✧ The Seller's Right to the Slave's Wealth as Opposed to the Buyer

إِسْحَاقُ: أَخْبَرَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ الْمَدَنِيُّ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ ؓ قَالَ:

مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ. قَضَى بِذَلِكَ رَسُولُ اللهِ ﷺ

Translation

Chain of narrators

✧ Whoever sells a slave who has property, his property belongs to the seller unless the buyer stipulates it. And whoever sells palm trees that have been pollinated, their fruit belongs to the seller unless the buyer stipulates it. The Messenger of God ﷺ judged accordingly.
