33. Gifting
أَنَّ بَشِيرَ بْنَ سَعْدٍ جَاءَ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا هَذَا الْعَبْدَ فَقَالَ النَّبِيُّ ﷺ «أَوَكُلَّ وَلَدِكَ نَحَلْتَ هَذَا؟ » قَالَ لَا قَالَ «فَارْدُدْهُ»
✧ Bashir b. Sa'd came to the Messenger of Allah ﷺ and said: 'I have given this son of mine this slave.' The Prophet ﷺ said: 'Have you given all your children the like of this?' He said: 'No.' He said: 'Then take it back.'

✧ My father took me to the Messenger of Allah ﷺ to have him witness a gift he was giving me. He said: 'Do you have any other children besides him?' I said: 'Yes.' He said: 'Treat them equally.'

انْطَلَقَ بِي أَبِي إِلَى النَّبِيِّ ﷺ لِيُشْهِدَهُ عَلَى عَطِيَّةٍ أَعْطَانِيهَا فَقَالَ «هَلْ لَكَ بَنُونَ سِوَاهُ؟ » قَالَ نَعَمْ قَالَ «سَوِّ بَيْنَهُمْ»
"My father took me to the Messenger of Allah to ask him to bear witness to a gift that he had given me. He said: 'Do you have any other children besides him?' He said: 'Yes.' He said: 'Treat them equally.'" (Using translation from Nasāʾī 3686)

✧ His father brought him to the Messenger of Allah ﷺ and said: 'I have given this son of mine a slave that I owned.' The Messenger of Allah ﷺ said: 'Have you given all your children the like of this?' He said: 'No.' The Messenger of Allah ﷺ said: 'Then take it back.'
قَالَتِ امْرَأَةُ بَشِيرٍ انْحَلِ ابْنِي هَذَا غُلَامًا وَأَشْهِدْ رَسُولَ اللَّهِ ﷺ فَقَالَ يَعْنِي رَسُولَ اللَّهِ ﷺ «أَلَهُ إِخْوَةٌ؟ » قَالَ نَعَمْ قَالَ «فَأَعْطَيْتُ كُلَّ وَاحِدٍ مِنْهُمْ مِثْلَ مَا أَعْطَيْتُهُ؟ » فَقَالَ لَا فَقَالَ «لَا يَصْلُحُ هَذَا وَإِنِّي لَا أَشْهَدُ إِلَّا عَلَى الْحَقِّ»
✧ Bashir's wife said: 'Give this son of mine a slave as a gift, and have the Messenger of Allah ﷺ witness it.' The Messenger of Allah ﷺ said: 'Does he have brothers?' He said: 'Yes.' He said: 'Did you give each of them the like of what you gave him?' He said: 'No.' He said: 'This is not right, and I do not bear witness except to what is true.'

أَنَّ أَبَاهُ أَعْطَاهُ غُلَامًا فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا هَذَا الْغُلَامُ؟ » قَالَ غُلَامٌ أَعْطَانِيهِ أَبِي قَالَ «فَكُلُّ إِخْوَتِكَ أَعْطَاهُ كَمَا أَعْطَاكَ؟ » قَالَ لَا قَالَ «فَارْدُدْهُ» وَقَالَ لِأَبِيهِ لَا تُشْهِدْنِي عَلَى جَوْرٍ
✧ That his father gave him a slave. The Messenger of Allah ﷺ said: 'What is this slave?' He said: 'A slave my father gave me.' He said: 'Did he give all your brothers as he gave you?' He said: 'No.' He said: 'Then return him.' And he said to his father: 'Do not call me as a witness to injustice.'

سَأَلَتْ أُمِّي أَبِي بَعْضَ الْمَوْهِبَةِ مِنْ مَالِهِ فَالْتَوَى بِهِ سَنَةً ثُمَّ بَدَا لَهُ فَوَهَبَهَا لِي وَإِنَّهَا قَالَتْ لَا أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أُمَّ هَذَا بِنْتَ رَوَاحَةَ قَاتَلَتْنِي مُنْذُ سَنَةٍ عَلَى بَعْضِ مَوْهِبَةٍ لِابْنِي هَذَا وَقَدْ بَدَا لِي فَوَهَبْتُهَا لَهُ وَقَدْ أَعْجَبَهَا أَنْ تُشْهِدَكَ يَا رَسُولَ اللَّهِ فَقَالَ «يَا بَشِيرُ أَلَكَ وَلَدٌ سِوَى هَذَا؟ » قَالَ نَعَمْ قَالَ «لَا تُشْهِدْنِي عَلَى جَوْرٍ»
✧ My mother asked my father for some gift from his wealth, and he put her off for a year. Then it occurred to him and he gave it to me. She said: 'I will not be satisfied until you have the Messenger of Allah ﷺ witness it.' He said: 'O Messenger of Allah, the mother of this one, the daughter of Rawaha, has disputed with me for a year over a gift for this son of mine. Now it has occurred to me to give it to him, and she would like you to witness it, O Messenger of Allah.' He said: 'O Bashir, do you have any child other than this one?' He said: 'Yes.' He said: 'Do not call me as a witness to injustice.'
طَلَبَتْ عَمْرَةُ بِنْتُ رَوَاحَةَ إِلَى بَشِيرِ بْنِ سَعْدٍ أَنْ يَنْحِلَنِيَ نَحْلًا مِنْ مَالِهِ وَإِنَّهُ أَبَى عَلَيْهَا ثُمَّ بَدَا لَهُ بَعْدَ حَوْلٍ أَوْ حَوْلَيْنِ أَنْ يَنْحَلَنِيهِ فَقَالَ لَهَا الَّذِي سَأَلْتِ لِابْنِي كُنْتُ مَنَعْتُكِ وَقَدْ بَدَا لِي أَنْ أَنْحَلَهُ إِيَّاهُ قَالَتْ لَا وَاللَّهِ لَا أَرْضَى حَتَّى تَأْخُذَ بِيَدِهِ فَتَنْطَلِقَ بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَتُشْهِدَهُ قَالَ فَأَخَذَ بِيَدِي فَانْطَلَقَ بِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَصَّ عَلَيْهِ الْقِصَّةَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ مَعَهُ وَلَدٌ غَيْرَهُ؟ » قَالَ نَعَمْ قَالَ «فَهَلْ آتَيْتَ كُلَّ وَاحِدٍ مِنْهُمْ مِثْلَ الَّذِي آتَيْتَ هَذَا؟ » قَالَ لَا قَالَ «فَإِنِّي لَا أَشْهَدُ عَلَى هَذَا هَذَا جَوْرٌ أَشْهِدْ عَلَى هَذَا غَيْرِي اعْدِلُوا بَيْنَ أَوْلَادِكُمْ فِي النَّحْلِ كَمَا تُحِبُّونَ أَنْ يَعْدِلُوا بَيْنَكُمْ فِي الْبِرِّ وَاللُّطْفِ»
✧ "To allow me to have a honey bee from his property, but he refused. Then after a while or two, he offered to give me a honey bee. I said to the person who had asked for it for my son, 'I had prevented you, but it has become clear to me that I should allow it for him.' She said, 'No, by Allah, I will not agree until you take him by the hand and present him to the Messenger of Allah ﷺ so that he may intercede for you.' So he took me by the hand and brought me to the Messenger of Allah ﷺ and narrated the incident to him. The Prophet ﷺ said to him, 'Do you have any other offspring besides him?' He said, 'Yes.' The Prophet ﷺ asked, 'Have you given each of them the same as you have given this one?' He replied, 'No.' The Prophet ﷺ then said, 'I will not bear witness in favor of this action. This is an injustice. I only bear witness in favor of justice. Be fair to your children in regard to the bees as you would like them to be fair to you in righteousness and kindness.'"

أَتَى رَسُولُ اللَّهِ ﷺ بَشِيرَ بْنَ سَعْدٍ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ عَمْرَةَ بِنْتَ رَوَاحَةَ أَرَادَتْنِي أَنْ أَتَصَدَّقَ عَلَى ابْنِهَا بِصَدَقَةٍ وَأَمَرَتْنِي أَنْ أُشْهِدَكَ عَلَيْهَا فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «هَلْ لَكَ بَنُونَ سِوَاهُ؟ » قَالَ نَعَمْ قَالَ «فَكُلُّهُمْ أَعْطَيْتَهُمْ مِثْلَ مَا أَعْطَيْتَ هَذَا؟ » قَالَ لَا قَالَ «فَلَا تُشْهِدْنِي عَلَى جَوْرٍ»
✧ Bashir b. Sa'd came to the Messenger of Allah ﷺ and said: 'O Messenger of Allah, 'Amra bt. Rawaha wanted me to give a charitable gift to her son and told me to have you witness it.' The Messenger of Allah ﷺ said to him: 'Do you have sons other than him?' He said: 'Yes.' He said: 'Did you give all of them the like of what you gave this one?' He said: 'No.' He said: 'Then do not call me as a witness to injustice.'
إِنَّ أَبِي نَحَلَنِي كَذَا وَكَذَا فَأَتَى بِي رَسُولَ اللَّهِ ﷺ لِيُشْهِدَهُ فَقَالَ «أَكُلَّ وَلَدِكَ أَعْطَيْتَ مِثْلَ مَا أَعْطَيْتَ؟ » فَقَالَ لَا فَقَالَ رَسُولُ اللَّهِ ﷺ «أَشْهِدْ عَلَى هَذَا غَيْرِي هَذَا جَوْرٌ» ثُمَّ قَالَ «أَتُحِبُّونَ أَنْ يَكُونُوا فِي الْبِرِّ سَوَاءً؟ » قَالَ نَعَمْ قَالَ «فَلَا إِذًا»
✧ My father gave me such-and-such, and he brought me to the Messenger of Allah ﷺ to have him witness it. He said: 'Did you give all your children the like of what you gave him?' He said: 'No.' The Messenger of Allah ﷺ said: 'Have someone other than me witness this. This is injustice.' Then he said: 'Would you like them to be equal in dutifulness to you?' He said: 'Yes.' He said: 'Then not so.'

إِنَّ وَالِدِي بَشِيرَ بْنَ سَعْدٍ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ عَمْرَةَ بِنْتَ رَوَاحَةَ نُفِسَتْ بِغُلَامٍ وَإِنِّي سَمَّيْتُهُ نُعْمَانَ وَإِنَّهَا أَبَتْ أَنْ تُرَبِّيَهُ حَتَّى جَعَلْتُ لَهُ حَدِيقَةً لِي أَفْضَلَ مَالِي هُوَ وَإِنَّهَا قَالَتْ أَشْهِدِ النَّبِيَّ ﷺ عَلَى ذَلِكَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ وَلَدٌ غَيْرَهُ؟ » قَالَ نَعَمْ قَالَ «لَا تُشْهِدْنِي إِلَّا عَلَى عَدْلٍ فَإِنِّي لَا أَشْهَدُ عَلَى جَوْرٍ»
✧ My father Bashir b. Sa'd came to the Messenger of Allah ﷺ and said: 'O Messenger of Allah, 'Amra bt. Rawaha gave birth to a boy, and I named him Nu'man. She refused to raise him unless I gave him a garden of mine, the best of my property. She said: 'Have the Prophet ﷺ witness that.' The Prophet ﷺ said to him: 'Do you have any child other than him?' He said: 'Yes.' He said: 'Do not call me as a witness except to justice, for I do not witness injustice.'
«مَنْ بَلَغَهُ مَعْرُوفٌ عَنْ أَخِيهِ مِنْ غَيْرِ مَسْأَلَةٍ وَلَا إِشْرَافِ نَفْسٍ فَلْيَقْبَلْهُ وَلَا يَرُدَّهُ»
✧ Whoever receives a favor from his brother without asking or coveting, let him accept it and not reject it.
«مَنْ عُرِضَ عَلَيْهِ طِيبٌ فَلَا يَرُدَّهُ فَإِنَّهُ خَفِيفُ الْمَحْمَلِ طَيِّبُ الرَّائِحَةِ»
✧ Whoever is offered perfume should not refuse it, for it is light to carry and pleasant in scent.
كَانَ رَسُولُ اللَّهِ ﷺ فِي دَارِ أَبِي أَيُّوبَ فَأُتِيَ بِطَعَامٍ فِيهِ ثُومٌ فَلَمْ يَأْكُلْ مِنْهُ وَأَرْسَلَ بِهِ إِلَى أَبِي أَيُّوبَ فَلَمْ يَأْكُلْ مِنْهُ أَبُو أَيُّوبَ إِذْ لَمْ يَرَ فِيهِ أَثَرَ النَّبِيِّ ﷺ ثُمَّ أَتَاهُ فَسَأَلَهُ عَنْهُ فَقَالَ يَا رَسُولَ اللَّهِ أَحَرَامٌ هُوَ؟ قَالَ «لَا وَلَكِنْ كَرِهْتُهُ مِنْ أَجْلِ الرِّيحِ» فَقَالَ إِنِّي أَكْرَهُ مَا كَرِهْتَ
✧ The Messenger of Allah ﷺ was in the house of Abu Ayyub. Food containing garlic was brought to him, but he did not eat from it. He sent it to Abu Ayyub, but Abu Ayyub did not eat from it because he did not see the Prophet's ﷺ trace in it. Then he came to him and asked him about it, saying: 'O Messenger of Allah, is it forbidden?' He said: 'No, but I disliked it because of the smell.' He said: 'I dislike what you dislike.'
أَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ يُرِيدُ مَكَّةَ حَتَّى إِذَا كَانَ بِالرَّوْحَاءِ إِذَا حِمَارٌ وَحْشِيٌّ عَقِيرٌ فَذُكِرَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «دَعُوهُ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبَهُ» فَجَاءَ الْبَهْزِيُّ وَهُوَ صَاحِبُهُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ بِهِ رَسُولُ اللَّهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ثُمَّ مَضَى حَتَّى إِذَا كَانَ بِالْأُثَايَةَ بَيْنَ الرُّوَيْثَةِ وَالْعَرْجِ إِذَا ظَبْيٌ حَاقِفٌ فِي ظِلٍّ وَفِيهِ سَهْمٌ فَزَعَمَ أَنَّ رَسُولَ اللَّهِ ﷺ أَمَرَ رَجُلًا يَقِفُ عِنْدَهُ لَا يَرِيبُهُ أَحَدٌ مِنَ النَّاسِ حَتَّى يُجَاوِزَهُ
✧ The Messenger of Allah ﷺ set out for Makkah. When he was at al-Rawha', there was a wounded wild donkey. It was mentioned to the Messenger of Allah ﷺ, and he said: 'Leave it, for its owner will soon come.' Its owner, a man from Bahz, came to the Messenger of Allah ﷺ and said: 'O Messenger of Allah, this donkey is yours to dispose of.' The Messenger of Allah ﷺ ordered Abu Bakr to divide it among the traveling companions. Then he continued until he was at al-Uthaya, between al-Ruwaytha and al-'Arj, where there was a gazelle crouching in the shade with an arrow in it. It is claimed that the Messenger of Allah ﷺ ordered a man to stand by it so that no one would disturb it until he passed it.
بَيْنَمَا نَحْنُ نَسِيرُ مَعَ رَسُولِ اللَّهِ ﷺ بِبَعْضِ أَثْنَاءِ الرَّوْحَاءِ وَهُمْ حُرُمٌ إِذَا حِمَارٌ مَعْقُورٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «دَعُوهُ فَيُوشِكُ صَاحِبُهُ أَنْ يَأْتِيَهُ» فَجَاءَ رَجُلٌ مِنْ بَهْزٍ هُوَ الَّذِي عَقَرَ الْحِمَارَ فَقَالَ يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولُ اللَّهِ ﷺ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ النَّاسِ
✧ While we were traveling with the Messenger of Allah ﷺ through parts of al-Rawha' in a state of ihram, there was a wounded donkey. The Messenger of Allah ﷺ said: 'Leave it, for its owner will soon come to it.' A man from Bahz, the one who had wounded the donkey, came and said: 'O Messenger of Allah, this donkey is yours to dispose of.' The Messenger of Allah ﷺ ordered Abu Bakr to divide it among the people.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ خَرَجَ فَرَأَى حُلَّةَ إِسْتَبْرَقٍ تُبَاعُ فِي السُّوقِ فَأَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ اشْتَرِهَا فَالْبَسْهَا يَوْمَ الْجُمُعَةِ وَحِينَ يَقْدَمُ عَلَيْكَ الْوفُودُ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا يَلْبَسُ هَذِهِ مَنْ لَا خَلَاقَ لَهُ» قَالَ ثُمَّ أُتِيَ رَسُولُ اللَّهِ ﷺ بِثَلَاثِ حُلَلٍ مِنْهَا فَكَسَا عُمَرَ حُلَّةً وَكَسَا عَلِيًّا حُلَّةً وَكَسَا أُسَامَةَ حُلَّةً فَأَتَاهُ عُمَرُ فَقَالَ يَا رَسُولَ اللَّهِ قُلْتَ فِيهَا مَا قُلْتَ ثُمَّ بَعَثْتَ بِهَا إِلَيَّ فَقَالَ «بِعْهَا فَاقْضِ بِهَا حَاجَتَكَ أَوْ شُقَّهَا خُمُرًا بَيْنَ نِسَائِكَ»
✧ 'Umar b. al-Khattab went out and saw a silk brocade suit being sold in the market. He came to the Messenger of Allah ﷺ and said: 'O Messenger of Allah, buy it and wear it on Friday and when delegations come to you.' The Messenger of Allah ﷺ said: 'Only one who has no share in the Hereafter wears this.' Then the Messenger of Allah ﷺ was brought three suits from it, and he gave one to 'Umar, one to 'Ali, and one to Usama. 'Umar came to him and said: 'O Messenger of Allah, you said what you said about it, then you sent one to me.' He said: 'Sell it and meet your need with its price, or cut it into head covers for your women.'
لَمَّا تَزَوَّجَنِي رَسُولُ اللَّهِ ﷺ قَالَ «إِنِّي قَدْ أَهْدَيْتُ إِلَى النَّجَاشِيِّ حُلَّةً وَأَوَاقِيَّ مِسْكٍ وَلَا أُرَاهُ إِلَّا قَدْ مَاتَ وَسَتُرَدُّ الْهَدِيَّةُ فَإِنْ كَانَ كَذَلِكَ فَهِيَ لَكَ» قَالَتْ فَكَانَ كَمَا قَالَ النَّبِيُّ ﷺ مَاتَ النَّجَاشِيُّ وَرُدَّتِ الْهَدِيَّةُ فَدَفَعَ النَّبِيُّ ﷺ إِلَى كُلِّ امْرَأَةٍ مِنْ نِسَائِهِ أُوقِيَّةَ مِسْكٍ وَدَفَعَ الْحُلَّةَ وَسَائِرَ الْمِسْكِ إِلَى أُمِّ سَلَمَةَ
✧ When the Messenger of Allah ﷺ married me, he said, “I had gifted to the Negus a garment and some ounces of musk, and I do not think he has died and the gift will be returned. If that is the case, then it is for you.” She said, “It happened as the Prophet ﷺ said: the Negus died and the gift was returned. The Prophet ﷺ gave to each of his wives an ounce of musk, and gave the garment and the rest of the musk to Umm Salamah.”
أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ فَاشْتَرَطُوا وَلَاءَهَا فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» وَأُهْدِيَ لِرَسُولِ اللَّهِ ﷺ لَحْمٌ فَقُلْتُ لِلنَّبِيِّ ﷺ هَذَا تُصُدِّقَ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
✧ That she wanted to buy Barirah in order to manumit her, but they stipulated her wala'. That was mentioned to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said, “Buy her and manumit her, for wala' belongs to the one who manumits.” And some meat was gifted to the Messenger of Allah ﷺ. I said to the Prophet ﷺ, “This was given as charity to Barirah.” He said, “It is charity for her and a gift for us.”
كَانَ فِي بَرِيرَةَ ثَلَاثُ سُنَنٍ إِحْدَى السُّنَنِ الثَّلَاثِ أَنَّهَا أُعْتِقَتْ فَخُيِّرَتْ فِي زَوْجِهَا وَقَالَ رَسُولُ اللَّهِ ﷺ «الْوَلَاءُ لِمَنْ أَعْتَقَ» وَدَخَلَ رَسُولُ اللَّهِ ﷺ وَالْبُرْمَةُ تَفُورُ بِلَحْمٍ فَقُرِّبَ إِلَيْهِ خُبْزٌ وَإِدَامٌ مِنْ إِدَامِ الْبَيْتِ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَلَمْ أَرَ بُرْمَةً فِيهَا لَحْمٌ» قَالُوا بَلَى يَا رَسُولَ اللَّهِ وَلَكِنْ ذَاكَ لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ وَأَنْتَ لَا تَأْكُلُ الصَّدَقَةَ فَقَالَ رَسُولُ اللَّهِ ﷺ «هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ»
Three Sunan were established because of Barirah. One of those Sunan was that she was set free and was given the choice concerning her husband; the Messenger of Allah said: 'Al Wala' is to the one who set the slave free;' and the Messenger of Allah entered when some meat was being cooked in a pot, but bread and some condiments were brought to him. He said: 'Do I not see a pot in which some meat is being cooked?' They said: 'Yes, O Messenger of Allah, that is meat that was given in charity to Barirah and you do not eat (food given in) charity.' The Messenger of Allah said: 'It is charity for her and a gift for us.' (Using translation from Nasāʾī 3447)

أَنَّ جُوَيْرِيَةَ زَوْجَةَ النَّبِيِّ ﷺ أَخْبَرَتْهُ أَنَّ رَسُولَ اللَّهِ ﷺ دَخَلَ عَلَيْهَا فَقَالَ «هَلْ مِنْ طَعَامٍ؟ » قَالَتْ لَا وَاللَّهِ يَا رَسُولَ اللَّهِ مَا عِنْدَنَا طَعَامٌ إِلَّا عَظْمَ شَاةٍ أُعْطِيَتْ مَوْلَاتِي مِنَ الصَّدَقَةِ قَالَ «قَرِّبِيهِ فَقَدْ بَلَغَتْ مَحِلَّهَا»
✧ That Juwayriyah, the wife of the Prophet ﷺ, informed him that the Messenger of Allah ﷺ entered upon her and said, “Is there any food?” She said, “No, by Allah, O Messenger of Allah, we have no food except a sheep’s bone that was given to my freedwoman from charity.” He said, “Bring it, for it has reached its destination.”
أَنَّ النَّبِيَّ ﷺ دَخَلَ عَلَيْهَا فَقَالَ «هَلْ مِنْ طَعَامٍ؟ » قَالَتْ لَا يَا رَسُولَ اللَّهِ إِلَّا طَعَامٌ أُعْطِيَتْهُ مَوْلَاةٌ لَنَا مِنَ الصَّدَقَةِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قَرِّبِيهِ»
✧ That the Prophet ﷺ entered upon her and said, “Is there any food?” She said, “No, O Messenger of Allah, except food that a freedwoman of ours was given from charity.” The Messenger of Allah ﷺ said, “Bring it.”

أَنَّ النَّبِيَّ ﷺ قَالَ لِعَائِشَةَ «عِنْدَكِ شَيْءٌ تُطْعِمِينِي؟ » قَالَتْ لَا إِلَّا مِنَ الشَّاةِ الَّتِي بُعِثَتْ بِهَا إِلَى نُسَيْبَةُ مِنَ الصَّدَقَةِ قَالَ «هَاتِيهِ فَقَدْ بَلَغَتْ مَحِلَّهَا»
✧ That the Prophet ﷺ said to A’ishah, “Do you have anything to feed me?” She said, “No, except from the sheep that was sent to Nusaybah from charity.” He said, “Bring it, for it has reached its destination.”
اشْتَرَتْ عَائِشَةُ بَرِيرَةَ مِنَ الْأَنْصَارِ لِتُعْتِقَهَا وَاشْتَرَطُوا عَلَيْهَا أَنْ تَجْعَلَ لَهُمْ وَلَاءَهَا فَشَرَطَتْ ذَلِكَ فَلَمَّا جَاءَ نَبِيُّ اللَّهِ ﷺ أَخْبَرَتْهُ بِذَلِكَ فَقَالَ ﷺ «إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» ثُمَّ صَعِدَ الْمِنْبَرَ فَقَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ» وَكَانَ لِبَرِيرَةَ زَوْجٌ فَخَيَّرَهَا رَسُولُ اللَّهِ ﷺ إِنْ شَاءَتْ أَنْ تَمْكُثَ مَعَ زَوْجِهَا كَمَا هِيَ وَإِنْ شَاءَتْ فَارَقَتْهُ فَفَارَقَتْهُ وَدَخَلَ النَّبِيُّ ﷺ الْبَيْتَ وَفِيهِ رِجْلُ شَاةٍ أَوْ يَدٍ فَقَالَ ﷺ لِعَائِشَةَ «أَلَا تَطْبُخُونَ لَنَا هَذَا اللَّحْمَ» فَقَالَتْ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْهُ لَنَا فَقَالَ «اطْبُخُوا فَهُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
✧ A’ishah bought Barirah from the Ansar to manumit her, and they stipulated that she make her wala' theirs. She stipulated that. When the Prophet of Allah ﷺ came, she informed him of that, and he ﷺ said, “Wala' belongs only to the one who manumits.” Then he ascended the minbar and said, “What is the matter with people who stipulate conditions that are not in the Book of Allah?” Barirah had a husband, and the Messenger of Allah ﷺ gave her the choice: if she wished, she could remain with her husband as she was, and if she wished, she could separate from him. She separated from him. The Prophet ﷺ entered the house, and in it was a sheep’s leg or foreleg. He ﷺ said to A’ishah, “Will you not cook this meat for us?” She said, “It was given as charity to Barirah, and she gifted it to us.” He said, “Cook it, for it is charity for her and a gift for us.”
«مَثَلُ الَّذِي يَتَصَدَّقُ ثُمَّ يَرْجِعُ فِي صَدَقَتِهِ مَثَلُ الْكَلْبِ يَقِيءُ ثُمَّ يَرْجِعُ فَيَأْكُلُ قَيْئِهِ»
✧ “The example of the one who gives charity then takes it back is like the dog that vomits then returns and eats its vomit.”
«لَا يَحِلُّ لِرَجُلٍ أَنْ يُعْطِيَ عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ وَمَثَلُ الَّذِي يُعْطِي عَطِيَّةً أَوْ هِبَةً ثُمَّ يَرْجِعُ فِيهَا كَمَثَلِ الْكَلْبِ أَكَلَ حَتَّى شَبِعَ ثُمَّ قَاءَ ثُمَّ عَادَ إِلَى قَيْئِهِ»
✧ “It is not lawful for a man to give a gift or grant then take it back, except a father in what he gives his child. The example of the one who gives a gift or grant then takes it back is like the dog that eats until it is full, then vomits, then returns to its vomit.”
أَنَّ عُمَرَ بْنَ الْخَطَّابِ حَمَلَ عَلَى فَرَسٍ لَهُ فِي سَبِيلِ اللَّهِ فَوَجَدَهُ يُبَاعُ فَأَرَادَ أَنْ يَبْتَاعَهُ فَسَأَلَ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَقَالَ «لَا تَبْتَعْهُ وَلَا تَعُدْ فِي صَدَقَتِكَ»
✧ That Umar b. al-Khattab gave a horse of his to be ridden in the cause of Allah, then he found it being sold. He wanted to buy it, so he asked the Messenger of Allah ﷺ about that. He said, “Do not buy it, and do not take back your charity.”
حَمَلْتُ عَلَى فَرَسٍ فِي سَبِيلِ اللَّهِ فَأَضَاعَهُ الَّذِي كَانَ عِنْدَهُ فَأَرَدْتُ أَنْ أَبْتَاعَهُ مِنْهُ وَظَنَنْتُ أَنَّهُ بَائِعُهُ بِرُخْصٍ فَسَأَلْتُ عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «لَا تَبْتَعْهُ وَإِنْ أَعْطَاكَهُ بِدِرْهَمٍ وَاحِدٍ فَإِنَّ الْعَائِدَ فِي صَدَقَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ»
✧ I gave a horse to be ridden in the cause of Allah, and the one who had it neglected it. I wanted to buy it from him, and I thought that he would sell it cheaply. I asked the Messenger of Allah ﷺ about that, and he said, “Do not buy it, even if he gives it to you for a single dirham, for the one who takes back his charity is like the dog that returns to its vomit.”
«الْعَائِدُ فِي هِبَتِهِ كَالْعَائِدِ فِي قَيْئِهِ»
✧ “The one who takes back his gift is like the one who goes back to his vomit.”
