34. Giving Away Property
«لَا تُرْقِبُوا أَمْوَالَكُمْ فَمَنْ أَرْقَبَ شَيْئًا فَهُوَ لِمَنْ أَرْقَبَهُ»
✧ “Do not reserve your properties as ruqba; whoever gives something as ruqba, it belongs to the one to whom he gave it.”
«لَا تُرْقِبُوا وَلَا تُعْمِرُوا فَمَنْ أَعْمَرَ شَيْئًا أَوْ أَرْقَبَ فَهُوَ لَهُ»
✧ Do not give ruqba or give 'umra; whoever gives 'umra for something or gives ruqba, it belongs to [the recipient].
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «الْعُمْرَى لِمَنْ أَعْمَرَهَا وَالرُّقْبَى لَمْ أَرْقَبَهَا»
✧ From the Messenger of Allah ﷺ, he said: "The 'umra belongs to the one to whom it is given, and the ruqba — I did not give ruqba."
«الْعُمْرَى جَائِزَةٌ»
✧ The 'umra is permissible.
«الْعُمْرَى لِمَنْ وُهِبَتْ لَهُ»
✧ The 'umra belongs to the one to whom it is given.
«لَا عُمْرَى وَمَنْ أَعْمَرَ شَيْئًا فَهُوَ لَهُ»
✧ There is no 'umra; whoever gives 'umra for something, it belongs to him.
«الْعُمْرَى سَبِيلُهَا سَبِيلُ الْمِيرَاثِ»
✧ The 'umra is to be treated like inheritance.
«أَنَّ النَّبِيَّ ﷺ قَضَى بِالْعُمْرَى لِلْوَارِثِ»
✧ The Prophet ﷺ ruled that the 'umra belongs to the heir.
«مَنْ أُعْمِرَ أَرْضًا فَهِيَ لِوَرَثَتِهِ»
✧ Whoever is given 'umra of land, it belongs to his heirs.
«الْعُمْرَى لِمَنْ أُعْمِرَهَا هِيَ لَهُ وَلِعَقِبِهِ يَرِثُهَا مَنْ يَرِثُهُ مِنْ عَقِبِهِ»
✧ The 'umra belongs to the one to whom it is given; it is his and for his descendants; those who inherit from him inherit it.
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لِلْأَنْصَارِ «لَا تُعْمِرُوا أَمْوَالَكُمْ فَمَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ وَلِوَرَثَتِهِ إِذَا مَاتَ»
✧ The Messenger of Allah ﷺ said to the Ansar: "Do not give 'umra of your properties; whoever is given 'umra of something for his lifetime, it belongs to him and to his heirs when he dies."
«أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي أُعْطِيَهَا لَا تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا لِأَنَّهُ أَعْطَى عَطِيَّةً وَقَعَتْ فِيهَا الْمَوَارِيثُ»
✧ Any man who is given 'umra for himself and his descendants, it belongs to the one who was given it; it does not return to the one who gave it, because he gave a gift in which inheritance takes effect.
«مَنْ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَقَدْ قَطَعَ قَوْلُهُ حَقَّهُ مِنْهَا وَهِيَ لِمَنْ أُعْمِرَ وَلِعَقِبِهِ»
✧ Whoever gives a man 'umra for him and his descendants, his statement has cut off his own right to it, and it belongs to the one given 'umra and his descendants.
إِنَّمَا الْعُمْرَى الَّتِي أَجَازَهَا رَسُولُ اللَّهِ ﷺ أَنْ يَقُولَ «هِيَ لَكَ وَلِعَقِبِكَ مِنْ بَعْدِكَ فَأَمَّا إِذَا قَالَ هِيَ لَكَ مَا عِشْتَ فَإِنَّهَا تَرْجِعُ إِلَى صَاحِبِهَا»
✧ The only 'umra that the Messenger of Allah ﷺ permitted is when one says, 'It is for you and for your descendants after you.' As for when he says, 'It is for you as long as you live,' then it reverts to its owner.
«مَنْ أُعْمِرَ شَيْئًا فَهُوَ لَهُ حَيَاتَهُ وَبَعْدَ مَوْتِهِ»
✧ Whoever is given a thing as 'umra, it belongs to him during his life and after his death.
«أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلَا تُعْمِرُوهَا فَإِنَّهُ مَنْ أُعْمِرَ شَيْئًا فَهُوَ لَهُ حَيَاتَهُ وَلِوَرَثَتِهِ إِذَا مَاتَ»
✧ Hold onto your wealth and do not give it as 'umra, for whoever is given a thing as 'umra, it belongs to him during his life and to his heirs when he dies.
