أَخْبَرَنَا عَمْرُو بْنُ زُرَارَةَ قَالَ أَخْبَرَنَا إِسْمَاعِيلُ عَنْ أَيُّوبَ عَنْ مُحَمَّدٍ قَالَ
لَمْ أَعْلَمْ شُرَيْحًا كَانَ يَقْضِي فِي الْمُضَارِبِ إِلَّا بِقَضَائَيْنِ كَانَ رُبَّمَا قَالَ لِلْمُضَارِبِ بَيِّنَتُكَ عَلَى مُصِيبَةٍ تُعْذَرُ بِهَا وَرُبَّمَا قَالَ لِصَاحِبِ الْمَالِ بَيِّنَتُكَ عَلَى أَنَّ أَمِينَكَ خَانَكَ وَإِلَّا فَيَمِينُهُ بِاللهِ مَا خَانَكَ

✧ I did not know that Shurayh ruled concerning the speculative partner except with two rulings. Sometimes he would say to the speculative partner: 'Your proof is required for a loss for which you may be excused.' And sometimes he would say to the owner of the capital: 'Your proof is required that your trustee betrayed you; otherwise, his oath by God that he did not betray you.'
