The caliphate of ʿUmar b. al-Khaṭṭāb
ضَرَبَ عُمَرُ بْنُ الْخَطَّابِ ابْنَهُ عُبَيْدَ اللَّهِ فِي الشَّرَابِ هُوَ وَجَمَاعَةٌ مَعَهُ وَفِي سَّنَةِ أربع عشرة من الهجرة ضَرَبَ عُمَرُ أَبَا مِحْجَنٍ الثَّقَفِيَّ سَبْعَ مَرَّاتٍ فِي الْخَمْرِ، وَضَرَبَ مَعَهُ رَبِيعَةَ بْنَ أُمَيَّةَ بْنِ خَلَفٍ، فِي شَرَابٍ شَرِبُوهُ فِي ذَلِكَ، وَضَرَبَ ابْنَهُ عَبْدَ الرَّحْمَنِ فِي ذَلِكَ. فَعن سَالِمُ بْنُ عَبْدِ اللَّهِ ]، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ قَالَ: شَرِبَ عَبْدُ الرَّحْمَنِ بْنُ عُمَرَ، وَشَرِبَ مَعَهُ أَبُو سِرْوَعَةَ عُقْبَةُ بْنُ الْحَارِثِ، وَنَحْنُ بِمِصْرَ فِي خَلَافَةِ عُمَرَ بْنِ الْخَطَّابِ، فَسَكِرَا، فَلَمَّا أَصْبَحُوا انْطَلَقَا إِلَى عَمْرِو بْنِ الْعَاصِ وَهُوَ أَمِيرُ مِصْرَ، فَقَالَا: أَطْهِرْنَا فَإِنَّا قَدْ سَكِرْنَا مِنْ شَرَابٍ شَرِبْنَاهُ. قَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ: وَلَمْ أَشْعُرْ أَنَّهُمَا أَتَيَا عَمْرَو بْنَ الْعَاصِ. قَالَ: فَذَكَرُوا أَخِي أَنَّهُ قَدْ سَكِرَ، فَقُلْتُ لَهُ: ادْخُلِ الَّدَارَ أُطَهِّرْكَ، فَآذَنَنِي أَنَّهُ حَدَّثَ الْأَمِيرَ. فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ: فَقُلْتُ: وَاللَّهِ لَا يُحْلَقُ الْيَوْمَ عَلَى رُءُوسِ النَّاسِ، ادْخُلْ أَحْلِقْكَ -وَكَانُوا إِذْ ذَاكَ يَحْلِقُونَ مَعَ الْحَدِّ، فَدَخَلَ مَعِي الدَّارَ، فَحَلَقْتُ أَخِي بِيَدِي، ثُمَّ جَلَدَهُمَا عَمْرُو بْنُ الْعَاصِ فَسَمِعَ عُمَرُ بْنُ الْخَطَّابِ بِذَلِكَ، فَكَتَبَ إِلَى عَمْرٍو: أَنِ ابْعَثْ إِلَيَّ بِعَبْدِ الرَّحْمَنِ بْنِ عُمَرَ عَلَى قَتَبٍ، فَفَعَلَ ذَلِكَ عَمْرٌو، فَلَمَّا قَدِمَ عَبْدُ الرَّحْمَنِ عَلَى عُمَرَ جَلَدَهُ وَعَاقَبَهُ مِنْ أَجْلِ مَكَانِهِ مِنْهُ، ثُمَّ أَرْسَلَهُ، فَلَبِثَ شَهْرًا صَحِيحًا ثُمَّ أَصَابَهُ قَدَرُهُ، فَتَحْسِبُ عَامَّةُ النَّاسِ أَنَّهُ مَاتَ مِنْ جَلْدِ عُمَرَ، وَلَمْ يَمُتْ مِنْ جَلْدِهِ. قَالَ ابن الجوزي: وَلَا يَنْبَغِي أَنْ يُظَنَّ بِعَبْدِ الرَّحْمَنِ أَنَّهُ شَرِبَ الْخَمْرَ، إِنَّمَا شَرِبَ النَّبِيذَ مُتَأَوِّلًا، فَظَنَّ أَنَّ مَا شَرِبَ مِنْهُ لَا يُسْكِرُ، وَكَذَلِكَ أَبُو سِرْوَعَةَ، فَلَمَّا خَرَجَ الْأَمْرُ بِهِمَا إِلَى السُّكْرِ طَلَبَا التَّطْهِيرَ بِالْحَدِّ، وَقَدْ كَانَ يَكْفِيهِمَا مُجَرَّدُ النَّدَمِ، غَيْرَ أَنَّهُمَا غَضِبَا لِلَّهِ تَعَالَى عَلَى أَنْفُسِهِمَا الْمُفَرِّطَةِ، فَأَسْلَمَاهَا إِلَى إِقَامَةِ الْحَدِّ. وَأَمَّا إِعَادَةُ عُمَرَ الضَّرْبَ فَإِنَّمَا ضَرَبَهُ تَأْدِيبًا لَا حَدًّا.
Translation
✧ ʿUmar b. al-Khaṭṭāb flogged his son ʿUbayd Allāh for drinking, he and a group with him. And in the year fourteen of the Emigration, ʿUmar flogged Abū Miḥjan al-Thaqafī seven times for wine, and flogged with him Rabīʿah b. Umayyah b. Khalaf for a drink they drank in that regard, and flogged his son ʿAbd al-Raḥmān for that. According to Sālim b. ʿAbd Allāh, that ʿAbd Allāh b. ʿUmar said: ʿAbd al-Raḥmān b. ʿUmar drank, and Abū Sirwaʿah ʿUqbah b. al-Ḥārith drank with him, while we were in Egypt during the caliphate of ʿUmar b. al-Khaṭṭāb, and they became intoxicated. When morning came, the two went to ʿAmr b. al-ʿĀṣ, who was governor of Egypt, and said: Purify us, for we have become intoxicated from a drink we drank. ʿAbd Allāh b. ʿUmar said: I was not aware that the two had gone to ʿAmr b. al-ʿĀṣ. He said: They mentioned my brother, that he had become intoxicated, so I said to him: Enter the house and I will purify you. He informed me that he had told the governor. ʿAbd Allāh b. ʿUmar said: I said: By God, he will not be shaved today before the people; enter and I will shave you—for at that time they used to shave along with the punishment. So he entered the house with me, and I shaved my brother with my own hand. Then ʿAmr b. al-ʿĀṣ flogged the two of them. ʿUmar b. al-Khaṭṭāb heard of that, and wrote to ʿAmr: Send ʿAbd al-Raḥmān b. ʿUmar to me on a camel saddle. ʿAmr did that. When ʿAbd al-Raḥmān came to ʿUmar, he flogged him and punished him because of his position with him, then sent him away. He remained for a month in good health, then his fate overtook him. Most people think that he died from ʿUmar's flogging, but he did not die from his flogging. Ibn al-Jawzī said: It should not be thought of ʿAbd al-Raḥmān that he drank wine; he only drank nabīdh, interpreting it, and thought that what he drank would not intoxicate, and likewise Abū Sirwaʿah. When the matter with the two of them resulted in intoxication, they sought purification by the prescribed punishment. Mere remorse would have sufficed for them, but they were angry for the sake of God Almighty at their own negligent selves, and handed them over to the establishment of the prescribed punishment. As for ʿUmar's repeating the flogging, he only flogged him as discipline, not as a prescribed punishment.
