✧ The Messenger of Allah ﷺ cursed the briber and the bribed in judgment. Al-Dhahabī remained silent about it in the Talkhīṣ.

«مَنْ وُلِّيَ عَلَى عَشَرَةٍ فَحَكَمَ بَيْنَهُمْ بِمَا أَحَبُّوا أَوْ كَرِهُوا جِيءَ بِهِ يَوْمَ الْقِيَامَةِ مَغْلُولَةً يَدَاهُ إِلَى عُنُقِهِ فَإِنْ حَكَمَ بِمَا أَنْزَلَ اللَّهُ وَلَمْ يَرْتَشِ فِي حُكْمِهِ وَلَمْ يَحِفْ فَكَّ اللَّهُ عَنْهُ يَوْمَ الْقِيَامَةِ يَوْمَ لَا غُلَّ إِلَّا غُلُّهُ وَإِنْ حَكَمَ بِغَيْرِ مَا أَنْزَلَ اللَّهُ تَعَالَى وَارْتَشَى فِي حُكْمِهِ وَحَابَى شُدَّتْ يَسَارُهُ إِلَى يَمِينِهِ وَرُمِيَ بِهِ فِي جَهَنَّمَ فَلَمْ يَبْلُغْ قَعْرَهَا خَمْسَمِائَةِ عَامٍ»
✧ Whoever is appointed over ten people and judges between them according to what they like or dislike, he will be brought on the Day of Resurrection with his hands chained to his neck. If he judges by what Allah has revealed and does not take a bribe in his judgment and does not incline wrongly, Allah will release him on the Day of Resurrection—a day when there is no chain except his chain. But if he judges by other than what Allah, Exalted is He, has revealed and takes a bribe in his judgment and shows favoritism, his left hand will be bound to his right hand and he will be cast into Hell, and he will not reach its bottom for five hundred years.

أَنَّ أَهْلَ الطَّفِّ لَا يُؤَدُّونَ الزَّكَاةَ فَبَعَثَ بِلَالٌ رَجُلًا يَسْأَلُ عَمَّا يَقُولُونَ فَوَجَدَ الرَّجُلَ يُطْعَنُ فِي نَسَبِهِ فَرَجَعَ إِلَى بِلَالٍ فَأَخْبَرَهُ فَكَبَّرَ بِلَالٌ وَقَالَ حَدَّثَنِي أَبِي عَنْ أَبِي مُوسَى قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ سَعَى بِالنَّاسِ فَهُوَ بِغَيْرِ رِشْدَةٍ وَفِيهِ شئٌ مِنْهُ»
✧ The people of al-Taff do not pay zakah. Bilal sent a man to ask about what they say, and the man found that he was being reviled in his lineage. He returned to Bilal and informed him, so Bilal said the takbir and said: My father narrated to me from Abu Musa who said: The Messenger of Allah ﷺ said, "Whoever slanders people is of illegitimate birth, and there is something of that in him."

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أَرْضَى سُلْطَانًا بِسَخَطِ رَبِّهِ ﷻ خَرَجَ مِنْ دِينِ اللَّهِ تَبَارَكَ وَتَعَالَى» تَفَرَّدَ بِهِ عَلَّاقُ بْنُ أَبِي مُسْلِمٍ وَالرُّوَاةُ إِلَيْهِ كُلُّهُمْ ثِقَاتٌ «آخِرُ كِتَابِ الْأَحْكَامِ» تفرد به علاق والرواة إليه ثقات
✧ The Messenger of Allah ﷺ said: "Whoever pleases a ruler by displeasing his Lord, Exalted is He, has departed from the religion of Allah, Blessed and Exalted is He." ʿAllaq b. Abi Muslim was alone in narrating it, and all the narrators up to him are trustworthy. End of the Book of Commandments. ʿAllaq was alone in narrating it, and the narrators up to him are trustworthy.

بَعَثَ النَّبِيُّ ﷺ إِلَى الْيَمَنِ عَلِيًّا فَقَالَ «عَلِّمْهُمُ الشَّرَائِعَ وَاقْضِ بَيْنَهُمْ» قَالَ لَا عِلْمَ لِي بِالْقَضَاءِ فَدَفَعَ فِي صَدْرِهِ فَقَالَ «اللَّهُمَّ اهْدِهِ لِلْقضَاءِ»
✧ The Prophet ﷺ sent 'Ali to Yemen and said, "Teach them the sacred laws and judge between them." He said, "I have no knowledge of judging." So he struck his chest and said, "O Allah, guide him for judging."

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فَقَالَ لِعَمْرٍو «اقْضِ بَيْنَهُمَا» فَقَالَ أَقْضِي بَيْنَهُمَا وَأَنْتَ حَاضِرٌ يَا رَسُولَ اللَّهِ؟ قَالَ «نَعَمْ عَلَى أَنَّكَ إِنْ أَصَبْتَ فَلَكَ عَشْرُ أُجُورٍ وَإِنِ اجْتَهَدْتَ فَأَخْطَأْتَ فَلَكَ أَجْرٌ»
✧ Two men brought a dispute to the Prophet ﷺ, and he said to 'Amr, "Judge between them." He said, "Shall I judge between them while you are present, O Messenger of Allah?" He said, "Yes. If you judge correctly, you will have ten rewards; and if you exercise judgment and err, you will have one reward."

أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ فِي خُطْبَتِهِ أَصْحَابُ الْجَنَّةِ ثَلَاثَةٌ ذُو سُلْطَانٍ مُصَدَّقٌ وَمُقْسِطٌ مُوَفَّقٌ وَرَجُلٌ رَحِيمٌ رَقِيقُ الْقَلْبِ بِكُلِّ ذِي قُرْبَى وَرَجُلٌ فَقِيرٌ عَفِيفٌ
✧ He heard the Prophet ﷺ say in his sermon: "The people of Paradise are three: a ruler who is truthful, just, and divinely guided; a man who is merciful and tender-hearted toward every relative; and a poor man who is chaste."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «إِنَّ الْمُقْسِطِينَ فِي الدُّنْيَا عَلَى مَنَابِرَ مِنْ لُؤْلُؤٍ يَوْمَ الْقِيَامَةِ بَيْنَ يَدَيِ الرَّحْمَنِ ﷻ بِمَا أَقْسَطُوا فِي الدُّنْيَا»
✧ The Messenger of Allah ﷺ said: "Indeed, those who are just in this world will be upon pulpits of pearl on the Day of Resurrection, before the Most Merciful ﷻ, because of their justice in this world."

✧ "O people, Allah does not accept the prayer of an imam who rules by other than what Allah has revealed."

«مَا مِنْ أَحَدٍ يُؤَمَّرُ عَلَى عَشَرَةٍ فَصَاعِدًا لَا يُقْسِطُ فِيهِمْ إِلَّا جَاءَ يَوْمَ الْقِيَامَةِ فِي الْأَصْفَادِ وَالْأَغْلَالِ»
✧ "There is no one who is put in charge of ten or more and does not act justly among them, except that he will come on the Day of Resurrection in shackles and chains."

أَنَّ نَاسًا سَأَلُوا أُسَامَةَ بْنَ زَيْدٍ أَنْ يُكَلِّمَ لَنَا هَذَا الرَّجُلَ يَعْنِي عُثْمَانَ بْنَ عَفَّانَ قَالَ قَدْ كَلَّمْنَاهُ مَا دُونَ أَنْ يَفْتَحَ بَابًا أَنْ لَا يَكُونَ أَوَّلَ مَنْ فَتَحَهُ مَا أَقُولُ أُمَرَاؤُكُمْ خِيَارُكُمْ بَعْدَ شَيْءٍ سَمِعْتُهُ مِنْ رَسُولِ اللَّهِ ﷺ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ يُؤْتَى بِالْوَالِي الَّذِي كَانَ يُطَاعُ فِي مَعْصِيَةِ اللَّهِ ﷻ فَيُؤْمَرُ بِهِ إِلَى النَّارِ فَيُقْذَفُ فِيهَا فَتَنْدَلِقُ بِهِ أَقْتَابُهُ يَعْنِي أَمْعَاءَهُ فَيَسْتَدِيرُ فِيهَا كَمَا يَسْتَدِيرُ الْحِمَارُ فِي الرَّحَا فَيَأْتِي عَلَيْهِ أَهْلُ طَاعَتِهِ مِنَ النَّاسِ فَيَقُولُونَ لَهُ أَيْ فُلْ أَيْنَ مَا كُنْتَ تَأْمُرُنَا؟ فَيَقُولُ كُنْتُ آمُرُكُمْ بِأَمْرٍ وَأُخَالِفُكُمْ إِلَى غَيْرِهِ
✧ Some people asked Usama b. Zayd to speak to this man—meaning Uthman b. Affan—for us. He said: "We have spoken to him, short of opening a door, lest he be the first to open it. I do not say your rulers are your best after something I heard from the Messenger of Allah ﷺ. I heard the Messenger of Allah ﷺ say: The governor who was obeyed in disobedience to Allah ﷻ will be brought and ordered to the Fire, and he will be cast into it, and his intestines will spill out, and he will go round in it as a donkey goes round a mill. Then the people who obeyed him will come to him and say: 'O so-and-so, where is what you used to command us?' He will say: 'I used to command you to one thing and contradict you to another.'"

سِتَّةٌ لَعَنْتُهُمْ لَعَنَهُمُ اللَّهُ وَكُلُّ نَبِيٍّ مُجَابٌ الْمُكَذِّبُ بِقَدَرِ اللَّهِ وَالزَّائِدُ فِي كِتَابِ اللَّهِ وَالْمُتَسَلِّطُ بِالْجَبَرُوتِ لِيُذِلَّ مَا أَعَزَّ اللَّهُ وَيُعِزَّ مَا أَذَلَّ اللَّهُ وَالْمُسْتَحِلُّ لِحَرَمِ اللَّهِ وَالْمُسْتَحِلُّ مِنْ عِتْرَتِي مَا حَرَّمَ اللَّهُ وَالتَّارِكُ لِسُنَّتِي
✧ Six whom I have cursed, and Allah has cursed them, and every prophet whose supplication is answered: the one who denies the decree of Allah, the one who adds to the Book of Allah, the one who dominates by tyranny to humiliate whom Allah has honored and honor whom Allah has humiliated, the one who makes lawful what Allah has forbidden, the one who makes lawful from my offspring what Allah has forbidden, and the one who abandons my Sunnah.

الْقُضَاةُ ثَلَاثَةٌ قَاضِيَانِ فِي النَّارِ وَقَاضٍ فِي الْجَنَّةِ قَاضٍ عَرَفَ الْحَقَّ فَقَضَى بِهِ فَهُوَ فِي الْجَنَّةِ وَقَاضٍ عَرَفَ الْحَقَّ فَجَارَ مُتَعَمِّدًا فَهُوَ فِي النَّارِ وَقَاضٍ قَضَى بِغَيْرِ عِلْمٍ فَهُوَ فِي النَّارِ
✧ Judges are of three types: two judges are in the Fire and one judge is in Paradise. A judge who knew the truth and ruled by it is in Paradise. A judge who knew the truth but ruled unjustly deliberately is in the Fire. And a judge who ruled without knowledge is in the Fire.

«قَاضِيَانِ فِي النَّارِ وَقَاضٍ فِي الْجَنَّةِ قَاضٍ قَضَى بِالْحَقِّ فَهُوَ فِي الْجَنَّةِ وَقَاضٍ قَضَى بِجَوْرٍ فَهُوَ فِي النَّارِ وَقَاضٍ قَضَى بِجَهْلِهِ فَهُوَ فِي النَّارِ» قَالُوا فَمَا ذَنْبُ هَذَا الَّذِي يَجْهَلُ قَالَ «ذَنْبُهُ أَنْ لَا يَكُونَ قَاضِيًا حَتَّى يَعْلَمَ»
✧ "Two judges are in the Fire and one judge is in Paradise: a judge who ruled with the truth is in Paradise, a judge who ruled with injustice is in the Fire, and a judge who ruled out of ignorance is in the Fire." They said: "What is the sin of this one who is ignorant?" He said: "His sin is that he should not be a judge until he knows."

«مَا مِنْ أَحَدٍ يَكُونُ عَلَى شَيْءٍ مِنْ أُمُورِ هَذِهِ الْأُمَّةِ قَلَّتْ أَمْ كَثُرَتْ فَلَا يَعْدِلُ فِيهِمْ إِلَّا كَبَّهُ اللَّهُ فِي النَّارِ»
✧ "There is no one who is in charge of any of the affairs of this nation, whether small or great, and does not act justly among them, except that Allah will cast him into the Fire."

أَنَّ الضَّحَّاكَ بْنَ قَيْسٍ بَعَثَ مَعَهُ بِكِسْوَةٍ إِلَى مَرْوَانَ بْنِ الْحَكَمِ فَقَالَ مَرْوَانُ لِلْبَوَّابِ انْظُرْ مَنْ بِالْبَابِ؟ قَالَ أَبُو هُرَيْرَةَ فَأَذِنَ لَهُ فَقَالَ يَا أَبَا هُرَيْرَةَ
✧ Al-Dahhak b. Qays sent with him a garment to Marwan b. al-Hakam. Marwan said to the doorkeeper: "See who is at the door?" He said: "Abu Hurayrah." So he gave him permission, and he said: "O Abu Hurayrah..."

«وَيْلٌ لِلْأُمَرَاءِ وَوَيْلٌ لِلْعُرَفَاءِ وَوَيْلٌ لِلْأُمَنَاءِ لَيَتَمَنَّيَنَّ أَقْوَامٌ يَوْمَ الْقِيَامَةِ أَنَّ ذَوَائِبَهُمْ كَانَتْ مُعَلَّقَةً بِالثُّرَيَّا يُدَلْدَلُونَ بَيْنَ السَّمَاءِ وَالْأَرْضِ وَأَنَّهُمْ لَمْ يَلُوا عَمَلًا»
✧ "Woe to the rulers, woe to the chiefs, and woe to the trustees. On the Day of Resurrection, some people will wish that their forelocks were hung from the Pleiades, dangling between heaven and earth, and that they had never taken on any responsibility."

«يَا أَبَا ذَرٍّ إِنِّي أَرَاكَ ضَعِيفًا فَلَا تُأَمَّرَنَّ عَلَى اثْنَيْنِ وَلَا تُوَلَّيَنَّ مَالَ يَتِيمٍ»
✧ "O Abu Dharr, I see that you are weak, so do not be put in charge of even two people, and do not take charge of the property of an orphan."

«مَنْ جُعِلَ قَاضِيًا فَكَأَنَّمَا ذُبِحَ بِغَيْرِ سِكِّينٍ»
✧ "Whoever is appointed a judge, it is as if he has been slaughtered without a knife."

لِرَسُولِ اللَّهِ ﷺ أَمِّرْنِي فَقَالَ «إِنَّكَ ضَعِيفٌ وَإِنَّهَا أَمَانَةٌ وَإِنَّهَا يَوْمَ الْقِيَامَةِ خِزْيٌ وَنَدَامَةٌ»
✧ He said to the Messenger of Allah ﷺ: "Appoint me as a commander." He said: "You are weak, and it is a trust, and on the Day of Resurrection it will be disgrace and regret."

قُلْتُ يَا رَسُولَ اللَّهِ أَمِّرْنِي قَالَ «الْإِمَارَةُ أَمَانَةٌ وَهِيَ يَوْمَ الْقِيَامَةِ خِزْيٌ وَنَدَامَةٌ إِلَّا مَنْ أَمَرَ بِحَقٍّ وَأَدَّى بِالْحَقِّ عَلَيْهِ فِيهَا»
✧ I said: "O Messenger of Allah, appoint me as a commander." He said: "Authority is a trust, and on the Day of Resurrection it will be disgrace and regret, except for one who commands with truth and fulfills the truth incumbent upon him therein."

سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «مَنْ طَلَبَ الْقَضَاءَ وَاسْتَعَانَ عَلَيْهِ وُكِلَ إِلَيْهِ وَمَنْ لَمْ يَطْلُبْهُ وَلَمْ يَسْتَعِنْ عَلَيْهِ وُكِّلَ بِهِ مَلَكٌ يُسَدِّدُهُ»
✧ I heard the Prophet ﷺ say: "Whoever seeks judgment and seeks help for it will be left to it, and whoever does not seek it and does not seek help for it, an angel will be assigned to him to guide him aright."

«لَتُنْتَقَضُ عُرَى الْإِسْلَامِ عُرْوَةٌ عُرْوَةٌ فَكُلَّمَا انْتَقَضَتْ عُرْوَةٌ تَشَبَّثَتْ بِالَّتِي تَلِيهَا وَأَوَّلُ نَقْضِهَا الْحُكْمُ وَآخِرُهَا الصَّلَاةُ»
✧ "The bonds of Islam will be undone one by one. Whenever a bond is undone, the people will cling to the one that follows it. The first of them to be undone is judgment, and the last is prayer."

«مَنِ اسْتَعْمَلَ رَجُلًا مِنْ عِصَابَةٍ وَفِي تِلْكَ الْعِصَابَةِ مَنْ هُوَ أَرْضَى لِلَّهِ مِنْهُ فَقَدْ خَانَ اللَّهَ وخانَ رَسُولَهُ وخانَ الْمُؤْمِنِينَ»
✧ "Whoever appoints a man from a group while there is in that group one more pleasing to Allah than him, he has betrayed Allah, betrayed His Messenger, and betrayed the believers."

قَالَ لِي أَبُو بَكْرٍ الصِّدِّيقُ حِينَ بَعَثَنِي إِلَى الشَّامِ يَا يَزِيدُ إِنَّ لَكَ قَرَابَةً عَسَيْتَ أَنْ تُؤْثِرَهُمْ بِالْإِمَارَةِ ذَلِكَ أَكْثَرُ مَا أَخَافُ عَلَيْكَ فَقَدْ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ وَلِيَ مِنْ أَمْرِ الْمُسْلِمِينَ شَيْئًا فَأَمَّرَ عَلَيْهِمْ أَحَدًا مُحَابَاةً فَعَلَيْهِ لَعْنَةُ اللَّهِ لَا يَقْبَلُ اللَّهُ مِنْهُ صَرْفًا وَلَا عَدْلًا حَتَّى يُدْخِلَهُ جَهَنَّمَ»
✧ Abu Bakr al-Siddiq said to me when he sent me to Syria: "O Yazid, you have relatives; perhaps you will favor them with authority. That is what I fear most for you. The Messenger of Allah ﷺ said: 'Whoever is given any authority over the affairs of the Muslims and appoints over them anyone as a favor, upon him is the curse of Allah. Allah will not accept from him any obligatory or supererogatory deed until He admits him into Hell.'"

بَعَثَنِي رَسُولُ اللَّهِ ﷺ إِلَى الْيَمَنِ فَقُلْتُ تَبْعَثُنِي إِلَى قَوْمٍ ذَوِي أَسْنَانٍ وَأَنَا حَدَثُ السِّنِّ قَالَ «إِذَا جَلَسَ إِلَيْكَ الْخَصْمَانِ فَلَا تَقْضِ لِأَحَدِهِمَا حَتَّى تَسْمَعَ مِنَ الْآخَرِ كَمَا سَمِعْتَ مِنَ الْأَوَّلِ» قَالَ عَلِيٌّ فَمَا زِلْتُ قَاضِيًا
✧ The Messenger of Allah ﷺ sent me to Yemen. I said: "You are sending me to a people of mature age while I am young." He said: "When the two litigants sit before you, do not judge for one of them until you hear from the other as you heard from the first." Ali said: "I have continued to be a judge ever since."

قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ مَعَ الْقَاضِي مَا لَمْ يَجُرْ فَإِذَا جَارَ تَبَرَّأَ اللَّهُ ﷻ مِنْهُ» أَبُو الْعَوَّامِ هَذَا عِمْرَانُ بْنُ دَاودَ الْقَطَّانُ وَالْإِسْنَادُ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ صحيح
✧ The Messenger of Allah ﷺ said: "Allah is with the judge as long as he does not act unjustly. If he acts unjustly, Allah disavows him." Abu al-'Awwam is 'Imran b. Dawud al-Qattan, and the chain is authentic, though they did not include it. Sahih.

عَنْ أَبِي مَرْيَمَ صَاحِبِ رَسُولِ اللَّهِ ﷺ قَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ وَلِيَ مِنْ أَمْرِ الْمُسْلِمِينَ شَيْئًا فَاحْتَجَبَ دُونَ خَلَّتِهِمْ وَحَاجَتِهِمْ وَفَقْرِهِمْ وَفَاقَتِهِمْ احْتَجَبَ اللَّهُ ﷻ يَوْمَ الْقِيَامَةِ دُونَ خَلَّتِهِ وَفَاقَتِهِ وَحَاجَتِهِ وَفَقْرِهِ»
✧ From Abu Maryam, the companion of the Messenger of Allah ﷺ, he said: I heard the Messenger of Allah ﷺ say: "Whoever is given any authority over the affairs of the Muslims and then veils himself from their need, their want, their poverty, and their destitution, Allah will veil Himself from his need, his destitution, his want, and his poverty on the Day of Resurrection."

«مَنْ أَغْلَقَ بَابَهُ دُونَ ذَوِي الْحَاجَةِ وَالْخَلَّةِ وَالْمَسْكَنَةِ أَغْلَقَ اللَّهُ بَابَ السَّمَاءِ دُونَ خَلَّتِهِ وَحَاجَتِهِ وَفَقْرِهِ وَمَسْكَنَتِهِ»
✧ "Whoever shuts his door against the needy, the destitute, and the poor, Allah will shut the gate of heaven against his need, his want, his poverty, and his destitution."

أَنَّ أَبَاهُ عَبْدَ اللَّهِ بْنَ الزُّبَيْرِ كَانَتْ بَيْنَهُ وَبَيْنَ أَخِيهِ عَمْرِو بْنِ الزُّبَيْرِ خُصُومَةٌ فَدَخَلَ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ عَلَى سَعِيدِ بْنِ الْعَاصِ وَعَمْرُو بْنُ الزُّبَيْرِ مَعَهُ عَلَى السَّرِيرِ فَقَالَ سَعِيدٌ لِعَبْدِ اللَّهِ هَاهُنَا قَالَ لَا قَضَاءُ رَسُولِ اللَّهِ وَسُنَّةُ رَسُولِ اللَّهِ ﷺ أَنَّ الْخَصْمَيْنِ يَقْعُدَانِ بَيْنَ يَدَيِ الْحَاكِمِ
✧ His father 'Abd Allah b. al-Zubayr had a dispute with his brother 'Amr b. al-Zubayr. 'Abd Allah b. al-Zubayr entered upon Sa'id b. al-'As while 'Amr b. al-Zubayr was with him on the couch. Sa'id said to 'Abd Allah: "Here." He said: "No. The judgment of the Messenger of Allah and the Sunnah of the Messenger of Allah ﷺ is that the two litigants sit before the judge."

«مَنْ عُرِضَ لَهُ قَضَاءٌ فَلْيَقْضِ بِمَا فِي كِتَابِ اللَّهِ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ ﷻ فَلْيَقْضِ بِمَا قَضَى بِهِ النَّبِيُّ ﷺ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ ﷻ وَلَمْ يَقْضِ بِهِ نَبِيُّهُ ﷺ فَلْيَقْضِ بِمَا قَالَهُ الصَّالِحُونَ فَإِنْ جَاءَهُ أَمْرٌ لَيْسَ فِي كِتَابِ اللَّهِ وَلَمْ يَقْضِ بِهِ نَبِيُّهُ ﷺ وَلَمْ يَقْضِ بِهِ الصَّالِحُونَ فَلْيَجْتَهِدْ رَأْيَهُ فَإِنْ لَمْ يُحْسِنْ فَلْيُقِرَّ وَلَا يَسْتَحِي»
✧ Whoever is presented with a judicial matter should judge by what is in the Book of Allah. If a matter comes to him that is not in the Book of Allah, then let him judge by what the Prophet ﷺ ruled. If a matter comes to him that is not in the Book of Allah and His Prophet ﷺ did not rule on it, then let him judge by what the righteous have said. If a matter comes to him that is not in the Book of Allah, and His Prophet ﷺ did not rule on it, and the righteous did not rule on it, then let him exercise his own judgment; and if he is not able, let him acknowledge and not be ashamed.

«أَنَّ رَجُلَيْنِ ادَّعَيَا بَعِيرًا أَوْ دَابَّةً إِلَى النَّبِيِّ ﷺ وَلَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَجَعَلَهُ النَّبِيُّ ﷺ بَيْنَهُمَا»
✧ Two men brought a dispute over a camel or a riding animal to the Prophet ﷺ, and neither of them had any proof, so the Prophet ﷺ divided it between them.
al-Mustadrak (al-Hakim) 7032Sahih
«أَنَّ رَجُلَيْنِ ادَّعَيَا بَعِيرًا فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا شَاهِدَيْنِ فَقَسَمَهُ النَّبِيُّ ﷺ بَيْنَهُمَا» وَهَذَا الْحَدِيثُ أَيْضًا صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم
✧ Two men claimed a camel, and each of them produced two witnesses, so the Prophet ﷺ divided it between them. This hadith is also authentic according to the conditions of the two Shaykhs, but they did not include it on the condition of al-Bukhari and Muslim.

✧ Abu al-Muwajjih narrated to us, Abdan informed us, Abdullah informed us, Usamah b. Zayd informed me from the client of Umm Salamah, from Umm Salamah, who said: Two men came to the Prophet ﷺ disputing over an inheritance between them, and neither of them had any proof. The Prophet ﷺ ordered them to divide it and to seek what is right, then to cast lots, and then each of them should absolve the other. The chain is authentic, but they did not include it. The client of Umm Salamah is Ubaydullah b. Abi Rafi', who is cited in the two Sahihs. Authentic.

✧ I heard Umm Salamah say: I was with the Prophet ﷺ when two men came to him disputing over an inheritance between them, and neither of them had any proof. Each of them said to the other, 'O Messenger of Allah, this is my right that I sought from so-and-so.' He said, 'No, but go and seek what is right, then cast lots, then divide it, then let each of you absolve the other.'

أَنَّ رَجُلًا ادَّعَى عِنْدَ رَجُلٍ حَقًّا فَاخْتَصَمَا إِلَى النَّبِيِّ ﷺ فَسَأَلَهُ الْبَيِّنَةَ فَقَالَ مَا عِنْدِي بَيِّنَةٌ فَقَالَ لِلْآخَرِ احْلِفْ فَحَلَفَ فَقَالَ وَاللَّهِ مَا لَهُ عِنْدِي شَيْءٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «بَلْ هُوَ عِنْدَكَ ادْفَعْ إِلَيْهِ حَقَّهُ» ثُمَّ قَالَ لَهُ رَسُولُ اللَّهِ ﷺ «شَهَادَتُكَ بِأَنْ لَا إِلَهَ إِلَّا اللَّهُ كَفَّارَةٌ لِيَمِينِكَ»
✧ A man claimed a right against another man, and they brought their dispute to the Prophet ﷺ. He asked the claimant for proof, and he said, 'I have no proof.' He said to the other, 'Swear,' and he swore, saying, 'By Allah, he has nothing with me.' The Messenger of Allah ﷺ said, 'Rather, it is with you. Give him his right.' Then the Messenger of Allah ﷺ said to him, 'Your testimony that there is no god but Allah is an expiation for your oath.'

«إِذَا رَأَيْتُ أُمَّتِي تَهَابُ فَلَا تَقُولُ لِلظَّالِمِ يَا ظَالِمُ فَقَدْ تُودِّعَ مِنْهُمْ»
✧ If you see my community fearing the oppressor and not saying to the oppressor, 'O oppressor,' then they have been given leave.

أَنَّ عَلِيًّا بَعَثَهُ النَّبِيُّ ﷺ إِلَى الْيَمَنِ فَارْتَفَعَ إِلَيْهِ ثَلَاثَةً يَتَنَازَعُونَ وَلَدًا كُلُّ وَاحِدٍ يَزْعُمُ أَنَّهُ ابْنُهُ قَالَ فَخَلَا بِاثْنَيْنِ فَقَالَ «أَتَطِيبَانِ نَفْسًا لِهَذَا الْبَاقِي؟» قَالَا لَا وَخَلَا بِاثْنَيْنِ فَقَالَ لَهُمَا مِثْلَ ذَلِكَ فَقَالَا لَا فَقَالَ «أَرَاكُمْ شُرَكَاءَ مُتَشَاكِسُونَ وَأَنَا مُقْرِعٌ بَيْنَكُمْ فَأَقْرَعَ بَيْنَهُمْ فَجَعَلَهُ لِأَحَدِهِمْ وَأَغْرَمَهُ ثُلُثَيِ الدِّيَةِ لِلْبَاقِينَ» قَالَ «فَذَكَرَ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ» قَدْ أَعْرَضَ الشَّيْخَانِ عَنِ الْأَجْلَحِ بْنِ عَبْدِ اللَّهِ الْكِنْدِيِّ وَلَيْسَ فِي رِوَايَاتِهِ بِالْمَتْرُوكِ فَإِنَّ الَّذِي يُنْقَمُ عَلَيْهِ بِهِ مَذْهَبُهُ الأجلح ليس بالمتروك
✧ Ali was sent by the Prophet ﷺ to Yemen, and three men disputing over a child were brought to him, each claiming that he was his son. He said: He took two of them aside and said, 'Are you both willing to give him up to this remaining one?' They said, 'No.' He took two of them aside and said the same to them, and they said, 'No.' Then he said, 'I see you are quarrelsome partners, and I will cast lots among you.' So he cast lots among them and assigned the child to one of them and made him pay two-thirds of the blood money to the remaining two. He said: He mentioned that to the Messenger of Allah ﷺ, and he laughed until his molars showed. The two Shaykhs turned away from al-Ajlah b. Abdullah al-Kindi, but his narrations are not rejected; what is criticized about him is his doctrine. Al-Ajlah is not rejected.

كَانَتْ جَارِيَةٌ لِزَمْعَةَ يَطَؤُهَا وَكَانَتْ تَظُنُّ بِرَجُلٍ آخَرَ أَنَّهُ كَانَ يَقَعُ عَلَيْهَا فَمَاتَ زَمْعَةُ وَهِيَ حَامِلٌ فَوَلَدَتْ غُلَامًا يُشْبِهُ الرَّجُلَ الَّذِي كَانَ يُظَنُّ بِهِ فَذَكَرَتْ سَوْدَةُ لِلنَّبِيِّ ﷺ فَقَالَ «أَمَّا الْمِيرَاثُ فَلَهُ وَأَمَّا أَنْتِ فَاحْتَجِبِي مِنْهُ فَإِنَّهُ لَيْسَ لَكَ بِأَخٍ»
✧ There was a slave girl belonging to Zam'ah whom he used to have intercourse with, and she suspected another man of also having intercourse with her. Zam'ah died while she was pregnant, and she gave birth to a boy who resembled the man she had suspected. Sawdah mentioned this to the Prophet ﷺ, and he said: 'As for the inheritance, it belongs to him. As for you, veil yourself from him, for he is not a brother to you.'

بَيْنَا أَنَا جَالِسٌ عِنْدَ أَبِي هُرَيْرَةَ جَاءَتْهُ امْرَأَةٌ فَارِسِيَّةٌ مَعَهَا ابْنٌ لَهَا وَقَدْ طَلَّقَهَا زَوْجُهَا فَقَالَتْ يَا أَبَا هُرَيْرَةَ ثُمَّ رَطَنَتْ فَقَالَتْ بِالْفَارِسِيَّةِ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِابْنِي قَالَ فَجَاءَ زَوْجُهَا فَقَالَ مَنْ يُجَافِنِي؟ فَقَالَ أَبُو هُرَيْرَةَ إِنِّي لَا أَقُولُ فِي هَذَا إِلَّا أَنِّي سَمِعْتُ أَنَّ امْرَأَةً جَاءَتْ إِلَى رَسُولِ اللَّهِ ﷺ وَأَنَا عِنْدَهُ فَقَالَتْ فِدَاكَ أَبِي وَأُمِّي إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِابْنِي وَهُوَ يَسْقِيَنِي مِنْ بِئْرِ أَبِي عُتْبَةَ وَقَدْ نَفَعَنِي فَقَالَ «اسْتَهِمَا عَلَيْهِ» فَقَالَ زَوْجُهَا مَنْ يُجَافِنِي فِي وَلَدِي يَا رَسُولَ اللَّهِ فَقَالَ النَّبِيُّ ﷺ «يَا غُلَامُ هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ فَخُذْ بِيَدِ أَيِّهِمَا شِئْتَ» فَأَخَذَ الْغُلَامُ بِيَدِ أُمِّهِ فَانْطَلَقَتْ بِهِ
✧ While I was sitting with Abu Hurayrah, a Persian woman came to him with her son, and her husband had divorced her. She said, 'O Abu Hurayrah,' then she spoke in Persian, saying, 'My husband wants to take my son away.' Her husband then came and said, 'Who will dispute with me?' Abu Hurayrah said, 'I will not say anything about this except that I heard that a woman came to the Messenger of Allah ﷺ while I was with him, and she said, 'May my father and mother be your ransom, my husband wants to take my son away, and he has been giving me water from the well of Abu Utbah, and he has benefited me.' He said, 'Cast lots for him.' Her husband said, 'Who will dispute with me over my son, O Messenger of Allah?' The Prophet ﷺ said, 'O boy, this is your father and this is your mother, so take the hand of whichever of them you wish.' The boy took his mother's hand, and she went away with him.

«قَضَى رَسُولُ اللَّهِ ﷺ فِي النَّخْلَةِ وَالنَّخْلَتَيْنِ وَالثَّلَاثِ فَيَخْتَلِفُونَ فِي حُقُوقِ ذَلِكَ فَقَضَى أَنَّ لِكُلِّ نَخْلَةٍ مُبْلَغَ جَرِيدِهَا حَرِيمًا»
✧ The Messenger of Allah ﷺ ruled regarding a single palm tree, two palm trees, and three, when they dispute over the rights of that: he ruled that for every palm tree, the extent of its fronds is a protected zone.

«إِنَّ بَيْنَ يَدَيِ السَّاعَةِ تَسْلِيمَ الْخَاصَّةِ وَفُشُوَّ التِّجَارَةِ حَتَّى تُعِينَ الْمَرْأَةُ زَوْجَهَا عَلَى التِّجَارَةِ وَقَطْعَ الْأَرْحَامِ وَظُهُورَ شَهَادَةِ الزُّورِ وَكِتْمَانَ شَهَادَةِ الْحَقِّ»
✧ Indeed, before the Hour there will be the greeting of the elite, the spread of trade until a woman helps her husband in trade, the severing of kinship ties, the appearance of false testimony, and the concealment of true testimony.

«مَا كَانَ شَيْءٌ أَبْغَضَ إِلَى رَسُولِ اللَّهِ ﷺ مِنَ الْكَذِبِ وَمَا جَرَّبَهُ رَسُولُ اللَّهِ ﷺ مِنْ أَحَدٍ وَإِنْ قَلَّ فَيُخْرِجَ لَهُ مِنْ نَفْسِهِ حَتَّى يُجَدِّدَ لَهُ تَوْبَةُ»
✧ Nothing was more hateful to the Messenger of Allah ﷺ than lying, and the Messenger of Allah ﷺ never tested anyone, even a little, without bringing out from himself [a reaction] until he renewed repentance for him.

✧ A man was mentioned in the presence of the Messenger of Allah ﷺ who would give testimony, so he said to me: “O Ibn Abbas, do not testify except to what is as clear to you as the brightness of this sun,” and the Messenger of Allah ﷺ pointed with his hand to the sun.

✧ Leave what causes you doubt for what does not cause you doubt, for truthfulness is tranquility and lying is doubt.

✧ Allah ﷻ [says]: {from those whom you approve as witnesses} [al-Baqarah 282]. He said: “Children are not among those who are approved.”

«الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ إِلَّا صُلْحًا حَرَّمَ حَلَالًا أَوِ أَحَلَّ حَرَامًا وَإِنَّ الْمُسْلِمِينَ عَلَى شُرُوطِهِمْ إِلَّا شَرْطًا حَرَّمَ حَلَالًا»
✧ Settlement is permissible among the Muslims, except a settlement that makes unlawful something lawful or makes lawful something unlawful. And the Muslims are bound by their conditions, except a condition that makes unlawful something lawful.

«أَنَّ رَسُولَ اللَّهِ ﷺ حَجَرَ عَلَى مُعَاذٍ مَالَهُ وَبَاعَهُ بِدَيْنٍ كَانَ عَلَيْهِ» صحيح
✧ The Messenger of Allah ﷺ placed a restriction on Muʿādh's property and sold it to pay off a debt he owed. Authentic.

أَنَّ رَجُلًا كَانَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ يَبْتَاعُ وَكَانَ فِي عُقْدَتِهِ ضَعْفٌ فَأَتَى أَهْلُهُ رَسُولَ اللَّهِ ﷺ فَقَالُوا يَا نَبِيَّ اللَّهِ احْجُرْ عَلَى فُلَانٍ فَإِنَّهُ يَبْتَاعُ وَفِي عُقْدَتِهِ ضَعْفٌ فَدَعَاهُ نَبِيُّ اللَّهِ ﷺ فَنَهَاهُ عَنِ الْبَيْعِ قَالَ يَا نَبِيَّ اللَّهِ إِنِّي لَا أَصْبِرُ عَنِ الْبَيْعِ فَقَالَ «إِنْ كُنْتَ غَيْرَ تَارِكٍ الْبَيْعَ فَقُلْ هَا وَلَا خِلَابَةَ» وَ
During the time of the Messenger of Allah ﷺ a man used to buy (goods), and he was weak in his intellect. His people came to the Prophet of Allah ﷺ and said: Prophet of Allah, stop so-and-so (to make a bargain) for he buys (goods), but he is weak in his intellect. So the Prophet ﷺ called on him and forbade him to make a bargain. He said: Prophet of Allah, I cannot keep away myself from business transactions. Thereupon the Messenger of Allah ﷺ said: If you cannot give up making a bargain, then say: Take, and give, and there is no attempt to deceive. (Using translation from Abū Dāʾūd 3501)

لِي سَمَّانِي رَسُولُ اللَّهِ ﷺ وَلَمْ أَكُنْ لِأَدَعَ ذَلِكَ أَبَدًا فَقُلْتُ لِمَ سَمَّاكَ؟ قَالَ قَدِمَ رَجُلٌ مِنْ أَهْلِ الْبَادِيَةِ بِبَعِيرَيْنِ فَابْتَعْتُهُمَا مِنْهُ ثُمَّ دَخَلْتُ بَيْتِي وَخَرَجْتُ مِنْ خَلْفٍ فَبِعْتُهُمَا فَقَضَيْتُ بِهِمَا حَاجَتِي وَغِبْتُ حَتَّى ظَنَنْتُ أَنَّ الْعِرَاقِيَّ قَدْ خَرَجَ فَإِذَا الْعِرَاقِيُّ مُقِيمٌ فَأَخَذَنِي فَذَهَبَ بِي إِلَى رَسُولِ اللَّهِ ﷺ وَأَخْبَرَهُ الْخَبَرَ فَقَالَ «مَا حَمَلَكَ عَلَى مَا صَنَعْتَ؟» قُلْتُ قَضَيْتُ بِثَمَنِهِمَا حَاجَتِي يَا رَسُولَ اللَّهِ قَالَ «اقْضِهِ» قُلْتُ لَيْسَ عِنْدِي قَالَ «أَنْتَ سَرَقٌ اذْهَبْ يَا عِرَاقِيُّ فَبِعْهُ حَتَّى تَسْتَوْفِيَ حَقَّكَ» قَالَ فَجَعَلَ النَّاسُ يَسُومُونَهُ بِي وَيَلْتَفِتُ إِلَيْهِمْ فَيَقُولُ مَاذَا تُرِيدُونَ؟ فَيَقُولُونَ نُرِيدُ أَنْ نَفْدِيَهُ مِنْكَ فَقَالَ وَاللَّهِ إِنِّي مِنْكُمْ أَحَقُّ وَأَحْوَجُ إِلَى اللَّهِ ﷻ اذْهَبْ فَقَدْ أَعْتَقْتُكَ
✧ He named me, and I would never give that up. I said, "Why did he name you that?" He said, "A man from the desert came with two camels, and I bought them from him. Then I entered my house and went out from the back and sold them, and with their price I fulfilled my need. I stayed away until I thought the Iraqi had left, but the Iraqi was still there. He seized me and took me to the Messenger of Allah ﷺ and told him the story. He said, 'What led you to do what you did?' I said, 'I satisfied my need with their price, O Messenger of Allah.' He said, 'Pay it.' I said, 'I do not have it.' He said, 'You are a thief. Go, O Iraqi, and sell him until you recover your right.'" He said, "People began to bargain with him for me, and he turned to them and said, 'What do you want?' They said, 'We want to ransom him from you.' He said, 'By Allah, I am more entitled to him than you and more in need of Allah, the Exalted. Go, for I have freed you.'"

✧ The Prophet ﷺ detained a man on suspicion.

«أَنَّ النَّبِيَّ ﷺ حَبَسَ رَجُلًا فِي تُهْمَةٍ يَوْمًا وَلَيْلَةً اسْتِظْهَارًا وَاحْتِيَاطًا» إبراهيم بن خثيم متروك
✧ The Prophet ﷺ detained a man on suspicion for a day and a night as a precaution and out of caution. Ibrāhīm b. Khaytham is abandoned.

✧ Delay in payment by a wealthy person makes his honor and punishment lawful.

✧ The Messenger of Allah ﷺ cursed the briber and the bribed.
