34. Gifting of Slaves

   أَنَّ أَبَاهُ نَحَلَهُ غُلَامًا فَأَتَى النَّبِيَّ ﷺ يُشْهِدُهُ فَقَالَ «أَكُلَّ وَلَدِكَ نَحَلْتَ؟» قَالَ لَا قَالَ «فَارْدُدْهُ» وَاللَّفْظُ لِمُحَمَّدٍ

   ✧ His father gave him a slave, so he brought the Prophet ﷺ to bear witness. He said: "Did you give this to all your children?" He said: No. He said: "Then take it back." The wording is Muhammad's.

   أَنَّ أَبَاهُ أَتَى بِهِ رَسُولَ اللهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي غُلَامًا كَانَ لِي فَقَالَ رَسُولُ اللهِ ﷺ «أَكُلَّ وَلَدِكَ نَحَلْتَهُ؟» قَالَ لَا قَالَ رَسُولُ اللهِ ﷺ «فَارْجِعْهُ»

   ✧ His father brought him to the Messenger of Allah ﷺ and said: I have given my son a slave that I owned. The Messenger of Allah ﷺ said: "Did you give this to all your children?" He said: No. The Messenger of Allah ﷺ said: "Then take it back."

   أَنَّ أَبَاهُ بَشِيرَ بْنَ سَعْدٍ جَاءَ بِابْنِهِ النُّعْمَانِ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلَامًا كَانَ لِي فَقَالَ رَسُولُ اللهِ ﷺ «أَكُلَّ بَنِيكَ نَحَلْتَ؟» قَالَ لَا قَالَ «فَارْجِعْهُ»

   ✧ His father Bashir b. Sa'd brought his son al-Nu'man to the Messenger of Allah ﷺ and said: O Messenger of Allah, I have given this son of mine a slave that I owned. The Messenger of Allah ﷺ said: "Did you give this to all your children?" He said: No. He said: "Then take it back."

   أَنَّهُ جَاءَ إِلَى النَّبِيِّ ﷺ بِالنُّعْمَانِ بْنِ بَشِيرٍ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلَامًا فَإِنْ رَأَيْتَ أَنْ أَنْفِذَهُ أَنْفَذْتُهُ فَقَالَ رَسُولُ اللهِ ﷺ «أَكُلَّ بَنِيكَ نَحَلْتَهُ؟» قَالَ لَا قَالَ «فَارْدُدْهُ»

   ✧ He came to the Prophet ﷺ with al-Nu'man b. Bashir and said: I have given this son of mine a slave; if you think I should execute it, I will execute it. The Messenger of Allah ﷺ said: "Did you give this to all your children?" He said: No. He said: "Then take it back."

   أَنْ يُشْهِدَ النَّبِيَّ ﷺ فَقَالَ «كُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ ذَا؟» قَالَ لَا قَالَ «فَارْدُدْهُ»

   ✧ Should the Prophet ﷺ bear witness? He said: "Did you give all your children the like of this?" He said: No. He said: "Then take it back."

   لَهُ أُمَّهُ أَشْهِدِ النَّبِيَّ ﷺ عَلَى مَا نَحَلْتَ ابْنِي فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَكَرِهَ النَّبِيُّ ﷺ أَنْ يَشْهَدَ لَهُ

   ✧ His mother said to him: Have the Prophet ﷺ bear witness to what you have given my son. So he came to the Prophet ﷺ and mentioned that to him, and the Prophet ﷺ disliked bearing witness for him.

   أَنَّ بَشِيرًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا نَبِيَّ اللهِ إِنِّي نَحَلْتُ النُّعْمَانَ نِحْلَةً قَالَ «أَعْطَيْتَ إِخْوَتَهُ؟» قَالَ لَا قَالَ «فَارْدُدْهُ»

   ✧ That Bashir came to the Prophet ﷺ and said, "O Prophet of Allah, I have given al-Nu'man a gift." He said, "Did you give his brothers?" He said, "No." He said, "Then take it back."

   انْطَلَقَ بِهِ أَبُوهُ يَحْمِلُهُ إِلَى النَّبِيِّ ﷺ فَقَالَ اشْهَدْ أَنِّي قَدْ نَحَلْتُ النُّعْمَانَ مِنْ مَالِي كَذَا وَكَذَا قَالَ «كُلَّ بَنِيكَ نَحَلْتَ مِثْلَ الَّذِي نَحَلْتَ النُّعْمَانَ؟»

   ✧ His father went carrying him to the Prophet ﷺ and said, "Bear witness that I have given al-Nu'man such-and-such from my property." He said, "Have you given all your sons the like of what you have given al-Nu'man?"

   أَنَّ أَبَاهُ أَتَى بِهِ النَّبِيَّ ﷺ يُشْهِدُهُ عَلَى نُحْلٍ نَحَلَهُ إِيَّاهُ فَقَالَ «أَكُلَّ وَلَدِكَ نَحَلْتَ مِثْلَ الَّذِي نَحَلْتَهُ؟» قَالَ لَا قَالَ «فَأَشْهِدْ عَلَى هَذَا غَيْرِي أَلَيْسَ يَسُرُّكَ أَنْ يَكُونُوا إِلَيْكَ فِي الْبِرِّ سَوَاءً؟» قَالَ بَلَى قَالَ «فَلَا إِذًا»

   ✧ That his father brought him to the Prophet ﷺ to witness a gift he had given him. He said, "Have you given all your children the like of what you have given him?" He said, "No." He said, "Then have someone other than me witness this. Would it not please you that they be equal to you in dutifulness?" He said, "Yes." He said, "Then no."

    أَنَّ أُمَّهُ ابْنَةَ رَوَاحَةَ سَأَلَتْ أَبَاهُ بَعْضَ الْمَوْهِبَةِ مِنْ مَالِهِ لِابْنِهَا فَالْتَوَى بِهَا سَنَةً ثُمَّ بَدَا لَهُ فَوَهَبَهَا لَهُ فَقَالَتْ لَا أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللهِ ﷺ عَلَى مَا وَهَبْتَ لِابْنِي فَأَخَذَ أَبِي بِيَدِي وَأَنَا غُلَامٌ يَوْمَئِذٍ فَأَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ أُمَّ هَذَا ابْنَةَ رَوَاحَةَ قَاتَلَتْنِي مُنْذُ سَنَةٍ عَلَى بَعْضِ الْمَوْهِبَةِ مِنْ مَالِي لِابْنِي هَذَا وَقَدْ بَدَا لِي فَوَهَبْتُهَا لَهُ وَقَدْ أَعْجَبَهَا أَنْ أُشْهِدَكَ عَلَى الَّذِي وَهَبْتُ لَهُ فَقَالَ رَسُولُ اللهِ ﷺ «يَا بَشِيرُ أَلَكَ وَلَدٌ سِوَى هَذَا؟» قَالَ نَعَمْ فَقَالَ رَسُولُ اللهِ ﷺ «أَفَكُلُّهُمْ وَهَبْتَ لَهُمْ مِثْلَ الَّذِي وَهَبْتَ لِابْنِكَ هَذَا؟» قَالَ لَا قَالَ رَسُولُ اللهِ ﷺ «فَلَا تُشْهِدْنِي إِذًا فَإِنِّي لَا أَشْهَدُ عَلَى جَوْرٍ»

    ✧ That his mother, the daughter of Rawahah, asked his father for some of his property as a gift for her son. He delayed for a year, then it occurred to him and he gave it to him. She said, "I will not be satisfied until you have the Messenger of Allah ﷺ witness what you have given to my son." So my father took me by the hand, and I was a boy that day, and came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, the mother of this one, the daughter of Rawahah, has been fighting me for a year over some of my property as a gift for this son of mine. It has occurred to me, and I have given it to him. It pleased her that I have you witness what I have given to him." The Messenger of Allah ﷺ said, "O Bashir, do you have a son other than this one?" He said, "Yes." The Messenger of Allah ﷺ said, "Have you given all of them the like of what you have given this son of yours?" He said, "No." The Messenger of Allah ﷺ said, "Then do not have me witness, for I do not witness injustice."

    لَا أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللهِ ﷺ قَالَ فَأَخَذَ أَبِي بِيَدِي وَأَنَا غُلَامٌ فَأَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ أُمَّ هَذَا ابْنَةَ رَوَاحَةَ زَاوَلَتْنِي بَعْضَ الْمَوْهِبَةِ لَهُ وَقَدْ وَهَبْتُهَا لَهُ وَقَدْ أَعْجَبَهَا أَنْ نُشْهِدَكَ عَلَى ذَلِكَ قَالَ «يَا بَشِيرُ أَلَكَ ابْنٌ غَيْرُ هَذَا؟» قَالَ نَعَمْ قَالَ «فَوَهَبْتَ لَهُ مِثْلَ مَا وَهَبْتَ لِهَذَا؟» قَالَ لَا قَالَ «فَلَا تُشْهِدْنِي إِذًا فَإِنِّي لَا أَشْهَدُ عَلَى جَوْرٍ»

    ✧ "I will not be satisfied until you have the Messenger of Allah ﷺ witness." He said, "My father took me by the hand, and I was a boy, and came to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, the mother of this one, the daughter of Rawahah, has been dealing with me about some of the gift for him, and I have given it to him. It pleased her that we have you witness that.' He said, 'O Bashir, do you have a son other than this one?' He said, 'Yes.' He said, 'Have you given him the like of what you have given this one?' He said, 'No.' He said, 'Then do not have me witness, for I do not witness injustice.'"

    أَنَّ بَشِيرَ بْنَ سَعْدٍ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ امْرَأَتِي عَمْرَةَ بِنْتَ رَوَاحَةَ أَمَرَتْنِي أَنْ أَتَصَدَّقَ عَلَى ابْنِهَا نُعْمَانَ بِصَدَقَةٍ وَأَمَرَتْنِي أَنْ أُشْهِدَكَ عَلَى ذَلِكَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ بَنُونَ سِوَاهُ؟» قَالَ نَعَمْ قَالَ «فَأَعْطَيْتَهُمْ مِثْلَ مَا أَعْطَيْتَ هَذَا؟» قَالَ لَا قَالَ «فَلَا تُشْهِدْنِي عَلَى جَوْرٍ»

    ✧ That Bashir b. Sa'd came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, my wife 'Amrah bt. Rawahah commanded me to give charity to her son Nu'man and commanded me to have you witness that." The Prophet ﷺ said to him, "Do you have sons other than him?" He said, "Yes." He said, "Have you given them the like of what you have given this one?" He said, "No." He said, "Then do not have me witness injustice."

    أَنَّ رَجُلًا أَتَى النَّبِيِّ ﷺ فَقَالَ إِنِّي تَصَدَّقْتُ عَلَى ابْنِي بِصَدَقَةٍ فَاشْهَدْ فَقَالَ «هَلْ لَكَ وَلَدٌ غَيْرُهُ؟» قَالَ نَعَمْ قَالَ «أَعْطَيْتَهُمْ كَمَا أَعْطَيْتَهُ؟» قَالَ لَا قَالَ «لَا أَشْهَدُ عَلَى جَوْرٍ»

    ✧ That a man came to the Prophet ﷺ and said, "I have given charity to my son, so bear witness." He said, "Do you have a child other than him?" He said, "Yes." He said, "Have you given them as you have given him?" He said, "No." He said, "I do not witness injustice."

    سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ يَقُولُ ذَهَبَ بِي أَبِي إِلَى النَّبِيِّ ﷺ يُشْهِدُهُ عَلَى شَيْءٍ أَعْطَانِيهِ فَقَالَ «أَلَكَ وَلَدٌ غَيْرُهُ؟» قَالَ نَعَمْ وَصَفَّ بِيَدِهِ بِكَفِّهِ أَجْمَعَ كَذَا «أَلَا سَوَّيْتَ بَيْنَهُمْ»

    ✧ I heard al-Nu'man b. Bashir say, "My father took me to the Prophet ﷺ to have him witness something he had given me. He said, 'Do you have a child other than him?' He said, 'Yes,' and he gestured with his hand and his whole palm, like this. 'Why did you not make them equal?'"

    سَمِعْتُ النُّعْمَانَ بْنَ بَشِيرٍ يَقُولُ وَهُوَ يَخْطُبُ انْطَلَقَ بِي أَبِي إِلَى رَسُولِ اللهِ ﷺ؛ لِيُشْهِدَهُ عَلَى عَطِيَّةٍ أَعْطَانِيهَا فَقَالَ «هَلْ لَكَ بَنُونَ سِوَاهُ؟» قَالَ نَعَمْ قَالَ «سَوِّ بَيْنَهُمْ»

    ✧ I heard al-Nu'man b. Bashir say while he was giving a sermon, "My father took me to the Messenger of Allah ﷺ to have him witness a gift he had given me. He said, 'Do you have sons other than him?' He said, 'Yes.' He said, 'Make them equal.'"

    قَالَ رَسُولُ اللهِ ﷺ «اعْدِلُوا بَيْنَ أَبْنَائِكُمْ اعْدِلُوا بَيْنَ أَبْنَائِكُمْ»

    ✧ The Messenger of Allah ﷺ said, "Be just among your children, be just among your children."
