20. Penalty for Drinking Intoxicants

    «قُمْ يَا حَسَنُ فَاجْلِدْهُ وَفِيمَ أَنْتَ وَهَذَا وَلِّ غَيْرُكَ» قَالَ بَلْ ضَعُفْتُ وَوَهَنْتُ وَعَجَزْتُ قُمْ يَا عَبْدَ اللهِ بْنَ جَعْفَرٍ فَاجْلِدْهُ قَالَ فَجَعَلَ يَجْلِدُهُ وَعَلِيٌّ يَعُدُّ حَتَّى بَلَغَ أَرْبَعِينَ فَقَالَ أَمْسِكْ جَلَدَ نَبِيُّ اللهِ ﷺ وَأَبُو بَكْرٍ أَرْبَعِينَ وَكَمَّلَهَا عُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ

    ✧ "Stand, O Hasan, and flog him. And what are you to this? Appoint someone else." He said, "Rather, I have become weak and feeble and incapable. Stand, O 'Abd Allah b. Ja'far, and flog him." He said: So he began to flog him while 'Ali counted until it reached forty. Then he said, "Stop. The Prophet of Allah ﷺ and Abu Bakr flogged forty lashes, and 'Umar completed it to eighty. Each is a Sunnah."

    ✧ 'Ali said, "The Prophet ﷺ flogged forty, Abu Bakr forty, and 'Umar eighty. Each is a Sunnah."

    قَالَ عَلِيٌّ مَا مِنْ رَجُلٍ أَقَمْتُ عَلَيْهِ حَدًّا فَمَاتَ فَأَجِدُ فِي نَفْسِي إِلَّا الْخَمْرَ فَإِنَّهُ إِنْ مَاتَ فِيهِ وَدَيْتُهُ أَنَّ رَسُولَ اللهِ ﷺ «لَمْ يَسُنَّهُ»

    ✧ 'Ali said, "Never have I carried out a prescribed punishment on a man and he died, then I felt uneasy within myself, except in the case of wine, for if he dies from it, I would pay his blood money, because the Messenger of Allah ﷺ did not institute that."

    سَمِعْتُ عَلِيًّا يَقُولُ «مَنْ أَقَمْنَا عَلَيْهِ حَدًّا فَمَاتَ مِنْهُ فَلَا دِيَةَ لَهُ إِلَّا مَنْ ضَرَبْنَاهُ فِي الْخَمْرِ فَإِنَّمَا هُوَ شَيْءٌ صَنَعْنَاهُ»

    ✧ I heard 'Ali say, "Whoever we carry out a prescribed punishment on and he dies from it, there is no blood money for him, except one whom we beat for wine, for that is only something we did on our own."

    أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَجَلَدَهُ بِجَرِيدَتَيْنِ نَحْوًا مِنْ أَرْبَعِينَ وَفَعَلَهُ أَبُو بَكْرٍ فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَخَفُّ الْحُدُودِ ثَمَانُونَ فَأَمَرَ بِهِ عُمَرُ

    ✧ The Prophet ﷺ was brought a man who had drunk wine, and he flogged him with two palm branches, about forty lashes. Abu Bakr did the same. When 'Umar came, he consulted the people, and 'Abd al-Rahman b. 'Awf said, "The lightest of the prescribed punishments is eighty." So 'Umar ordered that.

    ✧ The Messenger of Allah ﷺ was brought a man who had drunk wine, and he beat him with sandals, about forty lashes. Then Abu Bakr was brought him and did the same. Then 'Umar was brought him, and he mentioned something similar.

    ✧ The Messenger of Allah ﷺ flogged for wine with palm branches and sandals.

    سَمِعْتُ السَّائِبَ بْنَ يَزِيدَ يَقُولُ «كُنَّا فِي زَمَنِ النَّبِيِّ ﷺ وَأَبِي بَكْرٍ وَبَعْضِ زَمَانِ عُمَرَ حَتَّى عَتَوْا فِيهَا يَعْنِي فِي الْخَمْرِ فَجَلَدَهُمْ أَرْبَعِينَ فَلَمْ يَنْكُلُوا فَجَلَدَ ثَمَانِينَ»

    ✧ I heard al-Sa'ib b. Yazid say: We were in the time of the Prophet ﷺ, Abu Bakr, and part of Umar's time, until they became defiant regarding it—meaning wine—so he flogged them forty lashes, but they did not stop, so he flogged eighty.

    «كُنَّا نُؤْتَى بِالشَّارِبِ فِي عَهْدِ رَسُولِ اللهِ ﷺ وَعَهْدِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمَارَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَأَرْدِيَتِنَا وَنِعَالِنَا حَتَّى كَانَ وَسَطَ إِمَارَةِ عُمَرَ فَجَلَدَ فِيهَا أَرْبَعِينَ حَتَّى إِذَا عَتَوْا وَفَسَقُوا جُلِدَ فِيهَا ثَمَانِينَ»

    We used to strike the drunks with our hands, shoes, clothes (by twisting it into the shape of lashes) during the lifetime of the Prophet, Abu Bakr and the early part of ʿUmar's caliphate. But during the last period of ʿUmar's caliphate, he used to give the drunk forty lashes; and when drunks became mischievous and disobedient, he used to scourge them eighty lashes.     «كُنَّا نُؤْتَى بِالشَّارِبِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَفِي إِمْرَةِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمْرَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَنِعَالِنَا وَأَرْدِيَتِنَا»

    ✧ A drinker would be brought to us in the time of the Messenger of Allah ﷺ, during the rule of Abu Bakr, and in the early part of Umar's rule, and we would stand against him and strike him with our hands, our sandals, and our cloaks.

    رَأَيْتُ رَسُولَ اللهِ ﷺ يَوْمَ حُنَيْنٍ يَسْأَلُ عَنْ مَنْزِلِ خَالِدٍ فَأُتِيَ بِسَكْرَانَ «فَأَمَرَ رَسُولُ اللهِ ﷺ مَنْ كَانَ عِنْدَهُ أَنْ يَضْرِبُوهُ بِمَا فِي أَيْدِيهِمْ وَحَثَا رَسُولُ اللهِ ﷺ التُّرَابَ عَلَيْهِ فَلَمَّا كَانَ أَبُو بَكْرٍ أُتِيَ بِسَكْرَانَ فَتَوَخَّى الَّذِي كَانَ مِنْ ضَرْبِهِمْ يَوْمَئِذٍ فَضَرَبَ أَرْبَعِينَ»

    ✧ I saw the Messenger of Allah ﷺ on the day of Hunayn asking about the dwelling of Khalid, and a drunkard was brought to him. The Messenger of Allah ﷺ ordered those with him to strike him with what they had in their hands, and the Messenger of Allah ﷺ threw dust at him. Then when Abu Bakr came, a drunkard was brought, and he sought to match the way they had struck that day, and he struck forty lashes.

    ✧ He attended the Messenger of Allah ﷺ when he was throwing dust in their faces.

    أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِشَارِبٍ يَوْمَ حُنَيْنٍ فَحَثَى فِي وَجْهِهِ التُّرَابَ ثُمَّ أَمَرَ أَصْحَابَهُ فَضَرَبُوهُ بِنِعَالِهِمْ وَبِمَا كَانَ فِي أَيْدِيهِمْ حَتَّى قَالَ لَهُمْ «ارْفَعُوا» فَرَفَعُوا فَتُوُفِّيَ رَسُولُ اللهِ ﷺ وَتِلْكَ سُنَّةٌ قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ

    ✧ The Messenger of Allah ﷺ was brought a drinker on the day of Hunayn, and he threw dust in his face. Then he ordered his companions, and they struck him with their sandals and with whatever was in their hands, until he said to them, "Lift [your hands]." So they lifted. Then the Messenger of Allah ﷺ passed away, and that is a sunnah. Abu Abd al-Rahman said: This is more correct than the one before it.

    أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ سَكْرَانَ فَقَالَ «اضْرِبُوهُ فَضَرَبُوهُ بِنِعَالِهِمْ»

    ✧ The Messenger of Allah ﷺ was brought a drunk man, and he said, "Strike him," so they struck him with their sandals.

    ✧ The Messenger of Allah ﷺ said, "Stand against him and strike him." So the people stood and struck him with their sandals.

    أَبُو هُرَيْرَةَ إِنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ قَدْ شَرِبَ فَقَالَ رَسُولُ اللهِ ﷺ «اضْرِبُوهُ» فَمِنَّا الضَّارِبُ بِيَدِهِ وَالضَّارِبُ بِنَعْلِهِ وَالضَّارِبُ بِثَوْبِهِ فَلَمَّا انْصَرَفَ قَالَ بَعْضُ الْقَوْمِ أَخْزَاكَ اللهُ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقُولُوا هَكَذَا لَا تُعِينُوا عَلَيْهِ الشَّيْطَانَ وَلَكِنْ قُولُوا رَحِمَكَ اللهُ»

    ✧ Abu Hurayrah: The Messenger of Allah ﷺ was brought a man who had drunk. The Messenger of Allah ﷺ said, "Strike him." So among us were those who struck with his hand, those who struck with his sandal, and those who struck with his garment. When he left, some of the people said, "May Allah disgrace you." The Messenger of Allah ﷺ said, "Do not say that. Do not help Satan against him. Rather say, 'May Allah have mercy on you.'"

    أَنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعِصِيِّ حَتَّى تُوُفِّيَ رَسُولُ اللهِ ﷺ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ أَكْثَرَ مِنْهُمْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَقَالَ أَبُو بَكْرٍ لَوْ فَرَضْنَا لَهُمْ حَدًّا فَتَوَخَّى نَحْوَ مَا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَكَانَ أَبُو بَكْرٍ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ كَانَ عُمَرُ بَعْدُ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ قَدْ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لَمْ تَجْلِدْنِي بَيْنِي وَبَيْنَكَ كِتَابُ اللهِ قَالَ عُمَرُ وَأَيُّ كِتَابِ اللهِ تَجِدُ أَنْ لَا أَجْلِدَكَ؟ قَالَ لَهُ إِنَّ اللهَ يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ فَأَنَا مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا شَهِدْتُ مَعَ رَسُولِ اللهِ ﷺ بَدْرًا وَأُحُدًا وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَؤُلَاءِ الْآيَاتِ أُنْزِلْنَ عُذْرًا لِلْمَاضِينَ وَحُجَّةً عَلَى الْبَاقِينَ فَعُذْرُ الْمَاضِينَ بِأَنَّهُمْ لَقُوا اللهَ قَبْلَ أَنْ تُحَرَّمَ عَلَيْهِمُ الْخَمْرُ وَحُجَّةٌ عَلَى الْبَاقِينَ؛ لِأَنَّ اللهَ يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ} [المائدة 90] الْآيَةَ ثُمَّ قَرَأَ أَيْضًا الْآيَةَ الْأُخْرَى فَإِنْ كَانَ مِنَ {الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا} فَإِنَّ اللهَ قَدْ نَهَاهُ أَنْ يَشْرَبَ الْخَمْرَ فَقَالَ عُمَرُ صَدَقْتَ فَمَا تَرَوْنَ؟ فَقَالَ عَلِيٌّ إِنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ

    ✧ The drinkers were beaten during the time of the Messenger of Allah ﷺ with hands, sandals, and sticks until the Messenger of Allah ﷺ passed away. They were more numerous during the caliphate of Abu Bakr than during the time of the Messenger of Allah ﷺ. Abu Bakr said, "If we assigned them a fixed penalty," so he sought to match what they had been beaten with during the time of the Messenger of Allah ﷺ. Abu Bakr flogged them forty lashes until he passed away. Then Umar came after him and flogged them likewise forty lashes, until a man from the first emigrants who had drunk was brought to him. He ordered that he be flogged. He said, "You will not flog me; between me and you is the Book of Allah." Umar said, "And in which Book of Allah do you find that I should not flog you?" He said to him, "Allah says in His Book: {There is no sin on those who believe and do righteous deeds for what they have eaten} [al-Ma'idah 93], the verse. I am of those who believed and did righteous deeds, then feared and believed, then feared and did good. I witnessed with the Messenger of Allah ﷺ Badr, Uhud, the Trench, and the other battles." Umar said, "Will you not answer what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who passed and a proof against those who remain. The excuse for those who passed is that they met Allah before wine was forbidden to them, and a proof against those who remain; because Allah says: {O you who believe, wine, gambling, sacrificial stones, and divining arrows are only an abomination of Satan's work} [al-Ma'idah 90], the verse. Then he also recited the other verse. If he is of those who {believed and did righteous deeds, then feared and believed, then feared and did good}, then Allah has forbidden him to drink wine." Umar said, "You have spoken truly. What do you think?" Ali said, "When he drinks, he becomes intoxicated; when he becomes intoxicated, he raves; when he raves, he fabricates lies; and the liar is to be given eighty lashes." So Umar ordered, and he was flogged eighty.

    لَأَنَّ اللهَ يَقُولُ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ} [المائدة 93] وَأَنَا مِنْهُمْ أَيْ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ وَمِنْ أَهْلِ بَدْرٍ وَأَهْلِ أُحُدٍ فَقَالَ لِلْقَوْمِ أَجِيبُوا الرَّجُلَ فَسَكَتُوا فَقَالَ لِابْنِ عَبَّاسٍ أَجِبْهُ فَقَالَ إِنَّمَا أَنْزَلَهَا عُذْرًا لِمَنْ شَرِبَهَا مِنَ الْمَاضِينَ قَبْلَ أَنْ تُحَرَّمَ وَأَنْزَلَ {إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ} [المائدة 90] مِنْ عَمَلِ الشَّيْطَانِ حُجَّةٌ عَلَى الْبَاقِينَ ثُمَّ سَأَلَ مَنْ عِنْدَهُ عَنِ الْحَدِّ فِيهَا فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ إِنَّهُ إِذَا شَرِبَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى فَاجْلِدُوهُ ثَمَانِينَ

    ✧ Because Allah says: {There is no sin on those who believe and do righteous deeds for what they have eaten, if they fear and believe and do righteous deeds} [al-Ma'idah 93], and I am of them—that is, of the first emigrants, of the people of Badr and the people of Uhud. He said to the people, "Answer the man." They were silent. He said to Ibn Abbas, "Answer him." He said, "He only revealed it as an excuse for those who drank it among those who passed before it was forbidden, and He revealed {Wine, gambling, sacrificial stones, and divining arrows are only an abomination} [al-Ma'idah 90] of Satan's work as a proof against those who remain." Then he asked those with him about the penalty for it. Ali b. Abi Talib said, "When he drinks, he raves; when he raves, he fabricates lies; so flog him eighty."

    لَمْ يُقْتِ رَسُولُ اللهِ ﷺ فِي الْخَمْرِ حَدًّا قَالَ ابْنُ عَبَّاسٍ فَشَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي الْفَجِّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا حَاذَى دَارَ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ فَذُكِرَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ «أَفَعَلَهَا وَلَمْ يَأْمُرْ فِيهِ بِشَيْءٍ»

    ✧ The Messenger of Allah ﷺ did not set a fixed penalty for wine. Ibn Abbas ؓ said: A man drank and became drunk, and he was found staggering in the mountain pass. He was taken to the Prophet ﷺ, and when they brought him near the house of al-Abbas, he broke loose and entered upon al-Abbas and clung to him. That was mentioned to the Prophet ﷺ, and he laughed and said, "Did he do that?" And he did not order anything concerning him.

    أَنَّ النَّبِيَّ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا فَقَالَ ابْنُ عَبَّاسٍ شَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي فَجٍّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا أَنْ حَاذَوْا بِهِ دَارَ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى عَبَّاسٍ فَالْتَزَمَهُ مِنْ وَرَائِهِ فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ أَقَدْ فَعَلَهَا ثُمَّ لَمْ يَأْمُرْ فِيهِ بِشَيْءٍ

    ✧ The Prophet ﷺ did not set a fixed penalty for wine. Ibn Abbas ؓ said: A man drank and became drunk, and he was found staggering in a mountain pass. He was taken to the Prophet ﷺ, and when they brought him near the house of al-Abbas, he broke loose and entered upon Abbas and clung to him from behind. They mentioned that to the Prophet ﷺ, and he laughed and said, "Did he do that?" Then he did not order anything concerning him.

    أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ نَشْوَانَ فَقَالَ إِنِّي لَمْ أَشْرَبْ خَمْرًا إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا فِي دُبَّاءٍ قَالَ «فَبُهِزَ بِالْأَيْدِي وَخُفِقَ بِالنِّعَالِ وَنَهَى عَنِ الزَّبِيبِ وَالتَّمْرِ أَنْ يُخْلَطَا»

    ✧ A man who was intoxicated was brought to the Prophet ﷺ. He said, "I did not drink wine; I only drank raisin and date infusion in a gourd." He ﷺ said, "He was struck with hands and beaten with sandals, and he prohibited mixing raisins and dates."

    أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ سَكْرَانَ فَضَرَبَهُ فَقَالَ لَهُ «أَيُّ شَيْءٍ شَرِبْتَ؟» قَالَ نَبِيذٌ قَالَ «أَيُّ نَبِيذٍ» قَالَ نَبِيذُ تَمْرٍ وَزَبِيبٍ قَالَ «لَا تَخْلِطُوهَا كُلُّ وَاحِدٍ يَكْفِي وَحْدَهُ»

    ✧ A drunk man was brought to the Prophet ﷺ, and he flogged him. He said to him, "What did you drink?" He said, "Nabidh." He said, "What kind of nabidh?" He said, "Nabidh of dates and raisins." He said, "Do not mix them; each one is sufficient on its own."

    أُتِيَ بِالنُّعْمَانِ وَهُوَ سَكْرَانُ فَشَقَّ عَلَى النَّبِيِّ ﷺ مَشَقَّةً شَدِيدَةً «فَأَمَرَ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبُوهُ فَضَرَبُوهُ بِالنِّعَالِ وَالْجَرِيدِ فَكُنْتُ فِيمَنْ ضَرَبَهُ»

    ✧ Al-Nu'man was brought while he was drunk, and it was very hard on the Prophet ﷺ. He ordered those in the house to beat him, so they beat him with sandals and palm stalks. I was among those who beat him.

    أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ وَذَكَرَ كَلِمَةً مَعْنَاهَا فَاقْتُلُوهُ» خَالَفَهُ عَاصِمُ بْنُ بَهْدَلَةَ

    ✧ The Prophet ﷺ said: "Whoever drinks wine, flog him; then if he drinks, flog him; then if he drinks, flog him; then if he drinks for the fourth time"—and he mentioned a word meaning "kill him." Asim b. Bahdalah contradicted him.

    ✧ "When a man drinks, flog him; then if he does it again, flog him; then if he does it a fourth time, kill him." A man from among us was brought to the Messenger of God ﷺ, and he did not kill him.

    قَالَ رَسُولُ اللهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاضْرِبُوهُ فَإِنْ عَادَ فَاضْرِبُوهُ فَإِنْ عَادَ فَاضْرِبُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاضْرِبُوا عُنُقَهُ» فَضَرَبَ رَسُولُ اللهِ ﷺ نُعَيْمَانَ أَرْبَعَ مَرَّاتٍ فَرَأَى الْمُسْلِمُونَ أَنَّ الْحَدَّ قَدْ وَقَعَ وَأَنَّ الْقَتْلَ قَدْ رُفِعَ

    ✧ The Messenger of God ﷺ said: "Whoever drinks wine, flog him; then if he does it again, flog him; then if he does it again, flog him; then if he does it a fourth time, strike his neck." The Messenger of God ﷺ flogged Nu'ayman four times, and the Muslims saw that the legal penalty had been applied and that killing had been lifted.
