42. Cutting off the Hands of a Thief

    عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ وَهُوَ مُؤْمِنٌ»

    ✧ The Messenger of Allah ﷺ said: The fornicator does not fornicate while he is a believer, nor does the thief steal while he is a believer, nor does one drink wine while he is a believer, nor does one seize a plunder of great value while people raise their eyes to him in it while he is a believer.

    ✧ The Messenger of Allah ﷺ said—and Muhammad said: from the Prophet ﷺ—: The fornicator does not fornicate while he is a believer, nor does the thief steal while he is a believer, nor does one drink wine while he is a believer. Then repentance is offered afterwards.

    «لَا يَزْنِي الزَّانِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ وَهُوَ مُؤْمِنٌ وَذَكَرَ رَابِعَةً فَنَسِيتُهَا فَإِذَا فَعَلَ ذَلِكَ خَلَعَ رِبْقَةَ الْإِسْلَامِ مِنْ عُنُقِهِ فَإِنْ تَابَ تَابَ اللهُ عَلَيْهِ»

    ✧ The fornicator does not fornicate while he is a believer, nor does the thief steal while he is a believer, nor does one drink wine while he is a believer—and he mentioned a fourth but I forgot it. When he does that, he casts off the bond of Islam from his neck; if he repents, Allah will accept his repentance.

    قَالَ رَسُولُ اللهِ ﷺ «لَعَنَ اللهُ السَّارِقَ يَسْرِقُ الْبَيْضَةَ فَتُقْطَعَ يَدُهُ وَيَسْرِقُ الْحَبْلَ فَتُقْطَعَ يَدُهُ»

    Allah 's Apostle said, "Allah curses the thief who steals an egg (or a helmet) for which his hand is to be cut off, or steals a rope, for which his hand is to be cut off." (Using translation from Bukhārī 6799)

    النَّبِيُّ ﷺ «لَا تُسَبِّخِي عَنْهُ» أَرْسَلَهُ عَبْدُ الرَّحْمَنِ [7] 7319 أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ حَبِيبٍ عَنْ عَطَاءٍ مُرْسَلٌ

    ✧ The Prophet ﷺ: “Do not reduce it for him.” Abd al-Rahman sent it as mursal. 7319 Muhammad b. Bashshar informed us: Abd al-Rahman narrated to us: Sufyan narrated to us from Habib from Ata as mursal.

    أَنَّ حَاكَةً سَرَقُوا مَتَاعًا فَحَبَسَهُمْ أَيَّامًا ثُمَّ خَلَّى سَبِيلَهُمْ فَأَتَوْهُ فَقَالُوا خَلَّيْتَ سَبِيلَ هَؤُلَاءِ بِلَا امْتِحَانٍ وَلَا ضَرْبٍ فَقَالَ النُّعْمَانُ مَا شِئْتُمْ إِنْ شِئْتُمْ أَضْرِبُهُمْ فَإِنْ أَخْرَجَ اللهُ مَتَاعَكُمْ فَذَاكَ وَإِلَّا أَخَذْتُ مِنْ ظُهُورِكُمْ مِثْلَهُ قَالُوا هَذَا حُكْمُكَ؟ قَالَ هَذَا حُكْمُ اللهِ وَرَسُولِهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ مُنْكَرٌ لَا يُحْتَجُّ بِمِثْلِهِ وَإِنَّمَا أَخْرَجْتُهُ لِيُعْرَفَ

    ✧ Some weavers stole goods, so he imprisoned them for days and then released them. They came to him and said, "You released these people without examination or beating." Al-Nu'man said, "Whatever you wish. If you wish, I will beat them; if Allah brings out your goods, then that is that; otherwise I will take the like of it from your backs." They said, "Is this your ruling?" He said, "This is the ruling of Allah and His Messenger." Abu 'Abd al-Rahman said: This is a rejected hadith, the like of which is not to be used as evidence. I only cited it so that it may be known.

    أَنَّ النَّبِيَّ ﷺ حَبَسَ نَاسًا فِي تُهْمَةٍ أَخْبَرَنَا عَلِيُّ بْنُ سَعِيدِ بْنِ مَسْرُوقٍ قَالَ حَدَّثَنَا عَبْدُ اللهِ بْنُ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنْ بَهْزِ بْنِ حَكِيمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللهِ ﷺ «حَبَسَ رَجُلًا فِي تُهْمَةٍ ثُمَّ خَلَّى سَبِيلَهُ»

    ✧ The Prophet ﷺ imprisoned some people on suspicion. 'Ali b. Sa'id b. Masruq informed us, saying: 'Abd Allah b. al-Mubarak narrated to us from Ma'mar from Bahz b. Hakim from his father from his grandfather that the Messenger of Allah ﷺ "imprisoned a man on suspicion and then released him."

    أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِلِصٍّ اعْتَرَفَ اعْتِرَافًا وَلَمْ يُوجَدْ مَعَهُ مَتَاعٌ فَقَالَ رَسُولُ اللهِ ﷺ «مَا إِخَالُكَ سَرَقْتَ؟» قَالَ بَلَى قَالَ «اذْهَبُوا بِهِ فَاقْطَعُوهُ» ثُمَّ ذَهَبُوا بِهِ فَقَطَعُوهُ ثُمَّ جَاءُوا بِهِ فَقَالَ لَهُ «قُلْ أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ» قَالَ أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ قَالَ «اللهُمَّ تُبْ عَلَيْهِ»

    ✧ A thief was brought to the Messenger of Allah ﷺ; he confessed, but no goods were found with him. The Messenger of Allah ﷺ said, "I do not think you stole." He said, "Yes, I did." He said, "Take him and cut off his hand." They took him and cut off his hand, then brought him back. He said to him, "Say: I seek Allah's forgiveness and turn to Him in repentance." He said, "I seek Allah's forgiveness and turn to Him in repentance." He said, "O Allah, accept his repentance."

    أَنَّ رَجُلًا سَرَقَ بُرْدَةً لَهُ فَرَفَعَهُ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِقَطْعِهِ فَقَالَ يَا رَسُولَ اللهِ قَدْ تَجَاوَزْتُ عَنْهُ قَالَ أَبَا وَهْبٍ أَفَلَا كَانَ قَبْلَ أَنْ تَأْتِينَا بِهِ فَقَطَعَهُ رَسُولُ اللهِ ﷺ

    ✧ A man stole a cloak belonging to him, so he brought him to the Prophet ﷺ, who ordered his hand to be cut off. He said, "O Messenger of Allah, I have forgiven him." He said, "Abu Wahb, why was it not before you brought him to us?" So the Messenger of Allah ﷺ cut off his hand.

    أَنَّ رَجُلًا سَرَقَ بُرْدَةً فَرَفَعَهُ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِقَطْعِهِ قَالَ يَا رَسُولَ اللهِ قَدْ تَجَاوَزْتُ عَنْهُ قَالَ «فَلَوْلَا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ يَا أَبَا وَهْبٍ فَقَطَعَهُ رَسُولُ اللهِ ﷺ» خَالَفَهُ الْأَوْزَاعِيُّ فَأَرْسَلَ الْحَدِيثَ

    ✧ A man stole a cloak, so he brought him to the Prophet ﷺ, who ordered his hand to be cut off. He said, "O Messenger of Allah, I have forgiven him." He said, "Why was this not before you brought him to me, O Abu Wahb?" So the Messenger of Allah ﷺ cut off his hand. Al-Awza'i differed from him and transmitted the hadith in mursal form.

    أَنَّ رَجُلًا سَرَقَ ثَوْبًا فَأُتِيَ بِهِ رَسُولُ اللهِ ﷺ فَأَمَرَ بِقَطْعِهِ فَقَالَ الرَّجُلُ يَا رَسُولَ اللهِ هُوَ لَهُ قَالَ «فَهَلَّا قَبْلَ الْآنَ»

    ✧ A man stole a garment, so he was brought to the Messenger of Allah ﷺ, who ordered his hand to be cut off. The man said, "O Messenger of Allah, it is his." He said, "Why not before now?"

    أَنَّهُ طَافَ بِالْبَيْتِ فَصَلَّى ثُمَّ لَفَّ رِدَاءً لَهُ مِنْ بُرْدٍ فَوَضَعَهُ تَحْتَ رَأْسِهِ فَنَامَ فَأَتَاهُ لِصٌّ فَاسْتَلَّهُ مِنْ تَحْتِ رَأْسِهِ فَأَخَذَهُ فَأَتَى بِهِ النَّبِيَّ ﷺ فَقَالَ إِنَّ هَذَا سَرَقَ رِدَائِي فَقَالَ لَهُ النَّبِيُّ ﷺ «أَسَرَقْتَ رِدَاءَ هَذَا؟» قَالَ نَعَمْ قَالَ «اذْهَبَا بِهِ فَاقْطَعَا يَدَهُ» قَالَ صَفْوَانُ مَا كُنْتُ أُرِيدُ أَنْ تَقْطَعَ يَدَهُ فِي رِدَائِي فَقَالَ لَهُ فَلَوْ مَا كَانَ قَبْلَ هَذَا خَالَفَهُ أَشْعَثُ بْنُ سَوَّارٍ

    ✧ He circumambulated the House and prayed, then wrapped a cloak of his made of striped cloth and placed it under his head and slept. A thief came and pulled it out from under his head, so he caught him and brought him to the Prophet ﷺ, saying, "This man stole my cloak." The Prophet ﷺ said to him, "Did you steal this man's cloak?" He said, "Yes." He said, "Take him and cut off his hand." Safwan said, "I did not want his hand to be cut off for my cloak." He said to him, "Why was it not before this?" Ash'ath b. Sawwar differed from him.

    كَانَ صَفْوَانُ نَائِمًا فِي الْمَسْجِدِ وَرِدَاؤُهُ تَحْتَهُ فَسُرِقَ فَقَامَ وَقَدْ ذَهَبَ الرَّجُلُ فَأَدْرَكَهُ فَأَخَذَهُ فَجَاءَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِقَطْعِهِ قَالَ صَفْوَانُ يَا رَسُولَ اللهِ مَا بَلَغَ رِدَائِي أَنْ يُقْطَعَ فِيهِ رَجُلٌ قَالَ «فَهَلَّا كَانَ هَذَا قَبْلَ أَنْ تَأْتِينَا بِهِ؟»

    ✧ Safwan was sleeping in the mosque with his cloak beneath him, and it was stolen. He got up, but the man had gone, so he caught up with him and seized him, and brought him to the Prophet ﷺ, who ordered his hand to be cut off. Safwan said, "O Messenger of Allah, my cloak is not worth a man's hand being cut off for it." He said, "Why was this not before you brought him to us?"

    كُنْتُ نَائِمًا فِي الْمَسْجِدِ عَلَى خَمِيصَةٍ لِي ثَمَنُهَا ثَلَاثُونَ دِرْهَمًا فَجَاءَ رَجُلٌ فَاخْتَلَسَهَا مِنِّي فَأَخَذَ الرَّجُلَ فَأُتِيَ بِهِ النَّبِيَّ ﷺ فَأَمَرَ بِهِ لِيُقْطَعَ فَأَتَيْتُهُ فَقُلْتُ لَهُ تَقْطَعُهُ مِنْ أَجْلِ ثَلَاثِينَ دِرْهَمًا؟ أَنَا أَبِيعُهُ وَأُنْسِئُهُ ثَمَنَهَا قَالَ «فَهَلَّا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ؟»

    ✧ I was sleeping in the mosque on a cloak of mine worth thirty dirhams. A man came and snatched it from me. The man was caught and brought to the Prophet ﷺ, who ordered him to be punished by cutting off his hand. I came to him and said, "Will you cut off his hand for thirty dirhams? I will sell it to him and give him time to pay for it." He said, "Why was this not before you brought him to me?"

    أَنَّهَا سُرِقَتْ خَمِيصَتُهُ مِنْ تَحْتِ رَأْسِهِ وَهُوَ نَائِمٌ فِي مَسْجِدِ النَّبِيِّ ﷺ فَأَخَذَ اللِّصَّ فَجَاءَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِقَطْعِهِ قَالَ صَفْوَانُ أَتَقْطَعُهُ؟ قَالَ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ تَرَكْتَهُ»

    ✧ His cloak was stolen from under his head while he was sleeping in the Prophet's mosque. He caught the thief and brought him to the Prophet ﷺ, who ordered his hand to be cut off. Safwan said, "Will you cut off his hand?" He said, "Why did you not leave him before you brought him to me?"

    قُلْتُ يَا رَسُولَ اللهِ إِنَّ هَذَا سَرَقَ خَمِيصَةً لِي لِرَجُلٍ مَعَهُ فَأَمَرَ بِقَطْعِهِ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي قَدْ وَهَبْتُهَا لَهُ قَالَ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ»

    ✧ I said, "O Messenger of Allah, this man stole a cloak of mine belonging to a man who is with me." He ordered his hand to be cut off. I said, "O Messenger of Allah, I have given it to him as a gift." He said, "Why not before you brought him to me?"

    عَنِ النَّبِيِّ ﷺ قَالَ «تَعَافُوا الْحُدُودَ فِيمَا بَيْنَكُمْ قَبْلَ أَنْ تَأْتُونِي فَمَا أَتَانِي مِنْ حَدٍّ فَقَدْ وَجَبَ»

    ✧ The Prophet ﷺ said: "Forgive one another the prescribed punishments among yourselves before you come to me, for whatever prescribed punishment reaches me has become binding."

    ✧ The Messenger of Allah ﷺ said: "Pardon the legal punishments among yourselves, for whatever punishment reaches me, it becomes binding."

    ✧ A Makhzumi woman used to borrow goods and then deny it. The Prophet ﷺ ordered that her hand be cut off.

    ✧ A Makhzumi woman used to borrow goods in the names of her neighbors and then deny it. The Messenger of Allah ﷺ ordered that her hand be cut off.

    رَسُولُ اللهِ ﷺ «لِتَتُبْ هَذِهِ الْمَرْأَةُ إِلَى اللهِ وَإِلَى رَسُولِهِ وَتُرَدَّ مَا تَأْخُذُ عَلَى الْقَوْمِ» ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «قُمْ يَا بِلَالُ فَخُذْ بِيَدِهَا فَاقْطَعْهَا» خَالَفَهُ شُعَيْبٌ فَأَرْسَلَ الْحَدِيثَ

    ✧ The Messenger of Allah ﷺ said: "Let this woman repent to Allah and His Messenger and return what she took from the people." Then the Messenger of Allah ﷺ said: "Get up, O Bilal, take her hand and cut it off." Shu'ayb disagreed with him and narrated the hadith as mursal.

    أَنَّ امْرَأَةً كَانَتْ تَسْتَعِيرُ الْحُلِيَّ فِي زَمَانِ رَسُولِ اللهِ ﷺ فَاسْتَعَارَتْ مِنْ ذَلِكَ حُلِيًّا فَجَمَعَتْهُ ثُمَّ أَمْسَكَتْهُ فَقَالَ رَسُولُ اللهِ ﷺ «لِتَتُبْ امْرَأَةٌ إِلَى اللهِ وَتُؤَدِّي مَا عِنْدَهَا مِرَارًا فَلَمْ تَفْعَلْ فَأَمَرَ بِهَا فَقُطِعَتْ»

    ✧ A woman used to borrow jewelry during the time of the Messenger of Allah ﷺ. She borrowed some jewelry, collected it, and then withheld it. The Messenger of Allah ﷺ said several times: "Let the woman repent to Allah and return what she has." She did not do so, so he ordered that she be brought and her hand was cut off.

    أَنَّ امْرَأَةً مِنْ بَنِي مَخْزُومٍ سَرَقَتْ فَأُتِيَ بِهَا النَّبِيُّ ﷺ فَعَاذَتْ بِأُمِّ سَلَمَةَ فَقَالَ النَّبِيُّ ﷺ «وَاللهِ لَوْ كَانَتْ فَاطِمَةَ بِنْتَ مُحَمَّدٍ لَقَطَعْتُ يَدَهَا» فَقُطِعَتْ

    ✧ A woman from Banu Makhzum stole. She was brought to the Prophet ﷺ and sought refuge with Umm Salamah. The Prophet ﷺ said: "By Allah, if she were Fatimah bint Muhammad, I would cut off her hand." Then her hand was cut off.

    «أَنَّ امْرَأَةً مِنْ بَنِي مَخْزُومٍ اسْتَعَارَتْ حُلِيًّا عَلَى لِسَانِ أُنَاسٍ فَجَحَدَتْهَا فَأَمَرَ بِهَا النَّبِيُّ ﷺ فَقُطِعَتْ» 7339 أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنَا عَبْدُ الصَّمَدِ قَالَ حَدَّثَنَا هِشَامٌ قَالَ حَدَّثَنَا قَتَادَةُ عَنْ دَاوُدَ بْنِ أَبِي عَاصِمٍ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ حَدَّثَهُ نَحْوَهُ

    ✧ A woman from Banu Makhzum borrowed jewelry in the names of some people, then denied it. The Prophet ﷺ ordered that she be brought, and her hand was cut off." 7339 Muhammad b. al-Muthanna informed us, he said: Abd al-Samad narrated to us, he said: Hisham narrated to us, he said: Qatadah narrated to us, from Dawud b. Abi Asim, that Sa'id b. al-Musayyib narrated to him something similar.

    كَانَتْ مَخْزُومِيَّةٌ تَسْتَعِيرُ مَتَاعًا فَتَجْحَدُهُ فَرُفِعَتْ إِلَى رَسُولِ اللهِ ﷺ فَكُلِّمَ فِيهَا فَقَالَ «لَوْ كَانَتْ فَاطِمَةَ بِنْتَ مُحَمَّدٍ لَقَطَعْتُ يَدَهَا» قِيلَ لِسُفْيَانَ مَنْ ذَكَرَهُ؟ قَالَ أَيُّوبُ بْنُ مُوسَى عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ إِنْ شَاءَ اللهُ تَعَالَى خَالَفَهُ مُحَمَّدُ بْنُ مَنْصُورٍ فِي لَفْظِهِ

    ✧ A Makhzumi woman used to borrow goods and then deny it. She was brought to the Messenger of Allah ﷺ, and intercession was made for her. He said: "If she were Fatimah bint Muhammad, I would cut off her hand." It was said to Sufyan: Who mentioned it? He said: Ayyub b. Musa, from al-Zuhri, from Urwah, from Aishah, if Allah wills. Muhammad b. Mansur differed with him in its wording.

    أَنَّ امْرَأَةً سَرَقَتْ فَأُتِيَ بِهَا النَّبِيُّ ﷺ فَقَالُوا مَنْ يَجْتَرِئُ عَلَى رَسُولِ اللهِ ﷺ إِلَّا أَنْ يَكُونَ أُسَامَةَ فَكَلَّمُوا أُسَامَةَ فَكَلَّمَ النَّبِيَّ ﷺ فَقَالَ النَّبِيُّ ﷺ «يَا أُسَامَةُ إِنَّمَا هَلَكَتْ بَنُو إِسْرَائِيلَ حِينَ كَانُوا إِذَا أَصَابَ فِيهِمُ الشَّرِيفُ الْحَدَّ تَرَكُوهُ وَلَمْ يُقِيمُوا عَلَيْهِ وَإِذَا أَصَابَ الْوَضِيعُ أَقَامُوا عَلَيْهِ لَوْ كَانَتْ فَاطِمَةَ بِنْتَ مُحَمَّدٍ لَقَطَعْتُهَا»

    ✧ A woman stole. She was brought to the Prophet ﷺ. They said: Who dares to speak to the Messenger of Allah ﷺ except Usamah? So they asked Usamah, and he spoke to the Prophet ﷺ. The Prophet ﷺ said: "O Usamah, the Children of Israel were destroyed only when a noble person among them committed a crime, they would leave him and not enforce the punishment on him, but when a lowly person committed it, they would enforce it on him. If she were Fatimah bint Muhammad, I would cut off her hand."

    ✧ A woman borrowed jewelry in the names of people who were known, while she was unknown. She sold it and took its price. She was brought to the Prophet ﷺ. Her family went to Usamah b. Zayd, and he spoke to the Messenger of Allah ﷺ about her. The face of the Messenger of Allah ﷺ changed color while he was speaking to him. Then the Messenger of Allah ﷺ said to him: "Do you intercede regarding one of the limits set by Allah?" Usamah said: "Ask forgiveness for me, O Messenger of Allah." Then the Messenger of Allah ﷺ stood up that evening, praised Allah as He deserves, and said: "To proceed: The people before you were destroyed only because when a noble person among them stole, they would leave him, and when a weak person among them stole, they would enforce the punishment on him. By the One in Whose hand is the soul of Muhammad, if Fatimah bint Muhammad stole, I would cut off her hand." Then he cut off that woman's hand. Al-Layth agreed with him in his saying 'she stole'.

So he came to him and spoke to him, but he rebuked him and said, "The Children of Israel, when a noble person stole, they left him alone, but when a lowly person stole, they cut off his hand. By the One in whose hand is my soul, if Fatima bt. Muhammad were to steal, I would cut off her hand."

By the One in whose hand is the soul of Muhammad, if Fatima bt. Muhammad were to steal, I would cut off her hand." Then the Messenger of Allah ﷺ ordered that woman, and her hand was cut off. Her repentance was good after that. Aisha said: After that, she would come to me, and I would raise her need to the Messenger of Allah ﷺ.

    ✧ From the Messenger of God ﷺ that he was asked about hanging fruit. He said: Whoever takes some of it out of need, not making a pouch, there is nothing upon him. And whoever goes out with something of it, he owes double its value and punishment. And whoever steals something of it after the threshing floor shelters it, and it reaches the price of a shield, cutting applies. And whoever steals less than that, he owes double its value and punishment.

    ✧ A man from Muzaynah came to the Messenger of God ﷺ and said: O Messenger of God, what do you think about a mountain sheep taken by stealth? He said: It and its like, and exemplary punishment. There is no cutting for any livestock except what the fold shelters; if it reaches the price of a shield, cutting of the hand applies. And what does not reach the price of a shield, he owes double its value and lashes as exemplary punishment. He said: O Messenger of God, what do you think about hanging fruit? He said: It and its like with it, and exemplary punishment. There is no cutting for any hanging fruit except what the threshing floor shelters; whatever is taken from the threshing floor and reaches the price of a shield, cutting applies. And what does not reach the price of a shield, he owes double its value and lashes as exemplary punishment.

Rabi'a, Makhlad b. Yazid, and Salama b. Sa'id, but none of them said in it: “Abu al-Zubayr narrated to me.” I do not think he heard it from Abu al-Zubayr, and Allah knows best.

    ✧ A thief was brought to the Messenger of Allah ﷺ and he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” Then he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” He said: “Cut off his hand.” He said: Then he stole again and his leg was cut off. Then he stole during the time of Abu Bakr until all his limbs were cut off. Then he stole a fifth time, and Abu Bakr said: “The Messenger of Allah ﷺ knew better about this when he said: ‘Kill him.’” Then he handed him over to some young men of Quraysh to kill him, among them Abd Allah b. al-Zubayr, who loved leadership. He said: “Appoint me as your leader,” so they appointed him over them. Whenever he struck, they struck, until they killed him.

    جِيءَ بِسَارِقٍ إِلَى النَّبِيِّ ﷺ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَقُطِعَ ثُمَّ جِيءَ بِهِ الثَّانِيَةَ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الثَّالِثَةَ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الرَّابِعَةَ قَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الْخَامِسَةَ فَقَالَ «اقْتُلُوهُ» قَالَ جَابِرٌ فَانْطَلَقْنَا بِهِ إِلَى مِرْبَدِ النَّعَمِ فَاسْتَلْقَى عَلَى ظَهْرِهِ ثُمَّ كَسَّ بِيَدِهِ وَرِجْلِهِ فَانْصَدَعَتِ الْإِبِلُ ثُمَّ حَمَلُوا عَلَيْهِ الثَّانِيَةَ فَفَعَلَ مِثْلَ ذَلِكَ ثُمَّ حَمَلُوا عَلَيْهِ الثَّالِثَةَ فَرَمَيْنَاهُ بِالْحِجَارَةِ فَقَتَلْنَاهُ ثُمَّ أَلْقَيْنَاهُ فِي بِئْرٍ ثُمَّ رَمَيْنَا عَلَيْهِ الْحِجَارَةَ قَالَ أَبُو عَبْدِ الرَّحْمَنِ مُصْعَبُ بْنُ ثَابِتٍ لَيْسَ بِالْقَوِيِّ وَيَحْيَى الْقَطَّانُ لَمْ يَتْرُكْهُ وَهَذَا الْحَدِيثُ لَيْسَ بِصَحِيحٍ وَلَا أَعْلَمُ فِي هَذَا الْبَابِ حَدِيثًا صَحِيحًا عَنِ النَّبِيِّ ﷺ

    ✧ A thief was brought to the Prophet ﷺ and he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” He said: “Cut him.” So he was cut. Then he was brought a second time and he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” He said: “Cut him.” Then he was brought a third time and he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” He said: “Cut him.” Then he was brought a fourth time and he said: “Kill him.” They said: “O Messenger of Allah, he only stole.” He said: “Cut him.” Then he was brought a fifth time and he said: “Kill him.” Jabir said: We took him to the camel pen. He lay on his back, then he kicked with his hand and his leg, and the camels scattered. Then they attacked him a second time and he did the same. Then they attacked him a third time, and we stoned him and killed him. Then we threw him into a well and threw stones on him. Abu Abd al-Rahman said: Mus'ab b. Thabit is not strong, and Yahya al-Qattan did not abandon him. This hadith is not authentic, and I do not know of any authentic hadith from the Prophet ﷺ on this subject.
