نا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ نا الْقَاسِمُ بْنُ عَبْدِ اللَّهِ بْنِ مَهْدِيٍّ حَدَّثَنِي عَمِّي مُحَمَّدُ بْنُ مَهْدِيٍّ نا عَنْبَسَةُ بْنُ خَالِدٍ عَنْ يُونُسَ بْنِ يَزِيدَ قَالَ سَأَلْتُ ابْنَ شِهَابٍ الزُّهْرِيَّ عَنِ الْجَدِّ وَالْإِخْوَةِ مِنَ الْأَبِ وَالْأُمِّ فَقَالَ أَخْبَرَنِي سَعِيدُ بْنُ الْمُسَيِّبِ وَعُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ وَقَبِيصَةُ بْنُ ذُؤَيْبٍ
أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَضَى أَنَّ الْجَدَّ يُقَاسِمُ الْإِخْوَةَ لِلْأَبِ وَالْأُمِّ وَالْإِخْوَةَ لِلْأَبِ مَا كَانَتِ الْمُقَاسَمَةُ خَيْرًا لَهُ مِنْ ثُلُثِ الْمَالِ فَإِنْ كَثُرَ الْإِخْوَةُ فَأَعْطَى الْجَدَّ الثُّلُثَ وَكَانَ لِلْإِخْوَةِ مَا بَقِيَ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ وَقَضَى أَنَّ بَنِي الْأَبِ وَالْأُمِّ هُمْ أَوْلَى بِذَلِكَ مِنْ بَنِي الْأَبِ ذُكُورِهِمْ أَنَّ بَنِي الْأَبِ يُقَاسِمُونَ الْجَدَّ بِبَنِي الْأَبِ وَالْأُمِّ فَيَرُدُّونَ عَلَيْهِمْ وَلَا يَكُونُ لِبَنِي الْأَبِ شَيْءٌ مَعَ بَنِي الْأَبِ وَالْأُمِّ إِلَّا أَنْ يَكُونَ بَنُو الْأَبِ يَرُدُّونَ عَلَى بَنَاتِ الْأَبِ وَالْأُمِّ فَإِنْ بَقِيَ شَيْءٌ بَعْدَ فَرَائِضِ بَنَاتِ الْأَبِ وَالْأُمِّ فَهُوَ لِلْأُخُوَّةِ مِنَ الْأَبِ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ

✧ That Umar b. al-Khattab ruled that the grandfather shares with full brothers and paternal brothers as long as sharing is better for him than a third of the estate. If the brothers are numerous, he gives the grandfather a third, and the brothers get what remains, with the male receiving the share of two females. He also ruled that the children of the same father and mother are more entitled to that than the paternal brothers, their males, and that the paternal brothers share with the grandfather alongside the full brothers and refer back to them, and the paternal brothers get nothing with the full brothers unless the paternal brothers refer back to the daughters of the same father and mother. If anything remains after the fixed shares of the daughters of the same father and mother, it goes to the paternal brothers, with the male receiving the share of two females.
