33. Will and Testiment

    جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَيُّ الصَّدَقَةِ أَعْظَمُ أَجْرًا قَالَ «تَصَدَّقْ وَأَنْتَ صَحِيحٌ شَحِيحٌ تَخْشَى الْفَقْرَ وَتَأْمُلُ الْبَقَاءَ وَلَا تُمْهِلْ حَتَّى إِذَا بَلَغَتِ الْحُلْقُومَ» قُلْتَ لِفُلَانٍ كَذَا وَقَدْ كَانَ لِفُلَانٍ

    ✧ A man came to the Prophet ﷺ and said, "O Messenger of God, which charity is greatest in reward?" He said, "Give charity while you are healthy and covetous, fearing poverty and hoping for long life. Do not delay until, when it reaches the throat, you say, 'For so-and-so is such, and for so-and-so is such,' though it already belongs to so-and-so."

    قَالَ رَسُولُ اللهِ ﷺ «أَيُّكُمْ مَالُ وَارِثِهِ أَحَبُّ إِلَيْهِ مِنْ مَالِهِ؟» قَالُوا يَا رَسُولَ اللهِ مَا مِنَّا مِنْ أَحَدٍ إِلَّا مَالُهُ أَحَبُّ إِلَيْهِ مِنْ مَالِ وَارِثِهِ فَقَالَ رَسُولُ اللهِ ﷺ «اعْلَمُوا أَنَّهُ لَيْسَ مِنْكُمْ مِنْ أَحَدٍ إِلَّا مَالُ وَارِثِهِ أَحَبُّ إِلَيْهِ مِنْ مَالِهِ مَالُكَ مَا قَدَّمْتَ وَمَالُ وَارِثِكَ مَا أَخَّرْتَ»

    ✧ The Messenger of God ﷺ said, "Which of you loves the wealth of his heir more than his own wealth?" They said, "O Messenger of God, there is not one of us but his own wealth is more beloved to him than the wealth of his heir." The Messenger of God ﷺ said, "Know that there is not one of you but the wealth of his heir is more beloved to him than his own wealth. Your wealth is what you send ahead, and the wealth of your heir is what you leave behind."

    عَنِ النَّبِيِّ ﷺ قَالَ {أَلْهَاكُمُ التَّكَاثُرُ حَتَّى زُرْتُمُ الْمَقَابِرَ} [التكاثر 2] قَالَ يَقُولُ ابْنُ آدَمَ مَالِي مَالِي وَإِنَّمَا لَكَ مِنْ مَالِكَ مَا أَكَلْتَ فَأَفْنَيْتَ أَوْ لَبِسْتَ فَأَبْلَيْتَ أَوْ تَصَدَّقْتَ فَأَمْضَيْتَ

    ✧ From the Prophet ﷺ: He said, "{Competition for more distracts you until you visit the graves} [al-Takathur:2]." He said, "The son of Adam says, 'My wealth, my wealth,' but you have from your wealth only what you eat and consume, or wear and wear out, or give in charity and send forth."

    أَوْصَى رَجُلٌ بِدَنَانِيرَ فِي سَبِيلِ اللهِ فَسُئِلَ أَبُو الدَّرْدَاءِ فَحَدَّثَ عَنِ النَّبِيِّ ﷺ قَالَ «مَثَلُ الَّذِي يَعْتِقُ أَوْ يَتَصَدَّقُ عِنْدَ مَوْتِهِ مَثَلُ الَّذِي يُهْدِي بَعْدَ مَا يَشْبَعُ»

    ✧ A man bequeathed dinars in the way of Allah. Abu al-Darda' was asked, and he narrated from the Prophet ﷺ who said: "The example of one who frees a slave or gives charity at his death is like the example of one who gives a gift after he is full."

    ✧ The Messenger of Allah ﷺ said: "It is not right for any Muslim who has something to bequeath to spend two nights without having his will written down with him."

    أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَا حَقُّ امْرِئٍ مُسْلِمٍ لَهُ شَيْءٌ يُوصَى فِيهِ يَبِيتُ لَيْلَتَيْنِ إِلَّا وَوَصِيَّتُهُ مَكْتُوبَةُ عِنْدَهُ» 6411 أَخْبَرَنَا مُحَمَّدُ بْنُ حَاتِمِ بْنِ نُعَيْمٍ الْمَرْوَزِيُّ قَالَ أَخْبَرَنَا حِبَّانُ قَالَ أَخْبَرَنَا عَبْدُ اللهِ عَنِ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَوْلَهُ

    ✧ The Messenger of Allah ﷺ said: "It is not right for any Muslim who has something to bequeath to spend two nights without having his will written with him." 6411 Muhammad b. Hatim b. Nu'aym al-Marwazi informed us, he said: Hibban informed us, he said: Abdullah informed us, from Ibn 'Awn, from Nafi', from Ibn 'Umar, his statement.

    أَنَّ النَّبِيَّ ﷺ قَالَ «مَا حَقُّ امْرِئٍ مُسْلِمٍ يَمُرُّ عَلَيْهِ ثَلَاثُ لَيَالٍ إِلَّا وَعِنْدَهُ وَصِيَّتُهُ» قَالَ عَبْدُ اللهِ بْنُ عُمَرَ مَا مَرَّتْ عَلَيَّ لَيْلَةٌ مُنْذُ سَمِعْتُ رَسُولَ اللهِ ﷺ قَالَ ذَلِكَ إِلَّا وَعِنْدِي وَصِيَّتِي

    "It is not befitting for a Muslim to abide for three nights without having his will with him." 'Abdullah bin 'Umar said: "Since I heard this from the Messenger of Allah, I have always had my will with me." (Using translation from Nasāʾī 3618)

    ✧ I asked Ibn Abi Awfa, "Did the Messenger of Allah ﷺ make a will?" He said, "No." I said, "How then was the will prescribed for the Muslims?" He said, "He bequeathed the Book of Allah."

    ✧ "The Messenger of Allah ﷺ left neither a dinar nor a dirham nor a camel, and he did not bequeath anything." Muhammad b. al-'Ala' said in his hadith: Al-A'mash narrated to us.

    ✧ The Messenger of Allah ﷺ left neither a dirham nor a dinar nor a sheep nor a camel, and he did not make a will.

    يَقُولُونَ إِنَّ رَسُولَ اللهِ ﷺ أَوْصَى إِلَى عَلِيٍّ لَقَدْ دَعَا بِالطَّسْتِ لِيَبُولَ فِيهَا فَانْخَنَثَتْ نَفْسُهُ ﷺ وَمَا أَشْعُرُ فَإِلَى مَنْ أَوْصَى

    ✧ They say that the Messenger of Allah ﷺ made a will to 'Ali. Indeed, he called for a basin to urinate in it, and his soul departed ﷺ while I was unaware. So to whom did he make a will?

    تُوُفِّيَ رَسُولُ اللهِ ﷺ وَلَيْسَ عِنْدَهُ أَحَدٌ غَيْرِي قَالَتْ وَدَعَا بِالطَّسْتِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ الصَّوَابُ حَدِيثُ أَبِي مُعَاوِيَةَ وَمُفَضَّلٌ وَدَاوُدُ وَحَدِيثُ ابْنِ عَيَّاشٍ لَا نَعْلَمُ أَنَّ أَحَدًا تَابَعَهُ عَلَى قَوْلِهِ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ

    ✧ The Messenger of Allah ﷺ died when no one was with him except me. She said: He called for a basin. Abu 'Abd al-Rahman said: The correct version is the hadith of Abu Mu'awiyah, Mufaddal, and Dawud. As for the hadith of Ibn 'Ayyash, we do not know anyone who agreed with his statement from Ibrahim, from al-Aswad.

    مَرِضْتُ مَرَضًا أَشْفَيْتُ مِنْهُ فَأَتَانِي رَسُولُ اللهِ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ لِي مَالًا كَثِيرًا وَلَيْسَ يَرِثُنِي إِلَّا ابْنَتِي أَفَأَتَصَدَّقُ بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قُلْتُ فَالشَّطْرُ قَالَ «لَا» قُلْتُ فَالثُّلُثُ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ لَهُمْ مِنْ أَنْ تَتْرُكَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ»

    ✧ I fell ill with an illness from which I was on the verge of death. The Messenger of Allah ﷺ came to visit me. I said, "O Messenger of Allah, I have much wealth and none will inherit from me except my daughter. May I give two-thirds of my wealth as charity?" He said, "No." I said, "Then half?" He said, "No." I said, "Then a third?" He said, "A third, and a third is a lot. That you leave your heirs wealthy is better for them than leaving them destitute, begging from people."

    جَاءَنِي النَّبِيُّ ﷺ يَعُودُنِي وَأنا بِمَكَّةَ قُلْتُ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلَّهِ؟ قَالَ «لَا» قُلْتُ فَالشَّطْرُ؟ قَالَ «لَا» قُلْتُ فَالثُّلُثُ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ يَتَكَفَّفُونَ فِي أَيْدِيهِمْ»

    ✧ The Prophet ﷺ came to visit me while I was in Makkah. I said: O Messenger of God, shall I bequeath all my wealth? He said: “No.” I said: Then half? He said: “No.” I said: Then a third? He said: “A third, and a third is large. If you leave your heirs wealthy, it is better than leaving them dependent, begging from people, begging with their hands.”

    كَانَ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَهُوَ يَكْرَهُ أَنْ يَمُوتَ بِالْأَرْضِ الَّتِي هَاجَرَ مِنْهَا فَقَالَ النَّبِيُّ ﷺ «يَرْحَمُ اللهُ سَعْدَ ابْنَ عَفْرَاءَ يَرْحَمُ اللهُ سَعْدَ ابْنَ عَفْرَاءَ» وَلَمْ تَكُنْ لَهُ إِلَّا ابْنَةٌ وَاحِدَةٌ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ النِّصْفُ؟ قَالَ «لَا» قُلْتُ فَالثُّلُثُ؟ قَالَ «الثُّلُثُ والثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ مَا فِي أَيْدِيهِمْ» 6423 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا أَبُو نُعَيْمٍ قَالَ حَدَّثَنَا مِسْعَرٌ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ قَالَ حَدَّثَنِي بَعْضُ آلِ سَعْدٍ قَالَ مَرِضَ سَعْدٌ فَدَخَلَ رَسُولُ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» وَسَاقَ الْحَدِيثَ

    ✧ The Prophet ﷺ used to visit him while he was in Makkah, and he disliked dying in the land from which he had emigrated. The Prophet ﷺ said: “May God have mercy on Sa‘d b. ‘Afra’. May God have mercy on Sa‘d b. ‘Afra’.” He had only one daughter. He said: O Messenger of God, shall I bequeath all my wealth? He said: “No.” He said: Half? He said: “No.” I said: Then a third? He said: “A third, and a third is much. If you leave your heirs wealthy, it is better than leaving them dependent, begging from people for what is in their hands.” 6423 Ahmad b. Sulayman informed us, saying: Abu Nu‘aym narrated to us, saying: Mis‘ar narrated to us from Sa‘d b. Ibrahim, who said: A member of Sa‘d’s family narrated to me, saying: Sa‘d fell ill, and the Messenger of God ﷺ entered upon him and said: O Messenger of God, shall I bequeath all my wealth? He said: “No.” And he related the rest of the hadith.

    أَنَّهُ اشْتَكَى بِمَكَّةَ فَجَاءَهُ رَسُولُ اللهِ ﷺ فَلَمَّا رَآهُ سَعْدٌ بَكَى وَقَالَ يَا رَسُولَ اللهِ أَمُوتُ بِالْأَرْضِ الَّتِي هَاجَرْتَ مِنْهَا قَالَ «لَا إِنْ شَاءَ اللهُ» وَقَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ فِي سَبِيلِ اللهِ؟ قَالَ لَا قَالَ وَذَكَرَ كلمةً مَعْنَاهَا قَالَ فَبِثُلُثَيْهِ؟ قَالَ «لَا» قَالَ فَبِنِصْفِهِ؟ قَالَ «لَا» قَالَ فَثُلُثُهُ؟ قَالَ رَسُولُ اللهِ ﷺ «الثُّلُثُ والثُّلُثُ كَبِيرٌ إِنَّكَ أَنْ تَتْرُكَ بَنِيكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ»

    ✧ He complained of illness in Makkah, and the Messenger of God ﷺ came to him. When Sa‘d saw him, he wept and said: O Messenger of God, will I die in the land from which you emigrated? He said: “No, God willing.” And he said: O Messenger of God, shall I bequeath all my wealth in the cause of God? He said: No. He said—and he mentioned a word whose meaning was—then two-thirds of it? He said: “No.” He said: Then half of it? He said: “No.” He said: Then a third of it? The Messenger of God ﷺ said: “A third, and a third is large. If you leave your children wealthy, it is better than leaving them dependent, begging from people.”

    عَادَنِي رَسُولُ اللهِ ﷺ فِي مَرَضِي فَقَالَ «أَوْصَيْتَ؟» قُلْتُ نَعَمْ قَالَ «بِكَمْ؟» قُلْتُ بِمَالِي كُلِّهِ فِي سَبِيلِ اللهِ قَالَ «فَمَا تَرَكْتَ لِوَلَدِكَ؟» قُلْتُ هُمْ أَغْنِيَاءُ قَالَ «أَوْصِ بِالْعُشْرِ» فَمَا زَالَ يَقُولُ وَأَقُولُ حَتَّى قَالَ «أَوْصِ بِالثُّلُثِ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ»

    ✧ The Messenger of God ﷺ visited me during my illness and said: “Have you made a will?” I said: Yes. He said: “For how much?” I said: All my wealth in the cause of God. He said: “Then what have you left for your children?” I said: They are wealthy. He said: “Bequeath a tenth.” He kept saying and I kept saying until he said: “Bequeath a third, and a third is much or large.”

    أَنَّ النَّبِيَّ ﷺ عَادَهُ فِي مَرَضِهِ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ فَالشَّطْرُ؟ قَالَ «لَا» قَالَ فَالثُّلُثُ؟ قَالَ «الثُّلُثُ والثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ»

    ✧ The Prophet ﷺ visited him during his illness. He said: O Messenger of God, shall I bequeath all my wealth? He said: “No.” He said: Then half? He said: “No.” He said: Then a third? He said: “A third, and a third is much or large.”

    أَنَّ رَسُولَ اللهِ ﷺ أَتَى سَعْدًا يَعُودُهُ فَقَالَ لَهُ سَعْدٌ يَا رَسُولَ اللهِ أُوصِي بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قَالَ فَأُوصِي بِالنِّصْفِ؟ قَالَ «لَا» قَالَ فَأُوصِي بِالثُّلُثِ؟ قَالَ «نَعَمْ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ إِنَّكَ أَنْ تَدَعَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ فُقَرَاءَ يَتَكَفَّفُونَ»

    ✧ The Messenger of God ﷺ came to Sa‘d to visit him. Sa‘d said to him: O Messenger of God, shall I bequeath two-thirds of my wealth? He said: “No.” He said: Then shall I bequeath half? He said: “No.” He said: Then shall I bequeath a third? He said: “Yes, a third, and a third is much or large. If you leave your heirs wealthy, it is better than leaving them poor, begging.”

    لَوْ غَضَّ النَّاسُ إِلَى الرُّبُعِ؛ لَأَنَّ رَسُولَ اللهِ ﷺ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ»

    "If the people were to reduce (their bequests) to one-quarter (of their wealth, that would be better), because the Messenger of Allah said: 'One-third, and one-third is much or large.'" (Using translation from Nasāʾī 3634)

    أَنَّ النَّبِيَّ ﷺ جَاءَهُ وَهُوَ مَرِيضٌ فَقَالَ إِنَّهُ لَيْسَ لِي وَلَدٌ إِلَّا ابْنَةٌ وَاحِدَةٌ فَأُوصِي بِمَالِي كُلِّهِ؟ قَالَ النَّبِيُّ ﷺ «لَا» قَالَ فَأُوصِي بِنِصْفِهِ؟ قَالَ النَّبِيُّ ﷺ «لَا» قَالَ فَأُوصِي بِثُلُثِهِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ»

    ✧ The Prophet ﷺ came to him while he was ill, and he said: I have no child except one daughter. Shall I bequeath all my wealth? The Prophet ﷺ said: “No.” He said: Then shall I bequeath half of it? The Prophet ﷺ said: “No.” He said: Then shall I bequeath a third of it? He said: “A third, and a third is large.”

    أَنَّ أَبَاهُ اسْتُشْهِدَ يَوْمَ أُحُدٍ وَتَرَكَ سِتَّ بَنَاتٍ وَتَرَكَ عَلَيْهِ دَيْنًا فَلَمَّا حَضَرَ جُزَازُ النَّخْلِ أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ قَدْ عَلِمْتَ أَنَّ وَالِدِي اسْتُشْهِدَ يَوْمَ أُحُدٍ وَتَرَكَ دَيْنًا كَثِيرًا وَإِنِّي أُحِبُّ أَنْ يَرَاكَ الْغُرَمَاءُ قَالَ «اذْهَبْ فَبَيْدِرْ كُلَّ تَمْرٍ عَلَى نَاحِيَةٍ» فَفَعَلْتُ ثُمَّ دَعَوْتُهُ فَلَمَّا نَظَرُوا إِلَيْهِ كَأَنَّمَا أُغْرُوا بِي تِلْكَ السَّاعَةَ فَلَمَّا رَأَى مَا يَصْنَعُونَ أَطَافَ حَوْلَ أَعْظَمِهَا بَيْدَرًا ثَلَاثَ مَرَّاتٍ ثُمَّ جَلَسَ عَلَيْهِ ثُمَّ قَالَ «ادْعُ أَصْحَابَكَ» فَمَا زَالَ يَكِيلُ لَهُمْ حَتَّى أَدَّى اللهُ أَمَانَةَ وَالِدِي وَأَنَا رَاضٍ أَنْ يُؤَدِّيَ اللهُ أَمَانَةَ وَالِدِي لَمْ تَنْقُصْ تَمْرَةٌ وَاحِدَةٌ

    ✧ His father was martyred on the day of Uhud, leaving six daughters and a debt. When the time for cutting the dates came, I went to the Messenger of God ﷺ and said: You know that my father was martyred on the day of Uhud and left a large debt, and I would like the creditors to see you. He said: “Go and heap all the dates in separate piles.” So I did, then I called him. When they saw him, it was as if they had been set against me at that moment. When he saw what they were doing, he walked around the largest of the heaps three times, then sat on it and said: “Call your companions.” He kept measuring out to them until God fulfilled my father’s debt, and I was content that God fulfilled my father’s debt, and not a single date was diminished.

    أَنَّ أَبَاهُ تُوُفِّيَ وَعَلَيْهِ دَيْنٌ فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ أَبِي تُوُفِّيَ وَعَلَيْهِ دَيْنٌ وَلَمْ يَتْرُكْ إِلَّا مَا تُخْرِجُ نَخْلُهُ وَلَا يَبْلُغُ مَا يُخْرِجُ نَخْلُهُ مَا عَلَيْهِ مِنَ الدَّيْنِ دُونَ سَنَتَيْنِ فَانْطَلِقْ مَعِي يَا رَسُولَ اللهِ؛ لِكَيْلَا يَفْحَشَ عَلَيَّ الْغُرَمَاءُ فَأَتَى رَسُولُ اللهِ ﷺ بَيْدَرًا مِنْ بَيَادِرَ فَمَشَى حَوْلَهُ وَدَعَا ثُمَّ جَلَسَ عَلَيْهِ وَدَعَا الْغُرَمَاءَ فَوَفَّاهُمُ وَبَقِيَ مِثْلُ مَا أَخَذُوا

    ✧ His father died owing a debt. I went to the Prophet ﷺ and said: O Messenger of God, my father has died owing a debt, and he left nothing but what his palm trees produce, and what his palm trees produce will not cover his debt within two years. Come with me, O Messenger of God, so that the creditors will not be harsh with me. The Messenger of God ﷺ came to one of the heaps, walked around it, supplicated, then sat on it and called the creditors and paid them off, and there remained the like of what they had taken.

    وَتَرَكَ دَيْنًا فَاسْتَشْفَعْتُ بِرَسُولِ اللهِ ﷺ عَلَى غُرَمَائِهِ أَنْ يَضَعُوا مِنْ دَيْنِهِ شَيْئًا فَطَلَبَ إِلَيْهِمْ فَأَبَوْا فَقَالَ لِي النَّبِيُّ ﷺ «اذْهَبْ فَصَنِّفْ تَمْرَكَ أَصْنَافًا الْعَجْوَةَ عَلَى حِدَةٍ وَعِذْقَ زَيْدٍ عَلَى حِدَةٍ وَأَصْنَافَهُ ثُمَّ ابْعَثْ إِلَيَّ» قَالَ فَفَعَلْتُ قَالَ فَجَاءَ رَسُولُ اللهِ ﷺ فَجَلَسَ فِي الْعُلَا أَوْ فِي أَوْسَطِهِ ثُمَّ قَالَ «كِلْ لِلْقَوْمِ» قَالَ فَكِلْتُ لَهُمْ حَتَّى أَوْفَيْتَهُمْ وَبَقِيَ تَمْرِي كَأَنْ لَمْ يَنْقُصْ مِنْهُ شَيْءٌ

    ✧ He left a debt, and I sought the intercession of the Messenger of God ﷺ with his creditors to reduce something of the debt. He asked them, but they refused. The Prophet ﷺ said to me: “Go and sort your dates into different kinds: the ‘ajwah separately, the bunch of Zayd separately, and the other kinds, then send for me.” He said: So I did. He said: The Messenger of God ﷺ came and sat at the top or in the middle of it, then said: “Measure out for the people.” He said: So I measured out for them until I paid them off, and my dates remained as if nothing had been taken from them.

    كَانَ لِيَهُودِيٍّ عَلَى أَبِي تَمْرٌ فَقُتِلَ يَوْمَ أُحُدٍ وَتَرَكَ حَدِيقَتَيْنِ وَتَمْرُ الْيَهُودِيِّ يَسْتَوْعِبُ مَا فِي الْحَدِيقَتَيْنِ فَقَالَ النَّبِيُّ ﷺ «هَلْ لَكَ أَنْ تَأْخُذَ الْعَامَ بَعْضَهُ وَتُؤَخِّرَ بَعْضَهُ؟» فَأَبَى الْيَهُودِيُّ فَقَالَ النَّبِيُّ ﷺ يَا جَابِرُ إِذَا حَضَرَ الْجُدَادَ فَآذَنِّي فَآذَنْتُهُ فَجَاءَ هُوَ وَأَبُو بَكْرٍ فَجَعَلَ يُجَدُّ وَيُكَالُ مِنْ أَسْفَلِ النَّخْلِ وَرَسُولُ اللهِ ﷺ يَدْعُو بِالْبَرَكَةِ حَتَّى وَفَيْنَا جَمِيعَ حَقِّهِ مِنْ أَصْغَرِ الْحَدِيقَتَيْنِ فِيمَا يَحْسِبُ عَمَّارٌ ثُمَّ أَتَيْتُهُمْ بِرُطَبٍ وَمَاءٍ فَأَكَلُوا وَشَرِبُوا ثُمَّ قَالَ «هَذَا مِنَ النَّعِيمِ الَّذِي تُسْأَلُونَ عَنْهُ»

    ✧ A Jew had a debt of dates owed by my father, who was killed on the day of Uhud and left two gardens. The Jew’s dates would consume all that was in the two gardens. The Prophet ﷺ said: “Would you take part of it this year and postpone part?” But the Jew refused. The Prophet ﷺ said: O Jabir, when the time of cutting comes, inform me. So I informed him, and he came with Abu Bakr. He began cutting and measuring from the bottom of the palm trees while the Messenger of God ﷺ supplicated for blessing, until we paid him all his due from the smaller of the two gardens, as ‘Ammar estimated. Then I brought them fresh dates and water, and they ate and drank. Then he said: “This is part of the bliss about which you will be questioned.”

    أَنَّ فِيهِ وَفَاءً فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ قَالَ «إِذَا جَدَدْتَهُ فَوَضَعْتَهُ فِي الْمِرْبَدِ فَآذِنِّي» فَلَمَّا جَدَدْتَهُ فَوَضَعْتُهُ فِي الْمِرْبَدِ أَتَيْتُ رَسُولَ اللهِ ﷺ فَجَاءَ وَمَعَهُ أَبُو بَكْرٍ وَعُمَرُ فَجَلَسَ عَلَيْهِ وَدَعَا بِالْبَرَكَةِ ثُمَّ قَالَ «ادْعُ غُرَمَاءَكَ فَأَوْفِهِمْ» قَالَ فَمَا تَرَكْتُ أَحَدًا لَهُ عَلَى أَبِي دِينٌ إِلَّا قَضَيْتُهُ وَفَضَلَ لِي ثَلَاثَةَ عَشَرَ وَسْقًا فَذَكَرْتُ ذَلِكَ لَهُ فَضَحِكَ وَقَالَ ائْتِ أَبَا بَكْرٍ وَعُمَرَ فَأَخْبِرْهُمَا ذَلِكَ فَأَتَيْتُ أَبَا بَكْرٍ وَعُمَرَ فَأَخْبَرْتُهُمَا فَقَالَا قَدْ عَلِمْنَا إِذْ صَنَعَ رَسُولُ اللهِ ﷺ مَا صَنَعَ أَنَّهُ سَيَكُونُ ذَلِكَ

    ✧ He said: In it there was enough to pay. I went to the Messenger of God ﷺ and mentioned that to him. He said: “When you have cut it and placed it in the drying area, inform me.” So when I had cut it and placed it in the drying area, I went to the Messenger of God ﷺ, and he came with Abu Bakr and ‘Umar, sat on it, and supplicated for blessing. Then he said: “Call your creditors and pay them off.” He said: I did not leave anyone to whom my father owed a debt except that I paid him, and there remained for me thirteen wasqs. I mentioned that to him, and he laughed and said: “Go to Abu Bakr and ‘Umar and tell them that.” So I went to Abu Bakr and ‘Umar and told them, and they said: We already knew, when the Messenger of God ﷺ did what he did, that this would happen.

    ✧ He witnessed the Messenger of Allah ﷺ delivering a sermon to the people while on his mount, and it was chewing its cud and its saliva was flowing. The Messenger of Allah ﷺ said in his sermon, “Allah has apportioned to every person his share of inheritance, so a bequest by an heir is not valid.”

    ✧ When [the verse] “And warn your closest relatives” [al-Shuʿaraʾ 214] was revealed, the Messenger of Allah ﷺ called Quraysh and they gathered, and he addressed them generally and specifically. He said, “O Banu Kaʿb b. Luʾayy, O Banu Murrah b. Kaʿb, O Banu ʿAbd Shams, O Banu ʿAbd Manaf, O Banu Hashim, O Banu ʿAbd al-Muttalib, save yourselves from the Fire. O Fatimah, save yourself from the Fire. I do not possess for you anything from Allah, except that you have ties of kinship which I will keep moist with their due.”

    ✧ The Messenger of Allah ﷺ said, “O Banu ʿAbd Manaf, purchase yourselves from your Lord. I do not possess for you anything from Allah. O Banu ʿAbd al-Muttalib, purchase yourselves from your Lord. I do not possess for you anything from Allah, but between me and you there are ties of kinship which I shall keep moist with their due.”

    ✧ The Messenger of Allah ﷺ said when [the verse] “And warn your closest relatives” [al-Shuʿaraʾ 214] was revealed to him: “O company of Quraysh, purchase yourselves from Allah.     ✧ It was said to the Prophet ﷺ: “My mother died suddenly, and had she spoken she would have given charity. Shall I give charity on her behalf?” The Messenger of Allah ﷺ said, “Yes.” So he gave charity on her behalf.

    خَرَجَ سَعْدُ بْنُ عُبَادَةَ مَعَ النَّبِيِّ ﷺ فِي بَعْضِ مَغَازِيهِ وَحَضَرَتْ أُمَّهُ الْوَفَاةُ بِالْمَدِينَةِ فَقِيلَ لَهَا أَوْصِي فَقَالَتْ فِيمَ أُوصِي؟ الْمَالُ مَالُ سَعْدٍ فَتُوُفِّيَتْ قَبْلَ أَنْ يَقْدُمَ سَعْدٌ فَلَمَّا قَدِمَ سَعْدٌ ذَكَرَ ذَلِكَ لَهُ فَقَالَ يَا رَسُولَ اللهِ هَلْ يَنْفَعُهَا أَنْ أَتَصَدَّقَ عَنْهَا؟ فَقَالَ النَّبِيُّ ﷺ «نَعَمْ» فَقَالَ سَعْدٌ حَائِطُ كَذَا وَكَذَا صَدَقَةٌ عَنْهَا لِحَائِطٍ سَمَّاهُ

    ✧ Saʿd b. ʿUbadah went out with the Prophet ﷺ on one of his campaigns, and his mother was near death in Madinah. It was said to her, “Make a bequest.” She said, “What shall I bequeath? The wealth is Saʿd's wealth.” She died before Saʿd arrived. When Saʿd arrived, he was told of that, and he said, “O Messenger of Allah, will it benefit her if I give charity on her behalf?” The Prophet ﷺ said, “Yes.” Saʿd said, “The orchard of such-and-such is a charity on her behalf,” naming a particular orchard.

    ✧ The Messenger of Allah ﷺ said, “When a person dies, his deeds come to an end except for three: ongoing charity, knowledge that is benefited from, or a righteous child who supplicates for him.”

    أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ إِنَّ أُمِّي أَوْصَتْ أَنْ تَعْتِقَ عَنْهَا رَقَبَةً وَإِنَّ عِنْدِي جَارِيَةً نُوبِيَّةً أَفَيُجْزِئُ عَنِّي أَنْ أَعْتِقَهَا عَنْهَا؟ قَالَ «ائْتِنِي بِهَا» فَأَتَيْتُهُ بِهَا فَقَالَ لَهَا النَّبِيُّ ﷺ «مَنْ رَبُّكِ؟» قَالَتِ اللهُ قَالَ «مَنْ أَنَا؟» قَالَتْ أَنْتَ رَسُولُ اللهِ قَالَ «أَعْتِقْهَا فَإِنَّهَا مُؤْمِنَةٌ»

    ✧ I came to the Messenger of Allah ﷺ and said, “My mother bequeathed that a slave be freed on her behalf, and I have a Nubian slave-girl. Will it suffice for me to free her on her behalf?” He said, “Bring her to me.” So I brought her to him, and the Prophet ﷺ said to her, “Who is your Lord?” She said, “Allah.” He said, “Who am I?” She said, “You are the Messenger of Allah.” He said, “Free her, for she is a believer.”

    ✧ The Messenger of Allah ﷺ said to me: "O Abu Dharr, I see you are weak, and I love for you what I love for myself. Do not take charge of two people, and do not take charge of an orphan's wealth."

    ✧ A man came to the Prophet ﷺ and said: I am poor, I have nothing, and I have an orphan. He said: "Eat from the wealth of your orphan without being extravagant, without hastening, and without taking it as your own."

    لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ {وَلَا تَقْرَبُوا مَالَ الْيَتِيمِ إِلَّا بِالَّتِي هِيَ أَحْسَنُ} [الأنعام 152] وَ {إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا} [النساء 10] قَالَ اجْتَنَبَ النَّاسُ مَالَ الْيَتِيمِ وَطَعَامَهُ فَشَقَّ ذَلِكَ عَلَى النَّاسِ فَشَكَوْا ذَلِكَ إِلَى النَّبِيِّ ﷺ فَأَنْزَلَ اللهُ تَبَارَكَ وَتَعَالَى {يَسْأَلُونَكَ عَنِ الْيَتَامَى قُلْ إِصْلَاحٌ لَهُمْ خَيْرٌ} [البقرة 220] إِلَى قَوْلِهِ {لَأَعْنَتَكُمْ} [البقرة 220]

    ✧ When this verse was revealed: {Do not approach the orphan's wealth except in the best manner} [al-An'am 152] and {Indeed those who consume the wealth of orphans unjustly} [al-Nisa' 10], the people avoided the wealth and food of the orphan, and that became hard for them, so they complained to the Prophet ﷺ, and Allah, Blessed and Exalted, revealed: {They ask you about orphans; say: Setting things right for them is best} [al-Baqarah 220] up to His saying {He would have put you in difficulty} [al-Baqarah 220].

    ✧ Regarding His saying, Exalted be He: {Indeed those who consume the wealth of orphans unjustly} [al-Nisa' 10], he said: An orphan would be in the care of a man, and he would set aside his food and drink for him, and that became hard for the Muslims, so Allah, Blessed and Exalted, revealed: {And if you mix with them, they are your brothers} [al-Baqarah 220], and He allowed mixing with them.

    أَنَّ رَسُولَ اللهِ ﷺ قَالَ «اجْتَنِبُوا السَّبْعَ الْمُوبِقَاتِ» قِيلَ يَا رَسُولَ اللهِ مَا هِيَ؟ قَالَ «الشِّرْكُ بِاللهِ وَالسِّحْرُ وَقَتْلُ النَّفْسِ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَأَكْلُ الرِّبَا وَأَكْلُ مَالِ الْيَتِيمِ وَالتَّوَلِّي يَوْمَ الزَّحْفِ وَقَذْفُ الْمُحْصَنَاتِ الْغَافِلَاتِ الْمُؤْمِنَاتِ»

    ✧ The Messenger of Allah ﷺ said: "Avoid the seven destructive sins." It was said: O Messenger of Allah, what are they? He said: "Associating partners with Allah, sorcery, killing a soul which Allah has forbidden except by right, consuming interest, consuming the wealth of an orphan, fleeing on the day of battle, and slandering chaste, believing women who are unaware."
