حَدَّثَنَا أَبُو خَيْثَمَةَ، حَدَّثَنَا يُونُسُ بْنُ مُحَمَّدٍ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، قَالَ: أَخَذْتُ هَذَا الْكِتَابَ مِنْ ثُمَامَةَ بْنِ عَبْدِ اللهِ بْنِ أَنَسٍ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ أَبَا بَكْرٍ، كَتَبَ لَهُ
أَنَّ هَذِهِ فَرَائِضُ الصَّدَقَةِ الَّتِي أَمَرَ اللهُ بِهَا رَسُولَهُ، فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطِهَا، وَمَنْ سُئِلَ فَوْقَهُ فَلَا يُعْطِهِ: فِيمَا دُونَ خَمْسٍ وَعِشْرِينَ مِنَ الْإِبِلِ، فِي خَمْسِ ذَوْدٍ: شَاةٌ، فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ فَفِيهَا ابْنَةُ مَخَاضٍ، إِلَى خَمْسٍ وَثَلَاثِينَ، فَإِذَا لَمْ يَكُنِ ابْنَةُ مَخَاضٍ فَابْنُ لَبُونٍ ذَكَرٌ، فَإِذَا بَلَغَتْ سِتًّا وَثَلَاثِينَ فَفِيهَا ابْنَةُ لَبُونٍ، إِلَى خَمْسٍ وَأَرْبَعِينَ، فَإِذَا بَلَغَتْ سِتًّا وَأَرْبَعِينَ فَفِيهَا حِقَّةٌ طَرُوقَةُ الْفَحْلِ، إِلَى سِتِّينَ، فَإِذَا بَلَغَتْ وَاحِدًا وَسِتِّينَ فَفِيهَا جَذَعَةٌ إِلَى خَمْسٍ وَسَبْعِينَ، فَإِذَا بَلَغَتْ سِتَّةً وَسَبْعِينَ فَفِيهَا ابْنَتَا لَبُونٍ إِلَى تِسْعِينَ، فَإِذَا بَلَغَتْ وَاحِدًا وَتِسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ، إِلَى عِشْرِينَ وَمِائَةٍ، فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ أَرْبَعِينَ بِنْتُ لَبُونٍ، وَفِي كُلِّ خَمْسِينَ حِقَّةٌ، فَإِذَا تَبَايَنَ أَسْنَانُ الْإِبِلِ فِي الْفَرَائِضِ الصَّدَقَاتِ، فَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْجَذَعَةِ وَلَيْسَتْ عِنْدَهُ جَذَعَةٌ، وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ، وَيُجْعَلُ مَعَهَا شَاتَانِ إِنِ اسْتَيْسَرَتَا لَهُ، أَوْ عِشْرِينَ دِرْهَمًا، وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ، وَلَيْسَ عِنْدَهُ إِلَّا جَذَعَةٌ، فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ، وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ، وَلَيْسَتْ عِنْدَهُ، وَعِنْدَهُ ابْنَةُ لَبُونٍ، فَإِنَّهَا تُقْبَلُ مِنْهُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا أَوْ عِشْرِينَ دِرْهَمًا، وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ لَبُونٍ، وَلَيْسَتْ عِنْدَهُ إِلَّا حِقَّةٌ، فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ، وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ لَبُونٍ، وَلَيْسَتْ عِنْدَهُ ابْنَةُ لَبُونٍ، وَعِنْدَهُ ابْنَةُ مَخَاضٍ، فَإِنَّهَا تُقْبَلُ مِنْهُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا، أَوْ عِشْرِينَ دِرْهَمًا، وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ مَخَاضٍ، وَلَيْسَ عِنْدَهُ إِلَّا ابْنُ لَبُونٍ ذَكَرٌ، فَإِنَّهُ يُقْبَلُ مِنْهُ وَلَيْسَ مَعَهُ شَيْءٌ، وَمَنْ لَمْ يَكُنْ عِنْدَهُ إِلَّا أَرْبَعَةٌ مِنَ الْإِبِلِ فَلَيْسَ فِيهَا شَيْءٌ إِلَّا أَنْ يَشَاءَ رَبُّهَا، وَفِي صَدَقَةِ الْغَنَمِ فِي سَائِمَتِهَا، إِذَا كَانَتْ أَرْبَعِينَ، فَفِيهَا شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ، فَإِذَا زَادَتْ فَفِيهَا شَاتَانِ إِلَى مِائَتَيْنِ، فَإِذَا زَادَتْ فَفِيهَا ثَلَاثُ شِيَاهٍ إِلَى ثَلَاثِمِائَةٍ، فَإِذَا زَادَتْ وَاحِدَةً فَفِي كُلِّ مِائَةٍ شَاةٌ، وَلَا تُؤْخَذُ فِي الصَّدَقَةِ هَرِمَةٌ وَلَا ذَاتُ عَوَارٍ وَلَا تَيْسُ الْغَنَمِ، إِلَّا أَنْ يَشَاءَ الْمُصَدِّقُ، وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ، وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ، وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ، إِذَا كَانَتْ سَائِمَةُ الرَّجُلِ نَاقِصَةً مِنَ الْأَرْبَعِينَ شَاةً وَاحِدَةً، فَلَيْسَ فِيهَا، إِلَّا أَنْ يَشَاءَ رَبُّهَا، وَفِي الرِّقَةِ رُبُعُ الْعُشُورِ، فَإِذَا لَمْ يَكُنِ الْمَالُ إِلَّا تِسْعِينَ وَمِائَةَ دِرْهَمٍ، فَلَيْسَ فِيهِ شَيْءٌ، إِلَّا أَنْ يَشَاءَ رَبُّهَا

✧ These are the obligatory alms that Allah enjoined upon His Messenger. Whoever among the Muslims is asked for them in their proper manner should give them, and whoever is asked for more should not give it: For fewer than twenty-five camels, for every five a ewe; when they reach twenty-five, a one-year-old she-camel is due up to thirty-five; if there is no one-year-old she-camel, then a male two-year-old camel; when they reach thirty-six, a two-year-old she-camel is due up to forty-five; when they reach forty-six, a three-year-old she-camel that has been covered by the stallion is due up to sixty; when they reach sixty-one, a four-year-old she-camel is due up to seventy-five; when they reach seventy-six, two two-year-old she-camels are due up to ninety; when they reach ninety-one, two three-year-old she-camels that have been covered by the stallion are due up to one hundred and twenty; when they exceed one hundred and twenty, for every forty a two-year-old she-camel, and for every fifty a three-year-old she-camel. If the ages of camels differ in the obligatory alms, then whoever owes a four-year-old she-camel but does not have one and has a three-year-old she-camel, it may be accepted from him, and he adds two ewes if they are easy for him, or twenty dirhams. Whoever owes a three-year-old she-camel but has only a four-year-old she-camel, it may be accepted from him, and the collector gives him twenty dirhams or two ewes. Whoever owes a three-year-old she-camel but does not have one and has a two-year-old she-camel, it may be accepted from him, and he adds two ewes if they are easy for him, or twenty dirhams. Whoever owes a two-year-old she-camel but has only a three-year-old she-camel, it may be accepted from him, and the collector gives him twenty dirhams or two ewes. Whoever owes a two-year-old she-camel but does not have one and has a one-year-old she-camel, it may be accepted from him, and he adds two ewes if they are easy for him, or twenty dirhams. Whoever owes a one-year-old she-camel but has only a male two-year-old camel, it may be accepted from him without anything added. Whoever has only four camels, nothing is due unless their owner wishes. On zakat of sheep in their grazing herds, when they are forty, one ewe is due up to one hundred and twenty; when they exceed that, two ewes up to two hundred; when they exceed that, three ewes up to three hundred; when they exceed that by one, for every hundred one ewe. In zakat, no old ewe, no defective animal, and no male goat is to be taken unless the collector wishes. Herds should not be combined, and combined herds should not be separated out of fear of zakat. Whatever belongs to two partners, they settle between themselves equally. If a man's grazing herd is one ewe short of forty, nothing is due unless its owner wishes. On silver, one quarter of one tenth is due; if the wealth is only one hundred and ninety dirhams, nothing is due unless its owner wishes.
