أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الرَّحِيمِ بْنِ الْبَرْقِيُّ قَالَ حَدَّثَنَا سَعِيدُ بْنُ عُفَيْرٍ قَالَ حَدَّثَنَا يَحْيَى بْنُ فُلَيْحِ بْنِ سُلَيْمَانَ الْمَدَنِيُّ عَنْ ثَوْرِ بْنِ زَيْدٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ
أَنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعِصِيِّ حَتَّى تُوُفِّيَ رَسُولُ اللهِ ﷺ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ أَكْثَرَ مِنْهُمْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَقَالَ أَبُو بَكْرٍ لَوْ فَرَضْنَا لَهُمْ حَدًّا فَتَوَخَّى نَحْوَ مَا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَكَانَ أَبُو بَكْرٍ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ كَانَ عُمَرُ بَعْدُ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ قَدْ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لَمْ تَجْلِدْنِي بَيْنِي وَبَيْنَكَ كِتَابُ اللهِ قَالَ عُمَرُ وَأَيُّ كِتَابِ اللهِ تَجِدُ أَنْ لَا أَجْلِدَكَ؟ قَالَ لَهُ إِنَّ اللهَ يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ فَأَنَا مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا شَهِدْتُ مَعَ رَسُولِ اللهِ ﷺ بَدْرًا وَأُحُدًا وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَؤُلَاءِ الْآيَاتِ أُنْزِلْنَ عُذْرًا لِلْمَاضِينَ وَحُجَّةً عَلَى الْبَاقِينَ فَعُذْرُ الْمَاضِينَ بِأَنَّهُمْ لَقُوا اللهَ قَبْلَ أَنْ تُحَرَّمَ عَلَيْهِمُ الْخَمْرُ وَحُجَّةٌ عَلَى الْبَاقِينَ؛ لِأَنَّ اللهَ يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ} [المائدة 90] الْآيَةَ ثُمَّ قَرَأَ أَيْضًا الْآيَةَ الْأُخْرَى فَإِنْ كَانَ مِنَ {الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا} فَإِنَّ اللهَ قَدْ نَهَاهُ أَنْ يَشْرَبَ الْخَمْرَ فَقَالَ عُمَرُ صَدَقْتَ فَمَا تَرَوْنَ؟ فَقَالَ عَلِيٌّ إِنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ

✧ The drinkers were beaten during the time of the Messenger of Allah ﷺ with hands, sandals, and sticks until the Messenger of Allah ﷺ passed away. They were more numerous during the caliphate of Abu Bakr than during the time of the Messenger of Allah ﷺ. Abu Bakr said, "If we assigned them a fixed penalty," so he sought to match what they had been beaten with during the time of the Messenger of Allah ﷺ. Abu Bakr flogged them forty lashes until he passed away. Then Umar came after him and flogged them likewise forty lashes, until a man from the first emigrants who had drunk was brought to him. He ordered that he be flogged. He said, "You will not flog me; between me and you is the Book of Allah." Umar said, "And in which Book of Allah do you find that I should not flog you?" He said to him, "Allah says in His Book: {There is no sin on those who believe and do righteous deeds for what they have eaten} [al-Ma'idah 93], the verse. I am of those who believed and did righteous deeds, then feared and believed, then feared and did good. I witnessed with the Messenger of Allah ﷺ Badr, Uhud, the Trench, and the other battles." Umar said, "Will you not answer what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who passed and a proof against those who remain. The excuse for those who passed is that they met Allah before wine was forbidden to them, and a proof against those who remain; because Allah says: {O you who believe, wine, gambling, sacrificial stones, and divining arrows are only an abomination of Satan's work} [al-Ma'idah 90], the verse. Then he also recited the other verse. If he is of those who {believed and did righteous deeds, then feared and believed, then feared and did good}, then Allah has forbidden him to drink wine." Umar said, "You have spoken truly. What do you think?" Ali said, "When he drinks, he becomes intoxicated; when he becomes intoxicated, he raves; when he raves, he fabricates lies; and the liar is to be given eighty lashes." So Umar ordered, and he was flogged eighty.
