56. Conditions and Stipulations

    عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ نَسِيَ صَلَاةً أَوْ نَامَ عَنْهَا فَكَفَّارَتُهَا أَنْ يُصَلِّيَهَا إِذَا ذَكَرَهَا»

    ✧ The Prophet ﷺ said: "Whoever forgets a prayer or sleeps through it, its expiation is that he prays it when he remembers it."

    أَنَّ النَّبِيَّ ﷺ «رَأَى نُخَامَةً فِي قِبْلَةِ الْمَسْجِدِ فَحَكَّهَا بِحَصَاةٍ ثُمَّ نَهَى أَنْ يَبْزُقَ الرَّجُلُ عَنْ يَمِينِهِ أَوْ أَمَامَهُ وَلَكِنْ يَبْزُقُ عَنْ يَسَارِهِ أَوْ تَحْتَ قَدَمِهِ الْيُسْرَى»

    ✧ The Prophet ﷺ saw sputum in the qiblah of the mosque, so he scraped it with a pebble. Then he forbade a man from spitting to his right or in front of him, but rather he should spit to his left or under his left foot.

    فَرَضَ رَسُولُ اللهِ ﷺ صَدَقَةَ الْفِطْرِ عَلَى الصَّغِيرِ وَالْكَبِيرِ وَالذَّكَرِ وَالْأُنْثَى وَالْحُرِّ وَالْعَبْدِ صَاعًا مِن تَمْرٍ أَوْ صَاعًا مِنْ شَعِيرٍ [354] 11658 وَعَنْ قُتَيْبَةَ عَنِ اللَّيْثِ عَنْ نَافِعٍ بِهِ 11659 وَعَنْ قُتَيْبَةَ عَنْ مَالِكٍ عَنْ نَافِعٍ بِهِ

    ✧ The Messenger of Allah ﷺ made the zakat al-fitr obligatory upon the young and the old, the male and the female, the free and the slave: a sa' of dates or a sa' of barley. [354] 11658 And from Qutaybah, from al-Layth, from Nafi', likewise. 11659 And from Qutaybah, from Malik, from Nafi', likewise.

    عَنِ النَّبِيِّ ﷺ قَالَ «لَيَلِيَنِّي مِنْكُمْ أُولُو الْأَحْلَامِ وَالنُّهَى ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ وَلَا تَخْتَلِفُوا فَتَخْتَلِف قُلُوبُكُمْ وَإِيَّاكُمْ وَهَوَشَاتِ الْأَسْوَاقِ»

    ✧ The Prophet ﷺ said: "Let those of you who possess maturity and intellect stand closest to me, then those who follow them, then those who follow them. And do not differ, lest your hearts differ. And beware of the clamor of the marketplaces."

    أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ يَسْتَأْمِرُهُ فِي ذَلِكَ فَقَالَ «إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَحَّبَسَ أَصْلَهَا أَنْ لَا يُبَاعَ وَلَا يُوهَبَ وَلَا يُورَثَ فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْقُرْبَى وَالرِّقَابِ وَفِي الْمَسَاكِينِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مِن وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ فِيهِ

    ✧ Umar acquired a piece of land in Khaybar, so he came to the Prophet ﷺ to consult him about it. He said, "If you wish, you may make its principal an endowment and give it in charity." So he made its principal an endowment, not to be sold, gifted, or inherited, and he gave it in charity to the poor, the relatives, the slaves, the needy, the wayfarer, and the guest. There is no blame on the one who manages it if he eats from it in a reasonable manner or feeds a friend, without seeking to accumulate wealth from it.

    أَنْ رَجُلًا أَفْطَرَ فِي رَمَضَانَ فِي زَمَانِ النَّبِيِّ ﷺ «فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُكَفِّرَ بِعِتْقِ رَقَبَةٍ أَوْ صِيَامِ شَهْرَيْنِ أَوْ إِطْعَامِ سِتِّينَ مِسْكِينًا» قَالَ فَقَالَ لَا أَجِدُ فَأُتِي النَّبِيُّ ﷺ بِعَرَقِ تَمْرٍ فَقَالَ «خُذْ هَذَا فَتَصَدَّقَ بِهِ» فَقَالَ يَا رَسُولَ اللهِ لَا أَجِدُ أَحْوَجَ إِلَيْهِ مِنِّي فَقَالَ فَضَحِكَ رَسُولُ اللهِ ﷺ حَتَّى بَدَتْ أَنْيَابُهُ ثُمَّ قَالَ «كُلْهِ»

    (A man broke his fast intentionally) during Ramadan. The Messenger of Allah ﷺ commanded him to emancipate a slave, or fast for two months, or feed sixty poor men. He said: I cannot provide. The Messenger of Allah ﷺ said: Sit down. Thereafter a huge basket of dates ('araq) was brought to the Messenger of Allah ﷺ. He said: Take this and give it as sadaqah (alms). He said: Messenger of Allah, there is no poorer than I. The Messenger of Allah ﷺ thereupon laughed so that his canine teeth became visible and said: Eat it yourself. Abu Dawud said: Ibn Juraij narrated it from al-Zuhri in the wordings of the narrator Malik that a man broke his fast. This version says: You should either free a slave, or fast for two months, or provide food for sixty poor men. (Using translation from Abū Dāʾūd 2392)

    أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِي لِلْأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا»

    ✧ The Messenger of Allah ﷺ said: "Whichever woman is given in marriage by two guardians, she belongs to the first of them. And whoever sells a sale to two men, it belongs to the first of them."

    عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ أَحَقَّ الشُّرُوطِ أَنْ تُوَفُّوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ»

    ✧ The Prophet ﷺ said: "The conditions most deserving to be fulfilled are those by which you make the private parts lawful."

    كُنْتُ مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ فَأَعْيَا جَمَلِي فَأَرَدْتُ أَنْ أُسَيِّبَهُ فَلَحِقَنِي رَسُولُ اللهِ ﷺ فَدَعَا لَهُ وَضَرَبَهُ فَسَارَ سَيْرًا لَمْ يَسِرْ مِثْلَهُ قَالَ «بِعْنِيهِ بِوُقِيَّةٍ» قُلْتُ لَا قَالَ «بِعْنِيهِ» فَبِعْتُهُ بِوُقِيَّةٍ وَاسْتَثْنَيْتُ حُمْلَانَهُ إِلَى الْمَدِينَةِ فَلَمَّا بَلَغَنَا الْمَدِينَةَ أَتَيْتُهُ بِالْجَمَلِ وَانْتَقَدْتُ ثَمَنَهُ ثُمَّ رَجَعْتُ فَأَرْسَلَ إِلَيَّ فَقَالَ «أَتُرَانِي إِنَّمَا مَاكَسْتُكَ لِآخُذَ جَمَلَكَ؟ خُذْ جَمَلَكَ وَدَرَاهِمَكَ»

    ✧ I was with the Prophet ﷺ on a journey, and my camel became exhausted. I wanted to let it go, but the Messenger of Allah ﷺ caught up with me and supplicated for it and struck it, so it traveled as it had never traveled before. He said: “Sell it to me for an uqiyyah.” I said: No. He said: “Sell it to me.” So I sold it to him for an uqiyyah and stipulated that I would ride it to Madinah. When we reached Madinah, I brought him the camel and received its price, then I left. He sent for me and said: “Do you think I haggled with you only to take your camel? Take your camel and your dirhams.”

    قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِن صِدْقًا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»

    The Prophet ﷺ said, "The buyer and the seller have the option of canceling or confirming the bargain unless they separate, and if they spoke the truth and made clear the defects of the goods, them they would be blessed in their bargain, and if they told lies and hid some facts, their bargain would be deprived of Allah's blessings."     ✧ The Messenger of Allah ﷺ said: “The two parties to a sale have no binding sale between them until they separate, except in a sale with an option.”

    ✧ "The Messenger of Allah, may Allah bless him and grant him peace, said: 'The two parties in a transaction have the option [to cancel the transaction] as long as they have not separated, or one of them says to the other 'choose [whether to proceed with the transaction or not].'" And from Ziyad ibn Ayoub, from Ismail ibn Ulayyah, from Ayoub with the same narration. And from Ali ibn Maymun al-Raqqi, from Sufyan, from Ibn Jurayj, from Nafi', with the same narration. And from Amr ibn Ali, from Yahya ibn Saeed al-Qattan, from Ubaidullah ibn Umar, from Nafi', with the same narration. And from Qutaibah, from Layth, from Nafi', with the same narration. And from Muhammad ibn Salamah and Harith ibn Muskin, both from Ibn al-Qasim, from Malik, from Nafi', with the same narration."

    «نَهَانِي رَسُولُ اللهِ ﷺ أَنْ أَبِيعَ مَا لَيْسَ عِنْدِي» 11679 وَعَنِ الْحَسَنِ بْنِ إِسْحَاقَ الْمَرْوَزِيِّ عَنْ خَالِدِ بْنِ خِدَاشٍ عَنْ حَمَّادِ بْنِ زَيْدٍ عَنْ يَحْيَى بْنِ عَتِيقٍ عَنِ ابْنِ سِيرِينَ عَنْ أَيُّوبَ بِهِ قَالَ حَمَّادٌ وحَدَّثَنِيهِ أَيُّوبُ 11680 وَعَنْ حُمَيْدِ بْنِ مَسْعَدَةَ عَنْ عَبْدِ الْوَارِثِ عَنْ أَيُّوبَ بِهِ 11681 عَنْ عِمْرَانَ بْنِ يَزِيدَ عَنْ مَرْوَانَ الْفَزَارِيِّ عَنْ عَوْفٍ وَذَكَرَ آخَرَ كِلَاهُمَا عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ حَكِيمِ بْنِ حِزَامٍ عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ

    ✧ "The Messenger of Allah ﷺ forbade me from selling what I do not possess." [358] 11679 It was narrated from Al-Hasan ibn Ishaaq Al-Marwazi, from Khalid ibn Khidash, from Hammad ibn Zaid, from Yahya ibn Atiq, from Ibn Sirin, from Ayyub bihi, who said: Hammad narrated it to me from Ayyub, 11680 and Humaid ibn Mas'adah narrated it from Abdul-Warith, from Ayyub with the same chain of narration. 11681 And Imran ibn Yazid narrated it from Marwan Al-Fazari, from Auf, and they both mentioned it from Muhammad ibn Sirin, from Hakim ibn Hizam, from the Prophet ﷺ with a similar wording.

    ✧ The Messenger of Allah ﷺ said, "It is not permissible to make a sale of a debt, nor two conditions in a sale, nor a sale of that which is not in your possession." (11683) And from Ziyad ibn Ayyub, from Ismail, from Ayyub (11684) And from Muhammad ibn Rafi', from Abdul Razzaq, from Ma'mar, from Ayyub (11685) And from Ibrahim ibn Muhammad At-Taymi, from Yahya ibn Sa'id, from Husayn Al-Muallim, from Amr ibn Shu'aib (11686) And from Ismail ibn Mas'ood, from Khalid ibn Al-Harith, from Husayn Al-Muallim, from Amr ibn Shu'aib (11687) And from Harun ibn Ishaq, from Abdah ibn Sulayman, from Sa'eed ibn Abi 'Arubah, from Matar Al-Warraq, from Amr ibn Shu'aib.

    قَالَ لِيَ الْعَدَّاءُ بْنُ خَالِدٍ أَلَا أُقْرِئَكَ كِتَابًا كَتَبَهُ لِي رَسُولُ اللهِ ﷺ؟ قَالَ قُلْتُ بَلَى فَأَخْرَجَ لِي كِتَابًا «هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ مِنْ مُحَمَّدٍ ﷺ اشْتَرَى مِنْهُ عَبْدًا أَوْ أُمَّةً لَا دَاءَ وَلَا غَائِلَةَ وَلَا خِبْثَةَ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ»

    ✧ Al-‘Adda’ b. Khalid said to me: Shall I not read to you a document that the Messenger of Allah ﷺ wrote for me? He said: I said: Yes. So he brought out for me a document: “This is what al-‘Adda’ b. Khalid b. Hawdhah purchased from Muhammad ﷺ. He purchased from him a male slave or a female slave, with no defect, no treachery, and no deception – an exchange between one Muslim and another Muslim.”

    قَالَ رَسُولُ اللهِ ﷺ «الرَّجُلُ أَحَقُ بِعَيْنِ مَالِهِ إِذَا وَجَدَهُ وَيَتْبَعُ الْبَيْعَ مِنْ بَاعَهُ»

    ✧ The Messenger of Allah ﷺ said: “A man is more entitled to his property when he finds it, and he may pursue the sale against the one who sold it.”

    «أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَعَنِ الثُّنْيَا إِلَّا أَنْ يَعْلَمَ»

    ✧ That the Prophet ﷺ forbade muhaqalah, muzabanah, mukhabarah, and exceptions unless they are specified.

    قَالَ رَسُولُ اللهِ ﷺ «مَنْ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا فِيهَا ثَمَرَةٌ قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» اللَّفْظُ لِمُحَمَّدٍ

    The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision.     عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا فِيهَا ثَمَرَةٌ قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» وَقَالَ أَبُو عَبْدِ الرَّحْمَنِ مَطَرُ بْنُ طَهْمَانَ ضَعِيفٌ

    ✧ From the Prophet ﷺ: “Whoever sells a slave, the slave’s property belongs to the seller unless the buyer stipulates it. And whoever sells palm trees that have been pollinated, their fruit belongs to the seller unless the buyer stipulates it.” Abu ‘Abd al-Rahman said: Matar b. Tahman is weak.

    ✧ The Messenger of Allah ﷺ said: “A town-dweller must not sell on behalf of a desert-dweller; do not bid against one another to raise the price; a man must not bargain over the bargain of his brother; a man must not propose marriage to a woman when his brother has already proposed; a woman must not ask for the divorce of her sister so that she may empty her vessel; let her marry, for she will have only what Allah has decreed for her.”

    ✧ I asked the Messenger of Allah ﷺ about Barirah, and I wanted to buy her and stipulate the wala’ for her people. He said: “Buy her, for the wala’ belongs to the one who manumits.” He said: And she was given the choice, and her husband was a slave. Then he said after that: “I do not know, I do not know.” And some meat was brought to the Messenger of Allah ﷺ, and they said: “This is from what was given as charity to Barirah.” He said: “It is charity for her and a gift for us.”

    ✧ Her people said: “If you wish, you can pay the rest of her kitabah, and the wala’ will be ours.” When the Prophet ﷺ came, she mentioned that to him, and he said: “Buy her and manumit her, for the wala’ belongs to the one who manumits.” Then the Messenger of Allah ﷺ ascended the pulpit and said: “What is the matter with people who impose conditions that are not in the Book of Allah? Whoever imposes a condition that is not in the Book of Allah, it is not valid for him, even if he imposes a hundred conditions.”

    أَنَّ رَجُلَيْنِ أَتَيَا رَسُولَ اللهِ ﷺ يَخْتَصِمَانِ إِلَيْهِ فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجْلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَى بِامْرَأَتِهِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمَائَةِ شَاةٍ وَجَارِيَةٍ ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مَائَةٍ وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ قَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ» وَجَلَدَ ابْنَهُ مَائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا أَنْ يُرْجَمَ امْرَأَةَ الْآخَرِ إِنِ اعْتَرَفَتْ فَاعْتَرَفَتْ فَرَجَمَهَا

    ✧ Two men came to the Messenger of Allah ﷺ disputing before him. One of them said, "Judge between us by the Book of Allah." The other, who was the more knowledgeable of the two, said, "Yes, judge between us by the Book of Allah, and allow me to speak." He said, "Speak." He said, "My son was a laborer for this man, and he committed adultery with his wife. He informed me that my son must be stoned, so I ransomed him with a hundred sheep and a slave girl. Then I asked the people of knowledge, and they told me that my son should receive a hundred lashes and banishment for a year, and that stoning is only for his wife." The Messenger of Allah ﷺ said, "By the One in Whose hand is my soul, I will judge between you by the Book of Allah. Your sheep and your slave girl are returned to you." He gave his son a hundred lashes and banished him for a year, and he ordered Unays to stone the other man's wife if she confessed. She confessed, so he stoned her.

    ✧ On the day of Hudaybiyyah, the Prophet of Allah ﷺ made peace with the polytheists. He said to 'Ali, "Write, O 'Ali: This is what Muhammad, the Messenger of Allah, has agreed to." They said, "If we knew that you were the Messenger of Allah, we would not have fought you." The Messenger of Allah ﷺ said, "Erase it, O 'Ali. O Allah, You know that I am the Messenger of Allah. Erase it, O 'Ali, and write: This is what Muhammad b. 'Abd Allah has agreed to." Abridged. It is an abridgment from the hadith of al-Haruriyyah.

    ✧ From the Companions of the Messenger of Allah ﷺ: When Suhayl b. 'Amr made the treaty that day, among the conditions Suhayl b. 'Amr imposed on the Prophet ﷺ was that no one from us should come to you, even if he follows your religion, unless you return him to us and leave us to deal with him. The believers disliked that and were angered by it, but Suhayl refused anything else. So the Prophet ﷺ made the treaty with him on that basis. He returned Abu Jandal that day to his father, Suhayl b. 'Amr. No man came to him except that he returned him during that period, even if he was a Muslim. Then believing women came as emigrants. Umm Kulthum bt. 'Uqbah b. Abi Mu'ayt was among those who went out to the Messenger of Allah ﷺ that day, and she was a young woman. Her family came asking the Prophet ﷺ to return her to them, but he did not return her to them because Allah revealed concerning them: {When believing women come to you as emigrants, test them; Allah knows best their faith} [al-Mumtahanah 10] up to His saying {and they are not lawful for them} [al-Mumtahanah 10].

    ✧ The Ansar said to the Prophet ﷺ, "Divide the palm trees between us and our brothers." He said, "No." They said, "You spare us the labor, and we will share the fruit with you." They said, "We hear and obey."

    لَمْ أَعْلَمْ شُرَيْحًا كَانَ يَقْضِي فِي الْمُضَارِبِ إِلَّا بِقَضَاءَيْنِ كَانَ رُبَّمَا قَالَ لِلْمُضَارِبِ «بَيِّنَتُكَ عَلَى مُصِيبَة تُعْذَرُ بِهَا» وَرُبَّمَا قَالَ لِصَاحِبِ الْمَالِ «بَيِّنَتُكَ عَلَى أَنَّ أَمِينُكَ خَانَكَ وَإِلَّا فَيَمِينُهُ بِاللهِ مَا خَانَكَ»

    ✧ I did not know that Shurayh ruled in the case of a mudarib (speculator) except with two rulings. Sometimes he would say to the mudarib, "Produce your proof for a loss for which you may be excused." And sometimes he would say to the owner of the capital, "Produce your proof that your trustee betrayed you; otherwise, his oath by Allah that he did not betray you."

    ✧ I said to 'Ata': A slave I hire for a year with his food, and another year for a tax of such and such? He said: "No harm." He said: And he disliked that you stipulate until you hire him for some days as invalid, or you hired him and part of the month had passed. He said: "You will not settle accounts with me for what has passed."
