عَنْ يُوسُفَ بْنِ سَعِيدٍ عَنْ حَجَّاجِ بْنِ مُحَمَّدٍ عَنِ ابْنِ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ قَالَ

«قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يَقْسِمْ رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَهُ حَتَّى يُؤَذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ»

Translation

✧ The Messenger of Allah ﷺ ruled for preemption in every undivided share, whether a house or a garden. It is not lawful for him to sell it until he informs his partner. If he wishes, he may take it, and if he wishes, he may leave it. If he sells without informing him, then he (the partner) has more right to it.
