حَدَّثَنَا أَبُو بَكْرٍ، حَدَّثَنَا يُونُسُ بْنُ مُحَمَّدٍ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، حَدَّثَنَا مُجَالِدُ بْنُ سَعِيدٍ، حَدَّثَنِي الشَّعْبِيُّ، عَنْ جَابِرٍ
أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ قَتَلَتْ إِحْدَاهُمَا الْأُخْرَى، وَلِكُلِّ وَاحِدَةٍ مِنْهُمَا زَوْجٌ وَوَلَدٌ، فَجَعَلَ رَسُولُ اللهِ ﷺ دِيَةَ الْمَقْتُولِ عَلَى عَاقِلَةِ الْقَاتِلَةِ، وَبَرَّأَ زَوْجَهَا وَوَلَدَهَا، قَالَ: فَقَالَ عَاقِلَةُ الْمَقْتُولِ: مِيرَاثُهَا لَنَا، فَقَالَ رَسُولُ اللهِ ﷺ: لَا، مِيرَاثُهَا لِزَوْجِهَا وَوَلَدِهَا، قَالَ: وَكَانَتْ حُبْلَى، فَقَالَتْ عَاقِلَةُ الْمَقْتُولَةِ: إِنَّهَا كَانَتْ حُبْلَى، وَأَلْقَتْ جَنِينًا، قَالَ: فَخَافَ عَاقِلَةُ الْقَاتِلَةِ أَنْ يُضَمِّنَهُمْ، قَالَ: فَقَالُوا: يَا رَسُولَ اللهِ، لَا شَرِبَ، وَلَا أَكَلَ، وَلَا صَاحَ، فَاسْتَهَلَّ، فَقَالَ رَسُولُ اللهِ ﷺ: أَسَجْعُ الْجَاهِلِيَّةِ ؟ فَقَضَى فِي الْجَنِينِ غُرَّةً: عَبْدٌ أَوْ أَمَةٌ

✧ Two women of Hudhayl, one killed the other, and each of them had a husband and a child. The Messenger of God ﷺ made the blood money of the slain woman the responsibility of the killer's agnates, and he absolved her husband and child. He said: The agnates of the slain woman said, "Her inheritance belongs to us." The Messenger of God ﷺ said, "No, her inheritance belongs to her husband and her child." He said: She was pregnant, so the agnates of the slain woman said, "She was pregnant and she cast a fetus." He said: The agnates of the killer feared that they would be held liable. He said: They said, "O Messenger of God, it did not drink, nor eat, nor cry out, so did it utter a sound?" The Messenger of God ﷺ said, "Is it the rhymed prose of the pre-Islamic era?" So he ruled for the fetus a ghurrah: a male slave or a female slave.
