"A man from the tribe of Aslam came to the Prophet ﷺ and confessed adultery. He turned away from him, the he confessed (again). Then he turned away from him (again) until he had testified against himself four times. So the Prophet ﷺ said: "Are you insane?" He said:"No" He said: "Are you married?" He said: "Yes". So he gave the order and he was stoned at the Musalla. He ran when he was stuck by the stones, and he was caught and stoned until he died. So the Messenger of Allah ﷺ spoke well of him but he did not perform the (funeral) Salat for him.

machine translationAbū ʿĪsā said: This ḥadīth is good and sound (ḥasan ṣaḥīḥ). Some of the people of knowledge act upon this ḥadīth: that the one who confesses to fornication, when he confesses against himself four times, the prescribed punishment (ḥadd) is carried out on him. This is the view of Aḥmad and Isḥāq. Some of the people of knowledge said: When he confesses against himself once, the prescribed punishment is carried out on him. This is the view of Mālik b. Anas and al-Shāfiʿī. The proof of those who hold this view is the ḥadīth of Abū Hurayrah and Zayd b. Khālid that two men brought a dispute to the Messenger of Allah ﷺ, and one of them said: O Messenger of Allah, my son fornicated with the wife of this man, (and he mentioned) the ḥadīth in full. The Prophet ﷺ said: "Go in the morning, O Unays, to the wife of this man, and if she confesses, stone her." He did not say: "if she confesses four times."

  • Ibn Ḥajar al-ʿAsqalānī

machine translationThe report that negates it is taken to mean that he did not pray over him when he was stoned, and the report that affirms it is taken to mean that he ﷺ did so on the second day.

  • al-Bukhari

machine translationYūnus and Ibn Jurayj did not say, from al-Zuhrī, "and he prayed over him." Abū ʿAbd Allāh was asked: Is it authentic that he prayed over him? He said: Maʿmar narrated it. It was said to him: Did anyone other than Maʿmar narrate it? He said: No.
