Sunan ad-Darimi 2342Sahih
رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّغِيرِ حَتَّى يَحْتَلِمَ وَعَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ
✧ The pen is lifted from three: from the sleeper until he wakes, from the child until he reaches puberty, and from the insane until he regains his sanity.
Sunan ad-Darimi 2343Sahih
لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا بِإِحْدَى ثَلَاثٍ بِكُفْرٍ بَعْدَ إِيمَانٍ أَوْ بِزِنًى بَعْدَ إِحْصَانٍ أَوْ يَقْتُلُ نَفْسًا بِغَيْرِ نَفْسٍ فَيُقْتَلُ
✧ The blood of a Muslim man is not lawful except for one of three reasons: disbelief after faith, adultery after being married, or killing a person without right, in which case he is killed.

لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلَّا أَحَدَ ثَلَاثَةِ نَفَرٍ النَّفْسُ بِالنَّفْسِ وَالثَّيِّبُ الزَّانِي وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ
✧ The blood of a man who testifies that there is no god but Allah and that I am the Messenger of Allah is not lawful except for one of three persons: a life for a life, a previously married person who commits adultery, and one who abandons his religion and separates from the community.
كَانَ صَفْوَانُ بْنُ أُمَيَّةَ نَائِمًا فِي الْمَسْجِدِ فَأَتَاهُ رَجُلٌ وَهُوَ نَائِمٌ فَاسْتَلَّ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ فَتَنَبَّهَ بِهِ فَلَحِقَهُ فَأَخَذَهُ فَانْطَلَقَ بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ كُنْتُ نَائِمًا فِي الْمَسْجِدِ فَأَتَانِي هَذَا فَاسْتَلَّ رِدَائِي مِنْ تَحْتِ رَأْسِي فَلَحِقْتُهُ فَأَخَذْتُهُ فَأَمَرَ بِقَطْعِهِ فَقَالَ لَهُ صَفْوَانُ يَا رَسُولَ اللَّهِ إِنَّ رِدَائِي لَمْ يَبْلُغْ أَنْ يُقْطَعَ فِيهِ هَذَا قَالَ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ؟»
Safwan bin Umayyah was sleeping in the mosque, then a man came to him while he was also sleeping. He took his cloak from under his head and woke him up. Safwan caught up with him and took it back, then he went to the Prophet Muhammad ﷺ and said, "O Messenger of Allah, I was sleeping in the mosque and this man came to me and took my cloak from under my head. I caught up with him and took it back. He ordered for it to be cut, so Safwan said to him, "O Messenger of Allah, my cloak has not reached the point where it should be cut." He said, "Why didn't you accept it before bringing it to me?"

«تُقْطَعُ الْيَدُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
✧ The hand is cut off for a quarter of a dinar or more.

«قَطَعَ رَسُولُ اللَّهِ ﷺ فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ»
✧ The Messenger of Allah ﷺ cut off (the hand) for a shield worth three dirhams.

أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ ﷺ قَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ ﷺ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ثُمَّ قَامَ فَاخْتَطَبَ» فَقَالَ «إِنَّمَا هَلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا»
✧ The Quraysh were concerned about the case of the Makhzumi woman who had stolen. They said, "Who will speak to the Messenger of Allah ﷺ about her?" They said, "Who would dare (to do so) except Usama b. Zayd, the beloved of the Messenger of Allah ﷺ?" So Usama spoke to him, and the Messenger of Allah ﷺ said, "Do you intercede regarding one of the limits set by Allah?" Then he stood and delivered a sermon, saying, "Those before you were destroyed only because when a noble person among them stole, they left him alone, but when a weak person among them stole, they carried out the punishment on him. By Allah, if Fatima bt. Muhammad were to steal, I would cut off her hand."

أَنَّ رَسُولَ اللَّهِ ﷺ أُتِيَ بِسَارِقٍ اعْتَرَفَ اعْتِرَافًا لَمْ يُوجَدْ مَعَهُ مَتَاعٌ فَقَالَ «مَا إِخَالُكَ سَرَقْتَ؟» قَالَ بَلَى قَالَ «مَا إِخَالُكَ سَرَقْتَ؟» قَالَ بَلَى قَالَ «فَاذْهَبُوا فَاقْطَعُوا يَدَهُ ثُمَّ جِيئُوا بِهِ فَقَطَعُوا يَدَهُ ثُمَّ جَاءُوا بِهِ» فَقَالَ اسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ فَقَالَ أَسْتَغْفِرُ اللَّهَ وَأَتُوبُ إِلَيْهِ فَقَالَ «اللَّهُمَّ تُبْ عَلَيْهِ اللَّهُمَّ تُبْ عَلَيْهِ»
✧ A thief was brought to the Messenger of Allah ﷺ who confessed, but no goods were found with him. He said, "I do not think you stole." He said, "Yes, I did." He said, "I do not think you stole." He said, "Yes, I did." He said, "Go and cut off his hand, then bring him to me." So they cut off his hand and then brought him. He said, "Ask Allah for forgiveness and repent to Him." He said, "I ask Allah for forgiveness and I repent to Him." He said, "O Allah, accept his repentance. O Allah, accept his repentance."

✧ Abu Nu'aym narrated to us: Sufyan narrated to us, from Yahya b. Sa'id, from Muhammad b. Yahya b. Habban, from Rafi' b. Khadij, from the Prophet ﷺ something similar.

✧ There is no cutting off (of the hand) for the one who plunders openly, nor for the one who snatches away, nor for the betrayer.

أَنَّ النَّبِيَّ ﷺ «أُتِيَ بِرَجُلٍ قَدْ شَرِبَ خَمْرًا فَضَرَبَهُ بِجَرِيدَتَيْنِ» ثُمَّ فَعَلَ أَبُو بَكْرٍ مِثْلَ ذَلِكَ فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَخَفُّ الْحُدُودِ ثَمَانِينَ قَالَ «فَفَعَلَ»
✧ A man who had drunk wine was brought to the Prophet ﷺ, and he struck him with two palm branches. Then Abu Bakr did likewise. When it was Umar's time, he consulted the people, and Abd al-Rahman b. Awf said, "The lightest of the prescribed punishments is eighty (lashes)." He said, "So he did that."

شَهِدْتُ عُثْمَانَ بْنَ عَفَّانَ وَأُتِيَ بِالْوَلِيدِ بْنِ عُقْبَةَ فَقَالَ عَلِيٌّ «جَلَدَ النَّبِيُّ ﷺ أَرْبَعِينَ وَجَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ وَعُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ»
✧ I witnessed Uthman b. Affan when al-Walid b. Uqba was brought to him. Ali said, "The Prophet ﷺ flogged forty lashes, Abu Bakr flogged forty, and Umar eighty, and each is a Sunnah."
«إِذَا شَرِبَ أَحَدُكُمْ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ فَاضْرِبُوهُ ثُمَّ إِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ»
✧ When one of you drinks, flog him; then if he returns, flog him; then if he returns, flog him; then if he returns a fourth time, kill him.

«لَا يَحِلُّ لِأَحَدٍ أَنْ يَضْرِبَ أَحَدًا فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ»
✧ It is not lawful for anyone to strike anyone more than ten lashes except in a hadd from the hudud of Allah.

أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى النَّبِيَّ ﷺ فَحَدَّثَهُ أَنَّهُ زَنَى فَشَهِدَ عَلَى نَفْسِهِ أَنَّهُ زَنَى أَرْبَعًا «فَأَمَرَ بِرَجْمِهِ وَكَانَ قَدْ أُحْصِنَ»
✧ A man from Aslam came to the Prophet ﷺ and told him that he had committed adultery, and he testified against himself four times that he had committed adultery. So he ordered his stoning, and he had been married.

أُتِيَ النَّبِيُّ ﷺ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ قَصِيرٍ فِي إِزَارٍ مَا عَلَيْهِ رِدَاءٌ وَرَسُولُ اللَّهِ ﷺ مُتَّكِئٌ عَلَى وِسَادَةٍ عَلَى يَسَارِهِ فَكَلَّمَهُ فَمَا أَدْرِي مَا يُكَلِّمُهُ بِهِ وَأَنَا بَعِيدٌ مِنْهُ بَيْنِي وَبَيْنَهُ الْقَوْمُ فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَالَ «رُدُّوهُ» فَكَلَّمَهُ أَيْضًا وَأَنَا أَسْمَعُ غَيْرَ أَنَّ بَيْنِي وَبَيْنَهُ الْقَوْمَ ثُمَّ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» ثُمَّ قَامَ النَّبِيُّ ﷺ فَخَطَبَ وَأَنَا أَسْمَعُهُ ثُمَّ قَالَ «كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللَّهِ خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ مِنَ اللَّبَنِ؟ وَاللَّهِ لَا أَقْدِرُ عَلَى أَحَدٍ مِنْهُمْ إِلَّا نَكَّلْتُ
✧ Ma'iz b. Malik was brought to the Prophet ﷺ, a short man wearing only a lower garment and no cloak, while the Messenger of Allah ﷺ was reclining on a pillow to his left. He spoke to him, and I do not know what he said to him, as I was far from him, with people between me and him. Then he said, "Take him and stone him." Then he said, "Bring him back." He spoke to him again, and I could hear, though people were between me and him. Then he said, "Take him and stone him." Then the Prophet ﷺ stood and delivered a sermon, and I could hear him. Then he said, "Whenever we go out in the way of Allah, one of them stays behind and bleats like a he-goat, granting one of them a small amount of milk. By Allah, if I get hold of any of them, I will make an example of him."

جاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ أَنْشُدُكَ اللَّهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَالَ خصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ صَدَقَ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَأْذَنْ لِي يَا رَسُولَ اللَّهِ أَنْ أَتَكَلَّمَ فَقَالَ رَسُولُ اللَّهِ ﷺ «قُلْ» فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى أَهْلِ هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ وَإِنِّي سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَيَا أُنَيْسُ اغْدُ عَلَى امْرَأَةِ هَذَا فَسَلْهَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَاعْتَرَفَتْ فَرَجَمَهَا
A man came to the Prophet ﷺ and said, "I beseech you to judge us according to Allah's Laws." Then his opponent who was wiser than he, got up and said, "He has spoken the truth. So judge us according to Allah's Laws and please allow me (to speak), O Messenger of Allah ﷺ." The Prophet ﷺ said, "Speak." He said, "My son was a laborer for the family of this man and he committed illegal sexual intercourse with his wife, and I gave one-hundred sheep and a slave as a ransom (for my son), but I asked the religious learned people (regarding this case), and they informed me that my son should be flogged onehundred stripes, and be exiled for one year, and the wife of this man should be stoned (to death)."The Prophet ﷺ said, "By Him in Whose Hand my soul is, I will Judge you (in this case) according to Allah's Laws. The one-hundred (sheep) and the slave shall be returned to you and your son shall be flogged one-hundred stripes and be exiled for one year. And O Unais! Go in the morning to the wife of this man and ask her, and if she confesses, stone her to death." She confessed and he stoned her to death. (Using translation from Bukhārī 6859)

كُنْتُ فِيمَنْ رَجَمَهُ قَالَ أَبُو مُحَمَّد يَعْنِي مَاعِزَ بْنَ مَالِكٍ «فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا» قَالَ فَذَكَرْنَا ذَلِكَ لِرَسُولِ اللَّهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»
✧ I was among those who stoned him. Abu Muhammad said: meaning Ma'iz b. Malik. When he felt the touch of the stones, he panicked severely. He said: We mentioned that to the Messenger of Allah ﷺ, and he said, "Why did you not leave him?"

«انْطَلِقُوا بِمَاعِزِ بْنِ مَالِكٍ فَارْجُمُوهُ» فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ فَوَاللَّهِ مَا أَوْثَقْنَاهُ وَلَا حَفَرْنَا لَهُ وَلَكِنْ قَامَ فَرَمَيْنَاهُ بِالْعِظَامِ وَالْخَزَفِ وَالْجَنْدَلِ
✧ "Go with Ma'iz b. Malik and stone him." So we went with him to Baqi' al-Gharqad. By Allah, we did not tie him or dig for him, but he stood and we threw at him with bones, pottery shards, and stones.

كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَهُ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَرَدَّهُ ثَلَاثَ مَرَّاتٍ ثُمَّ جَاءَ الرَّابِعَةَ فَاعْتَرَفَ «فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ وَأَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ»
✧ I was sitting with the Prophet ﷺ when a man called Ma'iz b. Malik came to him and confessed adultery to him. He turned him away three times. Then he came a fourth time and confessed. The Prophet ﷺ ordered that a pit be dug for him, and he was placed in it up to his chest, and he ordered the people to stone him.

أَنَّ الْيَهُودَ جَاءُوا إِلَى رَسُولِ اللَّهِ ﷺ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ قَدْ زَنَيَا فَقَالَ «كَيْفَ تَفْعَلُونَ بِمَنْ زَنَى مِنْكُمْ؟» قَالُوا لَا نَجِدُ فِيهَا شَيْئًا فَقَالَ لَهُمْ عَبْدُ اللَّهِ بْنُ سَلَامٍ كَذَبْتُمْ فِي التَّوْرَاةِ الرَّجْمُ فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ فَوَضَعَ مِدْرَاسُهَا الَّذِي يَدْرُسُهَا مِنْهُمْ كَفَّهُ عَلَى آيَةِ الرَّجْمِ فَقَالَ «مَا هَذِهِ؟» فَلَمَّا رَأَوْا ذَلِكَ قَالُوا هِيَ آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ ﷺ فَرُجِمَا قَرِيبًا مِنْ حَيْثُ تُوضَعُ الْجَنَائِزُ عِنْدَ الْمَسْجِدِ قَالَ عَبْدُ اللَّهِ فَرَأَيْتُ صَاحِبَهَا يَجْنَأُ عَلَيْهَا يَقِيهَا الْحِجَارَةَ
✧ "Indeed, the Jews came to the Messenger of Allah ﷺ with a man and a woman from among them who had committed adultery. The Messenger said, 'What should be done with those who have committed adultery among you?' They replied, 'We do not find anything mentioned about it in our scripture.' Abdullah bin Salam said, 'You have lied regarding stoning in the Torah. Bring the Torah and recite it if you are truthful.' So they brought the Torah, and he placed his hand on the verse of stoning and asked, 'What is this?' When they saw that, they said, 'It is the verse of stoning.' So the Messenger of Allah ﷺ ordered that they be stoned near the site where funeral processions are placed near the mosque.' Abdullah said, 'I saw the man shielding the woman with his body from the stones.'"

إِنَّ اللَّهَ تَعَالَى بَعَثَ مُحَمَّدًا ﷺ بِالْحَقِّ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ وَكَانَ فِيمَا أَنْزَلَ آيَةُ الرَّجْمِ فَقَرَأْنَاهَا وَوَعَيْنَاهَا وَعَقَلْنَاهَا وَرَجَمَ رَسُولُ اللَّهِ ﷺ وَرَجَمْنَا بَعْدَهُ فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ الْقَائِلُ لَا نَجِدُ حَدَّ آيَةِ الرَّجْمِ فِي كِتَابِ اللَّهِ وَالرَّجْمُ فِي كِتَابِ اللَّهِ حَقٌّ عَلَى مَنْ زَنَى مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا أُحْصِنَ إِذَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ
ʿUmar said: Allah, may He be exalted, sent Muhammad ﷺ and sent down the Book to him. Among that which was revealed to him was the verse of stoning. We recited it and understood it. But I fear that with the passage of time, some people will say: We do not find the verse of stoning in the Book of Allah, and as a result an obligation that Allah revealed will be forsaken. Stoning is the due punishment in the Book of Allah for those who commit zina, both men and women, if they have been married and if proof is established, or there is a pregnancy or a confession. كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَتْهُ امْرَأَةٌ مِنْ بَنِي غَامِدٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهَا «ارْجِعِي فَلَمَّا كَانَ مِنَ الْغَدِ أَتَتْهُ أَيْضًا فَاعْتَرَفَتْ عِنْدَهُ بِالزِّنَا» فَقَالَتْ يَا نَبِيَّ اللَّهِ طَهِّرْنِي فَلَعَلَّكَ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ فَوَاللَّهِ إِنِّي لَحُبْلَى فَقَالَ لَهَا النَّبِيُّ ﷺ «ارْجِعِي حَتَّى تَلِدِي» فَلَمَّا وَلَدَتْ جَاءَتْ بِالصَّبِيِّ تَحْمِلُهُ فِي خِرْقَةٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ هَذَا قَدْ وَلَدْتُ فَقَالَ فَاذْهَبِي فَأَرْضِعِيهِ ثُمَّ افْطِمِيهِ فَلَمَّا فَطَمَتْهُ جَاءَتْ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ يَا نَبِيَّ اللَّهِ قَدْ فَطَمْتُهُ فَأَمَرَ النَّبِيُّ ﷺ بِالصَّبِيِّ فَدُفِعَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ وَأَمَرَ بِهَا فَحُفِرَ لَهَا حُفْرَةٌ فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهَا فَأَقْبَلَ خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَرَمَى رَأْسَهَا فَتَلَطَّخَ الدَّمُ عَلَى وَجْنَةِ خَالِدِ بْنِ الْوَلِيدِ فَسَبَّهَا فَسَمِعَ النَّبِيُّ ﷺ سَبَّهُ إِيَّاهَا فَقَالَ «مَهْ يَا خَالِدُ لَا تَسُبَّهَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ» فَأَمَرَ بِهَا فَصُلِّيَ عَلَيْهَا وَدُفِنَتْ
✧ I was sitting with the Prophet ﷺ when a woman from Banu Ghamid came to him and said, "O Prophet of Allah, I have committed adultery, and I want you to purify me." He said to her, "Go back." The next day she came to him again and confessed adultery to him. She said, "O Prophet of Allah, purify me. Perhaps you will turn me away as you turned away Ma'iz b. Malik. By Allah, I am pregnant." The Prophet ﷺ said to her, "Go back until you give birth." When she gave birth, she came with the child, carrying him in a cloth, and said, "O Prophet of Allah, I have given birth to this." He said, "Go and nurse him, then wean him." When she had weaned him, she came with the child, in his hand a piece of bread, and said, "O Prophet of Allah, I have weaned him." The Prophet ﷺ ordered that the child be handed over to a man among the Muslims, and he ordered about her, and a pit was dug for her, and she was placed in it up to her chest. Then he ordered the people to stone her. Khalid b. al-Walid came forward with a stone and threw it at her head, and blood splattered onto Khalid b. al-Walid's cheek, and he cursed her. The Prophet ﷺ heard his cursing her and said, "Gently, Khalid, do not curse her. By Him in Whose hand is my soul, she has repented such a repentance that if a tax collector repented like that, he would be forgiven." Then he ordered about her, and the funeral prayer was offered for her, and she was buried.

أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ أَتَتِ النَّبِيَّ ﷺ وَهِيَ حُبْلَى مِنَ الزِّنَا فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَدَعَا رَسُولُ اللَّهِ ﷺ وَلِيَّهَا فَقَالَ «اذْهَبْ فَأَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ حَمْلَهَا فَأْتِنِي بِهَا» فَفَعَلَ فَأَمَرَ بِهَا رَسُولُ اللَّهِ ﷺ فَشُكَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا فَقَالَ عُمَرُ يَا رَسُولَ اللَّهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ فَقَالَ «لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ ﷻ؟»
✧ A woman from Juhaynah came to the Prophet ﷺ while pregnant from adultery and said, "O Messenger of Allah, I have committed a sin meriting a hadd, so carry it out on me." The Messenger of Allah ﷺ called her guardian and said, "Go and treat her well, and when she gives birth, bring her to me." He did so, and the Messenger of Allah ﷺ ordered that her clothes be fastened about her, then he ordered her to be stoned. Then he prayed over her. Umar said, "O Messenger of Allah, will you pray over her when she committed adultery?" He said, "She has repented such a repentance that if it were divided among seventy of the people of Madinah, it would suffice them. Have you found anything better than her giving her life for Allah ﷻ?"

أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصَنْ فَقَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا قَالَ فَمَا أَدْرِي فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ «فَبِيعُوهَا وَلَوْ بِضَفِيرٍ»
✧ "The Prophet ﷺ was asked about a slave woman who commits adultery but is not married. He said, 'If she commits adultery, then flog her, and if she commits adultery again, then flog her.' He said, 'I do not know about the third or fourth time, sell her, even if it is for a lock of hair.'"

خُذُوا عَنِّي خُذُوا عَنِّي قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ وَالثَّيِّبُ بِالثَّيِّبِ الْبِكْرُ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ جَلْدُ مِائَةٍ وَالرَّجْمُ
✧ "Take from me, take from me. Allah has made a way for them: the virgin with the virgin, and the previously married with the previously married. The virgin: one hundred lashes and exile for a year. The previously married: one hundred lashes and stoning."

أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ أَخْبَرَنَا هُشَيْمٌ عَنْ مَنْصُورٍ عَنْ الْحَسَنِ عَنْ حِطَّانَ بْنِ عَبْدِ اللَّهِ عَنْ عُبَادَةَ بْنِ الصَّامِتِ عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ
✧ Amr b. Awn informed us: Hushaym informed us, from Mansur, from al-Hasan, from Hittan b. Abdullah, from Ubadah b. al-Samit, from the Prophet ﷺ, with something similar.
لَأَقْضِيَنَّ فِيهِ بِقَضَاءٍ شَافٍ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَهُ رَجَمْتُهُ فَقِيلَ لَهَا زَوْجُكِ فَقَالَتْ إِنِّي قَدْ أَحْلَلْتُهَا لَهُ فَضَرَبَهُ مِائَةً قَالَ يَحْيَى هُوَ مَرْفُوعٌ
✧ "I will spend in it a year of medical treatment if it is permissible for him." If she made it permissible for him, he would receive one hundred lashes. And if she did not make it permissible for him, she would be stoned. Her husband was asked, and he said, "Indeed, I have made it permissible for him." So he struck him one hundred times. Yahya said, "He is elevated."
حَدَّثَنَا صَدَقَةُ بْنُ الْفَضْلِ أَنْبَأَنَا مُحَمَّدُ بْنُ جَعْفَرٍ عَنْ شُعْبَةَ عَنْ أَبِي بِشْرٍ عَنْ خَالِدِ بْنِ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنْ النُّعْمَانِ بْنِ بَشِيرٍ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
✧ Sadaqah b. al-Fadl narrated to us: Muhammad b. Ja'far informed us, from Shu'bah, from Abu Bishr, from Khalid b. Urfutah, from Habib b. Salim, from al-Nu'man b. Bashir, from the Prophet ﷺ, with something similar.
Sunan ad-Darimi 2376Hasan
«مَنْ أُقِيمَ عَلَيْهِ حَدٌّ غُفِرَ لَهُ ذَلِكَ الذَّنْبُ»
✧ Whoever has a prescribed punishment carried out upon him, that sin is forgiven for him.
