Abu Salamah said, “Because he gave a gift in which the laws of inheritance take effect, and the laws of inheritance cut off his condition.”

✧ Al-Zuhri said: “The lifelong gift is only when one is given it and his descendants after him. If he does not assign his descendants after him, then it belongs to the one who sets his condition.” Qatadah said: Ata b. Abi Rabah was asked and he said: Jabir b. Abd Allah narrated to me that the Messenger of Allah ﷺ said: “The lifelong gift is permissible.” Qatadah said: Al-Zuhri said: “The caliphs did not judge by this.” Ata said: “Abd al-Malik b. Marwan judged by it.”

✧ That the Messenger of Allah ﷺ said: “It is not permissible for a woman to make a gift from her property when her husband controls her marriage bond.” The wording is Muhammad’s. 6556 Ismail b. Masud informed us; he said: Khalid narrated to us; he said: Husayn al-Muallim narrated to us from Amr b. Shuayb, that his father narrated to him, from Abd Allah b. Amr.

قَدِمَ وَفْدُ ثَقِيفٍ عَلَى رَسُولِ اللهِ ﷺ وَمَعَهُمْ هَدِيَّةٌ فَقَالَ «أَهَدِيَّةٌ أَمْ صَدَقَةٌ؟ فَإِنْ كَانَ هَدِيَّةً فَإِنَّهَا يُبْتَغَى بِهَا وَجْهُ رَسُولِ اللهِ وَقَضَاءُ الْحَاجَةِ وَإِنْ كَانَتْ صَدَقَةً فَإِنَّمَا يُبْتَغَى بِهَا وَجْهُ اللهِ» قَالُوا لَا بَلْ هَدِيَّةٌ فَقَبِلَهَا مِنْهُمْ وَقَعَدَ مَعَهُمْ يُسَائِلُهُمْ وَيُسَائِلُونَهُ حَتَّى صَلَّى الظُّهْرَ مَعَ الْعَصْرِ
✧ A delegation of Thaqif came to the Messenger of Allah ﷺ, and with them was a gift. He said: “Is it a gift or charity? If it is a gift, then it is intended for the sake of the Messenger of Allah and fulfilling a need. If it is charity, then it is intended only for the sake of Allah.” They said: “No, rather it is a gift.” So he accepted it from them and sat with them, asking them questions and they asking him, until he prayed Zuhr with Asr.

أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِلَحْمٍ فَقَالَ «مَا هَذَا؟» فَقِيلَ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»
"What is this?" It was said: "It was given in charity to Barirah." He said: "It is charity for her and a gift for us." (Using translation from Nasāʾī 3760)
