✧ The Imam's Residence in Addressing the People of the Book When They Resort to Him.

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ الْمُبَارَكِ قَالَ حَدَّثَنَا أَبُو مُعَاوِيَةَ قَالَ حَدَّثَنَا الْأَعْمَشُ عَنْ عَبْدِ اللهِ بْنِ مُرَّةَ عَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ

مَرَّ عَلَى النَّبِيِّ ﷺ يَهُودِيٌّ مُحَمَّمٌ مَجْلُودٌ فَقَالَ «هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟» قَالُوا نَعَمْ فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ قَالَ أَنْشُدُكَ بِاللهِ هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ قَالَ لَا وَلَوْلَا أَنَّكَ مَا سَأَلْتَنِي مَا صَدَقْتُكَ نَجِدُهُ الرَّجْمَ وَلَكِنْ كَثُرَ فِي أَشْرَافِنَا كُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ فَقُلْنَا تَعَالَوْا نَجْتَمِعُ عَلَى شَيْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ مِنَّا فَاجْتَمَعْنَا عَلَى التَّحْمِيمِ وَالْجَلْدِ مَكَانَ الرَّجْمِ فَأَنْزَلَ اللهُ تَعَالَى {يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ} [المائدة 41] إِلَى قَوْلِهِ {إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ} [المائدة 41] يَقُولُونَ ائْتُوا مُحَمَّدًا فَإِنْ أَفْتَاكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ} [المائدة 45] قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ} [المائدة 47] قَالَ هِيَ فِي الْكُفَّارِ كُلُّهَا قَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمَرَكَ إِذْ أَمَاتُوهُ» فَأَمَرَ بِهِ فَرُجِمَ

Translation

✧ A Jew who had been blackened and flogged passed by the Prophet ﷺ. He said, "Is this how you find the punishment for the adulterer in your Book?" They said, "Yes." He called a man from their scholars and said, "I adjure you by Allah, is this how you find the punishment for the adulterer in your Book?" He said, "No; and were it not that you asked me, I would not have told you the truth. We find it to be stoning, but it became frequent among our nobles. When we seized a noble, we let him go; and when we seized a weak person, we carried out the punishment on him. So we said, 'Come, let us agree on something we will enforce on both noble and lowly among us.' We agreed on blackening and flogging in place of stoning." Then Allah Most High revealed: {O Messenger, do not let those who hasten into disbelief grieve you} [al-Ma'idah 41] up to His saying {If you are given this, then take it} [al-Ma'idah 41]. They say, "Go to Muhammad; if he gives you a ruling of blackening and flogging, accept it; but if he gives you a ruling of stoning, beware." Up to His saying {And whoever does not judge by what Allah has revealed, then those are the disbelievers} [al-Ma'idah 44]. He said: This is about the Jews. Up to His saying {And whoever does not judge by what Allah has revealed, then those are the wrongdoers} [al-Ma'idah 45]. He said: This is about the Jews. Up to His saying {And whoever does not judge by what Allah has revealed, then those are the defiantly disobedient} [al-Ma'idah 47]. He said: These are all about the disbelievers. The Messenger of Allah ﷺ said, "O Allah, I am the first to revive Your command when they had killed it." Then he ordered that he be stoned.
