move. I went to the Messenger of God ﷺ and he said: "Move to the house of your cousin Amr b. Umm Maktum and observe your waiting period there." Al-Aswad threw pebbles at him and said: "Woe to you! Why do you give such a ruling?" Umar said: "If you bring two witnesses who testify that they heard it from the Messenger of God ﷺ, then we will accept; otherwise we will not abandon the Book of God for the statement of a woman: 'Do not turn them out of their houses, nor shall they leave, unless they commit clear immorality' [al-Talaq 1]."

    ✧ That she should go out to some date-palms of hers, and she met a man who forbade her, so she came to the Messenger of Allah ﷺ, and he said: “Go out and harvest your date-palms; perhaps you will give charity and do good.”

    فَوَضَعَ لِي عَشَرَةً عِنْدَ ابْنِ عَمٍّ لَهُ خَمْسَةٌ شَعِيرٌ وَخَمْسَةٌ تَمْرٌ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ لَهُ ذَلِكَ فَقَالَ «صَدَقَ» وَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ فُلَانٍ وَكَانَ زَوْجُهَا طَلَّقَهَا طَلَاقًا بَائِنًا

    ✧ He allocated for me ten [items] with a paternal cousin of his: five of barley and five of dates. I came to the Messenger of Allah ﷺ and told him that, and he said: “He has spoken the truth.” And he commanded me to observe my waiting period in the house of so-and-so. Her husband had divorced her with an irrevocable divorce.

    أَنَّ رَسُولَ اللهِ ﷺ أَفْتَاهَا بِالِانْتِقَالِ حِينَ طَلَّقَهَا أَبُو عَمْرِو بْنُ حَفْصٍ الْمَخْزُومِيُّ فَأَرْسَلَ مَرْوَانُ قَبِيصَةَ بْنَ ذُؤَيْبٍ إِلَى فَاطِمَةَ يَسْأَلُهَا عَنْ ذَلِكَ فَزَعَمَتْ أَنَّهَا كَانَتْ تَحْتَ أَبِي عَمْرٍو فَلَمَّا أَمَرَ رَسُولُ اللهِ ﷺ عَلِيَّ بْنَ أَبِي طَالِبٍ عَلَى الْيَمَنِ خَرَجَ مَعَهُ فَأَرْسَلَ إِلَيْهَا بِتَطْلِيقَةٍ وَهِيَ بَقِيَّةُ طَلَاقِهَا وَأَمَرَ لَهَا الْحَارِثُ بْنُ هِشَامٍ وَعَيَّاشُ بْنُ أَبِي رَبِيعَةَ بِنَفَقَتِهَا وَأَرْسَلَتْ إِلَى الْحَارِثِ وَعَيَّاشٍ تَسْأَلُهُمَا النَّفَقَةَ الَّتِي أَمَرَ لَهَا بِهَا زَوْجُهَا فَقَالَا وَاللهِ مَا لَهَا عَلَيْنَا نَفَقَةٌ إِلَّا أَنْ تَكُونَ حَامِلًا وَمَا لَهَا أَنْ تَسْكُنَ فِي مَسْكَنِنَا إِلَّا بِإِذْنِنَا فَزَعَمَتْ فَاطِمَةُ أَنَّهَا أَتَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَصَدَّقَهُمَا قَالَتْ فَقُلْتُ فَأَيْنَ أَنْتَقِلُ يَا رَسُولَ اللهِ؟ فَقَالَ «انْتَقِلِي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ» وَهُوَ الْأَعْمَى الَّذِي عَاتَبَهُ اللهُ فِي كِتَابِهِ فَانْتَقَلْتُ عِنْدَهُ فَكُنْتُ أَضَعُ ثِيَابِي عِنْدَهُ حَتَّى أَنْكَحَهَا رَسُولُ اللهِ ﷺ زَعَمَتْ أُسَامَةَ بْنَ زَيْدٍ

    "By Allah, she is not entitled to any provision. So, she sent to Al-Harith bin Hisham and 'Ayyash asking them for the provisions from us unless she is pregnant, and she has no right to live in our house unless we permit her." Fatimah said that she went to the Messenger of Allah and told him about that and he said that they had told the truth. She said: "I said: 'Where shall I move to, O Messenger of Allah?' He said: 'Move to the house of Ibn Umm Maktum' -who was the blind man, concerning whom Allah rebuked him in His Book. I moved to his house, and I used to take off my outer garments." Then the Messenger of Allah married her to Usamah bin Zaid. (Using translation from Nasāʾī 3552)

    ✧ She came to the Messenger of Allah ﷺ and complained to him about bleeding. The Messenger of Allah ﷺ said to her: “That is only a vein. Consider: when your menstrual period comes, do not pray, and when your menstrual period passes, purify yourself, then pray between one period and the next.”

    "Whatever a Verse do We abrogate or cause to be forgotten, We bring a better one or similar to it." and "And when We change a Verse in place of another -and Allah knows best what He sends down" (Al-Nahl 16:101) and "Allah blots out what He wills and confirms (what He wills). And with Him is the Mother of the Book." The first thing that was abrogated in the Qur'an was the Qiblah. And He said: "And divorced women shall wait (as regards their marriage) for three menstrual periods, and it is not lawful for them to conceal what Allah has created in their wombs, if they believe in Allah and the Last Day." "And their husbands have better right to take them back in that period, if they wish for reconciliation." -that is because when a man divorced his wife, he had more right to take her back, even if he had divorced her three times. Then (Allah) abrogated that and said: "The divorce is twice, after that, either you retain her on reasonable terms or release her with kindness." (Using translation from Nasāʾī 3554)

    ✧ I divorced my wife while she was menstruating. 'Umar came to the Prophet ﷺ and mentioned that to him. The Prophet ﷺ said: “Let him take her back, and when she becomes pure—meaning, if he wishes, he may divorce her.” I said to Ibn 'Umar: “And count it [as a divorce]?” He said: “What prevents him? Consider: if he is unable or foolish.”

    ✧ To take her back until she menstruates another menstrual period. Then when she becomes pure, if he wishes he may divorce her, and if he wishes he may keep her. For that is the divorce which Allah has commanded. He, the Exalted, said: {Divorce them at their waiting period} [al-Talaq 1].

    ✧ About a man who divorced his wife while she was menstruating. He says: As for divorcing her once or twice, the Messenger of Allah ﷺ commanded him to take her back, then keep her until she menstruates another menstrual period, then becomes pure, then divorce her before he touches her. And as for divorcing her thrice, then you have disobeyed Allah in what He commanded you regarding divorcing your wife, and your wife has become irrevocably separated from you.

    ✧ That he divorced his wife while she was menstruating. So 'Umar came to the Prophet ﷺ and informed him of the matter, and he commanded him to take her back until she becomes pure. And I did not hear him add anything to this.

    ✧ That the Prophet ﷺ divorced Hafsah and then took her back.
