Sunan ad-Darimi 2308Accepted
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ «مُرْهُ أَنْ يُرَاجِعَهَا وَيُمْسِكَهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ»
✧ He divorced his wife while she was menstruating. Umar mentioned that to the Prophet ﷺ, and he said: "Order him to take her back and keep her until she becomes pure, then menstruates, then becomes pure. Then, if he wishes, he may keep her, and if he wishes, he may divorce her before touching her. That is the prescribed waiting period during which Allah has commanded women to be divorced."

أَنَّ عُمَرَ قَالَ لِلنَّبِيِّ ﷺ حِينَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ فَقَالَ «مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرَةٌ»
✧ Umar said to the Prophet ﷺ when Ibn Umar divorced his wife: "Order him to take her back, then let him divorce her when she is pure."

أَنَّ النَّبِيَّ ﷺ «طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا»
✧ The Prophet ﷺ "divorced Hafsah, then took her back."
أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ «أَنْ لَا يَمَسَّ الْقُرْآنَ إِلَّا طَاهِرٌ وَلَا طَلَاقَ قَبْلَ إِمْلَاكٍ وَلَا عَتَاقَ حَتَّى يَبْتَاعَ»
✧ The Messenger of Allah ﷺ wrote to the people of Yemen, "The Quran should not be touched except by one who is pure, and divorce cannot be pronounced before ownership is established, and the freeing of a slave cannot be done until it is bought." Abu Muhammad was asked about Sulaiman, and he said, "I think he is a writer among the writers of Umar ibn Abdul Aziz."

جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللَّهِ ﷺ وَعِنْدَهُ أَبُو بَكْرٍ وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ عَلَى الْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ لَهُ عَلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي فَبَتَّ طَلَاقِي قَالَ «أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ وَتَذُوقِي عُسَيْلَتَهُ» فَنَادَى خَالِدُ بْنُ سَعِيدٍ أَبَا بَكْرٍ أَلَا تَرَى مَا تَجْهَرُ بِهِ؟ هَذِهِ عِنْدَ رَسُولِ اللَّهِ ﷺ؟
✧ The wife of Rifa'ah al-Qurazi came to the Messenger of Allah ﷺ while Abu Bakr and Khalid b. Sa'id b. al-'As were at the door, waiting to be granted permission to enter upon the Messenger of Allah ﷺ. She said: "O Messenger of Allah, I was married to Rifa'ah, and he divorced me with a final divorce." He said: "Do you want to return to Rifa'ah? No, not until he tastes your sweetness and you taste his sweetness." Then Khalid b. Sa'id called out to Abu Bakr: "Do you not see what she is saying openly in the presence of the Messenger of Allah ﷺ?"

طَلَّقَ رِفَاعَةُ رَجُلٌ مِنْ بَنِي قُرَيْظَةَ امْرَأَتَهُ فَتَزَوَّجَهَا عَبْدُ الرَّحْمَنِ بْنُ الزُّبَيْرِ فَدَخَلَتْ عَلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ وَاللَّهِ إِنْ مَعَهُ إِلَّا مِثْلُ هُدْبَتِي هَذِهِ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ لَعَلَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ أَوْ قَالَ تَذُوقِي عُسَيْلَتَهُ
✧ Rifa'ah, a man from Banu Qurayzah, divorced his wife. Then 'Abd al-Rahman b. al-Zubayr married her. She came to the Messenger of Allah ﷺ and said: "O Messenger of Allah, by Allah, he has nothing but something like this fringe of mine." The Messenger of Allah ﷺ said to her: "Perhaps you want to return to Rifa'ah. No, not until he tastes your sweetness," or he said, "until you taste his sweetness."

سَأَلْتُ عَائِشَةَ عَنِ الْخِيَرَةِ فَقَالَتْ قَدْ «خَيَّرَنَا رَسُولُ اللَّهِ ﷺ أَفَكَانَ طَلَاقًا»
✧ I asked 'A'ishah about the choice given to women. She said: "The Messenger of Allah ﷺ gave us a choice, and was that a divorce?"

«أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا الطَّلَاقَ مِنْ غَيْرِ بَأْسٍ فَحَرَامٌ عَلَيْهَا رَائِحَةُ الْجَنَّةِ»
✧ "Any woman who asks her husband for a divorce without a serious reason, the fragrance of Paradise is forbidden to her."

أَنَّ حَبِيبَةَ بِنْتَ سَهْلٍ تَزَوَّجَهَا ثَابِتُ بْنُ قَيْسِ بْنِ شَمَّاسٍ فَذَكَرَتْ أَنَّ رَسُولَ اللَّهِ ﷺ كَانَ هَمَّ أَنْ يَتَزَوَّجَهَا وَكَانَتْ جَارَةً لَهُ وَأَنَّ ثَابِتًا ضَرَبَهَا فَأَصْبَحَتْ عَلَى بَابِ رَسُولِ اللَّهِ ﷺ فِي الْغَلَسِ وَأَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ فَرَأَى إِنْسَانًا فَقَالَ «مَنْ هَذَا؟» قَالَتْ أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ فَقَالَ «مَا شَأْنُكِ؟» قَالَتْ لَا أَنَا وَلَا ثَابِتٌ فَأَتَى ثَابِتٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ لَهُ رَسُولُ اللَّهِ «خُذْ مِنْهَا وَخَلِّ سَبِيلَهَا» فَقَالَتْ يَا رَسُولَ اللَّهِ عِنْدِي كُلُّ شَيْءٍ أَعْطَانِيهِ فَأَخَذَ مِنْهَا وَقَعَدَتْ عِنْدَ أَهْلِهَا
✧ Habibah bt. Sahl was married to Thabit b. Qays b. Shammas. She mentioned that the Messenger of Allah ﷺ had intended to marry her, and she was his neighbor. Thabit struck her, and she went out at dawn to the door of the Messenger of Allah ﷺ. The Messenger of Allah ﷺ came out and saw someone, so he said: "Who is this?" She said: "I am Habibah bt. Sahl." He said: "What is the matter with you?" She said: "Neither I nor Thabit." Then Thabit came to the Messenger of Allah ﷺ, and the Messenger of Allah said to him: "Take from her what you gave her and let her go." She said: "O Messenger of Allah, I have everything he gave me." So he took from her, and she stayed with her family.
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ «مَا أَرَدْتَ؟» فَقَالَ وَاحِدَةً قَالَ «آللَّهِ؟» قَالَ آللَّهِ قَالَ هُوَ مَا نَوَيْتَ
✧ He divorced his wife with an irrevocable divorce. He came to the Prophet ﷺ and mentioned that to him. He said: "What did you intend?" He said: "One divorce." He said: "By Allah?" He said: "By Allah." He said: "It is according to what you intended."

كُنْتُ امْرَأً أُصِيبُ مِنَ النِّسَاءِ مَا لَا يُصِيبُ غَيْرِي فَلَمَّا دَخَلَ شَهْرُ رَمَضَانَ خِفْتُ أَنْ أُصِيبَ فِي لَيْلِي شَيْئًا فَيَتَتَابَعَ بِي ذَلِكَ إِلَى أَنْ أُصْبِحَ قَالَ فَتَظَاهَرْتُ إِلَى أَنْ يَنْسَلِخَ فَبَيْنَا هِيَ لَيْلَةً تَخْدُمُنِي إِذْ تَكَشَّفَ لِي مِنْهَا شَيْءٌ فَمَا لَبِثْتُ أَنْ نَزَوْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ خَرَجْتُ إِلَى قَوْمِي فَأَخْبَرْتُهُمْ وَقُلْتُ امْشُوا مَعِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَالُوا لَا وَاللَّهِ لَا نَمْشِي مَعَكَ مَا نَأْمَنُ أَنْ يَنْزِلَ فِيكَ الْقُرْآنُ أَوْ أَنْ يَكُونَ فِيكَ مِنْ رَسُولِ اللَّهِ ﷺ مَقَالَةٌ يَلْزَمُنَا عَارُهَا وَلَنُسْلِمَنَّكَ بِجَرِيرَتِكَ فَانْطَلَقْتُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَصَصْتُ عَلَيْهِ قصتي فَقَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ قَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ قَالَ يَا سَلَمَةُ «أَنْتَ بِذَاكَ» قُلْتُ أَنَا بِذَاكَ وَهَا أَنَا صَابِرٌ نَفْسِي فَاحْكُمْ فِيَّ مَا أَرَاكَ اللَّهُ قَالَ «فَأَعْتِقْ رَقَبَةً» قَالَ «فَضَرَبْتُ صَفْحَةَ رَقَبَتِي» فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ رَقَبَةً غَيْرَهَا قَالَ «فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ» قُلْتُ وَهَلْ أَصَابَنِي الَّذِي أَصَابَنِي إِلَّا فِي الصِّيَامِ؟ قَالَ «فَأَطْعِمْ وَسْقًا مِنْ تَمْرٍ سِتِّينَ مِسْكِينًا» فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا وَحْشَى مَا لَنَا مِنَ الطَّعَامِ قَالَ فَانْطَلِقْ إِلَى صَاحِبِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ وَأَطْعِمْ سِتِّينَ مِسْكِينًا وَسْقًا مِنْ تَمْرٍ وَكُلْ بَقِيَّتَهُ أَنْتَ وَعِيَالُكَ قَالَ فَأَتَيْتُ قَوْمِي فَقُلْتُ وَجَدْتُ عِنْدَكُمُ الضِّيقَ وَسُوءَ الرَّأْيِ وَوَجَدْتُ عِنْدَ رَسُولِ اللَّهِ ﷺ السَّعَةَ وَحُسْنَ الرَّأْيِ وَقَدْ أَمَرني بِصَدَقَتِكُمْ
✧ I was a man who had relations with women in a way that no one else did. When the month of Ramadan entered, I feared that I would do something at night and then continue doing it until morning. He said: So I resolved to abstain until the month ended. While she was serving me one night, something of her was revealed to me, and I did not wait before I fell upon her. When morning came, I went out to my people and told them. I said: "Come with me to the Messenger of Allah ﷺ." They said: "No, by Allah, we will not go with you. We fear that the Qur'an will be revealed concerning you, or that the Messenger of Allah ﷺ will say something about you that will bring us shame. We will hand you over for your own offense." So I went to the Messenger of Allah ﷺ and told him my story. He said: "O Salamah, you did that?" I said: "I did that." He said: "O Salamah, you did that?" I said: "I did that." He said: "O Salamah, you did that?" I said: "I did that. Here I am, patient with myself, so judge for me as Allah shows you." He said: "Free a slave." He said: I struck the side of my neck, and I said: "By the One who sent you with the truth, I do not own any slave other than this." He said: "Fast two consecutive months." I said: "Did what happened to me happen except because of fasting?" He said: "Feed sixty poor people a wasq of dates." I said: "By the One who sent you with the truth, we spent the night without any food." He said: "Go to the collector of charity of Banu Zurayq and have him give it to you. Feed sixty poor people a wasq of dates, and you and your family may eat the rest." He said: I went to my people and said: "I found with you hardship and bad judgment, and I found with the Messenger of Allah ﷺ ease and good judgment. He has ordered me to take your charity."

أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا «فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ ﷺ نَفَقَةً وَلَا سُكْنَى»
✧ that her husband divorced her with three pronouncements, and the Prophet ﷺ did not assign her any maintenance or housing.

«أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَأَمَرَهَا النَّبِيُّ ﷺ أَنْ تَعْتَدَّ عِنْدَ ابْنِ عَمِّهَا ابْنِ أُمِّ مَكْتُومٍ»
✧ that her husband divorced her with three pronouncements, and the Prophet ﷺ ordered her to observe her waiting period in the house of her cousin Ibn Umm Maktum.

«لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ»
✧ "We will not abandon the Book of our Lord and the Sunnah of His Prophet for the word of a woman. The woman divorced with three pronouncements is entitled to housing and maintenance."

أَخْبَرَنَا طَلْقُ بْنُ غَنَّامٍ عَنْ حَفْصِ بْنِ غِيَاثٍ عَنْ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ عَنْ الْأَسْوَدِ عَنْ عُمَرَ نَحْوَهُ
✧ Talq b. Ghannam reported to us from Hafs b. Ghiyath from al-A'mash from Ibrahim from al-Aswad from Umar something similar.
Sunan ad-Darimi 2324Sahih
«لَا نُجِيزُ قَوْلَ امْرَأَةٍ فِي دِينِ اللَّهِ الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ»
✧ "We do not accept the word of a woman in the religion of Allah. The woman divorced with three pronouncements is entitled to housing and maintenance."

أَنَّ أَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ أَخْبَرَهُ أَنَّهُ اجْتَمَعَ هُوَ وَابْنُ عَبَّاسٍ عِنْدَ أَبِي هُرَيْرَةَ فَذَكَرُوا الرَّجُلَ يُتَوَفَّى عَنِ الْمَرْأَةِ فَتَلِدُ بَعْدَهُ بِلَيَالٍ قَلَائِلَ فَقَالَ ابْنُ عَبَّاسٍ حِلُّهَا آخِرُ الْأَجَلَيْنِ وَقَالَ أَبُو سَلَمَةَ إِذَا وَضَعَتْ فَقَدْ حَلَّتْ فَتَرَاجَعَا فِي ذَلِكَ بَيْنَهُمَا فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ فَسَأَلَهَا فَذَكَرَتْ أُمُّ سَلَمَةَ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ الْأَسْلَمِيَّةَ مَاتَ عَنْهَا زَوْجُهَا فَنَفِسَتْ بَعْدَهُ بِلَيَالٍ وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ خَطَبَهَا وَأَخْبَرَهَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ فَقَالَ لَهَا أَبُو السَّنَابِلِ فَإِنَّكِ لَمْ تَحِلِّينَ فَذَكَرَتْ سُبَيْعَةُ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ «فَأَمَرَهَا أَنْ تَتَزَوَّجَ»
✧ Abu Salamah b. Abd al-Rahman reported to him that he and Ibn Abbas gathered at Abu Hurayrah's, and they mentioned the man whose wife he dies leaving, and she gives birth a few nights after his death. Ibn Abbas said: Her waiting period ends at the later of the two terms. Abu Salamah said: When she gives birth, she becomes lawful. They argued about that between them, and Abu Hurayrah said: I am with my nephew, meaning Abu Salamah. So they sent Kurayb, the freed slave of Ibn Abbas, to Umm Salamah, and he asked her. Umm Salamah mentioned that Subay'ah bt. al-Harith al-Aslamiyyah's husband died, and she gave birth a few nights after his death, and that a man from Banu Abd al-Dar, called Abu al-Sanabil, proposed to her and informed her that she had become lawful, so she wanted to marry someone other than him. Abu al-Sanabil said to her: You are not lawful. Subay'ah mentioned that to the Messenger of Allah ﷺ, and he ordered her to marry.

تُوُفِّيَ زَوْجُ سُبَيْعَةَ بِنْتِ الْحَارِثِ فَوَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَيَّامٍ «فَأَمَرَهَا رَسُولُ اللَّهِ ﷺ أَنْ تَتَزَوَّجَ»
✧ Subay'ah bt. al-Harith's husband died, and she gave birth a few days after her husband's death, so the Messenger of Allah ﷺ ordered her to marry.

وَضَعَتْ سُبَيْعَةُ بِنْتُ الْحَارِثِ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا بِبِضْعٍ وَعِشْرِينَ لَيْلَةً فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَشَوَّفَتْ فَعِيبَ ذَلِكَ عَلَيْهَا فَذُكِرَ أَمْرُهَا لِرَسُولِ اللَّهِ ﷺ فَقَالَ «إِنْ تَفْعَلْ فَقَدِ انْقَضَى أَجَلُهَا»
✧ Subay'ah bt. al-Harith gave birth to her child twenty-some nights after her husband's death. When she recovered from her postpartum bleeding, she adorned herself, and that was criticized, so her case was mentioned to the Messenger of Allah ﷺ, and he said: "If she does so, her term has ended."

أَنَّ سُبَيْعَةَ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَيَّامٍ فَتَشَوَّفَتْ فَعَابَ أَبُو السَّنَابِلِ فَسَأَلَتْ أَوْ ذَكَرَتْ أَمْرَهَا لِرَسُولِ اللَّهِ ﷺ؟ «فَأَمَرَهَا أَنْ تَتَزَوَّجَ»
✧ Subay'ah gave birth a few days after her husband's death, and she adorned herself, and Abu al-Sanabil criticized her, so she asked, or her case was mentioned to the Messenger of Allah ﷺ, and he ordered her to marry.

«لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَوْ تُؤْمِنُ بِاللَّهِ أَنْ تَحِدَّ عَلَى أَحَدٍ فَوْقَ ثَلَاثَةِ أَيَّامٍ إِلَّا عَلَى زَوْجِهَا»
✧ "It is not lawful for a woman who believes in Allah and the Last Day—or who believes in Allah—to mourn for anyone more than three days, except for her husband."

أَنَّ أَخًا لَهَا مَاتَ أَوْ حَمِيمًا لَهَا فَعَمَدَتْ إِلَى صُفْرَةٍ فَجَعَلَتْ تَمْسَحُ يَدَيْهَا وَقَالَتْ إِنَّمَا أَفْعَلُ هَذَا لِأَنَّ النَّبِيَّ ﷺ قَالَ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحِدَّ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجِهَا فَإِنَّهَا تَحِدُّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
✧ that a brother of hers or a close relative died, so she took some yellow dye and began rubbing her hands with it, and said: I only do this because the Prophet ﷺ said: "It is not lawful for a woman who believes in Allah and the Last Day to mourn more than three days except for her husband; for him she mourns four months and ten."

سَمِعْتُ زَيْنَبَ بِنْتَ أُمِّ سَلَمَةَ تُحَدِّثُ عَنْ أُمِّهَا أَوِ امْرَأَةٍ مِنْ أَزْوَاجِ النَّبِيِّ ﷺ نَحْوَهُ
✧ I heard Zaynab bt. Umm Salamah reporting from her mother, or a woman among the wives of the Prophet ﷺ, something similar.

«لَا تَحِدُّ الْمَرْأَةُ فَوْقَ ثَلَاثَةِ أَيَّامٍ إِلَّا عَلَى زَوْجٍ فَإِنَّهَا تَحِدُّ عَلَيْهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا لَا تَلْبَسُ ثَوْبًا مَصْبُوغًا إِلَّا ثَوْبَ عَصْبٍ وَلَا تَكْتَحِلُ وَلَا تَمَسُّ طِيبًا إِلَّا فِي أَدْنَى طُهْرِهَا إِذَا اغْتَسَلَتْ مِنْ مَحِيضِهَا نُبْذَةً مِنْ كُسْتٍ وَأَظْفَارٍ»
✧ A woman should not mourn more than three days, except for a husband, for whom she mourns four months and ten days. She should not wear a dyed garment except a garment of 'asb (Yemeni striped cloth), nor apply kohl, nor touch perfume, except when she is closest to her purity after bathing from her menses, a small amount of costus and azfar (a type of perfume).

أَنَّ الْفُرَيْعَةَ بِنْتَ مَالِكٍ أَخْبَرَتْهَا أَنَّهَا سَأَلَتْ رَسُولَ اللَّهِ ﷺ أَنْ يَأْذَنَ لَهَا أَنْ تَرْجِعَ إِلَى أَهْلِهَا؟ فَإِنَّ زَوْجَهَا قَدْ خَرَجَ فِي طَلَبِ أَعْبُدٍ لَهُ أَبَقُوا فَأَدْرَكَهُمْ حَتَّى إِذَا كَانَ بِطَرَفِ الْقَدُومِ قَتَلُوهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَقُلْتُ إِنَّهُ لَمْ يَدَعْنِي فِي بَيْتٍ أَمْلِكُهُ وَلَا نَفَقَةٍ فَقَالَ «امْكُثِي حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَاعْتَدَّتْ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَلَمَّا كَانَ عُثْمَانُ أَرْسَلَ إِلَيَّ فَسَأَلَنِي عَنْ ذَلِكَ؟ فَأَخْبَرْتُهُ فَاتَّبَعَ ذَلِكَ وَقَضَى بِهِ
✧ Al-Furay'ah bint Malik informed that she asked the Messenger of Allah ﷺ for permission to return to her family because her husband had gone out in pursuit of some slave girls of his who had fled, and he caught up with them, and when he reached them at the edge of Al-Qudum, they killed him. The Messenger of Allah ﷺ said, 'Stay in your house until the prescribed period reaches its term.' I said, 'He did not leave me a house that I own or any maintenance.' He said, 'Stay until the prescribed period reaches its term.' So she observed the waiting period for four months and ten days. She said, 'When it was the time of Uthman, he sent for me and asked me about that, and I informed him, so he followed that and upheld it in his judgment.'"

طُلِّقَتْ خَالَتِي فَأَرَادَتْ أَنْ تَجُدَّ نَخْلًا لَهَا فَقَالَ لَهَا رَجُلٌ لَيْسَ لَكِ أَنْ تَخْرُجِي قَالَتْ فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «اخْرُجِي فَجُدِّي نَخْلَكِ فَلَعَلَّكِ أَنْ تَصَدَّقِي أَوْ تَصْنَعِي مَعْرُوفًا»
✧ My maternal aunt was divorced and wanted to harvest her palm trees. A man said to her, 'You have no right to go out.' She said, 'So I went to the Prophet ﷺ and mentioned that to him.' He said, 'Go out and harvest your palm trees, for perhaps you will give charity or do some good.'

أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ فَأَرَادَ مَوَالِيهَا أَنْ يَشْتَرِطُوا وَلَاءَهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَاشْتَرَتْهَا فَأَعْتَقَتْهَا وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ ﷺ أُتِيَ بِلَحْمٍ فَقَالَ مِنْ أَيْنَ هَذَا؟ قِيلَ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
✧ She wanted to buy Barirah, and her masters wanted to stipulate her wala' (clientage). She mentioned that to the Messenger of Allah ﷺ, and he said, 'Buy her, for the wala' belongs to the one who frees.' So she bought her and freed her, and gave her the choice regarding her husband, who was a free man. And the Prophet ﷺ was brought some meat and said, 'Where is this from?' It was said, 'It was given as charity to Barirah.' He said, 'It is charity for her and a gift for us.'

دَخَلَ النَّبِيُّ ﷺ عَلَيَّ فَقَرَّبْتُ إِلَيْهِ طَعَامًا لَيْسَ فِيهِ لَحْمٌ فَقَالَ «أَلَمْ أَرَ لَكُمْ قِدْرًا مَنْصُوبَةً» قُلْتُ يَا رَسُولَ اللَّهِ هَذَا لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْ لَنَا قَالَ «هُوَ عَلَيْهَا صَدَقَةٌ ولَنَا هَدِيَّةٌ» وَكَانَ لَهَا زَوْجٌ فَلَمَّا عُتِقَتْ خُيِّرَتْ
✧ The Prophet ﷺ entered upon me and I brought him some food without meat. He said, 'Did I not see a pot set up for you?' I said, 'O Messenger of Allah, this is meat given as charity to Barirah, and she gave it to us as a gift.' He said, 'It is charity for her and a gift for us.' She had a husband, and when she was freed, she was given the choice.

أَنَّ بَرِيرَةَ حِينَ أَعْتَقَتْهَا عَائِشَةُ كَانَ زَوْجُهَا عَبْدًا فَجَعَلَ رَسُولُ اللَّهِ ﷺ يَحُضُّهَا عَلَيْهِ فَجَعَلَتْ تَقُولُ لِرَسُولِ اللَّهِ ﷺ أَلَيْسَ لِي أَنْ أُفَارِقَهُ؟ قَالَ «بَلَى» قَالَتْ فَقَدْ فَارَقْتُهُ
✧ When 'A'ishah freed Barirah, her husband was a slave, so the Messenger of Allah ﷺ urged her to stay with him. She kept saying to the Messenger of Allah ﷺ, 'Do I not have the right to separate from him?' He said, 'Yes.' She said, 'Then I have separated from him.'

أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ يَا عَبَّاسُ «أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا» فَقَالَ لَهَا «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» فَقَالَتْ يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي؟ قَالَ «إِنَّمَا أَنَا شَافِعٌ» قَالَتْ لَا حَاجَةَ لِي فِيهِ
✧ Barirah's husband was a slave called Mughith. It is as if I am looking at him walking behind her, crying, with his tears flowing onto his beard. The Prophet ﷺ said to al-'Abbas, 'O 'Abbas, are you not amazed at the intensity of Mughith's love for Barirah and the intensity of Barirah's hatred for Mughith?' He said to her, 'If only you would take him back, for he is the father of your child.' She said, 'O Messenger of Allah, are you commanding me?' He said, 'I am only interceding.' She said, 'I have no need of him.'

كُنْتُ عِنْدَ أَبِي هُرَيْرَةَ فَجَاءَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي فَقَالَ أَبُو هُرَيْرَةَ كُنْتُ عِنْدَ رَسُولِ اللَّهِ ﷺ إِذْ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِوَلَدِي أَوْ بِابْنِي وَقَدْ نَفَعَنِي وَسَقَانِي مِنْ بِئْرِ أَبِي عِنَبَةَ فَقَالَ رَسُولُ اللَّهِ ﷺ اسْتَهِمَا أَوْ قَالَ تَسَاهَمَا أَبُو عَاصِمٍ الشَّاكُّ فَجَاءَ زَوْجُهَا فَقَالَ مَنْ يُخَاصِمُنِي فِي وَلَدِي أَوْ فِي ابْنِي؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «يَا غُلَامُ هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ فَخُذْ بِيَدِ أَيِّهِمَا شِئْتَ» وَقَدْ قَالَ أَبُو عَاصِمٍ فَاتْبَعْ أَيَّهُمَا شِئْتَ فَأَخَذَ بِيَدِ أُمِّهِ فَانْطَلَقَتْ بِهِ
✧ I was with Abu Hurayrah when a woman came to him and said, 'My husband wants to take away my child.' Abu Hurayrah said, 'I was with the Messenger of Allah ﷺ when a woman came to him and said, "My husband wants to take away my child, or my son, who has benefited me and given me water from the well of Abu 'Inabah." The Messenger of Allah ﷺ said, "Draw lots," or he said, "Let them draw lots" – Abu 'Asim was the one who doubted. Then her husband came and said, "Who will dispute with me regarding my child, or my son?" The Messenger of Allah ﷺ said, "O boy, this is your father and this is your mother, so take the hand of whichever of them you wish." And Abu 'Asim said, "Follow whichever of them you wish." So he took his mother's hand and she left with him.'
«لِلْأَمَةِ تَطْلِيقَتَانِ وَقُرُوؤُهَا حَيْضَتَانِ»
✧ For a slave woman there are two divorces, and her waiting period is two menstrual cycles.
Sunan ad-Darimi 2341Hasan
أَنَّهُ قَالَ فِي سَبَايَا أَوْطَاسٍ «لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ حَمْلَهَا وَلَا غَيْرُ ذَاتِ حَمْلٍ حَتَّى تَحِيضَ حَيْضَةً»
✧ Regarding the captives of Awtas, he said, 'A pregnant woman is not to be had intercourse with until she gives birth, nor a non-pregnant woman until she has menstruated once.'
