كَانَ الْمُغِيرَةُ بْنُ شُعْبَةَ إِذَا غَزَا مَعَ النَّبِيِّ ﷺ حَمَلَ مَعَهُ رُمْحًا فَإِذَا رَجَعَ طَرَحَهُ كَيْمَا يَحْمِلُ فَقَالَ لَهُ عَلِيٌّ لَأَذْكُرَنَّ هَذَا لِلنَّبِيِّ ﷺ فَقَالَ «لَا تَفْعَلْ فَإِنَّكَ إِذَا فَعَلْتَ بِهَا فَلَمْ تَحْمِلْ ضَالَّةً»
✧ When al-Mughirah b. Shu'bah went on a military expedition with the Prophet ﷺ, he would carry a spear with him. When he returned, he would throw it away so that he could carry (something else). Ali said to him: I will certainly mention this to the Prophet ﷺ. He said: 'Do not do that, for if you do that with it, then you have not carried a stray.'

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ أَخَذَ لُقَطَةً فَلْيُشْهِدْ ذَوِي عَدْلٍ وَلْيَحْفَظْ عِفَاصَهَا وَوِكَاءَهَا وَلَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِنْ جَاءَ صَاحِبُهَا فَهُوَ أَحَقُّ بِهَا وَإِنْ لَمْ يَجِئْ صَاحِبُهَا فَهُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»
✧ The Messenger of Allah ﷺ said: 'Whoever takes a lost item should have two just witnesses testify, and he should preserve its container and its string, and he should not conceal it or hide it. If its owner comes, he is more entitled to it. If its owner does not come, then it is the wealth of Allah which He gives to whom He wills.'

✧ The Messenger of Allah ﷺ was asked about a lost item. He said: 'It should be announced and not hidden or concealed. If its owner comes, it is his; otherwise, it is the wealth of Allah which He gives to whom He wills.'

بَيْنَا نَحْنُ مَعَ رَسُولِ اللهِ ﷺ فِي بَعْضِ أَسْفَارِهِ وَفِي الظَّهْرِ قِلَّةٌ تَذَاكَرَ الْقَوْمُ الظَّهْرَ بَيْنَهُمْ قُلْتُ يَا رَسُولَ اللهِ لَقَدْ عَلِمْتُ مَا يَكْفِينَا مِنَ الظَّهْرِ قَالَ «مَا يَكْفِينَا؟» قُلْتُ ذَوْدٌ يَعْنِي نَأْتِي عَلَيْهِنَّ فَنَتَوَسَّعُ بِظُهُورِهِنَّ فَقَالَ «لَا ضَالَّةُ الْمُسْلِمِ حَرَقُ النَّارِ فَلَا تَقْرَبَنَّهَا» ثَلَاثًا قَالَ «اللُّقَطَةُ وَالضَّالَّةُ تَجِدُهَا فَأَنْشِدْهَا فَإِنْ عَرَفْتَ فَأَدِّهَا وَإِلَّا فَمَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»
✧ While we were with the Messenger of Allah ﷺ on one of his journeys, and there was a shortage of riding animals, the people discussed the riding animals among themselves. I said: O Messenger of Allah, I know what riding animals would suffice us. He said: 'What would suffice us?' I said: A small herd, meaning we could come upon them and make use of their backs. He said: 'No, the stray of a Muslim is the burning of fire, so do not approach it' three times. He said: 'A lost item or a stray that you find, announce it. If you recognize it, then return it; otherwise, it is the wealth of Allah which He gives to whom He wills.'

✧ The Messenger of Allah ﷺ was asked about a lost item. He said: 'Announce it for a year. If you do not recognize it, then know its container and its string, then consume it. If its owner comes, then give it to him.' [346] 5780 from Harun b. Abdullah from Ibn Abi Fudayk and Abu Bakr al-Hanafi, both from al-Dahhak b. Uthman with it.

✧ A man asked the Prophet ﷺ about a stray camel and asked him about lost property. He said: “Note its purse-string, its tie, and its number, then announce it for a year. If its owner comes and recognizes its purse-string, its number, and its tie, then give it to him.”

✧ A man asked the Messenger of Allah ﷺ about lost property. He said: “Announce it for a year, then note its tie and its purse-string, then spend it. If its owner comes, then return it to him.” Abu Abd al-Rahman said to us: This hadith has been narrated from Ismail b. Umayyah from Rabi'ah from Abdullah b. Yazid from a man as a mursal report with different wording.

✧ From a man among the Companions of the Prophet ﷺ, from the Prophet ﷺ, that he was asked about a stray animal. He said: “Note its purse-string and its tie, then announce it for three days at the door of the mosque. If its owner comes, hand it over to him; and if he does not come, then announce it for a year. If its owner comes (give it to him); otherwise, it is your business.” Abu Abd al-Rahman said to us: This hadith has been narrated by Abbad b. Ishaq from Abdullah b. Yazid from his father from Zayd b. Khalid.

✧ He said: The Messenger of Allah ﷺ was asked about a stray sheep and was asked about lost property. He said: “Announce it for a year. If its owner comes, hand it over to him; otherwise, note its tie—or he said: its purse-string—then put it into your own wealth. If its owner comes, hand it over to him.”

لِي عَرِّفْهَا حَوْلًا فَلَمَّا كَانَ عِنْدَ قَرْنِ الْحَوْلِ لَقِيتُهُ بِهَا فَقُلْتُ إِنِّي قَدْ عَرَّفْتُهَا فَلَمْ تُعْتَرَفْ فَقَالَ هِيَ لَكَ إِنَّ رَسُولَ اللهِ ﷺ «أَمَرَنَا بِذَلِكَ» قُلْتُ لَا حَاجَةَ لِي بِهَا فَأَمَرَ بِهَا فَأُلْقِيَتْ فِي بَيْتِ الْمَالِ
✧ I found a purse in the time of the Messenger of Allah ﷺ, so I brought it to him. He said: “Announce it for a year.” When it was near the completion of the year, I met him with it and said: “I have announced it, but it was not recognized.” He said: “It is yours. The Messenger of Allah ﷺ commanded us to do this.” I said: “I have no need of it.” So he ordered that it be put in the public treasury.

عَرِّفْهَا سَنَةً فَإِنْ عُرِفَتْ فَذَلِكَ وَإِلَّا فَهِيَ لَكَ فَلَمْ تُعْرَفْ فَلَقِيتُهُ مِنَ الْعَامِ الْمُقْبِلِ مِنَ الْمَوْسِمِ فَذَكَرْتُهَا لَهُ فَقَالَ هِيَ لَكَ إِنَّ رَسُولَ اللهِ ﷺ «أَمَرَنَا بِذَلِكَ» قَالَ لَا حَاجَةَ لِي بِهَا فَقَبَضَهَا عُمَرُ وَجَعَلَهَا فِي بَيْتِ الْمَالِ
✧ I found a purse in the time of the Messenger of Allah ﷺ, so I brought it to him. He said: “Announce it for a year. If it is recognized, fine; otherwise, it is yours.” It was not recognized, so I met him in the following year during the pilgrimage season and mentioned it to him. He said: “It is yours. The Messenger of Allah ﷺ commanded us to do this.” I said: “I have no need of it.” So Umar took it and placed it in the public treasury.

أَسْتَمْتِعْ بِهِ فَإِنْ جَاءَ صَاحِبُهُ أَدَّيْتُهُ إِلَيْهِ خَيْرٌ مِنْ أَنْ أَتْرُكَهُ لِتَأْكُلَهُ السِّبَاعُ فَلَقِيَ أُبَيَّ بْنَ كَعْبٍ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ أَصَبْتَ وَأَخْطَأَ فَقَالَ أُبَيُّ بْنُ كَعْبٍ وَجَدْتُ مِائَةَ دِينَارٍ فِي زَمَنِ رَسُولِ اللهِ ﷺ فَجِئْتُ بِهَا إِلَيْهِ فَقَالَ «عَرِّفْهَا عَامًا» فَعَرَّفْتُهَا فَلَمْ تُعْرَفْ فَرَجَعْتُ فَقَالَ «عَرِّفْهَا عَامًا عَرِّفْهَا عَامًا» مَرَّتَيْنِ أَوْ ثَلَاثًا ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «اعْرِفْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا وَاخْلِطْهَا لِمَالِكِ فَإِنْ جَاءَ رَبُّهَا فَأَدِّهَا إِلَيْهِ»
✧ I said: I will make use of it, and if its owner comes, I will return it to him; that is better than leaving it for wild animals to eat. Then he met Ubayy b. Ka'b and mentioned that to him. He said: “You are right in some ways and wrong in others.” Ubayy b. Ka'b said: “I found a hundred dinars during the time of the Messenger of Allah ﷺ, so I brought them to him. He said: ‘Announce it for a year.’ I announced it, but it was not recognized, so I returned. He said: ‘Announce it for a year; announce it for a year’—two or three times. Then the Messenger of Allah ﷺ said: ‘Note its number, its container, and its tie, and mix it with your wealth. If its owner comes, then return it to him.’”

لِي الْتَقَطْتُ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ بِهَا النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا حَوْلًا فَقُلْتُ قَدْ عَرَّفْتُهَا حَوْلًا فَقَالَ «عَرِّفْهَا سَنَةً أُخْرَى» فَعَرَّفْتُهَا سَنَةً أُخْرَى ثُمَّ أَتَيْتُهُ فَقُلْتُ عَرَّفْتُهَا سَنَةً فَقَالَ عَرِّفْهَا سَنَةً أُخْرَى ثُمَّ أَتَيْتُهُ فَقُلْتُ عَرَّفْتُهَا قَالَ «انْتَفِعْ بِهَا وَاعْرِفْ وِكَاءَهَا وَخِرَقتهَا وَأَحْصِ عَدَدَهَا فَإِنْ جَاءَ صَاحِبُهَا» قَالَ جَرِيرٌ لَمْ أَحْفَظْ بَعْدُ يَعْنِي هَذَا
✧ I found a purse containing a hundred dinars, so I brought it to the Prophet ﷺ and mentioned that to him. He said: “Announce it for a year.” I announced it for a year, then I said: “I have announced it for a year.” He said: “Announce it for another year.” I announced it for another year, then I came to him and said: “I have announced it for a year.” He said: “Announce it for another year.” Then I came to him and said: “I have announced it.” He said: “Make use of it, and note its tie and its cloth, and count its number, if its owner comes.” Jarir said: “I did not memorize after that, meaning this.”

✧ I found a purse containing a hundred dinars during the time of the Messenger of Allah ﷺ, so I brought it to the Prophet ﷺ. He said: “Announce it for a year.” I announced it, but I did not find anyone who recognized it, so I came to him. He said: “Announce it for a year.” I announced it, but I did not find anyone who recognized it, so I came to him. He said: “Announce it for a year.” I announced it, but I did not find anyone who recognized it, so I came to him. He said: “Memorize its number, its container, and its tie, and make use of it.” So I made use of it. [5792] Amr b. Yazid informed us, he said: Bahz narrated to us, he said: Shu'bah narrated to us with this chain something similar. Shu'bah said: I heard it after ten years, and he said: “Announce it for one year.” [351] [5793] Amr b. Ali informed us, he said: Muhammad narrated to us, he said: Shu'bah narrated to us with this chain something similar. He said: I met him after that in Makkah, and he said: “I do not know whether it was three years or one year.”

أَحْسَنْتَ وَجَدْتُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ رَسُولَ اللهِ ﷺ بِهَا فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ إِلَى الْحَوْلِ الثَّانِي فَقَالَ «عَرِّفْهَا» فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ فَقَالَ «عَرِّفْهَا» فَعَرَّفْتُهَا ثُمَّ أَتَيْتُهُ الثَّالِثَ فَقَالَ «اعْلَمْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا فَإِنْ جَاءَ أَحَدٌ يُخْبِرُ بِعَدَدِهَا وَوِعَائِهَا وَوِكَائِهَا فَأَعْطِهَا إِيَّاهُ وَإِلَّا فَاسْتَنْفِعْ بِهَا»
✧ You have done well. I found a purse containing a hundred dinars during the time of the Messenger of Allah ﷺ, so I brought it to the Messenger of Allah ﷺ. He said: “Announce it for a year.” I announced it for a year, then I came to him in the second year. He said: “Announce it.” I announced it for a year, then I came to him. He said: “Announce it.” I announced it, then I came to him the third time. He said: “Know its number, its container, and its tie. If anyone comes and informs you of its number, its container, and its tie, then give it to him; otherwise, make use of it.”

عَنْ رَسُولِ اللهِ ﷺ وَسُئِلَ عَنِ اللُّقَطَةِ فَقَالَ «مَا كَانَ مِنْهَا فِي الطَّرِيقِ الْمِيتَاءِ وَالْقَرْيَةِ الْجَامِعَةِ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا فَادْفَعْهَا إِلَيْهِ وَإِنْ لَمْ يَأْتِ فَهِيَ لَكَ وَمَا كَانَ فِي الْخَرِبِ فَفِيهَا وَفِي الرِّكَازِ الْخُمُسُ»
✧ It was narrated from the Messenger of Allah ﷺ that he was asked about a found item, and he said: "Whatever is found in a well-trodden road or in a populous village, announce it for a year. If its owner comes, give it to him; if he does not come, it is yours. Whatever is found in ruins—in that, as well as in buried treasure, is one-fifth."

أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ كَيْفَ فِيمَا وُجِدَ فِي الطَّرِيقِ الْمِيتَاءِ أَوْ فِي الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ «عَرِّفْ سَنَةً فَإِنْ جَاءَ بَاغِيَةٌ فَادْفَعْهُ إِلَيْهِ وَإِلَّا فَشَأْنُكَ بِهِ» قَالَ «فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ وَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِيتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ»
✧ A man came to the Messenger of Allah ﷺ and said: "How about what is found in a well-trodden road or in an inhabited village?" He said: "Announce it for a year. If its seeker comes, give it to him; otherwise it is your concern." He said: "If its claimant comes one day later, return it to him. Whatever is found in a road that is not well-trodden or in an uninhabited village—in that, as well as in buried treasure, is one-fifth."

سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ «مَا كَانَ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَلَكَ وَمَا لَمْ يَكُنْ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ» خَالَفَهُ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ
✧ The Messenger of Allah ﷺ was asked about a found item, and he said: "Whatever is found in a frequented road or in a populated village, announce it for a year. If its owner comes, [return it]; otherwise it is yours. Whatever is not in a frequented road or in a populated village—in that, as well as in buried treasure, is one-fifth." Muhammad b. ʿAbd Allah al-Ansari disagreed with him.

عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ ذَكَرَ أَنَّ رَجُلًا مِنْ بَنِي إِسْرَائِيلَ سَأَلَ بَعْضَ بَنِي إِسْرَائِيلَ أَنْ يُسْلِفَهُ أَلْفَ دِينَارٍ قَالَ ائْتِنِي بِشُهَدَاءَ أُشْهِدُهُمْ قَالَ كَفَى بِاللهِ شَهِيدًا قَالَ ائْتِنِي بِكَفِيلٍ قَالَ كَفَى بِاللهِ كَفِيلًا قَالَ صَدَقْتَ فَدَفَعَهَا إِلَيْهِ إِلَى أَجَلٍ مُسَمَّى فَخَرَجَ فِي الْبَحْرِ فَقَضَى حَاجَتَهُ ثُمَّ الْتَمَسَ مَرْكَبًا يَقْدُمُ عَلَيْهِ لِلْأَجَلِ الَّذِي أَجَّلَهُ فَلَمْ يَجِدْ مَرْكَبًا فَأَخَذَ خَشَبَةً فَنَقَرَهَا فَأَدْخَلَ فِيهَا أَلْفَ دِينَارٍ وَصَحِيفَةً مَعَهَا إِلَى صَاحِبِهَا ثُمَّ زَجَّجَ مَوْضِعَهَا ثُمَّ أَتَى بِهَا الْبَحْرَ ثُمَّ قَالَ اللهُمَّ إِنَّكَ قَدْ عَلِمْتَ أَنِّي اسْتَسْلَفْتُ فُلَانًا أَلْفَ دِينَارٍ فَسَأَلَنِي كَفِيلًا فَقُلْتُ كَفَى بِاللهِ كَفِيلًا فَرَضِيَ بِكَ وَسَأَلَنِي شَهِيدًا فَقُلْتُ كَفَى بِاللهِ شَهِيدًا فَرَضِىَ بِكَ وَإِنِّي قَدْ جَهِدْتُ أَنْ أَجِدَ مَرْكَبًا أَبْعَثُ إِلَيْهِ بِالَّذِي أَعْطَانِي فَلَمْ أَجِدْ مَرْكَبًا فَإِنِّي أَسْتَوْدِعَكَهَا فَرَمَى بِهَا الْبَحْرَ حَتَّى وَلِجَتْ فِيهِ ثُمَّ انْصَرَفَ وَهُوَ فِي ذَلِكَ يَطْلُبُ مَرْكَبًا يَخْرُجُ إِلَى بَلَدِهِ فَخَرَجَ الرَّجُلُ الَّذِي كَانَ أَسْلَفَهُ يَنْظُرُ لَعَلَّ مَرْكَبًا يَجِيئُهُ بِمَالِهِ فَإِذَا بِالْخَشَبَةِ الَّتِي فِيهَا الْمَالُ فَأَخَذَهَا لِأَهْلِهِ حَطَبًا فَلَمَّا كَسَرَهَا وَجَدَ الْمَالَ وَالصَّحِيفَةَ ثُمَّ قَدِمَ الرَّجُلُ الَّذِي كَانَ تَسَلَّفَ مِنْهُ فَأَتَاهُ بِأَلْفِ دِينَارٍ وَقَالَ وَاللهِ مَازِلْتُ جَاهِدًا فِي طَلَبِ مَرْكَبٍ لِآتِيَكَ بِمَالِكَ فَمَا وَجَدْتُ مَرْكَبًا قَبْلَ الَّذِي أَتَيْتُ فِيهِ قَالَ هَلْ كُنْتَ بَعَثْتَ إِلَيَّ بِشَيْءٍ؟ قَالَ أَلَمْ أُخْبِرْكَ أَنِّي لَمْ أَجِدْ مَرْكَبًا قَبْلَ هَذَا الَّذِي جِئْتُ فِيهِ؟ قَالَ فَإِنَّ اللهَ قَدْ أَدَّى عَنْكَ الَّذِي بَعَثْتَ بِهِ فِي الْخَشَبَةِ فَانْصَرَفْ بِأَلْفِكَ رَاشِدًا
✧ It was narrated from the Messenger of Allah ﷺ that he mentioned that a man from the Children of Israel asked one of the Children of Israel to lend him a thousand dinars. He said: "Bring me witnesses that I may call them to witness." He said: "Allah is sufficient as a witness." He said: "Bring me a guarantor." He said: "Allah is sufficient as a guarantor." He said: "You have spoken the truth," so he gave it to him for a fixed term. He went out to sea and fulfilled his need. Then he sought a ship that would bring him back by the appointed term, but he found no ship. So he took a piece of wood, hollowed it out, placed inside it a thousand dinars and a letter to its owner, then sealed its opening and brought it to the sea. Then he said: "O Allah, You know that I borrowed a thousand dinars from so-and-so. He asked me for a guarantor and I said: Allah is sufficient as a guarantor, and he accepted You. He asked me for a witness and I said: Allah is sufficient as a witness, and he accepted You. I have exerted myself to find a ship to send him what he gave me, but I found no ship. I entrust it to You." Then he threw it into the sea until it went in, then departed, still seeking a ship to return to his land. The man who had lent him went out looking, hoping a ship might bring him his wealth, and there was the piece of wood containing the money. He took it for his family as firewood, but when he broke it open, he found the money and the letter. Then the man who had borrowed from him arrived and brought him a thousand dinars, saying: "By Allah, I kept striving to find a ship to bring you your money, but I found no ship before the one on which I came." He said: "Did you send me anything?" He said: "Did I not tell you that I found no ship before the one on which I came?" He said: "Allah has delivered on your behalf what you sent in the piece of wood. Take your thousand dinars and depart, rightly guided."
