أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الرَّحِيمِ قَالَ حَدَّثَنَا سَعِيدُ بْنُ أَبِي مَرْيَمَ قَالَ حَدَّثَنَا يَحْيَى بْنُ فُلَيْحِ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنِي ثَوْرُ بْنُ زَيْدٍ الدِّيلِيُّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ قُدَامَةَ بْنَ مَظْعُونٍ شَرِبَ الْخَمْرَ بِالْبَحْرَيْنِ فَشَهِدَ عَلَيْهِ ثُمَّ سُئِلَ فَأَقَرَّ أَنَّهُ شَرِبَهُ فَقَالَ لَهُ عُمَرُ بْنُ الْخَطَّابِ §مَا حَمَلَكَ عَلَى ذَلِكَ فَقَالَ

لَأَنَّ اللهَ يَقُولُ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ} [المائدة 93] وَأَنَا مِنْهُمْ أَيْ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ وَمِنْ أَهْلِ بَدْرٍ وَأَهْلِ أُحُدٍ فَقَالَ لِلْقَوْمِ أَجِيبُوا الرَّجُلَ فَسَكَتُوا فَقَالَ لِابْنِ عَبَّاسٍ أَجِبْهُ فَقَالَ إِنَّمَا أَنْزَلَهَا عُذْرًا لِمَنْ شَرِبَهَا مِنَ الْمَاضِينَ قَبْلَ أَنْ تُحَرَّمَ وَأَنْزَلَ {إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ} [المائدة 90] مِنْ عَمَلِ الشَّيْطَانِ حُجَّةٌ عَلَى الْبَاقِينَ ثُمَّ سَأَلَ مَنْ عِنْدَهُ عَنِ الْحَدِّ فِيهَا فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ إِنَّهُ إِذَا شَرِبَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى فَاجْلِدُوهُ ثَمَانِينَ

✧ Because Allah says: {There is no sin on those who believe and do righteous deeds for what they have eaten, if they fear and believe and do righteous deeds} [al-Ma'idah 93], and I am of them—that is, of the first emigrants, of the people of Badr and the people of Uhud. He said to the people, "Answer the man." They were silent. He said to Ibn Abbas, "Answer him." He said, "He only revealed it as an excuse for those who drank it among those who passed before it was forbidden, and He revealed {Wine, gambling, sacrificial stones, and divining arrows are only an abomination} [al-Ma'idah 90] of Satan's work as a proof against those who remain." Then he asked those with him about the penalty for it. Ali b. Abi Talib said, "When he drinks, he raves; when he raves, he fabricates lies; so flog him eighty."
