44. Chapter of Ḍād (Female)

   أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِضُبَاعَةَ «حُجِّي وَاشْتَرِطِي أَنَّ مَحِلِّي حَيْثُ حَبَسْتَنِي»

   ✧ The Prophet of Allah ﷺ said to a merchant, "Perform Hajj and make a condition that my place of confinement is where you have detained me."

   «أَنَّ رَسُولَ اللهِ ﷺ أَمَرَهَا أَنْ تَشْتَرِطَ فِي إِحْرَامِهَا»

   ✧ The Messenger of Allah ﷺ commanded her to stipulate a condition in her ihram.

   أَنَّهَا «رَأَتْ رَسُولَ اللهِ ﷺ أَكَلَ كَتِفًا ثُمَّ قَامَ إِلَى الصَّلَاةِ وَلَمْ يَتَوَضَّأْ»

   ✧ She saw the Messenger of Allah ﷺ eat a shoulder, then stand for prayer without performing wudu.

   «أَنَّهَا رَفَعَتْ لِلنَّبِيِّ ﷺ لَحْمًا فَانْتَهَشَ مِنْهُ ثُمَّ صَلَّى وَلَمْ يَتَوَضَّأْ»

   ✧ She (Aisha) lifted some meat for the Prophet ﷺ, he took a bite from it, then he prayed without performing ablution.

   عَنْ زَيْنَبَ بِنْتِ نُبَيْطٍ عَنْ ضُبَاعَةَ بِنْتِ الزُّبَيْرِ أَنَّ النَّبِيَّ ﷺ قَالَ لَهَا «حُجِّي وَاشْتَرِطِي»

   ✧ From Zaynab bint Nubayṭ, from Dubāʿah bint al-Zubayr, that the Prophet ﷺ said to her: "Perform Hajj and stipulate a condition."

   أَنَّ النَّبِيَّ ﷺ أَمَرَهَا أَنْ تُحْرِمَ فَقَالَتْ إِنِّي مَرِيضَةٌ فَقَالَ لَهَا «اشْتَرِطِي أَنَّ مَحِلِّي حَيْثُ حَبَسْتَنِي» فَلَمَّا سَمِعَ ابْنُ عَبَّاسٍ بِهَذَا الْحَدِيثِ قَالَ «الْحَمْدُ لِلَّهِ أَنْ كُنْتُ لِأَفْعَلَهُ وَمَا سَمِعْتُ فِيهِ بِشَيْءٍ»

   ✧ The Prophet ﷺ commanded her to enter ihram. She said, "I am ill." He said to her: "Stipulate a condition that my place of exiting ihram is wherever You detain me." When Ibn ʿAbbās heard this hadith, he said: "Praise be to Allah. I would have done it, but I had not heard anything about it."

   دَخَلْتُ عَلَى رَسُولِ اللهِ ﷺ وَأَنَا أَشْتَكَى فَذَكَرْتُ لَهُ الْحَجَّ فَقَالَ «حُجِّي وَاشْتَرِطِي اللهُمَّ مَحِلِّي حَيْثُ حَبَسْتَنِي»

   ✧ I entered upon the Messenger of Allah ﷺ while I was complaining of illness, and I mentioned Hajj to him. He said: "Perform Hajj and stipulate a condition: O Allah, my place of exiting ihram is wherever You detain me."

   دَخَلَ عَلِيَّ النَّبِيُّ ﷺ وَأَنَا شَاكِيَةٌ فَقَالَ «أَمَا تُرِيدِينَ الْحَجَّ الْعَامَ؟» فَقَالَتْ إِنِّي عَلِيلَةٌ يَا رَسُولَ اللهِ قَالَ حُجِّي وَقُولِي مَحِلِّي حَيْثُ حَبَسْتَنِي

   ✧ The Prophet ﷺ entered upon me while I was ill and said: "Do you not intend to perform Hajj this year?" She said, "I am sick, O Messenger of Allah." He said: "Perform Hajj and say: My place of exiting ihram is wherever You detain me."

   أَنَّهَا كَانَتْ فِي بَيْتِهَا شَاةٌ فَأَرْسَلَ إِلَيْهَا رَسُولُ اللهِ ﷺ «أَنْ أَطْعِمِينَا مِنْ شَاتِكُمْ» فَقَالَتْ لِلرَّسُولِ مَا بَقِيَ عِنْدَنَا إِلَّا الرَّقَبَةُ وَأَنَا أَسْتَحْيِي أَنْ أُرْسِلَ بِهَا إِلَى رَسُولِ اللهِ ﷺ فَرَجَعَ الرَّسُولُ إِلَيْهِ فَأَخْبَرَهُ فَقَالَ ارْجِعْ إِلَيْهَا فَقُلْ لَهَا أَرْسِلِي بِهَا فَإِنَّهَا هَادِيَةُ الشَّاةِ وَأَقْرَبُ الشَّاةِ إِلَى الْخَيْرِ وَأَبْعَدُهَا مِنَ الْأَذَى

   ✧ She had a sheep in her house. The Messenger of Allah ﷺ sent to her: "Feed us from your sheep." She said to the messenger, "Nothing remains with us except the neck, and I am ashamed to send it to the Messenger of Allah ﷺ." The messenger returned to him and informed him. He said: "Go back to her and tell her: Send it, for it is the guide of the sheep, the closest part of the sheep to good, and the farthest from harm."

    لَهُ أُمِّي عَمْرَةُ بِنْتُ رَوَاحَةَ ائْتِ رَسُولَ اللهِ ﷺ وأَشْهِدْهُ فَأَتَى رَسُولَ اللهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ إِنِّي نَحَلْتُ ابْنِي النُّعْمَانَ نُحْلًا وَإِنَّ عَمْرَةَ سَأَلْتَنِي أَنْ أُشْهِدُكَ عَلَى ذَلِكَ فَقَالَ «لَكَ وَلَدٌ سِوَاهُ؟» فَقُلْتُ نَعَمْ قَالَ «وَكُلُّهُمْ أَعْطَيْتُهُمْ مِثْلَ مَا أَعْطَيْتُ النُّعْمَانَ؟» قَالَ لَا قَالَ بَعْضُ هَؤُلَاءِ الْمُحَدِّثِينَ «هَذَا جَوْرٌ» وَقَالَ بَعْضُهُمْ «هَذِهِ تَلْجِئَةٌ أَشْهِدْ عَلَى هَذَا غَيْرِي» قَالَ مُغِيرَةُ «أَلَيْسَ يَسُرُّكَ أَنْ يَكُونُوا لَكَ فِي الْبِرِّ وَاللُّطْفِ سَوَاءً؟» قَالَ نَعَمْ قَالَ «فَأَشْهِدْ عَلَى هَذَا غَيْرِي» وَذَكَرَ مُجَالِدٌ فِي حَدِيثِهِ «أَنَّ لَهُمْ عَلَيْكَ مِنَ الْحَقِّ أَنْ تَعْدِلَ بَيْنَهُمْ كَمَا أَنَّ لَكَ مِنَ الْحَقِّ عَلَيْهِمْ أَنْ يَبَرُّوكَ»

    ✧ My mother ʿAmrah bint Rawāḥah said to him: "Come to the Messenger of Allah ﷺ and have him witness it." He came to the Messenger of Allah ﷺ and mentioned that to him, saying: "I have given my son al-Nuʿmān a gift, and ʿAmrah asked me to have you witness that." He said: "Do you have any other children besides him?" I said, "Yes." He said: "Have you given all of them the like of what you gave al-Nuʿmān?" He said, "No." Some of these hadith narrators said: "This is injustice," and others said: "This is coercion. Have someone other than me witness this." Mughīrah said: "Would it not please you that they be equal to you in dutifulness and kindness?" He said, "Yes." He said: "Then have someone other than me witness this." Mujālid mentioned in his hadith: "They have a right over you that you treat them justly, just as you have a right over them that they be dutiful to you."

    عَنْ رَسُولِ اللهِ ﷺ قَالَ «وَجَبَ الْخُرُوجُ عَلَى كُلِّ ذِي نِطَاقٍ»

    ✧ The Messenger of Allah ﷺ said: "Going out is obligatory upon every possessor of a waist-wrapper."
