✧ The Permissibility of Abandoning the Forbidding of Wrong for One Who Is Unable

وَقَالَ أَبُو يَعْلَى: حَدَّثَنَا أَحْمَدُ بْنُ الْمِقْدَامِ، ثَنَا عُبَيْدُ بْنُ الْقَاسِمِ، ثَنَا الْعَلَاءُ بْنُ ثَعْلَبَةَ، عَنْ أَبِي الْمَلِيحِ الْهُذَلِيِّ، عَنْ وَاثِلَةَ بْنِ الْأَسْقَعِ ؓ، قَالَ:
رَأَيْتُ النَّبِيَّ ﷺ بِمَسْجِدِ الْخَيْفِ، وَقَالَ لِي أَصْحَابُهُ: إِلَيْكَ يَا وَاثِلَةُ، أَيْ: تَنَحَّ عَنْ وَجْهِهِ، فَقَالَ: دَعُوهُ فَإِنَّمَا جَاءَ لِيَسْأَلَ، فَدَنَوْتُ، فَقُلْتُ: بِأَبِي أَنْتَ وَأُمِّي يَا رَسُولَ اللهِ، أَفْتِنَا عَنْ أَمْرٍ نَأْخُذُهُ عَنْكَ مِنْ بَعْدِكَ، قَالَ ﷺ: لِتُفْتِكَ نَفْسُكَ، قُلْتُ: وَكَيْفَ لِي بِذَلِكَ ؟ قَالَ ﷺ: دَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَرِيبُكَ، وَإِنْ أَفْتَاكَ الْمُفْتُونَ، قُلْتُ: وَكَيْفَ لِي بِعِلْمِ ذَلِكَ ؟ قَالَ ﷺ: تَضَعُ يَدَكَ عَلَى فُؤَادِكَ، فَإِنَّ الْقَلْبَ يَسْكُنُ إِلَى الْحَلَالِ، وَلَا يَسْكُنُ لِلْحَرَامِ، وَإِنَّ وَرَعَ الْمُسْلِمِ أَنْ يَدَعَ الصَّغِيرَ مَخَافَةَ أَنْ يَقَعَ فِي الْكَبِيرِ، قُلْتُ: فَمَنِ الْحَرِيصُ ؟ قَالَ: الَّذِي يَطْلُبُ الْمَكْسَبَ فِي غَيْرِ حِلِّهَا، قُلْتُ: فَمَنِ الْوَرِعُ ؟ قَالَ ﷺ: الَّذِي يَقِفُ عِنْدَ الشُّبْهَةِ، قُلْتُ: فَمَنِ الْمُؤْمِنُ ؟ قَالَ: مَنْ أَمِنَهُ النَّاسُ عَلَى أَمْوَالِهِمْ وَدِمَائِهِمْ، قُلْتُ: فَمَنِ الْمُسْلِمُ ؟ قَالَ ﷺ: مَنْ سَلِمَ الْمُسْلِمُونَ مِنْ لِسَانِهِ وَيَدِهِ، قُلْتُ: فَأَيُّ الْجِهَادِ أَفْضَلُ ؟ قَالَ ﷺ: كَلِمَةُ حَقٍّ عِنْدَ إِمَامٍ جَائِرٍ

✧ I saw the Prophet ﷺ in the mosque of al-Khayf, and his companions said to me: "Move aside, O Wathilah," meaning: get out of his way. He said: "Leave him, for he has only come to ask." So I drew near and said: "May my father and mother be your ransom, O Messenger of Allah, give us a ruling about a matter that we may take from you after you are gone." He ﷺ said: "Let your own self give you a ruling." I said: "How can I do that?" He ﷺ said: "Leave what causes you doubt for what does not cause you doubt, even if the muftis give you rulings." I said: "How can I know that?" He ﷺ said: "Place your hand on your heart, for the heart is at rest with the lawful and is not at rest with the unlawful. And the scrupulousness of a Muslim is that he leaves the small sin for fear of falling into the great one." I said: "Who is the greedy?" He said: "The one who seeks earnings from what is not lawful." I said: "Who is the scrupulous?" He ﷺ said: "The one who stops at what is doubtful." I said: "Who is the believer?" He said: "The one whom people trust with their wealth and their lives." I said: "Who is the Muslim?" He ﷺ said: "The one from whose tongue and hand the Muslims are safe." I said: "Which jihad is best?" He ﷺ said: "A word of truth in the presence of a tyrannical ruler."
