The Prophet ﷺ said: I am nearer to every believer than himself, so if anyone leaves a debt or a helpless family, I shall be responsible, but if anyone leaves property, it goes to his heirs. I am patron of him who has none, inheriting his property and freeing him from his liabilities. A maternal uncle is patron of him who has none, inheriting his property and freeing him from his liabilities. Abu Dawud said: da'iah means dependants or helpless family. Abu Dawud said: This tradition has been transmitted by al-Zubaidi from Rashid b. Sa'd from Ibn 'A'idh on the authority of al-Miqdam. It has also been transmitted by Mu'awiyah b. Salih from Rashid who said: I heard al-Miqdam (say).

machine translationThis hadith is not strong (laysa bi-l-qawī). It was narrated by Rāshid b. Saʿd and Abū ʿĀmir ʿAbdullāh b. Luḥayy al-Hawzanī, both of whom the two Shaykhs use as evidence. It is a hadith that is disputed, and Ismāʿīl b. ʿAyyāsh narrated it, and he is weak (ḍaʿīf).

Saʿd, from Abū ʿĀmir al-Hawzanī, from al-Miqdām; Shuʿbah, Ḥammād b. Zayd and Ibrāhīm b. Ṭahmān related it. Muʿāwiyah b. Ṣāliḥ differed from them and narrated it from Rāshid b. Saʿd, from al-Miqdām, without mentioning Abū ʿĀmir. The first is closer to the correct view.

machine translationAbū Zurʿah said: Ḥammād b. Salamah made an error in it. The correct version is what Shuʿbah and Ḥammād b. Zayd narrated from Budayl b. Maysarah, from ʿAlī b. Abī Ṭalḥah, from Rāshid b. Saʿd, from Abū ʿĀmir al-Hawzanī, from al-Miqdām al-Kindī, from the Prophet ﷺ, who said: "The maternal uncle is the heir of one who has no heir."
