( أَخْبَرَنَا ) أَبُو الْقَاسِمِ عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ الْعَطَّارُ بِبَغْدَادَ، ثَنَا أَحْمَدُ بْنُ سَلْمَانَ الْفَقِيهُ، ثَنَا عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ، ثَنَا مُعَلَّى بْنُ أَسَدٍ، ثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، ثَنَا مُجَالِدُ بْنُ سَعِيدٍ، حَدَّثَنِي الشَّعْبِيُّ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ:

أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ قَتَلَتْ إِحْدَاهُمَا الْأُخْرَى وَلِكُلِّ وَاحِدَةٍ مِنْهُمَا زَوْجٌ وَوَلَدٌ، فَجَعَلَ رَسُولُ اللهِ ﷺ دِيَةَ الْمَقْتُولَةِ عَلَى عَاقِلَةِ الْمَرْأَةِ الْقَاتِلَةِ وَبَرَّأَ زَوْجَهَا وَوَلَدَهَا، فَقَالَتْ: عَاقِلَةُ الْمَقْتُولَةِ مِيرَاثُهَا لَنَا فَقَالَ رَسُولُ اللهِ ﷺ: " مِيرَاثُهَا لِزَوْجِهَا وَوَلَدِهَا ". وَكَانَتْ حُبْلَى فَأَلْقَتْ جَنِينَهَا، فَخَافَتْ عَاقِلَةُ الْقَاتِلَةِ أَنْ يُضَمِّنَهُمْ فَقَالُوا: يَا رَسُولَ اللهِ، لَا شَرِبَ وَلَا أَكَلَ وَلَا صَاحَ فَاسْتَهَلَّ. فَقَالَ رَسُولُ اللهِ ﷺ: " هَذَا سَجْعُ الْجَاهِلِيَّةِ ". فَقَضَى فِي الْجَنِينِ غُرَّةً: عَبْدً أَوْ أَمَةً.
