يَا بَنِي حَارِثَةَ لَقَدْ دَخَلَتْ عَلَيْكُمْ مُصِيبَةٌ قَالُوا مَا هِيَ؟ قَالَ «نَهَى رَسُولُ اللهِ ﷺ عَنْ كِرَاءِ الْأَرْضِ» قُلْنَا يَا رَسُولَ اللهِ إِذًا نُكْرِيهَا بِشَيْءٍ مِنَ الْحَبِّ قَالَ «لَا» قَالَ وَكُنَّا نُكْرِيهَا بِالتِّبْنِ فَقَالَ «لَا» وَكُنَّا نُكْرِيهَا بِمَا عَلَى الرَّبِيعِ السَّاقِي فَقَالَ «لَا ازْرَعْهَا أَوِ امْنَحْهَا أَخَاكَ» خَالَفَهُ مُجَاهِدٌ
✧ "O Banu Harithah, a calamity has befallen you." They said, "What is it?" He said: "The Messenger of Allah ﷺ forbade renting land." We said, "O Messenger of Allah, then we will rent it for some grain." He said, "No." He said: "And we used to rent it for straw." He said, "No." "And we used to rent it for what grows on the spring stream." He said, "No. Cultivate it or grant it to your brother." Mujahid disagreed with him.

✧ Indeed, the Messenger of Allah ﷺ "forbade you from haql, and haql is renting for one-third and one-fourth, and from muzabanah." And muzabanah is buying what is on the tops of palm trees for such-and-such wasq of dates.

✧ The Messenger of Allah ﷺ forbade a matter that was beneficial for us, and obedience to the Messenger of Allah ﷺ is better for you. "He forbade you from haql, and he said: 'Whoever has land, let him grant it or leave it.' And he forbade muzabanah, and muzabanah is when a man has a great amount of palm trees, and a man comes and takes it for such-and-such wasq of dates."

✧ Indeed, the Messenger of Allah ﷺ forbade you from a matter that used to benefit you, and obedience to the Messenger of Allah ﷺ is better for you than what benefits you. "The Messenger of Allah ﷺ forbade haql, and haql is sharecropping for one-third and one-fourth. Whoever has land and can do without it, let him grant it to his brother or leave it. And he forbade you from muzabanah, and muzabanah is when a man comes to many palm trees with great wealth and says: 'Take it for such-and-such wasq of dates this year.'"

✧ Rafi' b. Khadij said: "The Messenger of Allah ﷺ forbade a matter that was beneficial for us, and obedience to the Messenger of Allah ﷺ is more beneficial for us." He said: "Whoever has land, let him cultivate it; if he is unable, let him give it to his brother to cultivate." 'Abd al-Karim b. Malik disagreed with him.

عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ «نَهَى عَنْ كِرَاءِ الْأَرْضِ» فَأَبَى طَاوُسٌ وَقَالَ سَمِعْتُ ابْنَ عَبَّاسٍ لَا يَرَى بِذَلِكَ بَأْسًا قَالَ أَبُو عَبْدِ الرَّحْمَنِ رَوَاهُ أَبُو عَوَانَةَ عَنْ أَبِي حَصِينٍ عَنْ مُجَاهِدٍ عَنْ رَافِعٍ مُرْسَلٌ
✧ On the authority of the Messenger of Allah ﷺ that he "forbade renting land." Tawus refused and said: "I heard Ibn 'Abbas say that he saw no harm in that." Abu 'Abd al-Rahman said: "Abu 'Awanah narrated it from Abu Husayn from Mujahid from Rafi' as mursal."

مَرَّ النَّبِي ﷺ عَلَى أَرْضِ رَجُلٍ مِنَ الْأَنْصَارِ قَدْ عُرِفَ أَنَّهُ مُحْتَاجٌ فَقَالَ «لِمَنْ هَذِهِ الْأَرْضُ؟» فَقَالَ لِفُلَانٍ أَعْطَانِيهَا بِالْأَجْرِ قَالَ «لَوْ مَنَحَهَا أَخَاهُ» فَأَتَى رَافِعٌ الْأَنْصَارَ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ نَهَاكُمْ عَنْ أَمْرٍ كَانَ بِكُمْ رَافِقًا وَطَاعَةُ رَسُولِ اللهِ ﷺ أَنْفَعُ لَكُمْ
✧ The Prophet ﷺ passed by the land of a man from the Ansar who was known to be in need. He said, "Whose land is this?" He said, "It belongs to so-and-so; he gave it to me for rent." He said, "If only he had granted it to his brother." Then Rafi' came to the Ansar and said: "The Messenger of Allah ﷺ has forbidden you from a matter that was beneficial for you, and obedience to the Messenger of Allah ﷺ is more beneficial for you."

✧ The Messenger of Allah ﷺ came out to us and forbade us from a matter that was beneficial for us, and the command of the Messenger of Allah ﷺ is better for us. He said, "Whoever has land, let him cultivate it, or leave it, or grant it." Abu 'Abd al-Rahman said: "Among what indicates that Tawus did not hear this hadith from Rafi' b. Khadij is that [395] 4586 Muhammad b. 'Abd Allah b. al-Mubarak informed us, saying..."

✧ The Prophet ﷺ forbade muhaqalah, muzabanah, mukhabarah, and (selling) with a thunya (exception), unless it is known. Abu Abd al-Rahman said: In the narration of Hammam b. Yahya there is an indication that Ata did not hear from Jabir his hadith from the Prophet ﷺ: “Whoever has land, let him cultivate it.”

رَافِعٌ أَتَى النَّبِي ﷺ بَنِي حَارِثَةَ فَرَأَى زَرْعًا فَقَالَ «مَا أَحْسَنَ زَرْعِ ظُهَيْرٍ» قَالُوا لَيْسَ لِظُهَيْرٍ فَقَالَ «أَلَيْسَ أَرْضُ ظُهَيْرٍ؟» قَالُوا بَلَى وَلَكِنَّهُ أَزْرَعَهَا فَقَالَ رَسُولُ اللهِ ﷺ «خُذُوا زَرْعَكُمْ وَرُدُّوا إِلَيْهِ نَفَقَتُهُ» قَالَ فَأَخَذْنَا زَرْعَنَا وَرَدَدْنَا إِلَيْهِ نَفَقَتَهُ رَوَاهُ طَارِقُ بْنُ عَبْدِ الرَّحْمَنِ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ وَاخْتُلِفَ عَلَيْهِ فِيهِ
✧ Rafi' came to the Prophet ﷺ in Banu Harithah, and he saw a crop and said, "How fine is the crop of Zuhayr!" They said, "It is not Zuhayr's." He said, "Is it not Zuhayr's land?" They said, "Yes, but he had it farmed." The Messenger of Allah ﷺ said, "Take your crop and return to him his expenses." He said, "So we took our crop and returned to him his expenses." Tariq b. 'Abd al-Rahman narrated it from Sa'id b. al-Musayyab, and there is disagreement about it from him.

✧ The Messenger of Allah ﷺ forbade muhaqalah and muzabanah, and said: "Only three may farm: a man who owns land and farms it, or a man who is given land as a gift and farms what he is given, or a man who rents land for gold or silver." Isra'il distinguished it from Tariq, so he made the first statement mursal and made the last statement from the words of Sa'id.

✧ That the Messenger of Allah ﷺ forbade muhaqalah and muzabanah. Muhammad b. 'Abd al-Rahman b. Labibah narrated it from Sa'id, and he said from Sa'd b. Abi Waqqas.

✧ The owners of farms used to lease their farms during the time of the Messenger of Allah ﷺ for what would grow on the water channels from the crop. They came to the Messenger of Allah ﷺ and disputed about some of that, so the Messenger of Allah ﷺ forbade them from leasing for that and said: "Lease for gold and silver." Sulayman b. Yasar narrated this hadith from Rafi' b. Khadij, and he said from a man among his paternal uncles.

✧ We used to engage in muhaqalah with land during the time of the Messenger of Allah ﷺ, leasing it for one-third, one-fourth, and a specified amount of food. One day a man from my paternal uncles came and said: "The Messenger of Allah ﷺ forbade me from something that was beneficial for us, but obedience to Allah and His Messenger is more beneficial for us. He forbade us from engaging in muhaqalah with land and leasing it for one-third, one-fourth, and a specified amount of food, and he commanded the owner of the land to farm it himself or let his brother farm it, and he disliked leasing it." And anything besides that—Ayyub did not hear it from Ya'la.

"My paternal uncle told me that they used to lease land at the time of the Messenger of Allah in return for what grew on the banks of the streams, and a share of the crop stipulated by the owner of the land. But the Messenger of Allah forbade us that." I (Hanzalah) said to Rafi': "How about leasing it in return for Dinars and Dirhams?" ✧ There is no harm in that. In the time of the Messenger of Allah ﷺ, people used to rent out what was on the banks of streams and the openings of water channels, so one would be safe and another would perish, and one would be safe and another would perish. People had no other lease than this, so for that reason he prohibited it. As for something known and guaranteed, there is no harm in it. Malik b. Anas b. Malik agreed with him in its chain of narration but differed in its wording.

'Abd Allah b. 'Umar narrated it from Rafi' b. Khadij, and there is disagreement about al-Zuhri's narration from him.

✧ From the Messenger of Allah ﷺ regarding renting land. Rafi' said to 'Abd Allah, 'I heard my two paternal uncles, who had been present at Badr, telling the people of the house that the Messenger of Allah ﷺ prohibited renting land.' 'Abd Allah said, 'I knew during the time of the Messenger of Allah ﷺ that land was rented. Then 'Abd Allah feared that the Messenger of Allah ﷺ might have introduced something regarding that which he did not know, so he abandoned renting land.' Shu'ayb b. Abi Hamza transmitted it as mursal.

✧ His paternal uncles came to the Messenger of Allah ﷺ and then returned to Rafi' and informed him that the Messenger of Allah ﷺ prohibited renting farms. 'Abd Allah said, 'We knew that he was the owner of a farm which he used to rent during the time of the Messenger of Allah ﷺ on the condition that he would have what grew on the flowing spring from which water gushed, and a portion of straw - I do not know how much.' Ibn 'Awn narrated it from Nafi' and said, 'From some of his paternal uncles.'

✧ He said: The Messenger of Allah ﷺ forbade that. He said: We used to lease land before we knew Rafi'. Then he found something in his heart, so he placed his hand on my shoulder until we reached Rafi', and Abdullah said to him: Did you hear the Prophet ﷺ forbid leasing land? Rafi' said: I heard the Prophet ﷺ say: Do not lease land for anything.

✧ The Messenger of Allah ﷺ forbade a matter that was beneficial to us. I said: What is that? Whatever the Messenger of Allah ﷺ said is true. He said: He asked me: How do you deal with your fields? I said: We lease them for a quarter and measures of dates or barley. He said: Do not do that; cultivate them, or have them cultivated, or retain them. Bukayr narrated it from Usayd b. Rafi', making the narration for Rafi's brother.

✧ Muhammad used to say: Land, in my view, is like capital in a mudarabah partnership. Whatever is valid in a mudarabah partnership is valid in land, and whatever is not valid in a mudarabah partnership is not valid in land. He said: He saw no harm in handing over his land to a farmer on the condition that he work on it himself with his children, his helpers, and his oxen, and not spend anything, with all expenses borne by the owner of the land.

✧ A man and a woman came to Ali, each with a group of people. When he sent the two arbiters, he said: 'Wait both of you until I inform you what is upon you. Do you know what is upon you? If you see fit to reconcile, you may reconcile; and if you see fit to separate, you may separate.' Then he turned to the woman and said: 'Have you accepted what they rule?' She said: 'Yes, I accept the Book of God for me and against me.' Then he turned to the man and said: 'Have you accepted what they rule?' He said: 'No, but I accept that they reconcile, and I do not accept that they separate.' Ali said: 'You have lied, by God! You will not leave until you accept the like of what I have accepted.'

✧ The Messenger of Allah ﷺ said: "Part of unlawful earnings is the price of a dog, the dowry of a prostitute, and the earnings of a cupper." Abu Abd al-Rahman said: It seems that Ibn Fudayl attributed Abd al-Rahman to his grandfather. Yahya b. Abi Kathir narrated it from Ibrahim b. Abd Allah, from al-Sa'ib b. Yazid, from Rafi' b. Khadij.

✧ The Messenger of Allah ﷺ used to wake up in a state of major ritual impurity without having had a wet dream, then he would fast. And along with this hadith she narrated to us that she brought a roasted side of meat to the Messenger of Allah ﷺ, and he ate from it, then he stood for prayer and did not perform ablution. Al-Hajjaj b. Muhammad al-A'war disagreed with him.
